Full textGiven the large diversity of situations characterising the different territorial sub-state components of the European Union (EU), community law incorporates various possibilities of legal territorial differentiation. Far from hindering the integration process, differentiation between territorial sub-entities of EU member states allows to continue that way, while supporting the effective implementation of EU law. From this perspective, two main methods of dealing with territorial diversity can be identified. On the one hand, a method takes into account ad hoc territorial specificities through the authorisation of differentiated rules adapted to each particular case. The other method is one of rationalised diversity management, based on the categorization of territorial components for the definition and implementation of policies with a strong territorial dimension. The latter favours a clearly positive and definitely objective approach for legal territorial differentiation. Nevertheless, new methods for the differentiated management of territorial diversity must be envisaged, as part of a process that favours planning and the balanced and sustainable development of the EU, linked to the repeatedly stated objective of its territorial cohesion. Respecting local and regional contexts and going beyond sectoral thinking, the various EU policies should be more coherent, particularly those with important geographical implications. In this respect, it is essential that the different actors of territorial development, both at a horizontal and vertical level, cooperate and consult each other. Considered a more general and flexible component of EU law, intra-state differentiation progressively enters the framework of this quest for coherence and better territorial governance within the EU. As territorial diversity grows in line with EU enlargement, the enrichment, diversification and improvement of legal differentiation methods, in relation to a synthetic vision of this large entity, gradually benefit its awareness as a European territory, well beyond its infra-state components

Full textSchengen, NATO, EMU, opt-outs, enhanced cooperation: doctrinal analysis focuses on intergovernmental differentiation. EU-Law however offers a fertile ground for a multilevel interpretation of that principle : sub-national autonomy within Member States'constitutional framework as well as the EU Regional Policy embrace territorial differentiation whereas European Case Law provides for differentiation at individual level. The EGTC-Regulation constitutes the first EU-Law establishing a common legal basis for territorial cooperation, including those three levels of differentiation, thus granting for such a multilevel approach. Within an EGTC (Statutes and Conventions), Member States, local and regional authorities like numerous bodies governed by public law autonomously define specific norms : such contractual differentiations, with respect to constitutional differentiations foreseen by the regulation, alludes to a contractual form of subsidiarity. Within the EU, the EGTC regulation allows a bottom-¬up territorial differentiation, hitherto confined to a top-down approach ruled by Member States (Council of Europe, Regional Policy). The regulation also potentially permits a differentiation of EU-Citizenship and, beyond, of fundamental rights as yet implemented through European Courts of Justice. Loosening the modalities of territories’ articulation, that coherent regime of differentiation, within the regulation’s limits, deeply renews the techniques of European integration towards the contractualist and personalist perspective of the integral federalism

Full textPartant ici de ce double constat, et plaçant au centre de notre réflexion le triptyque " TIC -- Territoire -- Acteurs économiques ", nous rappelons tout d'abord comment les TIC en sont venues à occuper la place qui est la leur, aujourd'hui, dans l'économie, en étant
introduites au sein de territoires servant certes de réceptacles mais surtout de ressources à leur développement. Les TIC se sont par ailleurs insérées dans des schémas de localisation et d'organisation de
l'activité économique venant alors à être réinterrogés (notamment en
terme de métropolisation). Enfin, les TIC repositionnent les différents acteurs économiques (surtout publics) au centre d'enjeux nouveaux pour
les territoires.
Les terrains de ce travail, " territoires en archipel ", nous permettent notamment de nous interroger sur les effets de métropolisation de l'activité liée aux TIC, d'une part en effectuant une étude statistique
autour des métropoles bordelaise, toulousaine et marseillaise, et en étudiant, consécutivement en France et au Canada, une métropole et une ville -- ou " territoire numérique " -- se localisant dans son
arrière-pays. Il s'agit donc d'étudier quelle est la place des TIC, et la manière dont s'en saisissent les différents acteurs économiques, tout d'abord au sein de la métropole toulousaine puis dans le bassin de
Castres-Mazamet, ce dernier constituant le véritable coeur de ce travail. De même, avec des échelles incomparables mais des stratégies différentes justifiant le positionnement des acteurs territoriaux,
Montréal et Bromont, au Québec (Canada), permettent de renouveler l'illustration de l'importance de la place des TIC, à la fois en matière de développement économique et de développement territorial.
Si les métropoles s'inscrivent bien sûr dans une optique de développement technopolitain, les " territoires numériques " ont plutôt
pour objectif, quant à eux, la dynamisation et la différenciation, dans le jeu actuel de la concurrence territoriale, mais aussi la complémentarité avec cette métropole voisine contre laquelle il serait de toute façon impossible de lutter.
Malgré les échelles et les stratégies différentes, ces études démontrent certaines récurrences, comme la place et le rôle des différents types d'acteurs considérés, la force de la métropolisation (notamment en matière de marketing territorial) et l'importance du temps. Enfin, se pose la question de l'échelle pertinente et de la bonne gouvernance, en
matière de gestion des TIC ; si des études récentes relevaient l'importance du niveau régional, on peut s'interroger sur la place que prennent actuellement les intercommunalités et autres communautés d'agglomérations, dans le domaine du développement local axé autour des TIC.

Full textFrom the 1990’s health administration became part of a regionalization movement resulting in the setting up of the regional health agencies. These structures, and the methods adopted to reorganize the regional steering of health matters, marked the importing into the heath sector of the trends involved in the renovation of the French administrative machinery.Throughout the 20th century, the « territorialization » of the public policies followed the tempo of a two-step waltz, with a mix of « deconcentration » and decentralization. It is therefore possible to question the place given to thelocal authorities in the steering of regional health matters. The specific investment made by some authorities, such as the former Nord-Pas de Calais Region, raises further questions.After having observed the place given to the local authorities in the health architecture, we will look into the reasons for this, especially as regards the “Region”. In many respects the choices made do not appear to be in step with the legal and political dynamics on which decentralization, seen from a global standpoint, is based. We will try to understand the reasons behind this differential treatment of health issues, before looking ahead to what healthsector decentralization might be; i.e. in short, the completion of the health regionalization process

Full textThe infra-State body represents a pluriform institutional reality and a fragmented geographical reality of the regional and local dimension in EU Member States. Its European legal status is appeared in large part under jurisdictional impetus. The review of the case law of the Court allows to identify and to characterize this legal status. We note that European legal status of the regional or local authority is ambivalent and hybrid in character because of this specificities of the legal system of the European Union. On the one hand, the regional or local authority is assimilated sometimes to the status of the EU Member States, sometimes to the status of the individuals. That ambivalence in terms of legal status, as a subject to European law, cornes from the specificities of the mission of the Court. The Court must be insuring the primacy of European law into national legal systems and into the legal order of the European Union. On the other hand, the Court should consider the requirements of the regional and local dimension of EU Member State. The infra-State body is as an object to EU regulation. The normative action of the regional or local authority is supervised with a view to european integration, and at the same time, a special normative body for overseas regions has developed. We note that the Court contributes to define the normative corpus applying to the regional and local dimension in EU Member States

Full textLocal preference is a sensitive issue. It fascinates those who claim it. It tenses up those who reject it. In the French legal order, this favorable measure is assimilated as a positive discrimination carrying a territorial differentialism. In a sense, local preference would be the legal phenomenon where the respective limits of the principles of equality and indivisibility of the Republic converge. Local preference would therefore be inherently suspect. The objective of the thesis breaks with these premises. Local preference can be reconciled with the French republican, universalist and indivisible model. To this end, it was first necessary to identify the characteristic features of local preference. This step revealed that local preference, like any positive discrimination, carries typical functions: both legitimate and subversive. Nevertheless, its beneficiaries remain atypical. Local preference is less than an ethnic preference, but more than a territorial preference. Secondly, it was necessary to consider the applicable regime. As such, local preference is characterized by a form of duality. Its integration is based, first, on positive constitutional authorization. In this case, the local preference falls, to some extent, within the competence of the local government. It is then based on a negative constitutional authorization. In this case, local preference falls, in principle, within the competence of the central power. These integration regimes question the aporias of the republican model which, while easily recognizing a right of local preference, struggles to realize a right to local preference
