Abstract:
The monograph reveals the concept, role and functions of the form of law in the modern Russian legal system. The author turns to the ontological foundations of knowledge of the sources of law. Attention is focused on the legal doctrine and its application as a form of law in modern legal proceedings both in Russia and in a number of neighboring countries. At the same time, judicial acts of a number of foreign states are being introduced into scientific circulation. The theoretical substantiation of the possibility of distinguishing the hypostases of the legal doctrine, considered as a condition for the formation of an open civil society, is given. The primacy of legal doctrine over judicial precedent and legal custom is proved against the background of its subsidiary effect in relation to a normative legal act. A significant part is devoted to the problems of modern codification activities and the prospects for creating a Code of laws of the Russian Federation. For a wide range of readers interested in legal issues. It can be useful for students, postgraduates and teachers of law schools.

Abstract:
The concept of customary international law, although differently formulated, was already present in early modern European debates on natural law and the law of nations. However, no scholarly monograph has addressed the relationship between custom and the European natural law and ius gentium tradition. This is a book on this neglected story, and offers a solid conceptual framework to contextualize and understand the ‘problematic of custom’, namely how to identify its normative content. Natural law doctrines, and the different ways in which they help construct human reason, provided custom with such normative content. ‘Normative content’ here means a set of fundamental moral values that foundationally help identify the status of custom as either a fundamental feature or an original source of ius gentium. Thus, the book explores what cultural values and practices facilitated the emergence of custom and rendered it a source of the law of nations, and how they did so. Two crucial issues will be at the core of the book’s analysis: first, it will qualify the nature of the interrelation between natural law and ius gentium and explain why it matters in relation to our understanding of the idea of custom; second, it will claim that the process of custom’s formation as a source of law calls into question the role of the authority of history. The interpretation of the past through this approach can, thus, be described as one of ‘invention’.

Abstract:
This chapter examines the rules of offer and acceptance in the formation of contract in Taiwan law. An offer is binding unless: the offer states otherwise, the revocation reaches the offeree before or at the same time as the offer, or if the offeree does not respond within a reasonable time. An acceptance only becomes effective when it reaches the offeror. The postal rule does not apply, but if the postal acceptance is delayed for reasons not attributable to the offeree, the offeror who knows of the delay must inform the offeree of it, otherwise the offeror will be bound at the time that the acceptance would normally have arrived. In a ‘battle of forms’ situation there is no binding contract if the different terms are core to the contract. Silence may amount to acceptance if communication of acceptance is waived by the offeror or by custom, or acceptance by conduct is inferred. There is no general requirement of form for a valid contract, but exceptionally, formalities are necessary.
