Full textThis work aims to describe the issue of industrial actions within both, the National and European frameworks. First, this paper analyses the evolution in the assessment of industrial conflicts in the Italian system and it describes some of the most significant types of industrial actions according to the case-law of the Italian Supreme Court. The analysis it not limited only to the right to strike. The aim is considering whether the traditional notion of “strike” as “a collective abstention from work organised by several employees” is still current and meaningful The second chapter of the work is dedicated to the reform proposals regarding the right to strike recently drawn in Italy. After a brief description of the Law no. 146/1990, amended by Law no. 83/2000 and Law no. 135/2012, I focus on the Intersectoral Agreement signed on the 28th June 2011. Furthermore, I analyse two Agreements, signed at Fiat’s Pomigliano and Mirafiori plants respectively in June and December 2010. In the light of the mentioned legal sources, I examine the issues related to the entitlement to exercise the right to strike, rule of peace obligation and recent promotion of conciliation and arbitration procedures as an alternative to conflictive industrial actions. The last part of this work focus on the European legal sources and the recent Viking and Laval cases. According to these judgments, which are going to strongly impact on the future of Trade Unions’ rights, at the European level the promotion of the economic freedoms seems to prevail on the protection of industrial actions. In conclusion, in these times of globalisation, both the National and European system, do not seem to give adequate attention to the issues related with the protection of industrial actions. On the contrary, they should be understood as a tool of emancipation and social progress.

Full textAfter the last political and legal developements which leads toward the uniformation it is clear that even the airport management and regulation market is a very important issue in the air transport sector. There is the need of a uniformation of the legal framework. The airport management and the handling services has to be considered part of the air law. In order to have “air transport” we need a bilateral agreement between two States, a air navigation permit and a slot of time for takking off and landing, which need to perform in a regulated environment, in order to be offered in safety conditions, as a conditio sine qua non of all’aviation activities. Despite of this, in legal doctrine there is a separation between air law and the regulation of aeroportual issues, even it is clear that the two sectors are very contiguous. This il legitimated by the opposite needs of the operators of the two sectors. In final consideration we analyze the legal developements in European transport law and the airport regulation as a relevant part of it. At the moment the main issue that we are going to stress is the legal future of airport regulation in European and national legislation in order to address problems like capacity constrains and inefficiency of he airport realty, analyzing the airport regulation,the handling regulation and other issues regarding airports in national legal systems. We performed our research regarding regulation of airports in a State member of European Union, Italy, and in a potential canditate State for the future adesion, Albania, which is dealing with the aquis communautaire.

Full textThe present work is devoted to VAT tax profiles of investment services provided by banks, investment firms and financial advisors to retail investors, according to both European and Italian legislation. Its main aim is to identify possible solutions to any issue that still remain unsolved with regard to the investment services’ correct VAT treatment. In doing so indications provided over time by the European Court of Justice (ECJ) have been taken into high consideration. In light of the great differences between the MiFID classification of investment services and the VAT classification of financial transactions, and given the lack of coordination between the relevant European regulations which do not even meet in the hermeneutic activity of the ECJ, with the present work we have tried to interpret the VAT Directive (for what concerns financial transactions) according to the MiFID legislation. Therefore the analysis of the VAT Directive and, more specifically, of the financial transactions’ VAT treatment, has been carried out by trying to understand to which (specific) investment services the expression “financial transactions” refers to. In doing so we have tried to identify a link between the VAT Directive and the MiFID Directive that neither the EU legislator nor the ECJ have identified. The analysis shows that the whole VAT system, with particular regard to financial transactions, has now consolidated on the interpretations of the European Court of Justice which have shown a high intrinsic resilience. Therefore, it is highly desirable to take legislative action at EU level in order to modify the VAT Directive and to provide clearer and more specific criteria for the application of its provisions with particular regard to those relating to financial transactions.

Full textThe exaltation of the dichotomous aspect of time, divided between work and leisure time, has led to obscure reproductive, domestic, educational and assistance work, but also to ignore the work of school and professional training; just as it has deprived of legal relevance the times forcibly linked to work, such as those of the journey from home to the workplace or the time dedicated to work, in addition to the scheduled time, in creative and responsible work. In this dynamic, paid time has represented a masculine time par excellence to which women have had to adapt if they wanted to take part in it on an equal footing. This approach, both in the organization of work and in the rules that regulate its functioning, is still strongly present in our system today. Starting from these considerations, the thesis aims instead to take an approach that puts the subject at the center, enhancing the concept of time of the person, in a perspective that is not linked only to productive needs, but that gives value to the human person and his relationships as such. Dwelling first on the search for a legal anchorage within the Constitution at the time of the person, the emphasis was subsequently placed on the most recent developments in Europe with respect to the chosen theme, in particular on the failure of attempts to rewrite the directive on working hours, on the additional role played by the Court of Justice in the reinterpretation of existing legislation and on the emphasis attributed by European governance to issues relating to family care and assistance. The topic was then framed with respect to the internal perspective of the national system. The reference legislation on working hours was analyzed to underline the approach mainly aimed at defending temporal flexibility in the interest of the employer, who has a strong power to decide and vary the location of the service. It was therefore reasoned on the need, also in the perspective of support and enhancement of the initiatives applicable collectively, of a legislative intervention, aimed at attributing subjective rights in favor of workers over the temporal organization, which prevail over the interest economic activity of the company, if they detect particular needs of the person linked to fundamental rights and values that find constitutional legal recognition. Finally, the main legal solutions pursued so far, and still widely practicable, for the creation of new balances between the efficient management of the organization of the company and greater self-control by the single worker and the single worker were described and analyzed in a problematic key.

Its vast territory, mostly flat and fertile, crossed by the magnificent river Dnepr favored its condition of cultural crossroad and clash field, at the same time. Today, a little more than 20 years after its birth, Ukraine is still building its national identity through a process of construction and of emancipation from being simply considered a regional variant of the Russian nation. The Country has always had deep internal historical and cultural differences, more than ethnic ones. However, the two souls of the country: the one that looks to Russia and the other that aspires to Europe now have broken their balance and have come to the clash, and its outcome remains uncertain.

Full textThe purpose of this doctoral dissertation is to investigate the topic of the verification of powers in the European Parliament. Chapter I examines the models of verification of credentials offered by the comparative landscape. To this end, five systems are considered: England, France, Germany, Spain and the United States. Except for the latter case, an attempt has been made to follow a chronological order, starting with the oldest system and arriving at the most recent one. In particular, two elements are considered in the analysis: the verification of powers carried out in the upper chamber – where present – and the overall degree of protection of the subjective legal positions of candidates and elected officials. The choice of these profiles is justified for two reasons. Starting with the first, the scrutiny of the credentials of those elected in the chambers representing territorial autonomies provides an interesting point of comparison with the European Parliament, whose members – as is well known – are elected in the individual member states according to an only partially uniform electoral system. On the other hand, the examination of the degree of protection of the fundamental rights of elected members is related with second part of Chapter I, devoted to the Italian legal system and, in more detail, to the relations between the parliamentary, administrative and civil jurisdictions. Particular attention had been paid to domestic constitutional jurisprudence, whose relevance on the topic of electoral litigation has increased considerably over the years, as evidenced, most recently, by Judgment No. 48/2021 of the Italian Constitutional Court. Chapter II aims to reconstruct the legal framework for the verification of credentials, analyzing the discipline dictated by the founding treaties and the 1976 Act. The second part of the Chapter concentrates on the analysis of individual national regulations, examining four aspects: the bodies responsible for the proclamation of election results and, if necessary, their communication to the European Parliament, with particular reference to the possible assessment at the national level of the existence of grounds for incandidability or incompatibility; the nature of those bodies – with particular reference to their politicalness – and, finally, the system of remedies that can be brought against the proclamation of elected officials and, more generally, for challenging flaws in the electoral process. In light of the results obtained, it will be possible to classify the different jurisdictions into the patterns of verification of powers outlined in the previous Chapter. The last part of Chapter II focuses on the EDU Court's jurisprudence on the protection of the right to vote, including the recent Mugemangango v. Belgium case and its impact on the parliamentary model of verification of powers. Chapter III examines in chronological order the most relevant cases of electoral litigation for the European Parliament, both from the point of view of parliamentary practice and jurisprudence. The examination addresses the cases of Le Pen v. European Parliament and Donnici v. Occhetto, and then deals with the recent events concerning the Catalan independence MEPs, from which Judgments Nos. C-502/19 and C-646/19 originated. The last event to which space is devoted in the discussion is the disqualification of British MEPs and its impact on election results in the Italian legal system. Chapter IV deals with the evolution of the electoral legislation of the European Parliament, with a view to the adoption of a uniform electoral procedure or, reasoning in the short term, of a transnational electoral constituency, observing this affair from the point of view of the protection of the subjective legal positions of candidates and elected members, with particular reference to the possible identification of the competent body in matters of electoral litigation.

Full textThe research focuses on the d.p.r. 7 August 2012, n. 137 concerning the disciplinary procedure for alleged violations committed by social workers. It provides a theoretical, empirical and reflective analysis of the system. Given the disciplinary powers held by the Professional Order on its members, the legislator has instructed it to regulate and administer the entire proceeding, from collecting complaints to possible sanctions. The attention is focused on the methods chosen by the Territorial Councils of Discipline (CTD) to implement the system at local level, and to the activity carried out between July 2014 and June 2017. Three main research focus have been identified, which empirically drive the study: (a) the procedural complexities of this device and its management; (b) the features of the disciplinary proceedings and of the actors involved; and (c) representations, attributions of meaning and impact of the system on the profession. I choose data collection and analysis techniques according to the target of each focal point. Firstly, I used documental analysis on the national regulation, describing the phases of the disciplinary procedure. The presence of ambiguous aspects has led to the need for territorial integrations, and to the consequent creation of local differences between the praxis adopted by the various CTDs. This result has been later confirmed by the in-depth examination of the websites of the Regional Councils of the Order, which provide different level of informativity and accessibility. To study the second focus, I collected all the disciplinary proceedings received by 12 CTDs in 3 years. I analysed a total of 769 cases with the aim of measuring the extent of the phenomenon. I sued quantitative techniques to identify recurrent elements and find out information on the person who made the complaint, the social worker complained and the bureaucratic proceeding managed by the CTDs. A high number of violations due to non-compliance with administrative and professional requirements emerges, as well as the highly critical situation of parents’ conflicts and the incidence of cases filed without any sanctions. Finally, the third topic is addressed through interviews with experts and privileged witnesses. Information collected regard how the disciplinary procedure is considered an important step, albeit problematic, in the process of professionalization of the Social Work, and which directions can be taken for its overall improvement. The novelty of the disciplinary procedure, its potential implications in terms of protection of the public and of the profession itself, as well as the absence of previous research on the subject are elements that considerably increase the relevance of this study, allow to deepen how the Order absolved the its disciplinary functions of protecting the public and the profession itself.

Full textL’aggravation de l’immigration irrégulière résulte de l’activité croissante des filières d’entrée illégale et cette activité est favorisée par les insuffisances législatives ou opérationnelles des États d’immigration et par tout ce qui permet aux clandestins d’entrer et de se maintenir sur le territoire en violation des lois. Dès le programme de Tampere, le Conseil européen se déclarait déterminé à combattre à sa source l’immigration clandestine et cette volonté politique se situe au cur de l’action de l’Union, notamment dans la perspective de l’adhésion des nouveaux États membres et de la levée des contrôles aux frontières intérieures avec ces États. La politique européenne de lutte contre l’immigration irrégulière comporte deux aspects quasiment indissociables : la prévention et la répression. Dans une logique de prévention, la méthode désormais employée pour combattre ce phénomène ne se préoccupe pas seulement des problèmes d’admission des personnes sur le territoire concerné, mais s’attaque également aux causes profondes de l’immigration irrégulière à partir de certains États tiers. Par conséquent, la prévention peut couvrir plusieurs catégories de mesures qui concernent l’amélioration des conditions de vie et de sécurité humaine, la communication ou l’information, les partenariats, le dialogue et la recherche en matière migratoire, la formation des autorités en gestion de la migration et le soutien en vue du retour. Ce travail vise d’abord à examiner l’évolution qui a abouti à une gestion intégrée et coordonnée des frontières extérieures et l’importance de la dimension extérieure de l’action de l’Union européenne en matière migratoire. Ensuite, nous aborderons la question de la répression de l’immigration irrégulière, en analysant notamment les mesures adoptées au niveau européen pour lutter contre les formes les plus classiques et directes d’aide à l’immigration irrégulière et, en général, contre toutes les formes d’encouragement à ce phénomène. Enfin, nous examinerons les politiques prévues par la France et l’Italie à l’égard des étrangers en position irrégulière, afin d’établir si elle sont conformes ou non aux standards européens. Sous l’effet de la construction européenne, les différents États ont en effet mené des politiques de flux migratoires tendant à se rapprocher, en particulier dans un sens restrictif. Même si l’ensemble des flux migratoires qui affectent l’Union européenne obéissent à des facteurs historique et politiques variables, les pays européens ont décidé de mettre fin à de nouveaux flux migratoires en provenance des États tiers et d’intégrer les populations étrangers durablement installées en leur sein. Les mesures adoptées par les différents Gouvernements montrent une tendance à la pénalisation de l’immigration clandestine, cohérente à l’approche sécuritaire décrit pour l’Europe. Ce processus de pénalisation s’est exprimé essentiellement à travers la multiplication de personnes nouvellement visées par ce mouvement répressif. Le champ personnel des dispositions légales en matière d’immigration s est en effet largement étendu dans tous les deux pays, passant d’une répression administrative, visant l’étranger, principal destinataire des règles d’entrée, de circulation et de séjour forgeant la base de toute politique d’immigration, à une répression pénale touchant dans un premier temps ce même destinataire, tout en s’étendant aux autres acteurs favorisant la violation des règles primaire de cette politique.
