L'articolo si propone di chiarire la natura sui generis del diritto di iniziativa legislativa dei cittadini europei introdotto dal Trattato di Lisbona, esaminando quindi il contenuto del regolamento di attuazione che disciplina la raccolta del milione di firme necessarie per chiedere alla Commissione europea l'elaborazione di una proposta di legge europea. L'articolo analizza in particolare le principali differenze tra il testo di regolamento proposto inizialmente dalla Commissione europea e quello ufficialmente adottato il 16 febbraio 2011. L'autore ritiene che il nuovo strumento potrebbe avere a livello europeo la stessa efficacia di analoghi strumenti esistenti a livello nazionale, tanto piů se, com'č probabile, la Commissione si conformerŕ alla pratica seguita finora nei riguardi delle richieste legislative ricevute dagli Stati membri, dalle altre istituzioni europee (Parlamento e Consiglio) e dai gruppi di pressione.

Il lavoro indaga sugli esiti dell'entrata in vigore del Trattato di Lisbona, quanto alla disciplina dell'agricoltura europea. L'esame di una serie di riforme, anteriori e successive al Trattato di Lisbona, induce a concludere che la ri-nazionalizzazione e ri-localizzazione di alcune scelte di governo dell'economia agricola si è accompagnata ad una rinnovata articolazione del rapporto fra economia e diritto nella politica agricola comune. Il diritto in senso proprio, il diritto regolatorio, in contrapposizione con il diritto incentivante, caratterizza in misura crescente la legislazione di fonte europea in materia agricola. Le riforme della Pac di fine ed inizio secolo si sono così tradotte nella posizione di codici europei dell'agricoltura, dal codice dei regimi di sostegno al reddito [con il reg. (CE) n. 1782/2003, e poi con il reg. (CE) n. 73/2009], al codice dello sviluppo rurale [con il reg. (CE) n. 1257/2009, e poi con il reg. (CE) n. 1698/2005], al codice del mercato e della commercializzazione dei prodotti agricoli [reg. (CE) n. 1234/2007, c.d. regolamento unico Ocm]. Queste discipline di fonte europea dialogano con le discipline di fonte nazionale e compongono, che non è unper i 27 Paesi che oggi compongono l'Unione Europea, ma piuttosto un, nel quale bisogni e soggetti, nazionali, regionali e locali, occupano un posto di rilievo accanto a quello proprio delle scelte disciplinari espresse centralmente.

La ley de presupuestos ha venido a poner prácticamente fin a una legislatura que ha estado marcada por la profunda crisis económica, que, aunque de alcance europeo, ha tenido un espacial impacto entre nosotros. Y, lógicamente, la tramitación de la ley de presupuestos se vio obviamente condicionada por el debate que había arraigado con fuerza en el escenario político desde la vertiginosa reforma del art. 135 CE llevada a cabo los meses de julio y agosto. Reforma constitucional que, según se ha sostenido repetidamente, tuvo como detonante inmediato la cumbre franco–alemana de 16 de agosto, de la que habría resultado la conminación a determinados Estados a acelerar la incorporación al máximo nivel normativo interno de los compromisos fiscales asumidos en el seno de la Unión Europea.

Resumen: Si el Derecho Tributario de la Unión Europea aspira a un mayor desarrollo y legitimidad, necesariamente debería partir de la articulación de unos principios de justicia tributaria en la disciplina de la Unión. En ausencia de una Constitución Europea, sólo cabe la deducción de tales principios de los derechos fundamentales que forman parte del Derecho de la Unión. Es más, ni el fracasado proyecto de Constitución Europea daba expresamente respuesta a esta necesidad. Posteriormente, en los cuerpos normativos resultantes del Tratado de Lisboa, ni el Tratado de la Unión Europea, ni el Tratado de Funcionamiento de ésta, dieron tampoco respuesta expresa a esta necesidad.Palabras clave: Unión Europea, Derecho Tributario, principios, lagunas.Abstract: If the Tax Law of the European Union aspires to further development and legitimacy, it should necessarily start from the articulation of principles of tax justice in the discipline of the Union. - As regards the subject of food product hygiene European Community legislation disciplines hygiene food requirements by means of three regulations passed in 2004, the first Regulation n.852/2004 regards general information, the second n. 853/2004 deals with food of an animal origin, the third n. 854/2004 concerns the organisation of official controls on products of animal origin destined for human consumption. Our attention is focused on the first regulation, due to the fact that, by its application to food products of a vegetable origin, it especially affects Egypt as regards fruit and vegetable exportation to Europe. Egypt is a country which is taken into consideration so as to face the matter of the commercialisation of farm produce towards Europe in view of the establishment of a free trade area within the Mediterranean. The field of application of regulation n. 852/2004 includes primary production as of its definition given in Art. 3 of Regulation n. 178/2002. In Enclosure I it is specified that within the primary production environment, primary products may be transported, stored and handled on the condition that these procedures do not alter their aspects. At this point, the assessment arises as regards the ascribability of certain operations to the three hypotheses and according to the abovementioned condition. Both during primary production phases and throughout subsequent activities, in order to apply community legislation, it is sufficient to carry out one of the phases of the foreseen activities in order to be considered pursuant to Art. 3, n. 2, Regulation n. 178/02. Within the food business the control functions are carried out by the food sector operator. Hygiene rules must be both respected and applied to the entire food chain but also in a different way as regards the primary activities with respects to those carried out subsequently. As regards Third-Party countries, it is accepted that products may be obtained by means of equivalent hygienic rules and however dispensations from community standards are not permitted. Abstract: One of the basic preliminary issues that would contribute to a better development of EU Tax Law should consist on a definition, within its own judicial discipline, of the material principles of Tax Justice. We cannot expect to make progress in the technical development of the community tax rules and in the enlargement of their scope of action, without having previously defined certain taxation parameters. These, in turn, could be seen as a reassurance by the taxpayers of the various Member States of the European Union regarding its tax rules. It should be able to define some principles that were somewhat similar to those included in the Constitutions or the Constitutional Law of the various member States.Keywords: law, European Union, states, tax justice, European taxpayers.Resumen: Una de las cuestiones preliminaries básicas que contribuirían a un mejor desarrollo del Derecho Tributario de la Unión Europea, sería la concreción de una definición, sin perjuicio de su propia disciplina jurisprudencial, de los principios materiales de justicia tributaria. No podemos pretender progresar en el desarrollo técnico de las normas tributarias comunitarias y en una ampliación del alcance de su actuación sin haber definido previamente ciertos parámetros tributarios. Il rapporto tra innovazione scientifica e innovazione giuridica trova nella disciplina europea sui novel food profili peculiari correlati all’accesso al mercato di alimenti innovativi, potenzialmente idonei a contribuire al raggiungimento degli obiettivi di sostenibilità e di sicurezza alimentare come individuati, nel contesto internazionale, dall’Agenda 2030 delle Nazioni Unite e successivamente declinati, nell’ambito dell’Unione europea, dall’European Green Deal e dalla Strategia Farm to Fork. Attraverso una ricostruzione dei cambiamenti che hanno interessato la regolazione europea in materia, il lavoro di ricerca illustra e discute le problematiche che l’applicazione del Reg. (UE) 2015/2283 sugli alimenti nuovi pone nella catena alimentare, con particolare attenzione al ruolo svolto dai principi di innovazione, precauzione e trasparenza nella procedura di autorizzazione pre-market dettata dal legislatore europeo. L’analisi giuridica esplora, in particolare, le garanzie di trasparenza previste nella procedura di risk assessment, come modificata dalla riforma introdotta dal Reg. (UE) 2019/1381, interrogandosi sulla idoneità della normativa a far fronte alle sfide che la produzione e la commercializzazione di alimenti nuovi pongono nel mercato agroalimentare europeo.
The relationship between scientific innovation and legal innovation finds in the European regulation on novel foods peculiar profiles related to the market access of innovative foods, potentially suitable to contribute to the achievement of sustainability and food security objectives as identified, in the international context, by the United Nations 2030 Agenda and subsequently declined, within the European Union, by the European Green Deal and the Farm to Fork Strategy. Through a reconstruction of the changes that have affected the European regulation on the subject, the research work illustrates and discusses the issues that the application of Reg. (EU) 2015/2283 on novel foods poses in the food chain, with particular attention to the role played by the principles of innovation, precaution and transparency in the pre-market authorisation procedure dictated by the European legislator. The legal analysis explores, in particular, the guarantees of transparency provided in the risk assessment procedure, as amended by the reform introduced by Reg. (EU) 2019/1381, questioning the suitability of the legislation to meet the challenges that the production and marketing of novel foods pose in the European agri-food market.

L’obiettivo del presente lavoro è di illustrare il fenomeno della pubblicità comparativa, confrontare la disciplina europea ed americana in materia ed analizzarne l’interferenza con le rispettive discipline del marchio. Nel primo capitolo è stata analizzata in generale la pubblicità comparativa. Nel secondo capitolo sono state analizzate nello specifico la disciplina statunitense e la disciplina europea in materia di pubblicità comparativa. In merito alla prima disciplina è stata analizzata la prima legge in materia, l'attuale quadro normativo, i vari organi di controllo, gli strumenti di tutela preposti ed i “case law”. Per quanto concerne il contesto europeo è stata illustrata l’evoluzione della disciplina europea in materia di pubblicità comparativa fino ad arrivare all'attuale quadro normativo. Infine, sono state evidenziate le differenze e le similarità fra le due discipline in analisi. Nel capitolo terzo è stata analizzata l’interferenza fra le due discipline in materia di pubblicità comparativa e le rispettive discipline del marchio. In seguito sono state evidenziate le differenze fra le disposizioni statunitensi e quelle europee in merito all’utilizzo del marchio all’interno di una pubblicità comparativa. Al quarto capitolo viene fornita una dimostrazione pratica di come pubblicità comparative lecite ai sensi delle due discipline in analisi creata per l’impresa Tecnozoo s. r. l.

In the first part of the research work, I have examined the international context where a slots allocation discipline were is developed, in particular I.C.A.O. organisation, I.A.T.A. organisation and United Staes order. In this section I have analysed the Deregulation in aviation transport in United States and the secondary market of slots. In the second part, I have worked on the European Union order, in particular the Liberalisation of aviation transport market and the Regulation 95/93 and 793/2004. In addition, I have examined the Guernsey case in the United Kingdom. The third part has been focused on competition law, in particular the abuse of dominant position and the Essential Facilities Doctrine, both in the United States and in European Union order. In addition, I have analysed the model of secondary market of slots allocation in European Union order. Finally the fourth part, deals with the external relations of European law in the aviation transport, in particular the Open Sky agreement with the United States. Furthermore, I have worked on the EU-Russia Agreement in aviation law and the recent developments of European Commission’s Investigations and the relations of EU with WTO about the regulation af air traffic services.

The present work relates to market abuse, particularly insider trading and market manipulation. The thesis, in particular, is divided into 5 chapters. In the first chapter we examine the abusive practices and related economic issues. The second chapter deals with the European profile of market abuse by the discussion of the Community acts that have influenced this matter. The chapter three number deals with the national legislation for the implementation of European regulations, and also focuses on the powers of CONSOB and the disclosure obligations of companies. Chapter four concerns in more detail the issues relating insider trading and market manipulation. The final chapter regards, finally, the proposed changes in the regulations analyzed and a proposal made by the author about ways to punish market abuse.

La presente ricerca si propone di esaminare l’evoluzione del principio di solidarietà interstatale nell’ambito della politica di asilo europea. L’attuazione di tale principio è stata invocata in occasione dei recenti flussi migratori, composti principalmente da persone bisognose di protezione internazionale, che hanno sovraccaricato la capacità di accoglienza di alcuni Paesi euro-mediterranei. Il SECA si è dimostrato fragile e inadeguato, principalmente a causa della mancanza di coordinamento interstatale e di sostegno ai Paesi di primo asilo in difficoltà. E’ emersa pertanto con chiarezza la necessità di tradurre in concreto il concetto di burden-sharing, favorendo una più equa ripartizione intra-europea degli oneri e delle responsabilità in materia di asilo. In primo luogo, la ricerca delinea il concetto di “burden-sharing”, inteso come declinazione del principio di solidarietà e finalizzato a realizzare un’equa distribuzione dei rischi e dei costi tra i membri di un gruppo per il raggiungimento di un obiettivo comune. In particolare, si approfondisce il dibattito sviluppatosi su tale principio in diverse aree del diritto internazionale e i meccanismi adottati per renderlo operativo. Quindi si analizza la natura e il contenuto del principio di solidarietà nell’ambito del diritto dell’Unione Europea, percorrendo le fasi principali dell’evoluzione della politica europea di asilo e esaminando il diritto primario e secondario dell’UE rilevante. Particolare attenzione è dedicata al sistema Dublino, la cui analisi è incentrata sul principio di mutua fiducia, in base al quale si presume che tutti gli Stati membri sono rispettosi del divieto di refoulement e quindi si considerano reciprocamente sicuri. Infine, si esamina la risposta dell’EU all’emergenza umanitaria provocata dalla guerra in Siria al fine di stabilire se l’attuale politica di asilo europea rappresenta una concreta espressione del principio di solidarietà o se, al contrario, l’Unione Europea abbia scelto di percorrere la strada opposta a quella tracciata da tale concetto.
The principle of solidarity among EU Member States and its expression through the fair sharing of responsibility represent one of the constitutive elements of the Common European Asylum System (CEAS) and, more generally, of the European Union idea. Nevertheless, this principle has not found an effective implementation in European policies yet. The aim of this research is to argue, firstly, that the application of the principle of burden-sharing is a condicio sine qua non for the effectiveness of the CEAS as well as a way to ensure the commitment to international human rights standard. Moreover, it seeks to demonstrate the inefficiency of the instruments adopted so far by the European Union to enhance intra-EU solidarity. The first part analyses the role of the principle of “burden-sharing” in international law and, in particular, its application in security law, environmental law and refugee law. The second chapter examines the legal nature and the content of the principle of solidarity in EU law, identifying its role in primary and secondary law and describing its evolution in the European asylum policy. The third chapter addresses the major dysfunctions of the Dublin System, which allocates to Member States the responsibility for asylum claims examination. In particular, it describes the consequences of this deficiency, such as the difficulties in assuring the respect of fundamental rights standards, and in complying with the duty to gather fingerprints by the Member States situated at the EU external border. Finally the research analyses the instruments adopted by the EU in order to manage the current “refugee crisis”, such as the EU-Turkey agreement, the emergency relocation mechanisms and the hotpost approach.
Le flux massif des réfugiés provenant de la Syrie a pris au dépourvu la capacité d'accueil de certains pays euro-méditerranéens, et mis en relief l'absence de solidarité et de partage équitable de responsabilités entre les États de l'Union européenne. En premier lieu, cette étude définit le concept de “burden-sharing” entendu comme une mesure concrète de solidarité à réaliser à travers la distribution des risques et des coûts parmi les membres d'un groupe pour la réalisation d'un objectif commun. Après avoir analysé l’évolution de ce principe dans le droit international, on évalue sa mise en oeuvre dans l’ordre juridique de l’Union européenne, notamment, dans le Système Européen Commun d'Asile (SECA) consacré par l’article 80 TFUE. La presente ricerca si propone di esaminare l’evoluzione del principio di solidarietà interstatale nell’ambito della politica di asilo europea. L’attuazione di tale principio è stata invocata in occasione dei recenti flussi migratori, composti principalmente da persone bisognose di protezione internazionale, che hanno sovraccaricato la capacità di accoglienza di alcuni Paesi euro-mediterranei. Il SECA si è dimostrato fragile e inadeguato, principalmente a causa della mancanza di coordinamento interstatale e di sostegno ai Paesi di primo asilo in difficoltà. E’ emersa pertanto con chiarezza la necessità di tradurre in concreto il concetto di burden-sharing, favorendo una più equa ripartizione intra-europea degli oneri e delle responsabilità in materia di asilo. In primo luogo, la ricerca delinea il concetto di “burden-sharing”, inteso come declinazione del principio di solidarietà e finalizzato a realizzare un’equa distribuzione dei rischi e dei costi tra i membri di un gruppo per il raggiungimento di un obiettivo comune. In particolare, si approfondisce il dibattito sviluppatosi su tale principio in diverse aree del diritto internazionale e i meccanismi adottati per renderlo operativo. Quindi si analizza la natura e il contenuto del principio di solidarietà nell’ambito del diritto dell’Unione Europea, percorrendo le fasi principali dell’evoluzione della politica europea di asilo e esaminando il diritto primario e secondario dell’UE rilevante. Particolare attenzione è dedicata al sistema Dublino, la cui analisi è incentrata sul principio di mutua fiducia, in base al quale si presume che tutti gli Stati membri sono rispettosi del divieto di refoulement e quindi si considerano reciprocamente sicuri. Infine, si esamina la risposta dell’EU all’emergenza umanitaria provocata dalla guerra in Siria al fine di stabilire se l’attuale politica di asilo europea rappresenta una concreta espressione del principio di solidarietà o se, al contrario, l’Unione Europea abbia scelto di percorrere la strada opposta a quella tracciata da tale concetto.
The principle of solidarity among EU Member States and its expression through the fair sharing of responsibility represent one of the constitutive elements of the Common European Asylum System (CEAS) and, more generally, of the European Union idea. Nevertheless, this principle has not found an effective implementation in European policies yet. The aim of this research is to argue, firstly, that the application of the principle of burden-sharing is a condicio sine qua non for the effectiveness of the CEAS as well as a way to ensure the commitment to international human rights standard. Moreover, it seeks to demonstrate the inefficiency of the instruments adopted so far by the European Union to enhance intra-EU solidarity. The first part analyses the role of the principle of “burden-sharing” in international law and, in particular, its application in security law, environmental law and refugee law. The second chapter examines the legal nature and the content of the principle of solidarity in EU law, identifying its role in primary and secondary law and describing its evolution in the European asylum policy. Anyone in Europe who considers that they have suffered an abuse of power on the part of a public body can apply to a judge for justice. But this role is not restricted to a single judge. Not only is there a plurality of judges corresponding to the plurality of States in which they exercise their functions, but also (in the majority of cases) within each State there is more than one type of judge appointed to impose respect of the law even on public bodies, just as the procedures and manner in which the judicial action may materialise are also different. The protection of the citizens is differentiated, and this can be explained by the varying requirements or the different motivations which cannot always justify the deriving complications. The book explores this phenomenon, considering some of the principal European State systems, as well as the system of the European Union itself.

AbstractPolitical science as an independent academic discipline emerged in Europe after the Second World War. Moreover, up until the 1990s, it was mainly a preserve of Western Europe. The discipline began to develop in Central and Eastern Europe only after the 1989/91 political upheavals. When political science was institutionalised as a discipline in Western Europe, it was helped by international organisations such as the International Political Science Association (IPSA) and the European Consortium for Political Research (ECPR). It would seem, however, that European cross-national organisations do not currently promote and facilitate European political science successfully, as only a few Central and Eastern European institutions participate fully in international cooperation. The current field of European political science is organisationally fragmented, which makes it difficult to enable new countries to adapt to existing institutional frameworks, and to create an institutionalised pan-European political science discipline. Resolving this problem is vital if European political science is to develop more fully.

AbstractThis chapter expands the police integrity approach by focusing on the link between the evaluations of disciplinary fairness and the code of silence. Based on the writings by Klockars and Kutnjak Ivković (The code of silence and the Croatian police. In Pagon M (ed) Policing in central and Eastern Europe: organizational, managerial, and human resource aspects. College of Police and Security Studies, Ljubljana, Slovenia, 329–347, 1998), this chapter presents three potential theoretical approaches hypothesizing the relationship between police officers’ willingness to report misconduct and disciplinary fairness. We rely on the data from one mid-sized police department in the United States to test the effects across 12 scenarios depicting police corruption, use of excessive force, interpersonal deviance, and organizational deviance. Our multivariate models show that perceptions of disciplinary fairness are independently related to the police officers’ willingness to adhere to the code of silence. Discipline that is viewed as too harsh does not entice police officers to report; rather, in such cases, police officers are more likely to say that they would not report than police officers who evaluated discipline as fair. The effects are not as clear for the cases in which police officers evaluated discipline as too lenient.

It addresses the specific research needs in order to move forward from the current situation, where evidence on shared physical custody produce results that are scattered across disciplines and hard to compare across contexts. It concludes by arguing that the complexity of shared physical custody implications in terms of health, educational, relational and living standards requires research from different disciplinary fields in order to agree on a comprehensive theoretical perspective, standardize definitions and collect longitudinal and comparable data on the custody arrangements and their normative environments.

A pesar de la extendida percepción sobre la necesidad de renovar las formas de facilitar la adquisición de contenidos, el papel del profesor en el proceso de enseñanza-aprendizaje y el desarrollo de competencias en la educación superior, existen todavía disciplinas que presentan dificultades de adaptación a los nuevos modelos de innovación docente. La titulación de Derecho, en algunos aspectos, es un claro ejemplo, pues todavía prevalecen las clases magistrales y la memorización. Por todo lo anterior, sobre todo cuando se trata de asignaturas de carácter introductorio, es de gran importancia garantizar una buena comprensión del lenguaje de especialidad (en nuestro caso el lenguaje jurídico) que acompañará al alumnado a lo largo de la titulación y durante toda su carrera profesional. Esta necesidad resulta, si cabe, aún más acuciante en lo que a asignaturas con docencia en inglés se refiere, pues a la dificultad intrínseca de la jerga jurídica, se añade la dificultad de la equivalencia entre sistemas de Derecho Común y Derecho Civil (en nuestro caso, el sistema sui generis de la Unión Europea y su terminología jurídico-administrativa propia). La presente comunicación se centra en el uso de crucigramas como metodología docente en el aula y como estrategia de aprendizaje en materia de inglés jurídico, a partir de una experiencia piloto en el primer curso del Grado en Derecho en el grupo de Alto Rendimiento Académico (ARA) con docencia en inglés. Así, se pretende señalar las ventajas probadas del crucigrama, acercando a los docentes de asignaturas introductorias de cualquier disciplina técnica (sobre todo las que se enseñan en inglés) a una herramienta de motivación y de generación de aprendizaje significativo.

El sector del patrimonio cultural se encuentra en una encrucijada. El uso creciente de la tecnología y los elementos digitales son soluciones que se aplican en el contexto cultural para dar respuesta a la creciente demanda de desarrollo de la audiencia. Sin embargo, su uso exige nuevos enfoques para relacionarnos con nuestro patrimonio cultural y artístico. La creación de narrativas digitales permite formas de participación, abre nuevos espacios para que en los contextos educativos se exploren nuevas formas de colaboración para comprender, preservar e interactuar con el patrimonio cultural. Las herramientas de aprendizaje digital abren nuevas puertas para acceder a contenidos culturales desde los hogares, las escuelas y las universidades, y permiten que las personas generen, reutilicen y añadan valor a los contenidos tangibles e intangibles del patrimonio cultural. Los contextos educativos constituyen espacios seguros e inclusivos para estudiantes con distintas habilidades. Sin embargo, la educación en patrimonio cultural en muchas ocasiones se percibe como una disciplina, unidireccional y académica, por lo que no es consecuente con los principios del Diseño Universal para el Aprendizaje (CAST 2018), que favorecen un enfoque centrado en el alumnado. La accesibilidad y la inclusión son conceptos cruciales para cumplir con la CDPD (2006), y los objetivos de desarrollo sostenible que forman parte de la Agenda 2030 para el Desarrollo Sostenible. Asimismo, se han convertido en prioridades de la Agenda Europea en el marco de la “Estrategia para los Derechos de las Personas con Discapacidad” (2021-2030). En el caso específico del patrimonio cultural, la “Estrategia Europea del Patrimonio para el siglo XXI” (2017), también identifica la accesibilidad como un reto social. Pero, ¿qué significa ser inclusivo y promover la accesibilidad en el patrimonio cultural? “Young ArcHers” es un proyecto Erasmus+ que propone un cambio de mentalidad en la educación que aboga por el uso del patrimonio cultural como una herramienta valiosa para que el profesorado de primaria cree nuevos contenidos digitales inclusivos y accesibles para promover el diálogo intercultural y la inclusión social.

Decoding the Disciplines is a methodology aimed to support teachers and students of University to tackle obstacles and difficulties in learning process. It is assumed that students come to classroom with different level of secondary school preparation and teachers are generally reinforcing the inequalities in principle deplored as form of injustice in our society. The question of giving tools that students need to succeed in our disciplines requires new strategies intend to make teaching effective in line with the development of the democratic vision of teaching. The methodology represents a dynamic sequence of steps based on the understanding of the content of discipline taught and learned. All disciplines are involved, humanities as well as sciences. Under the Erasmus Plus Programme some European Universities are collecting relevant evidences to understand what to teach about an academic discipline. Monitoring students' learning and motivation means to bring out the bottlenecks, which hinder the achievement of knowledge and slow down the learning process leading to failure. Presentation of initial results aims to share the benefits of this methodology able to guide students to master basic mental operations required in university courses. Decoding emerges as challenge and option for policy-makers of higher education.

O artigo parte de uma revisão teórico-conceitual dos elementos que compõem a interpretação contemporânea do urbanismo, de forma a introduzir a discussão seus aportes teóricos – forma urbana – e metodológicos – desenho urbano e projeto urbano. Tem como objetivo a elaboração de figuras conceituais que representem e expliquem a materialização das cidades latino-americanas, que, como apontou Waisman (2013), carecem de aportes teóricos próprios, recorrendo aos aportes do Hemisfério Norte, muitas vezes inadequados ao lidar com nossa peculiar realidade sociocultural e material, baseada na figura da Espontaneidade. Inicialmente, recorre-se às diferentes interpretações acerca da disciplina, através da revisão da Historia, Teoria e Critica. Posteriormente, apresentam-se figuras conceituais, propostas como elementos mediadores entre a teoria e a prática do urbanismo em sua origem – aqui europeia – e a realidade da materialização das cidades brasileiras. The paper revises the contemporary urbanism´s theory and concepts as means of introducing its theoretical and practical approaches – urban morphology and urban projects. The main goal is to construct new concepts which represent and explain the latin-american cities´s materialization, which as pointed by Waisman (2013), lack of theorization of their own, relying on Northern Theory, many times not appropriated to the peculiar urban conditions socio cultural and materiality faced by southern cities. First we discuss the different interpretation of the discipline by means of Historic, theoretical and critical revision. In the conclusion, some conceptual figures are proposed, as mediating elements between theory and practice of urbanism in its European origin and the reality of Latin American cities.

Esta investigación analiza algunas de las conceptualizaciones urbanas y las estrategias proyectuales desarrolladas por la ‘vanguardia’ disciplinar de la posguerra europea en el período ‘pop’ (1956-1967), relacionadas con el ‘movimiento’ en sus implicancias lúdicas. Se definen como los principales operadores disciplinares: el Independent Group, la Internacional Situacionista, Yona Friedman, Cedric Price y el grupo ARCHIGRAM. Se propone un enfoque original que analiza en sus obras el ‘moverse’, en tanto ‘jugar’ (play), como inspiración de una novedosa imaginería urbana y como auténtico generador de proyecto urbano al servicio del nuevo hombre libre (pop-homo ludens). El discurso se construye a modo de “collage”, abordando la producción de múltiples fuentes de época (eventos, proyectos y artículos), con una metodología sistémica y relacional. Esta (re)lectura de época profundiza en la historiografía del urbanismo, como aporte al entendimiento del desarrollo conceptual desde la superación del urbanismo funcionalista Moderno, hacia el abordaje urbano contemporáneo de una ciudad viva, compleja, “delirante, congestionada y caótica”. This research work analyzes some urban conceptualizations and design strategies developed by the disciplinary 'vanguard' movement of postwar Europe in the 'pop' era (1956-1967), from the standpoint of the playful implications of 'movement'. The major disciplinary operators at play are defined as: Team X, the Independent Group, the Situationist International, Yona Friedman, Cedric Price and the ARCHIGRAM group. This paper innovatively proposes to examine specific pieces of work under the light of the act of `moving´, understood as playing, as the inspiration for a new urban imagery and as an authentic generator of the city project serving the emergence of the new free man (pop-homo ludens). The script is constructed in the form of a collage, addressing the production of multiple sources taken from the pop era (events, projects and items), through a systemic and relational methodological lens. The proposed (re)reading of this historical period delves into the historiography of urbanism and contributes to the understanding of its conceptual development, from modern functionalist urbanism towards a contemporary urban approach that acknowledges the lively, complex, "delusional, congested and chaotic" city.

For some countries, the discussion about entrepreneurship, more related to education, seems to be a taboo topic, while for others is a trend which must be valorized. There are many European documents and strategies regarding the promotion of entrepreneurship in the higher education context, from Entrepreneurship in higher education, especially in Non-business studies”, to Lisbon Strategy 2010, Oslo Agenda for Entrepreneurship Education in Europe”, or a newest one Europa 2020 – A European Strategy for smart, sustainable and inclusive growth. Moreover, the economical and social changes we are facing right now couldn’t be anticipated by these documents, but in the same time each of them was developed based on the society’s needs from that time. But one thing is clear: education is one of the most important element which could drive to development, growth and stability. Even when we are talking about employability or nanotechnology, there is or was an educational process in the background which facilitated that. This article aims to present, at the beginning, the core competencies from an European, Australian and Canadian perspective, focused on entrepreneurship education. Both Meyer’s report from 1991 or the European Parliament Recommendation about Key Competencies for Lifelong Learning were focused on entrepreneurship as a competence which must be proved by everybody. The transformations which individuals are facing in the contemporary economy should be anticipated and offered innovative eSolutions in order to develop the necessary competences at work or in day by day life. Higher education institutions could act, in a first phase, as key promoters of this discipline among both business and non-business studies, which will conduct to a great development of mindsets. After a short analysis of how key competences are defined (transversal, core or generic), the author will focus on the actual stadium of teaching entrepreneurship education in Romania and finally he will present some concrete examples of how this topic could be teach using WEB 2.0 technologies: podcast, eMentoring, Moodle platforms or online forums. Also, educational policies and possible solutions are treated.

Reducing the impact on the environment and the associated commercial implications are two major challenges that the global commercial aviation industry is addressing with significant commitment today. In this respect, Clean Sky, which is a €1.6 billion Joint Technology Initiative part funded by the European Commission is the largest ever programme addressing the greening of air transportation in response to the Advisory Council for Aeronautics Research in Europe (ACARE) goals of reducing CO2 and perceived noise emissions by 50% and NOx by 80% by 2020 compared to 2000 condition. This paper presents research work carried out within the Systems for Green Operations Integrated Technology Demonstrator (ITD) of Clean Sky that is associated with GATAC, a trajectory and route planning tool to enable the multi-objective optimization of flight trajectories and missions. The design and operational methodology of the tool, the optimization algorithms and models are discussed and the results of a preliminary application for a long-range commercial flight are presented.

Currently, it is important in Ukraine to harmonize cloud technologies application with European and world scientific initiatives. Need to modernize preparation of future PhDs is caused by challenges of new information, globalized society and digital transformation of all spheres of life, including education and science. The research was aimed to determine features of cloud services application in preparation of future PhDs. Concepts of “cloud computing”, “cloud technologies”, “cloud learning technologies”, “cloud services”, “cloud oriented environment” were analyzed. Experience of cloud technologies and their services application in educational and scientific space in researches of foreign and Ukrainian students was considered. Ukrainian experience in preparation of future PhD of various specialties with cloud services application was analyzed. It was emphasized that approaches improving to preparation of future PhDs based on cloud services application would increase their level of digital competence. It is recommended to include a separate course or module of specific discipline on work with cloud technologies and services during preparation of future PhDs. It is important to improve disciplines and tools content to support education process. It can be learning of disciplines using cloud technologies or services by future PhD’s. Also, cloud services application to support scientific and scientific-organizational activities will increase level of organization and implementation of scientific research. It is important to create cloud-oriented environment for preparation of future PhDs in higher education and research institutions. Making cloud-oriented educational and scientific environment should be based on principles of open education. It is recommended to use cloud-based platforms and services (G Suite for Education; Microsoft Office 365; specialized SaaS (CoCalc or other)).

This report presents the results of the survey conducted among EASA members in 2018. The survey was a collaboration between EASA and the PrecAnthro Collective, whose members have worked together and mobilised since 2016 to raise awareness about the challenges of developing an academic career in anthropology. The themes explored in the survey reflect existing academic research on changes to the academic profession and the casualisation of labour in Europe and beyond. The survey enquired into the extent to which and how trends already documented in other disciplines, and in academia as a whole, affect anthropologists. These trends include a growing division between research and teaching, the deprofessionalisation of academic labour through multiple contract types, the imperatives of international mobility and cyclical fundraising, and weak labour unions. This report captures overall trends as well as regional differences in the anthropological profession in Europe.

Abstract:
Cruise AL534/2 is part of a multi-disciplinary research initiative as part of the JPI Oceans project HOTMIC and sought to investigate the origin, transport and fate of plastic debris from estuaries to the oceanic garbage patches. The main focus of the cruise was on the horizontal transfer of plastic debris from major European rivers into shelf regions and on the processes that mediate this transport. Stations were originally chosen to target the outflows of major European rivers along the western Europe coast between Malaga (Spain) and Kiel (Germany), although some modifications were made in response to inclement weather. In total, 16 stations were sampled along the cruise track. The sampling scheme was similar for most stations, and included: 1) a CTD cast to collect water column salinity and temperature profiles, and discrete samples between surface and seafloor, 2) sediment sampling with Van Veen grab and mini-multi corer (mini-MUC), 3) suspended particle and plankton sampling using a towed Bongo net and vertical WP3 net, and 4) surface neusten sampling using a catamaran trawl. At a subset of stations with deep water, suspended particles were collected using in situ pumps deployed on a cable. During transit between stations, surface water samples were collected from the ship’s underway seawater supply, and during calm weather, floating litter was counted by visual survey teams. The samples and data collected on cruise AL534/2 will be used to determine the: (1) abundance of plastic debris in surface waters, as well as the composition of polymer types, originating in major European estuaries and transported through coastal waters, (2) abundance and composition of microplastics (MP) in the water column at different depths from the sea surface to the seafloor including the sediment, (3) abundance and composition of plastic debris in pelagic and benthic organisms (invertebrates), (4) abundance and identity of biofoulers (bacteria, protozoans and metazoans) on the surface of plastic debris from different water depths, (5) identification of chemical compounds (“additives”) in the plastic debris and in water samples.

The prodPhD project aims to address the challenging problem of introducing entrepreneurship training in PhD programmes regardless of discipline. The prodPhD project will create the necessary teaching methodologies and the platform for applying them. The project consists of a consortium of four organizations from across Europe. The main objective of the prodPhD project is to implement innovative social network-based methodologies for teaching and learning entrepreneurship in PhD programmes. The multidisciplinary teaching and learning methodologies will enable entrepreneurship education to be introduced into any PhD programme, providing students with the knowledge, skills, and motivation to engage in entrepreneurial activities. The methodology will be conceived to develop experiential knowledge, involving academics, entrepreneurship experts, and mentors in its development and implementation. Why research Palaeolithic and Mesolithic Scotland? Palaeolithic and Mesolithic archaeology sheds light on the first colonisation and subsequent early inhabitation of Scotland. It is a growing and exciting field where increasing Scottish evidence has been given wider significance in the context of European prehistory. It extends over a long period, which saw great changes, including substantial environmental transformations, and the impact of, and societal response to, climate change. The period as a whole provides the foundation for the human occupation of Scotland and is crucial for understanding prehistoric society, both for Scotland and across North-West Europe. Within the Palaeolithic and Mesolithic periods there are considerable opportunities for pioneering research. Individual projects can still have a substantial impact and there remain opportunities for pioneering discoveries including cemeteries, domestic and other structures, stratified sites, and for exploring the huge evidential potential of water-logged and underwater sites. Palaeolithic and Mesolithic archaeology also stimulates and draws upon exciting multi-disciplinary collaborations. Panel Task and Remit The panel remit was to review critically the current state of knowledge and consider promising areas of future research into the earliest prehistory of Scotland. This was undertaken with a view to improved understanding of all aspects of the colonization and inhabitation of the country by peoples practising a wholly hunter-fisher-gatherer way of life prior to the advent of farming. In so doing, it was recognised as particularly important that both environmental data (including vegetation, fauna, sea level, and landscape work) and cultural change during this period be evaluated. The resultant report, outlines the different areas of research in which archaeologists interested in early prehistory work, and highlights the research topics to which they aspire. The report is structured by theme: history of investigation; reconstruction of the environment; the nature of the archaeological record; methodologies for recreating the past; and finally, the lifestyles of past people – the latter representing both a statement of current knowledge and the ultimate aim for archaeologists; the goal of all the former sections. The document is reinforced by material on-line which provides further detail and resources. The Palaeolithic and Mesolithic panel report of ScARF is intended as a resource to be utilised, built upon, and kept updated, hopefully by those it has helped inspire and inform as well as those who follow in their footsteps. Future Research The main recommendations of the panel report can be summarized under four key headings:  Visibility: Due to the considerable length of time over which sites were formed, and the predominant mobility of the population, early prehistoric remains are to be found right across the landscape, although they often survive as ephemeral traces and in low densities. Therefore, all archaeological work should take into account the expectation of Palaeolithic and Mesolithic ScARF Panel Report iv encountering early prehistoric remains. This applies equally to both commercial and research archaeology, and to amateur activity which often makes the initial discovery. This should not be seen as an obstacle, but as a benefit, and not finding such remains should be cause for question. There is no doubt that important evidence of these periods remains unrecognised in private, public, and commercial collections and there is a strong need for backlog evaluation, proper curation and analysis. The inadequate representation of Palaeolithic and Mesolithic information in existing national and local databases must be addressed.  Collaboration: Multi-disciplinary, collaborative, and cross- sector approaches must be encouraged – site prospection, prediction, recognition, and contextualisation are key areas to this end. Reconstructing past environments and their chronological frameworks, and exploring submerged and buried landscapes offer existing examples of fruitful, cross-disciplinary work. Palaeolithic and Mesolithic archaeology has an important place within Quaternary science and the potential for deeply buried remains means that geoarchaeology should have a prominent role.  Innovation: Research-led projects are currently making a substantial impact across all aspects of Palaeolithic and Mesolithic archaeology; a funding policy that acknowledges risk and promotes the innovation that these periods demand should be encouraged. The exploration of lesser known areas, work on different types of site, new approaches to artefacts, and the application of novel methodologies should all be promoted when engaging with the challenges of early prehistory.  Tackling the ‘big questions’: Archaeologists should engage with the big questions of earliest prehistory in Scotland, including the colonisation of new land, how lifestyles in past societies were organized, the effects of and the responses to environmental change, and the transitions to new modes of life. This should be done through a holistic view of the available data, encompassing all the complexities of interpretation and developing competing and testable models. Scottish data can be used to address many of the currently topical research topics in archaeology, and will provide a springboard to a better understanding of early prehistoric life in Scotland and beyond.

Abstract. The article reveals the experience of organizing blended learning for geography students using Google Classroom, and discloses its potential uses in the study of geography. For the last three years, the authors have tested such in-class and distance courses as “Cartography and Basics of Topography”, “Population Geography”, “Information Systems and Technologies in Tourism Industry”, “Regional Economic and Social World Geography (Europe and the CIS)”, “Regional Economic and Social World Geography (Africa, Latin America, Asia, Anglo-America, Australia and Oceania)”, “Socio-Economic Cartography”. The advantages of using the specified interactive tool during the study of geographical disciplines are highlighted out in the article. As it has been established, the organization of the learning process using Google Classroom ensures the unity of in-class and out-of-class learning; it is designed to realize effective interaction of the subjects learning in real time; to monitor the quality of training and control the students’ learning achievements in class as well as out of it, etc. The article outlines the disadvantages that should be taken into account when organizing blended learning using Google Classroom, including the occasional predominance of students’ external motivation in education and their low level of readiness for work in the classroom; insufficient level of material and technical support in some classrooms; need for out-of-class pedagogical support; lack of guidance on the content aspect of Google Classroom pages, etc. Through the test series conducted during 2016-2017, an increase in the number of geography students with a sufficient level of academic achievements and a decrease of those with a low level of it was revealed.

The main recommendations of the panel report can be summarised under five key headings:  HUMANITY The Panel recommends recognition that research in this field should be geared towards the development of critical understandings of self and society in the modern world. Archaeological research into the modern past should be ambitious in seeking to contribute to understanding of the major social, economic and environmental developments through which the modern world came into being. Modern-world archaeology can add significantly to knowledge of Scotland’s historical relationships with the rest of the British Isles, Europe and the wider world. Archaeology offers a new perspective on what it has meant to be a modern person and a member of modern society, inhabiting a modern world.  MATERIALITY The Panel recommends approaches to research which focus on the materiality of the recent past (i.e. the character of relationships between people and their material world). Archaeology’s contribution to understandings of the modern world lies in its ability to situate, humanise and contextualise broader historical developments. Archaeological research can provide new insights into the modern past by investigating historical trends not as abstract phenomena but as changes to real lives, affecting different localities in different ways. Archaeology can take a long-term perspective on major modern developments, researching their ‘prehistory’ (which often extends back into the Middle Ages) and their material legacy in the present. Archaeology can humanise and contextualise long-term processes and global connections by working outwards from individual life stories, developing biographies of individual artefacts and buildings and evidencing the reciprocity of people, things, places and landscapes. The modern person and modern social relationships were formed in and through material environments and, to understand modern humanity, it is crucial that we understand humanity’s material relationships in the modern world.  PERSPECTIVE The Panel recommends the development, realisation and promotion of work which takes a critical perspective on the present from a deeper understanding of the recent past. Research into the modern past provides a critical perspective on the present, uncovering the origins of our current ways of life and of relating to each other and to the world around us. It is important that this relevance is acknowledged, understood, developed and mobilised to connect past, present and future. The material approach of archaeology can enhance understanding, challenge assumptions and develop new and alternative histories. Modern Scotland: Archaeology, the Modern past and the Modern present vi Archaeology can evidence varied experience of social, environmental and economic change in the past. It can consider questions of local distinctiveness and global homogeneity in complex and nuanced ways. It can reveal the hidden histories of those whose ways of life diverged from the historical mainstream. Archaeology can challenge simplistic, essentialist understandings of the recent Scottish past, providing insights into the historical character and interaction of Scottish, British and other identities and ideologies.  COLLABORATION The Panel recommends the development of integrated and collaborative research practices. Perhaps above all other periods of the past, the modern past is a field of enquiry where there is great potential benefit in collaboration between different specialist sectors within archaeology, between different disciplines, between Scottish-based researchers and researchers elsewhere in the world and between professionals and the public. The Panel advocates the development of new ways of working involving integrated and collaborative investigation of the modern past. Extending beyond previous modes of inter-disciplinary practice, these new approaches should involve active engagement between different interests developing collaborative responses to common questions and problems.  REFLECTION The Panel recommends that a reflexive approach is taken to the archaeology of the modern past, requiring research into the nature of academic, professional and public engagements with the modern past and the development of new reflexive modes of practice. Archaeology investigates the past but it does so from its position in the present. Research should develop a greater understanding of modern-period archaeology as a scholarly pursuit and social practice in the present. Research should provide insights into the ways in which the modern past is presented and represented in particular contexts. Work is required to better evidence popular understandings of and engagements with the modern past and to understand the politics of the recent past, particularly its material aspect. Research should seek to advance knowledge and understanding of the moral and ethical viewpoints held by professionals and members of the public in relation to the archaeology of the recent past. There is a need to critically review public engagement practices in modern-world archaeology and develop new modes of public-professional collaboration and to generate practices through which archaeology can make positive interventions in the world. And there is a need to embed processes of ethical reflection and beneficial action into archaeological practice relating to the modern past.

The main recommendations of the panel report can be summarised under four key headings:  High quality, high impact research: the importance of archaeological science is reflected in work that explores issues connected to important contemporary topics, including: the demography of, the nature of movement of, and contact between peoples; societal resilience; living on the Atlantic edge of Europe; and coping with environmental and climatic change. A series of large-scale and integrated archaeological science projects are required to stimulate research into these important topics. To engage fully with Science in Scottish Archaeology iv these questions data of sufficient richness is required that is accessible, both within Scotland and internationally. The RCAHMS’ database Canmore provides a model for digital dissemination that should be built on.  Integration: Archaeological science should be involved early in the process of archaeological investigation and as a matter of routine. Resultant data needs to be securely stored, made accessible and the research results widely disseminated. Sources of advice and its communication must be developed and promoted to support work in the commercial, academic, research, governmental and 3rd sectors.  Knowledge exchange and transfer: knowledge, data and skills need to be routinely transferred and embedded across the archaeological sector. This will enable the archaeological science community to better work together, establishing routes of communication and improving infrastructure. Improvements should be made to communication between different groups including peers, press and the wider public. Mechanisms exist to enable the wider community to engage with, and to feed into, the development of the archaeological and scientific database and to engage with current debates. Projects involving the wider community in data generation should be encouraged and opportunities for public engagement should be pursued through, for example, National Science Week and Scottish Archaeology Month.  Networks and forums: A network of specialists should be promoted to aid collaboration, provide access to the best advice, and raise awareness of current work. This would be complemented by creating a series inter-disciplinary working groups, to discuss and articulate archaeological science issues. An online service to match people (i.e. specialist or student) to material (whether e.g. environmental sample, artefactual assemblage, or skeletal assemblage) is also recommended. An annual meeting should also be held at which researchers would be able to promote current and future work, and draw attention to materials available for analysis, and to specialists/students looking to work on particular assemblages or projects. Such meetings could be rolled into a suitable public outreach event.

Abstract:
The main recommendations of the panel report can be summarised under five key headings:  Building the Scottish Bronze Age: Narratives should be developed to account for the regional and chronological trends and diversity within Scotland at this time. A chronology Bronze Age Scotland: ScARF Panel Report iv based upon Scottish as well as external evidence, combining absolute dating (and the statistical modelling thereof) with re-examined typologies based on a variety of sources – material cultural, funerary, settlement, and environmental evidence – is required to construct a robust and up to date framework for advancing research.  Bronze Age people: How society was structured and demographic questions need to be imaginatively addressed including the degree of mobility (both short and long-distance communication), hierarchy, and the nature of the ‘family’ and the ‘individual’. A range of data and methodologies need to be employed in answering these questions, including harnessing experimental archaeology systematically to inform archaeologists of the practicalities of daily life, work and craft practices.  Environmental evidence and climate impact: The opportunity to study the effects of climatic and environmental change on past society is an important feature of this period, as both palaeoenvironmental and archaeological data can be of suitable chronological and spatial resolution to be compared. Palaeoenvironmental work should be more effectively integrated within Bronze Age research, and inter-disciplinary approaches promoted at all stages of research and project design. This should be a two-way process, with environmental science contributing to interpretation of prehistoric societies, and in turn, the value of archaeological data to broader palaeoenvironmental debates emphasised. Through effective collaboration questions such as the nature of settlement and land-use and how people coped with environmental and climate change can be addressed.  Artefacts in Context: The Scottish Chalcolithic and Bronze Age provide good evidence for resource exploitation and the use, manufacture and development of technology, with particularly rich evidence for manufacture. Research into these topics requires the application of innovative approaches in combination. This could include biographical approaches to artefacts or places, ethnographic perspectives, and scientific analysis of artefact composition. In order to achieve this there is a need for data collation, robust and sustainable databases and a review of the categories of data.  Wider Worlds: Research into the Scottish Bronze Age has a considerable amount to offer other European pasts, with a rich archaeological data set that includes intact settlement deposits, burials and metalwork of every stage of development that has been the subject of a long history of study. Research should operate over different scales of analysis, tracing connections and developments from the local and regional, to the international context. In this way, Scottish Bronze Age studies can contribute to broader questions relating both to the Bronze Age and to human society in general.
