Full textThe study focuses on the authority of the protective order in the Italian legal system. This concept was firstly introduced for procedures concerning corporate disputes – by Article 23, paragraph 6, legislative decree n. 5/2003 – and, eventually, generalized, in 2005, by Article 669-octies, 9th paragraph, of Italian code of civil procedure. However, the legislator didn’t provide a definition of this concept, evoking the debate over Article 337, 2nd paragraph, of Italian code of civil procedure. The first chapter of the present work, therefore, focuses on the notion of "authority" in relation to other judicial measures in the Italian legal system. In particular, the debate over the notion of "authority of the sentence" about Article 337, 2nd paragraph, of Italian code of civil procedure has been examined. On the outcome of this study, it has been investigated the meaning of "authority" with specific reference to the protective order, examining both the meaning of the expression "auctoritas" in Roman law and the meaning of "autorité de la chose jugée”, with specific reference to the ordinances of référé, in the French legal system. In this way, it has been shown that a single definition of "authority" can’t be given: it is, rather, necessary to evaluate, on a case by case basis, the meaning to attribute to this expression. In the second part, it has been examined how the notion of "authority" of a protective order – and the prohibition, contained in Article 669-octies, 9th paragraph, of Italian code of civil procedure, to evoke it in a different judgment – can affect both the civil and procedural law. In particular, in the second chapter, it has been examined the relationships between protective orders and some institutions of civil law, such as prescription, adverse possession and repetition of undue, were examined. In the third chapter it has been studied the limit within which the protective order can be evoked in a judgment on the matter. In conclusion, in the fourth chapter, it has been examined the boundary of the authority of the protective order in an executive judgment and in a different protective judgment. By examining these interferences, what emerges is that the notion of authority can change, sometimes significantly, in relation to the institutions of procedural or civil law. Therefore, despite the content of Article 669-octies, 9th paragraph, of Italian code of civil procedure, it is possible to conclude that sometimes the authority of the protective order can be evoked in a different judgment.

Full textModellers’ choice on closure rules affects a CGE model results and consequently its policy prescriptions. In this thesis, the aim is to detect and assess this issue, both through a theoretical discussion and an empirical application. Starting from Amartya Sen’s 1963 paper, literature presents many contributions on this topic. Currently, the closure rule problem is not central in the CGE debate. After a brief introduction on CGEs, their development and their structure, a series of simple maquette is presented. They have the exemplary role of introducing the concept of closures, explain how they affect final outcomes and how this modeller’s choice is strictly connected to the macroeconomic foundation of the economic system. After theory, we move into the real World analyzing through different models (Neoclassical, “Bastard Keynesian”, and Structuralist/ Post- Keynesian), and through different closure rules for macro- aggregates (private, public and foreign savings) the impact of the Regional Trade Agreement of SADC with respect to the Mozambican economy. The Mozambican CGE models are calibrated on a 2003 Social Accounting Matrix (SAM) and they are performed using GAMS/ MPSGE. Outcomes show that closure rules affect them and each model presents a set of policy prescription to implement the SADC agreement.

Full textSounds and scene have always been connected to each other. Throughout history, several ways of connecting them were developed. Regarding the understanding of the principles which motivated the development of this relationship between sound and scenic compounds, this dissertation intends to research this relation to such a hybrid process of creation, lately amplified into several media. The goal is to understand the means of connecting sound to drama elements: the spoken or sung text, or even the soundtrack, the body (gesture, light, space and other methods of capture and register). With such a goal, the work presents a detailed history of ways to relate both languages to each other (text and sound) as well as other elements which can concur to the scene. The concept basis employed to such reading was taken from Gilles Deleuze and Paul Zumthor. From these authors some concepts are fundamental. From Deleuze, the concept of ritornello and becoming; from Zumthor, the orality studies and the relation between sung voice, spoken voice and body presence into the performatic happening. The dissertation is presented in two parts, each one with two chapters, in which the first part has a map of the relation between the two languages since its beginning to the most recent results brought by the media. The second part accounts for two study cases on the relation between sound creation and scenic creation in which it focuses, above all, in the process of creation by different media, which presents the body as the element to join both sound and visual layers. Along with the theoretical and analytical text, there are also two records in digital media of both works analyzed and enabled in complete format on the site: htpp://ricardonash.spaces.live.com
