Full textA vision and an overall coherence: these are the qualities that were missing from the notion of Ŗsignificant imbalanceŗ inscribed in three rules of the Consumer code, the Commercial code, and, most recently, the Civil code. These are also the objectives that this study proposes to achieve through a double approach. First, it proposes a unitary and sequenced method of qualifying the significant imbalance constructed from the two special rules, and, while being applicable to each of special rules, it can also be generalized beyond them in the general rule of common law. Secondly, it elaborates to form a solution principle intended to govern the articulation between the new rule of common law and one of the pre-existing consumer or competition law, consisting of a principle of non-cumulation and non-option which requires, more broadly, a redefinition of the scope of both

Full textDesequilibrium analysis presents the functionning of a decentralized economy where prices are fixed throughout the short period and describes quantity adjustments necessary for transactions to take place. After a presentation of this approach, three critical notes are formulated : the economy described is not a monetary economy; disequilibrium cannot be estimated or does not even exist; explanation of price changes is unsatisfactory. By introducing credit market and financial values, one can remove the first criticism. A stochastic approach enables adjustments to be estimated. Partial price flexibility is studied, too. But excess of rules and regulations does not produce only price rigidity throughout the short period. Quantities inflexibility has therefore to be studied and a price adjustment mechanism to be developped under disequilibrium hypothesis. Because of an arbitration between the two mechanisms, adjustments can take place by turns during the same period while dynamic analysis shows their alternance by period. They can also coexist like in cobweb models or when the economy is characterized by a "contraints-field"

Full textThe price theory belongs to the general theory of the adjustments in desequilibrium. Its progressive elaboration is today certainly one of the most significant development of the economic analysis. In the view point the purpose of this work is to make a synthesis between the equilibrium theory with quantity rationing and the general equilibrium theory in the case of imperfect competition with price-maker. Since 1975 the main concern of the equilibrium models with rationings has been to explain how the prices are made. Than the purpose was no longer to justify the fixed-prices but rather to care about the inter-temporal problems of coordination ; one of the most important concern of the economics. This attitude has lead us : 1 - to present the equilibrium theory with quantity rationing. A presentation which provides the necessary concepts in order to be able to understand the theory. These concepts help us to observe the contribution of the information price-quantity ; 2 - to study the adjustment-processus which are slightly different of the traditionnel fixed-price method. Full textThe objective of the theory of temporary equilibria with rationing to the determination of quantities when prices, wealth distribution and agents' expectations are given. Accordingly, it supplies a microeconomic foundation for macroeconomic analysis such that it is presented in is-lm tradition. However, quantities solutions that appear are not stationary as long as agents' endowments cannot remain unchanged when trade occurs, and as they are not necessarily satisfied with the transactions they realise. Prices being given, dynamic adjustment of stocks leads to steady states whose stability and comparative static properties are not always the same that those of temporary equilibria. In order to study prices adjustment in disequilibrium situations, it is necessary to exhibit an exact measure of the effective excess demand that appears in a fixed price equilibrium. From this point of view, the theory of effective demand under stochastic and manipulable rationing is better than that one can get from deterministic and non-manipulable rationing schemes. To every price vector, it associate a locally unique temporary equilibrium with a vector of effective excess demand that must go to zero when prices move according to this "law of supply and demand". This price adjustment may be associated with that concerning stocks into a "non tatonnement" process. However, non competitive price dynamics are not to be excluded since, when prices move slowly, agents can rationally hold non walrasian conjectures about their trading possibilities

In the french practice, we demonstrated, in a first part, the aspects of the prestations disequilibrium, high rent, risks and charges assumed by the lessee, optimum protection of the lessor's guaranty, inadequate protection of the lessee in case of concealed defect and dangerous consequences in case of lessee insolvency. In a second part, we proved that the juridical order has shown its passivity towards lessor's abuse of both of contractual technics and private law notions, and so has permessed the disequilibrium. As we noticed the inefficiency of the requalification of the leasing convention, we proposed a new organising imperative regulation of the convention or a power given to the judge for supervising the terms of the convention

Full textBasing on theory of disequilibrium and using techniques of optimal control, this thesis wants mainly to build up an international model of general disequilibrium. Representative agents are firms, consumers and the government. The market of goods and that of labor can be in disequilibrium, though that of money is always in equilibrium, this because of a hypothesis of rigidity of price system. The model assumes rational expectations. Consumers and firms maximize respectively their discounted utility functions and discounted cash-flows subjects to quantity and price constraints in an infinite horizon. Firstly, temporary equilibria of Keynesian unemployment, of classical unemployment and of repressed inflation are analyzed as well as their conditions of existence. These three parallel studies make possible an instantaneous partition of the space of the two variables which contain the influence of expectation formed by agents. This partition corroborates the idea of self-fulfilling expectations. Secondly, the dynamic analysis specific to one regime is made possible by linearizing the model around the steady state of the considered regime since the method of simulation based on “multiple-shooting” gave inconsistent results. Thus, the resolution of this model comes to a determination of eighen values and eighen vectors. The assumption of rationality of expectation allows studies of announcement effects of an expected shock. Several experiments of economic policy are undertaken inside of the regime of Keynesian unemployment. Most of these experiments clearly show the effect of the announcement immediately after the announcement of the measure. Generally, long run substitution affects clog the immediate impact of the injected measure

Full textChronic kidney disease (CKD) is associated with dramatically increased cardio-vascular morbidity and mortality. Not only do traditional risk factors explain this accelerated atherosclerosis, but also chronic inflammation, oxidative stress and endothelial dysfunction. Uremic toxins are solutes accumulating in serum and tissues of CKD patients. Among them, protein-bound uremic toxins are poorly removed by haemodialysis (HD), and have shown deleterious effects on cultured endothelial cells (HUVEC). We showed that indoxyl suphate (IS), a protein-bound toxin, induces reactive oxygen species production in HUVEC, through activation of NAD(P)H oxidase, and intracellular glutathione depletion. This induction of oxidative stress was observed for concentrations of IS found in CKD patients. CKD patients exhibit high levels of endothelial microparticles (EMP), a marker of endothelial lesion, and low levels of endothelial progenitor cells (EPC), originating from bone marrow and implied in endothelial repair. We asked whetehr uremic toxins could play a role in this imbalance. In HD patients, we showed that the number of CD34+/CD133+ EPC was inversely correlated with the serum levels of two uremic toxins, indole-3-acetic acid (IAA, a protein-bound uremic toxin close to IS) and ß2microglobulin. In vitro, IAA induced apoptosis of CD133+ cells, unless erythropoietin was added to the medium. Uremic serum induced EPC apoptosis. Although endothelial progenitor cell number was reduced in CKD patients compared to healthy controls, it was positively correlated with two markers of vascular lesion : the number of EMP in serum, and the pulse wave velocity reflecting arterial stifness. This suggests that EPC can be mobilized in the circulation upon vessel injury, in spite of uremic toxicity, and maybe thanks to erythropoietin treatment in HD patients. In conclusion, uremic toxins induce endothelial dysfunction, assessed by increased endothelial oxidative stress and shedding of EMP, and reduce regeneration capacities of endothelium. They are probably key actors in cardio-vascular risk of CKD patients

Full textIn the first part, we were interested in the criteria of oxygen supply/demand imbalance involved in the occurrence of a type 2 infarction. We explored in 610 patients the association between the parameters of these criteria and the occurrence of acute myocardial injury and type 2 infarction, as well as the correlation between these parameters and the extent of myocardial injury. Our results did not show any association between the importance of oxygen mismatch and the occurrence of acute myocardial injury. There was also no correlation with the magnitude of such injury. Therefore, we could not define strict restrictive thresholds that could be considered a significant myocardial stressor. In the second part, we compared the short-term and the long-term outcomes of patients admitted with an oxygen supply/demand imbalance condition according to the presence of myocardial injury or type 2 infarction and assessed the association of these pathological entities with mortality and major cardiovascular events. In this population of 824 patients, the occurrence of myocardial injury or type 2 infarction led to high in-hospital mortality of more than 20% and was significantly associated with it after adjustment for patient characteristics. In the follow-up of survivors, the outcome was dependent on comorbidities without the involvement of the occurrence of these initial myocardial injuries, with mortality rates of 27 to 35% and major cardiovascular events of 23 to 40%. We proposed to compare these results in another study, conducted prospectively, with a standardized 6-month follow-up of patients admitted for oxygenation failure, the methods of which are detailed here. This cohort consists of 670 patients whose data are currently being analyzed. Finally, in the third part, we focused on the 675 elderly patients, who represent more than 80% of our cohort, to determine the factors associated with the occurrence of these myocardial injuries and type 2 infarction according to age classes. We found very dependent patient profiles in these classes, linked to the epidemiological changes of aging. However, the individualization of type 2 myocardial infarction within acute myocardial lesions was not obvious, nor was the impact on mortality, which was essentially based on the burden of comorbidities

Full textThe psoriasis is a complex chronic inflammatory skin disease due to a strong genetic component as well as environmental factors. The only major locus for psoriasis susceptibility implicated to date, named PSORS1 on chromosome 6p21, has been demonstrated in various populations in linkage and association studies. It could nevertheless be responsible for up to 50% of the genetic contribution to the disease. The aim of my thesis was thus to identify the other genetic factors, in particular in the French population. To identify the loci, a linkage study was carried out, showing possible regions on 12q, 14q, 16p, 20p, in addition to that on 6p. Two loci on 6p and 20p were studied in more detail, revealing the contribution of the two genes, HLA-C and ADAM33. In parallel, a "candidate gene" strategy was undertaken, exposing a probable role of FLG, TGM5, CARD15 and CYLD genes and a confirmed role of SLC12A8 gene in the etiology of psoriasis

Full textThe main theoretical idea of this research is to introduce disequilibrium situations in a mundell-fleming type open economy model. The economy is compound, on the one hand, of the goods and labour markets with sticky prices in the short run. These markets are subject to quan titative rationings, and therefore produce spill-over effects on the other markets. On the other hand, the model contains the stock market and the balance of paiements that are always in equilibrium. A stochas tic specification is chosen for the effective demands and supplies of goods and labour. The parameters of the disequilibrium model are then estimated using a non-linear iterative optimisation procedure based on maximum likelihood method and the occurence probalities of the random regimes are computed (quarterly french data, period 1963-1984). A rationing on a market leads to three types of repercussions : intramarket restrictive effects, spill-over effects between markets and gross compensation effects with foreign markets. The results of various economic policies are studied. The computation of the occurence probabilities of the regimes shows some persistence of the classical un employment regime over the 1976-84 period in the industrial sector

But does this model sufficiently consider the arts of the circus, or the reality of all the risks taken by the artistes ? Drawing upon the history, studies on the ground, professional experience and daily confrontation with the practice, this work recreates the recent history of the circus arts in France and it's archaic sources, and proposes, following the risk factor, a new approach to the circus. The risk taking notion of instability and loss of balance is expanded upon, and considers the fluctuations of the artistic forms and economics, of the formation process, and of the physical and social risks that result from this practice. These types of expression and existence where the artist is permenantly exposed to loss of balance, are the basis for the hypothesis of the aesthétic of circus risks

Full textVersus the external disequilibrium the Moroccan authorities use policy measures to offset the impact on the economy. Our aim was to determine the efficiency of their decisions. Do the fiscal, monetary, exchange rate and industrialization policies permit the resorption of the current account deficit? Based on a statistical approach for the period 1973-1985, and a macro econometric model presenting 47 equations and 5 multipliers, our analysis show that the authorities were unable to set against the bop disequilibrium, the expansion of the external debt, and the upward of socio-economic pressures. Populations evolve under the evolutionary pressures, pressures that modify phenotypic traits, gene frequencies and might affect neutral diversity. The aim of the thesis was to quantify the importance of the different evolutionary pressures in selfing populations. For this, we studied the temporal evolutionary of neutral (microsatellite) and selected diversity in wheat population conducted under DM. In the first part, we analysed the emergence of new microsatellite alleles at different time intervals, we identified the origin and we characterized the dynamics of this novel diversity. New alleles were mainly due to microsatellite mutation , and mutation rates estimated here (10-3) emphasized the importance of mutation in the renewing of neutral diversity. In a study based on the genotyping of parents and their progenies, we were able to propose molecular mechanisms at the origin of mutation. In the second part, we studied the evolution of two adaptive genes: one involved in plant height, was submitted to strong directional selection whereas the second one involved in the yellow rust resistance was submitted to balanced selection. The genotyping of neutral neighbouring markers did not show any selective sweep event in region of normal recombination. This result proved the dynamic management program was very efficient to conserve diversity and particularly to favour recombination

Full textThe following thesis is a research about the art of performance in its aesthetic, political,ethical, cognitive and subjective implications; within the Brazilian anthropophagy tradition’s artistic and cultural context in the period when the art of performance emerges as an artistic genre, in the sixties and seventies. Faced with such implications, the art of performance not only indicates a process of hybridization of artistic genres and the relations between artist, work and spectator; but also indicates a whole different way of existence: « becoming-hybrid ». Defining « hybrid » as an intruder paradigm who overcomes the age of signification, one that assumes a hegemonic and uncritical trend in the world established by Western modernity; we ask ourselves about the critical contributions and challenges of becoming-hybrid in the art of performance and in the culture, especially considering the mechanisms that blocks the new ways of feeling and of production of subjectivity.To develop this discourse, we lean foremost on the concept of: the esthetic ideas of Deleuze-Guattari; the psychodynamic approach to subjectivity and the sensitive ways to deal with the otherness of thought of Suely Rolnik; the reformulation of the anthropophagic tradition according to the Anthropophagous manifesto by Oswald de Andrade; the theory of perspectivism; and the Amerindian myth by the anthropologist Viveiros de Castro. In this sense, in order to increase the critical power of the body and other ways of existence concerning the hybridization of the world, we propose the thinking of performing art as a hybrid paradigm of some another modernity. The way of creation, the resistance and the knowledge of the performer show a critical attitude and a heterogenetic dynamic, an alter-action of himself and of the world itself, which is very similar to the old anthropological matrix of anthropophagy. The performer, then, affirms the possibility of the emergence of another modernity, possibly linked to another kind of hybrid world, an animistic and completely anti monotheist world, which understands life as devouring, as immanence of the danger and imminence of the meaning. A world where social solidarity is defined by otherness and where the indian cogito would be « it exists, therefore it thinks »

Full textWe find carbon, oxygen and hydrogen in a large number of applications or processes involving electric arcs and thermal plasmas. These include: low-voltage circuit breakers with mixtures of air and organic vapor (due to the erosion of thermoplastic walls) inside the device, high-voltage circuit breakers for which are tested new gases or gas mixtures for filling the tank by replacing SF6, the treatment of biomass for synthesis gas production, processes for arc welding (MIG - MAG) but also processes for the ignition of reactive media, especially air - methane plasmas which are typical mixtures of electrical discharge for reactive media ignition of combustion. These kinds of processes are often studied theoretically using magneto-hydrodynamic models (MHD), under the assumption of local thermodynamic equilibrium (LTE). However, spark discharges involved in combustion ignition correspond to low power arcs for which the LTE hypothesis is relatively dubious. In this case, the temperature on the axis of the plasma remains relatively low. Thus the collisions are not enough efficient to ensure an equal distribution of the energy between the various chemical species in the mixture. The consequence is that the electrons have a kinetic temperature Te higher than that of the heavy species Tg. For an accurate theoretical study of this kind of discharge, taking into account the possible occurrence of departures from thermal equilibrium (Te ≠ Tg), it is necessary to develop multi-temperature MHD models. The implementation of these multi temperature models is often based upon 2T thermodynamic and transport property databases as a function of Te and of the ratio θ = Te /Tg. The present work falls under these considerations as it concerns the calculation of two-temperature (2T) Air - methane plasma properties: compositions, thermodynamic properties (mass density, enthalpy and specific heat at constant pressure) and transport coefficients (thermal conductivity, viscosity and electrical conductivity). The composition is obtained from the 2T mass action law and from the conservation equations (pressure, electrical neutrality and atomic proportions). Thermodynamic properties are then calculated analytically from the composition. Finally, transport coefficients are obtained from the Chapman-Enskog theory (extended to the 2T case) and from recent theoretical developments. The four contributions to thermal conductivity (translation of electrons, translation of heavy particles, internal and reaction) are calculated separately so that they can be used in a different way in the two energy conservation equations (electrons and heavy particles) involved in 2T MHD models

Full textThe aim of this work is to study disequilibrium in the algerian consumption goods market. For that purpose, we consider works done in this fieldfor centrally planned economies in eastern europe. These economies are said to suffer from sustained, significand excess demand. If we wish to test this hypothesis, we must admit for each observation the possibility that it reflects either positve or negagtive excess aggregate demand. The appropriate model must therefore allow that either buyers or sellers may encounter quantity constraints. Estimation in this context requires the techniques for dealing with markets in disequilibrium. That provides the opportunity to review the various available estimation techniques : full information maximum likelihood ; three pseudo-maximum likelihood methods and their simulated counterparts. On the basis of our results, excess supply seems to be the most frequent case and this justifies rejecting the hypothesis of sustained excess demand in the market for consumption goods. We cannot draw strong, unambigous empirical conclusions from this work, while considering the labour market on one hand and the second economy or the other,would appear to be very great indeed

Dans la seconde partie de ce travail, nous proposons un synthétiseur de fréquence agile sur 14 bandes dont les composants ont été optimisés afin de rendre sa réalisation la moins complexe possible et qui répondent aux exigences des systèmes MultiBandes en termes de temps de commutation, de bruit de phase et de pureté spectrale. Ce nouveau type de synthétiseur de fréquences rend inévitable le déséquilibre entre les voies I et Q de l'émetteur et/ou du récepteur. La troisième partie de ce travail consiste à proposer des algorithmes originaux permettant conjointement d'égaliser le canal et de compenser numériquement le déséquilibre IQ. Ces traitements valables pour tout système OFDM permettent de relâcher les contraintes de la partie analogique.

Full textThe study of the Vehicle to Grid (V2G) interactions is the main contribution of this research work. To charge an electric vehicle (EV) battery the overloading in low voltage (LV) residential networks is expected to be between 2 kW and maximum 10kW. To avoid power quality deterioration a battery recharge management is a priority for the charging infrastructure business. Our work has been, first, to study the impact of a significant number of EVs in recharge mode on the voltage and current unbalances in a LV residential electric network scenario and second to develop charging strategies to minimize those unbalances.First, we defined why it is important for the LV residential network to minimize the unbalances both in current and in voltage. Then, we studied the impact of different market penetration rates of the EV on the unbalances by estimating the sensibility of the statistical parameters describing them. Finally we developed several charging/discharging strategies in order to minimize the current unbalance by using optimization algorithms in the continuous and discrete domains. Several constraints were formulated in order to preserve power limits and an enough state of charge for the mobility
