Abstract:
Le législateur marocain a édicté une réglementation particulière aux baux commerciaux. Le dahir du 24 mai 1955 s’inscrit dans la réforme voulue par le législateur qui, dés 1930, a édicté une réglementation particulière aux baux commerciaux, jusque- là régis par le dahir des obligations et des contrats marocains. Ce dahir du 24 mai 1955 s’applique désormais aux baux d’immeubles ou locaux loués à usage commercial, industriel ou artisanal. Le droit au renouvellement du bail commercial constitue la pierre angulaire du dahir du 24 mai 1955. Il est accordé à tout locataire d’un bail commercial. Cette réglementation spécifique avait pour seul but la protection du fonds de commerce et des locataires contre l’éviction abusive des bailleurs. Cette protection avait comme objectif essentiel l’assurance de la stabilité du fonds de commerce. En favorisant la stabilité des baux commerciaux, le législateur souhaite protéger le locataire qui, souvent, a investi dans les lieux loués. On peut alors se demander, sinon faire le bilan de cette législation spéciale. A-t-elle atteint l’objectif qu’elle s’est assignée? Au vu de l’état actuel des choses, et après que ledit dahir ait été mis en avance, nul ne peut douter que cette législation ne constitue pas le remède approprié aux différentes situations des locataires
The dahir of 2 chaoual on 1374 (in May 24th, 1955) concerning the leases of buildings or premises rented (praised) in commercial, industrial or craft (home-made) custom (usage) joins in the reform wanted by the legislator who, from 1930, promulgated a particular rule in commercial leases, up to there governed by the dahir of the obligations (bonds) and the Moroccan contracts. This specific rule had for main objective the protection of the business and the tenants against the excessive (unfair) evictions. Indeed, these evictions have consequences on the developers and on the stability of the Moroccan companies. By facilitating the stability of commercial leases, the legislator wished to protect the buyer who, often, invested (surrounded) in the rented (praised) places. Did this special legislation on commercial leases make a success of the purpose for which, it had been created? Seen the current state of things, and after the dahir showed its ability, as we saw through this study, nobody can doubt that the solutions brought by the dahir of May 24th, 1955 do not establish (constitute) the remedy suited to the various situations of the tenant

Lorsque, dans un contrat, les deux parties sont marocaines, et que le contrat s’exécute au Maroc, il n’existe aucun problème pour connaître la loi applicable et le tribunal compétent en cas de litige. Tout problème est soumis au droit marocain et aux tribunaux territorialement compétents (domicile du défendeur ou lieu d’exécution du contrat). Mais lorsqu’il existe un élément d’extranéité dans le contrat, on se pose la question de la loi applicable (première partie) et du tribunal compétent (deuxième partie). La question est d’importance et mérite d’être examinée de très prés, car de la réponse qu’on y apporte découlent d’importantes conséquences pratiques
When the parties to a contract are Moroccan nationals and the contract itself is concluded in Morocco, we except no problem to raise to know the law to be enforced and the competent court in case a dispute at law shall raise. Every problem shall be considered subject to Moroccan law and nationwide concerned courts (defendant’s abode and place where the contract is concluded). But in case the contract has foreign origin criterion, we shall consider the question as to the law to be enforced (First Part) and the concerned court (Second Part). Such question is very important to the extent that it requires deep study since the answer may have important practical consequences/ repercussions

Abstract:
Quelle que soit l’origine de l’atteinte à l’intégrité physique subie par une victime, ses effets seront ressentis de la même manière. Du point de vue de la victime, il est en effet indifférent que l’acte dommageable soit fautif ou non, qu’il émane d’un individu ou d’un groupe, que son auteur ait pu être identifié, ce qui importe c’est le besoin d’indemnisation. Ainsi, le législateur marocain a adopté dans l’article 88 du DOC une règle spéciale concernant la responsabilité délictuelle du fait des choses. A l’image de notre pays qu’on dit à juste titre placé au carrefour du monde musulman et du monde occidental, le droit marocain s’efforce d’adapter aux préceptes de l’Islam les techniques juridiques européennes. Mais nos Codes n’ont donné lieu qu’à peu d’études doctrinales et leur application a parfois suscité dans les juridictions des interprétations divergentes. Dans ce travail, il s’agit pour nous d’aborder la question la plus délicate du droit de la responsabilité en essayant de dégager son évolution jurisprudentielle. Avant d’entamer le vif du sujet qui portera sur le but de la responsabilité, à savoir la réparation du dommage, un préliminaire s’impose, ce qui permettra d’envisager la question dans sa globalité y compris son aspect historique. Il faut retracer cette évolution, dont la connaissance est essentielle à la formation de tout juriste. Néanmoins, c’est essentiellement sur la base de ce texte que se règle en particulier la responsabilité des accidents de la circulation qui occupe actuellement la grande part du contentieux de la réparation des dommages. Désormais, la matière est appelée à jouer un rôle plus énergique notamment en matière d’incident nucléaire et d’atteinte à l’environnement
No matter what is the origin of the physical damage to the victim their effects will be felt in the same manner, from the victim’s point of view. Effectively there is no difference if it was as a result of a fault or not, if it was the act of an individual or a group or if the person responsible could be identified, the most important aspect is the need for compensation. There for the Moroccan legislator has adopted in the article 88 of DOC a special rule concurring the responsibility for offences originally from the effects of inanimate objects. In the image of our county which could rightly be said is at the crossroad of the Muslim world and the western world, Moroccan law seeks to adapt E. U legal techniques to the precepts of Islam. But our codes have give rise to only little doctrinal studies and their application has same times raises divergent interpretation in court

L'examen du contenu normatif des actes royaux (dahirs et decrets royaux) en droit marocain a travers le postulat de la separation des pouvoirs, nous met en contact avec une situation juridique bien propre au droit positif marocain. Au-dela de la verification du caractere legislatif ou reglementaire des actes normatifs du monarque, il importe de mettre l'accent sur l'originalite du systeme juridique marocain qui s'apparente a la famille des etats arabo-musulmans. Il reste qu'il s'agit d'une situation juridique qui necessite plusieurs lectures, en raison de la pluralite des systemes de reference (apport juridique occidental, impact de principes de droit musulman, la tradition locale de gouvernement). Le choix des actes normatifs royaux se base sur leur impact sur la hierarchie des normes, sur leur elaboration, ainsi que sur le role du juge.

Mouridiyya är en senegalesisk sufiorden, som sprider sig i världen genom att medlemmarna flyttar till nya städer och nya länder. De finns också representerade i Sverige och har bl. a bildat en bönecirkel, en dahira, i Stockholm. Syftet med uppsatsen är att undersöka hur mouridiska immigranter bygger upp sin organisation i Sverige, särskilt när det gäller religiös mötesverksamhet, ansvarsfördelning, ekonomi, könsperspektiv och koppling till Senegal eller Gambia, samt att undersöka om detta kan länkas till teorier om religion och migration. Vi har fått möjlighet att besöka den mouridiska gruppen och fått en att undersöka den utifrån vår frågeställning. Vi har varit med om en vanlig lördagsdahira samt besökt en konferens som Dahira Mouridoullahi Touba Sweden anordnade på temat ”islam och ickevåld”. Vi har genom fältstudier samt intervjuer skaffat oss en bild av dahiran och i nedanstående arbete presenterat det vi kommit fram till.

Abstract:
This thesis offers the first detailed study of publishing culture in the medieval eastern Islamic world by examining how two influential anthologists active in Central Asia mediated between authors and their audiences. It analyses the contents of al-Tha'ālibī's (d. 429/1037-8) Yatīmat al-dahr, a biographical anthology of Arabic poetry and prose concerned with the literature of the 4th/10th and the early 5th/11th centuries, comparing them with the material found in 'Awfī's (d. 640/1242 or before) Lubāb al-albāb, a biographical anthology of Persian poetry focused on verse produced between the late 3rd/9th and the early 7th/13th centuries. Yatīmat al-dahr and Lubāb al-albāb are approached as ventures which aimed to render the high culture of Arabic and Persian literature accessible to readers by presenting hitherto unpublished texts in a pedagogical fashion. The thesis contributes to a current wave of research that is concerned with the history of the book in the Islamic world, but it moves the focus of such scholarship onto literary texts and their manipulation. Its principal findings can be summarised as follows: Firstly, it revises the prevalent idea that literary culture was entirely dependent on patronage, by demonstrating how market demand influenced the kinds of writing produced in the different regions of the Arabic- and Persian-speaking worlds. Patronage emerges as a force that was intertwined with the book trade, which had already begun to define conceptions of authorship. Secondly, it shows that anthologies are more than collections of exemplary texts, by uncovering how al-Tha'ālibī and 'Awfī pursue the study of society, literary history and literary theory. The anthologists did not simply reproduce extracts, but edited them in accordance with their broader intellectual projects. Lastly, it reconstructs the cosmopolitan literary culture which existed in Khurasan and Transoxiana between the 4th/10th and 7th/13th centuries, showing that many authors worked in bilingual Arabic-Persian environments, moved between Arabic and Persian spheres, and read books in both languages. The thesis is accompanied by an index of circa eight thousand poems catalogued by genre, and by an appendix which lists the material that the anthologists drew from their sources.

Aussi longtemps, le droit de créance est demeuré intransmissible à titre particulier, seule la transmissibilité à cause de mort était admise. En droit marocain, le transport ou la cession de créance qui est une institution protectorale, est réglementée par le Dahir des obligations et contrats du 13 août 1913 au titre du transport des obligations en considérant que la créance comme un bien. S’il est admis que la créance puisse se transmettre à titre particulier, sa cession suppose le respect de certaines formalités. Cette exigence légale qui a pour double but de prévenir le débiteur cédé et toute autre personne intéressée à connaître l’actuel créancier atteint. Quelles sont les caractéristiques de la cession de créance en droit marocain ? et peut-on, dès lors, se satisfaire d’un système qui ne rend qu’un service limité par rapport au formalisme excessif qu’il suppose ?

Insulin-like growth factors (IGFs) and inflammatory cytokines (e.g. IL-1) affect cartilage metabolism in opposite ways. The actions of IGFs in biological systems are modulated by locally produced IGF binding proteins (IGFBPs). This thesis investigated the effects of the IGFs and inflammatory cytokines on IGFBPs produced by chondrocytes and the subsequent interplay of these factors on proteoglycan production in vitro. To do this, a primary culture of ovine articular chondrocytes was used as an in vitro experimental model system. It was concluded that the IGFBP-5-mediated decrease in proteoglycan synthesis could be a relevant in vivo mechanism by which IL-1 exerts its catabolic effect and disturbs the balance between the synthesis and degradation of cartilage matrix macromolecules in pathological conditions.
