Abstract:
The book provides analysis of the principal rules of trust law which control the exercise of powers and discretions by trustees. The primary focus is on the principle known as "the Rule in Re Hastings-Bass", and this is considered alongside the doctrines of fraud on a power and mistake. This is the first book-length treatment focussed on this specific aspect of trust law, and in particular the first on the Rule in Re Hastings-Bass, which is the subject of much professional and academic interest especially following consideration by the Supreme Court in Pitt v Holt and Futter v Futter [2013] UKSC 26. Whilst considering Pitt and the Rule in Re Hastings-Bass alongside mistake and fraud on a power, the book also explains how these doctrines interact, and how the law regulates trustee decision-making as a whole. It sets out examples and considers extensive practical problems, allowing the reader to understand not only the core trust law rules, but also the broader consequences of those rules which arise in real cases. This aspect of trust law is of great practical importance for practitioners as it arises frequently in the context of trust litigation, and in advising trustees and beneficiaries of their rights and obligations. The newly settled state of the law after Pitt will encourage reliance on the Re Hastings-Bass and mistake rules by practitioners in challenges to trustees' conduct and decisions. This book equips all involved with the key principles and arguments in this area.

Social learning theory is one of the leading theories in the field of criminology. This chapter provides an overview of the role of choice and human agency within the theoretical framework of social learning and their integrative importance for understanding delinquency and crime. Emphasis is placed on research stemming from Herrnstein’s matching law, choice allocation, and statistical models of social learning as applied to social networks. The chapter provides a unifying discussion of choice-based theories of behavior, elaborates on existing statistical models used to test these choice-based and social learning theories, and suggests topics for an innovative research agenda grounded in the relevant literature. In addition, the chapter articulates a research agenda that will help researchers further promote empirical and theoretical advancements in the social learning tradition of criminology.

It also demonstrates the importance of personality to criminological inquiry more generally. The chapter begins with an explanation of what is personality, with a focus on two of the more common structural models used to measure it. In addition, a review of the robust association between personality and offending is provided. This is followed by an explanation of the theoretical and empirical linkages between personality and offender decision making. Abstract:
Sources of bias in confidence and probability judgments, for example conservatism, overconfidence, and subadditivity, are some of the most important and rigorously researched topics within judgment and decision making. However, despite the seemingly obvious importance of memory processes on these types of judgments, much of this research has focused on external factors independent of memory processes, such as the effects of various types of elicitation format. In this chapter, we review the research relevant to commonly observed effects related to confidence and probability judgment, and then provide a memory-process account of these phenomena based on two models: Minerva-DM, a multiple-trace memory model; and HyGene, an extension of Minerva-DM that incorporates hypothesis generation. We contend that accounting for the dependence of judgments on memory provides a unifying theoretical framework for these various phenomena, as well as cognitive models that accurately reflect real-world behavior.

Exposure to various forms of media can potentially impact decision-making by jurors in criminal trials. Cases like the highly publicized Casey Anthony trial, in which jurors’ media exposure might have affected the verdict, highlight the importance of understanding what messages jurors receive from the media and how those messages might influence their perceptions of trial participants and evidence. This chapter first explores research on the content of legally relevant news media, reality television, and scripted television dramas to better understand the messages the media might be delivering. Next, it reviews research suggesting how various media sources influence the development of legally relevant attitudes and, in turn, juror decision-making. The chapter then investigates the media’s direct influence on juror decision-making, focusing particularly on the CSI Effect. Finally, it discusses recommendations for jury system reform that might decrease media influence as well as future research directions.

Both at national and international level, the right to reproduce and form a family has considerable personal and social implications. The policies that underpin the regulatory approach in this area need careful consideration for their supporting values and principles. While regulation of reproductive decisions may be direct or indirect, it is virtually universal. Reflection on the importance of the decision whether or not to reproduce, irrespective of the sophistication (or not) of the techniques used to effect it, demands attention to the human rights guaranteed by national laws and international agreements. This remains the case whether or not the decision concerns an individual, a couple, or a nation. Thus, both individual reproductive choices and policies on population control must be measured against human rights norms. As regulation is generally based on policy decisions, it is also important to explore how policy is made and the assumptions that underpin it.

Innumeracy in the Wild explains how numeric ability supports the quality of the decisions we make and, ultimately, the life outcomes we experience. It dissects three ways that people can be good or bad with numbers and how each of these numeric competencies matter to decision making. Furthermore, it delves into how we can use this knowledge to improve decision making. Understanding the roles of numeric ability (often called numeracy) is particularly important today due to widespread innumeracy. In addition, policies in health and financial domains have shifted toward giving consumers and patients more information (which is often numeric). These changes are intended to empower individuals to take charge of their own welfare. The evidence is clear, however, that not everybody is prepared to use this information effectively and that those who are less numerate tend to make worse decisions unless provided adequate support. The book discusses four main points: the complex and systematic psychological mechanisms that underlie objective numeracy’s effects in judgment and decision making; the importance of numeracy to experiencing positive life outcomes especially in health and finances; the decision-making support provided by two additional ways of knowing and using numbers; and the methods that exploit existing evidence and enable those who are less comfortable with numbers to use them more effectively and make better choices in an often numeric world.

For over three decades, cultural psychologists have advocated the importance of cultural meaning systems and their effects on basic modes of perception and cognition. This chapter reviews findings which have demonstrated that culturally dominant ways of thinking influence people’s basic perceptual and cognitive processes: East Asians are more likely to endorse holistic thinking and dialectical thinking style when they process information, such that they incorporate more contextual information into their judgments of focal objects, and North Americans are more likely to endorse non-dialectical thinking and analytical thinking styles, by focusing on foreground information. The chapter also reviews recent findings related to higher cognitive processes in judgments and decision making processes. It emphasizes two lines of research showing how cultural differences in perception and cognition affect the online decision making process, one involving various online processes in decision making and the other involving how cultures experience indecisiveness in their decisions. Finally, this chapter introduces recent findings highlighting how cultural differences in perception and cognition affect how people make judgments involved in resource allocation, how cultural consistency values affect personality judgments, and how memory judgments are affected by neural cues. To close, it discusses the importance of this line of research and its future directions.

This chapter describes the importance of evidence-based decisions in health protection practice. It describes the hierarchy of evidence, from systematic reviews of randomized controlled trials to case reports and opinion. The chapter emphasizes the importance of assessing methodological quality, the quality of the evidence, and the risks of different types of bias. For policy to be as robust as possible it should be based on the best available evidence, and much evidence is useful even when it isn’t used in policy. Therefore, in this chapter, tools are described for reaching evidence-based recommendations, including the Evidence to Decision Framework. Factors that may influence policy development are reviewed, including social and political pressures that may impede evidence-based policy. Finally, the chapter considers critical appraisal of policy using the AGREE II tool.

Chapter 1 introduces the idea of the chain as related to investment management. It highlights the increasing importance and influence of the asset management industry and argues that, despite this fact, the behaviour and decision-making of asset managers has been little studied. The chapter suggests that investment decisions today cannot be understood by focusing on isolated investors. Rather, most of their money flows through a chain: a sequence of intermediaries that ‘sit between’ savers and companies/governments. The chapter introduces the central argument of the book that investment management is shaped profoundly by the opportunities and constraints that this chain creates.
