Abstract:
El artículo muestra un análisis sobre cómo afecta la corrupción y la delincuencia a las micro y pequeñas empresas (mypes) de México, desde la percepción del empresario. Se fundamenta en los resultados obtenidos, de una muestra de 381 encuestas aplicadas a mypes de toda la república mexicana. Se analizan las características de las mypes, los factores de bienestar y desarrollo organizacional, los efectos de corrupción y delincuencia, así como las acciones que toman los empresarios ante estos fenómenos. La causa específica del vandalismo contra establecimientos es la situación que más afecta a las mypes mexicanas, que en vez de invertir en recursos, insumos o en el desarrollo organizacional, se tienen que realizar erogaciones principalmente para cambiar cerraduras y candados, instalar alarmas o videocámaras, asimismo cambiar puertas y ventanas. El estudio pone de manifiesto las necesidades y áreas de oportunidad que deben considerar los propietarios. AbstractThis article sets forth an analysis on how corruption and delinquency affect micro and small enterprises (MSEs) in Mexico, from an entrepreneur’s perspective. The outcomes are substantiated by results obtained from a sample of 381 surveys applied to MSEs throughout the Mexican Republic. An analysis was performed on MSEs characteristics, well-being and organizational development, the effects of corruption and delinquency as well as the steps taken by entrepreneurs in response to this phenomenon. Specifically, vandalism towards establishments is the issue that most affect Mexican MSEs, so, rather than investing in resources, commodities or in organizational development, a need to invest in having to change locks and padlocks, installing alarms and video cameras, as well as having to replace doors and windows. This research highlights the needs and areas of opportunity that company owners must consider.

Abstract:
In this work the unobservable heterogeneity respect to the choice of household’s residential location is analyzed, considering three alternatives: urban area, interurban area and rural area. It is employed latent class choice model to represent this behavior and the results are compared with the multinomial and mixed logit models. The more flexible structure of the latent class model allows us more deeply into the analysis of unobservable heterogeneity with respect to the more limited analysis of the randomness of the parameters of the mixed logit model. The empirical results indicate two classes or groups of households with differentiated behaviors regarding to the decision of location and associated to different lifestyles. Thus, certain attributes of the location of the dwelling, such as noise, pollution or delinquency, have an effect on household preference in a different way according to the class of belonging. Also, individual characteristics of the household’s head, such as age, gender or educational level, have a different impact on the preference for location according to the class of belonging. The results allow us to distinguish two lifestyles associated with each class or group of preference: suburban and urban.

English This article reviews the socioeconomic and political context of substance misuse by street children in Brazil. Although findings are limited, available research reveals an urgent need for implementation of policies for street children. Programs for preventing substance misuse and delinquency are still missing political and infrastructural support. French Cette étude analyse le contexte politique et socioéconomique qui entoure le mauvais emploi de substances par les enfants de la rue du Brésil. Bien que les résultats soient limités, la recherche indique que l'établissement de politiques concernant les enfants de la rue est un enjeu urgent. Il n'y a pas encore de cadre politique et d'infrastructures pour soutenir les programmes de prévention de la consommation et de la délinquance. Spanish Este artículo revisa el contexto socioeconómico y político del fundamento del abuso de niños de la calle en Brasil. Aunque los hallazgos son limitados, la investigación disponible revela una urgente necesidad de implementación de políticas respecto a los niños de la calle. Los programas para prevenir el fundamento del abuso y la delincuencia aún están ausentes de apoyo político e infraestructural.

En Cabo Verde, desde finales de los años 90, se asiste a un creciente aumento del comportamiento antisocial de los jóvenes con edades comprendidas entre los 12 y los 21 años. Sin embargo, el conocimiento de los factores que causan y perpetúan tal comportamiento es aún muy incipiente. Este estudio busca identificar los factores que pueden predecir el comportamiento antisocial reportado en Cabo Verde, utilizando para tal fin, el International Self-Report Delinquency Study -3, (ISRD-3). La muestra estuvo constituida por 535 estudiantes de ambos sexos que asisten a la escuela pública en Cabo Verde, siendo 284 (53%) del sexo femenino y 247 (46.25%) del sexo masculino. La edad de los jóvenes varía entre los 13 y los 21 años, con una media de edad de 16.66 y una desviación estándar de 2.04. Los resultados indican que el sexo es un fuerte predictor de la perpetración de comportamientos antisociales, siendo que los individuos del sexo masculino revelan una mayor probabilidad de involucrarse en comportamientos antisociales. Los adolescentes con menos actitudes antisociales son también los que tienen menores probabilidades de envolverse en comportamientos antisociales. Del mismo modo, aunque sólo se revele marginalmente significativa, los adolescentes que relatan una mayor implicación en actividades antisociales se muestran más propensos a ocupar su tiempo libre en actividades perjudiciales. Estos resultados son analizados en términos de sus implicaciones para la prevención de la delincuencia.

Objectives: Juvenile delinquents are a group of people that is in dire need of psychosocial rehabilitation. In this research, we seek to assess the lived experience in two groups of delinquent adolescents: one group is repetitive delinquents, the second group successfully returned to society. We tried to understand the relevant and essential factors in making this difference. Methods: This study is a qualitative research based on Grounded Theory. In this study, samples of adolescents with recurrent crimes and samples that have successfully returned to society without recidivism were reviewed. To do this, we should have investigated each case separately and the whole process that led to the recurrence of the crime. However, because the size of the statistical population is not sufficient to use quantitative and generalized methods, a case-experienced study has been conducted. This method assesses current phenomena in their real-life context, especially when the boundaries between a phenomenon and the context in which it occurs are not clearly defined. Several sources of evidence were used. After the coding of the gathered data and the formulation of the interviews in the form of concepts, the next step was to increase the level of abstraction of these concepts and propositions in the form of subcategories. Results: Finally, of 222 propositions, we reached 100 concepts that were mainly associated with recurrent delinquency or regret and return to society. Some of the most important ones were family problems (such as parental quarrels, parental addiction, parental unemployment, and a history of a criminal conviction and parental imprisonment). Discussion: Undoubtedly, one of the essential factors in the occurrence of crime is the environments in which the perpetrators deal with them. They are influenced by these environments whose personalities are shaped. Family, school, neighborhood, dropout, peer group, and general social determinants are influential in juvenile delinquency and its continuation or abandonment.

<p>El presente artículo analiza las manifestaciones de un <em>habitus</em> agresivo en diversos espacios de las interacciones sociales en los distritos de Apatzingán y Coalcomán, del suroeste de Michoacán. Postula que entre 1930 y 1980 en la región coexistió una violencia instrumental (agraria, delincuencial y la vinculada al trasiego de enervantes) con una violencia expresiva (pistolerismo, <em>vendettas</em>). Ambas clases de violencia estaban vinculadas a la ineficacia del Estado para brindar seguridad en la región. Ese contexto de inseguridad propició la persistencia de un <em>habitus</em> violento así como una cultura del honor y de la autodefensa.</p><p>This article analyzes the manifestations of the aggressive habitus in divers spaces of the social interactions in the districts of Apatzingán and Coalcomán, southwest of Michoacán, México. Postulate that between 1930 and 1980 in the region coexisted an instrumental violence (agrarian, delinquency, drugs) with a ritual violence (<em>vendettas</em>, pistolerismo). Both kinds of violence were linked to the inefficiency of the Mexican State to offer segurity in the region. That context of insegurity propitiated the persistence of a violent habitus as well as a culture of honor and of the self-defense.</p>

This research uses a qualitative approach. This type of research is a qualitative descriptive study, research time in August 2018. Subjects in the study amounted to 35 people consisting of 18 men and 17 women, 4th Grade students of Primary School Purwodadi, Nagan Raya District. Data collection techniques such as: interviews, observation and documentation. Based on the results of the research, the factors causing the delinquency of 4th Grade students of Primary School Purwodadi are the delinquency of students that occurs at school is not only influenced by students' internal factors, but there are also external factors which also greatly affect the delinquency of students and how to handle delinquents of 4th Grade students of Primary School Purwodadi from the solutions provided by the teacher are often spontaneous without regard to the psychological impact of students which consequently can cause problems for students who get sanctions. Like, the teacher punishes students in front of their peers, thus making the students embarrassed, because they are embarrassed that the student won't go to school the next day. This is what is meant by problems for students.

The present work brings to light a criminology and a preventative system from a less classic perspective, which does not aim to explain the criminal or the reasons why the act is committed, but rather a theoretical overview that focuses on the setting of the offense and the environmental opportunities that the criminal has taken to commit him. Situational Crime Prevention places attention and works on a set of public and private facilities (such as schools, hospitals, transport systems, shops, shopping malls, small businesses, telephone companies, parks, clubs, entertainment venues, bars and parkings) that create conditions, actions and performance that are potentially suitable and fertile for delinquency. ---------- Il presente lavoro porta alla luce una criminologia e un sistema preventivo letti da una prospettiva meno classica, che non si pone l’obiettivo di spiegare il criminale o le ragioni per cui l’atto illecito viene compiuto, bensì tratta una panoramica teorica che si focalizza sul setting del reato e sull’opportunità ambientale che il reo ha colto per commetterlo. Youth development and prevention of violence are two sides of the same public policy issue. A great deal of theoretical and empirical effort has focused on identification of risk factors for delinquency and development of interventions for general risks. Recent calls for changes in public policy are evaluated here—and challenged—in light of new comprehensive, longitudinal empirical data on urban violent delinquency. Treatments such as prenatal care, home visitation, prevention of bullying, prevention of alcohol and/or drug abuse, promotion of alternative thinking, mentoring, life skills training, rewards for graduation and employment, functional family therapy, and multidimensional foster care are effective because they prevent or ameliorate risks for delinquency occurring during development. At present, the best treatments yield 10 to 40% reductions in delinquent recidivism. Better controlled application of developmentally appropriate treatments in higher doses, with narrow targeting of the highest-risk youth based on actuarial testing—rather than less accurate clinical judgment—should result in higher effectiveness. Such a focused approach in a geographical area with high homicide rates should be cost-effective. A prediction of cost-benefit outcomes for a carefully constructed example of a large-scale program is presented.

Self-report delinquency studies among adolescents are frequently conducted as paper-and-pencil studies. With the introduction of computers in schools, a new infrastructure for interviewing students is available. Until now only a few criminological studies deal with the question of whether paper-and-pencil and computer-assisted surveys lead to the same results. This question is analysed using a paper-and-pencil sample of 2033 adolescents and a netbook sample of 610 adolescents. In contrast to other experiments, not only are prevalence rates of delinquent behaviour compared but also prevalence rates of factors influencing delinquent behaviour, correlations between these factors and the behaviour, missing values and evaluations of the survey by the adolescents. Among others, the analyses differentiate between gender and educational groups. All in all, largely no differences were found between the two methods regarding all these topics. The netbook survey obtained the same results as the paper-and-pencil survey.

Resumen: Se trata de una discusión sobre la pluralidad de las violencias, entendidas como una construcción cultural. Nos referimos principalmente a dos dimensiones de la violencia: directa y estructural. La primera dimensión suele ser la más notoria, porque implica la acción intencionada de daño entre dos o más sujetos, mientras la segunda es más silenciosa e invisible, porque ha sido normalizada y preservada en los sistemas económicos, políticos y culturales, como en el caso de la desigualdad con efectos en las desventajas heredadas de ciertos sectores de la población. Ambas, dimensiones, suelen tratarse de forma independiente, pero son indisolubles, se entrecruzan y generan una pluralidad de formas y efectos que las políticas públicas no han logrado mitigar; en consecuencia, la degradación social es progresiva en los territorios. En México, la violencia directa y su manifestación en la delincuencia, ha sido una justificación para el uso político del miedo, a fin de imponer agendas políticas, persuadir a los ciudadanos y legitimar acciones de seguridad; todo ello, sin lograr resarcir las manifestaciones de las violencias, ni la delincuencia. Palabras clave: violencia estructural, violencia directa, miedo, territorio, prevención.Abstract: It is a discussion about the plurality of violence, understood as a cultural construct. We are mainly talking about two dimensions of violence: direct and structural. The first dimension is usually the most notorious, because it implies the intentional action of harm between two or more subjects, while the second is more silent and invisible, because it has been standardized and preserved in economic, political and cultural systems, as in the case of inequality with effects on the inherited disadvantages of certain sections of the population. Both dimensions are usually treated independently, but are indissoluble, intersect and generate a plurality of forms and effects that public policies have failed to mitigate; consequently, social degradation is progressive in the territories. In Mexico, direct violence and its manifestation in crime has been a justification for the political use of fear, in order to impose political agendas, persuade citizens and legitimize security actions; all this, without being able to compensate the manifestations of the violence, not the delinquency. Quando incontriamo gli studenti nel nostro progetto di confronto tra il carcere e le scuole, ci sono testimonianze di detenuti che si sono fatti trent'anni e piů di galera, che hanno attraversato gli anni prima e dopo la riforma penitenziaria, ed erano comunque "delinquenti veri", perché in quegli anni andavano in galera i delinquenti. Poi mi guardo intorno e ascolto le testimonianze di altri detenuti, che sono entrati in carcere in questi ultimi anni, e vedo quelli che arrivano da situazioni di difficoltŕ o di esclusione, i tossicodipendenti, i migranti, ma anche tanti "turisti", come li chiamano gli altri detenuti, cioč i cittadini comuni, i "regolari" che finiscono sempre piů spesso in galera, per reati in famiglia, per la droga, per l'incapacitŕ di affrontare i conflitti in modo equilibrato.

Tendencias como la virtualización de la delincuencia, el cambio de énfasis del aspecto físico al aspecto simbólico de la violencia y la vulnerabilidad de las clases medias, eventualmente electorados de corte populista, no permiten pronosticar un decrecimiento de las poblaciones carcelarias en América Latina o una mejora de sus condiciones de vida, pese a los esfuerzos de algunos sistemas judiciales y penales, así como organizaciones interestatales y no gubernamentales. Abstract The article analyzes the circumstances surrounding the contradictory duality present in the social function of the penitentiary centers (punishment and rehabilitation) taking into account two elements: the adjacent debates about insecurity, and the discourses instigated by public opinion, political organizations and intellectuals. Trends such as the virtualization of delinquency, the change of emphasis from the physical aspect to the symbolic aspect of violence, the vulnerability of the middle classes (eventually populist electorates) do not allow us to predict a decrease in prison populations in Latin America or an improvement of their living conditions, despite the efforts of some judicial and criminal systems, as well as inter-state and non-governmental organizations.

La novela negra ha revelado una versatilidad que le ha permitido establecer una relación de ósmosis con otros géneros. Uno de ellos es la conocida como «novela de Hollywood». En la narrativa de Ross MacDonald, uno de los maestros de la novela negra norteamericana, se producen abundantes cruces entre las historias de detectives herederas de la ficción hard-boiled y la novela que utiliza el mundo de Hollywood como trasfondo o tema principal de las tramas. El presente artículo trata de mostrar cómo ese diálogo intergenérico se traduce en la incorporación al relato de imágenes de naturaleza cinematográfica o que enfatizan el aspecto fílmico de la realidad que representan. Asimismo, las novelas y cuentos de MacDonald perfilan un universo, unos ambientes y unos personajes vinculados o cercanos a la industria del cine americano dominados por la pérdida de valores éticos, la delincuencia y el crimen. The noir novel has generated a versatility that has allowed it to establish a relationship of osmosis with other genres, with one of these being the so-called «Hollywood novel». In narrative of Ross MacDonald, one of the masters of the American noir novel, we can find abundant overlaps between the detective stories deriving from the hard-boiled fiction tradition and those novels that use the world of Hollywood as their fictional background or as main element in their plots. The present article attempts to show how this intergeneric dialogue is achieved by the incorporation of cinematographic images in the story or by others that emphasize the filmic aspect of the reality they represent. Likewise, MacDonald's novels and short stories define a universe, settings and characters linked to or in reflection of the American film industry and dominated by the loss of ethical values, delinquency and crime.

This research is a normative juridical method, namely Legal Research conducted by examining library materials or secondary data. The results show that factors causing juvenile / juvenile delinquency, among others, are psychiatric or psychological factors and family structure. Mass fighting is one form of juvenile delinquency, where there are two contributing factors, namely internal factors (from within) and external factors, namely environmental factors (family, school and community). While specific factors for example to show a sense of solidarity and loyalty from friends (who tend to be inconsequential), defending the good name of the school, negative competition, lack of transportation facilities, the complexity of big city life, showing hard films on television and so on.

There exists few studies on Mexico related to research of the factors involved in the decision-making process of individuals when choosing whether to be a law-abiding citizen or a criminal. From the perspective of members of criminal markets—i.e., victims, felons, and the government—this work explains under a general equilibrium model how the delinquency rate for felonies, such as theft, in the various Mexican states function as structural parameters for wages, taxes, police reliability, and legal penalties. The results suggest that, in an environment of low accusation and punishment, the only variable in this model which has a real effect in reducing crime are monetary penalties, due to the fact that the felon must face this kind of penalty once accused, captured, and jailed. Spanish Existen pocos estudios para el caso mexicano donde se investiga cuáles son los factores que intervienen en la toma de decisiones de los individuos al elegir entre ser criminal o no. Desde la perspectiva de los integrantes del mercado del crimen, esto es, víctimas, delincuentes y gobierno, este trabajo explica bajo un modelo de equilibrio general, cómo responde la tasa de delincuencia para delitos como el robo de las entidades federativas mexicanas ante cambios en los parámetros estructurales como salarios, impuestos, productividad de la policía y las penas consideradas en el marco legal. Los resultados encontrados sugieren que en un contexto de bajas tasas de denuncia y castigo, la única variable de política que en el marco de este modelo tiene efecto para reducir el crimen son las penas monetarias, ya que estas las enfrenta el criminal una vez que es denunciado, capturado y encarcelado. French Rares sont les études au Mexique qui s'interrogent sur les facteurs liés au processus de prise de décision chez les individus concernant leur choix de devenir ou non des criminels. Fondé sur les opinions des agents du crime organisé, dont les victimes, les criminels et le gouvernement, cet article analyse sur la base d'un modèle d'équilibre général, la manière dont le taux de délinquance, à l'instar des détournements des fonds publics dans des régions mexicaines, réagit aux changement des paramètres structurels tels que les salaires, les impôts, l'efficience de la police et la fiabilité des sanctions dans le cadre juridique. Les résultats suggèrent que dans un contexte pareil marqué par un faible taux de plaintes et de sanctions, la seule variable de politiques susceptibles de réduire efficacement la criminalité, sont les sanctions pécuniaires, auxquelles les criminels seraient systématiquement confrontés en cas de dénonciation, d'arrestation ou d'emprisonnement.

Juvenile delinquency poses a constant social challenge to the public. Juvenile delinquency can be defined as a repeated social disorder among children or adolescents. In this regard, human behaviour and the environment are linked to each other. Hence, the distortion of one aspect will definitely affect the latter. This article presents a comprehensive intervention where the integrated social work approach was applied to deal with juvenile delinquency. The integrated social work approach has become a framework for social work as it focuses on both the individuals and the environment. This framework has been applied to reduce the gap between individuals and their environments, and it is very important for social work intervention. Since the nature of this framework encompasses several different professions, it has become beneficial for social workers to deliver a multi-context intervention and assessment that is based on the preventive, rehabilitative, and development perspectives, especially in the case of juvenile delinquency. The implementation of an integrated social work framework in the line of a social worker’s profession could bring advantages in terms of pinpointing the cause of the problems. Finally, social workers will be able to address juvenile delinquency problems through appropriate techniques.

Este artículo quiere ser una contribución por las víctimas de cualquier forma de violencia sexual y, en particular, una reflexión política de denuncia ante la injustificada falta de calidad de fuentes cuantitativas para el estudio de este suceso en España. En la primera parte, identificamos los organismos responsables de producir y difundir estadísticas de criminalidad sexual, proponiéndose una primera evaluación de las principales fuentes disponibles que implicaría problematizar sobre el sub-registro estadístico de esta tipología penal y examinar las deficiencias técnicas que presentan los datos publicados. En la segunda parte, presentamos una compilación de las series sobre delincuencia sexual extraídas de los distintos Anuarios Estadísticos publicados por el Ministerio del Interior desde 1987, advirtiendo su escasa capacidad para un estudio cuantitativo riguroso de las violencias sexuales.Sexual violence against women and girls is one of the most brutal forms of gender violence and, at the same time, a long-silenced crime. This article wants to be a contribution to the struggle of women victims of any form of sexual violence and, in particular, a political reflection of denunciation against the unjustified shortage of quantitative sources and the inexplicable low quality of the data for the study of this event in Spain. In the first part, we identify the agencies responsible for producing and disseminating sexual crime statistics, making a succinct evaluation of the main sources available. In the second part, we present a compilation of the series on sexual delinquency extracted from the different Statistical Yearbooks published by the Ministry of the Interior since 1987, noting its low capacity for a rigorous quantitative study of sexual violence.

Juvenile delinquency is getting more worrying in both developed and developing countries over times. Juvenile delinquency is also a problem with which any family often complains. One of attempts to be taken to deal with juvenile delinquency is to conduct rehabilitation or mentoring. This research aimed to analyze the type of juvenile delinquency and its cause, to find out the form of building and the factors supporting and inhibiting the mentoring. This research employed Max Weber’s Social Action theory. This qualitative research with case study was conducted in Sukoharjo. The sampling technique employed was purposive sampling technique. The informant of research consists of Chairperson and Mentors of Children in SINAI Foundation of Sukoharjo, and children who have ever committed delinquency and live in SINAI Foundation. Data was collected through observation, in-depth interview, and documentation. To validate the data, source triangulation was used. Technique of analyzing data used was Miles and Huberman’s interactive analysis model. The result of research showed that type of delinquency committed by children residing SINAI Foundation is non-conform action including escaping from home or foundation and playing truant, and antisocial or asocial action including not paying transportation ticket or cost when going by public transportation and large vehicles crossing the road. The cause of delinquency committed by children residing SINAI Foundation included internal and external factors. Internal factor included wish coming from inside. External factor included family environment, economic condition, and friendship environment. The form of children mentoring conducted by SINAI foundation included mental spiritual building, skill building, and discipline building. The factor supporting the mentor was a belief inside assuming that mentoring the needy children was the form of worship to God and that fellow human beings should help each other. Meanwhile the factors supporting the child to attend the mentoring were the presence of complete and feasible facilities for residence and the fulfilled daily need, the access to education and the presence of friends or relatives living there. The factor inhibiting the Mentor included queer SINAI Foundation resident’s queer behavior and sometimes accident occurring during mentoring or treatment. The factor inhibiting the children attending the mentoring was the Mentor’s resoluteness making them sometimes upset and longing for seeing their parents.

Abstract The paper is composed of two parts. The first part covers juvenile delinquency with all its characteristics. When analyzing the delinquency, we gave a special place to the socio-pathological phenomena which is more and more present and the rate is higher from year to year. Social pathology is a huge issue that requires special commitment, first, for its detection and then prevention. Within the delinquency, we also cover the most common crimes committed by juveniles. In the second part of this paper, the authors deal in more details with a specific form of crime which can also be committed by juveniles: child sexual abuse and pedophilia. First, the difference between child sexual abuse and pedophilia will be discussed, a difference that is of particular importance in cases where minors are abusers. Furthermore, the main characteristics of cases when both perpetrators and victims of sexual abuse are minors will be addressed. Although these criminal offenses are rarer in practice unlike the criminal offenses and deviant behaviors treated in the first part, however, knowing the main characteristics and specifics of such cases is of particular importance for the legal-criminal treatment of the perpetrators of these criminal offenses.

Abstract The majority of studies within the framework of Developmental and Life-Course Criminology focus on adolescence. There are even fewer studies that deal with heterotypic measures of delinquency. This study fills a gap in the literature by targeting exclusively the period of emerging adulthood (ages 18 to 28) and scrutinizing different trajectories and patterns of offending (offending portfolios) thereof. We discuss the topic of continuity of offending with changing opportunity structures for an adult population via contrast of one set of delinquent behaviors reflecting opportunity structures in adolescence (youth set) and one where adult-appropriate criminal activities were added (total set). We applied latent class growth analysis (LCGA) to both sets in a sample of 1810 German men and women aged 18 to 28 years. During emerging adulthood, average crime versatility and incidences increase slightly with items of the total set, while it decreases with only the youth set. LCGA on the total set reveals five meaningful trajectories with declining but also increasing slopes. Among these is one trajectory of innocuous adolescents, who start an offending career with mainly adult crimes during emerging adulthood. Of the sample, 45.25% reported at least one offense during that period. Traffic offenses and fraud are the most prevalent types of offending. While the sample’s majority is considered non-offenders, emerging adults do not entirely cease to commit offenses. Instead, they shift their preference towards age-appropriate and covert ways to act anti-socially. Trajectory groups reflect proclivities towards either youth, adult, or a mix of both types of crime.

Until recent years, the causes of female offending and the experiences of incarcerated females have been largely ignored. Female offenders are being incarcerated at unprecedented rates, and there has been considerable attention given to the “new” violent female delinquent. In an effort to better understand delinquent girls' experiences before and during institutionalization, focus groups were conducted across the state of Ohio in 1996 with institutionalized delinquent girls and the professionals who work with them. The findings from these focus groups point out some serious problems among many of these girls before and while they are incarcerated. Policy implications are discussed in terms of the findings from the qualitative data garnered from 11 focus groups, which included 48 delinquent girls and 42 professionals who deal with delinquent girls.

This research was conducted at SD AL-Kautsar Bandar Lampung. Data obtained from interviews with school principals and teacher educators and questionnaires distributed to students. Data were analyzed using the following steps: data reduction, data display and conclusion/verification. Based on the results of research in the field, the authors conclude that character education at SD Al-Kautsar Bandar Lampung is very good in terms of teaching and practice. Character development in schools is pursued through several ways including learning activities in the classroom and outside the classroom with qualified teachers who are believed to be able to build the character of their students, as well as cooperation from parents of students in cultivating good character at home.

Abstract:
This study discusses how to deal with juvenile delinquency in students in different ways, namely in a more spiritual way, rich in self-affection and mental enlightenment. The purpose of implementing this death education model is to bring naughty students to change for the better. The research subjects were troublesome students at SMK N 1 Mataram. In this case, 10 students followed this death education technique. This research was an applied research using the Research Development (RD) method. This study resulted in findings of the motivation for implementing death education, applying the death education model, and the death education model's advantages. There were weaknesses in the death education model. They are: (a) not all BK and PAI teachers can bring their students to a mental and spiritual phase, (b) it takes a lot of time because at least one week per phase, and there is no counseling phase (c) it cannot be applied to students below the SMK level.

A diferencia del Estado, que soporta su economía con la produccióny los impuestos de los ciudadanos, los grupos guerrilleros que delinquen en el territoriocolombiano, no cuentan con ningún tipo de financiamiento legal. Por lo tanto, someten alpueblo a la extorsión y el secuestro; pero siendo estos medios insuficientes, han acudidoal narcotráfico como forma de financiar su accionar delictivo.Una vez desaparecidos los carteles de Cali y Medellín, dueños del negocio de las drogasilícitas, esta empresa quedaría en manos de las guerrillas de las FARC y el ELN, quienescambiarían sus ideales comunistas por la narco-ideología que domina la deslumbrantemafia. Sin las exorbitantes utilidades que genera el negocio del narcotráfico, los gruposguerrilleros que delinquen en territorio colombiano, hubieran pasado a la historia comosimple cuadrillas de bandoleros que amedrantaban a la población con ideas socialistas.Los conflictos armados que ha vivido Colombia desde sus inicios como repúblicaindependiente, siempre han contenido un tinte político. El actual no es la excepción,desafortunadamente éste ha sido el más difícil para poner punto final, contando de algunaforma con la complacencia de sectores del Estado, que han permitido el abandono estatalen algunos rincones del país, dando razones a los narcoterroristas para argumentar susansias de poder y justificar su violencia.

La Napoli che emerge dall’analisi dei testi narrativi di Luigi Incoronato ( Scala a San Potito, L’imprevisto e altri racconti) è contrassegnata da una forte sperequazione economico-sociale. L’attenzione del nostro autore, che si serve di un narratore ora extra-eterodiegetico ora extra-omodiegetico, si concentra sui ceti più bassi, che affollano i vicoli della città: individui che lottano quotidianamente per la sopravvivenza, per i quali sembra impossibile cambiare condizione. Emblematica è la situazione descritta nel romanzo Scala a San Potito: al gruppo di diseredati che occupano le Scale di San Potito si aggiunge lo stesso io narrante, dopo aver perso il suo impiego, a sottolineare la precarietà del ruolo dell’intellettuale e la sua incapacità a risolvere i problemi dei ceti più bassi. La fabula denuncia così le piaghe sociali che caratterizzano Napoli nel secondo dopoguerra, quando “Ormai gli americani se n’erano andati”; la disperazione causata dalla disoccupazione, dalla miseria fa emergere il lato peggiore degli esseri umani o conduce alla follia, alla morte, alla delinquenza. L’attività di Incoronato si pone dunque in continuità con quella di Bernari e rappresenta una posizione originale nell’ambito della corrente neorealistica (Napoli si pone pure come simbolo di una realtà più ampia), anche grazie ad una lingua essenziale, priva di orpelli retorici, e che, a volte, ricalca il parlato.

El hurto es el delito más recurrente en Barcelona, que causa una percepción de inseguridad ciudadana, y que plantea la necesidad de crear estrategias de prevención e intervención por parte de la policía, siendo de gran ayuda la perfilación geográfica. Así, el objetivo principal de esta investigación es establecer el perfil geoespacial de una muestra de hurtadores, mediante un estudio empírico, descriptivo y aplicado, en el que se empleó el método cuantitativo. Se partió de una muestra inicial de 66 delincuentes, en la cual se analizó la distancia del domicilio al lugar del hurto, y de una segunda muestra de 15, para comparar los perfiles de los commuters y los maraduers y establecer la safety zone y la decay distance. De acuerdo con la teoría; los ladrones nocturnos viven más cerca del lugar del hurto que los diurnos, la mayoría residen en la zona metropolitana y hurtan aproximadamente a unos 5 km de su domicilio. Se distribuyen equitativamente entre commuters y marauders, siendo los marauders los que recorren distancias más cortas y delinquen de forma más recurrente. Concretamente, en Barcelona, tres de cada diez vuelven a delinquir dentro de los 70 días posteriores al hurto; para los marauders se estableció la safety zone a una distancia de 0.36 km y la decay distance a 3 km de su domicilio.

Il saggio si sofferma su un elemento essenziale per il consolidamento della rivoluzione scoppiata il 12 gennaio 1848 a Palermo, ossia sull'intervento delle squadre. L'autore si serve della memorialistica prodotta dopo il fallimento della rivoluzione al fine di verificare quale fu il giudizio complessivo e comprendere il reale impatto di queste formazioni. Quello che emerge è uno scenario frammentato e non privo di ambiguità, in quanto i principali memorialisti ricoprirono importanti ruoli istituzionali. Il sodalizio tra delinquenza comune e opposizione politica si rivelò fondamentale per l'affermazione della rivoluzione, ma fu deleterio per lo stato dell'ordine pubblico. In fatti, il tentativo di smobilitazione delle squadre fu di difficile esecuzione, e nel caso di reimpiego dei membri all'interno dei corpi deputati al mantenimento della pubblica sicurezza si ebbero ulteriori e ancora più gravi problemi.

El presente artículo realiza una breve exposición sobre la regulación penal española en relación al delito de tráfico de drogas y los preceptos aplicables a aquellas personas que delinquen como consecuencia de su drogodependencia. Si bien existe una vinculación entre drogas y delincuencia, no existe unanimidad sobre cuál es el mecanismo que debe utilizar el Estado para hacer frente a dicho consumo y tráfico, el legislador español ha optado por una regulación amplia del delito de tráfico de drogas, lo cual resulta ciertamente excesivo. Es por ello, que se analizará la regulación de este delito en el artículo 368 del Código Penal de español.

En este estudio de corte cualitativo, se realizaron los relatos de vida de 94 mujeres procedentes de 15 naciones diferentes, que estaban o habían estado en la prisión. Se analizaron sus relatos con el fin de responder la pregunta: ¿por qué las mujeres delinquen y porqué desisten de la actividad delictiva?. Del análisis de contenido temático se desprende que haber sufrido violencia de género, es un factor explicativo del ingreso de las mujeres en prisión. Estos hallazgos sugieren que las mujeres han estado encarceladas desde antes de entrar a la prisión a través de vínculos identitatrios que las encorsetan o limitan su capacidad de elección. Pueden ser estos mismos vínculos positivos los que las llevan a movilizar sus recursos psicosociales para salir de la prisión y desistir del delito.

Con el sistema penal acusatorio, se pretende completar el marco de un nuevo sistema de judicialización basado en el reconocimiento del derecho más básico y fundamental, que tienen las partes dentro de un proceso, esto es el reconocimiento de los derechos humanos, y del resto del instituciones que procuran contraponerse contra los excesos del sistema que por años a dominado la escena judicial. Los niños, niñas y adolescentes que delinquen no pueden ser tratados como una personaadulta, y menos en plena etapa avanzada del reconocimiento judicial de las garantías fundamentales, para evitarles graves violaciones a sus derechos y garantías, reafirmándose la importancia de buscar mecanismos de protección para esta población bajo una dimensión integral. La entrada en vigencia a nivel nacional, del sistema penal acusatorio, activa los canales institucionales, formados por el ÓrganoJudicial y el Ministerio Público, para fomentar el estudio, análisis, comunicación y formación de los colaboradores de justicia, pero sobre todo, empodera a la sociedad de sus derechos, invitándola a ser participativa, activa y no pasiva.

Este estudio se centra en el recorrido y desarrollo de Mario Conde, detective protagonista de las ocho novelas policiales del escritor cubano Leonardo Padura. De la tetralogía que se inicia con Pasado Perfecto,en 1991, hasta la ambiciosa y última entrega de Herejes, en 2013, Conde actúa mayormente dentro del “período especial” cubano marcado por la debacle de la Unión Soviética, para arribar a la primera década del siglo XXI. Dicho “período especial” produjo un quiebre en el desarrollo del género policial en Cuba. Por lo tanto, el género policial revolucionario, con apoyo oficial que nace a comienzos de la década de los 70, se transforma en los 90 para insertarse en la vertiente neopolicial que el resto de Latinoamérica venía desarrollando desde una década antes.Lejos de los personajes modélicos revolucionarios del género en su origen, el neopolicial de Padura crea personajes que resuelven crímenes y delitos pero a la vez delinquen y evaden la ley. A partir de los casos que investiga, Conde se mueve dentro de esa paradójica conducta, al mismo tiempo que deconstruye y desmitifica las grandes políticas y discursos revolucionarios.

The research of criminal act structure of minors is considered as social phenomenon related to different human communities in spite of their difference in values, standards and social rules. In terms of this phenomenon, the Algerian society is one of concerned societies in which investigation remains complex because research pass through different levels linked to social organization forms that Emile Durkheim considers as integral part of social system where durability and continuity depend on. Anthony Giddens admits that structure and act are in constant state of development and construction, that is why a new step of this construction and development are shaped because criminal act has a common purpose needs a decision taking and judicious organization where group of minors and band become hierarchical organization in professionalism state. The latter led to a new transformation in terms of phenomenon processing that is one of the greatest disasters affect the interest of individual, security and stability of society in general en particular. As far as these problems and hypothesis that criminal phenomenon lies down in terms of structure of criminal act for minors in the Algerian society, we set up a filed study in Cité Seybouse, Wilaya of Annaba in order to shed light on repercussions of this disaster on social values system in the analysis of structure of criminal act of minors and its interpretation so as to define development way or method of this social structure till policies instauration that can diminish this phenomenon which we will deal with answering the following sub-hypothesis: 1. Abstract:
An integral part of modern criminal policy is criminal procedure policy regarding juvenile delinquents, aimed at resolving a criminal law conflict in the ways that are most beneficial for these persons and that lead to their re-integration in the society. The purpose of juvenile criminal proceedings is connected with special educational tasks and requires special procedures. In Russian criminal proceedings, the court can substitute criminal punishment with compulsory educational measures as part of such procedures. Russian system of compulsory educational measures is complicated, and a special place is held by the most severe sanction — directing a juvenile guilty of a grave crime or a crime of medium gravity into a special residential correctional school. The authors note that the legislation does not fully regulate the application of this sanction, which hinders its use by courts. They also present statistical data on the number of juveniles who the courts place into special residential correctional schools and analyze the reasons why this measure is seldom used. As there is no service of probation in Russia, the courts have no opportunity to find good solutions to the problems connected with a delinquent’s stay in a residential correctional school. The authors support the initiative of the Supreme Court of the Russian Federation to transfer these problems to the sphere of administrative court procedure, which should both benefit the court system and promote the rights of minors. They argue for the development of two strategic spheres of state criminal procedure policy for juveniles — that criminal court procedure should no longer deal with resolving socio-pedagogical, rehabilitation and medical problems of a juvenile's stay in a residential correctional school, and that there should be a detailed procedure for placing a juvenile into such an institution.

The use of credit card has increased tremendously in the past few years because of the boom in the economy which has also resulted in the increase in the credit card fraud cases. Various leading banks and software development companies worldwide are taking serious measures to deal with the gravity of this situation. This paper proposes a framework for credit card fraud detection that will detect frauds using maximum entropy according to the irregular behavior of the customers in various transactions of credit card. The comparative study of above approach with existing approaches is also addressed. Results show the feasibility and validity of each approach.

La relación entre espacio y delincuencia ha sido ampliamente documentada por los criminólogos ambientales. En España, dada la escasez de datos cuantitativos, el conocimiento que se tiene aún es limitado y se hace preciso un mayor desarrollo de investigación empírica, más si cabe en lo referido a la delincuencia juvenil. Con objeto de profundizar en el conocimiento acerca de las características espaciales de la delincuencia juvenil, utilizando una muestra de 145 casos extraídos de las diligencias incoadas en 2009 por la Fiscalía provincial de menores de Albacete, el presente estudio lleva a cabo un análisis exploratorio en dos etapas. En la primera etapa, se analiza la distribución espacial del fenómeno por medio de la elaboración y visualización de mapas de hotspots. Seguidamente, para ahondar en los determinantes del desplazamiento de estos delincuentes hasta los lugares donde delinquen, se lleva a cabo un análisis de regresión utilizando algunas de las variables que la literatura especializada ha considerado más significativas.

A partir de los postulados de Paul Ricoeur de la intencionalidad ética y la norma moral, y de la primacía de la primera sobre la segunda, se establece cómo la estructura tripartida de la concepción de ética en forma insoluble conlleva en su tercer polo, la interpelación del sí desde su intención de la vida buena con la norma en el sentido moral. A partir, de esta tensión dialéctica de la alteridad y la ipse de Ricoeur, es donde se indaga en el rol del género en la interiorización de la norma moral, específicamente en mujeres que delinquen. Se plantea la vinculación de los conceptos culturales y sociales a la base de la norma moral en un sistema patriarcal, en términos anónimos y naturales, que implican para la mujer en su actuar una doble contradicción. Se discute sobre la incidencia de estructura tradicional de valores y normas precedentes, en el plano de la libertad y la vinculación con la ley para la mujer. The present work embraces multiple aspects related to the theme of serial murder, which is essentially addressed by a criminological and personological perspective. Attention will be focused first on the serial killer figure, which will analyze both the intrapsychic peculiarities and the most intrinsic motivations behind the homicidal action as well as the more technical and specific aspects of the modus operandi and the signature that convey this kind of offenders. At the same time, a victimological overview will be developed, focusing on the preferential victims in this delinquent mode. The article will also highlight a categorization of serial killings based on the motive, as well as different classifications of the major types of serial killers identified by multiple authors. Finally, criminal profiling will be analyzed, deepening the role of the profiler in investigations and outlining the presumed personality of the offender, thus circumscribing the field of potential investigators with particular reference to US reality. ---------- Il lavoro qui presentato abbraccia molteplici aspetti relativi al tema dell’omicidio seriale, che viene essenzialmente affrontato da una prospettiva criminologica e personologica. L’attenzione, infatti, si concentrerà inizialmente sulla figura del serial killer, di cui saranno analizzate sia le peculiarità intrapsichiche sia le motivazioni più intrinseche alla base dell’azione omicidiaria, nonché gli aspetti più tecnici e specifici quali il modus operandi e la firma, che connotano questo tipo di autori di reato. Parallelamente verrà sviluppata una panoramica vittimologica, con focus sulle vittime preferenziali in questa modalità delittuosa. L’articolo porterà inoltre alla luce sia una categorizzazione degli omicidi seriali in base al movente, sia diverse classificazioni dei principali tipi di serial killer individuati da più autori. Al mismo tiempo, se desarrollará un panorama vistimológico centrado en las víctimas preferenciales en este modo delincuente. El artículo también destacará una categorización de asesinatos en serie basados en el motivo, así como varias clasificaciones de los principales tipos de asesinos en serie identificados por múltiples autores.
