Full textL’analisi dei principi e degli istituti connessi alla tutela del contribuente nelle odierne democrazie rappresentative è stata orientata al raggiungimento di vari obiettivi, tra loro logicamente connessi e fondati su di un’unica premessa: l’indiscutibile importanza e l’assoluta attualità, sotto il profilo costituzionale, del tema riguardante il nuovo ruolo che il contribuente dovrebbe assumere come esito dell’evoluzione dello Stato costituzionale contemporaneo, da suddito a cittadino, da partner a customer. La complessità degli eventi storico-economici che oggi incidono direttamente nel rapporto tra Stato e cittadino e le implicazioni istituzionali degli ormai così noti taxpayers’ rights impongono, infatti, ora più che mai, nuove riflessioni sul ruolo stesso del contribuente onesto e sulle sue preferenze, divenute, oramai, non più sacrificabili. La prospettiva costituzionale, attraverso il metodo comparatistico, ha portato, innanzitutto, ad analizzare due diverse legislazioni in materia di diritti del contribuente, quella statunitense e quella italiana. Ciò, sia per l’importanza che le Taxpayers’ Charters hanno acquisito a livello internazionale, sia per lo scopo collaterale di valutarne gli standards di best practice raggiunti attraverso gli specifici processi di modernizzazione messi in atto per aggiornare relazione tra fisco e contribuente. L’analisi comparata ha messo, poi, in evidenza le specifiche modalità attuative delle due diverse famiglie, di civil e di common law. (Parte Prima, Le Carte dei Diritti del contribuente: mera enumerazione dei taxpayers’ rights o strumenti di implementazione di service standards?). Di qui il tentativo, consapevolmente arduo, di trasporre la tematica della soddisfazione del contribuente e delle sue esigenze, in contesto altro rispetto a quello strettamente tributario o, più precipuamente, commerciale: quello del diritto costituzionale. O meglio, del diritto costituzionale comparato. L’analisi delle due esperienze normative è stata dunque orientata alla verifica della compatibilità di esse con l’idea di contribuente-cliente e, quindi, con la configurabilità di una particolare situazione giuridica soggettiva di libertà in capo ad esso. Sono risultate imprescindibili determinate condizioni. Da un lato, la rivisitazione del principio di responsabilità in capo a chi governa e opera nel settore, e l’obiettivo di creare un network di relazioni (Parte Seconda, Verso nuovi servizi e ‘politiche di qualità’ nell’ottica della ‘soddisfazione’ del taxpayer customer). Dall’altro, la valorizzazione di forme di coinvolgimento e interazione del contribuente attraverso un approccio ampiamente garantistico della “libertà di scelta” all’interno di un ordinamento responsabilmente organizzato (Parte Terza, Per un’idea di libertà nello ‘Stato fiscale’ : modelli di taxpayers’ choice per i nuovi orizzonti del respectful approach e della customer satisfaction). In questo contesto, è emersa la centralità della relazione tra Garante del contribuente e fisco sia per l’individuazione di un punto di equilibrio nella tutela dei taxpayers’ rights, sia per la realizzazione di modelli applicativi fondati sulla scelta del contribuente (TCM Model 2012-2013).

Full textThe study examines the relationship between two realities: one legal, marriage consent, and the other belonging to the context of the fact, pre and para suicidal conduct. The concrete need was to understand in a univocal way the interaction between the freedom of consent - as a fundamental dimension for this to have legal effects - and some behaviors put in place by one of the two engaged or by third parties, so as to evaluate how these can affect on the validity of the deed. Two heads of nullity have been considered - the Grave fear and the Lake of discretion of judgment - which doctrine and jurisprudence consider those that involve the willful faculty, deepening in the first part the relationship between conduct and external freedom while in the second on the internal freedom. The method was to analyze the jurisprudence as a source that allows both to interpret the law and to specify and embody the cases in point. The conclusion is that the pre- and para-suicidal behaviors cannot be inserted among the circumstances that make the nullity of the marriage manifest in relation to the freedom of consent, in fact it is not possible to support the presumptive value but it is necessary, every time, to compare them with the other facts. reported in the procedural tables.

Full textThis thesis aims to identify some issues related to the operation and restriction of the right to freedom of expression in the context of the global surveillance and control of the Information and Communication Technologies. These activities, undertaken by the States as well as by private operators, are fostered by the nebulous relationship between public, private and code norms, and are opposed by collective and individual recourse to the possibilities offered by the technologies themselves for the conduct of activities in anonymity and secrecy. The global surveillance in the context of privatization uses the code of private autonomy, as digital resistance uses computer skills and the degree of autonomy of action of the individuals. In this context, the guarantee of the existence and the exercise of fundamental human rights, including the right of everyone to freedom of expression and the right to protection of privacy, through the adoption of self-defence oriented techniques and practices, such as encryption and anonymous communications. The individuals, in this conflict, both technical and social, is having to defend the exercise of their rights and even the fulfilment of their duties, when related to specific professional or social, such as lawyers, justice operators, journalists, or simply parents. In conclusion, the elaborate propose some reflections on the formation, by the lawyers of new technologies, of the citizenship and the professionals to a conscious, aware and responsible use of new information technologies, so that they may even direct their activities to the protection and promotion of fundamental democratic, constitutional, civil and social human rights.

Full textThe first part of the research aims to put a solid study of the European Court of Human Rights on freedom of religion and belief. The work therefore begins by examining the institutional profiles in their historical origin and evolution, to get to make the point about the ECtHR of protection of fundamental rights. In the second chapter the research relates to the most important provision of the Convention that protect religious freedom and belief, namely the art. 9: the latter is examined in his structure and, secondly, in the application in abstracto given to it by the Strasbourg Court. In the third chapter is examined the jurisprudence of the ECtHR which has given application not only to art. 9, but also to other provisions that are of central importance for the protection of freedom of belief (art. 14 Conv and 2 Prot 1). The second part of the research completes the first part: it is the collection of all judgments of the European Court of Human Rights which have specifically considered the impact of Article 9 of the Rome Convention. The reproduction of the judgments is limited to parts of immediate interest for law and religion researchers.

Full textLa tesi ha come titolo ed oggetto d’indagine “l’amministrazione dei beni temporali come spazio di libertà per l’ordinamento canonico”. Il tema, che rappresenta una delle più tipiche res mixtae, è affrontato ponendosi nella prospettiva dell’ordinamento canonico e cercando di offrire un’originale ed esaustiva trattazione dei termini giuridici con cui la Chiesa cattolica rivendica per sé la libertà di amministrare i beni temporali. L’analisi è condotta a partire dal canone 1254 del vigente Codex iuris canonici che riconosce il principio dello ius pubbblicum ecclesiasticum per il quale la Chiesa ha il diritto nativo di acquistare, possedere, amministrare ed alienare i beni temporali per conseguire i fini che le sono propri. In particolare, la norma è considerata tanti sotto il profilo dell’evoluzione storica che ha condotto alla formulazione testuale vigente quanto nel suo significato dogmatico e nelle sue implicazioni nell’ordinamento canonico vigente. Definito attraverso lo studio di questa norma lo spazio di libertà patrimoniale che la Chiesa rivendica per se stessa, lo sviluppo della tesi riguarda le norme contenute nel titolo II del libro V del Codex iuris canonici, dedicato all’amministrazione dei beni temporali della Chiesa. Di esso vengono presi in considerazione dapprima i soggetti coinvolti a vario titolo nell’amministrazione dei beni ecclesiastici (il Romano Pontefice, l’Ordinario, l’Amministratore immediato, l’economo, gli organi consultivi con competenze economico-patrimoniali e le Conferenze episcopali) e successivamente, le differenti tipologie di atti di amministrazione (atti che intaccano il patrimonio stabile del soggetto giuridico proprietario, atti di ordinaria e di straordinaria amministrazione, atti maioris momenti). Concludono l’elaborato una riflessione sulla patologia dell’atto di amministrazione nell’ordinamento canonico, sia per quanto riguarda gli effetti della sua invalidità sia per quanto attiene la responsabilità che ne discende, e un esame delle connessioni ed i rapporti della disciplina del titolo II con l’ordinamento statuale italiano.

Full textThe dissertation addresses the issue of the massive dissemination of disinformation through the Internet from the perspective of constitutional law, investigating whether the scale of the phenomenon requires the elaboration of new principles and solutions or whether the constitutional paradigms enunciated by the constitutionalist tradition with reference to freedom of expression provide sufficient tools for effective intervention. The paper premises a reconstruction of the disinformation phenomenon in an attempt to identify the socio-cognitive and technological perimeter within which it proliferates, describing the elements that distinguish the information disseminated by the new media from that conveyed by mainstream media. That said, the study goes on to outline the "constitutional status" of falsehood, investigating the constitutional relevance of falsehood in its relationship with freedom of manifestation of thought in domestic, European and U.S. legal systems. The analysis then continues examining policies to counter disinformation introduced by individual states (mainly Germany, France, and Italy), the European Union, and platforms, with the aim of highlighting advantages and limitations of models of regulation, co-regulation, and self-regulation. Lastly, the paper breaks down some of the actions and measures reviewed and analyzes them through the magnifying glass of freedom of speech, sorting their contents according to their specific propensity to compress freedom of expression. The dissertation ends with some brief remarks highlighting the need, based on the constitutional principles analyzed, for any regulatory interventions to be eventually aimed at regulating platforms, i.e., "containers," leaving content to the free exchange of ideas.

Full textArticle 19 of Italian Constitution guarantees freedom of religion in its traditional aspects, i.e. freedom of confessing and disseminating one’s faith and of following the worship. However, before considering every single right recognized by article 19 of Italian Constitution, it’s necessary to ask oneself what is meant by “religion” and in particular whether atheism can be accounted in the religion nomen iuris or not and if, missing any other law that sanctions it, atheism happens to be automatically regulated by the law about the freedom of religion in a determined juridical system. Once asked if “morality”, only restriction expressly set by the Italian Constitution, refers exclusively to rites performing or applies both to faith profession and dissemination, it’s highlighted the different sphere of action compared to the analogous restriction belonging to article 21 of the Italian Constitution about the freedom of opinion. Another issue here debated is whether the freedom of religion has to be subjected to public order limitations. Eventually, it’s analysed the institution of conscientious objection with special regard to military service, abortion, wording of the oath in trials and animal testing.

Full textThis research aims to study the issue of preventing and resolving conflicts of jurisdiction between judicial authorities of EU Member States when faced with transnational crimes. In such cases, it is necessary to spell out criteria that can identify in advance the competent judicial authority. The current legislation (Framework Decision 2009/948/JHA) is not sufficient in many regards: in particular, the current system lacks precision and cogency in the determination of a State’s jurisdiction and puts no value in the individual’s defence rights when establishing the forum. Therefore, in this perspective, it is necessary to find a balance between the repressive instances and the protection of the fundamental rights. In other words, the prevention of "free zones" in the Area of freedom, security and justice – also keeping in mind individuals and criminals freedom of movement – cannot encroach upon the legal sphere of the European citizen. After the analysis of current principles and rules, this thesis aims to identify appropriate guidelines, in line with the guarantee content of the Charter of Fundamental Rights of the European Union and with the effective fulfilling of the mandate of Article 82(1)(b) TFEU: to prevent and resolve conflicts of jurisdiction.

Full textA common feature of all consolidation regimes provided by different jurisdictions is that they allow the offsetting of gains and losses of resident companies, while denying or making it particularly difficult to be granted the same right to compensation when losses are suffered by non-resident companies. Not being able to take into consideration such losses lead gross taxation of cross-border groups, through which it is not possible to tax the actual income of the companies belonging to that group. The immediate effect is to reduce incentives for groups to expand beyond national borders. This prevents the proper functioning of the single market, to the detriment of the freedom of establishment provided for in Articles 49-54 TFUE. Those provisions aim at giving foreign companies the benefit of the rules of the host Member State and at prohibiting the State of origin from hindering the establishment of its nationals or of the companies which have been set up under its laws in another Member State. Member States continue to justify the discrimination between residents and non-residents in light of their fiscal sovereignty in the field of direct taxation, basically by resorting to the balanced allocation of taxing rights. In the absence of any legal framework, it is up to the Court of Justice to interpret European law. With a series of important decisions, the Court has verified the compatibility of the different national regimes denying the cross-border carrying of losses with EU law. In its decisions, the Court has always looked for a (difficult) balance between freedom of establishment and a proper allocation of taxing rights.

Full textLast 25 years, technological developments have determined very important changes both on the material side and on the spiritual one of the people. The introduction of digital citizenship has obliged to rethink the bunch of rights and the way to apply them. The religious freedom, both individually and in association, has suffered the effects of these changes, but moreover has been a preferred sector where testing new governance rules needed to manage the innovations due to constantly increasing presence of information technologies in day by day life. Therefore, starting from a deep rethinking of the relationships between law and religion, some sectors of analysis, where testing new electronic governance rules, has been identified, in order to understand new evolutions of religious freedom rights in the digital society. These sectors are: presence of religious denominations in the national press; Internet world and issues related both to the trademark management and to religious sentiments; presence of religious denominations in radio-TV system; protection of religious sensitive personal data in agreement with the new privacy Code.

Full textThe exponential increase of medico-legal claims - originated in the USA in the sixties in such proportions as to talk of medical liability crisis, and developed in Italy since the mid-eighties - has led and continues to lead, together with other negative consequences, to the more frequent use of health care practices of defensive medicine, with very high costs to the NHS due to the overabundance of unnecessary treatments and hospitalizations, and worthless invasive diagnostic procedures, which generate emotional distress in patients. The cause of the increase in litigation is to be found largely in the doctor-patient relationship, especially with reference to the information that precedes the acquisition of the informed consent for clinical treatment. In Italy, the limits which mostly characterize the studies regarding informed consent derive mainly from the fact that they tend to focus solely on the written component of the same. The focus of informed consent, however, must be considered represented by a communication between healthcare and patient concerning a proposed treatment and its possible alternatives, to not subjecting the patient to any treatment, and the risks and benefits of each of these options. In such a context, the issue of communication between the physician and the patient is attracting interest because it is expected that it will lead to improvements in patient outcomes and to fewer malpractice claims. The increased attention to the doctor - patient relationship has highlighted the need to improve and enhance the communication skills of doctors, in a perspective in which the time dedicated to communication can be perceived by the professional as the core of the doctor-patient relationship, with a view to developing strategies to prevent the phenomena of defensive medicine.

Full textThe thesis investigates the Holy See's participation in the Conference for Security and Cooperation in Europe (now Organization for the Security and Cooperation in Europe), focusing on documents about religious freedom. After a brief description of the geo-politic scenery that brought to the Conference and the Holy See's position, the thesis analyzes the Helsinki Conference's works and thereafter the Follow-up Meetings of Belgrade, Madrid and Vienna. The thesis examines also the Conference's transformation and institutionalization and, then, the OSCE activity in the human dimension, focusing on procedures and mechanisms provided for the commitments' implementation. Finally, the thesis investigates the OSCE program for tolerance and non discrimination to religions' members.

Full textThe thesis analyses the impact of international labour standards about freedom of association on national legal systems and on the European level, to verify if they can reinforce the protection of collective social rights. The research starts from a survey of ILO sources on freedom of association, considered as a fundamental right to be promoted universally, and from the definition, provided by the supervisory bodies, conceiving strike as an “intrinsic corollary” of the right to organize. The thesis focuses on the use of international labour standards by judges in the context of the cooperation among judiciary authorities and quasi-judicial specialized bodies. In particular, the research considers some judgments of the European Court of Human Rights, as Demir and Enerji Yapi, where ILO instruments, together with the European Social Charter and the decisions of the European Committee of Social Rights, were used to extend the scope of art. 11 ECHR so as to cover the right to collective bargaining and collective action. In the light of the Lisbon Treaty modifications, the thesis considers, after the ECJ rulings in the Viking and Laval cases, if and how ILO standards and the recent ECHR case-law may have a positive impact on EU, stimulating a fairer balancing between economic freedoms and social rights.

Full textThe considerations of this doctoral dissertation originate from two legal cases (known as Viking and Laval) that submit to the Court of Luxembourg the conflict between economic freedoms and social rights and, therefore, between two opposite interests (companies and workers). For lack of specific rules, the European judge solves such cases in a way that seems balanced to all appearances, but that in effect recognizes the economic supremacy which is at the root of the foundation of the European community. These rulings represent the opportunity to begin to think about the relationship between social rights and economic freedoms in a particular dimension as the European one. After explaining the main differences between the European contest and the national ones, in particular the Italian situation, I analysed the settlement’s freedom and workers’rights: in both cases it is possible to specify a patrimonial and a non-patrimonial dimension. The critical moment occurs when the patrimonial spirits of these rights come into conflict. The survey on which my dissertation is based shows from the very beginning the diabolic face of settlement’s freedom on all cases when it is exerted in order to exploit the territorial differences between workers’ national tutelage. In this case the economic competition is fulfilled through the juridical competition and expresses its incapacity to act with ordinary instruments; the juridical competition in its turn expresses a different juridical level between the countries. Also, there is a question concerning the settlement’s freedom: when is it possible a legitimate exercise of it, and when is there an abuse? The awareness of the two inseparable components that coexist in every law – the patrimonial and the non-patrimonial one – points out the importance of a true connection between substantial and procedural rules: the rule that establishes the law to be applied in the case of settlement’s freedom ends up causing consequences on individual rights. After these considerations we come to the last question: which economy for which labour law or which labour law for which economy; but the answer is completely different from the options that have been proposed and represents the outcome of my research and the conclusion of my doctoral dissertation.

Full textThe subject of the present thesis is the principle of freedom of establishment under EU company law. This principle has involved relevant questions concerning its application within the internal market since the entering into force of the EC Treaty. Freedom of establishment has also generated a long debate over the last fifty years, in doctrine papers as well as in EU Court of Justice' judgements.The discussion on the principle of freedom of establishment is mainly related to the companies’ mobility in Europe. Secondly, the process between harmonization and liberalisation in EU company law has to be further devoloped, considering also the risks of “forum shopping” between EU member states. Referring to the mobility of companies in Europe, analysis has been enlarged with the discussion about european directives (i.e. Merger Directive 2005/56/CE) concerning the right to exercize mobility from one member state to another, european company statutes (i.e. SE), the proposal of “fourteenth directive” and European Private Company (SPE). The mobility of companies in EU implies international law matter referred to the important choice between “incorporation theory” or “real seat theory” as criteria in transferring company seat, and in cross-boarder mergers among industrial and commercial companies. Comparison between the above-mentioned subject of mobility in Europe with the freedom of establishment's principle, as defined in banking, insurance and financial law, is common so as to stress an in-depth difference in the legislative approach: registered office and administrative office must be positioned in the same member state, european authorisation admitted by the country of origin, establishing branches in other member states. The aforesaid conceptual framework allows to formulate some conclusions based on the right of free establishment next upgrade and fixing perspectives on balance between harmonisation and liberalisation in European company law.

Full textThe thesis treats of the defence of not-wealthy people, guaranteed as a constitutional right to receive aids. Approaching the study, it’s operated, previously a distinction between the particular typology of constitutional guarantees represented from the rights to receive aids and the indeterminate category of the so-called "social rights". The work proceeds analysing similarities and differences between rights to receive aids and rights of freedom, even in terms of their different legal effects, resulting from the belonging of the first category to the one of the so-called "programmatic rules". Here is also considered the instrumental relationship that binds rights of freedom and rights to receive aids and, finally, the different effects of the last category and the principle set out in art. 3, paragraph II of the Constitution. In order to identify not-wealthy people protected by art. 24, paragraph III, Constitution, it’s performed a comparison among the terms used by the Constituent Assembly to determine the subjective reference of the various rights to receive aids. In this direction, however, it proceeds, living out the cases whom doesn’t provide the Republic, as well as those where the condition of public intervention is not the inadequacy of economic resources. The instrumental relationship between rights to receive aids and freedom determines the need to study this second right as the object of the first one, especially in the conceptual perspective, to identify the differences between action and defence, their relationship and their constitutional guarantees. Finally, the study focuses on the legislative implementation of the third paragraph of art. 24, considering the historical perspective as well as the current discipline. At the time it’s been necessary to examine the problems concerning the conformity of the discipline of the subject to the constitutional guarantees. In particular it seemed appropriate to focus on the decision to refer to the familiar resources instead of the individual ones in regulating the legal aid.

Full textThe work aims to deepen the political thought of Alexis de Tocqueville, highlighting how, behind the aporias of his reflection on democratic societies, there is actually a very strong criticism of Modernity understood as a phenomenon not only political, but more generally anthropological. Moving away from the readings that see Tocqueville as a supporter of liberalism, I propose to highlight his criticism of bourgeois society, whose contradictions would be destined to remain unsolved and to imprison the modern citizen in new and more formidable forms of slavery.

Full textThe associations, which have a religious and worship purpose, are growing, hand in hand with immigration and with the integration willingness. As regards the religious ferment of the associations, the legislature has remained inert so that there is no single text or legislation on non-Catholic cults and the legislation of the years 1929-1930 is still used. My thesis intends to explore the theme of religious associations, particularly of the Muslim ones, both to account for the existing law and to understand which prospects it is possible to outline. The first chapter contains some introductory remarks which illustrate the interpretive guidelines and the starting point of the work. In the second one the constitutional reference framework is given. In the third chapter I discuss the different forms of religious associations in the special law and in the civil law; then, I attempt a definition of confession and association as well as of confessional and contractual autonomy. The fourth one takes into account the instruments of civil law used by Muslim associations to escape the "trap" of the law on allowed cults, analyzing some statutes of Muslim associations and indicating the common mistakes to avoid, and then trying to propose one from which it is inferred with transparency the purpose of religion and worship. The final part of the chapter contains a reflection on the legal structure of a possible federation of Muslim associations. In the fifth chapter, finally, space is given to recent openings, that is to the experience of the Municipality of Milan, that established in July 2012 the Register of Associations and Religious Organizations, to signify the importance of the religious associative phenomenon in the local territorial area. In conclusion, I suggest an answer to the question of whether the Muslim association is challenge for the right of religious freedom.
