Full textThe thesis addresses the issue of protection instruments for the condition of unemployment. In the absence of a general legal concept of unemployment, the goal is to find the common elements to different institutions which define the protection scope afforded to persons without a job. The study provides, at first, a comprehensive historical-critical survey of the tools for income support in the event of lack of work. The analysis of the legislative intervention models highlights goals, characteristics and problems of each legal institution, the more established as well as the most recent ones. The second part of the thesis tries to integrate the recognition of forms of economic protection through the analysis of active policies in the labour market and measures to support employability. The intent is to verify how legislative initiatives try to connect income protection and employment promotion. The research also addresses the question of limits to freedom of movement of EU citizens and restrictions determined by measures that reduce or discourage the exportability of social security benefits in other European countries. The final section seeks to identify the fundamental elements of the complex of institutions analyzed in order to define events to which legal order provides protection. The study identifies two important elements characterizing all the protection instruments: first, the condition of "lack of work"; second, the current state of unemployment, stated as general parameter for protective action. The analysis points out, however, that the mechanisms of so-called conditionality for access to economic benefits and employment services do not allow a successful promotion of quality of work and workers skills. The thesis identifies a possible field of development for the protection of the unemployed in the integration between tools supporting employment and general universal interventions.

Full textThe characteristics of the labor market require an increasing personalization of labor market management interventions (training, guidance, passive and active labor policies), with the aim of satisfying the recipients of the measures also considering their heterogeneity and emerging needs, including those of an extra-work nature. This study aims to assess the possible use of innovative labor market management tools within the national context in order to meet these emerging needs. To this end, a survey of the main instruments adopted, including experimental ones, for labor market management was conducted, highlighting their common features and defining their positive and critical effects. Secondly, an analysis of the regulatory framework of reference at the national and supranational level was carried out in order to understand the application limitations of the investigated instruments and to identify possible interventions to adapt current legislation. Consideration was given to European, national and in some cases regional regulatory acts that rule how labor supply and demand are matched, rulings of national and European courts, decisions and guidelines of independent authorities, especially data protection authorities, and collective bargaining. The thesis developed from the analysis of national and international scientific literature related to the subjects under research: labor market, IT law, and data governance. The normative and literature analysis activity was accompanied by experiential data related to the apprenticeship, thanks to which it was possible to develop an in-depth knowledge of the main tools useful for labor market management. The analysis carried out showed that the new technologies in use for labor market management focus mainly on the utilization of data in various forms and allow an increase in the quality of services and greater personalization of interventions. They fit within a complex, multilevel regulatory framework, in some ways still in its embryonic stage, where some technical and organizational aspects have only recently been taken into account by European law and subsequently by Italian law. The priorities that emerge so that all labor market actors can successfully benefit from the new technologies used to manage the labor market are the initiation of a widespread digital literacy process and the creation of an IT and organizational infrastructure. This thesis is integrated within a multi-disciplinary discussion on labor market management policy development that links issues specific to labor market law with those of legal informatics and the inherent regulation of data circulation. The cross-disciplinary nature of the paper allowed for a broader reading of the topic of the use of new technologies for labor market management, involving branches of law and disciplines that will be increasingly closely related to each other in the future.

Full textThe research work that presents itself is divided into three chapters, in which it is examined the issue of job instability. In the first chapter, the candidate shows the causes that led to the dizzying increase in use of flexible contracts and, in this regard, analyzes the European directives, principles and guidelines that, in the path of development of the European strategy for employment, have placed the 'flexicurity' as a typical model of European labor market; from the same perspective, paying attention to the theme of social problems of the global markets, it analyzes to the economic investigation of labor law and, in particular, the consequences for job security related to the economic transformations. The second chapter is devoted to the role played by trade unions in Italy on the issue of flexibility. In this sense, the author shows how the "institutional" function which are also called to comply workers' organizations has also characterized the political choices of trade unions' in the field of temporary work; so are examined the concepts of flexibility "negotiated", as already shown in the literature, and are theorized the differences between mandate "open" and "closed", such as different forms of delegation of legislative power to the trade unions in the theme of flexibility. In the third and final chapter the author tries to highlight the benefits and features that relate to the use of fixed-term contracts, as the main form of flexible contract in use in our labor market. Introduced such benefits, he made a critical judgment about the degree of liberalization of this type of labor contract considered that in the last reforms is always more the arbitrariness in the choice of the employer of the duration and conditions of carrying out the work performance.

Full textThe word Regolazione can refer to two different meaning that originate respectively, the first in the research and reflections and the other in the deepening economic policy and experience of civil law and public law and administrative law. In the economic theory of regulation is deepend a research program originated in France in the early seventies where the focus of the researcher is primarily directed to all the rules and procedures, standards, laws that ensure functioning, withinin a capitalist system of production, the ability of the accumulation process to endure over time and causes that may lead to the crisis or failure. The French Theorie of Regolazione explains the reasons why a capitalist economic system while being directed to the duration can not escape the crisis that will interrupt the positive cycle, introducing periods of crisis. As a result, some sectors of the economy (particularly those derived from here or public services that affect protected areas of economic trade) can not be left to the risk of default affecting the markets that operate according to the principle of free competition but need an external source to the market leading corrections to the asymmetry of the system of free market competition. According to the theory of regulation, however, the strategic economic sectors (energy, transport, insurance, healthcare) can be ousted only by centralized management and introduced in the market according to a commercial logic. However, given the importance and sensitivity of the services that they provide, it will be necessary that the state, indirectly, through the establishment of third parties and Technical Agency (Independent) maintains an active role. Also the doctrine of the social sciences and philosophy in particular has deepened the concept of adjustment. These authors have mainly investigated the relationship between the space, the production and the effectiveness of the rules. This setting provides the opportunity for the discussion of this thesis within the international context, characterized, as is known, by a constant process of economic and cultural convergence between the various countries of the world, better known as globalization. The analysis will move so the function of the adjustment in the global market and the main actors of this regulatory activity: international organizations and multinational enterprises. The survey will examine the current situation of the Italian labor market, in particular will be esxamined which were the effects of globalization on it and if the current economic crisis has affected it and in which way.

Full textThe crisis of the welfare state has encouraged the emergence of subsidiary forms of welfare, categorised as a whole under the name of "second welfare", collateral to the traditional form and providing ancillary services and social welfare services to be guaranteed to specific groups of beneficiaries. The literature on the topic, which is retraced within this paper, has mapped this in a complex and articulated way, with the aim of identifying the sub-categories that make up the second welfare, breaking it down into the forms of occupational, contractual and corporate welfare. Corporate welfare, in particular, was the subject of the legislator's attention in the context of the 2016 Budgetary Law, which expanded the range of tax-exempt services with social relevance to be paid to workers and, at the same time, established taxation subsidised through variable remuneration. Furthermore, performance bonuses can in turn be converted into goods and services in kind, giving rise to a further form of welfare defined as "productivity welfare". The tax exemption legislative initiative has revived the interest of companies towards total reward policy, which combines traditional remuneration with forms of ancillary remuneration in terms of people care, income support (mortgages), forms of work-life balance, entertainment and leisure services. The increase in demand for goods and services has been intercepted by specialized operators, known as providers, who act as intermediaries of corporate welfare services for companies. Welfare solution providers represent a seemingly peripheral node, but their role is central to employees by acting as gatekeepers for effective access to the benefits they become holders. The providers offer a technological service that uses an IT platform, but their strength lies in the ability to provide a consulting activity with which to support companies in the design, implementation and monitoring of interventions and welfare plans. The paper aims to provide a scientific reflection on this entrepreneurial segment, analysing the different types of operators and players who populate it and the size of the market generated by commercial opportunities deriving from the provision of tax incentives, from which a thriving employment induced has emerged, giving rise to new professional figures to be employed in the sector. Furthermore, from a legal and fiscal point of view, this essay analyses the services of which the welfare plans are composed in order to outline the tax advantages for companies and workers, who frequently access the services identified through the instrument of the voucher. Together with other fundamental players, providers are redesigning HR management and remuneration policies with a view to strengthening welfare services as a structural element of the company organisation to implement the company's organisational well-being and social role. It is necessary to identify opportunities and critical issues linked to this innovation, striving to govern the phenomenon towards the enhancement of the social merit of ancillary remuneration, preventing the danger of consumerist drifts and making the most of the potential of all the players involved, including trade unions.

Full textThe thesis, after a reconstruction of the present legal framework on temporary contracts in Italy and major European jurisdictions (Spain, France and England), addresses the most important problem areas of the institute. Particular attention is devoted to issues that have arisen as a result of recent legislative changes referred to Connected work (Law n. 183/2010), until the decisive intervention of the Constitutional Court, by judgment no. 303 of 9 November 2011, which declared the legitimate compensation for damages, additional to the conversion of the contract. All the issues addressed have highlighted the difficulties for the Superior Courts, as well as Community and national courts, to find unique and shared a line in resolving controversies on the subject. The paper concludes with some reflections on the issues of flexibility and precariousness in the labor market, through a quantitative and qualitative assessment of the institution in order to provide an answer to some questions: flexibility is necessarily precarious and can be read as special form of employment? What are the possible antidotes to insecurity? In conclusion, it is shown how flexibility can be a problem for businesses and workers only in the long term. The solution was found in the opportunity to invest in training. It is thus assumed a new "flexible socially and economically sustainable", to be achieved through the use of regions and, therefore, the contributions from the European Regional Development: the worker, thus, can be ensured continuity with the work through targeted training and, on the other hand, the employer shall not be liable for costs for the training of temporary employees.

Full textMafia-type organized crime has progressively broadened its field of action. It is now characterized by an increasingly transnational character, which goes at the same pace as the assumption of multinational, flexible and networked organizational profiles, as it has autonomous units located in territories all over the world. Alongside the purely illegal activities, Mafia-type organized crime has a massive influence in the legal economy, both in public markets (e.g. tenders and concessions in general, access to public funding) and in the private economy, thanks to relations of collaboration, collusion and complicity with the actors of the so-called grey area (i.e. the system of relations within which the interests of subjects formally operating in the legal market are intertwined with those of subjects belonging to the 'criminal world'). In order to effectively counter mafia infiltration into the legal economy, besides the preventive and repressive criminal apparatus, the legislator has introduced certain preventive measures of an administrative nature aimed at protecting the legal economy. The purpose of this research, conducted from a labour law perspective, is to investigate the interactions - and short-circuits - between this model of prevention of Mafia-type organized crime and labour law. Accordingly, several measures were selected – measures which aim at assessing the legality of companies acting in the market, and which have significant repercussions on labour and, in general, on the market itself. Such a research made it necessary to extend the perspective of the investigation to the European dimension with reference to two aspects. The first, more strictly technical-legal, relating to the compatibility of the forementioned measures with EU law (especially with the freedom of establishment and the free movement of services). The second, relating to the concrete applicability of the measures to companies that have their headquarters in a EU Member State other than Italy. The research was divided into three parts. In the first part, the regulatory framework was reconstructed. To this end, the selected measures were analysed separately, but always looking at their mutual interrelationships (both those already in place and those that are possible and/or desirable) in order to contrast the current alluvial and fragmentary nature of regulatory interventions with the pursuit of a systematic need. In the second part, the profiles of possible incompatibility of the measures under consideration with EU law and, especially, with the 'freedom to provide services' and the 'freedom of establishment' were examined. Such analysis also offered food for thought on the limits to the concrete application and the adequacy of control mechanisms on 'foreign' companies. The third part dealt with the question of the effectiveness of the measures, analyzed from an eminently labour-law perspective. The aim was to test not only the ability of these instruments to contribute to the prevention of Mafia-criminal infiltration into the economy, but also (and above all) to assess their propensity to grant spaces of protection to labour and workers, as well as to safeguard and/or promote the productivity of the companies to which they are addressed.

Full textThis study analyzes the strategies and techniques of political communication adopted by politicians and union leaders to communicate labor and work in Italy. The theoretical framework is obtained by revisiting the framing theory from the perspective of the new rhetoric. The thesis provides the analysis of two case studies: the political communication of the last reform of the Italian labor market, known as the Jobs Act, and the public communication during the negotiation that took place around the so-called “Fiat Pomigliano” case in 2010. The study also analyzes collective bargaining in the US automotive sector during autumn 2015. The findings suggest that in communicating labor and work, the controversial strategy adopted in political communication may not be considered effective in building a lasting consensus.

Full textThe aim of this research is to study how Labour Law and Social Security systems can contribute to prevent the early exit from the labour market of people with chronic diseases and promote their return to work. The main objective is to identify alternative ways that allow workers with chronic illnesses to continue working in a manner compatible with their reduced working capacity rather than leaving the labor market prematurely, mainly through dismissal related with capacity or though the access to disability or incapacity benefit. The first chapter analyses the concept and chronic diseases by differencing that from other concepts like disability. The conclusion is that chronic diseases are different from disability and the best solution to protect workers with chronic diseases can not be their assimilation to disabled. The second chapter focuses on the rights of workers with chronic diseases, particularly, the right of non-discrimination and the right to health. Chronic diseases should be considered as an autonomous cause of discrimination. In the third chapter the different measures in force in the legislation, particularly reasonable adjustments and Occupational Safety and Health regulations, that could potentially promote the conservation and return to work of workers with chronic diseases are analyzed. The conclusion is that these measures are not sufficient to adapt working conditions of workers with chronic diseases and that It would be necessary to include in the legislation an specific measure. The forth chapter is about the regulation of the dismissal, with a focus on the reasons that would consent a valid dismissal of workers with chronic diseases. The last chapter provides an overview of the treatment given to chronic diseases by the Social Security systems, focusing attention on the current situation and possible reforms that could be put into practice regarding incapacity benefits and active employment policies.

Full textIn light of the current work situation, with employment rates showing high gender inequality, this doctoral thesis “Equal opportunities, work-life balance and inclusive work organisation: evolution, prospects for development and case study” addresses the issue of the promotion of equal opportunities in labour market participation through a balanced distribution of care-taking and work responsibilities between partners, with the aim of organising work in a more inclusive way. This thesis consists of three essays: the first provides an analysis of the evolution of European labour law in terms of gender discrimination, the second restricts the scope of analysis to the case of Italy, while the third focuses on a specific system in Italy, i.e. the judicial system. The first essay "Equal opportunities in EU labour law: from the principle of preferential treatment to the conciliation of working time and care-taking time" highlights how EU labour law has evolved over time to encourage equal opportunities in employment participation. The principle of equal treatment, which was initially intended as prohibition of discrimination of the most vulnerable groups and then developed into the principle of preferential treatment, is identified as the starting point of this evolution. Subsequently, the driving role of the European Pillar of Social Rights is discussed: this initiative was ground-breaking in that it placed the emphasis on work-life balance, intended as an incentive for women to enter and remain in the labour market and which laid the ground for the issue of Directive no. 1158/2019, which encourages a better distribution of responsibilities between partners. The second essay “Work-life balance in Italy. The progressive functional evolution of parental leave, from tool to support maternity through the sharing of family responsibilities between partners” brings parental leave to the centre of attention, investigating its innovative scope within the existing regulatory framework, from Law no. 1204 of 1971 to the unprecedented measures introduced by Law no. 53/2000, up to the reform of the Jobs Act and the recent measures implemented to respond to the Covid-19 emergency. The future reforms that are currently under discussion in EU Directive no. 1158/2019 and the new Italian “Family Act 2021” are also examined. In the third essay "The long road to gender equality: the case of the Italian judicial system", the question of equal opportunities in the world of work is explored, focusing on the judicial system. In its introduction, this work provides a reconstruction of the history of the regulatory path that led to the approval of Law no. 66 of 9 February 1963 entitled "Admission of women to public offices and jobs", which allowed women to access the judiciary, and points out the difficulties women have encountered to establish themselves in the system. Subsequently, the survey "Analysis of the current situation of the judicial system in the Emilia-Romagna region" is presented. The results of this survey, which was conducted by the Department of Economics and the Marco Biagi Foundation of Modena in collaboration with the Emilia-Romagna Section of the ANM (Italian Association of Judges), confirm and shed light on the persistence of forms of discrimination in the judicial system to this day. In addition to examining the issues emerging from the organisation of work in the judicial system, the survey identifies the main difficulty currently encountered by women in this sector of the labour market: work-life balance.

Full textL’obiettivo di questo studio è quello di esaminare, dopo aver passato in rassegna i principali provvedimenti in materia di ammortizzatori sociali che si sono succeduti dal dopoguerra ad oggi, prima la normativa del D.Lgs. n.148/2015, che è stata modificata da ultimo, dalla L. n. 234/2021, passando attraverso le disposizioni contenute nei vari decreti-legge che si sono succeduti a ritmo serrato durante la pandemia da Covid-19 negli anni 2020-2021. Infatti dapprima la legge delega n. 183/2014 (c.d. “Jobs Act”) ha delegato il Governo ad adottare uno o più decreti legislativi finalizzati al riordino della normativa in materia di ammortizzatori sociali, tenuto conto della peculiarità dei diversi settori produttivi. L’intervento normativo, in attuazione di tale disegno, ha comportato, sul versante delle politiche passive, la riscrittura della disciplina degli ammortizzatori sociali in costanza di rapporto, ad opera del D.Lgs. n.148/2015. Ciò per razionalizzare la normativa in materia al momento disseminata in molteplici testi normativi, nonché le disposizioni concernenti gli strumenti di tutela del reddito in costanza di lavoro, con contestuale abrogazione di tutte le disposizioni che fino a prima regolavano la materia. Al fine di fronteggiare l'emergenza epidemiologica da Covid-19 e la conseguente sospensione dell’attività lavorativa allo scopo di contenere e contrastare la diffusione del virus, sono stati realizzati diversi interventi normativi e introdotte molteplici misure. Dal punto di vista lavoristico, le predette misure sono state indirizzate, tra l'altro, alla tutela dei lavoratori, con l'obiettivo, in particolare, di favorire lo svolgimento dell'attività lavorativa in modalità agile e di predisporre strumenti di sostegno al reddito in conseguenza della riduzione o sospensione del lavoro conseguente all'emergenza. L’ impulso per la riforma organica di tutto il sistema degli ammortizzatori sociali si è reso necessario e urgente, anche per via degli effetti socio-economici determinati dalla pandemia da COVID-19, che hanno inizialmente spinto l’Esecutivo a mettere in atto interventi emergenziali susseguitisi con soluzione di continuità, diretti a sostenere imprese e mercato del lavoro, per evitare conseguenze ancora più drammatiche dal punto di vista sociale. Le misure hanno riguardato il blocco dei licenziamenti e l’estensione degli schemi di protezione sociale, oltre a misure di sostegno settoriali specifiche, contro il rischio di disoccupazione. Ciò anche e soprattutto con l’ausilio degli strumenti finanziari europei che, sia con il meccanismo SURE, che con il Next Generation EU, hanno consentito, seppure in una situazione emergenziale, la tutela del mercato del lavoro. Con la ripresa delle attività produttive e il miglioramento dei principali indicatori occupazionali, il legislatore con la L. n.234/2021 “c.d. Legge di Bilancio 2022” ha previsto la realizzazione di un sistema maggiormente universale ed inclusivo, affinché tutti i lavoratori, compresi quelli momentaneamente privi di impiego, non risultino esclusi dal sistema di protezione sociale. Tra gli obiettivi vi è quello di garantire tutele adeguate non più attraverso misure assistenziali, ma dirette a favorire maggiori garanzie del lavoro e politiche attive attraverso la ricollocazione e la mobilità professionale verso le reali esigenze del mercato del lavoro, garantendo un impianto capace di adattarsi alle dinamiche in corso, consentendo così un adeguamento dei trattamenti, secondo le caratteristiche settoriali e dimensionali delle aziende. In tale contesto, sono stati trattati i controlli ispettivi in materia di ammortizzatori sociali, secondo le disposizioni legislative e le circolari esplicative, per contrastare l’uso distorto degli stessi da parte delle aziende.

Full textLatin America is experiencing a complex process of reform from both a political and a social point of view. It is in light of this situation that the nearly consolidated process of regional integration will be studied, with special attention paid to the social importance and the regulation of fundamental social rights within Mercosur. Despite the fact that social rights were never historically uttered in the text of the Treaty of Asuncion, subsequently, the subject finally gained institutional recognition with the signing of the Social and Labor Declaration which elevated fundamental social rights to the same standards as those of Mercosur. Ample space will be dedicated to the identification of those fundamental social rights as provided for in said instrument while highlighting the principal developments, shortfalls and prospects of their success in Mercosur. Special importance will also be given to Mercosur’s controversial legal system, an intergovernmental organization unlike the European supranational system. This undoubtedly represents a limit to be surpassed towards the achievement of social and economic development. Understanding the legal system in question is fundamental in order to further examine the evolution of Mercosur’s legislative system, formed primarily on bilateral or multilateral accords and, as a result, lacking in a common law able to coordinate the protection of social rights. The purpose of this analysis is also to study how the creation of supranational frameworks such as a Court of Justice and a Mercosur Parliament may symbolize fundamental elements needed to reduce the existing asymmetry within the internal systems, while favoring the harmonization of the standards and the consolidation of a fair social dimension in Mercosur.

Full textThe present research investigates the healthcare sector from the point of view of labour market trasformation and the need (particularly felt in this sector) to promote integrity in the face of increasing cases of corruption and maladministration. The aim is to read the phenomenon from a different point of view, focusing on the labour market and on workers. After the analysis of the existing literature on the subject (in the Literature Review chapter) and a quantitative analysis of the personal data (as examined in chapter one) which shows the growing use of flexible contracts and outsourcing, the research explores how the trasformation for a more ethic, efficient and effective healthcare system has to be entrusted not exclusively on formal aspects but require efforts in terms of investment in human capital, in the training and the diffusion of ethical issues among all workers who work in the sector. In particular what the research wants to highlight, if the integrity promotion (as examined in chapter two) could be complicated by the diffusion of non-standard contracts or fraudulent contracting of work (flexible, atypical, autonomous and pseudo-autonomous workers, trainees), types of work without a contract (voucher, undeclared jobs) and new labour organization models (economy on demand, smart-work, posting of workers by Eastern Europe temporary agencies). The theoric analysis has been flanked by an empirical research conducted through two different methods: an on-line questionnaire sent to the managers of the corruption prevention in the SSN and frontal interviews with witnesses (SSN employees, workers of cooperatives, self-employment and freelance workers, trade unionists, representatives of professional associations, managers of corruption prevention).

Full textThis research is based on the theory of the pluralism of the sources of the law. It aims at encompassing the three hypotetical systems of the setting of the Transnational Labour Law as following : transnational company, industrial relations, and arbitration as a mean of fixing the corporation customs (lex mercatoria, lex sportiva). This dissertation focuses on the way to insert in the local law (i. E. The Italian and the French law) the different legal act related to each legal system that is : company unilateral norms, collective transnational agreements, and arbitration awards. Furthermore, this thesis addresses the difficulty to determine the type of each and problems of international private law. The author concludes that it is necessary to establish new links between States law and these new forms of regulations

Full textThe present study is directed to verify if administrative sanctions in force are fit instruments to ensure that labour rules are observed. After examining, in chapter I, the main theories about effectiveness (principle revealing relationships between facts and law), the study analyses the cause of decriminalization of labour crimes and the general principles of administrative crimes as regulated by legge n. 689/81. In chapter III is a short pass of the main administrative labour crimes. Particular attention is given to administrative time work and undeclared work crimes because of the importance of values concerned and the numerous laws recently occurred. In chapter IV labour vigilance is examined considering the importance that controls have to ensure laws’ respect.
