Abstract:
Abstract Predation is a major cause of mortality and nest failure in birds. Cooperative predator defense can enhance nest success and adult survival but, because it is inherently risky, dynamic risk assessment theory predicts that individuals modify defense behavior according to the risk posed by the predator. Parental investment theory, on the other hand, predicts that reproductive payoffs (brood value) determine investment in nest defense. We propose that, in cooperative breeders, fitness benefits deriving from the survival of other group members may additionally influence defense behavior (social group benefits theory). We tested predictions of these theories in the cooperatively breeding purple-crowned fairy-wren, Malurus coronatus, where brood value is higher for breeders, but social group benefits more important for helpers. We recorded experimentally induced individual defense behaviors in response to predator models presented near nests, representing differing levels of threat to nests and adults. As predicted, 1) individuals engaged in less risky defenses when encountering a more dangerous predator (dynamic risk assessment theory); 2) individuals defended older broods more often, and breeders defended more than helpers (parental investment theory); and 3) helpers were more likely to respond to a predator of adults (social group benefits theory). Our findings highlight that predator defense in cooperative breeders is complex, shaped by the combination of immediate risk and multiple benefits.

Abstract:
Defense mechanisms are unconscious processes that protect a person from excessive anxiety. They are part of everyday functioning, and mature defenses are associated with positive outcomes. However, the excessive use of defenses or the use of immature defenses is associated with psychopathology. The present study aims to analyze the defense mechanisms that characterize two types of heavy study investment: Studyholism and Study Engagement. We performed a path analysis, MANOVAs, and binary logistic regressions on 422 Italian college students (Mage = 22.56 ± 2.87; 63.5% females). Among the main findings, the strongest (and positive) predictor of Studyholism is regression (maladaptive defense), while for Study Engagement, it is task-orientation (adaptive defense). Hence, Studyholism might be defined as a new potential clinical condition. Additionally, a critical analysis of all the defense mechanisms predicting Studyholism supports the appropriateness of the OCD-related framework for conceptualizing Studyholism. Regarding Study Engagement, even if generally associated with a positive defense style, the finding that it is positively predicted by projection confirms previous studies suggesting that, for some students, it might constitute a coping strategy with paranoid symptoms (and social anxiety and anxiety). Hence, we recommend screening engaged students for social impairment and clinically relevant symptoms that might be hidden by hard studying.

Abstract:
By considering the demand and supply effects of defense investment and the uncertainty of the stochastic process of the production and defense investment, this study proposes a stochastic endogenous growth model to explore the impact of defense investment on economic growth. The results suggest that the relationship between defense investment and economic growth rate is nonlinear and obtains the optimal percentage of defense investment to maximize economic growth. Moreover, the impact of defense investment volatility on economic growth rate is subject to production and defense investment interference term's covariance and representative private investment risk preference. Finally, the empirical data are used to illustrate the applicability of the proposed model.

Abstract:
More than fifty investor-state arbitration claims have been filed by foreign investors against the Republic of Argentina due to the country's adoption of measures to mitigate the consequences of a severe financial crisis that struck the country in the early 2000s. Argentina invoked the Non-Precluded Measures (NPM) clause in the U.S.-Argentina Bilateral Investment Treaty (BIT) and the necessity defence in customary international law as its defense in these arbitrations. As a result of taking divergent approaches to interpreting the NPM clause in the U.S.-Argentina BIT, the tribunals reached inconsistent decisions on Argentina’s liability for damages incurred by foreign investors, which intensified the legitimacy crisis in the investment arbitration regime. Consequently, the tribunals’ approaches to interpreting the nexus requirement of the treaty NPM clause (the "necessary for" term) caused a fierce academic debate among scholars. This thesis studies the issues related to the inconsistent interpretation of treaty NPM clauses and the customary necessity defense in the investment arbitration regime. It presents a detailed examination of the necessity defense in customary international law and treaty NPM clauses through the lens of regime theory. By applying relevant concepts of regime theory, such as regime formation, regime attributes, regime consequences and regime dynamics, this work explores the origins and evolution of the necessity doctrine, and provides a comparative analysis of the attributes, structural elements and the consequences of invoking the customary necessity defense and treaty NPM clauses. This thesis analyses the interpretative issues in the Argentine cases, and based on the dynamics of developments in the practice of states, it arrives at concrete proposals that will contribute to the coherent practice of investment arbitration tribunals in interpreting treaty NPM clauses. By applying the concept of interaction of regimes, this thesis provides a comparative analysis of tests suggested by scholars for interpreting Article XI of the U.S.-Argentina BIT. It examines whether the interpretative testsmargin of appreciation, proportionality and less restrictive meansused by dispute settlement bodies in other specialized treaty regimes have the potential to serve as an optimal standard for interpreting Article XI. This work explains the contents of these tests and inquires as to the advantages and criticisms related to their application in the investment arbitration regime. This thesis further advances the argument that the interpretation of treaty NPM clauses (Article XI of the U.S.-Argentina BIT) should be performed with strict adherence to the general rules of interpretation as established under Article 31 of the Vienna Convention on the Law of Treaties (VCLT). Specifically, it argues that in cases when tribunals fail to define the meaning of a treaty provision under Article 31 (1) and (2) of VCLT, they should not look for guidance from other specialized treaty regimes, but rather, must have recourse to general international law, specifically, customary rules of international law. As a methodology for performing this interpretation, this thesis proposes to apply a systemic integration approach through operationalizing Article 31(3)(c) of VCLT. Furthermore, this thesis advances the argument that the interpretation of the only means requirement of the customary necessity defense (Article 25 of Articles on the Responsibility of States) does not accurately reflect the contemporary customary rules on necessity. Thus, by applying the concept of regime dynamics, it proposes to reconceptualise the interpretation of the only means requirement through incorporating the elements of a more progressive version, which is found in the international trade regime. Unlike the scholars who rejected the application of the customary necessity elements, and proposed the direct importation of the LRM test from the international trade regime to interpret Article XI, this thesis proposes a different approach to taking advantage of the WTO jurisprudence. Specifically, it argues that WTO jurisprudence can be incorporated into the investment regime indirectly by serving as a source from which we can identify the development of state practice in examining the "only means" nature of state measures adopted in emergency (necessity) circumstances. It is contended that such state practice represents a more progressive and practical approach to interpreting the only means requirement of customary necessity defense, and thus, should be incorporated into the interpretation practice of investment arbitral tribunals.

Sophisticated cyber threats represent a significant adversary in the evolving world of the cyber domain. Furthermore, determining whether or not an attack has taken place and the extent of the damage caused requires significant resources. In order to guarantee reliable detection, prevention and mitigation of these advanced threats, the Department of Defense (DoD) must invest in advanced information security technologies that increase the defensive capabilities of its information networks. This thesis focuses on Security Information and Event Management (SIEM) systems as an enabling technology that possesses the advanced security capabilities required to address sophisticated, evolving cyber threats. The research explores the capabilities of this technology in terms of the speed of detection, depth of investigative power, and additional value provided. Additionally, this research attempts to quantify the return on investment that a SIEM solution could provide when deployed in a notional DoD network architecture. Ultimately, the research provided in this thesis endeavors to justify DoD investment in SIEM technology. The focus of this research revolves around a qualitative description of the inherent capabilities of SIEM products and utilizes several Return on Security Investment models in an attempt to quantitatively define the value of these capabilities in a DoD network.

Abstract:
The purpose of this Master's work Strategy, presented in the Institute of Social and Political Sciences, is to study the strategies and development policies for the diversification of the Angolan Economy: Promotion of Private Investment. In this context, we intend to analyze the Foreign Direct Investment and the challenges it poses to the national economic development of the Angolan State. In this dynamic, according to several authors, FDI has played an increasingly important role in boosting economic and social development of many countries. This study aimed to investigate the evolution of the Angolan production structures, understand the business strategies in the interest of agents operating in the market, the type of state intervention in the economy and the need to move from a primary specialization model to an alternative economic development model. This study aimed to further answer the question of departure: What is the economic development strategy to be implemented by the Angolan State, in view of the proper use of existing resources and meeting the needs of the general population? We conclude that diversification is a concern of economies and the Angolan economy is no exception. The changes for this to happen require infrastructure of human resources and capital and consistent policies and, in fact, Angola has been the target of much-oriented FDI to Africa, with the oil sector that has benefited most from this trend, so we understand that the country needs to do more to diversify economic activity, improving the environment business in order to attract more investment to the various sectors, by implementing a replacement model imports, which is for some authors the most appropriate for economies in transition.

Abstract:
AbstractJapan emerged from the 1980s as a leading net exporter of foreign direct investment, with very little corruption. Since 2001, it has accelerated ratifications of standalone bilateral investment treaties as well as investment chapters in free trade agreements. Almost all allow foreign investors from the home state to directly initiate investor–state dispute settlement (ISDS) arbitration against host states to get relief from violations of substantive treaty commitments. Japan’s investment treaty practice on corruption and illegality is intriguing. First, from around 2007, its treaties have often urged host states to take measures against corruption. This should help Japan’s outbound investors. Second, Japan’s treaties have been less consistent in expressly limiting their protections to foreign investments made in accordance with host state laws. This can again benefit Japanese outbound investors as claimants, as the absence of a legality provision renders more difficult defences from host states, which typically have more corruption than in Japan. Japan may adopt more and clearer legality provisions if subjected to more inbound ISDS arbitration claims and/or if claims by Japanese outbound investors are mostly against well-governed host states with little scope for corruption. Yet both types of claims remain few. The shift may therefore come more from other counterparty states pushing for such legality provisions and Japan agreeing in its future treaties to demonstrate its overall commitment to combatting corruption, and to preserve the legitimacy of the ISDS arbitration system.

Abstract:
AbstractThere are multiple international agreements that require states to criminalise corruption. This chapter deals with the effects of such international anti-corruption agreements in the field of investment treaty arbitration. Focus will be placed on Asia. This Asian perspective is pertinent given the continued prevalence of corruption in many Asian jurisdictions, despite their growing economic importance. International agreements on corruption and their implementation in domestic law can have an unintended consequence in the field of investment treaty arbitration. This is because anti-corruption laws can provide states with an effective defence against an arbitral tribunal’s jurisdiction. This chapter concludes with a proposal on how this consequence can be tempered by applying to international investment law the more nuanced approach to illegality established in recent common law jurisprudence. The article will be divided into four sections. Section 4.2will survey multilateral and bilateral international agreements on corruption. Section 4.3 will discuss how international agreements on corruption have been implemented in the domestic laws of various Asian jurisdictions. It will consider differences in anti-corruption laws of Asian states and comment on whether such differences give rise to uncertainty as to the scope of corruption crimes. Section 4.4 will look into how host states can use anti-corruption laws as a means of evading the scrutiny by arbitral tribunals of confiscatory conduct. Section 4.5 will argue that the ‘all or nothing’ approach to investments tainted with corruption should be replaced with a balancing approach to illegality.

Abstract:
AbstractInternational law in the form of international investment agreements (IIAs) and investor-state dispute settlement (ISDS) judgements provide impetus to changes in domestic labour and labour market related social regulation and policies in countries hosting foreign investment. The International Centre for the Settlement of Investment Disputes (ICSID) has a leading role in defining the contents of international law in what comes to IIAs as it has administered the majority of known international investment cases and many IIAs include provisions directing investment disputes to be arbitrated through ICSID’s ad hoc tribunals. This chapter pinpoints a non-negligeable incidence of ISDS cases including labour-related claims and defenses. Irrespective of the labour related claims’ success in arbitration, the analysis finds five different levels of these cases’ impacts on domestic regulation in host states.

Abstract:
AbstractThe so-called geoeconomic turn stands for the increased tendency of countries to use economic policy instruments to promote or defend national interests vis-à-vis trading partners or rival powers. Scholars note a similar shift in trade and investment policies of the European Union (“EU”). However, there are few studies that examine whether this proclaimed shift at the policy level is reflected in outcomes. Against this background, this chapter examines the EU’s ability to position itself as a defensive geoeconomic actor. Based on three exploratory case studies—investment screening, Most-Favoured Nations clauses in Free Trade Agreements (“FTAs”), and the EU’s (non-)response to China’s Belt and Road Initiative (“BRI”)—we find that the EU’s ability to act in line with its own geoeconomic ambitions varies across the policy initiatives studied. In particular, lack of alignment of individual EU Member States with a common EU policy stance serves as a possible challenge for implementing defensive geoeconomic policies. At the same time, we also find that that the EU’s own framing of what makes a policy initiative “geoeconomic” varies widely, and does not always correspond to the legal design or economic implications of a given initiative. These findings contribute to debates on the EU’s evolving relevance as a global actor and shed new light on recent conceptualizations of the geoeconomic turn.

Abstract:
Abstract The Department of Defense maintains an annual investment of $7.4 billion in basic and applied research and advanced technology development. This investment is the foundation of future systems and operational capability and supports an annual $70 billion investment in the engineering development, testing, and acquisition of new systems. The Materials Science and Technology Program at $330 million per year forms a significant part of this investment. Currently, approximately $90 million within the Materials Program is invested in composite materials of all types. These investments are described in context of the overall Defense Science and Technology Program and with respect to the future Defense capabilities and materiel opportunities that are enabled by composite materials. Emphasis is placed on the changing nature of the Defense missions, the platforms required to meet those missions, and the role of composite materials in Defense platforms. Significant challenges posed by expected operations and acquisition needs are related to composite materials. The need for improved affordability in composite systems is discussed in terms of current projects and future challenges and outlook.
