Abstract:
Objective There is a gap in knowledge regarding serious disciplinary matters concerning health professionals under the Health Practitioner Regulation National Law Act 2009 (hereafter ‘National Law’). The present study applies a typology of misconduct to the first 7 years of available tribunal cases under the National Law brought against the five most populous regulated health professions with the overarching goal of mapping the relationship between type of misconduct and outcome. As subquestions, the study examined whether the ostensibly uniform law is producing consistency of outcomes, both between the professions and between jurisdictions. Methods All publicly available Australian tribunal-level decisions concerning complaints of serious misconduct and/or impairment brought against the five most populous regulated health professions (nurses and midwives, doctors, psychologists, pharmacists, and dentists) were gathered from 1 July 2010 to 30 June 2017. Decisions were coded for case and respondent attributes, the type/s of misconduct alleged, whether proved, and the relevant disciplinary outcome. Respondent attributes were: profession, sex, legal representation, and certain identified ‘risk’ factors from previous studies. The type of allegation was coded based on five main categories or heads of misconduct, with subtypes within each. Outcomes for proved conduct were coded and categorised for severity. Analyses of cases was conducted using SPSS, version 21 (IBM, New York, NY, USA). Data was subject to statistical analysis using Pearson’s Chi-squared test with an α value of 0.05. Results Major variations were identified in outcomes across the professions, with doctors being subject to less severe outcomes than other professions, in particular compared with nurses, even when the same main head of misconduct was in issue. Differences in legal representation did not completely account for such variation. Marked disparities were also identified between outcomes in different states and territories, suggesting that the National Law is not being applied in a uniform manner. Conclusion Tribunal cases reflected complaint data in that: (1) male practitioners were greatly over-represented as respondents; (2) outcomes were most severe for sexual misconduct and least severe for clinical care; and (3) doctors faced less severe outcomes than other professions. There were also significant variations in severity of outcome by jurisdiction. Variations were more pronounced when deregistration was the focus of analysis. What is known about this topic? Existing research on complaints data under the National Law in place since 2010 has suggested that doctors may be receiving less severe outcomes than other professions at board level. There is a gap in knowledge concerning serious disciplinary matters heard by tribunals. Unlike data on complaints against regulated health professionals collated by AHPRA, legal tribunals, which hear only the most serious matters, do not record data on cases in a consistent or centralised form. What does this paper add? This study is the first to compare tribunal outcomes for the five most populous professions by reference to the type of misconduct proved. The finding that different professions are receiving different outcomes for the same malfeasance is novel. Other novel findings include significant variations in severity of outcome by jurisdiction, more pronounced variations in outcomes by both profession and jurisdiction when deregistration was the focus of analysis and variations in outcome according to legal representation. What are the implications for practitioners? There are major implications for policy makers and decision makers in terms of whether the National Law is operating consistently, with important outcomes for practitioners in terms of equitable and fair treatment when facing disciplinary charges.

ObjectivesTo study the frequency of observed cases of disciplinary law complaints concerning transgressive behaviour in Dutch healthcare by analysing disciplinary cases handled in Dutch disciplinary law.DesignRetrospective review of complaints in the Dutch disciplinary law tribunals from the period 1 January 2015 to 1 January 2020.SettingDutch healthcare.MethodDescriptive retrospective study. All judgements at regional disciplinary tribunals in the first instance from the period 1 January 2015 to 1 January 2020 concerning transgressive behaviour were investigated. The following was studied: year of judgement, number and nature of complaints, type of complainants, profession of defendant.ResultsOver the study period, 139 complaints about transgressive behaviour were handled, 90 of which involved sexual behaviour. 66/139 complaints were submitted by patients themselves (47.5%). Most complaints were directed against physicians (44.6%; n=62), followed by nurses (30.2%; n=42), psychologists (11.5%; n=16) and physiotherapists (7.9%; n=11). 80.6% of the complaints were directed against a male healthcare professional (OR 4.25; 95% CI 1.7590 to 10.2685; p=0.0013). 104/139 of the complaints originated from an outpatient work setting and about half of the complaints originated from mental healthcare. Of the 90 disciplinary cases in which the complaint was related to sexually transgressive behaviour, 83.3% (n=75) were ruled to be substantiated (5 of which partially) with a measure imposed in all cases: 6 formal warnings (8%), 11 reprimands (14.7%), 10 denials (partial suspension) (13.3%), 26 temporary suspensions (34.7%) and 22 cancellations of the licence to practice (29.3%).ConclusionThis study describes jurisprudence of disciplinary cases about transgressive behaviour of healthcare professionals in the Netherlands. The results of this study can be used to monitor trends in observed cases of transgressive behaviour.

Since 2010, a national scheme regulates the registration, accreditation and discipline of health professionals in Australia (the ‘National Law’). This research examines disciplinary cases from tribunals nationwide to address the question: Has the national regulation of health professionals produced consistency in outcomes in serious cases of professional misconduct? En 2009 el Tratado de Lisboa ha previsto el establecimiento de una Fiscalía Europea que impulse las investigaciones judiciales relacionadas con los delitos europeos, en particular los que afectan a los intereses financieros de la Unión. En ambos casos las investigaciones pueden concluir con la imposición de medidas disciplinarias y penales. Moreover, the Lisbon Treaty has foreseen the setting up of the European Public Prosecutor’s Office whose mandate is to investigate, prosecute and bring to judgment the perpetrators ofoffences against the Union’s financial interests. These organisms allow performing administrative and criminal inquiries regarding European officials. Tribunals, both European and National, are committed to control the disciplinary actions (European Courts) and criminal lawsuits (National Courts) against European politicians and officials.

The High Court has long struggled with the constitutional status of military tribunals established to hear disciplinary charges against service personnel. The Court's judgments reveal three distinct theories on this issue. The first view holds that military tribunals exercise judicial power, but not ‘the judicial power of the Commonwealth’ within the meaning of s 71 of the Constitution. The second view holds that the power in question is not judicial power at all for constitutional purposes. The third view holds that the power is ‘the judicial power of the Commonwealth’, but can be exercised by courts martial under a limited exception to the rules set out in Chapter III of the Constitution. The first view dominated the High Court's reasoning until Lane v Morrison (2009) 239 CLR 230, where the judges endorsed the second view. This article contends that the first and second views pose insuperable difficulties when placed in their broader constitutional context. The authors therefore argue for the third interpretation. They further argue that the constitutional basis for the third view strongly implies that military tribunals may only exercise jurisdiction over offences by military personnel that relate to service discipline.

Abstract:
Purpose Traditional understandings of financial abuse are limited to particular situations and people who have close access to vulnerable adults. This paper aims to add to a debate that intends to push the boundaries of the understanding of financial abuse further. In particular, it seeks to add to the understanding of what financial abuse might look like and who the perpetrators of such abuse can be. In so doing, it seeks to offer greater protection to the vulnerable. Design/methodology/approach Focusing on exploring the minutes of Church of England disciplinary tribunals, held to provide accountability for clergy, this paper considers how the church seeks to represent and construct the victims of financial abuse. Findings The paper identifies that the victims of financial abuse are whitewashed out of the tribunal minutes and discovers that the disciplinary tribunal is solely concerned with the financial loss afforded by the church. This discovery offers a new context in which it is possible to explore the competing interest in, what has been regarded as, the “legitimate assets” of older parishioners. It provides an example of how organisations and individuals compete for them. Originality/value This paper adds to the debate about the everyday nature of financial abuse and when and where it might take place. It provides an opportunity to reconsider potential offenders and the means by which abuse might be reduced. In exploring how the financial abuse of potentially vulnerable people can be reframed so that it is hidden by process and procedure, this paper offers an insight into the means by which it is possible to promote transparency and greater accountability.

Abstract:
This article examines the model established by the New Zealand Rugby Football Union Inc (NZRFU) to deal with acts of violence on the rugby field. The interface between sport and the law becomes relevant when society perceives sportsfield violence as going beyond acceptable boundaries. Identifying where these boundaries lie is problematic given the traditional reluctance of both sports administrators and the courts to invoke criminal sanctions for violence in sport. Part II examines violence in rugby, the limits to the consent defence, New Zealand case law on rugby violence and the likelihood of increased court action. It looks at the debate surrounding the appropriateness of internal disciplinary tribunals for sportsfield violence, and explores the criteria sports organisations must meet to avoid criminal prosecution of their players or judicial review of their internal disciplinary decisions. Part III outlines the establishment of NZRFU procedures to deal with violence in rugby and how they operate at local, national and international levels. In Part IV, the main features of the NZRFU's judicial disciplinary procedures are reviewed. It concludes that the NZRFU has created an effective and fair set of disciplinary rules to deal with violence in rugby, which has been extended to international competitions. However, there are some problems in its application. It will be suggested that changes could be made to the NZRFU's internal disciplinary procedures to improve consistency and independence and ultimately demonstrate to the rugby community, the courts and the public that violence in rugby is decreasing.

Through the data gathered and the problems identified at disciplinary administrative procedures at Rondônia local Judiciary and having as basic assumption the necessity of increasing celerity and efficiency to them, the present research offers a proposal of textbook for it aiming to ordain and control the procedural activities. Additionaly, it has as scope conceptualising it colaborating with all those who works with disciplinary administrative procedures to rationalise the development of activities. The proposed textbook provides concepts, methods and tools to rise the quality of the activities. The submitting proposal is focused at Rondônia local Judiciary and is objective and instrumental, permitting to aggregate efficiency at the disciplinary administrative procedures adding planning and administration techiniques to the juridical and law procedure knowledge.
A partir da análise do levantamento de dados e dos problemas verificados em processos administrativos disciplinares no âmbito do Tribunal de Justiça do Estado de Rondônia, tendo como pressuposto básico a necessidade de se impor celeridade e eficiência em sua tramitação, esta dissertação apresenta uma proposta de manual de processos administrativos disciplinares que viabilize a ordenação e controle das atividades procedimentais e que possibilite qualificar conceitos, colaborando com todos aqueles que atuam no campo disciplinar, aperfeiçoamento e racionalizando as atividades desenvolvidas. O modelo de manual proposto proporciona um conjunto de conceitos, métodos e ferramentas que objetivam melhorar a qualidade das atividades desempenhadas. A proposta trazida nesta dissertação está focada para o âmbito do TJRO e é objetiva, prática e instrumental, permitindo que se agregue eficiência na condução dos processos administrativos disciplinares, agregando ainda planejamento e gestão, além de conhecimento jurídico e processual sobre o tema disciplinar.

This study was conducted in the context of the regulation of professional nursing and midwifery practice in the Australian health care system. In this environment, professional regulatory authorities established by State and Territory legislation in all jurisdictions, regulate and control the work of health professionals. In Queensland, registered nurses, enrolled nurses and midwives are regulated by the Queensland Nursing Council, the statutory body created by the Nursing Act 1992 (Qld). Part of the regulatory role of this and other authorities is to discipline professionals whose conduct or behaviour falls short of appropriate and acceptable standards of practice. All regulated health professionals, including nurses and midwives, are potentially subject to professional disciplinary action if a complaint is lodged in relation to their conduct. This being an important issue in the management and delivery of health care, and an increased trend among health care consumers, the dearth of existing research into the disciplinary process is a major concern. This exploratory study examined the disciplinary role of the Queensland Nursing Council in adhering to its legislative mandate to ensure safe and competent nursing practice. The study focused on the extent to which structural (legislation and policy), professional, and process factors impacted on the outcomes of disciplinary Tribunals and Committees in cases of incompetent or unsafe practice and sexual misconduct. The study was situated within the interpretive paradigm using a case study approach. Specifically, it investigated cases of sexual misconduct by nurses and unsafe or incompetent practice by midwives. The study was guided by Donabedian's conceptual framework of structure-process-outcome. This framework was seen to be most suited to the aims of the study and provided a template for in-depth analysis of the data emerging from the two cases. The findings of this study provided insight into the factors underpinning the decisions of the disciplinary bodies in making determinations and formulating outcomes. There was found to be a lack of consistency and predictability in both the legislative frameworks and the interpretation of terms and concepts used to identify conduct warranting a disciplinary response from regulatory authorities. Although the processes of disciplinary proceedings are prescribed by both legislation and policy, their practical application was characterised by considerable challenges, which resulted in varying outcomes. The thesis reports this information so that it can be used as an initial basis to build a body of knowledge from practical experience with disciplinary proceedings that will inform future processes. Subsequent case studies in other contexts and systems will increase the level of knowledge available to nurses, other health care providers, health care institutions and regulatory authorities. The initial base of evidence suggests implications for practice, education and further research which are outlined in the final chapter of the thesis.

El presente trabajo de investigación versa en exponer cuál ha sido el tratamiento, criterios y lineamientos que han llevado a cabo el Tribunal del Servicio Civil respecto a la aplicación del principio de irretroactividad principalmente en la manifestación de retroactividad benigna sobre la norma que regula la prescripción, concretamente en los casos de responsabilidad administrativa disciplinaria. Asimismo, se ha tomado como punto de partida la importancia que tiene la naturaleza jurídica de la prescripción, un tema que resulta controvertido para el sector de la doctrina, pues dada su naturaleza no posee la calidad de norma sancionadora y por tanto inaplicable el principio de retroactividad benigna. Sobre estas premisas es que el presente trabajo de académico tiene como objetivos el dar a conocer el tratamiento actual de la prescripción en relación a su naturaleza jurídica y aplicación en el tiempo en los criterios aplicados por el Tribunal de Servir. De igual manera, se pretenden analizar las posiciones doctrinarias acerca de las teorías sustantiva y procesal respecto al fundamento de la prescripción; y las consecuencias jurídicas de aplicar el principio de irretroactividad en la norma que establece los plazos de prescripción y en los administrados como principales destinatarios de la misma.

Este trabajo se propone como objetivo describir al Tribunal de Disciplina de la Asociación Nacional de Fútbol Profesional, tanto en su aspecto orgánico como en su funcionamiento, a la vez que proponer alternativas para lograr una armónica inclusión de él dentro de nuestro ordenamiento jurídico. Para lograr este objetivo, se pasa revista a la legislación que le es aplicable y a la legislación comparada, además de comentar algunas de sus sentencias más relevantes. Finalmente se concluye la necesidad de un reconocimiento estatal de la función jurisdiccional de este Tribunal, la delimitación de los casos en los que es posible acudir a la justicia ordinaria frente a sus resoluciones –siempre que por determinadas resoluciones de los Órganos Jurisdiccionales del fútbol o bien cualquier ente de la ANFP, se infrinjan derechos que la Constitución Política garantiza- y la necesidad de que este Tribunal cumpla con las normas básicas del Debido Proceso, además de constatar la forma en que las cumple.

Con el presente proyecto proponemos una alternativa de mejoramiento en el sistema de justicia en materia administrativa disciplinaria, teniendo en cuenta que, existe una brecha preocupante, que se materializada en la inacción de la última instancia administrativa disciplinaria, el Tribunal de Disciplina Policial con la tardía resolución de expedientes sometidos a su competencia, lo que conlleva a la declaratoria desmedida de caducidad y prescripción. Cuando este debería ser el más idóneo y eficaz por ser la máxima instancia como hemos referido. En el trascurso del estudio, hemos advertido que existe un evidente descontrol por parte del Tribunal de Disciplina Policial respecto a los plazos, así como de la eficiencia y eficacia en la resolución de los casos, muchas veces evidenciado por un aparente exceso y extralimitación de su autonomía tanto funcional como administrativa, que conlleva a que no se ejerza control ni cuestionamiento a la gestión, por ende a sus resultados, lo que menoscaba no sólo el esfuerzo de los entes inferiores, como la Inspectoría General y todos sus órganos, sino también, de todos los efectivos policiales, que perciben negativamente la justicia administrativa disciplinaria; además los resultados podrían ser perjudiciales para la propia ciudadanía ya que esta ineficacia, puede reflejarse, por una parte, al mantener dentro del seno institucional, a efectivos policiales trasgresores de nuestras normas, y por otra parte, afectando los derechos fundamentales de aquellos que esperan justicia, al no haberse determinado plenamente su responsabilidad. Frente a esto se propone un modelo innovador de control, mediante la ampliación de funciones de la Oficina General de Integridad Institucional, a efectos que ejerza control sobre la gestión administrativa del Tribunal de Disciplina Policial, específicamente, sobre el avance y resolución de los expedientes administrativos disciplinarios sometidos a competencia. Precisándose que ambos órganos dependen orgánicamente del Ministro del Interior, y que las funciones de control y supervisión sobre los diversos órganos que conforman ese sector, está ya precisada y normada legalmente a favor de la Oficina General de Integridad Institucional, no existiendo al respecto, disposiciones legales que colisionen o se trasgredan. Además, no se requiere la dación o emisión de normas complejas, siendo únicamente, la vía que consolide una Resolución Ministerial que amplíe las funciones que el caso amerita. Concluimos en que de ejecutarse nuestra propuesta, se reducirá considerablemente la carga procesal administrativa, y se resolverán el mayor número de expedientes dentro de los plazos de ley. Estas acciones de control mejorarán la gestión del Tribunal de Disciplina Policial, así como de su propio personal, a quienes se les comprometerá a ejercen su función a cabalidad, transparencia y sobre todo en el control de resultados, lo que tendrá un impacto positivo en el personal de la PNP y la sociedad en general.

Les problèmes dans la procédure disciplinaire sont nombreux. A titre d’exemple, les multiples obstacles s'opposant à la reconnaissance de l'existence de la notion de faute disciplinaire ; la consistance des textes, le secret de la décision disciplinaire, l’absence de la compréhension de la procédure disciplinaire par l’autorité territoriale, faisant ainsi l’objet d’irrégularité et illégalité dans l’action disciplinaire, enfin, les droits et les libertés de l’agent local sont souvent violés. Cette étude s'intéresse d'abord à l'ensemble des théories, qui domine dans le contentieux disciplinaire de la fonction publique territoriale en Thaïlande. Il conviendra ensuite de s’intéresser à la question du régime disciplinaire, ce qui permettra d'analyser la différence fondamentale entre régime thaï et régime français
Disciplinary action in civil service of local governments in Thailand is interesting because it has a bunch of problems to be resolved. In addition, there is administrative litigation, especially disciplinary procedure. For instance, the problems about disciplinary procedure are the obstacles in recognition of existence of the concept of disciplinary offence, the consistency (formation) of text, the secret of the disciplinary decision, the lack of understanding in disciplinary procedure of the territorial authority that causes the irregularity and illegality of disciplinary action, the right and freedom of local servant which are frequently violated. This study primarily focuses on all theories dominating the disciplinary litigation in the civil service of local governments in Thailand. Then, the study will answer the question regarding the issue of the disciplinary regimes, which will be able to analyze the fundamental difference between the Thai regimes and French regimes

A presente pesquisa analisa a prestação da tutela jurisdicional  ofertada, processada e julgada perante o Tribunal Regional Federal da 4a Região e os Tribunais Superiores,  relativa ao direito do idoso à saúde. A análise procura constatar se há uma matriz disciplinar que possa justificar a presença da fraternidade como motivação para a decisões a serem proferidas. A tarefa proposta segue disposta de forma a apresentar o Poder Judiciário em sua precípua missão de proteger os direitos fundamentais, com destaque à saúde idoso. Desse modo, o objetivo traçado pretende analisar a dinâmica de defesa dos direitos do idoso à saúde, segundo um posicionamento interdisciplinar baseado na fraternidade, presente nas decisões dos tribunais brasileiros, a qual confere base à ?Matriz interpretativa da tutela jurisdicional da saúde do idoso perante os Tribunais?. A pesquisa destaca o fato de que o Poder Judiciário detém uma atuação importante quando se trata de políticas públicas de saúde, especialmente das demandas pertinentes à saúde do idoso. Tais demandas têm sido tratadas com base em princípios e valores previstos na Constituição da República Federativa do Brasil de 1988, e não raro fundamentadas na fraternidade, de onde decorre, que o valor da fraternidade tem conferido teoria e prática ao tratamento da saúde do idoso, guardado expressão e força a esta questão, gerado eficácia e exequibilidade nas decisões, e, sobretudo, verificado se a fraternidade tem sido capaz de incutir o mais alto grau de dignidade em nossa comum humanidade, conforme alerta a lição koninckiana. A pesquisa recorre ao método de abordagem indutiva, por meio das seguintes técnicas de pesquisa: bibliográfica, documental, legal, e, especialmente, por meio da técnica jurisprudencial  utilização de livros e revistas especializados e é desenvolvida em três capítulos.

Abstract : The following research analyzes the provision of jurisdictional tutelage  offered, processed and brought before the Tribunal Regional Federal da 4a Região and the Superior Courts, - on the right of the elderly to health care. The analysis seeks to establish whether there is a disciplinary matrix that may justify the presence of the fraternity as motivation for decisions to be handed down. The task proposed is arranged to present the Judiciary in its primary mission of protection to fundamental rights, especially the elderly health care. Thus, the outlined objective plans to analyze the dynamics of defense of the elderly s rights to health, according to an interdisciplinary position based on fraternity, present in the decisions of the Brazilian Courts, which confers base on ?interpretative Matrix of judicial protection of the elderly s health care before the Courts. The research highlights the fact that the Judiciary holds a significant practice when it comes to Public Health Policies, especially the relevant demands on aging health. Such demands have been treated based on principles and values foreseen in the Constituição da República Federativa do Brasil de 1988, and they re often grounded in fraternity, where it stems without any doubt, that the value of fraternity has conferred theory and practice to the treatment of the elderly health, guarding expression and strength to this question, generating efficiency and feasibility in decisions, and above all, verifying whether the fraternity has been able to instill the highest degree of dignity in our common humanity, as the koninckiana lesson alerts. The research resorts to the inductive approach method, through the following research techniques: bibliography, documentary, legal, and especially, by jurisprudential technique  use of specialized books and magazines and is developed in three chapters.

Le présent travail intitulé « La procédure devant les tribunaux ecclésiastiques de l’Église de Grèce : une analyse nomocanonique de la loi étatique 5383/1932 », ambitionne d’être la première monographie consacrée à la Loi 5383/1932, loi concernant les tribunaux ecclésiastiques grecs, dite aussi, d’après la définition du Conseil d’État, loi du droit disciplinaire ecclésiastique. Elle concerne 82 métropoles et l’archevêché d’Athènes. La procédure disciplinaire est une procédure judiciaire ; elle consiste en un procès au cours duquel doivent être appliqués tous les principes d’un procès juste. Ces tribunaux aussi doivent offrir la garantie d’un jugement juste. Le critère consiste à savoir s’ils saisissent une différence selon les règles du droit, avec compétence pour cette différence dans le cadre d’une procédure préétablie. La Loi 5383/1932 est un texte juridique et, pour la traiter, nous avons appliqué les méthodes juridiques et canoniques, dites nomocanoniques, d’analyse et d’interprétation
The present work bears the title, «The Procedure before the Ecclesiastical (Church) Courts of the Church of Greece: A nomocanonical analysis of the state law 5383/1932» which aspires to constitute the first monograph devoted to Law 5383/1932, a law that concerns the Greek Ecclesiastical courts, or better yet, the law regarding ecclesiastical disciplinary law according to the case law of the Council of State. This law concerns 82 metropolises (cathedrals) and the archdiocese of Athens. The disciplinary procedure is a judicial procedure that entails a hearing during which all of the principles of a fair trial must be applied. These courts owe a duty to offer the guarantees of a fair trial. The criterion is to know whether they are vindicating a difference with the rules of law having jurisdiction over this difference in the context of an existing procedure. Law 5383/1932 is a legal text and, in order to analyze it, we have used the legal and Canon law methods otherwise known as legal rule analysis and interpretation

The rules of each regulator will invariably provide for the appointment of suitably qualified persons to act as legal assessors or legal advisers, to give advice to the regulator’s tribunals or committees on questions of law or other functions arising in connection with any matter under consideration by the tribunal or committee. The statute will specify the qualifications required to be a legal assessor. For example, the Veterinary Surgeons Act 1966, Schedule 2, paragraph 6(1) (for the purposes of advising the disciplinary committee on questions of law arising in disciplinary cases, there shall in all such cases be an assessor to the committee who shall be a person who has a ten-year legal qualification in England Wales, Scotland, or Northern Ireland) and the Opticians Act 1989, section 23D(1) (appointment of legal advisers who must have a legal qualification of at least five years). Legal assessors, when advising tribunals or committees, are required to do so in the presence of the parties or their representatives, or, when advice is given in private, to notify the parties or their representatives of the advice that they have given.

Proportionality is part of the legal framework of all regulators, particularly at the stages of interim orders and sanction. Proportionality is expressly referred to when considering sanction in the Chartered Institute of Management Accountants, Disciplinary Committee Rules 2015, rule 24(7) (in deciding what sanctions are to be imposed, the panel shall take into account the issue of proportionality). The fitness to practise rules of other bodies may state that the committee shall have regard to any sanctions guidance issued by the regulator: see, for example, General Pharmaceutical Council (Fitness to Practise and Disqualification etc) Rules 2010, rule 31(14), and Bar Standards Board, Disciplinary Tribunals Regulations 2017, rE204. The guidance itself will often say that the panel should make sure that any sanction it imposes is appropriate and proportionate, based on the individual facts of the case, and is in the public interest.

In October 2005 a new tribunal, the Mental Health Tribunal for Scotland (“MHTS”), was born. This Tribunal1 is like no other that has been introduced in Scotland. It is based on a multi-disciplinary approach to decision-making involving a combination of health professionals and lawyers. The MHTS arose from the Millan Report2 and represents a sea change in the way in which decisions are made in respect of the treatment of mentally disordered persons. The Tribunal has been in operation now for around 4 years. It is still, therefore, relatively young and its procedures will remain on a steep developmental incline for some time to come. However, given that hearings take place every day, up and down the country, it is fair to say that, for such a young tribunal, a considerable amount of development has already occurred.

The novel characteristics of distributed ledger technology (‘DLT’) and ‘smart legal contracts’ (‘SLCs’) make it essential for parties to think carefully about how disputes arising in this context will be resolved. Put simply, codification and self-execution of parties’ agreements will not do away with disputes, and conflict of law questions can be very complicated in the absence of express dispute resolution mechanics within the SLC itself or the governance framework of the relevant DLT ecosystem. Many users of DLT are keen to resolve disputes ‘on chain’, avoiding recourse to traditional courts or tribunals. This trend is diving a new wave of Online Dispute Resolution (‘ODR’) tools. However, notwithstanding the potential benefits of efficiently enforcing ODR decisions ‘on-chain’ as a matter of practice, it is crucial to consider how those decisions can be anchored (and enforced or protected) within a valid domestic or international legal framework. It is no good to have a self-executing ODR process ‘on-chain’ which can be wholly unwound if a dissatisfied party takes the matter to a domestic court. This chapter summarizes the basic concepts related to ODR, DLT, smart contracts, and SLCs, reviews the possibility of resolving DLT disputes through new and established ODR processes, and explores the promise and challenges of DLT-based ODR solutions currently available. It comments on the need for greater multi-disciplinary collaboration at the interface of law and technology to build legally robust ODR processes that are fit for the digital economy and will enable and promote more mainstream adoption of DLT.

Para tanto, há direitos fundamentais como a ampla defesa e o contraditório, como reza a Constituição Federal do Brasil de 1988 (CF/88), Art. 5, Inc. LV. Ao longo do processo judicial os vestígios são analisados para decisões judiciais contra maus tratos animais. As provas periciais são essenciais para o processo penal. A Lei de proteção animal garantida recorre a essa etapa. Provas são obrigatórias quando o delito deixa vestígios. A fase processual no qual o perito veterinário atua inicia-se no inquérito policial, logo após o conhecimento da prática da infração penal, isola-se o local até a chegada dos peritos criminais. Esse auxílio é indiscutível, a fim de obter sentenças justas. Esses procedimentos devem ser conduzidos por Médicos Veterinários, com notório saber científico no assunto, chamados peritos veterinários, seja criminal ou judicial, que auxiliam o poder judiciário e partes envolvidas. A valoração desses profissionais, assim como investimentos em institutos de medicina veterinária legal e a obrigatoriedade de inclusão da disciplina na formação veterinária são essenciais. Objetivo Pretende o trabalho discutir a importância do perito veterinário, criminal ou forense, para casos de maus tratos animais, no auxílio à justiça. Sua valoração, em que pese o papel do poder público judiciário, em fomentar institutos médico-legais e aumentar a demanda de contratação de mais profissionais na área. Da mesma, forma a necessidade da obrigatoriedade de implementar a disciplina de medicina veterinária legal na grade escolar de intuições superiores de ensino veterinário. Métodos O trabalho foi elaborado através leitura e pesquisa em livros didáticos, revistas veterinárias, doutrinas jurídicas brasileiras, código penal e código processo penal brasileiro. Além de revistas científicas veterinárias, legislação ambiental e de direito dos animais, relatos de casos, casos práticos, e processos judiciais por meio de buscas em websites e sites jurídicos. Resultados e conclusão O Juízo pode decidir sobre matéria de maus tratos animais mesmo contra laudos periciais emitidos por peritos veterinários, porém, verifica-se cada vez mais processos cimentados em laudos periciais veterinários. Necessária é a expansão de concursos, contratação de peritos veterinários, assim como fomento às instituições médicos veterinário legais e de ensino superior veterinário. O crescente aumento de cursos e especializações comprovam a necessidade desses profissionais que auxiliam os tribunais. O perito médico veterinário deve ser especializado na área forense. Peritos veterinários corroboram e auxiliam o judiciário a elucidar crimes de maus tratos. Destaca-se o trabalho do perito veterinário criminal e judicial na aplicabilidade de sansões, com base na legislação ambiental e proteção animal. Assim, a medicina veterinária legal e a perícia veterinária devem ser exaltadas. Devendo haver mais subsídios para institutos médicos legais e obrigatoriedade de incluir a disciplina nas faculdades de medicina veterinária.
