“We saw no issues,” reports the Department of Homeland Security in a self-study of its practices for detaining children at the US–Mexico border, “except one unsanitary bathroom.” The system is working as it should; all is well. “CBP [Customs and Border Protection] facilities we visited,” the report summarizes, “appeared to be operating in compliance with the 2015 National Standards on Transport, Escort, Detention, and Search.” A footnote on page 2 of the September 2018 document defines the prisoners at these facilities, the “unaccompanied alien children,” as “aliens under the age of eighteen with no lawful immigration status in the United States and without a parent or legal guardian in the United States ‘available’ to care and [provide] physical custody for them.” Available is in scare quotes. This tic of punctuation discloses to us that the parents of these children have been arrested and removed. They are not available, and cannot take physical custody of their children, because they themselves are in physical custody. In a further typographical error, the word “provide” has been omitted: the children are without a parent or legal guardian in the United States “available” to care and physical custody for them. The dropped word turns “physical custody” into a verb and sets this new action, to physical custody, in tense relation to “care.”

This article discusses about joint custody or alternating custody and the doubt about the doctrine that became mandatory. This research aims to answer the following problem: Does Law No. 13,058/2014 regulate the Mandatory Joint Custody or the Mandatory Alternating Custody? In order to introduce the problem, we aim to compare the features of joint custody and alternating custody, with the enactment of Brazilian Law No. 13,058/2014. We also aim to present the importance of the principle of the best interests of the child, to study the dimension of the family power, andto highlight the concepts and features of joint custody compared to the alternating custody in order to, finally, analyze the kind of guard that was regulated by Brazilian Law No. 13,058/2014. This is a theoretical research, based on the legal work of relevant authors in this field. Moreover, in this paper, we also address topics such as the parents' relationship with their children, family power, and custody and its types.

Abstract:PREFERRED CUSTODY MODEL ACCORDING DIFFERENT GENERATIONSMany Spanish families face family break-ups every year. When a couple who are divorcing have children, it is necessary to decide on custodial arrangements. Usually, custody is awarded to mothers, but joint custody is beginning to be used among Spanish society. The change towards this kind of custody is rather slow. Thus, the main objective of this study has been to analyze, in an exploratory way, which type of custody the participants from three different generations consider most appropriate. Moreover, participants’ believes about the similarities and differences between mothers’ and fathers’ capabilities for raising their children were explored. A sample of 144 subjects (adolescents, young people and adults), from both sexes, participated in the study, answering a semi-structured interview. Results show an increasing acceptance of co-parenting, but it is dependent on certain circumstances such as the capacity and desire for involvement that each parent shows towards their children. These data lead to an important reflection on the need for higher social changes in the distribution of parental roles.Key-words: sole custody, joint custody, different generations, parental roles.Resumen:Numerosas familias españolas se enfrentan cada año a la ruptura familiar. Cuando la pareja que se separa tiene hijos, es necesario decidir el tipo de custodia. Normalmente, la custodia suele recaer en las madres, pero la custodia compartida empieza a ser una realidad en la sociedad española. El cambio hacia este tipo de custodia es lento. Por ello, el objetivo de este estudio ha sido analizar, de forma exploratoria, qué tipo de custodia consideran más adecuada los participantes de tres generaciones. Además, se exploraron las creencias de los participantes acerca de las similitudes y diferencias entre las capacidades de padres y madres para cuidar y educar a los hijos. En el estudio participó una muestra de 144 sujetos (adolescentes, jóvenes y adultos), de ambos sexos, a quienes se les realizó una entrevista semiestructurada. Los resultados muestran un incremento en la aceptación de la custodia compartida, pero condicionada a determinadas circunstancias, entre las que destaca la capacidad y deseos de implicación que muestre cada progenitor con sus hijos. Estos datos conllevan una importante reflexión sobre la necesidad de mayores cambios sociales en el reparto de roles parentales.Palabras clave: custodia exclusiva, custodia compartida, diferentes generaciones, roles parentales

Objective: The aim of this paper is to develop an understanding of how child-perceived parental support and knowledge among children in Sweden differ across ten forms of residential arrangement. Background: Shared physical custody has become an increasingly common arrangement for children in separated families in many European countries. In an international comparison, Sweden has a high rate of parental union dissolution but also the highest prevalence of shared physical custody arrangements following divorce or separation. Over a third of all children with divorced or separated parents spend an equal amount of time living in both parental households. Method: We used data from the Swedish HBSC survey from 2013/14, which are focused on children in grades 5, 7 and 9 in the Swedish comprehensive school system (n=7360) and used perceived parental support and perceived parental knowledge scales as dependent variables in multiple ordered logistic regressions conducted separately by the sex of the parent. Results: The results show that children in shared physical custody report higher levels of parental support and knowledge than children in sole physical custody and equally high as those who live in a two-parent family. Children living in non-symmetrical physical custody arrangements report lower levels of paternal support and knowledge than children whose parents share physical custody equally. Maternal support and knowledge does not differ between children living in symmetrical and non-symmetrical shared physical custody arrangements, whereas paternal support and knowledge is lower in families where the child lives in an unequal residential sharing arrangement with the mother as the main co-residential parent. Conclusion: Post-divorce living arrangements are clearly associated with the relationship between parents and children, with children in shared physical custody reporting stronger relationships than children in sole physical custody. The cross-sectional nature of the data prevents us from drawing conclusions on causality, however.

When thinking about custodial arrangements after a divorce, there has been a shift from sole custody (mainly by mothers) to joint physical custody after a divorce. In certain countries, joint physical custody has even become the primary, legal custodial arrangement. Joint physical custody, whether implemented in legislation or not, is believed to be in the best interests of the child, as children can shape a postdivorce relationship with both their mother and father. Nevertheless, many studies on joint physical custody focus only on child outcomes. This study aims to investigate (1) whether custodial arrangements matter in addition to the parental divorce for parent–child relationships and (2) whether joint physical custody provides a better framework for parent–child relationships than sole custody arrangements. The study adds to the existing literature by including both the mother–child relationship and the father–child relationship. Moreover, joint physical custody is not only compared to sole maternal custody, but also to sole paternal custody. Using a dyadic subsample of Belgian parents and children from the Divorce in Flanders data set ( N = 623), we compare two indicators of the parent–child relationship (parent–child communication and parenting) for children with married parents, with children in joint physical custody, sole maternal custody, and sole paternal custody. The results indicate that (1) the custodial arrangements after divorce affect parent–child relationships, in addition to the divorce, with regard to both open and problematic father–child communications and the support and control of children by mothers and fathers; and (2) joint physical custody, compared with sole custody (either by the mother or father), provides a better framework to shape a postdivorce parent–child relationship with both parents in terms of open communications and support.

Abstract:
The principle 'best interests of the child' has been expanded by the legal community in recent years to apply to any matter involving children in family law proceedings. The weight ascribed to this principle, however, has been diluted. In custody, access and child protection cases, evidence of which custodial arrangements are in a child's interests are often presented by adult parties in prolonged and costly proceedings. The judge makes an order which is intended to meet the child's "best interests", in the child's absence. This paper first examines the historical and theoretical justifications for children's rights in Canadian and international law and the "best interests" principle. Second, the concept of "legal representation for children" is explored, with specific reference to inconsistencies in the jurisprudence concerning the role of independent representation for children. This paper argues that to truly reflect a custodial or access arrangement made in the child's "best interests", it is imperative that the child's voice be heard by the court through independent legal counsel assigned to represent that child's individual needs and concerns.

AbstractFrom a sociological perspective, this chapter discusses how agency interventions in the lives of children involved in family disputes, could become as child-centred and child-friendly as possible. It is divided into two parts, the first focusing on child health in family disputes, and the second on children’s participation and perspectives. The discussion sets out the results of several empirical studies of children in contact with family-law services and identifies implications for policy and practice. On a policy level, the author describes a need to dissolve boundaries between family-law proceedings and child welfare. To reach that objective in practice, the issue of children’s participation is connected to risk assessments and how best to communicate with children. The author explains how both the principle of care and the principle of participation can be simplified, then applied in practice, in order to contribute to the child’s sense of security and coherence. It is further argued that children’s participation can be enhanced, drawing on research of how best to communicate with them. Finally, the chapter explores children’s actions beyond participation, noting that, the children interviewed in one of the studies, emphasized their right to decide for themselves.

AbstractThis chapter addresses conflicts of interest that might arise when there are ongoing custody disputes and, in particular, how legal instruments can be used where parents disagree regarding a decision concerning a child’s health. When a child is younger than 16 years, their parents must, as a rule, give consent regarding health matters. The child has a right, however, to be heard, and the parents must act in the best interests of the child. Through the analysis of several potential scenarios, the authors discuss, from a Norwegian legal context, whether parents in conflict are in fact able to act in the best interests of the child, and whether the child’s right to participation is respected. The authors conclude that the limited legal or other tools provided to parents and/or health institutions can lead to sole custody being the only way to resolve the disagreement. However, the authors also point out the dilemma in cases where the custody dispute or the parental conflict is the reason behind the child’s need for treatment.

AbstractThis contribution maps and analyses the definition, purpose, and content of alternative legal proceedings in custody conflicts in the various Scandinavian legal systems. It finds that such proceedings occur both as part of legal and social services, but there is a lack of coordination between them. Expert mediators are involved in some of the proceedings, but their qualifications and methods are not yet defined. Ultimately, the conclusion is drawn that the lack of clear content, role definition, and coordination, results in alternative legal proceedings that insufficiently account for the rights and perspectives of the child.

AbstractThe introductory chapter presents the aim, outline, and content of the anthology. First, it describes the dilemmas and challenges that arise in custody disputes, drawing on pre-existing empirical research, discussions among policymakers, and legal scholars. Second, the chapter outlines the child welfare family-law systems of the Nordic countries. It is also argued that the focus on gender equality and the awareness of domestic violence have affected law and policymaking—as well as created new dilemmas when handling custody disputes in practice. Third, the chapter presents the paradigm shift through which children’s rights have been strengthened, for example, the right of every child to freely express their views in all matters affecting them (Article 12, The United Nations Convention on the Rights of the Child). However, the right to participation raises demands for practical implementation that, so far, have not been fully met. It is proposed that the nature and complexity of custody disputes are serious challenges for society that call for an interdisciplinary and comparative discussion. Thus, the aim of the anthology is to transcend disciplinary, institutional, and jurisdictional boundaries, in search of new knowledge that can integrate multiple perspectives and experiences. The anthology will explore how legal proceedings, in and out-of-court, can be applied to the complex problems inherent in these disputes.

AbstractUsing interviews with various families and mediators/lawyers involved in three types of out-of-court procedures in England and Wales, this contribution assesses, first, to what extent the interests of the child are in focus in such procedures. And second, whether in certain types of cases, the interests of the child are better protected by means of in-court procedures. The authors find that, while out-of-court procedures are generally child-focused, it is less common that they are child-inclusive or that the clear voice of the child is represented in the adult decision-making. Further, in the out-of-court context, ‘child welfare’ tends to be understood in terms of ongoing contact with both parents and co-parenting. Consequently, the protection of children from an abusive parent can be under-emphasized. In some instances, concerns about children tend to be overshadowed by the financial dispute. Additionally, given there is growing evidence that many children would like to be consulted in out-of-court family dispute resolution, and that (where it is appropriate and safe) this can be a positive influence on their wellbeing. Consideration is given to how current practice in family dispute resolution fits with the rights expressed in Article 12 of the United Nations Convention on the Rights of the Child. In conclusion, the authors highlight a need for distinguishing between different types of conflicts and adjusting procedures accordingly. For example, in high-conflict cases and/or those involving issues of child safety, the interests of the child might be better protected in court, rather than through out-of-court dispute resolution. Whereas in other situations, barriers to hearing the child’s voice out-of-court must be overcome.

AbstractThis contribution is a descriptive overview of alternative legal proceedings in custody conflicts in Swedish law. The relationship between the development of Swedish substantive family law and the effort to prevent parents from battling in court, is compared with the practical outcome of these efforts. The author notes the mechanisms put in place to avoid the initiation of formal judicial proceedings, such as: availability of cooperation talks (which can be initiated both by the parents themselves and by the court), mediation, and a mandatory information meeting. She describes the role of social services and the courts in these disputes, finding that the responsibility they have towards one another and in relation to the parents, is not always clearly defined in the law. She further identifies a number of challenges relating to how the regulation functions in practice. For example, the appointment of an independent mediator, which is relied upon in only 1–3% of cases. She argues that parents in custody disputes often have problems incompatible with the image of parents on which the custody dispute process was designed. The system lacks what could be described as diagnostic tools and that the Swedish out-of-court processes are too rigid, in the sense that they only fit some of the families targeted. They are not sufficiently adapted to the varying and often complex needs of a modern family.

Abstract:
The study is aimed at studying the regulatory features of the mental image of an adopted child in parents with different forms of custody of orphans. In connection with the preparation of the bill on the support of foster families and the mandatory psychological testing of foster parents, empirical research in this area has received particular relevance and significance. The sample consisted of: 1. social educators — adoptive parents who perform their functions on the basis of an employment contract on a fee and raise a different number of orphans; 2. Blood guardians — adoptive parents having kinship with pupils left without parents. A total of N = 110 people were examined. To identify the peculiarities of the image of the adopted child, a verbal version of the SOCH (I) technique was used (V. L. Sitnikova). The following results were obtained: 1. In foster parents, in the hierarchy of image components, the leading place belongs to the qualities of the child, revealing its features as the subject of social interaction — the “Social” component. It was also established that for large adoptive parents, the behavior of the child and its characteristics as a subject of activity are important, occupying the lower hierarchical positions in the form of ordinary parents. We explain this structural feature of the child’s image in the mentality of parents with many children by the presence of many problems that arise in the dyad “adopted child — adopted adult”. 2. It has been established that the blood guardians in the image structure of the adopted child do not have the component “family values”, which is an alarming fact. As you know, it is the values of the family that perform the regulatory function and form the unity of a small group that unites the concept of “we”. 3. When comparing images of a “good-bad” child, an important feature of the mentality of large social educators was revealed — the images of a “good-bad” child turned out to be weakly differentiated in their structure, which in the context of previously obtained empirical data can be interpreted as weak emotional and personal involvement in the process of education, as well as the presence of psychological distance in relations with foster children.

Children's cultural and creative products, designed specifically for the child demographic, aim to subtly influence children by integrating high-quality cultural resources through diverse design techniques. These products help children understand cultural content such as history, geography, local customs, and artistic aesthetics, thereby fostering cultural confidence. Despite the wide range of children's cultural and creative products, including educational toys and cultural heritage tools, there is a lack of a scientific and systematic method for classifying these products. This gap affects the accuracy of product design and market positioning, as well as limits the potential for product innovation. To address this issue, this study introduces an innovative card classification method aimed at establishing a scientific framework for classifying children's cultural and creative products, thereby enhancing the precision and innovation of product design.In this study, we first collected and created 20 cards representing different children's cultural and creative products. Subsequently, we invited nine scholars and experts from the fields of design and vocational education to conduct experiments on the Optimal Workshop, an online card classification analysis platform. The results from the 3D cluster analysis categorized these 20 cards into four major groups: interactive educational products, technology-integrated products, cultural and scientific products, and aesthetically practical products. We conducted a thorough analysis of these four categories of children's cultural and creative product cards and their grouping labels, finding that the interactive educational products category had the most products, while the technology-integrated products category had the fewest. The study further conducted case analyses and feature descriptions for each category.The experimental results demonstrate that the card classification method can effectively classify children's cultural and creative products, providing a reliable and reusable method for categorizing these products. This classification not only helps designers accurately position products and foster innovation but also meets the diverse needs of children. Additionally, this scientific classification method provides solid support for the marketing and sales of products.

This article presents recommendations on the principles of software development and design for an inclusive robot toy, using engineering tools and practices that assist in the development of a robot, focusing on the rehabilitation of children with disabilities. Such recommendations come from the experience acquired during three years of research in the FATA project. Abstract:
ABSTRACT The pandemic set a huge challenge to the work of coaches, as the circumstances required to have trainings at home and in an online learning environment for which there were no ready and custom-made materials. This led to our study, which is focused on structuring a methodology for online rhythmic gymnastics training for beginners. The study developed in two stages: during the first stage we created a questionnaire, we organized and filmed the new methodology with a total of 48 exercises, conducted an initial stage of testing a control and an experimental group, trained the parents of our participants to use the ZOOM platform; the online trainings were held for 3 months. The experimental group was trained in accordance with the methodology proposed, following a certain algorithm. The exercises of the methodology were demonstrated to the children with photos and videos, and the demonstrators were dressed and made up with costumes of famous characters from various fairy tales or children’s entertainment shows. The control group was trained using the methodology of their lead coach, in which the exercises were included in combinations, without prior study, and did not follow a specific training algorithm. After that experiment, during the second stage of the study, a final testing was made to evaluate the results, run a statistical processing, analyze the results and complete the project. The results from the analyses show that the methodology used in this algorithm and with the proposed photos and videos is well mastered by the beginner gymnasts. The difference in growth in both groups in the initial testing is minimal. In the final testing, the increase between the average values of the two groups increased significantly in favour of the increased maximum results in the experimental group. During the experiment, no children lost their interest in the conducted training as observed in the control group.
