Abstract:
Diplomatic asylum is a practice of granting international protection outside of state territory which is often carried out based on the extraterritorial theory and the principle of inviolability possessed by a state to carry out its diplomatic mission. In several cases, diplomatic asylum is sometimes regarded as reducing the sovereignty of a state which potentially leads to increasing bilateral tensions. However, humanity considerations as the reasons behind the granting of diplomatic asylum are appreciated by the international society. This article aims to discuss the existence of diplomatic asylum from the perspective of sovereignty and the legitimacy of diplomatic officials to grant diplomatic asylum. This article concludes that international law generally places state sovereignty and non-intervention as fundamental principles that must be respected. Both the Vienna Convention on Diplomatic Relations (1961) and the Vienna Convention on Consular Relations (1963) do not specifically regulate the issue of diplomatic asylum, therefore, its legal basis often refers to state practices. The granting of diplomatic asylum that is not based on humanity's interest may raise a controversy under international law. Instruments of international human rights law justify for diplomatic officials to grant asylum to people in need, especially in critical situations that threaten the safety of that person. Abstrak Suaka diplomatik merupakan praktik pemberian perlindungan internasional di luar wilayah teritorial suatu negara yang kerap dilakukan atas dasar eksistensi teori ekstrateritorial dan prinsip inviolabilitas yang dimiliki oleh suatu negara untuk melaksanakan misi diplomatiknya. Dalam beberapa kasus, pemberian suaka diplomatik terkadang dianggap mereduksi kedaulatan suatu negara sehingga berpotensi meningkatkan tensi hubungan bilateral. Hanya saja, dalil kepentingan kemanusiaan sebagai dasar pemberian suaka diplomatik justru diapresiasi oleh masyarakat internasional. Artikel ini bertujuan untuk membahas mengenai eksistensi suaka diplomatik yang ditinjau dari perspektif kedaulatan dan legitimasi pejabat diplomatik untuk memberikan suaka diplomatik. Artikel ini menyimpulkan bahwa hukum internasional pada umumnya menempatkan kedaulatan negara dan non-intervensi sebagai prinsip-prinsip penting yang harus dihormati. Baik Konvensi Wina mengenai Hubungan Diplomatik (1961) maupun Konvensi Wina mengenai Hubungan Konsuler (1963), tidaklah secara spesifik mengatur persoalan suaka diplomatik, oleh karenanya suaka diplomatik berkembang pada praktik negara-negara. Pemberian suaka diplomatik yang tidak didasarkan dengan kepentingan kemanusiaan dapat memunculkan kontroversi dalam hukum internasional. Instrumen hukum hak asasi manusia internasional memberikan justifikasi bagi pejabat diplomatik untuk memberikan suaka kepada orang yang membutuhkan, khususnya dalam situasi genting yang mengancam keselamatan orang tersebut.

Abstract:
Leadership is the ability of a government in shaping the people’s mind to achieve goals that have been planned together in order to strengthen its administration especially in establishing diplomatic relations with other countries. Without the mobilization of intellectual and physical cooperation from these two groups, it is impossible for a government to succeed in its diplomatic missions. Therefore, this article will discuss the leadership of the Malay sultanate in establishing diplomatic relations through data analysis of the events described in historiographic manuscripts such as Sulalat al- Salatin , Al-Tarikh Salasilah Negeri Kedah , Hikayat Merong Mahawangsa and Tuhfat al-Nafis . In addition, this article also describes the effectiveness of this leadership in response to the diplomatic relations that had been initiated by and accepted from other governments. The result of the study will show that a variety of methods or approaches were used by the rulers of the Malay sultanate in advancing the government’s reputation from the economic, social and physical aspects. Tanpa penggemblengan daya fikir dan fizikal daripada dua golongan ini, adalah mustahil untuk sesebuah kerajaan itu berjaya dalam misi diplomatiknya. Oleh itu, makalah ini akan membincangkan kepemimpinan pemerintah kesultanan Melayu dalam hubungan diplomatik dengan menggunakan kaedah analisis data terhadap peristiwa yang terdapat dalam naskhah historiografi seperti Sulalat al- Salatin , Al-Tarikh Salasilah Negeri Kedah , Hikayat Merong Mahawangsa dan Tuhfat al-Nafis . Selain itu, tulisan ini juga menghuraikan keberkesanan kepemimpinan tersebut terhadap hubungan diplomatik yang ditawarkan dan diterima daripada kerajaan luar. Dapatan menunjukkan bahawa terdapat pelbagai kaedah kepemimpinan yang digunakan oleh pemerintah kesultanan Melayu untuk melonjakkan nama kerajaan yang diperintah dari aspek ekonomi, sosial dan fizikal. Malaysia and China have been enjoying cordial relations since 1974. In 2015, Chinese Premier Li Keqiang paid an official visit to Malaysia at the invitation of the Prime Minister of Malaysia, Najib Abdul Razak. This study aims to examine the framing of Malaysia–China relations as well as Premier Li’s visit to Malaysia by the mainstream Malay, English and Chinese-language newspapers in Malaysia, as well as the mainstream press in China. The findings indicate that the newspapers reported the topic with differing intensity and prominence, while employing different news sources. Economics and trade was found to be the most salient frame in the coverage by both the Malaysian and Chinese newspapers. In addition, this study also found that both Malaysian and Chinese newspapers mostly used neutral valence in reporting about Malaysia–China diplomacy and Premier Li’s visit to Malaysia. The frame built by the newspapers can be attributed to the fact that they have the inclination to serve the political and economic vested interests of their own countries.

Abstract:
This study argued that one of the primary reasons China-India renewed diplomatic intercourse after the border conflict of 2017 was the fear of emergent cross-border terrorism in the Southern Asia region. It also argued that, although both nations have different approaches to terrorism, there was a need for a collective fight against the emerging cross-border terrorist groups believed to have been strengthened by ISIS affiliation. Furthermore, the study revealed that India and China’s rising economic posture contributed to the renewed diplomatic ties. On these premises, this study is posed to examine the reasons and benefits of China-India’s renewed economic, diplomatic intercourse after the border conflict of 2017.Keywords: China-India, Economic Relations, Diplomatic Relations, Cross- border terrorismTulisan ini berargumen bahwa salah satu alasan utama China-India memperbarui hubungan diplomatik setelah konflik perbatasan tahun 2017adalah karena ketakutan akan terorisme lintas batas yang muncul di kawasan Asia Selatan. Tulisan ini juga berpendapat bahwa, meskipun kedua negara memiliki pendekatan berbeda terhadap terorisme, ada kebutuhan untuk perjuangan kolektif melawan kelompok teroris lintas batas yang diyakini telah diperkuat oleh afiliasi ISIS. AbstractThis article studies diplomatic history in its physical dimensions. Its point of departure is the interpretation of the term ‘corps diplomatique’ in a literal sense. The article introduces the concept of the diplomatic body as a diplomat's body and as a body with diplomatic functions and meanings. Based on material relating to the British Legation in Kabul from 1922 until 1947, the body's ubiquity in international relations is revealed through the themes of space, language, and medicine. The article first looks at the impact of Kabul's spatial conditions and the physical reactions it excited in British diplomats. It then considers the bodies of Afghanistan's ruling elite as objects of British attention, whose appearance was documented in diplomatic records. Descriptions of these bodies in diplomatic language expressed intimacy and consensus as well as estrangement in British–Afghan relations. In addition to the metaphorical use of the diplomatic body, the provision of healthcare through the Legation's medical unit addressed the needs of British and Afghan bodies alike. It was also employed to further diplomatic ends by extending colonial medicine to the Afghan population. The study of the Legation's physical practices ultimately reveals the diplomatic mission's colonial origins and character.

Of particular importance are the relations of the Republic of Uzbekistan with countries of the world, diplomatic relations, economic and investment cooperation, relations between countries in the cultural and humanitarian spheres. The Republic of Uzbekistan and the Federal Republic of Germany have one of the most important and complex bilateral relations. Coordination and intensive implementation of the programs of cooperation of the Republic of Uzbekistan with the Federal Republic of Germany in political,economic, scientific and technical and cultural spheres, formation of a mutually beneficial atmosphere of trust and interest between Uzbek and German partners, investment of Germany, the main directions, such as creating favorable conditions for the implementation of economic changes in Uzbekistan with the involvement of management experience and technologies, are precisely the factors that indicate the relevance of this topic. The strategic competition they provide is one of the pressing issues of particular importance. The Federal Republic of Germany has taken a strong position in its relations with the Republic of Uzbekistan, working closely with its allies and partners to protect their interests and values. Currently, the policy of the two countries in world politics is taking its toll on other countries.

The article looks at some aspects of Yugoslav-Italian economic relations from the end of the First World War to the beginning of the Great Depression. Those relations were not always driven by pure economic interests, but they also had political and strategic aims. Although Yugoslav-Italian political and diplomatic relations were well served in both Serbian/Yugoslav and Italian historiography, little has been written about economic relations between the two countries. Therefore, the article is mainly based on the documents from the Central State Archives (Archivio centrale dello Stato) and Historical-Diplomatic Archives of Ministry of Foreign Affairs (Archivio storico-diplomatico del Ministero degli Affari Esteri) in Rome, as well as from the Archives of Yugoslavia (Arhiv Jugoslavije) in Belgrade.

English abstract: This article analyzes the causes of low trade relations between Indonesia and Latin American states, arguing that dynamics of international political economy have opened opportunities to increase trade relations between those countries. Having good diplomatic and political relations with similar emerging economies, like Peru and Chile, should drive closer economic relations among them. A qualitative study was conducted using literature reviews, archival analysis, and in-depth interviews. Political will and lack of knowledge pertaining to the business character of each country hamper external relations. Thus, a functional multi-track diplomacy that incorporates state and non-state actors from various fields is crucial for enhancing economic relations among these countries. Trade relations can be particularly strengthened by maximizing cooperation among actors at various levels.Spanish abstract: Este artículo analiza las débiles relaciones comerciales entre Indonesia y América Latina, argumentando que la dinámica de la economía política abre oportunidades para mejorar estas relaciones. Las buenas relaciones diplomáticas y políticas entre Perú y Chile, debería estrechar sus relaciones económicas. Pero la escasa voluntad política y falta de conocimiento del carácter empresarial de cada país, obstaculizan sus relaciones externas. La investigación incluyó revisión de literatura, análisis de archivos y entrevistas en profundidad. Los resultados subrayan la necesidad de una diplomacia funcional de múltiples rutas que incorpore instituciones estatales y no estatales de diversos campos para mejorar las relaciones económicas. Las relaciones comerciales particularmente pueden fortalecerse entre países maximizando su recíproca cooperación en cada nivel (diplomacia multinivel).French abstract: Cet article analyse les causes de la faiblesse des relations commerciales entre l’Indonésie et les pays d’Amérique latine en faisant valoir que la dynamique de l’économie politique internationale a ouvert des opportunités pour stimuler les relations commerciales entre ces pays. Cette étude qualitative a été menée sur la base d’une étude de la littérature existante, d’analyses archivistiques et d’entretiens approfondis. Le manque de volonté politique et surtout de connaissances réciproques des atouts commerciaux de ces pays entravent leurs relations extérieures. Ainsi, une diplomatie fonctionnelle à plusieurs voies qui intègre des diplomaties étatiques et non-étatiques dans divers domaines est-elle cruciale pour améliorer leurs relations économiques. Les relations commerciales peuvent notamment être renforcées en maximisant la coopération entre ces pays à chaque niveau (diplomatie multi-niveaux).

The first chapter introduces the current work of the International Law Commission relating to subsequent conduct of treaties. Second chapter defines diplomatic privileges and immunities, three theories of diplomatic immunity and its historical background. Third chapter elaborately analyses treatment of diplomatic bag in Vienna Convention on Diplomatic Relations. Fourth chapter presents an overview of cases of abuse of the diplomatic bag or violation of its inviolability. Finally it introduces options, how states can fight against such abuses.

Abstract:
This thesis examines the political relations between England and the Iberian Peninsula, from the accession of Henry II of England to the death of Alfonso X of León-Castile, an episode in diplomatic history that remains largely unexplored. This period, spanning over a century and a half, was punctuated by a series of key political events. The study of these sheds light upon the diplomatic complexities of the period. Chapter One explores the historiography and the particularities of Spanish documentary sources. Chapter Two analyses the use of the word Hispania in thirteenth-century chronicles and charters, in an attempt to discover how the term was used and to whom it referred. Chapters Three examines the close relations between the crown of Aragón and the vicomté of Béarn in the twelfth century, while the following chapter looks at the unification of Catalonia and Aragón and the implications of the marriage between Eleanor of England and Alfonso VIII of Castile. Chapter Five explores the impact of Richard I and John’s alliances with Navarre. As León-Castile consolidated is power in the Peninsula, there was a shift of alliances, reflected on Anglo-Iberian relations. Chapter Six explores the particular circumstances that brought about the treaty of 1254 between Henry III of England and Alfonso X of Castile. No study of the political relations of the period would be complete without examination of the impact of the imperial controversy and interregnum upon relations between Henry III of England (the brother of a claimant) and Alfonso X of Castile (a claimant in his own right). Finally, Chapter Eight studies the failed marriage of the infante Sancho of Castile and Gilhelme (Willemina), the younger daughter of the vicomte of Béarn, Gaston VII. This involved negotiations between Edward I of England, Philip III of France and Alfonso X of Castile.

Rules of diplomatic immunity, which nowadays are enshrined in the Vienna Convention on Diplomatic Relations, play an important role in interstate diplomacy because they ensure the efficient performance of diplomatic functions. This thesis investigates a particular form of diplomatic immunity - diplomatic immunity ratione materiae. Unlike diplomatic immunity ratione personae, which pertains to the personal status of a diplomatic agent, diplomatic immunity ratione materiae depends in essence on the official nature of a particular act In practice, however, the determination of diplomatic immunity ratione materiae may meet with many conceptual and practical difficulties. For one, it is not always easy to distinguish the official acts of a diplomatic agent, who represents the sending State in the receiving State, from his or her private acts. In case of disagreement between the two States, questions may also arise as to who has the authority to make a final determination. The Vienna Convention does not offer much guidance on these issues; on the contrary, the Convention complicates them by employing, without adequate explanation, distinct formulas for different kinds of diplomatic immunity ratione materiae. This thesis examines these formulas in detail. On a general level, it is submitted that diplomatic immunity ratione materiae for certain types of activity constitutes not only a procedural bar to court proceedings but also a substantive exemption of individual responsibility. More specifically, it is argued that each formula must be understood in the light of the rationale behind immunity, the type of immunity concerned, and the specific functions or duties performed. In case of controversy, weight should be given to the opinion of the sending State, although the authority to make a decision lies ultimately with the court of the receiving State.

Abstract:
The present study attempts to understand the shift that occurred in Saudi-British relations by the year 1953. The tracing of such a shift is dealt with by investigating the development of these relations from 1939 and through to 1953.The research is drawn upon a documentary diplomatic history method reinforced by an analytical approach. Within the framework of analysis, the Realism approach to international politics is selected. Certain assumptions that most of - classical and modern - Realists agreed upon are in use, specifically the state-centric assumption, the rationality assumption, the unitary assumption, the anarchic assumption, and the security assumption. As is clear from existing secondary sources, Saudi Arabia and Britain enjoyed a kind of special relationship in the early 1940s, but by the last year of King Ibn Saud's reign (1953) these two states' relations had deteriorated into severe conflict. Though some existing sources have attempted to shed some light on that development, their findings are indeed modest. In fact, none of this literature has studied the topic from a purely Saudi-British perspective, nor has any of it explored and analysed the matter with the depth that it deserves. By focusing on Saudi-British relations the chapters of this thesis are endeavouring to answer profoundly a variety of questions that affected the main course of these relations. By questioning the impact of certain issues on Saudi-Anglo relations - such that of Saudi-US relations, the security concept, the Saudi-Hashemite problem, and the frontier conflict - the thesis will address its main theme.

The rule of non-interference in the internal affairs of the receiving State, which is today enshrined in Article 41 (1) of the Vienna Convention on Diplomatic Relations, contains a fundamental duty of the diplomatic agent. But the Convention does not define the scope and extent of the concept of interference, nor its relationship with norms which inform its character. This thesis investigates a particular form of interference: interference through the diplomatic message. In its first part it examines the problems arising from an analysis of the available sources on the law of diplomatic interference. Non-state actors not only play the role of diplomatic consumers in the international community, but also as diplomatic participants. Especially before the diplomatic relations between China and South Korea, non-state actors, through economic exchanges, played a particular role in improving the relations between the two countries. This study analyzes the improvement of China-South Korean ties from the perspective of non-state actors participating in economic exchanges divided into beginning, expansion, and maturity periods. In March 2022, while celebrating the 70th anniversary of Indo-Japanese diplomatic relations, Japan’s Prime Minister announced his country’s plan to invest USD 42 billion in India over the next five years. This policy brief, the first in a two-part series dedicated to India–Japan investment relations, examines whether, if realised, this plan would be a true game changer in Indo–Japanese investment relations. It finds that, historically, Japanese investments in India have mostly followed the broader trends in India’s ability to attract FDI, as well as Japan’s global investment position, and while over the last eight years Indo–Japanese diplomatic relations have intensified remarkably, this has only translated to a mild relative (although significant absolute) increase in Japanese investors’ role in the Indian economy. Against this background, the realisation of PM Kishida’s March announcement would only require a moderate uptake in the trends of the past decade. Whether this happens, however, is more a function of India’s ability to implement further meaningful reforms than of the spirit of high-level bilateral relations.

Abstract:
This paper explores Japan’s position in relation to Taiwan including Japanese policy options in different potential conflict scenarios around the island. Japan has a substantial stake in the conflict, given its economic ties to China and Taiwan, energy security, and its military alliance with the United States. In recent years, Japan’s deterrence capabilities were greatly enhanced by the reinterpretation of its constitution in 2014, as well as the development of its military capabilities. Regardless of its pacifist heritage, its geographic proximity and diplomatic as well as security relations make Japan an innate part of any conflict over the fate of Taiwan. The main conclusion is that these factors, as well as its vital economic and strategic interests make the Japanese position not radically different from other countries reacting to similar crises.

In a globalised world, the effects of climate change are likely to cascade across borders. Climate impacts in one location may have far reaching consequences in other places by affecting trade, migration, investments, and foreign policy objectives. Whether such cascading effects are likely to materialise depends in turn on a number of social, economic, and political factors that reinforce or attenuate the effects of climate change on economic development, migration, political stability, etc. These moderating conditions are crucial when considering possible challenges in connection with climate change, and opportunities for addressing them. In this report, we discuss the possible effects of climate change on issues at the core of European foreign, security, and development policy – namely, the impacts of climate change on livelihoods, food security, migration, and political stability in regions with close ties to Europe, where those impacts may affect European foreign policy objectives in a significant way. Across regions, we identify a number of challenges and opportunities in different scenarios, which assume either more or less favourable moderating conditions (i.e., with regard to technology and physical infrastructure; resource and conflict management; economic opportunities; trade and access to markets; governance and state-citizen relations; and social and diplomatic relations). Despite important challenges and mounting climatic pressures in all considered regions, our results leave some room for optimism. Depending on their ability to build strong and inclusive institutions, promote sustainable development, and strengthen social and diplomatic ties, affected countries and their partners might be able to reduce the risk of adverse cascading effects in connection with a warming world. Climate change will become increasingly challenging in the coming years, yet its effects are ultimately determined by social, economic, and political factors. Studying what makes societies susceptible to be adversely affected by climate change and how such conditions evolve over time then gives an indication of where to direct adaptation efforts. The moderating conditions presented in this report offer as many “levers” for preparing against the adverse effects of climate change.

The aim of present study is to provide a concise review of Serbia’s military neutrality, both the conditions of its “genesis” in 2007 and its “operationalization” in form of strategic documents and military cooperation during the period of Serbian Progressive Party (SNS) government (2012-2021), with special emphasis on the presidency of Aleksandar Vučić (2017-2021). The paper concluded that the “genesis” and maintenance of Serbian neutrality is due to both internal political considerations, as well as Serbian diplomatic exigencies with regards to the unresolved status of Kosovo. The long-term sustainability of Serbian neutrality policy, however, cannot be taken for granted. The delicate „balancing act” between the West, Russia, and increasingly, China, might not be sustainable in the future if relations between the West (and in particular, the EU) and China or Russia, deteriorate further, or when Serbia’s EU accession process enters its „final stretch”.

This rapid review focuses on Global Health Diplomacy and defines it as a method of interaction between the different stakeholders of the public health sector in a bid to promote representation, cooperation, promotion of the right to health and improvement of health systems for vulnerable populations on a global scale. It is the link between health and international relations. GHD has various actors including states, intergovernmental organizations, private companies, public-private partnerships and non-governmental organizations. Foreign policies can be integrated into national health in various ways i.e., designing institutions to govern practices regarding health diplomacy (i.e., health and foreign affairs ministries), creating and promoting norms and ideas that support foreign policy integration and promoting policies that deal with specific issues affecting the different actors in the GHD arena to encourage states to integrate them into their national health strategies. GHD is classified into core diplomacy – where there are bilateral and multilateral negotiations which may lead to binding agreements, multistakeholder diplomacy – where there are multilateral and bilateral negotiations which do not lead to binding agreements and informal diplomacy – which are interactions between other actors in the public health sector i.e., NGOs and Intergovernmental Organizations. The US National Security Strategy of 2010 highlighted the matters to be considered while drafting a health strategy as: the prevalence of the disease, the potential of the state to treat the disease and the value of affected areas. The UK Government Strategy found the drivers of health strategies to be self-interest (protecting security and economic interests of the state), enhancing the UK’s reputation, and focusing on global health to help others. The report views health diplomacy as a field which requires expertise from different disciplines, especially in the field of foreign policy and public health. The lack of diplomatic expertise and health expertise have been cited as barriers to integrating health into foreign policies. States and other actors should collaborate to promote the right to health globally.

In 2022, UNIDIR released primers for each of the three domains in which uncrewed systems operate (air, land and sea). While each primer gives an in-depth introduction into each type of uncrewed system, this compendium provides a comparative overview that highlights the common developments and security implications of these systems, as well as what distinguishes them. The focus of the compendium is on describing the main areas of technological innovation and development related to the key components that comprise uncrewed systems, outlining the anticipated areas of progress and potential concern, as well as areas of overlap between key enabling technology across the three types of systems. This compendium aims to provide policymakers, diplomats and other non-technical interested parties with an introductory overview and comparative overview of technological developments and their security implications relating to uncrewed systems in the air, land, and maritime domains. The compendium, as well as the primers, also serve as technical guides on issues relating to uncrewed systems for use within frameworks and processes where such systems are relevant and discussed, such as the Group of Governmental Experts (GGE) on the continuing operation and relevance of the United Nations Register of Conventional Arms (UNROCA) and its further development, the Conference of States Parties to the Arms Trade Treaty, and the GGE on Lethal Autonomous Weapons Systems.
