Full textThe present thesis, dedicated to prevention and repression measures of violence at sporting events, aims to outline a generally complete picture of the system that the Italian legal system has prepared over the years to counter the peculiar phenomenon of fan violence during sporting events (football matches, in particular). The thesis, after a brief clarification of the scope of the research, made through the distinction of the concept of fan violence (or football hooliganism) from sporting violence, is initially concerned with providing a historical reconstruction of the phenomenon, and then moving on to an examination of it in a socio-criminological key, taking into consideration both the scientific elaboration produced abroad (especially in the United Kingdom, but also in other European countries), and the studies carried out in Italy, which have highlighted some characteristics of the typical phenomenon of our country. The paper, in its first part, before dealing with the purely criminal (and procedural criminal) aspects of the matter, attempts to offer, from an interdisciplinary perspective, a key to understanding the phenomenon, useful for subsequently identifying the proportionality and reasonableness of the answer that the Italian legal system offers. Subsequently, the thesis takes into consideration the supranational sources – especially at European level – that have been issued in order to give common and harmonious answers to a phenomenon not limited by the borders of the individual nations. The 1985 Heysel massacre represents the tragic event that for the first time brought to the attention of both the European Community and the Council of Europe the serious dangers that football hooliganism can generate, especially in connection with major events; from that moment on, there has therefore been the gradual introduction of a supranational regulatory body aimed at standardizing the laws and practices of the European countries most affected by the phenomenon. The reference to these sources is useful, in the economics of the report, to verify whether the measures adopted by Italy are actually adequate to the standards developed by the European Union and the Council of Europe. The thesis then proceeds to describe, in an analytical way, the turbulent regulatory evolution that has characterized the national legislation to fight violence at sporting events, highlighting both the powerful development of personal prevention in this sector, and the introduction of a series of “differentiated” indictments and procedural provisions, aimed at completing the repressive response to the phenomenon; in describing the regulatory evolution, the critical issues that were proposed from time to time were highlighted: in particular, the various doctrinal positions developed over time were analyzed and the attempts made by jurisprudence (including constitutional) to offer an interpretation of anti-violence legislation that is as coherent and respectful of the rights of the individual as possible. The last chapter, more focused on prevention measures - both atypical (such as DASPO) and typical - aimed at people with sporting dangers, finally aims to bring out the specific problems that have arisen with regard to the preventive system of violence in stadiums, analyzing in particular the characteristics and criticalities of the “dangerous fan” category, without neglecting some due hints to the broader problems relating to the danger to public safety and, even more generally, to the legitimacy and compatibility with the constitutional system of the prevention measures present in the Italian legal system. In the conclusion of the thesis, there are some reflections on the framing of the preventive-repressive system to combat fan violence within the controversial paradigm of the criminal law of the enemy, as well as some observations on exporting within urban context (through the so-called urban DASPO) of the model effectively tested in relation to fans; Finally, some proposals for improvement of the current legislation are made, firstly, to make the existing measures more respectful of the rights of the individuals that are addressed to them and, secondly, to introduce an intervention on several levels, which does not neglect the cultural and social aspects of the phenomenon, and that it is no longer unbalanced on police repression and prevention, with the hope that the future legislator does not intervene, once again, under the pressure of the emergency.

This research s objective is to investigate the ways by which the modes of presence of Daspu s prostitutes figures are being restructured in the national journalistic communication under the impact of the homonymous fashion brand s website. It s about questioning if there were, since the website s appearance, any changes in the sense production of the prostitutes simulacrua they were figurativized by the brand in the same way they were made present in the current journalistic press. Our main hypothesis is that the presence of Daspu s prostitute figure would have promoted a change in the social visibility of the prostitutes linked with the brand in journalistic press. The theoretical references adopted were the postulates of Greimas semiotic theory. Through them we understand Daspu s prostitutes figures as semantic configurations that are discursively reiterated in audio-verbal-visual texts in the institutional brand s website and the journalistic texts that reverberate them. We also adopt Landowski s notion of simulacrum that defines it as the set of traces (linguistic or not) pertinent for a signification assignment installed by an addresser in a text, so it can be apprehended by an addressee. The syntaxic and semantic determinations held between addresser and addressee contribute to create a prostitute image that this partners send one another in the communication act. The research corpus gathers Daspu brand s institutional website, accessible at www.daspu.com.br and a set of reports extracted from different sections of Folha de S. Paulo s newspaper that show Daspu s prostitutes simulacra manifestations in the period between January 2005 and December 2010. The selection of such variety of reports aims to offer subsidies for the investigation of different types of simulacra build over the same basis of values as the referred website. We therefore infer that the senses produced are re-enunciated between press and digital medias and not only enunciated from the second one to the first
O objetivo deste trabalho é examinar como os modos de presença da figura da prostituta Daspu estão sendo presentemente reestruturados na comunicação jornalística nacional, sob o impacto do website da marca de moda homônima. Tratase de perguntar se houve, desde o surgimento do site, mudanças na produção de sentidos dos simulacros das prostitutas figurativizadas pela grife tais como são presentificados na imprensa jornalística atual. Operamos com a hipótese principal de que a presença da figura da prostituta Daspu teria promovido uma alteração na visibilidade social das prostitutas atreladas à marca na mídia jornalística. Tomandose como referencial teórico os postulados da teoria semiótica greimasiana, entendemos por figura da prostituta Daspu as configurações semânticas que são discursivamente reiteradas nos textos áudio-verbo-visuais do website institucional da marca e nos textos jornalísticos que os repercutem. Adotamos também a noção de simulacro de Landowski, que o define como o conjunto dos traços (linguísticos ou não) pertinentes para a atribuição de uma significação inscrita por um destinador, em um texto, para ser apreendida por um destinatário. As determinações sintáxicas e semânticas mantidas entre destinador e destinatário contribuem para forjar a imagem da prostituta que os parceiros enviam um ao outro no ato da comunicação. O corpus da pesquisa compreende o website institucional da marca Daspu, acessável em www.daspu.com.br, e um recorte dentre as reportagens extraídas dos diversos cadernos do jornal Folha de S. Paulo que trazem manifestações do simulacro da prostituta Daspu no período de janeiro de 2005 a dezembro de 2010. A seleção da abrangente variedade de reportagens objetiva oferecer subsídios para a investigação dos tipos de simulacros manifestos nos textos jornalísticos. O resultado mostra que as representações da prostituta nas pautas jornalísticas tem seus simulacros edificados sobre as mesmas bases de valores daquelas levantadas e analisadas no referido website. Full textThis master degree dissertation focuses on the publicizing of the fashion label Daspu, which has been developed by prostitutes from Rio de Janeiro, and the impacts of such publicizing on the receptors speech in regard to the spectacularized approach by the press media in reporting this label, as well as the their perceptions in regard to the prostitutes organized movement, whether as a resistance movement, or else as a compliance to power and to its social and moral values established in relation to prostitution. The methodology employed for the proposed survey comprises an exploratory documentary research for selecting a corpus, and a bibliographic research that supports the discussions about media culture spectacularization, as well as about power and resistance in contemporary society. As for the empiric research, we employed in-depth interview techniques to analyze the impacts of the media spectacularization on the prostitutes´N.G.O, who owns the label and a N.G.O. their leadership, and also a N.G.O. the reader/receptor audience of the chosen media vehicles. Considering that contemporary society is characterized by the hybridism between elements from both the spectacular and disciplinary societies, the media production surveyed here impacts individuals in odd ways, being a topic that, at the same time, entails reflection and a distant attitude. Our analysis about the publicizing of the Daspu label by the press media considers the spectacularization mechanisms that are present in the media texts examined, and the possibilities for both resistance and citizenship actions by the prostitutes group. It also ponders the receptors different readings of the media publicization, which involve issues ranging from the prostitutes victimization to their value assignment, the ways of the production of truth, as much as the power relations and knowledge relations set up in the contemporary world.
Esta dissertação de mestrado tem como objeto a divulgação da grife Daspu, de prostitutas cariocas, e seus impactos no discurso dos receptores sobre o tratamento espetacularizado da mídia impressa ao noticiar a grife, como também suas percepções em relação ao movimento organizado das prostitutas, se como movimento de resistência ou de obediência ao poder e seus valores sociais e morais estabelecidos em relação à prostituição. A metodologia utilizada para o estudo proposto é composta de uma pesquisa documental exploratória para a seleção do corpus e uma pesquisa bibliográfica que fundamenta as discussões sobre espetacularização na cultura da mídia, bem como sobre poder e resistência na sociedade contemporânea. Na pesquisa empírica utilizamos a técnica de entrevista em profundidade para analisarmos os impactos da espetacularização midiática no grupo de prostitutas da grife e suas lideranças, e no público leitor/receptor dos veículos escolhidos. Considerando-se que a sociedade contemporânea se caracteriza por um hibridismo dos elementos das sociedades espetacular e disciplinar, a produção midiática aqui estudada impacta nos indivíduos de maneiras díspares, sendo ao mesmo tempo objeto de reflexão e de distanciamento. Nossa análise sobre a divulgação pela mídia impressa da grife Daspu reflete sobre os mecanismos de espetacularização presentes nos textos midiáticos estudados e sobre as possibilidades de ações de resistência e de cidadania do grupo das prostitutas. Full textO presente trabalho é um estudo sobre a criação e aparecimento público da Daspu, marca de vestuário feminino que se tornou conhecida nacionalmente ao entrar em polêmica com a grife paulista Daslu, importante multimarcas de luxo. A Daspu foi criada em 2005, no Rio de Janeiro, pela Davida, uma ONG de prostitutas voltada para questões ligadas à cidadania, ao combate à vitimização, à discriminação, ao preconceito e ao estigma que atingem as mulheres que exercem essa profissão. E a marca surge publicamente através da imprensa, de modo inesperado para a Davida, antes que a confecção/grife estivesse estruturada. Com base no papel que a questão da autonomia relativa entre marca e imagem da marca adquire no caso Daspu, a opção desta pesquisa foi a de focalizar o processo de projeção pública da imagem da marca no espaço configurado pela mídia. Num cenário de várias confluências buscou-se a identificação dos temas que se cruzaram nesta cobertura, remetendo-os às suas condições de enunciação, dadas por posições e competências, e ao modo como se articulam na imagem da marca. Visando trazer uma nova inteligibilidade aos processos de produção de sentido presentes no caso Daspu recorre-se ao conceito de palavra de ordem, proposto por Deleuze e Guattari, como chave teórica para compreensão do caso, retomando as circunstâncias que possibilitam a enunciação Daspu transformar a idéia de uma confecção em uma grife possível, e potencializar social e politicamente a ONG Davida.
This is a study on the creation and public appearance of Daspu, women's clothing brand that became nationally known when entering into polemics with the São Paulo fashion Daslu, a leading multi-brand luxury. The Daspu was created in 2005 in Rio de Janeiro by Davida, an NGO dedicated to prostitutes to issues of citizenship, the fight against victimization, discrimination, prejudice and stigma suffered by women engaged in this profession. And it is made public through the press, unexpectedly for Davida, before the factory clothes / brand was structured. Based on the paper that the question of relative autonomy between brand and brand image in the case Daspu gets, the option of this research was to focus on the process of projection of the brand's public image caused by the action of the press in space configured by the media. Against a background of several confluences we sought to identify themes that crossed this coverage, linking them to their own conditions of enunciation, given by the positions and skills, and the way of their articulation on the brand image. In order to bring a new intelligibility to the processes of production of meaning that are present in Daspu case, we use the concept of word of order, proposed by Deleuze and Guattari, as a theoretical key to understanding the case, retaking the conditions that enabled the "enunciation Daspu" transform the idea of a clothing factory in a fashion brand, and potencialize socially and politically the NGO Davida.

Nos últimos 20 anos, observa-se no Brasil um fenômeno particular quanto à relação estabelecida entre grupos minorizados e meios de comunicação de massa: a tendência de deslocamento da figura da prostitutra das páginas policiais dos jornais para editorias de cultura nos anos 2000. Exerceram um papel significativo nessa mudança as ações de visibilidade promovidas pela organização não-governamental (ONG) Davida, dirigida pela ex-prostituta Gabriela Leite. Desde 1988, a Davida utiliza-se da mídia para divulgar imagens da profissional do sexo diferentes do esteriótipo de sujeito marginalizado. O uso das mídias pela ONG Davida foi feito de duas formas distintas ao longo de sua trajetória: por meio da utilização de veículos particulares e através da criação de eventos com potencial noticiável. A essa última merece destaque a grife de moda Daspu, lançada em 2005 com o objetivo de confeccionar roupas inspiradas nas mulheres da vida. Tendo como objeto de análise as matérias sobre a Daspu, o presente estudo é uma reflexão sobre o modo como: (1) As marcas identitárias de um grupo minorizado estão sendo veiculadas por sua militância e apropriadas pelos meios de comunicação de massa; (2) as influências desse processo na representação social desse grupo. Para isso, será utilizada a análise de conteúdo das matérias que abordaram a grife nos portais virtuais Universo Online (UOL), Terra e Internet Group (iG), durante os anos de 2006 e 2010. O quadro referencial adotado é a teoria do espaço social de Pierre Bourdieu (1983) e a teoria das representações sociais de Denise Jodelet (2001). Over the past 20 years, it is witnessed in Brazil a particular phenomenon regarding the relationship established between minority groups and means of mass communication: the tendency to shift prostitute's figure from newspapers' police pages to cultural pages during the 2000s. This shift is mainly due to visibility actions promoted by nongovernmental organization (NGO) Davida, run by ex-prostitute Gabriela Leite. Since 1988, Davida has been using the media to disseminate sex workers' images other than their stereotype, in which they are portrayed as marginalized people. Throughout its existence, NGO Davida has been using the media in two different ways: working with its own means of communication and creating newsworthy events. Among these events, it can be outlined the launching of fashion line Daspu in 2005, aiming the creation of outfits inspired by prostitutes' way of life. As Daspu is a genuine action from prostitutes' group, the information submitted by its outfits makes reference to an identity by the prostitutes, which is permeated by particular meanings. Considering articles about Daspu as an object of analysis, this research aims to reflect (1) how the identity required by the militancy of a minority group is being appropriated by means of mass communication; and (2) how this required identity could influence the social representation of this group. In order to prove this reflection, a content analysis of articles about Daspu published on the Internet was made. The articles selected were published on news provider services, such as Universo Online (UOL), Terra e Internet Group (iG), from 2006 to 2010. Theories used are Pierre Bourdieu's social space theory (1983) and Denise Jodelet's social representations theory (2001).
