Full textThe thesis analyses the regulation of interests in payment obligations, especially in light of the recent judicial decisions which have affected the topic. In particular, given the social and economic importance of the credit activity carried out by the banks, the aim of the thesis is the so called “anatocismo bancario” (i.e., the capitalisation of interests applied by the banks) subject to frequent interventions in law and by courts during the last years. The set of rules providing for the “anatocismo bancario”, which I am determined to analyse in details also including its factual aspects, is very complicated and sometimes inconsistent. The thesis starts with the analysis of the common practice of the banks to include in the financial contracts clauses setting out the quarterly capitalisation of interests: in the last fifty years the possibility to waive article 1283 of the Italian civil code has been frequently recalled by the financial institutions to legitimate the above common practice. Therefore, the quarterly capitalization of interests was deemed legitimated on the basis that such banks’ common practice represents the so called "usi contrari" (contrary practice) under article 1283 of the Italian civil code. The thesis then proceeds analysing the Supreme Court’s decisions No. 2374 of 16 March 1999 and No. 3069 of 30 March 1999 which have marked a real change in the Supreme Court’s case law: the "usi contrari" (contrary practice) under article 1283 of the Italian civil code are to be intended as “usi normativi” (regulatory practice) and, on the contrary, the practice to include capitalisation clauses represented an “uso negoziale” and not an “uso normativo”. In particular, two important decisions of the Supreme Court have been analysed: (i) the decision No. 21095 of 14 Novemebr 2004 specifying the retroactive validity of the nature of the banks’ common practice as “usi negoziali” and therefore the clauses on the quarterly capitalization of interests executed before the new Supreme Court’s case law of 1999 have been declared null and void; and (ii) the decision No. 24418 of 2 December 2010 specifying that the effective date of the limitation period starts from the termination of the contract or from the settlement payment. Also the following decisions have been analysed as well as the following regulatory interventions till the Italian Law No. 147 of 27 December 2013 which has modified article 120, paragraph 2, of the Banking Law, requiring the Interdepartmental Committee for Credit and Savings (Comitato Interministeriale per il Credito e il Risparmio) to provide for terms and criteria of interests accruing in banking transactions. Following further regulatory interventions in February 2016 (Law Decree 14 February 2016 No. 18 which has further amended article 120, paragraph 2, of the Banking Law), the thesis analyses the expected resolution of the Interdepartmental Committee for Credit and Savings (Comitato Interministeriale per il Credito e il Risparmio) dated 3 August 2016. Moreover, the thesis analyses the criminal law aspects of compounding interests taking into account the relationship between capitalisation and usury. Also, the thesis sets out a comparison between the Italian regulation of interests in payment obligations and the English regulation.

Full textThe thesis studies the gender dynamics as a multilevel and situated concept. It aims to investigate, by a comparative perspective, the change of attitudes toward female roles in the public sphere, here assumed as indicators of egalitarian values. The study uses data from cross-national surveys as the European Values Study and the Eurobarometer. The scales included in these surveys are critically evaluated in order to test their adequacy for comparative analysis. The multilevel analysis, performed in 22 European countries, shows the different contributes of individual and contextual factors. The attitudinal change from 1988 to 2008, in 7 cultural contexts (included the “Three Italies”) focused on the trend analysis, observing gender and generations differences, mechanism of change and its predictors. The results confirm that the context is relevant in the development of egalitarian values and, to promote an egalitarian culture, they invite societies to increase the educational level and the female economic participation. To get this, societies need to re-organize themselves in terms of services and benefits for families, in order to get the model of relationship based on the reciprocity between gender really possible.

Full textAdipocytes are a cell population largely located in the human bone marrow cavity. In this specific microenvironment where adipocytes can interact with a variety of different cells, the role of fat is mainly unknown. To our knowledge, this report is the first to characterize mature adipocytes isolated from human bone marrow (BM-A) molecularly and functionally to better understand their roles into the hematopoietic microenvironment. Healthy BM-A were isolated after collagenase digestion and filtration. We studied the morphology of BMA, their gene expression and immunophenotypic profile and their functional ability in the hematopoietic microenvironment, comparing them with adipocytes derived from adipose tissue (AT-A). BM-A showed a unilocular lipid morphology similar to AT-A and did not lose their morphology in culture; they showed a comparable pattern of stem cell-surface antigens to AT-A. In line with these observations, molecular data showed that BM-A expressed some embryonic stem cells genes, such as Oct4, KLf4, c-myc, Gata4, Tbx1, and Sox17, whereas they did not express the stem cell markers Sox2 and Nanog. Moreover, BM-A had long telomeres that were similar to bone marrow mesenchymal stem cells. Notably, BM-A supported the survival and differentiation of hematopoietic stem cells in long-term cultures. These results showed that BM-A are stromal cells with a gene expression pattern that distinguished them from AT-A. BM-A showed stem cell properties through their hematopoietic supporting function, which was certainly linked to their role in the maintenance of the bone marrow microenvironment. Depending on specific demands, BM-A may acquire different functions based on their local environment.

Full textBackground Organizational health, well-being and quality of life in health care settings are issues of increasing interest for nurse managers. It is important in health care setting to evaluate organizational health of nurses with a method of active listening that will bring out the perception they have about their own organization. Researching in their field of organizational health, managers can analyze their context and define actions that take into account the suggestions of their staff. Objectives During the three-year of the doctoral program it has been designed and implemented a research study with the aim of assessing the organizational health of nurses. The following research objectives have been identified: A. to identify in the literature and eventually to develop or modify a specific instrument for assessing the organizational health of nurses; B. to correlate the organizational health with the quality of life in nurses; C. to identify correlations between organizational health and clinical care contexts; D. to carry out an investigation on a large number of nurses in order to develop a manual for nurse managers. This manual will allow nurse managers to easily assess the organizational health on their working environment. Methods The Nursing Organizational Health Questionnaire (NOHQ), that has been derived from the Multidimensional Organizational Health Questionnaire (MOHQ) has been developed in the present study. The NOHQ underwent to content validity ad was administered to a sample of 1279 nurses. Eighteen dimensions (scales) have been identified by factor analysis each of one showed good psychometric properties of validity and reliability. To reach the second objective of the research, a survey was conducted on a sample of 411 nurses working in the territorial emergency. In this study the NOHQ and the SF-12 (to measure quality of life) were administered. Overall, male nurses had better mental health, better perception of their coordinators and higher appreciation (in terms of effectiveness and organizational efficiency) for their organization. Female nurses complained more psychophysical symptoms and showed more negative indicators of organizational health. For the third objective, 542 nurses were recruited in several university hospital in Italy: 337 nurses were enrolled from Medical Units and 205 from the Operating theaters. In this study it was demonstrated that operating room nurses had lower levels of organizational health and satisfaction than their colleagues working in the Medical Units. Statistical analysis also revealed that the organizational health did not differ among age and gender. With regard to the manual (objective D) a study with 4334 nurses was carried out in several health settings. This manual meticulously explains the different steps to investigate the organizational health in one’s own health context. It also gives procedures to administer the NOHQ, elaborate the data and understand the results. Conclusions The various studies conducted over three years allowed the validation of a new tool to measure the organizational health of nurses. It was possible to demonstrate how the quality of life of nurses is closely related to their organization and how some specific organizational circumstances can affect the mental and physical health in male and female nurses as well as in younger and older nurses. It was also demonstrated how the working context can affect the organizational health in nurses. In the medical units nurses have better organizational health than in the operating theaters; this means that in the first context nurses have a more positive perception of their organization, probably due to the relational and communicational aspects with patients. Finally, the manual will give the opportunity to nurse managers to better manage the personnel, carrying out surveys in their contexts, to properly use the NOHQ, to elaborate the data and to interpret the results.

Full textThis work consists in a reconstitution of the corpus of fragments ascribable to the Constitution of the Spartans by Aristotle through the translation and the exegetical, historical and historiographical commentary. Within the corpus of both the fragments preserved by the indirect tradition and the extract of Heraclides Lembo, the Alexandrian scholar of the second century B.C., who created an epitome of the Aristotelean Politeiai, which, in all likelihood, came to us in a further epitomized form by an anonymous excerptor. Since the substantial fidelity of the original extracts from Heracleides to the original version by Aristotle has been proved and accepted. For what concerns the presence of topics and the succession of the information, the Spartan extract is used, when possible, as a support element for the reconstitution work of the corpus in the recognition and numbering of fragments. The points of reference were the previous editions of Aristotle's fragments of indirect tradition made by V. Rose and O. Gigon and the Historicorum Fragmenta Graecorum (FHG) of C. Muller. In this work have been recognized as fragments both texts with explicit quotations from Aristotle or from the discussed work by Aristotle, and texts, in which there is just a strong similarity with others which can be connected with the Aristotelian pamphlet. Some information which emerged from the work led to proceed with a new and different numbering of the fragments compared with the one proposed by Rose and then by Gigon. The translations were made trying to respect as much as possible the Greek text both from the lexical and the syntactical point of view. This was to prevent distortions of the vocabulary and of the structure of the citing source, which could made difficult to detect distortions operated from the translation on the traditionalized text by Aristotle. The comments faced textual problems, where necessary, more frequently historical, historiographical, and, in some cases, philological issues; it was first tried to give an account of the choices regarding the allocation of the fragments, their boundaries within the texte- source and the numbering which has been attributed to them. For some texts it has also been proposed the recognition of doubtful fragments, potentially attributable to the Aristotelian pamphlet. These texts are not recognized by previous editions and graphically identified by the question mark. The parallel texts, i.e. the texts that report a content similar to that of the already recognized texts as Aristotelian, do not show explicit mention either of Aristotle or his work and they are graphically identified with an asterisk. Full textIn order to provide adequate nutrition to preterm infants with very low birth weight (< 1250), enteral nutrition is often associated with nutritional support by intravenous lipid emulsions. They allow to achieve a high energy intake without excessive glucose and are a source of essential fatty acids. The essential fatty acids linoleic (C 18:2 ω6) and α -linolenic (C 18:3 ω3) are important precursors for the synthesis of arachidonic acid (ARA C 20:4 ω6), eicosapentaenoic acid (EPA C 20:5 ω3) and docosahexaenoic acid (DHA C 22:6 ω3). The availability of adequate amounts of fatty acids, precursors and derivatives, is important for the growth and development of preterm infant: especially ARA and DHA are necessary for the neuro-intellectual development. The lipid emulsions also contain phytosterols, plant sterols that are not synthesized in humans, but which are taken through the diet. Some studies show that phytosterols as potentially dangerous for their possible association with cholestasis. The aim of this study was to analyze plasma lipid profile (fatty acids and phytosterols) of 144 preterm infants on parenteral nutrition. They were randomized to receive 5 different lipid emulsions, of which 2 containing fish oil (Lipidem® and SMOF®) and 3 conventional (Intralipid®, ClinOleic® and Lipofundin®). The content of fatty acids and sterols was analyzed by chromatographic analysis (TLC, GC/FID, GC/MS) . These results shown that the emulsions containing fish oil determine a modification of the plasma lipid profile. More in detail, they determine a significant increase of ω 3 fatty acids, especially EPA and DHA, and they induce a significant reduction of plasma phytosterols. Nevertheless, we have not found an association between high levels of plasma phytosterols and cholestasis. Further studies of follow-up are necessary to assess the development of neuro- intellectual patients.

Full textFarm4trade is an Italian startup that develops high-tech systems for the breeding of production animals and for animal health in general. Among the applications developed there are computer vision systems that take advantage of machine learning. Among these the most important are Photo Animal Identification (PHAID) and Automatic Detection of Abattoir Lesions (ADAL). In the case of these computer vision systems, the business challenge is to release into production to maximize application use to the company clients and to obtain predictions and overall results in real time. These systems must also seamlessly integrate with all business solutions and deliver information to third-party systems. The research work led to making important decisions with respect to the deploy technique of the systems that aimed to the business needs for efficiency and scalability. For the deployment, an MLOps approach was introduced for the integration of Machine Lerning models with CI / CD and DevOps technologies and the IT stack of corporate web solutions. The release of Machine Learning systems according to the model used was found to be efficient and responsive to business needs. All the models make inference in real time and are capable of transmitting information through the API to corporate systems and those of third parties. We expect to improve the MLOps model through the development of web solutions that are increasingly aimed at integration with the ML model that the various applications require.
