Abstract:

L'incontro con l'altro ci impone un lavoro psichico complesso, per i genitori questo lavoro di trasformazione inizia con la nascita del figlio che li confronta con il tema dell'estraneità e che si rinnova poi nel periodo dell'adolescenza. In questo lavoro l'autrice si interroga sul ruolo del confronto con l'estraneità come elemen-to costitutivo del passaggio alla pubertà. Tale aspetto viene osservato, presentando il materiale clinico di una famiglia adottiva con due figli adolescenti. Per le famiglie adottive questo pas-saggio si articola attraverso varie vicissitudini in cui si intrecciano fenomeni evolutivi ed espe-rienze traumatiche, che rendono il lavoro stesso di elaborazione psichica molto delicato e com-plesso per l'intero nucleo familiare. In questo scritto il punto di vista teorico, da cui osservare questi delicati passaggi, è quello interpersonale che si occupa non solo dei processi intrapsichi-ci, ma si interessa anche alle relazioni e alle interazioni che circondano i soggetti.

Abstract:

Anche nel settore del giudizio civile si registra un crescente interesse per il giurista e filosofo londinese Jeremy Bentham e per le sue proposte in tema di disciplina della prova e di organizzazione della procedura giudiziaria. Le tesi utilitaristiche benthamiane possono scorgersi pure nella impostazione generale delle “Civil Procedure Rules” inglesi e nella teoria, che vi è accolta, della “proportionate justice”. Peraltro, tanto le concezioni di Bentham, quanto l’impiego del canone di proporzionalità in chiave utilitaristica, pongono delicati problemi e rischiano di ostacolare una piena tutela dei diritti individuali alla tutela giudiziaria.

Algumas experiências passam tempos em um período de incubação e depois se transformam, ganham outros sentidos. Há graus e variações de pactuação, há acordos maiores, explícitos, e eles envolvem pequenas pactuações, invisíveis, sutis, mais próximas das alianças episódicas, pactos delicados que vão deslizando a sensibilidade. Abstract:

L’articolo affronta il tema del trapianto di gonadi a partire dai primi tentativi tardo ottocenteschi sino agli sviluppi odierni, tenendo conto sia dell’aspetto biomedico sia di quello etico. Si prendono in esame due possibili situazioni, il trapianto finalizzato a ripristinare una ormonogenesi deficitaria e il trapianto finalizzato a ripristinare la fertilità, cercando sempre di riportare i problemi alla loro radice antropologica. Il primo tipo di trapianto, lecito in linea di principio, pone tuttavia delicati problemi riguardo alle possibili ripercussioni sulla personalità del trapiantato; il secondo non solo si configura come una variante sofisticata della fecondazione eterologa, ma determina in aggiunta una violazione dello spazio personale attraverso l’inserzione di informazione genetica estranea trasmissibile alla prole. Nella stessa prospettiva si esaminano infine anche le discusse questioni del trapianto di tessuti gonadici provenienti da feti abortiti e da cadaveri, mostrandone l’impraticabilità psicologica ed etica.

L'autore individua alcuni punti chiave della visione psicoanalitica dell'essere umano e li applica al sociale. L'attenzione liberamente fluttuante, come capacitŕ di vedere ciň che si nasconde fra le pieghe, per la particolare utilitŕ di restituire un senso di apertura nelle situazioni che appaiono come prive di una via d'uscita. Il concetto di libido intesa come eros, cioč come dimensione del desiderio che si contrappone a quella del bisogno: la spinta che porta l'essere umano verso l'apertura e non verso la ripetizione degli schemi relazionali ed emotivi dai quali sarebbe altrimenti completamente condizionato. Il conflitto come umana impossibilitŕ di conciliare tutte le cose, la cui consapevolezza ci rende piů saggi e delicati nelle relazioni d'aiuto. Il transfert come coinvolgimento appassionato, difficile da reggere, fonte del rischio di trincerarsi nei ruoli. Infine l'autore si sofferma sulla differenza fra istituzione e comunitŕ. Comunitŕ deriva da munus che significa contemporaneamente impegno e dono. Nella dimensione del dono trova spazio l'unicitŕ della persona.

Abstract:

The subject of study in this paper are administrative-delict legal relations and the terms associated with this kind of relations. The purpose of the study is to analyze the nature of offences and administrative delicts. It is stated that the use of the term “delictum” it's been a certain evolution from private legal term in the sense of “delicta private” to the term, which can be used both in the sense of “delicta private” and value of “delicta publica”. The conclusion is that the term “delict” may be used in public relations and administrative legal use of the term “administrative delict”. Expanding the range of investigated administrative and delict relations, entails a change and the essential characteristics of administrative offenses, and also creates preconditions for formation of administrative-tort system of prevention of offenses, including not only administrative offences but also other offences that are not related to crimes and civil offenses. In this case, the responsibility should be named administrative and delict, which, in essence, will include a modern administrative and administrative-disciplinary liability. Depending on the nature of the administrative delict may be subdivided into administrative offense and administrative misdemeanor. The essential characteristics of an administrative offense should be upheld, and administrative misdemeanor must be attributed those acts which are now administrative and disciplinary misconduct. With this division of administrative delicts it is possible to realize a codification of administrative and delict legislation, i.e. the creation of Administrative-delict code of the Russian Federation. The work also made the assumption that procedural violations are treated as administrative delict. An attempt is made to distinguish between material legal relations in administrative law and administrative procedural legal relations. Concluded that you cannot mix administrative-tort legal relations, as a kind of material with tort and procedural legal relations. In turn, tort and procedural legal relations are an integral part of administrative and legal proceedings, and administrative delict production is an integral part of the administrative process. The methodological basis of the article is dialectical, formal logical methods, formal-legal method and method of interpretation of law.

Abstract:

Il saggio, dopo aver messo in evidenza come in Italia vi sia una vera e propria questione salariale legata alla diffusione del "lavoro povero" e al basso livello delle retribuzioni, analizza la Proposta di direttiva UE sul salario minimo, recentemente approvata dal Parlamento europeo e tuttora non definitiva. L'articolo esamina le finalità e le motivazioni della Proposta (diretta a garantire salari adeguati che consentano una vita dignitosa) e i delicati problemi giuridici connessi sia alla competenza della UE in materia salariale, sia alla disciplina in essa contenuta. Dopo aver sottolineato che la Proposta non impone una legge sul salario minimo nei paesi in cui la retribuzione è stabilita dai contratti collettivi (come l'Italia), il saggio valuta gli effetti che il recepimento della Direttiva in Italia potrebbe avere, anche in considerazione dei disegni di legge diretti da introdurre il salario minimo. Gli autori concludono la propria analisi sottolineando come sarebbe auspicabile un intervento legislativo che, in attuazione dell'art. 36 Cost., preveda retribuzioni minime corrispondenti a quelle previste dai contratti collettivi stipulati dai sindacati comparativamente più rappresentativi a livello nazionale.

Il contributo inizia con una panoramica sul tema corpo-mente, sottolineandone l'importanza sul piano epistemologico, clinico e teorico nello scenario psicoanalitico. L'autore, attraverso rivisitazioni teoriche e casi clinici, si concentra sui differenti livelli in cui il corpo può entrare nello scenario della mente nel complesso svi-luppo psichico individuale, esplorando la possibilità di rappresentare a livello psi-chico il proprio corpo biologico e soffermandosi sul processo che porta la propria corporeità ad una "visibilità psichica". Quando i primitivi processi di integrazione falliscono o risultano compromessi, può stabilirsi una forma di dissociazione corpo-mente, aspetto che si può evidenziare in diverse forme di psicopatologia e condotte sintomatiche contemporanee. Il contributo, inoltre, attraverso uno specifico passaggio clinico, sottolinea la centralità delle reazioni corporee dell'analista in momenti delicati della cura, soffermandosi su un controtransfert corporeo particolarmente intenso. Il controtransfert corporeo può indicare elementi non ancora avvicinabili su un piano diverso da quello delle manifestazioni somatiche. Il corpo dà indicazioni importanti rispetto alla collocazione di elementi del mondo interno del paziente non pensabili, ed è anche "regolatore di stato" per la relazione terapeutica in corso e per le possibilità e disponibilità di investimento dell'analista stes-so.

Abstract:

Lord Howe Island (LHI) is a remote oceanic island in the south-west Pacific that is World Heritage listed due to its diverse, and largely endemic, biota. A suite of introduced species have colonised the island, resulting in the widespread population declines of many native species. The delicate skink (Lampropholis delicata DeVis) was accidentally introduced to LHI from mainland eastern Australia, but there has been no detailed investigation of its biology on the island, or its potential impact on the native biota. We conducted a detailed study of the distribution and biology of the delicate skink on LHI over a six-year period (2007–12). The delicate skink was introduced to LHI in the 1980s, and rapidly spread across the island. It presently occurs in all 21 low-elevation vegetation communities on LHI. The delicate skink is diurnal on LHI, and displays seasonal variation in activity with a peak in November–December. The delicate skink exhibits sexual dimorphism with females having larger body and abdomen sizes and males having longer and broader heads, although the degree of genetic admixture may influence morphology on LHI. Females reproduce in spring and summer (September–February), with a positive relationship between body size and clutch size. Clutch size ranges from 1 to 7 (mean 3.4) and communal egg nests (11–200+ eggs) are common. Tail loss is common on LHI (55%), but is more frequent in adults and females. We conclude that, based on its distribution and abundance, the delicate skink has the potential to impact the diverse and endemic invertebrate fauna on LHI.

The transfer of Thiobacillus delicatus to the genus Thiomonas as a distinct species, Thiomonas delicata (type strain NBRC 14566T), is confirmed by its morphological and physiological properties, DNA–DNA hybridization and the grouping of its 16S rRNA gene sequence with those of other species of the genus. An emended formal description of Thiomonas delicata is given. The status of Thiomonas cuprina DSM 5495T as a member of the genus is reconsidered.

Abstract:

Viene discusso il ruolo del consenso rispetto alla qualificazione giuridicopenale del trattamento medico-chirurgico. Si sostiene che il principio di autodeterminazione non può costituire unico criterio orientativo per risolvere le problematiche etiche e giuridiche oggi emergenti in ambito biomedico, configurandosi altrimenti il pericolo di una medicina puramente contrattualistica e difensiva, ovvero concepita non come scienza (umana), ma come mero insieme di abilità tecniche. Sono in questo senso evidenziate varie situazioni in merito alle quali il riferimento al consenso è impossibile o inadeguato. Si mette in luce, del resto, come sia coessenziale al concetto moderno di democrazia il confronto teso a definire convergenze su ciò che risulti fondamentale per la tutela della dignità umana, e dunque a definire linee-guida condivise circa settori di attività particolarmente delicati. In particolare vengono sviluppate motivazioni pertinenti anche in un contesto laico e pluralista al fine di mantenere fermo il divieto giuridico dell’eutanasia sia passiva che attiva, nell’ottica di un approccio solidaristico alla sofferenza: approccio che dalle normative favorevoli all’eutanasia risulta inevitabilmente compromesso. In questo senso, è individuato un limite intrinseco al diritto nell’impossibilità di autorizzare giuridicamente una relazionalità inter-soggettiva – come quella fra medico e paziente – giocata per la morte. La questione dell’eutanasia viene tenuta distinta, ovviamente, dai problemi attinenti all’accanimento terapeutico e alla proporzionalità dell’intervento medico. In rapporto alla permanente validità giuridica del principio di indisponibilità della vita uno specifico approfondimento è dedicato all’interpretazione dell’art. 32, 2° comma, della Costituzione italiana. Sono altresì presi in considerazione problemi concernenti i soggetti incapaci, il ruolo della norma sullo stato di necessità, i compiti assolti dai comitati etici ospedalieri (anche con riguardo alla responsabilità dei relativi membri) e la necessità di nuovi modelli giuridici intesi alla prevenzione degli eventi medici “avversi”.

Vi sono 2 motivi per cui la MAV cerebrali si pongono come un problema neurochirurgico particolarmente difficile da affrontare. In primo luogo l'indicazione al trattamento (e con quali metodiche); e in secondo luogo l'obiettiva difficoltà tecnica che queste lesioni presentano alla chirurgia. Quali sono le MAV che si giovano di un trattamento chirurgico? Questa decisione si basa sulla storia naturale, la cui previsione è tuttora deducibile più dalle modalità d'esordio clinico che dagli aspetti morfologici. Sulla base dei dati della letteratura sono state redatte delle tabelle di calcolo per il rischio individuale di emorragia nell'arco di una vita che sono uno strumento imprescindibile per affrontare questi delicati problemi terapeutici in maniera razionale. Per quanto concerne il rischio chirurgico sono stati identificati precisi fattori di rischio morfo-funzionali che permettono una quantificazione preoperatoria del rischio di mortalità e morbilità cui può andare incontro il paziente, una volta operato. Inoltre, la terapia delle MAV è oggi un intervento multidisciplinare, in quanto nel percorso decisionale si inseriscono anche le opzioni di tecniche alternative quali il trattamento endovascolare e la radiochirurgia. Attualmente il nostro orientamento è quello di riservare alle tecniche di embolizzazione un ruolo di ‘preparazione’ al trattamento definitivo, sia esso chirurgico o radioterapico. Le nostre osservazioni sulla terapia chirurgica delle MAV cerebrali si basano su 175 casi personalmente operati. La chirurgia delle MAV cerebrali richiede una alta specializzazione nella microchirurgia vascolare affiancata da una adeguata struttura organizzativa. L'esperienza personale può orientare nella indicazione al miglior trattamento possibile, senza tuttavia pretendere di rappresentare un algoritmo decisionale assolutamente attendibile e standardizzabile. Infatti, mancano studi randomizzati di terapia radiochirurgica, endovascolare o microchirurgica, in grado di definire i criteri di trattamento. Questi studi, che richiedono una collaborazione multicentrica, sono necessari per stabilire la prognosi dei pazienti portatori di MAV cerebrali.

In this paper, I report on a long-term research project concerned with the elaboration of the description of the system of PROCESS TYPE (within the overall system of TRANSITIVITY), extending this description in delicacy, or degree of detail. I discuss the background to the research and different approaches that have been taken to the development of more delicate descriptions of PROCESS TYPE. Then I introduce the approach that I have taken — to classify Levin’s (1993) verb classes in terms of the systemic functional description of the system of PROCESS TYPE (Halliday 1967/8, 1985). Having outlined the approach, I summarize the outcome of the classificatory project, and go on to identify all the instances where it was necessary to split verb classes and all the cases where it was necessary to add verb classes. I characterize the classification in terms of the cline of delicacy (the continuum between grammar and lexis); in fact, the result of the classificatory project provides strong evidence in favour of Halliday’s (1961) hypothesis that lexis can be described as delicate grammar — what he called ‘the grammarian’s dream’. In addition, I indicate how the result of the classification can be used as a resource in the development of more delicate systemic descriptions of the type pioneered by Hasan (1987) in her pursuit of the grammarian’s dream.

This paper is devoted to the issues of international criminal responsibility for the crime of genocide. The author explores the corpus delicti of it and draws attention to the problem of bringing the guilty persons to international responsibility. The author examines in detail individual acts constituting the corpus delicti: the murder of members of any national, ethnic, racial or religious group, causing serious bodily or mental harm to the members of such group, deliberate creation of such living conditions which are meant for total or partial physical destruction of the group; imposing measures intended to prevent childbirth within the group; forcible transfer of children from one human group to another. Special attention is paid to the problem of describing the individual elements of an act. The author supports all theoretical conclusions by examples from the practice of the International Criminal Court.

Abstract:

The present article deals with the qualification of the offences problem in case of specific legal norms of constitutional and criminal law conjunction along with the place of constitutional delicts in contemporary system of offences. Having analyzed the situations relating to constitutional provisions in other civilized countries the author has identified common indicia for definition of constitutional delict and crime (social danger, wrongfulness, culpability and punishability). It is concluded that there is an established interrelation of these law violations conditioned that crime could be the cornerstone of constitutional delict. Author propose the criteria for separation of these definitions by reference to social danger level of above named offences together with special status of constitutional delict actor and fixed sequence of constitutional and criminal incurrence of liability for such person. In view of fact that constitutional delict presents the highest level of social danger as compared with crimes and other types of offences, the author suggests to adopt the approach according to which the structure of contemporary system of offences that covers constitutional delicts as a hierarchical subsystem should be based with regard to underlying constitutional delict (crime, administrative offence, disciplinary case or civil tort); crimes with regard to broad understanding of their wrongfulness and minor offences (or other types of offences).

Abstract Invasive species are considered one of the greatest threats to native ecosystems, second only to habitat loss and fragmentation. Despite this, the temporal dynamics of invasions are poorly understood, with most studies focusing on a single time point, providing us with only a snapshot of the biology and genetics of the invader. We investigated the invasion of Lord Howe Island by the delicate skink Lampropholis delicata and assessed the introduction history and genetic structure of this species over a 5-year period. Using genetic data taken from 2007, and again in 2011/12, we examined changes in the population genetic structure (whether new haplotypes had been introduced to the island, and shifts in haplotype frequencies) of the species on the island between these two time points. No new haplotypes were introduced to the island between 2007 and 2011/12; however, significant shifts in haplotype frequencies across the island were detected. We conclude that the delicate skink is expanding its range into the southern regions of the island and that the haplotype frequencies on Lord Howe Island are still in a state of highly dynamic flux. Our study highlights the importance of considering invasions as dynamic and studying them in such a way that enable us to better manage their impacts.
