Abstract:
ABSTRACT The purpose of this research is to describe the role and to find out the obstacles of Karang Taruna in Sajau Village in preserving customary forests based on local wisdom. This study used descriptive qualitative method. The results showed that the role of Karang Taruna in the preservation of customary forests in Sajau Village was to collaborate with customary institutions, village government, and the Sajau Village community to monitor, report, and enforce customary law based on local wisdom. Constraints in the preservation of customary forests are due to internal factors of the Sajau Village community taking wood in the customary forest without the permission of the customary institutions and the Sajau Village government and external factors there are people who do not know the boundaries of the customary forest, and the company is interested in buying customary forest land. The conclusions of the research are (1) the role of Karang Taruna in the preservation of customary forests, namely: Coordination with the village government and the Sajau Village customary institution to make and stipulate customary rules, conduct supervision, maintain customary forests, enforce customary law (2) Constraints in the preservation of customary forests, namely: Threats from within the village, communities from outside the village and threats from companies. Abstract:
The purpose of writing this article is to find out the role of customary functionaries in running the customary government system and the cooperative relations between these traditional partners in carrying out the customary government system for the indigenous people in Nafri Village. Both traditional partners from Nafri Village and also traditional partners from outside Nafri Village. This research can be categorized in the type of research with empirical aspects, because here we see the role of customary functionaries in the implementation of customary government law in the Nafri customary law community who sees the role of customary functionaries being carried out in reality. From the results of the study, it was revealed that customary functionaries have a very important role in carrying out the customary government system in the indigenous people of Nafri Village, both on ontofro and whase ontofro. And also these traditional functionaries have a cooperative relationship with traditional partners, both those from within the Nafri village itself and also traditional partners with villages from outside the Nafri village.

Abstract:
Aceh Province as an Islamic Sharia Regional has culture and customs based on the values of the Quran and Hadith. For the Acehnese people, customs and laws cannot be totally separated that Acehnese customary law continues to grow until the birth of Acehnese Qanun Number 9 of 2008 concerning the Development of Indigenous and Customary Life. In the implementation, the customary sanctions experience some obstacles due to their unwritten characteristic that made them slightly shifted by the presence of national law. As what happens nowadays in Central Aceh District which is famous with its traditional values, there found legal issues for the customary instrument (Sarak Opat) when the customary sanctions considered discriminatory and arbitrary. Therefore, the settlement of customary disputes must be in accordance with humanitarian principles prioritizing the principle of deliberation and peace although many obstacles still exist at the level of implementation because of lack of understanding by both community and customary instruments related to the implementation of customary itself.

This study aims to introduce the community to the customs of the Dayak tribe as well as to describe the role of the traditional head damang in handling cases of domestic violence that occurred in the city of Palangka Raya. The people of Central Kalimantan carry out their lives based on rules, norms or orders in navigating life that are regulated by traditional institutions in the form of kedamangan which in this kedamangan customary institution consist of damang, sub-district customary mantir, and village customary mantir. Damang is a customary leader and head of the district level customary peace mantir density who is authorized to enforce Dayak customary law in a customary area. The problem of domestic violence is a serious case that must be handled by the damang because the damang is a person who has the position to resolve and decide on a customary case that occurs in the adat community.

Abstract:
The existence of customary land rights in Article 3 of the Basic Agrarian Law is a common thing, because along with the territorial rights of indigenous peoples, they existed before the formation of the Republic of Indonesia. However, many problems with land in customary areas that arise in territorial and national sizes will never get a complete settlement without the fair treatment needed as a benchmark for determining the existence of customary rights and their implementation. The existence criteria for establishing customary rights consist of three elements, namely the existence of certain customary rights into the environment, the existence of certain customary law communities, and the purpose of taking the lives of indigenous peoples, and the existence of customary law regarding the maintenance of order, the use of controversial lands that apply and are adhered to by the government. culture. In this study using a normative juridical method. The results of this study show that there are still rules from the community, and there is no regulation on ulayat rights. Customary rights regulations can be a loophole for customary rights, even at the lowest level.

Customary law must be able to protect and serve as a legal umbrella for indigenous peoples in terms of resolving customary violations committed by tourists, so this research is to determine the effectiveness of the application of customary sanctions in resolving violations of customary "Aluk Todolo" communities in Tana Toraja and North Toraja Regencies and observe the application of sanctions customary law in resolving violations of the "Aluk Todolo" custom which can provide a deterrent effect for violators and become the basis for legal protection for people in Tana Toraja Regency and North Toraja Regency who carry out this rule, using empirical research by collecting data based on observed facts obtained from the results of interviews and direct observation. The purpose of this research is to show the different implementation of ulayat rights concept and the communal rights of a Land on the customary law community, after the enactment of Permen ATR/Head of BPN No. 10 of 2016., from the aspect of legal subject, object, characteristics, the validity is the same of not on the implementation based on the knowledge and the kindship system of the 9 (nine) ethnic group of customary law community in 12 (twelve) region of customary regency Jayapura, Province of Papua. This research using normative-juridical and empirical-juridical approach with a secondary legal material, observation, and interview, then the analysis has been done qualitatively which the reduction, presentation of legal material and verification. The Result showed that there are a perception differences on the government knowledge and customary law community knowledge of 9 ethnic group in 12 customary region on 4 development area of Jayapura. Especially the customary community of Sentani which are in the one of the development area, knows that the ulayat rights or communal rights is a common rights beside the individual rights, is different on its implementation. It means that for the 9 ethnic group of the customary law community of Sentani the concept of Ulayat rights are broad public rights and limited private rights to land, held and done by the head of the tribe, klen, and the main family, while the concept of communal rights is limited to the public rights and broad on the private of the land which done by the klen and the main family including the individual rights of the customary law community. The recognition of both differences of the concept on the implementation of ulayat rights and communal rights of 9 tribal ethnic group of Sentani on 12 sub-region of customary area of Jayapura, based on the knowledge and the legal system of kinship (the history of origin) genealogically and customary territorial and customary institution (social structure), the system of keondoafian leadership which are run until today, there are no legal certainty as the effort to overcome the differences in the concept of implementing ulayaat rights and communal rights as well as individual rights of the Sentani customary law community, Jayapura.

Abstract:
Customary law communities are the most important part of the history of the development of the Indonesian nation. The contribution given by the customary law community since ancient times has been very large for the development of human civilization, especially in the aspect of order that exists in customary law. The Baduy tribe is one of the customary law communities whose existence is still maintained to this day. The Baduy customary law community has a legal system including its government system which is the hallmark of indigenous peoples. In addition to using their customary government system, Baduy as well as part of the Unitary State of the Republic of Indonesia must participate in every national policy, especially in the area of ​​regional and village government. The recognition given by the 1945 Constitution of the Republic of Indonesia to indigenous peoples in Indonesia is the basis for the use of their respective customary law systems. Therefore, the researcher considers it necessary to conduct a study to see how the current system of governance of the Baduy customary law community is related to the existing positive law. The research method used is a normative juridical and empirical (mixed) juridical research method to see how the normative arrangements regarding the position of the Baduy community government system are and can describe what the government system is like. The specific target to be achieved in this research is to contribute ideas to the local government and the Baduy indigenous people in terms of the position of the Baduy customary government system in terms of the existing positive law. The results of the research carried out explain the Baduy customary law community uses a government system that originates from their customary law known as pikukuh or karuhun. Law 23/2014 on Regional Government gives authority to provincial and district governments to regulate the empowerment of indigenous peoples and the arrangement of customary villages through existing traditional institutions. This happens because community and village empowerment is included in the mandatory concurrent government affairs that are not related to basic services.

The Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia recently issued Ministerial Regulation of ATR No. 18 of 2019 concerning Procedures for Administration of Customary Land Community Units of Customary Law. However, the reality is that until now there are still ulayat lands of customary law community units whose management, control and use are based on local customary law provisions and are recognized by the members of the customary law community unit concerned. The research uses normative research, namely normative juridical research, namely research based on applicable laws and legal norms and has binding power to answer the legal issues faced. Diperoleh hasil bahwa Karakteristik hak ulayat masyarakat hukum adat, bahwa hak ulayat atas tanah tersebut dikuasai oleh masyarakat hukum adat, yakni masyarakat yang hidup berkelompok, turun menurun berdasarkan ikatan asal usul/leluhur atau kesamaan tempat tinggal, berbudaya sama, hidup dalam satu wilayah tertentu, memiliki harta benda adat milik bersama, mempunyai pranata adat mengandung sanksi, sepanjang masih hidup sesuai perkembangan dan tidak bertentangan dengan hukum nasional.Kata Kunci: Eksistensi; Hak Ulayat; Peraturan Menteri Agraria.

Abstract:
This discourse is a comparative study of the criminalisation of the violation of a corpse in context of traditional medicine in subequatorial Africa, including consideration of customary law and seeks specifically to examine whether the use of body parts for medicine falls within the paradigm of traditional medicine as opposed to professed any use in witchcraft. The question of any possible cultural defence for the violation of a corpse in traditional medicine is also examined. Regard has been given to relevant legislative precepts in subequatorial Africa including any common-law position, any statutory legislative precepts, including constitutional law, for the Democratic Republic of the Congo, the Gabonese Republic, the Kingdoms of Lesotho and Swaziland, the Republic of the Congo, the Republics of Angola, Botswana, Burundi, Kenya, Madagascar, Malawi, Mozambique, Namibia, Rwanda, South Africa, Uganda, Zambia, Zimbabwe, and the United Republic of Tanzania. In the Republic of South Africa, the violation of a corpse is a common-law crime, which sees its origins historically in Roman law and Roman-Dutch law. It has been found that the penal codes of the Democratic Republic of the Congo, the Gabonese Republic, the Republics of Angola, Botswana, Burundi, Kenya, Malawi, Rwanda, Uganda and the United Republic of Tanzania criminalise acts of violation on any corpse, but are applicable only to perpetrators and not to end-users, except for the Republic of Rwanda and the possessors of body parts for the Republic of Burundi. In the Republic of South Africa any removal of or trade in any body part in contravention of any law is also a criminal offence. Research has not found any specific reference to the violation of a corpse for the Kingdoms of Lesotho and Swaziland, the Republic of the Congo, the Republics of Madagascar, Mozambique, Namibia, Zambia and Zimbabwe in extant legislative precepts, but all subequatorial African constitutions provide for the right to life. Case law relating to the violation of a corpse for traditional medicine purposes has been found only for the Republic of South Africa, for the then-Rhodesia and the Republic of Botswana. In most of the subequatorial African countries, customary law is valid only insofar as it does not conflict with the constitutions of the majority of countries, with the exceptions of the constitutions of the Gabonese Republic, the Republic of Congo and the United Republic of Tanzania for which no provision for customary law in the constitutions of these countries has been found. In the Republic of South Africa, customary law, or a cultural defence is not condoned in instances of murder for body parts according to case law. Since research has discovered only a paucity of case law relating to the crime of violating a corpse in traditional medicine circumstances, it has not been possible to ascertain whether such use is widespread within traditional medicine, or confined to specific instances only. This discourse concludes that the legal position of the crime of violating a corpse for the use of body parts in traditional medicine in the Republic of South Africa should not be reviewed to accommodate such use, but that all relevant legal precepts should be reviewed and changed purposefully to provide for clarification for the specificity of this crime and to oppose any perception of such practices and beliefs in traditional medicine as being justified in any manner.

Com a crescente representatividade do setor de serviços na economia mundial, se torna cada vez mais necessária a pesquisa e a implementação de modelos que abordem as singularidades dos serviços em relação aos outros setores da economia. O presente trabalho tem por objetivo aplicar um plano de ações voltado à estratégia de retenção de clientes, identificando e abordando os componentes a serem implementados, pelo qual se obtenha uma vantagem competitiva sustentável no longo prazo, por meio de um atendimento diferenciado e pelo fortalecimento de uma cultura de serviços baseada no relacionamento com clientes e colaboradores. O plano de ações proposto está sendo implementado em uma empresa de medicina de grupo com atuação local, e por isso, além de se basear em vasta fundamentação teórica, foram consideradas as características da empresa e do mercado onde atua. Com os resultados advindos da validação parcial do plano de ações, uma vez que ainda faltam etapas a avançar, pode-se concluir que os primeiros passos em direção à retenção de clientes foram alcançados.
With the growing importance of the section of services in world-wide economy, research and the implementation of models that approach the uniqueness of the services in relation to the other sections of economy become more and more necessary. This dissertation aims at applying a plan of actions directed to the customer retention strategy by identifying and approaching the components to be implemented, through which a sustainable competitive advantage is obtained in the long term, by means of a differentiated assistance and by the strengthening of a culture of services based on the relationship with customers and collaborators. The plan of actions proposed is being implemented in a local company of group health care and, due to this, besides being based on an ample theoretical foundation, the company’s characteristics and the market where it operates, have also been taken into consideration. Considering the results that came upon the partial validation of the model, and the fact that there are still other stages to be accomplished, it is possible to conclude that the first steps towards to the retention of customers have been reached.

Healthcare leaders who struggle to understand the importance of interactions between patients, staff, and physicians can result in poor patient experience. Healthcare care leaders who understand the importance of patient experience can develop customer service training modules and tutorials to improve organizational outcomes. The purpose of this correlational study was to examine the relationship between staff communication, physician communication, size of the hospital, and patient experience. House's path-goal theory was used to frame the study. Secondary data were collected from hospitals in Northeastern Ohio, that reported patient experience scores through the Centers for Medicare and Medicaid's Hospital Consumer Assessment of Healthcare Providers and Systems survey database for the years 2016 and 2017. The results of the multiple linear regression indicated the results were significant, F(5, 144) = 56.822, p <.001, R2 = .652. The findings may provide health care leaders with tools to communicate with staff on how to improve patient experience through improving employee and patient engagement, thereby improving patient experience scores.

Esta dissertação discute a relevância, propondo um modelo de abordagem de gestão da qualidade conforme com os requisitos da lei fundamental da regulação de Serviços de Sangue, DL 267/2007, e com a norma global para sistemas de gestão da qualidade, ISO 9001. Esta abordagem usada descreve as várias etapas para a gestão eficaz de ocorrências, desde o seu relato, à sua classificação, tratamento com medição e análise risco associado e verificação da eficácia das ações tomadas. A eficácia do modelo teórico proposto foi verificado através da sua passagem para algoritmo informático num software comercial. Foi evidenciado neste software o cumprimento dos requisitos da abordagem teórica, pelo que a aplicação informática está conforme com os requisitos estabelecidos num procedimento documentado. Foi evidenciado, também, a rastreabilidade dos dados ao longo e toda a metodologia. A utilização de uma ferramenta informática também acrescentou valor ao modelo teórico, dado o acesso a toda a informação ser mais célere e de fácil acesso, quando comparado com o uso em suporte de papel.---------ABSTRACT: The issues management is a law requirement intended for regulation of “Blood Banks” and a quality management global requirement from ISO 9001. It is a critical activity, intended to to ensure continuous improvement on “Blood Bank”. Its goal is the continuous satisfaction of blood donors and transfusion recipients. Effective management and efficiency also depend on the effectiveness of the management of occurrence approach, namely in successful corrections, corrective actions and preventive actions. This paper discusses the relevance and it proposes a model approach to quality management according to the requirements of the fundamental law of regulation of “Blood Bank”, DL 267/2007, and according to the global standard for quality management systems, ISO 9001. This approach describes the various steps for effective management of incidents, such as his account, its classification, measurement and treatment using risk analysis and verification of the effectiveness of actions taken. The efficiency of the proposed theoretical model was verified through its transition to a computer algorithm trading software. It was demonstrated in this software that the requirements of the theoretical approach has been fulfilled by the computer application, which complies with the requirements established in a documented procedure. It was also evident that traceability of data across the methodology. The use of a software tool also added value to the theoretical model due to the access to all information to be faster and more easily accessible, when compared to paper.

AbstractBiocultural diversity refers to the dynamic interrelationship between the Earth’s biological, cultural, and linguistic diversity. The concept draws strength from the fact that biodiversity-rich regions of the world are also rich in cultural and linguistic diversities. This volume adds to scholarship in biocultural diversity with case studies from geographical Southeast Asia. The chapters presented in the volume, based on research in Brunei Darussalam, Indonesia, Malaysia, the Philippines, and Northeast India demonstrate i) how traditional ecological calendars and calendar keepers serve as repositories of knowledge on landscapes and their resources, ii) the importance of folk medicine for healthcare in contemporary Southeast Asia, and iii) how folk names of flora and fauna serve as condensed forms of traditional knowledge on biodiversity. While highlighting the importance of customary ways of knowing and categorizing the environment in areas such as resource management, conservation, and healthcare, the chapters also demonstrate that traditional environmental knowledge and the practical skills which accompany it are not necessarily widely shared and are under constant threat. As Southeast Asia marches forward in pursuit of economic growth, it would also have to ensure that its biocultural diversity stays alive, nurturing local communities for generations to come.

Customary use of plants in the treatment of ailments in Assam, India is a typical situation. Ethno medicinal study was led in a few topographically unique zones of the state and utilization of plants from Costus species were reported. The extent of study chose for the investigation range across seven organizational regions spread across Assam, India. The regions include Dibrugarh, Golaghat, Tinsukia, Dhemaji, Karbi Anglong, Goalpara and Kokrajhar. Different plants were reported and plants fitting with the said species were chosen for determining the relevance concerning its use in customary medication. The survey divulged that plants associated to three species of the genus Costus namely Costus speciosus, Costus pictus and Costus scaber were espied to be primarily ubiquitous in traditional medicine in the discrete contemplated regions. The species were predominantly utilized as prime ingrediants in hepatoprotactive and anti-diabetic formulations. Costus speciosus was perceived to be chiefly used in the treatment of hepatic disorders and ailments. Costus pictus was observed to be used customarily in the upper Assam region bordering Nagaland for treating diabetes and Costus scaber was being used in the area bordering Arunachal Pradesh for tending people with jaundice, snake bite etc. The research climaxed with the profiling of the costus species as annotated from the ethnomedicinal survey.

The new age has brought a new concept: to delay aging and dying for as long as possible. Most of the once-incurable, life-threatening diseases, which include malignancies, have today become chronic diseases and their poor prognoses—terminal condition and fatal outcome—are difficult or impossible for a large part of the population to accept. A holistic and multidisciplinary approach to the cancer patient has become increasingly complex due to the application of personalized medicine: the right medicine, for the right patient, at the right time. Surgery, oncological radiology, and medical oncology are on this path and are combined with modern diagnostics, especially genetics, but also with new domains: ethical, legislative, sociological, economic, customary, and spiritual. Success in determining the genetic map of humans has brought about emotional, psychological, cultural, and religious dilemmas. Spirituality is ubiquitous in sufferers of all nations, races, ages, and, regardless of different religious formats, it sets a need, almost an imperative, to create spiritual care teams (SCTs,). Developing countries have largely overcome the low-level state of enlightenment of certain communities which, even today, perceive cancer as God’s will, punishment, or destiny. On the other hand, their transition in some countries takes a very long time. They have not yet reached the level of a developed consumer society, and some have fallen into the trap of class stratification, corruption, and discrimination. Comprehensive, targeted individualization for each oncology patient is crucial to the final outcome of the malignant disease.

This chapter explores the second stage of the metagnostic narrative arc: subversion. Following the conception of a metagnostic revelation as both recognition and misrecognition, it examines the ways in which the revelation may unsettle labels and categories. First, central concepts of disability studies are introduced and explored, and it is suggested that terms such as disability and impairment are illuminated and interrogated by a metagnostic revelation, as it breaches the expected mapping between body and classification. Indeed, situating a given revelation requires a sudden renegotiation of the ontological balance between biological impairment and socially constructed disability, and also subverts customary narrative strategies for situating disability. Second, the individual’s relationship with a given disease is seen anew and challenged in light of metagnosis, as are concepts of disease, illness, and sickness. This chapter also serves as an introduction to key concepts in disability studies and philosophy of medicine.

The specialized literature does not confer a consensual definition of the quality in the pharmaceutical procedures. Nevertheless, most definitions imply the satisfaction of eth customers’ needs. The customers of the pharmaceutical procedures are the patients and also the professional persons from the domain of health that prescribe, issue and administrate medicines. The pharmacist is a professional person who is in direct contact with the patient, being the first professional person to whom the patients address when the affection is a mild one and they need counselling regarding the medication or diagnostic. The more complex the medication of the patient is, the more probable the side effects shall be. The morbidity and mortality may be consequences at the error of medication. The appearance of some medicines increases directly proportional to the errors of prescribing the medication. The quality in using the medication implies the choice of the medicine, the optimization of the compliance of the patient with the treatment, avoiding side effects, assuring the therapeutical objectives. The possibilities of appearing the errors being numerous, it is easy to understand why the assurance and improvement of the quality of the pharmaceutical procedures are important aspects for pharmacists and patients. The present paper has as purpose the qualitative improvement of the pharmaceutical procedures by the help of the pharmacist, thus the pharmacy becoming a supplier of pharmaceutical care of the best quality

This article covers a comprehensive study into preparations for and the conduct of telemedicine consultations that would provide for arranging and conducting high-quality remote sessions between a doctor and a patient. The purpose of our study is to detect the factors that have a positive impact on the healthcare services provision level, and to establish a procedure of conducting telemedicine consultations that would allow a clinic to provide medical health quickly, safely and with proper quality and to improve its customer focus. The work is novel in that such studies aimed at defining a telemedicine consultation algorithm have not been carried out in Russia before, therefore, the Department of Medical Informatics and Telemedicine of the Institute of Medicine at the RUDN University decided that it was necessary to hammer out a methodology of medical services provision. As part of the study, we viewed and analyzed pre-recorded telemedicine consultations and put together an expert team consisting of experts in various areas of medicine, as well as of patients. As a result of that work, this article lists and defines common mistakes that lead to conflicts and erode patients’ trust in a clinic, catalogues stages of preparation for a telemedicine consultation making it possible to reduce the number of errors in remote consulting and devises obligatory techniques of remote medical aid.

Public health in Kyrgyzstan is generally characterized by the dominance of inpatient care. There is an increase in hospitalization in all regions of the republic. This is an indicator of ineffective activity at the primary level, i.e. patients who have not been treated in polyclinics become hospital patients. This fact contradicts the goals of health care reform and shows that limited resources in health care are used inefficiently. A considerable part of the state funds is used for the treatment of privileged special patients. Accordingly, no more than 6% of budgetary funds are addressed for remaining citizens. During the analyzed period, the share of expenses for medicines decreased, most of the funds are aimed at increasing the salaries of medical staff, covering public services and other expenses. Customers who need state support do extra payment for doctors. Herewith a small share of their extra payment is used for treatment and nutrition in hospitals.
