Craig, Paul. EU Administrative Law. Oxford University Press, 2018. http://dx.doi.org/10.1093/oso/9780198831655.001.0001.

Full text
Abstract:
The third edition of EU Administrative Law provides comprehensive coverage of the administrative system in the EU and the principles of judicial review that apply in this area. This revised edition provides important updates on each area covered, including new case law; institutional developments; and EU legislation. These changes are located within the framework of broader developments in the EU. The chapters in the first half of the book deal with all the principal variants of the EU administrative regime. Thus there are chapters dealing with the history and taxonomy of the EU administrative regime; direct administration; shared administration; comitology; agencies; social partners; and the open method of coordination. The coverage throughout focuses on the legal regime that governs the particular form of administration and broader issues of accountability, drawing on literature from political science as well as law. The focus in the second part of the book shifts to judicial review. There are detailed chapters covering all principles of judicial review and the discussion of the law throughout is analytical and contextual. It begins with the principles that have informed the development of EU judicial review. This is followed by a chapter dealing with the judicial system and the way in which reform could impact on the subject matter of the book. There are then chapters dealing with competence; access; transparency; process; law, fact and discretion; rights; equality; legitimate expectations; two chapters on proportionality; the precautionary principle; two chapters on remedies; and the Ombudsman.

Craig, Paul, and Gráinne de Búrca. 10. EU International Relations Law. Oxford University Press, 2015. http://dx.doi.org/10.1093/he/9780198714927.003.0010.

Full text
Abstract:
All books in this flagship series contain carefully selected substantial extracts from key cases, legislation, and academic debate, providing able students with a stand-alone resource. This chapter discusses EU law on international relations. The area of external relations has become increasingly important in recent years, as the EU strives to enhance its global presence on issues such as trade, climate change, development, human rights, and international terrorism. Some of the crucial issues for the conduct of EU international relations are effective coordination across policy fields, coordination between the EU and the Member States, and coordination at the level of international representation. Consistency across and between policies has become a constitutional requirement of EU external relations.

Abstract:
All books in this flagship series contain carefully selected substantial extracts from key cases, legislation, and academic debate, providing able students with a stand-alone resource. This chapter discusses EU human rights law, and the way in which the ECJ developed fundamental rights as part of the Community legal order. The analysis includes the drafting of the EU Charter of Rights, and its application in the post-Lisbon world in which it is legally binding on the EU and on Member States when they act in the scope of EU law. The EU has gradually integrated human rights concerns into a range of its policies. The EU actively promotes its ‘human rights and democratization’ policy in many countries around the world, and uses human rights clauses in its international trade and development policies. It has imposed a human rights-based ‘political conditionality’ on candidate Member States, and claims to integrate human rights concerns throughout its common foreign and security policy.

Full text
Abstract:
This unique compilation of materials, cases, and commentary on EU external relations law is both a valuable teaching tool for (post-)graduate courses and seminars on the foreign relations of the European Union, as well as an indispensable first initiation in the legal foundations of the external action of the Union for diplomats, civil servants, attorneys, and other practitioners. Apart from making accessible key primary materials such as EU Treaty provisions; judgments and opinions of the Court of Justice; legislation; agreements; and more obscure documents revealing the law in practice, the book includes concise, expert legal analysis of these materials. The third edition of the book incorporates more than ten years of fascinating dynamics since the entry into force of the Lisbon Treaty. Apart from analysing the general basis of the Union’s external action and its relationship to international law, the book explores the law and practice of the EU in more specialized fields of external action, such as common commercial policy, neighbourhood policy, development cooperation, cooperation with third countries, humanitarian aid, external environmental policy, and common foreign and security policy, as well as EU sanctions. The chapters contain numerous cross-references with a view to facilitating the establishment of connections between different issues and fields of law. Annotations and materials are kept to what is strictly necessary to place them in their context and to clarify links to documents presented elsewhere in the book.

Martin, Colin J., John Le Heron, and Penelope Allisy-Roberts. Radiation protection legislation. Oxford University Press, 2015. http://dx.doi.org/10.1093/med/9780199655212.003.0005.

Full text
Abstract:
Radiation protection standards and practice have been developed through the cooperationof international organizations able to call upon experts from around the world. The ICRP hasbeen central to this development, establishing through its recommendations the principles ofjustification, optimization, and dose limitation that have been the foundations of radiationprotection practice for over 30 years. The IAEA, under the auspices of the UN, establishessafety standards based on ICRP recommendations which all countries can use in developingtheir own regulations and codes. Other groupings of countries such as the EU develop theirown standards or directives which are then enacted in the national legislation of memberstates. Brief descriptions of the legislative structure in a selection of countries are included toprovide an indication of the range of systems in place.
