Full textThis thesis examines different kinds of agreements, which regulate employees’ working conditions within the same workplace. This happens whether between trade unions and employers or between these latter and other workers’ representatives, leading to different legal consequences as far as the relationship between those agreements and each contract of employment is concerned. In the first place, the analysis describes the historical and theoretical transformation that finally brought legal systems to recognize plant level agreements in France, Germany and Italy. Afterwards, it focuses on rather recent transformations that finally lead to strengthen plant level agreements ability to regulate workers’ conditions, even in case of lack of their consent, especially to face enterprises’ economics needs and difficulties.

Full textMy research starts with the issue of locating dolus within the structure of crime. The work also approaches the question of dolus in reference to the non imputable subjects, which represents a vexata quaestio in the frame of the need of administering a sanction to the non imputable subject who committed a crime. Each chapter of the present work is structured in order to make a parallel between the italian and french legal systems. The work then approaches the issue of the structure of dolus, namely the analysis of the representation and of the will, discussing the main doctrinal and jurisprudential positions. The main focus is on the various forms of dolus, in particular on the tripartition, between dolus directus, dolus indirectus, and dolus eventualis, which is peculiar to the italian legal system. The above said tripartition is linked with the issue of the fine between dolus eventualis and gross negligence (colpa cosciente), in reference to which, the attention shifts on to the search for distinctive criteria in the elaboration of a new form of mens rea. In order to clarify this issue, the close examination of the "mise en danger délibérée, ancient art. 121-3 N. C. P. ", introduced with the goal of adjusting the french penal system to the need for protection coming from the general public, plays an important role. The same reasons are encouraging the jurists to find solutions differing from those offered by the italian penal code, and in particular, to evaluate the opportunity of adding a subjective provision, to be collocated in an intermediate position between intentional responsibility and negligent responsibility

Full textThe object of the research is religious discrimination, from a juridical point of view. The first chapter gives an overview of the different interpretations of the concept of equality and non-discrimination in international and European law. In the second chapter the research focuses on the EC directives n. 2000/43 and 2000/78 on racial discrimination and discrimination in the field of employment, which are relevant instruments for promoting integration and equality among the different ethnic and religious groups living in Europe. The other two chapters examine the implementation of the directives in Italy, France and United Kingdom. In these countries there are different approaches to combating discrimination and to dealing with religious diversity and religious needs. For all of them, however, the implementation of antidiscrimination law implies to tackle the problem of finding a balance between the principle of equality and the protection of religious diversity.

Firstly, the thesis investigates juridical structures which allow the modification of an administrative act, to understand if it can be compatible with the rule of law. Full textMeat production is regulated by both Jewish and Islamic Laws through sets of rules that, aside from their respective specificities, share the aim of teaching reverence for life to the believers. Generally speaking, in pluralist democracies the production of kosher (“fit/proper”, according to Jewish Law) and halal (“permissible”, under Islamic Law) meat is protected under the right to freedom of religion. However, the State retains the authority to regulate the use of religious slaughter and that of kosher and halal claims in the meat market, on the basis and within the limits of its mandate to protect and promote public health, humane treatment of animals, fair market competition and consumer rights. Fulfilling such responsibility without overstepping the bounds of State-religion mutual autonomy is a complex task, especially when it comes to determining the roles of public authorities, religious bodies and the private sector in the fields of ritual slaughter and religious certification; it requires, indeed, to strike a fair balance between several - sometimes competing - rights and interests. The dissertation analyses and compares the legal approaches through which these matters are addressed in France and in the US, where the general principle of separation between Church and State is construed and implemented in profoundly different ways.

Full textL’elaborato conclusivo del triennio della Scuola di Dottorato in Giurisprudenza, XXI Ciclo, svolto dal candidato presso l’Università degli Studi di Padova, sotto la direzione del Prof. Francesco Gentile, intitolato “Joseph-Emmanuel Sieyes. Le radici geometrico-legali del libero mandato rappresentativo nella Costituzione Francese del 1791”, costituisce il frutto di una ricerca volta ad investigare le origini giufilosofiche, di chiara matrice geometrico-legale, dell’istituto della rappresentanza politica della Nazione, senza vincolo di mandato, così come esso fu realizzato per la prima volta, nella storia del diritto costituzionale europeo, nella Costituzione francese del 1791. Il lavoro si divide in tre parti. La Parte I studia Il contesto storico istituzionale della Déclaration sur la constitution de l’Assemblée del 17 giugno 1789 e si sofferma sinteticamente sulla storia delle istituzioni rappresentative e quasi rappresentative della Francia d’Ancien Régime, con particolare attenzione all’evoluzione degli Stati Generali, fino all’ultima convocazione del 1788. Nel corso di questa Parte viene evidenziato, in modo particolare, il ruolo politico del mandato vincolato nella tradizione della Monarchia francese, quale forma di limitazione del potere sovrano e, per contrapposizione, il ruolo in tale ambito assunto dal Re Luigi XVI, introducendo limiti al contratto privatistico di mandato, nel tentativo di allentare il rapporto tra i deputati eletti agli Stati Generali e la Nazione. La Parte II – I dibattiti sulla rappresentanza politica in seno alla prima Assemblea nazionale (maggio-settembre 1789) – costituisce una lettura dei principali interventi, avvenuti nel periodo indicato, in seno alla deputazione eletta agli Stati Generali, dal 17 giugno Assemblea Nazionale e dal 7 luglio Assemblea Costituente, sul tema della verifica dei poteri, sulla denominazione dell’Assemblea, sui mandati imperativi e sul veto royal. Il candidato mette in evidenza il ruolo primario che nel primo trimestre di vita della nuova rappresentanza assume il deputato eletto per il Terzo Stato di Parigi, Abate Joseph-Emmanuel Sieyès, finalizzato a dare un fondamento teorico ai due principali caratteri che va ad assumere la nuova Assemblea: la rappresentanza della Nazione (e non più dei baliaggi elettori) e il divieto dei mandati imperativi, giustificato dall’idoneità (esclusiva) dei rappresentati a dar voce alla volontà generale. La Parte III – Le radici geometrico-legali della rappresentanza della Nazione nel pensiero di Joseph-Emmanuel Sieyès – dopo aver definito, alla scuola del filosofo del diritto Francesco Gentile, il concetto di geometria legale, investiga i tratti essenziali delle principali opere sieyèsiane, soffermandosi in modo particolare sui caratteri della Nazione, corpo sociale e potere costituente, sul ruolo del lavoro e della legge, sul protocollo dello stato di natura e del contratto sociale. Nel procedere in questo percorso si scopriranno non pochi elementi di comunanza del pensiero di Sieyès con quello di Thomas Hobbes e di Jean Jacques Rousseau.

Full textIn the Italian legal framework, the question concerning the regulation of procedures and contents of collective bargaining represents one of the major labour law issues, which has not found a satisfying solution yet. The abovementioned topic is, in addition, strictly connected to the selection of criteria aimed to determine the actors of the bargaining process. The purpose of the present dissertation is then to examine, first of all, the historical development of the debate on the aforementioned issues in the Italian context, to focus attention, afterwards, on the most recent instances to enact a clearer regulation of the bargaining process, in reason of the crisis of trade unions’ cohesion and of the fragmentation of production originated by globalisation. Finally, the last part of the dissertation will be centred on a comparative analysis with the French regulative context that, in opposition to the Italian one, disciplined by law prerequisites and procedures to accede to collective bargaining process already at the beginning of XX Century. In particular, the first chapter starts from the matter of contention at the base of the whole national discussion referred to the regulative process of arrangements executed between employers’ and workers’ organizations: the incapability of the Italian legislator to enact a law concerning the collective bargaining proceeding respecting, in the meantime, the criteria set forth by Article 39 of the Constitution, that has been at the base of the consequential declaration of illegitimacy of all the legislative attempts to generalize the efficacy of the considered agreements, circumventing the provision of the Fundamental Chart. The analysis continues focusing on the evolution of collective agreements regulated by civil law in the national legal framework: highly centred during the Fifties, then organized on two ordered levels in the brief period of “contrattazione articolata” – introduced initially in public industries with the Protocol Intersind-Asap of 1962 and soon extended to the private field – until the total independence between company and sectorial bargaining level in the years between the end of the Sixties and the beginning of the Seventies, and to the particular characteristics assumed by the said agreements during the oil crisis and in the following years, when the practice of the three-side covenants executed between main trade unions, employers’ organizations and the government, with different outcomes, perdured until the middle of 2000’s. In this context, particular attention is devoted to the collective agreements executed at national level in July-December 1993 that, during the following twenty years, have been considered the fulcrum of the two-level collective bargaining system, and which attempted, in the meantime, with the introduction of Trade unions’ Unitary Representative bodies (in Italian, Rappresentanze Sindacali Unitarie, RSU) to contrast the deep crisis of representativeness of workers’ organizations, whose gravitas has been highlighted, several months after, by the national referendum held in 1995 on Article 19 of law no. 300 of 1970. The last section of the first chapter founds an ideal continuation in the second one. In this field, the main topic become the most recent issues concerning the Italian bargaining system, and significantly the one which moved social actors of the industrial sector – on the base of the crisis of the system of 1993, showed by the Fiat dispute of 2009-2011, followed by the connected judgment of Constitutional Court that in 2013 modified another time the interpretation of Article 19 of law no. 300 of 1970, expanding the criteria to admit workers’ organization to benefits provided by the law, and by the enactment of Article 8 of law-decree no. 138 of 2011 – to affirm that is come the time to set new rules to try to govern the bargaining system. On this point, the dissertation focuses attention on the three national collective agreements held on 28 June 2011, 31 May 2013 and 10 January 2014 and on the further arrangement of 28 February-9 March 2018 and on the respective debate centred, in a perspective of reform, on the opportunity to introduce a bill able to completely fulfil the requirements of Article 39 of the Italian Constitution. The third chapter, finally, follows the scheme of the precedent ones, from the point of view of the French legal framework. Therefore, firstly is described the evolution of the said juridical context, from the loi of 1919 concerning collective agreements regulated by civil law and the regulations of 1936 and of 1950 on the extension erga omnes, through an administrative decree, of collective agreements signed by representative trade unions, until the new model of “citizenship in the company” promoted by the laws Auroux enacted in 1982 and to the fragmentation of the labour law system occurred between the 80s and 2000s, characterised by measures without a systematic approach and, sometimes, in contrast between each other. The attention is focused, then, on the reforms that, recently, heavily redefined the structure of the French labour law framework consisting in the introduction, in 2008, of objective criteria to select representative trade unions, in the extension of this model to employers’ organizations in 2014-2016 and, with reference to the bargaining structure, in the disputed reform responding to the name of loi Travail, held in 2016, and in the ordonnances promoted by the new President Macron in the late 2017, towards the direction of a relevant and decisive expansion of company collective agreement, to the detriment of sectoral level. The arrival point of the path traced above regards the attempt to reply to the issue concerning the opportunity to provide or not, in the Italian context, for a law regulating collective bargaining and the related obligations and rights of social actors, to clarify and stabilize the arrangement system. Secondly, also on the base of the comparison with the French frame of reference, the dissertation is closed by a reflection on the possible legal institutes to be introduced in the Italian juridical framework, in order to assure a general extension of collective bargaining, in the light to allow an harmonious development also of the company level.

Full textThis work aims to examine the legislation in force on the protection and valorisation of archaeological heritage, also from a comparative perspective. Within in the framework of the Italian legal system, were considered the regulations concerning finds and discoveries and the limitations of free availability and circulation, in order to analyse in depth the protection created in the national legislation. Particular attention was paid to the protection of territory into which archaeological goods are transferred and therefore to the indirect protection, as well as the ope legis constraints and landscape planning. Furthermore, this study investigated the regime of preventative archaeology and the valorisation and usage of archaeological areas and parks in the reciprocal interfacing of regional legislation and the guidelines issued by the Ministerial Decree of 18 April 2012. A comprehensive investigation was undertaken on the protection of underwater archaeological heritage and in particular the UNESCO Convention adopted in Paris in 2001, as well as the supranational protection of cultural assets, with reference to the regulations of the European Union, the European Convention for the Protection of Archaeological Heritage of 16 January 1992 and the UNIDROIT Convention of 24 June 1995 on stolen or illegally exported cultural assets. This investigation was followed by two case studies on the protection of archaeological heritage in Spain and France. Regarding the former, the current constitutional framework was examined, with reference to the protection of cultural heritage provided by Ley 16/1985 of 25 June 1985 and the legislation of the Comunidades autónomas. With respect to the latter, particular attention was dedicated to the Law of 27 September 1941 which introduced in France the first organic regulation on excavations and archaeological finds. An extensive analysis was dedicated to the contemporary legal provisions afforded by the Code du Patrimoine, whose fifth book entirely provides for archaeology.

Full textThis thesis addresses the evolving relationship between democratic constitutionalism and supranational law in Europe. The research is based on the idea that the increase in recent decades of constitutional conflicts between the two systems is due to their fundamental difference, particularly considering the absence of the social question in supranational law. The first chapter analyses the main legal theories that have provided the theoretical habitus for interpreting the integration process, justifying the adoption of a reading of the dynamics of the legal system through the prism of conflicts and the material constitution. The second chapter looks at the analysis of the case law, subdivided into two blocks: firstly – having studied some cornerstones of supranational law – the two systems will be compared, in a static way, on some themes (principle of non-discrimination, freedom of enterprise and the balancing with collective interests, the rights of democratic pressure, etc.) in order to highlight the different approaches. Secondly, it will be examined, in a more dynamic perspective, different disruptions that have affected the relations between systems: the former has been developed on the respect of fundamental rights by supranational law, while the latter, still in progress, focuses on the constitutional identity. In the final chapter, an attempt will be made to develop – on the basis of the results of the theoretical debate and of the case law analysis – a final proposal that tries to unite the social question and the constitutional identity in European public law, based on a more central role that the Constitutional Courts will have to play in the development of the dynamics of the legal system, in order to bring to the surface certain conflicts of value, absent in the European public space.

Full textThe study of the Urban Free Zones inside the European Tax Law must analyze the different types of free zones in the Countries intra/extra EU. Through cases-study of Madeira, Azores, Zone d'Economie Urbaine stimulée of Brussels, it is evident the absence of a definition of Urban Free Zone: analyzing the French and Italian experiences, it has been possible to study the territorial, subjective and objective profile of the support system turned to the recovery of the degraded urban areas. The instrumental function of taxation required a national and european compatibility check to ensure that national choices, even if legitimate internally, can be transformed into state aid tax. Highlighting the relationship between the ZFU and the European Market is wanted to: i) carry out a systemic necessary reconstruction for an interpretation of the ZFU that underlines the components of that instrument oriented to the pursuit of social and economic interest, which initially generate a contradiction, an exception to the constitutional and community principles, for then "to melt" into a coherent application of the same; ii) to try to give a definition of ZFU as a systemic measure of the UE. Took place, finally, a reasoning in terms of fiscal federalism with reference to the ZFU, finding a suitable placement in the path of devolution undertaken by the national legislator, having the Special Statute Regions as interlocutory privileged.

Full textThe study of the Urban Free Zones inside the European Tax Law must analyze the different types of free zones in the Countries intra/extra EU. Through cases-study of Madeira, Azores, Zone d'Economie Urbaine stimulée of Brussels, it is evident the absence of a definition of Urban Free Zone: analyzing the French and Italian experiences, it has been possible to study the territorial, subjective and objective profile of the support system turned to the recovery of the degraded urban areas. The instrumental function of taxation required a national and european compatibility check to ensure that national choices, even if legitimate internally, can be transformed into state aid tax. Highlighting the relationship between the ZFU and the European Market is wanted to: i) carry out a systemic necessary reconstruction for an interpretation of the ZFU that underlines the components of that instrument oriented to the pursuit of social and economic interest, which initially generate a contradiction, an exception to the constitutional and community principles, for then "to melt" into a coherent application of the same; ii) to try to give a definition of ZFU as a systemic measure of the UE. Took place, finally, a reasoning in terms of fiscal federalism with reference to the ZFU, finding a suitable placement in the path of devolution undertaken by the national legislator, having the Special Statute Regions as interlocutory privileged.

Full textThe present study deals with the examination of the elements, in fact and in law, which, within groups and networks of companies, allow the simultaneous reconditioning of a work relationship to several employers. In order to do this, it was essential to highlight the syntonic and dystonic elements between the commercial and the labour law discipline and, secondly, to address the doctrinal and jurisprudential surveys stratified over time. Finally, after bringing the case back into the category of obbligazione soggettiva complessa, has been pointed out the qualitative differences between the codatorialità in the groups, as a remedial matrix, and the one in the networks, introduced by law in 2013 and, only apparently, left to the wide discretion of the companies.

Full textThe thesis aims at analysing, from a comparative perspective, the role of medical ethics in Italy, France and Germany. The survey focuses on both the formal and substantive aspects of the relationships between law and medical ethics. As to the first issue, the thesis analyses the codification of medical ethics, the normative function of the medical councils, the binding value of the codes of medical ethics and their position in the hierarchy of norms. With regard to the second aspect, the role of medical ethics is studied from a more substantial perspective, analysing the concrete interrelations between law and medical ethics in the field of biolaw. The survey is then extended to the disciplinary procedure and to the European level. In the first part, the relationships between law and medical ethics are analysed from a linguistic perspective, aiming at underlining some specific features of the concepts referred to as “déontologie”, “deontologia” or “Standesrecht” and “Berufsordnung” in France, Italy and Germany. This part also deals with some “open questions” characterising the relationships between medical ethics and the law. The second part concerns the codification of medical ethics, while its role in the field of biolaw is analysed in the third part. The fourth part deals with deontological liability and disciplinary procedures. Lastly, the fifth part aims at elaborating a theoretical reconstruction of the results of the comparative analysis, at highlighting the main roles of medical ethics at the European level and at suggesting a different model for the relationships between law and medical ethics in the Italian system
L’obiettivo della tesi è un’analisi comparata del ruolo della deontologia medica nel sistema delle fonti del diritto in Italia, Francia e Germania. Per tenere conto della complessità del rapporto tra diritto e deontologia, sono stati analizzati sia gli aspetti formali di tale rapporto, sia i profili sostanziali del ruolo della deontologia medica nel biodiritto. Nella prima parte alcune considerazioni preliminari e l’analisi linguistica hanno permesso di definire l’ambito di indagine e i profili di maggiore complessità del rapporto tra dimensione deontologica e dimensione giuridica sui quali nelle parti successive si è concentrata l’indagine. La seconda parte, dedicata alla codificazione dell’etica medica, ha messo in luce la varietà di soluzioni e di modalità di ingresso della norma deontologica nell’ordinamento giuridico. Nella terza parte sono stati analizzati il ruolo della deontologia medica nell’ambito del biodiritto e l’influenza di alcuni fattori particolarmente rilevanti sull’evoluzione dei contenuti concreti dei codici deontologici e sulla loro portata pratica. La quarta parte è dedicata alla violazione della deontologia e ai procedimenti disciplinari. Infine la parte conclusiva contiene una ricostruzione teorica dei risultati emersi dall’analisi comparata, lo studio di alcuni profili legati alla dimensione europea della deontologia e la proposta di alcune ipotesi di riforma per un modello italiano più coerente, flessibile ed efficace dei rapporti tra diritto e deontologia

Full textThe expression “the oldest job in the world” suggests the idea of inter-temporality in prostitution. In reality, although the phenomenon of prostitution has always existed, the legal treatment of this activity is diversified and constantly evolving. From a juridical point of view, the current comparative picture reveals the difficulty of identifying a common and universal discipline to deal with prostitution in the various liberal-democratic systems. This is due to the fact that the legal treatment of prostitution is nothing but the result of a conflict of values. In other words, the different regimes of regulation of prostitution and the differentiated choices of criminal policy are the result of the conception accepted by each national legislator on the fundamental notions of vulnerability, dignity and availability of the body, which are relevant in this particular context, and the consequent balance that derives from it. In this context, starting from the comparative study of legislation and tribunal practice of countries that have adopted different regulatory models - Italy and France in particular – attention will be focused on the common justification that lies behind these different approaches. In fact, the present work aims precisely to consider the question of the criminalization of prostitution from the root, focusing the investigation on the ratio of the different theories, the legislative choices and the jurisprudential decisions adopted in the field of prostitution, particularly in the Italian and French legal systems. This study will allow, first of all, the understanding of the meaning of the most recent jurisprudential decisions and legislative reforms in the field of prostitution. Secondly, it will make it possible to verify to what extent the choices of criminal policy adopted from time to time by the various legislative and judicial authorities are sufficiently justified or supported by solid arguments and, at the same time, they guarantee the protection of the fundamental rights of prostitutes

Full textSince the beginning of the XXI century, Italian and French administrative courts have shown an increasing interest in the protection of legal certainty, which eventually culminated in the adoption of the power to modulate the temporal effects of judicial annulments, along the lines of the powers granted to the European Court of Justice by art. 264, sect. 2 T.F.E.U. An in-depth analysis of Italian and French case law revealed that several legal doctrines aimed at the preservation of unlawful administrative acts from the effects of an annulment had already been developed by domestic Courts prior to the introduction of the power to modulate their decisions, thus demonstrating a long-lasting commitment to legal certainty by the Courts.The new techniques generated different responses in the two sides of the Alps. While in France, they received general approval by legal scholars – at least initially – and their use is now widespread, in Italy they have been almost unanimously deemed in contravention of the guarantees enshrined in article 113 of the Italian Constitution. The dissertation describes and analyses the old and new techniques by which the stability of an unlawful act or of its effects are protected by Italian and French Courts, with the aim of further defining the concept of legal certainty by illustrating what is actually protected by the Court when the principle of legal certainty is acknowledged to prevail on the principle of legality. Furthermore, the dissertation focuses on the impact of these techniques on the justiciability of citizens’ rights, in France and in Italy, as a means to explain the different reception the power of modulation has had in the two Countries

Full textAccording to the comparative method, the thesis analyses the recent changes to the discipline of the collective agreement at plant and company level in Italy, France and Spain, introduced by the law and the bargaining process; the work is aimed to demonstrate that these countries nowadays have an industrial relations system more closed to the north-american one, where the employment relationship is basicly regulated by the plant or company agreement, and not by the law or the multi-employer bargaining pratice.Finally,in order to demonstrate this common trend, the author focuses on the recent agreements signed at Fiat and Chrysler after the merger.
