Abstract:
A Work Project, presented as part of the requirements for the Award of a Masters Degree in Economics from the NOVA – School of Business and Economics
The typical indicator used to assess school performance is average test score results. Literature has pointed out serious weaknesses of this measure as a school performance indicator. The strongest criticism resides in the bias that may exist in socially disadvantaged schools. In fact, this measure does not take into account socioeconomic and other variables which are relevant in determining student‟s school performance and out of the scope of school control. Using school level cross-section data from Portugal for 9th grade exams between 2005 and 2010, I have explicitly calculated the impact of these variables on school achievement as regards exams. I found an important causal effect between socioeconomic variables and school achievement. This implies that average test scores are an intrinsically flawed instrument. For this reason, this study proposes an adjusted measure of school performance. This measure consists of a ratio between current average school scores and expected average school scores, taking into account the reference variables by municipality.

In this work we prove some results of existence and multiplicity of solutions for equations of the type (􀀀 ) u + V (x)u = f(x; u) in RN; where 0 < < 1, N 2 , (􀀀 ) denotes the fractional Laplacian, V : RN ! R is a continuous function that satisfy suitable conditions and f : RN R ! R is a continuous function that may have critical growth in the sense of the Trudinger-Moser inequality or in the sense of the critical Sobolev exponent. In order to obtain our results we use variational methods combined with a version of the Concentration-Compactness Principle due to Lions.
Neste trabalho provamos alguns resultados de existência e multiplicidade de soluções para equações do tipo (􀀀 ) u + V (x)u = f(x; u) em RN; onde 0 < < 1, N 2 , (􀀀 ) denota o Laplaciano fracionário, V : RN ! R é uma função contínua que satisfaz adequadas condições e f : RN R ! R é uma função cont ínua que pode ter crescimento crítico no sentido da desigualdade de Trudinger-Moser ou no sentido do expoente crítico de Sobolev. A m de obter nossos resultados usamos métodos variacionais combinados com uma versão do Princípio de Concentração- Compacidade devido à Lions.

Abstract:
The purpose of this study was to examine the relationship between the constructs measured by the Watson-Glaser Critical Thinking Appraisal and the Graduate Record Examination Analytical Scale in "gifted" adolescents 15 to 17 years of age. There were three hypotheses addressed in this study: 1) "gifted" adolescents would be able to think critically as measured by college level norms when measured by the Watson-Glaser and the GRE-Analytical; 2) significant differences would exist between different levels of gifted populations; and 3) a factor or group of factors of the Watson-Glaser subscales would significantly predict performance on the GRE-Analytical Scale. The Watson-Glaser and the GRE-Analytical were administered to 104 high school students, most of whom were seniors in high school or in the summer preceeding their senior year. The subject pool labeled "national gifted" consisted of 50 students in summer programs for academically gifted sudents at the University of Indiana and Western Kentucky University. The "local gifted" group consisted of 54 students in secondary schools in western Kentucky and northern middle Tennessee. Analysis of Watson-Glaser total scores indicated that the national group mean was at the 60th percentile and the local group mean was at the 30th percentile when compared to college senior women. GRE-Analytical total raw scores converted to scaled scores were 580 for the national group and 440 for the local group. Statistical analysis confirmed the significantly superior performance of the national group over the local group on both instruments. Pearson product-moment correlation coefficients were calculated to examine the relationship between the GRE-Analytical and the Watson-Glaser for both national and local samples. The relationship between the performance on the two instruments was highly significant for both groups. The local group data were subjected to stepwise regression analysis to determine which individual subscale or group of subscales best predicted GRE-Analytical performance. In the local sample, Subscale 4 clearly emerged as the best single predictor. Pearson product-moment correlation coefficients based on a median-split of data from each test indicated that lower half total (national plus local) and local group scores were slightly more consistent than were the upper halves of these groups. Implications of these results for expanding the cognitive processes and motivating the gifted student were discussed.

Abstract:
In the oil and gas industry there is a high focus on integrating technology in the environmental monitoring happening before, during and after an offshore operation. In order to properly monitor the underwater environment, good images are needed. This can be achieved when proper equipment is used together with an underwater platform. There is a need for a good strategy on how to do underwater imaging in different environments. The strategy is used by the personnel involved in the operation, and to ensure that the right equipment and platform is selected for the job. A strategy on underwater imaging is presented and can be applied to analyse environmental monitoring operations from a top-down approach. The lack of natural light in underwater operations and the effect this has on the visibility is also of great importance. This is presented and investigated through an imaging experiment. Analyses of control methods have been conducted for ROV Minerva. This is a ROV that has been tested and developed through the AUR-Lab at the Department of Marine Technology at NTNU. In unknown areas and with poor visibility, it is important to maintain a good control of the ROV. The focus has been on how a joystick can be used with manual control and in a closed-loop control to make it easy for the pilot to navigate the vehicle. A joystick simulation system was developed for testing the joystick, and full scale experiments were conducted using ROV Minerva. The tests show promising results for using a joystick in closed-loop control. The different methods can become an important tool when navigating mobile platforms during underwater operations in known and unknown areas. The conclusion cannot account for all situations, as it also highly depends on the experience of the pilot. Therefore the joystick control should be tailored for each operation.

Abstract:
Pupil influence is supported by UN convention and legal text, yet it seems to be difficult to realize in school practice. Meaning and purpose of pupil influence appears unclear and can be understood and interpreted in different ways. The aim of this study is to examine, describe and thereby contribute to a better understanding of the phenomenon of pupil influence. The method used is Fairclough’s three- dimensional model for critical discourse analysis. The empirical data consists of focus group interviews with 9th grade pupils and the curriculum, Lgr 11. Four discourses are identified and discussed in relation to the results-driven and market-oriented Swedish school; a learning discourse, an individual discourse, a responsibility discourse and a conditional discourse. The results show that the pupils look upon pupil influence in school in relation to subject knowledge here and now and not as skills to acquire for a future active democratic citizenship. Contrary to the curriculum the pupils articulate pupil influence as a prerequisite for learning. Pupil influence seems to be regarded as individual and personal, and equated with having opportunities to make decisions. Areas possible to practice pupil influence on are characterized by being measurable and to provide a basis for comparison.

Why do African learners continue to be underrepresented in the top 20 positions of the Grade 12 examination results, and what can be done to remedy the situation? Yosso's notion of community cultural wealth shows that it is because our education continues to exclude the African learners' ways of knowing and being that the situation remains as it is. Analysing discourses of top performing white former Grade 12 learners, their teachers, their parents and their former African classmates, indicate that including modes of knowing of all learners in the curriculum irrespective of their race, class, disability or gender may help to create more socially just schooling, which is reflective of sustainable learning environments.

Os elementos de combustível de um reator nuclear de pesquisa tipo MTR (\"Material Testing Reactor\") são, em sua grande maioria, formados por placas de combustível revestidas com alumínio contendo no cerne silicileto de urânio (U3Si2) disperso em matriz de alumínio. Essas placas possuem espessura da ordem de milímetros e comprimentos muito maiores em relação à sua espessura. Elas são dispostas paralelamente no conjunto que forma o elemento combustível, de maneira a formar canais entre elas com poucos milímetros de espessura, por onde escoa o fluido de refrigeração (água leve ou água pesada). Essa configuração, associada à necessidade de um escoamento com altas vazões para garantir o resfriamento das placas em operação, pode gerar problemas de falhas mecânicas das placas de combustível devido às vibrações induzidas pelo escoamento nos canais e, consequentemente, acidentes de proporções graves no caso de velocidade crítica que possa gerar o colapso das placas. Embora não haja ruptura das placas de combustível durante o colapso, as deflexões permanentes excessivas das placas podem causar bloqueio do canal de escoamento no núcleo do reator e levar ao superaquecimento nas placas. Para este trabalho, foram desenvolvidas uma bancada experimental com capacidade para altas vazões volumétricas (Q=100 m3/h) e uma seção de testes que simula um elemento combustível do tipo placa com três canais de resfriamento. A seção de testes foi construída com placas de alumínio e acrílico e foi instrumentada com sensores de deformação, sensores de pressão, um acelerômetro e um tubo de pitot. As dimensões da seção de testes foram baseadas nas dimensões do Elemento Combustível do Reator Multipropósito Brasileiro (RMB), cujo projeto está sendo coordenado pela Comissão Nacional de Energia Nuclear - CNEN. Os experimentos realizados alcançaram o objetivo de chegar à condição de velocidade crítica de Miller com o colapso das placas. A velocidade crítica foi atingida com 14,5 m/s levando a consequente deformação plástica das placas que formam o canal do escoamento. O canal central na entrada da seção de testes apresentou uma abertura de 3 mm em seu centro, causando um grande bloqueio do escoamento nos canais laterais. Este comportamento foi v constatado visualmente durante a desmontagem da seção de testes, ilustrado e discutido na análise de resultados apresentado neste trabalho. O bloqueio dos canais também foi observado por meio de gráficos de queda de pressão e por gráficos das deformações da entrada, centro e saída das placas contra a velocidade média da seção de testes. Observou-se uma queda da resistência hidráulica da seção de testes devido ao aumento da seção transversal de escoamento no canal central e um aumento exponencial das deformações quando da ocorrência da velocidade crítica. Comparativamente, o valor experimental obtido para velocidade crítica na seção de testes foi da ordem de 85% do valor obtido por cálculo com a expressão teórica de Miller. Os experimentos realizados permitiram um melhor entendimento da interação fluido estrutura em elementos de combustível tipo placa como: valores de frequências de vibrações naturais, instabilidade fluido elástica e desenvolvimento de técnicas para a detecção de valores de velocidade crítica.

One of the most important tasks that business leaders undertake in order to achieve a superior market position is strategic planning. Beyond this obligation, business owners desire to maximize profit and maintain steady growth. In order to do this, resources must be invested in the most efficient way possible in order to achieve performance excellence. Adjusting business operations quickly, however, especially in times of economic uncertainty, is extremely difficult. Business leaders therefore need insight into which elements of organizational improvement are most effective in order to strategically invest their resources to achieve superior performance in the most efficient way possible. This research examines the results of companies which have a demonstrated ability to achieve performance excellence as defined by the National Institute of Standards and Technology's Malcolm Baldrige Criteria for Performance Excellence. This research examined award-winning applications to determine common input factors, compared the business results of a subset of those award-winners with the overall market for a time-frame of 11 years, and then investigated the profitability, liquidity, debt management, asset management, and per share performance ratios of award-winners compared with their industry peers over 11 years as well. The main focus of this research is to determine whether participation in performance excellence best practices have created value for shareholders and business owners. This objective is achieved through the analysis of performance results of award winning companies. This research demonstrates that the integration of efforts associated with performance excellence is in-fact advantageous.

Abstract:
Our criminal justice system works very hard to prevent criminals from harming other individuals; however, unfortunately mistakes happen. One wrongful conviction is one too many. There are multiple factors that can be assumed to be the cause of wrongful convictions. However, due to the lack of directly related research, the determents are not well established. The following research addresses wrongful convictions as a result of public defender representation. Through the process of theory construction, the research uses critical race theory and social disorganization theory to show the relationship between court appointed representation and wrongful convictions. A new theory is also established that is referred to as the partial load reduction theory. This theory establishes the relationship that exists between wrongful convictions and public defender representation and provides solutions as well as new avenues for future research.

Abstract:

This study examined interpersonal relationships among youth from different ethnic communities. The purpose of this study was to examine interpersonal relationships among youth from different ethnic communities in Kenya, especially the vulnerable population of individuals with disabilities, and the ways interpersonal relationships between youth from different ethnic communities change as a result of ethnic conflict. This study utilized survey methodology to gain a better understanding of interpersonal relationships between youth from different ethnic communities and individuals with disabilities. The sample of the survey comprised 42 participants between the ages of 18 and 35 who were in Kenya during the postelection conflict of 2007 and 2008. This study found that some participants experienced strain in their friendships with individuals from different ethnic communities, particularly those that were fighting against one another. Both participation in and harmful action against individuals with disabilities were also reported. However, the experience of youth with disabilities was not dissimilar to that of their nondisabled peers. This study has the capacity to lead to additional studies with a larger sample size within and outside of Kenya, and to break apart key findings into individual studies.

This research is linked to the project Critical Genre Analysis and implications for multiliteracies (HENDGES, 2012b). Our investigation concern the graphical academic abstract (GAA), a not regular discursive practice at the academic context, which coexists with the academic abstract (AA) in Tables of Contents of scientific journals and at the HTML version of the academic article, combining verbal and visual semiotic modes. Methodologically, we investigated the GAA from the perspective of Critical Genre Analysis (MEURER, 2002; BHATIA, 2004; MOTTA-ROTH, 2006, 2008). This theoretical and methodological approach enables investigate, textually and contextually, the rhetorical organization of the RAG, through the analysis of the different semiotic modes that constitute it, in order to verify standards for defining the RAG as (a new) genre. Forty GAAs from four scientific journals in Biodiversity and Chemistry (CAPES, 2014) were selected. For the contextual analysis we carried out: i) interviews with researchers of the investigated areas; and ii) documental analysis. For textual analysis, we carried out: i) identification, description and categorization of the meanings of semiotic modes that constitute the GAA, based on Systemic Functional Grammar (HALLIDAY; MATTHIESSEN, 2004), on the Grammar of Visual Design (KRESS; VAN LEEUWEN, 2006) and on metadiscourse markers (MORAES, 2005 conf. VANDE KOPPLE, 1985; CRISMORE; FRANSWORT, 1989; BAKHTIN, 1988; 2011, e.g.); and ii) identification of recurrent rhetorical patterns in GAAs (SWALES, 1990). This analysis showed that, although the GAA presents typical rhetorical movements of other academic genres, it is a new genre because the realization of these rhetorical moves is necessarily multimodal, especially realized by the visual semiotic mode. This characteristic differentiates the GAA of the AA because it enhances the communicative multi-purpose to attract the reader and summarize the research reported in an article. The critical study of GAAs allows to interpret new discourses available in the academic context, considering the multiplicity cultural and materialization of meanings. That study can also assist to propose teaching methodologies to promote multiliteracies.
Esta pesquisa está vinculada ao projeto guarda-chuva Análise crítica de gêneros e implicações para os multiletramentos (HENDGES, 2012a). Nossa investigação recai sobre o resumo acadêmico gráfico (RAG), prática discursiva não regular do contexto acadêmico, que, quando ocorre, coexiste com o resumo acadêmico (RA) nos Sumários de periódicos científicos e na versão HTML do artigo acadêmico. O RAG se materializa pela combinação dos modos semióticos verbal e visual. Metodologicamente, propomos investigar o RAG sob a perspectiva da Análise Crítica de Gêneros (MEURER, 2002; BHATIA, 2004; MOTTA-ROTH, 2006, 2008), abordagem teórico-metodológica que possibilita realizar o objetivo de investigar, textualmente e contextualmente, a organização retórica do RAG, por meio da análise dos diferentes modos semióticos que o constituem, a fim de verificar padrões que permitam definir o RAG como (um novo) gênero. Quarenta RAGs de quatro periódicos científicos das áreas de Biodiversidade e de Química (CAPES, 2014) foram selecionados. Para a análise contextual realizamos: i) entrevistas com pesquisadores das áreas investigadas; e ii) análise documental. Para a análise textual, realizamos: i) identificação, descrição e categorização dos significados dos modos semióticos que compõem o RAG, com base na Gramática Sistêmico-Funcional (HALLIDAY; MATTHIESSEN, 2004), na Gramática do Design Visual (KRESS; VAN LEEUWEN, 2006) e nos marcadores metadiscursivos (MORAES, 2005, conf. VANDE KOPPLE, 1985; CRISMORE; FRANSWORT, 1989; BAKHTIN, 1988; 2011, p. ex.); e ii) identificação de padrões retóricos recorrentes em RAGs (SWALES, 1990). Essa análise evidenciou que, embora o RAG apresente movimentos retóricos típicos de outros gêneros acadêmicos, é um novo gênero porque a realização desses movimentos retóricos é necessariamente multimodal, com destaque para o modo semiótico visual. Essa característica o diferencia do RA, pois potencializa o multi-propósito comunicativo de atrair o leitor e sintetizar a pesquisa reportada em um artigo. Esses propósitos dão conta da recorrente necessidade da comunidade científica de otimizar o tempo de busca e seleção de artigos acadêmicos para leitura e de otimizar a divulgação dos resultados da pesquisa científica. O estudo crítico de RAGs possibilita interpretar os novos discursos disponíveis no contexto acadêmico, considerando a multiplicidade cultural e de materialização dos significados, podendo auxiliar na proposição de meios pedagógicos capazes de promover os multiletramentos.

Specifically, this research aims to understand critically the meanings brought by the participants and how they share new meanings on the summary of expository texts as a tool for teaching-learning in Science classes. The research is organized through two socialhistorical activities (Reflexive Session and Class) that are related, in part, by the object summary production and the participants researcher and teacher , that enable the learning concepts to be understood, questioned and shared, like a creative chain (Liberali, 2011) and that contextualize the critical formation for the research participants. It is supported by Social-Historical-Cultural Activity Theory (TASHC), which conceives the man's work activity as a way for transforming society and the man himself. It s also supported by Bakhtin/Volochinov s discussions about the ways the subject is constituted as a social being, inserted in a particular context of communication and implicated in oral and written productions, in these specific situations. The discussions through TASCH provide an understanding of contexts of teacher formation in which the language enables the construction of ZPDs (Zones of Proximal Development) for the participants understanding and sharing of meanings. The contributions given by Dolz & Schneuwly (2004) will assist in understanding language organization in social practices with the genre summary , as a tool of teaching-learning in reading and writing texts. The Collaborative Critical Research, as discussed by Magalhães (2007; 2009; 2010) e Magalhães & Oliveira (2011) supports the methodological choices in close relationship within the theoretical base and the research contents. The analyzed data were produced during Reflexive Sessions with a teacher of Natural Science and through observing some of her classes. The results show the complexity of the collaborative-critical work and the transformation in some concepts on written production of summaries as an instrument of teaching-learning Science
Esta dissertação tem como objetivo geral desenvolver um trabalho colaborativo-crítico com uma professora de Ciências para compreensão e transformação do trabalho com produção de resumos de textos expositivos lidos pelos alunos. Mais especificamente, é objetivo desta pesquisa compreender criticamente os sentidos das participantes e o compartilhamento de significados sobre resumo de textos expositivos como instrumento de ensino-aprendizagem em aulas de Ciências. A pesquisa está organizada por meio de duas Atividades sócio-histórico-culturais (Sessão Reflexiva e Aula) relacionadas, parcialmente, pelo objeto produção de resumo , e pelos participantes pesquisadora e professora , o que possibilita que os conceitos trabalhados sejam compreendidos, questionados e compartilhados, como uma cadeia criativa (Liberali, 2011) e contextualizem a formação crítica das participantes da pesquisa. Está apoiada na Teoria da Atividade Sócio-Histórico-Cultural, que concebe a atividade de trabalho do homem como transformadora da sociedade e do próprio homem. E ainda, nas discussões de Bakhtin/Volochinov (1929) sobre os modos como o sujeito se constitui como um ser social, inserido em um contexto particular de comunicação e implicado em produções orais e escritas, nessas situações específicas. As discussões da TASCH proporcionam a compreensão de contextos de formação em que a linguagem possibilita a construção de ZDPs para a compreensão dos sentidos das participantes e do compartilhamento de significados. As contribuições de Schneuwly & Dolz (2004) auxiliarão na compreensão das organizações da linguagem nas práticas sociais com o gênero resumo, como instrumento de ensino-aprendizagem na leitura e escrita de textos. A Pesquisa Crítica de Colaboração, como discutida por Magalhães (2007; 2009; 2010) e Magalhães & Oliveira (2011) embasa as escolhas metodológicas em estreita relação com a teoria de base e o conteúdo da pesquisa. Os dados analisados foram produzidos em Sessões Reflexivas com a professora de Ciências Naturais e em observações da sala de aula. Os resultados apontam para a complexidade do trabalho colaborativo-crítico e para a transformação de alguns conceitos sobre a produção escrita de resumos como instrumento de ensino-aprendizagem em Ciências

Försvarsmakten genomgår, sedan snart tio år tillbaka, en transformering mot ett insatsförsvar med ökad försvarsförmåga. Behovet av luftburen taktisk transport har i denna transformering blivit alltmer betydelsefullt, främst vid internationella insatser. Författaren ställer sig dock frågan hur den taktiska luftburna transporten är tänkt att användas vid nationella insatser. Syftet med uppsatsen är således att utifrån Försvarsmaktens doktriner, Militärstrategisk doktrin och Doktrin för luftoperationer, undersöka om den resurs som det taktiska transportflyget utgör i det framtida användbara försvaret vid nationella insatser är att anse som kritisk. För att svara på syftet analyseras hur det användbara försvaret är tänkt att nyttjas vid nationella insatser, vilka målsättningar som finns för det taktiska transportflyget samt hur denna förmåga ser ut i dagsläget. Författaren använder sig sedan av de teorier som hämtats från doktrinerna för att analysera hur taktisk luftburen transport kan kopplas samman med den nya insatsorganisationen. Det genomförs även en jämförelse mellan de målsättningar som finns för den taktiska luftburna transporten med situationen i dagsläget i syfte att analysera hur framtiden kommer att se ut. Slutsatsen är att det taktiska transportflyget är av vikt men att det ej utgör en kritisk resurs i det användbara försvaret vid nationella insatser. Författaren gör även bedömningen att tillgängligheten på de flygplan som används för luftburen taktisk transport kommer att vara betydligt lägre än vad som planerats.
The Swedish Armed Forces is, since approximately ten years back, experiencing a transformation towards an improved defence capability. The importance of tactical air transport has within this transformation become of greater importance, especially concerning international operations. The author is, however, curios about how tactical air transport is to be implemented within domestic operations. Hence the purpose of the essay is to analyze, with the help of the two doctrines: Militärstrategisk doktrin and Doktrin för luftoperationer, if the resource that the tactical air transport constitutes to the new Swedish Armed Forces is to be seen as a crucial one within domestic operations? To answer the purpose the author analyzes how the new Swedish Armed Forces is intended to operate when it comes to domestic operations, what goals are set up for the tactical air transport and what the situation is like at the moment. The author then uses the theories described in the military doctrines to analyze how tactical air transport can be linked to the new Swedish Armed Forces .There is also a comparison made between the current state of the tactical air transport and the goals set up within the new organisation with the purpose of analyzing what the future might look like. The conclusion is reached that tactical air transport is of great importance to the new Swedish Armed Forces but that it is not to be seen as a crucial resource. The author also predicts that the availability of the aircraft fleet used for tactical air transport will be lower then planned.

Definitionen av sexuella trakasserier är händelser, kommentarer eller närmanden som är av sexuell karaktär och som av den utsatte upplevs som oönskade. Arbetsgivare har enligt Diskrimineringslagen lagstadgade skyldigheter att arbeta förebyggande vad gäller sexuella trakasserier inom den egna verksamheten.Dock påvisar #metoo under hösten 2017 att sexuella trakasserier är mer förekommande än allmänheten tidigare trott och det har därmed ökat det kritiska medvetandet om att arbetsgivare eventuellt besitter brister i sitt förebyggande arbete gällande sexuella trakasserier inom den egna verksamheten. Syftet med denna studie blir därmed att närmare undersöka om arbetsgivare inom restaurangbranschen kommit att förändra sitt förebyggande arbete gällande sexuella trakasserier som ett resultat av #metoo och i så fall hur detta förändringsarbete konkret ser ut. För att besvara studiens syfte och problemprecisering genomfördes en metodkombination bestående av en webbenkät och fördjupande intervjuer. Enkäten sändes via mail som distribution till 265 restauranger till sex på förhand utvalda städer som inbringade i en svarsfrekvens på 29 %. Utifrån enkäten genomfördes urvalet till vidare intervjuer där kravet var att hashtagen blivit uppmärksammad av restaurangen, att förändringar genomförts eller planeras genomföras som ett resultat av #metoo, samt att respondenten besatt ett intresse av att deltaga i en djupare intervju. Nio intervjuer kom att genomföras för att belysa hur förändringsarbetet implementerats. Studiens slutgiltiga resultat lyder att 93,5 % uppmärksammat eller delvis uppmärksammat #metoo och dess betydelse, 45,5 % har genomfört förändringar som ett resultat av #metoo och 54,5 % har avstått förändring. Resultatet visar tydligt att det är fler som uppmärksammat hashtagen än som därefter valt att genomföra förändringar. De som däremot valt att inleda eller planerar att inleda ett förändringsarbete har genomfört detta på olika sätt, i olika grad, med olika ambitionsnivåer och tidsperspektiv.
The definition of sexual harassment is phenomena, comments or approaches that are of a sexual nature and from the victim are perceived to be undesirable. Employers have statutory obligations under the Discrimination Act to work on preventive sexual harassment within their own organization. However, #metoo shows in the fall of 2017 that sexual harassment is more prevalent than the public previously believed and thus has increased the critical awareness that employers may have shortcomings in their preventive work on sexual harassment within their own business. The purpose of this study will be to investigate whether employers in the restaurant industry have changed their prevention work on sexual harassment as a result of #metoo and, if so, how this change work is concrete. In order to answer the purpose of the study and problem identification, a method combination consisting of a web survey and further interviews was conducted. The survey was sent by mail as distribution to 265 restaurants, in six pre-selected cities and brought a response rate of 29 %. Based on the survey, the selection was conducted for further interviews, where the requirement was that the restaurant has been noted the hashtag, implemented or planned changes as a result of #metoo, and that the respondent had an interest in participating in a deeper interview. Nine interviews were conducted to highlight how the change work has been implemented. The final result of the study is that 93,5 % were noticed or partially noticed #metoo and its significance, 45,5 % have made changes as a result of #metoo and 54,5 % rejected change. It is clear that it is the more employer who have noticed the hashtag than then chose to make changes. Those who, on the other hand, chose to initiate or plan to initiate a change implemented this in different ways, to different degrees, ambition levels and time perspectives.

The scope and purpose of this research is the examination of the theology and practice of the Methodist Church of Southern Africa in matters relating to marriage, divorce and remarriage in ministry. The theology of the Methodist Church of Southern Africa is based on its understanding of the scriptural injunctions on these matters and the Wesleyan tradition. These are examined in some detail as is the one paper in existence produced by the church on the subject. This is the report by a committee appointed by the Conference of the Methodist Church of Southern Africa, convened by Dr Donald Cragg; M.A. (OX ON) D.Phil. (OXON). This document is referred to in this thesis as The Cragg Document. Section One of this thesis deals with research into the theology of the church. The practice of the church is examined using the recently completed study by the writer of the decided cases of the church in all disciplinary matters dealt with by Conference from 1957 to 1997. These were compiled from the existing record of Conference proceedings kept in the Methodist Connexional Office in Durban. This case precedent is included in a larger work also recently completed by the writer, namely A Handbook/or Disciplinary Committees. This book is in the process of being published by the church. Section two of this work deals with research into the practice of the church. The conclusions drawn at the end of this paper include a possible model for ministry to ministers and their families in the area of marriage and family enrichment and pastoral assistance to families in crisis. This thesis includes qualitative research into the aforesaid practice and procedure of the church in these matters and it is submitted that the conclusions drawn and the model posed in the concluding chapters can be of value to the church as it seeks to deal of the problem of an increasing number of ministers suffering the breakup of their homes and going through the trauma of divorce.

Mètodes: Estudi d’una cohort prospectiva en que es van incloure durant 14 mesos consecutius els pacients ingressats a l’UCI de l’Hospital Universitari Vall d’Hebron sotmesos a ventilació mecànica durant més de 48 hores. Es va valorar la qualitat de vida relacionada amb la salut a l’ingrés mitjançant els qüestionaris SF-36 i Qüestionari Respiratori de Saint Georges (QRSG) i a l’alta de l’UCI. Els mateixos qüestionaris es van repetir a l’any de l’alta. Els Resultats Sensibles a Intervenció d’Infermeria (RSII) i les variables clíniques relacionades amb la patologia i l’evolució es van recollir de la documentació clínica diàriament. Es va realitzar una anàlisi descriptiva i analítica de la relació entre les variables principals. Resultats: La cohort inicial va estar formada per 184 pacients, a l’any se’n van poder estudiar 151. En els components resum (físic i mental) de l’SF-36 i la puntuació total del QRSG existien diferències estadísticament significatives entre la valoració a l’ingrés i a l’any (p= 0,001; p=0,001 i p<0,001 respectivament).Cap dels RSII van presentar associació estadísticament significativa amb els components resum de l’SF-36 ni amb cap dimensió del QRSG. Conclusions: Els pacients que van requerir ventilació mecànica durant el seu ingrés a l’UCI van presentar millor qualitat de vida a l'any de la seva alta que la que presentaven a l’ingrés, però va continuar sent pitjor que la de la població de referència. No es va poder determinar que existís relació entre els resultats sensibles a intervencions infermeres i la qualitat de vida a l’any dels pacients.

Se realizó un análisis descriptivo y analítico de la relación entre las variables principales. Resultados: La cohorte inicial estuvo formada por 184 pacientes, al año se pudieron estudiar 151. En los componentes resumen (físico y mental) de l’SF-36 y la puntuación total del QRSG existían diferencias estadísticamente significativas entre la valoración al ingreso y al año (p = 0,001; p = 0,001 y p <0,001 respectivamente). Los componentes resumen de l’SF-36 (Físico = 46, Mental = 47) y la puntuación total del QRSG (12 vs 8) tuvieron peores resultados al año que la población de referencia. Ninguno de los RSIE presentaron asociación estadísticamente significativa con los componentes resumen del SF-36 ni con el QRSG. Conclusiones: Los pacientes que requirieron ventilación mecánica durante su ingreso en la UCI presentaron mejor calidad de vida al año del alta que la que presentaban al ingreso, aunque continuó siendo peor que la de la población de referencia. No se pudo determinar relación entre los resultados sensibles a intervenciones enfermeras y la calidad de vida al año de los pacientes.
Objective: To assess the HRQL of mechanically ventilated patients admitted to ICU and its relation to nurse-sensitive outcomes (NSO). Methods: A prospective cohort of admitted to d'Hebron University Hospital ICU who underwent mechanical ventilation for more than 48 hours were included for 14 consecutive months. Health-related quality of life at admission and discharge from ICU was assessed using the SF-36 and Saint Georges Respiratory (QRSG) questionnaires. The same questionnaires were also utilised 1 year after ICU discharge. Nursing Sensitive Outcomes (NSO) and clinical variables related to patient’s diagnosis and clinical course were collected from patient records on a daily basis. A descriptive and analytical analysis of variables’ relationship performed. Results: The initial cohort consisted of 184 patients. Follow-up a year after discharge was done on 151 patients. In the summary components (physical and mental) of the SF-36 as well as the total score of the QRSG there were statistically significant differences between the assessment performed at ICU admission and the one performed a year after ICU discharge (p = 0.001, p = 0.001 and p <0.001, respectively). The summary components of the SF-36 (Physical = 46, Mental = 47) and the total QRSG score (12 vs 8) results obtained a1 year after ICU discharge were worse if compared with the ones obtained from the reference population. None of the NSO had a statistically significant association with the SF-36 summary components or any dimension of the QRSG. Conclusions: Patients who required mechanical ventilation during ICU admission had better quality of life 1 year after ICU discharge when compared with ICU admission, but was worse when compared with the reference population. It was not possible to determine if there is a relationship between NSO and quality of life a year after ICU discharge.

Introduction : Dans 70% des cas, le médecin généraliste se trouve à la fin de la consultation en situation d'incertitude diagnostique. Il doit rester vigilant face aux deux dangers qui le préoccupe : celui de faire une erreur diagnostique et celui de passer à côté d'une maladie grave. Le concept de résultat de consultation (RC) permet de caractériser les situations cliniques les plus fréquentes, de les nommer précisément et d'ainsi maitriser le premier danger. Notre travail s'est attaché à la gestion du second danger, celui de passer à côté d'une maladie grave. Nous avons tenté de répondre, en créant une méthode de gestion du risque nommée démarche cindynique, à la question suivante : est-il possible de rédiger des démarches cindyniques, adaptées aux situations cliniques les plus fréquentes en médecine générale ? Matériels et méthodes : Le travail a été encadré par un groupe de huit médecins, et s'est déroulé en quatre étapes : une revue de la littérature, l'élaboration d'une méthode de création des démarches cindyniques, son application à 20 RC, puis son évaluation auprès de 785 médecins généralistes, à l'aide d'une échelle de Likert. Résultats : Nous avons dans ce travail, élaboré les démarches cindyniques de 5 des 20 RC : "arthopathie-périarthropathie", "dépression", "réaction à situation éprouvante", "rhinite" et "toux". L'analyse de l'évaluation de ces démarches met en évidence une adhésion des médecins. Les ¾ notent l'intérêt de ces démarches à plus de 7/9 et 84% les trouvent applicables dans la pratique quotidienne avec une note supérieure à 7/9. Les médecins utilisant le Dictionnaire des résultats de consultation® (DRC), donnent globalement de meilleures appréciations. Conclusion : La création de ces démarches cindyniques est faisable et son accueil auprès des médecins généralistes favorable. Les étapes suivantes seront l'élargissement de ce travail à tout le DRC, puis à la gestion de la polypathologie, cœur de notre métier
Introduction: In 70% of cases, the general practitioner ends up in a situation of diagnostic uncertainty at the end of a consultation. He must remain vigilant concerning two dangers: in one hand, making a mistake in the diagnosis, and on the other, failing to detect a serious disease. The “résultat de consultation” (RC) concept helpsdefine the most frequent clinical situations, to designate them precisely and thus control the first danger. We focused our work on managing the second danger; that is to say, failing to detect a serious disease. By creating a risk management method called “démarches cindyniques“, we tried to answer the following question: Is it possible to draft approaches to risk analysis that are adapted to the most frequent clinical situations in general medicine? Materials and methods : The work has been carried out by a group of eight general practitioners, and has been divided into four steps: a thorough review of articles, the development of a method to create approaches to risk analysis, their application to 20 CRs, and lastly, its evaluation done by 785 general practitioners using the Likert scale. Results: Through this work, we developed theapproaches of risk analysis of 5 out of the 20 RC: "arthopathie-périarthropathie", "dépression", "réaction à situation éprouvante", "rhinite" and "toux". The analysis of the approaches' evaluations shows an extensive support from the general practitioners. Three-quarters of them evaluate the interest of these approaches at 7/9 and 84% find them useful in their daily work, rating their interest over 7/9. General practitioners using the Dictionnaire des Résultats de consultation® (DRC) generally give better evaluations. Conclusion: The creation of these approaches to risk analysis is feasible and is widely welcomed by general practitioners. The next steps will be the generalization of this method for the whole DRC and then forpolypathology which represents the core of our profession

The topic of this thesis is to improve the ionograms scaling results of the critical frequency of F2 layer (foF2). Comparing the foF2 scaling results between the automatic scaling program by using a fuzzy segmentation and a connectedness algorithm and by human eyes, the absolute values of differences between two scaling results less than 1 MHz are less than 60% for the chosen 2304 ionograms. The improved automatic scaling program filters the echo not belonging to the F layer, and then using the F layer echoes to determine the foF2. The absolute values of differences between two scaling results less than 1 MHz are more than 85%, better than the previous program. This thesis also discusses the accuracy of the scaling results. The 2304 ionograms were obtained by the Dynasonde that was established at Dong-Hwa University in Hualien, Taiwan since 2010.

Abstract:
Evaluating the effectiveness of Thabo Mbeki’s political mediation in the Zimbabwean conflict of 2008, following a disputed election outcome, is the principal objective of this study. The Ripeness Theory of mediation and conflict resolution that was proposed by William Zartman and developed by other scholars is deployed as the theoretical framework of the study. The principal measure of the effectiveness of mediation lies in its success in resolving conflict in a sustainable manner. There is consensus in conflict resolution scholarship that the post-cold war era has witnessed a marked shift of conflicts from the inter-state scene to the intra-state domain, such as the one in Zimbabwe, 2008. This shift has brought with it increasing attention to issues of human security, human rights and democratisation in mediation and conflict resolution. As a result, a compelling need for the effective resolution of such conflicts, and guarantee of the enforcement of human rights, security and promotion of democratisation as part of mediation, has arisen. There is also a general acceptance, amongst scholars, that the success of mediation goes beyond the signing of mediated agreements as often case conflict has re-ignited after the signing of peace agreements. For that reason, the argument that mediation is counter-productive as it often puts a lid on the can of conflict without resolving the underlying conflict issues has achieved currency. There is therefore a general convergence of views in mediation literature that addressing the structural causes of disputes guarantees the sustainable resolution of conflict. It is in the context of these developments and views in international relations and politics that this study evaluates, using the Ripeness Theory, its limits noted, the effectiveness of Thabo Mbeki’s mediation in Zimbabwe, and the argument is advanced that often case mediated agreements are not effective mechanisms for the sustainable resolution of conflict and the achievement of democratisation and durable peace. Civil society groups need to be involved to expand the scope of negotiations and limit effects of mediator partiality.

Background The Biochemistry and Haematology Outcome Model (BHOM) relies on the results from routine index blood tests to predict the patient risk of death. We aimed to externally validate the BHOM model. Method We considered all emergency adult medical patients who were discharged from Northern Lincolnshire and Goole (NLAG) hospital in 2014. We compared patient characteristics between NLAG (the validation sample) and the hospital where BHOM was developed. We evaluated the predictive performance, according to discriminative ability (with a concordance statistic, c), and calibration (agreement between observed and predicted risk). Result There were 29 834 emergency discharges of which 24 696 (83%) had complete data. In comparison with the development sample, the NLAG sample was similar in age, blood test results, but experienced a lower mortality (4.7% vs 8.7%). When applied to NLAG, the BHOM model had good discrimination (c-statistic 0.83 [95% CI 0.823 - 0.842]). Calibration was good overall, although the BHOM model overpredicted for lowest (<5%, observed = 229,predicted =286) and highest (≥50%, observed = 31, predicted = 49) risk groups, even after recalibrating for the differences in baseline risk of death. Conclusion Differences in patient case-mix profile and baseline risk of death need to be considered before the BHOM model can be used in another hospital. After re-calibrating for the baseline difference in risk the BHOM model had good discrimination but less adequate calibration.

Abstract:
This project responds to an ongoing discussion in scholarship that identifies and analyzes the ideological functions of computer interfaces. In 1994, Cynthia Selfe and Richard Selfe claimed that interfaces are maps of cultural information and are therefore ideological (485). For Selfe and Selfe and other scholars, these interfaces carried a colonial ideology that resulted in Western dominance over other cultures. Since this early scholarship, our perspectives on interface have shifted with changing technology; interfaces can no longer be treated as having persistent and predictable characteristics like texts. I argue that interfaces are interactions among dynamic information that is constantly being updated online. One of the most prominent ways users interact with information online is through the use of search engines such as Google. Interfaces like Google assist users in navigating dynamic cultural information. How this information is arranged in a Google search event has a profound impact on what meaning we make surrounding the search term. In this project, I argue that colonial ideologies are upheld in several Google search events for the term “Benghazi, Libya.” I claim that networked connection during Google search events leads to the creation and sustainment of a colonial ideology through patterns of arrangement. Finally, I offer a methodology for understanding how ideologies are created when search events occur. This methodology searches for patterns in connected information in order to understand how they create an ideological lens.

Abstract:
The PhD thesis deals with global in time existence results and blow-up result for a semilinear wave model with scale-invariant damping and mass. Since the time-dependent coefficients for the considered model make somehow the damping and the mass a threshold term between effective and non-effective terms, it turns out that a fundamental role in the description of qualitative properties of solutions to this semilinear model and to the corresponding linear homogeneous Cauchy problem is played by the multiplicative constants appearing in those coefficients. For coefficients that make the damping term dominant, we can use the standard approach for the classical damped wave model with L^2 − L^2 estimates and the so-called test function method. On the other hand, when the interaction among those coefficients is balanced, then, it is possible to observe how typical tools for hyperbolic models, as for example Kato’s lemma, provide sharp global in time existence results and sharp blow-up results for super- and sub-Strauss type exponents, respectively.

Abstract:
This thesis examines the validity of exclusionary clauses in medical contracts, more especially, hospital contracts in which the healthcare provider exonerates itself against edictal liability arising from the negligent conduct of its staff, resulting in the patient suffering damages. In assessing whether these types of clauses should be outlawed by our courts, this thesis attempts to synthesize six major traditional areas of law, namely, the law of delict, the law of contract, medical law and ethics, international and foreign law, statutory law and constitutional law into a legal conceptual framework relating specifically to exclusionary clauses in medical contracts in South Africa. This thesis highlights systemic inconsistencies with regard to the central issue, namely, whether these types of clauses are valid or not, especially, given the fact that the practice of exclusionary clauses or waivers in hospital contracts has hitherto traditionally been assessed within the framework of the law of contract. The alignment of the various pre-existing areas of statutory and common law with the Constitution highlights that an inter-disciplinary and purposive approach under the value-driven Constitution, brings about a less fragmented picture in assessing the validity of these types of clauses. This approach accords with the new solicitude of the executive, the judiciary, the legislature and academia to transform the South African legal system not only in terms of procedural law but also substantive law. This has resulted in the alignment with constitutional principles and the underlying values to test the validity of these types of clauses, alternatively, contracts. Whereas pre-constitutionally the assessment of disclaimers in hospital contracts was done against the stratum of antiquated principles, namely, freedom of contract and the sanctity of contract, ignoring values such as reasonableness, fairness and conscionability, post-constitutionally, because the values that underlie the Bill of Rights and which affects all spheres of law, including the law of contract, concepts such as fairness, equity, reasonableness should weigh heavily with the decision-maker. In this regard, broader medico-legal considerations, normative medical ethics and the common law principles of good faith, fairness and reasonableness play a fundamental role in the assessment of contractual provisions, including the practice of disclaimers or exclusionary clauses in hospital contracts. This thesis critically examines how these types of clauses or contracts ought to be adjudicated eventually against the background of such alignment. It concludes that the entering into a hospital contract, in which the patient exonerates a hospital and its staff from liability flowing from the hospital or its staff's negligence causing damages to the patient, would be inconsistent with the Constitution and invalid. In the old order in which traditional divisions of law have been encouraged, a fragmented approach resulted in legal in congruencies which, in turn, created turbulence and a lot of uncertainty. This approach is apposite to that which the new constitutionally based legal system, aims to achieve. The rights in the Bill of Rights which are interconnected and which influences all spheres of law, including contract law, offers a fairer basis upon which, the validity of contracts, or contractual provisions, can be measured than, the pure contract approach. In this regard, although contracts or contractual provisions in the past may have been unfair and unreasonable, the courts, however, refused to strike them down purely on this basis. The law of contract, as a legal vehicle for adjudicating the validity of exclusionary clauses or waivers in hospital contracts, is therefore not ideal. This is primarily due to the antiquated approach the South African courts have always taken in this area of law. The law of delict, statutory law and medical law, standing alone, also does not provide a satisfactory answer. What is needed is an integrated approach in which the traditional areas of law are united and wherein constitutional principles and values, give much guidance and direction. Alternatively, should the unification of the traditional areas of law not be possible in bringing about fair and equitable results, the introduction of legislative measures may very well be indicated.

As a first aspect the thesis treats existence results of the perturbed eigenvalue problem of the 1-Laplace operator. This is done with the aid of a quite general critical point theory results with the genus as topological index. Moreover we show that the eigenvalues of the perturbed 1-Laplace operator converge to the eigenvalues of the unperturebed 1-Laplace operator when the perturbation goes to zero. As a second aspect we treat the eigenvalue problems of the vectorial 1-Laplace operator and the symmetrized 1-Laplace operator. And as a third aspect certain related parabolic problems are considered.

Hepatitis B virus (HBV) is the major etiology of chronic hepatitis B (CHB), liver fibrosis, liver cirrhosis and hepatocellular carcinoma (HCC). Although antiviral therapy may suppress HBV replication and hepatic inflammation, there is no effective treatment to cure CHB. Because of high spontaneous error rate of HBV reverse transcriptase which has little proofreading ability, the HBV are prone to mutate during replication. Under the pressure of host`s immune attack, the HBV may escape the host`s immune attack by deletion of hepatitis B surface immune epitope. Although mutations may help HBV escape immune attacks, it also affect the HBV morphology and physiology. It had been reported that mis-folding of HBsAg with deletion segment might result in HBsAg retention in endoplasmic reticulum (ER) and induced oxidative stress, subsequent chromosome instability and activation of hepatocarcinogenesis pathways. It is one of reasons that pre-S deletions of HBV are more frequently found in HCC patients. In our recent study, HBV mutant with pre-S deletion were significantly associated with postoperative HCC recurrence only in the presence of high viral loads and HBsAg levels. Among the 216 HCC patients with complete HBs gene sequencing, 73 had the pre-S deletion HBV mutants, including 15 with the pre-S1 deletion mutant only, 43 with the pre-S2 deletion mutant only, and 15 with both. Of the 58 patients with the pre-S2 deletion mutants HBV, 25 (43.1%) had the deletion that ended at the amino acid 142 of the pre-S region. Proline was the preserved amino acid on this site in all of these mutants. It will be an interesting issue worthy of investigation if Proline at this location plays a key role in HBV assembly and secretion which results in the maintenance of viral quasi-species. In this study, human HCC cell line Huh 7 was transfected in vitro with wild type of HBV plasmid and different pre-S Proline142 mutant plasmids. We compared viral replication, transcription, translation of viral antigens, assembly and secretion between wild type and pre-S deletion by western blot, southern blot and northern blot. Interestingly, a single amino acid deletion or substitution of Proline at the residue 142 of pre-S region resulted in marked reduction of secreted HBsAg in culture medium and high retention of HBsAg than WT group in ER. The immunofluorescence also show that only WT group HBsAg diffused distribution in cell cytoplasm. However, all the MT groups HBsAg showed overlapping with ER at the marginal part of hepatocyte nucleus. This finding is original and supported our previous findings that Proline is critical in viral assembly and secretion. In addition, we also observed our data indicates that the hot-spot short segment deletion in the pre-S region markedly reduces HBV secretion and results in retention of mutated HBsAg in the ER. Furthermore, the P142 of the pre-S region plays a key role in HBV secretion to circulation.
