Abstract:
The author's theory of rights was developed in an earlier book. This successor volume includes applications, lectures, replies to critics, and clarifications. For the author, rights exist only if they are embedded in the operative practices of a community. People have a right in a community if their claim is acknowledged, and if they would acknowledge similar claims by others. This account contrasts with theories of natural rights, which state that humans have rights by virtue of being human. It also differs from Kantian attempts to derive rights from the necessary conditions of rationality. While denying that rights exist independently of a community's practices, the book maintains that rights to personal autonomy and authority ought to exist in all communities. Group rights, an anathema among individualistic theories, are a valuable institution. The book's discussion of rights appropriate for minority communities is particularly illuminating as a model of careful reasoning.

Abstract:
The changing fortunes of democracy and of rights discourse in the present have provoked the concern that ‘History is not turning out as intended’. Such changing fortunes call for renewed attention to the ‘age of revolution’ and a reconsideration of its conventional historiography. Universalism must now be balanced against particularism. Paine helps that analysis, and also sheds light on the unexplained contradiction in recent historiography between a late eighteenth century dominated by natural rights and Enlightenment discourse, and an early nineteenth dominated by utilitarianism and socialism. The long-term trajectories of natural rights theory and republicanism, especially, now demand reconsideration. Paine’s age did not see a transition from particularist legal right to universal human rights, and into the twentieth century universalizing rights language seldom provided a stable intellectual foundation for proliferating republics. Merely pragmatic reinterpretations of Paine’s ‘representative system’ contribute to blighting the democratic potential of many republics.

Abstract:
The present study discusses the role of the judiciary concerning the interpretation of the right to education, with emphasis on the educational constitutional principles, on the basic content of the right to education and on the problems faced by this right. Furthermore, the present study pursuits to bring the risks that the excessive judicialization of the education brings to the balance between powers and the natural order of administration itself and public policies management in which the executive and legislative as powers elected by the people, develop, approve and initiate such programmatic actions; the lack of technical capacity of the judiciary to manage such complex matters; and the absence of infinite public resources to look after all the rights and benefits contained in the constitutions of the democratic states. As the education is a right related to the human dignity, development and citizenship, this way it should be carried out with diligence: 1. by the public authorities, specially the judiciary that even though it has not been elected by the universal suffrage, will not be able to remain inert in cases of inefficiency of the executive and legislative, for this purpose, it will be necessary mechanisms that provide more legitimacy in the acting of the judge, avoiding an inappropriate misuse of powers; and 2. by all members of society, as doers of their citizen position in search of a more decent life, once that through education (for) democracy, rights connected to freedom and to personal development are also accomplished.

This chapter examines the role that human rights law can play in the governance of natural resources. Using the compass of the right to development, it explores how human rights law supports the emergence of a right to participation, to consent, and to benefit from the exploitation of natural resources. The aim is to analyse how the right to development, despite its flaws and controversies, has become an important anchor to support the right of local communities to the governance over the natural resources located on their territories. It discusses the emergence of the rights to participation and consent as well as to benefit from natural resources exploitation. It also examines the potential connection between human rights law and taxation, rent, allocation, and use of revenues emerging from natural resources exploitation.
