Abstract:
Vernacular architecture represents a great resource that has considerable potential to define principles for sustainable design and contemporary architecture. This publication is the result of an overall aim to produce a valuable tool for analysis regarding vernacular heritage through different assessments, in order to define principles to consider for sustainable development. This was possible through a comprehensive reflection on the principles established and the strategies to recognise in different world contexts. The present publication was the result of an in-depth approach by 46 authors from 12 countries, concerned with the analysis and critical assessment of vernacular heritage and its sustainable perspective. The book presents 8 chapters addressing operational definitions and synopses advances, regarding the main areas of vernacular heritage contribution to sustainable architecture. It also presents 15 chapters and 53 case studies of vernacular and contemporary approaches in all the 5 continents, regarding urban, architectural, technical and constructive strategies and solutions. VERSUS, HERITAGE FOR TOMORROW: Vernacular Knowledge for Sustainable Architecture is the result of a common effort undertaken by the partners ESG | Escola Superior Gallaecia, Portugal, as Project leader; CRAterre | École Nationale Supérieure d’Architecture de Grenoble, France; DIDA | Università degli Studi di Firenze, Italy; DICAAR | Università degli Studi di Cagliari, Italy; and UPV | Universitat Politècnica de València, Spain. Abstract:
This chapter focuses on Terry Moe’s 1984 paper “The New Economics of Organization”, which offers an in-depth analysis of Congressional and presidential influence on the bureaucracy and suggests that these institutions, as well as their officeholders, have the incentive to influence bureaucratic policy. Moe urges scholars of public bureaucracy to emulate economists who study why firms exist in the marketplace. This chapter examines Moe’s main ideas on topics ranging from principal-agent theory to agency losses, the ability of political principals to effectively employ contract design to specify sanctions for bureaucratic agents, and how Congress and the Presidency go about trying to take advantage of bureaucratic manpower and expertise in order to meet their goals.

Full text
Abstract:
Stereokinetic phenomena are visual illusions of three-dimensional objects produced by various drawings stuck on a platform rotating on the frontal plane. They are of theoretical interest because the phenomena cannot be explained by a “rigidity assumption” like other structures from motion, but they can be explained by a Gestalt general principle that minimizes speed differences. Other unique factors included (a) they do not appear to rotate but describe a circular translation (a movement analogous to that of a hand drawing a circle with the thumb oriented to the left and all its points moving at the same speed); (b) they appear to be three-dimensional and solid; and (c) they appear of a well-defined length in depth. This chapter discusses stereokinetic phenomena, including the related principles regarding the rigidity assumption, speed minimum difference, minimum principle, rotating figures, three-dimensional illusions, rotating circles, rotating ellipses, and rotating bar.

Svantesson, Dan Jerker B. The Tyranny of Territoriality. Oxford University Press, 2017. http://dx.doi.org/10.1093/oso/9780198795674.003.0002.

Full text
Abstract:
This chapter provides an in-depth analysis of the sources most commonly cited concerning the reason why the current paradigm is so focused on territoriality. In particular, attention is given to the Lotus case and the Harvard Draft—the two sources often relied upon without proper analysis. In addition, a broader analysis is provided highlighting that: (1) the territoriality principle cannot alone be the jurisprudential core of jurisdiction; (2) a strict application of territoriality is destructive; (3) State practice has already moved beyond territoriality, territorial sovereignty, and the Harvard Draft principles; (4) the imprecise, and conceptually flawed, concept of extraterritorial jurisdiction undermines territoriality as a concept; (5) territoriality is a component of a dysfunctional system; and (6) the flaws associated with territoriality also impact the offline world of jurisdiction.

Abstract:
This book provides a systematic in-depth study of the Principles, which were conceived and designed ‘as a guideline to assist States in developing effective measures for combating impunity’. The document contains 38 Principles, analyzed in the present book in the context of a host of complex theoretical and practical issues currently discussed in the arena of human rights and beyond. This introduction orients readers towards the basic issues, situating the Principles in their wider historical and political context and elucidating their conceptual and normative nature. It also clarifies the role, limitations and opportunities of the Principles in addressing current challenges, especially with respect to ‘transitional’ societies emerging from prolonged periods of armed conflict or oppression.

Lepora, Nathan F. Touch. Oxford University Press, 2018. http://dx.doi.org/10.1093/oso/9780199674923.003.0016.

Full text
Abstract:
Touch is the ability to perceive the world through physical contact. This article describes three principles underlying biological touch sensing and how these principles can result in biomimetic devices. First, that cutaneous touch is superresolved, in that the accuracy of perceiving fine stimulus detail is finer than the spacing between individual sensory mechanoreceptors. Second, that touch is active, in that animals actively select and refine sensations in a purposive manner. Third, that touch is exploratory, in that animals deploy purposive action patterns to encode properties of objects via a lexicon of exploratory procedures. Biomimetic tactile systems have utilized these principles to result in superior sensing capabilities, including systems that mimic the human fingertip and hand (cutaneous touch) and the rodent whisker system (vibrissal touch). Future biomimetic touch could rival human capabilities, enabling tactile sensors to have technological applications spanning across prosthetics, telehaptics, surgical robotics, wearable computing, medical probes, and manufacturing.

Full text
Abstract:
The arts sometimes precede the sciences in the discovery of fundamental visual principles. Victor Vasarely’s “Nested Squares” show an illusory effect in which corners look brighter and more salient than straight edges, despite having equivalent luminance. This chapter summarizes recent research, originally based on Victor Vasarely’s Nested Squares illusion, to discover the related perceptual and underlying physiological principles. The results offer significant insights into how corners, angles, curves, and line endings affect the appearance of brightness, shape, salience, depth, and color in our brains. Concepts covered include the alternating brightness star illusion, center-surround simulations, brain activation, corner perception, and the redundancy-reducing hypothesis.

Daniel, Girsberger, Kadner Graziano Thomas, and Neels Jan L, eds. Choice of Law in International Commercial Contracts. Oxford University Press, 2021. http://dx.doi.org/10.1093/law/9780198840107.001.0001.

Full text
Abstract:
Although the possibility of making a choice of law in respect of international commercial contracts has become widely accepted, national law still diverges in many respects with regard to the scope and relevance of, and the limitations on, party autonomy, leading to uncertainty in international commercial relations. This book compares the Hague Principles on Choice of Law in International Commercial Contracts (2015) with national, regional, supranational and international rules on choice of law around the world in order to chronicle the divergent approaches which exist today. The work is introduced by a comprehensive comparative report which sets out the similarities and differences between the featured national, regional, supranational and international rules, comparing such rules with those of the Hague Principles, thereby initiating a discussion on further harmonization in the field. Another report focuses on the application of the Hague Principles in the context of international commercial arbitration. Dedicated chapters analyse the Hague Principles from a historical, theoretical and international organizational point of view. Finally, examining each jurisdiction in detail, the book presents sixty national and regional article-by-article commentaries on the Hague Principles written by experts from all parts of the world. This dedicated and in-depth global comparative study of national, regional, supranational, and international rules provides a definitive reference guide to the key principles in respect of choice of law for international commercial contracts.
