Metal coordination complexes are emerging as an important class of optical imaging probes. They may function not only as stains for particular cell compartments, but also as responsive probes, able to report on changes in local ionic composition. The critical factors to consider in designing such probes are reviewed, including issues of cell uptake and compartmentalization, the degree of non-invasiveness and their functional performance. Prospects are considered for the development of lanthanide(iii) probes capable of reporting changes in local bicarbonate, citrate, and lactate.

Abstract:
Life insurance is a very important segment of the economy of most countries as demonstrated by the investments, premium revenue and numbers employed. Hence, it is paramount to determine accurately how well life insurance companies (LICs) perform and how viable they are for the benefit of both other industries and national economies.Three papers that investigate LIC efficiency directly analyze how efficiency affects LIC profits. One critical feature is that they show that the inefficiency of LICs can greatly affect their (financial) outcome and ultimately their survivorship. Thus, said research clearly indicates that life insurer efficiency is a crucial area to investigate and assess and that it could greatly enhance the ability to properly monitor and inspect the life insurers.This article co-ordinates information regarding life insurance efficiency studies to help researchers learn which approaches, methods and output/input proxies to use. While some papers do so for some of the aspects that are important and necessary for life insurance efficiency studies, this is the first to deal with said aspects together. More specifically, this paper especially considers and evaluates the different methods and output proxies used in life insurance efficiency studies, as they seem to be the elements where the most disagreement exists between researchers. In addition, this article is unique in examining how input (proxy) prices are used in life insurance efficiency studies.

The continuous downsizing of electronic devices has promoted many ideas of lithography and fabrication techniques at the nanometer scale. Scanning probe lithography (SPL) has been intensively explored as a potential alternative. The conceptual development of the SPL endeavors and their basic mechanisms in the past decade are briefly reviewed. Scaling down the conventional field effect transistors below 30 nm may present enormous technical and economical challenges. Random polarization and fabrication of reproducible lateral tunneling junctions continue to be two major barriers for quantum devices. Instead of trying to compete with other projection type lithographic techniques at the nanometer scale, scanning probes are best suited to explore atom scale devices.

Abstract:
This thesis critically analyses the law of promise. It does so for the purposes of identifying potential solutions to practical and doctrinal problems in the Thai law of promise. Scots law is chosen as the main point of comparison because, inter alia, both jurisdictions are mixed jurisdictions. Scots promissory law was influenced by the Canon Law and was part of the ius commune tradition. Scots law was not influenced by English law in this area. Scots law has developed its own promissory obligation as a free standing legal entity outwith contract. Thai promissory legal principles were derived from both Civilian and English sources. Consequently, promissory language is used both in the sense of a unilateral obligation and a contractual promise. Moreover, the Thai drafters did not acknowledge the different attitude towards a unilateral promise of French law (where a promise must be accepted in order to be binding) and German law (where particular types of unilateral obligations are recognised). This thesis argues that the flaws in promissory provisions under the Thai Code stem from the fact that, inter alia, the drafters did not understand the difference between unilateral and bilateral obligations. This thesis argues that the Scots promissory approach presents a more efficient structure of the law of obligations than the Thai approach. It encounters fewer problems than Thai law because a promise is deemed to be a standalone obligation. This thesis further analyses the practical applications of promise, arguing that a promissory analysis is useful in conceptualising practical circumstances. Adopting a promissory approach is beneficial, making doctrinal analysis clearer in comparison with the offer and acceptance approach. This thesis takes into account the role given to promise in the DCFR. The notion of a unilateral undertaking in the DCFR illustrates that the most recent model rule of European private law recognises the importance of a unilateral obligation. This reflects the fact that the notion of a contract cannot appropriately deal with certain situations in which a person unilaterally intends his/her undertaking to be bound without acceptance. It is concluded that the Scots approach of regarding a promise as an independent obligation separate from contract could be adapted to Thai law. There are certain resemblances between Scots and Thai law in promissory theories and the obligational nature of a promise. Therefore, Thai law is not unfamiliar with the notion that a declaration of wills can unilaterally create an obligation. The proposed approach provides a number of advantages e.g. eradicating an overlap between a promise and an offer; clarifying the legal status of promise; and making the legal status of a promise to make a contract compatible with a promise of reward. In particular, this thesis postulates that promise has a substantive role to play in governing an offer specifying a period of acceptance. This particular observation has, to date, not been made in relation to Thai law.

Abstract:
The historical survey of social movements in the United States reveals that the movement is a rhetorical ground occupied by groups who have been marginalized by society. Today, however, the distinctions between those who are marginalized and those who are part of the establishment have become difficult to distinguish. This study considers the emergence of Promise Keepers, an all-male social movement, and the rhetorical themes that emerge from the group. This study identifies five rhetorical themes in Promise Keepers. These themes include asserting authority of men in the home and church, the creation of a new male identity, sports and war rhetoric, political rhetoric, and racial reconciliation. The implications of these themes are considered from a critical perspective and areas for future research are provided.

Denna studie undersöker vilka strategier fyra organisationer från den ideella sektorn använder sig av för att hantera sitt samarbete med staten. Studien tar sitt avstamp i Staffan Johanssons teori om hur påtvingar ideell sektorn ett homogeniseringstryck. Genom att undersöka olika egenskaper hos den ideella sektorn, såsom ideologi, ekonomiska förutsättningar och möjligheten att vara me och påverka undersöks hur organisationerna uppfattar sin roll i samarbetet. Studien visar att ideologin och de ekonomiska förutsättningarna spelar avgörande roll för hur organisationerna kan strukturera både sig själva som organisation liksom deras arbete. I relationen till staten framstår det som viktigt att resursberoendet inte är allt för ensidigt för att organisationerna skall kunna hålla på sin särart och styra sin organisation i en självvald riktning.
This study examines the strategies four organizations from the voluntary sector uses to manage its cooperation with the State. The study takes its starting point in Staffan Johansson's theory of how imposing a non-profit sector with a homogenization pressure. By investigating various characteristics of the voluntary sector, such as ideology, economic conditions and the possibility of criticism, explores how organizations perceive their role in co-operation. The study shows that ideology and the economic environment plays key role in how organizations can structure themselves both as a organization and their work. In relation to the state, it seems important that resource dependence is not too one-sided for organizations to retain its character, ideology and control over their activities.

Despite the vast research on the effects of gaming, little is know how the phenomenon of e-sports and it’s followers is portrayed. While media can have significant impact on what and how e-sport is portrayed, no studies have been done in a Swedish context. This thesis aims at filling that gap with investigations of the two major Swedish newspapers. Six articles was analyzed with critical discourse analysis with a theoretical base of journalism.The result of which indicated that between the period of 2005 and 2012 e-sport and players was considered to be professional, committed and more in a sense that reminded much of the view on more traditional sport such as soccer and hockey. However the players was often treated as minor kids or teenagers, for e-sports seems only to be held by these groups according to the journalist’s. The implications of this finding should be viewed as a socially critical perspective on a phenomenon that is more than often the subject of leisure.

This thesis evaluates the recent work of the Organisation for Economic Cooperation and Development and civil society groups in creating requirements for multinational entities to disclose financial information on a Country-by-Country basis. Country-by-Country reports may identify profit-shifting activities and enable various stakeholders to hold multinational entities accountable for their global conduct, through the provision of transparent and decision-useful information. This thesis identifies inadequacies in current disclosure requirements and develops a standardised Country-by-Country model, which is applied to the disclosures of three multinational entities to illustrate its pragmatic feasibility and the improvement in quality of financial information available to users.

In this thesis, I seek to contextualize the exclusivity of traditional marriage in the United States. I investigate the use of Christian beliefs applied to the American legal system, consequently becoming the foundation of American commonsense. I draw out the ways in which Augustinian thoughts on marriage have inadvertently been used to justify institutional favoritism toward heterosexual, monogamous couples. Through examining the Christian-American lens that shapes our understanding of traditional marriage, I argue that previous and current secular opposition to non-traditional marriage is fundamentally grounded in Christian faith, furthermore, American cultural understanding of marriage is unconsciously lined with Augustinian thought.

Abstract:
The arm’s-length principle (ALP), the transactions taken place between unrelated parties acting at an arm’s length in competitive markets, is used by income tax authorities to determine transfer pricing, the pricing of goods, services and intangibles transferred between affiliates of a multinational enterprise (MNE), and is an important international tax issue for a number of reasons. First, globalization creates integrated businesses with enormous cross-border transfers whilst corporate income tax systems remain nationally based. Second, governments insist that globalization provides MNEs with more opportunities to manipulate transfer prices and reduce taxes than in the past, thus the need for tighter regulation. Third, there is an increased desire amongst tax authorities faced with tight fiscal situations, to protect and enhance their revenue base encouraging stricter regulation of MNEs. Profit is seen as only one of the many goals that motivate the behaviour of MNEs and the newly introduced profit based methods of transfer pricing has increased the reliance on comparables significantly. As the number of specified methods was increased and the hierarchy of acceptable methods was replaced by either the best method rule or the method of last resort, taxpayers are expected to document their transfer pricing policies. The documentation has to be contemporaneous and available upon request. The methods newly introduced by the Organization for Economic Cooperation and Development’s (OECD, 1995), Transaction Net Margin Method (TNMM), and US Internal Revenue Service’s (IRS, 1994) Comparable Profit Method (CPM), vary in relation to their application and views in controlling for function and risk when developing comparables. This suggests a degree of discretion may be exercised under different regulations that may be detected through ownership and tax. This study attempts to identify the level of discretion provided under both OECD (TNMM) and US IRS (CPM) methods. It is also tests the scope of ownership effect on the reported profit of Japanese-owned companies and US-owned companies compared to their UK counterparts. Finally this study examines whether the reported tax expense has changed subsequent to tax policy changes, specifically the latest UK transfer pricing regulations introduced in 1998 corporation tax self-assessment. The empirical analysis confirms differences between OECD and US IRS profit ranges and variations between profit level indicators (PLIs). Foreign-owned Japanese and US companies are also found to exhibit low profitability compared to UK companies. This research discovered low performance among a high number of the Japanese-owned companies with operating losses when compared to their UK counterparts and offers evidence of the low tax expenses reported by foreign-owned Japanese companies.

Temporary urbanism has become a distinctive feature of urban life after the 2008 global financial crisis. This book offers a critical exploration of its emergence and establishment as a seductive discourse and as an entangled field of practice encompassing architecture, visual and performative arts, urban regeneration policies and planning. Drawing on seven years of semi-ethnographic research, it explores the politics of temporariness from a situated analysis of neighbourhood transformation, media representations and wider political and cultural shifts in austerity London. Through a longitudinal engagement with projects and practitioners, the book tests the power of aesthetic and cultural interventions and highlights tensions between the promise of vacant space re-appropriation and its commodification. Against the normalisation of ephemerality, it presents a critique of the permanence of temporary urbanism as a glamorisation of the anticipatory politics of precarity which are transforming cities, subjectivities and imaginaries of urban action.

Named #Pads4GirlsUg, the campaign enabled local and global citizens to contribute toward the distribution of menstrual products and provide critical menstrual health education. Stella Nyanzi powerfully examines the strategies she used for popularizing the campaign, mobilizing citizen participation, and smashing the silence and taboo around menstruation. Above all, she dissects the countertactics employed by the government to discredit and criminalize the campaign. Stella Nyanzi demonstrates that menstruation and women’s bodies are political and politicized—to the extent that her activism and criticism has led to her imprisonment.

The authors are volunteers or staff with WoMena, an NGO that works to improve menstrual health and management in Uganda. Based on this experience and focusing on Uganda and Nepal, this practice note probes how the issue is approached in different contexts and at different stages—comparing urgent response after a sudden onset disaster (for example, earthquakes) to protracted crises (for example, long-term refugee settings). The authors discuss how interventions can be made sustainable beyond the short-term ‘kit culture’ response; they highlight experiences with more developmental approaches involving policy support, community participation, capacity building, and the use of products that are economically and environmentally sustainable.

Probes (sampling, temperature, pressure) for high-temperature environments, such as gas turbine combustors, can survive only if they are cooled. To keep probe size small, the cooling passages must be microchannels, [O] 100 micrometer internal diameter. For logistical reasons, the length-to-diameter ratio is considerable. Heat fluxes are high, so that boiling occurs even with high velocities. The limiting factor for probe survivability, then, is the critical heat flux (CHF). This paper summarizes an experimental study of CHF in cooling channels that might be used for probes. A CHF correlation for water coolant is developed for design. An orifice at the channel inlet, originally conceived for enhancement, was found to dramatically improve the flow stability and increase the CHF. Pumping power requirements for plain tubes and orificed tubes are also documented.

Critical heat flux (CHF) of water in circular stainless steel microchannels with inner diameters ranging from ∼127μm to ∼254 μm was investigated. Forty-five CHF data points were acquired over mass velocities ranging from 1,200 kg/m2s to 53,000 kg/m2s, heated lengths from 2 cm to 8 cm, and exit qualities from −0.2 to 0.15. Most of the exit qualities fell below 0.1. It was found that CHF conditions were more dependent on mass velocity and heated length than on exit thermal condition. The results were also compared to six CHF correlations, with a mean average error ranging from 22% to 261.8%. A new correlation was proposed to better predict the critical heat flux data under the thermal-hydraulic conditions studied in this investigation. In developing the correlation, 319 data points were added from two previous studies.

The Pursuing Regional Opportunities for Mentoring, Innovation, and Success for English Learners (PROMISE) Initiative Research Monograph is comprised of four sub-studies that took place between 2006 and 2009 to examine the effectiveness of the PROMISE Initiative across six implementing counties. Beginning in 2002, the superintendents of the six Southern California County Offices of Education collaborated to examine the pattern of the alarmingly low academic performance of English learners (EL) across Los Angeles, Orange, San Bernardino, San Diego, Riverside, and Ventura. Together, these six counties serve over one million EL students, more than 66% of the total EL population in the state of California, and close to 20% of the EL population in the nation. Data were compiled for the six counties, research on effective programs for ELs was shared, and a common vision for the success of ELs began to emerge. Out of this effort, the PROMISE Initiative was created to uphold a critical vision that ensured that ELs achieved and sustained high levels of proficiency, high levels of academic achievement, sociocultural and multicultural competency, preparation for successful transition to higher education, successful preparation as a 21st century global citizen, and high levels of motivation, confidence, and self-assurance. This report is organized into six chapters: an introductory chapter, four chapters of related studies, and a summary chapter. The four studies were framed around four areas of inquiry: 1) What is the PROMISE model? 2) What does classroom implementation of the PROMISE model look like? 3) What leadership skills do principals at PROMISE schools need to lead transformative education for ELs? 4) What impact did PROMISE have on student learning and participation? Key findings indicate that the PROMISE Initiative: • resulted in positive change for ELs at all levels including achievement gains and narrowing of the gap between ELs and non-ELs • increased use of research-based classroom practices • refined and strengthened plans for ELs at the district-level, and • demonstrated potential to enable infrastructure, partnerships, and communities of practice within and across the six school districts involved. Expanding small-scale interventions without lowering quality and attenuating impact is a critical policy challenge. Community monitoring overs a low-cost quality assurance mechanism by making service providers account-able to local citizens, rather than distant administrators. This paper provides experimental evidence from a home visit parenting program implemented at scale by the Nicaraguan government, with two types of monitoring: (a) institutional monitoring; and (b) community monitoring. We find d a positive intent-to-treat effect on child development, but only among groups randomly assigned to community monitoring. Our findings show promise for the use of community monitoring to ensure quality in large-scale government-run social programs.

The largest democracy in the world is now moving towards authoritarianism under the Hindutva civilizational populist prime minister Narendra Modi-led Bharatiya Janata Party (BJP)’s rule. This article focuses on digital rights in India that have seen a sharp decline in recent years. It explores the transformation of the internet and social media, from a relatively open and liberal space to a restricted one. This survey of India’s digital landscape finds that the rise of civilizational populist Modi and his eight years long rule have led to an upsurge in digital surveillance and control and has fostered an environment of online harassment and bullying for those who are critical of the BJP’s views and politics. The article uses a four-level framework (Full Network, Sub-Network, Proxies, and Network Nodes) to explore digital authoritarianism by the BJP government. At each of these levels, the Hindutva populist government has closed avenues of open discussion and exchange of views by enforcing new rules and regulations.

Findings from the first two years of a 3-year evaluation of the PROMISE Model pilot are presented in this policy brief that seeks to understand the extent to which school principals know, understand, and act upon research-based principles for English Language Learners (ELL) and their intersection with the California Professional Standards for Educational Leadership related to promoting ELL success. Surveys and focus groups were used to gather data from school principals at fifteen schools throughout Southern California including early childhood, elementary, middle, and high schools. School principals identified several areas where PROMISE serves as a beacon of hope in promoting and validating critical conversations around a collective vision for success for all learners including ELL, bilingual/biliterate, and monolingual students. Educational and policy recommendations are provided for the following areas: 1) recruitment and selection of personnel and professional development; 2) accountability, communication and support; and 3) university-based educational leadership programs. This policy brief concludes with a call for school principals to facilitate the development, implementation, and stewardship of a vision for learning that highlights success for English Learners and shared by the school and district community.

Investigations of recent firefighter line of duty deaths caused by rapid fire progression have highlighted a deficiency in firefighters’ understanding of how certain tactics affect the fire dynamics of ventilation-controlled fires. Many fires are in a ventilation-limited, decay state by the time firefighters arrive at the scene, meaning that introducing additional ventilation to the environment has the potential to cause rapid and intense fire growth. To more effectively teach firefighters about the potential effects of ventilation on a compartment fire, ventilation-controlled fires should be gener- ated during training. Safely creating such fires while maintaining compliance with NFPA 1403: Standard on Live-Fire Training Evolutions allows instructors to educate students on this important principle of fire dynamics in the training environment. Structures utilized for live-fire training have evolved from typical concrete burn buildings to now include smaller purpose-built props, like those constructed from steel shipping containers or wood and gypsum board. Such props have been embraced by organizations due to their cost-effectiveness and potential to improve fire behavior training. Obtaining a thorough understanding of the capa- bilities and limitations of such props is critical for instructors to convey accurate messages during training and properly prepare firefighters for scenarios they’ll encounter in the field. Experiments were conducted to quantify the fire environment in L-shaped props with different wall constructions. One prop had an interior wall lining of gypsum board over wood studs and fiberglass insulation. The two other props were constructed from metal shipping containers with corrugated steel walls; one had ceilings and walls comprised solely of the corrugated steel, while the other had ceilings and walls comprised of rolled steel sheeting over mineral wool insulation with the corrugated steel wall as its backing. Three fuel packages were compared between the props: one contained furnishings mainly composed of synthetic materials and foam plastics; another contained wooden pallets and straw; and the third contained wooden pallets, straw, and oriented strand board (OSB). A stochastic approach was used to compare data between replicate tests and quantify the repeatability of the different props and fuel packages, all of which were deemed sufficiently repeatable. Comparisons of data between the three props revealed that thermal conditions between experiments in the two metal props were indistinguishable, suggesting that the additional layer of insulation did not significantly alter the fire environment. Additionally, thermal conditions in the gypsum-lined prop were more severe than those in the metal props. The effects of ventilation changes on fire conditions were also analyzed across various prop and fuel load combinations. Lastly, the response of the thermal environment in each prop during interior suppression was evaluated, and the results implied that the thermal exposure to the firefighter was more severe in the metal props than the gypsum prop for a brief period following the start of suppression.

Scholars of teaching and learning examine the impacts of pedagogical decisions on students’ learning and course success. In this report, we describes findings from case studies of eight innovative postsecondary introductory statistics and general chemistry courses that have evidence of improving student completion rates for minoritized and low-income students. The goal of the case studies was to identify the course design elements and pedagogical practices that were implemented by faculty. To identify courses, Digital Promise sought nominations from experts in statistics and chemistry education and reviewed National Science Foundation project abstracts in the Improving Undergraduate STEM Education (IUSE) program. The case studies courses were drawn from 2- and 4-year colleges and were implemented at the level of individual instructors or were part of a department or college-wide intervention. Among the selected courses, both introductory statistics (n = 5) and general chemistry (n = 3) involved changes to the curriculum and pedagogy. Curricular changes involved a shift away from teaching formal mathematical and chemical equations towards teaching that emphasizes conceptual understanding and critical thinking. Pedagogical changes included the implementation of peer-based active learning, formative practice, and supports for students’ metacognitive and self-regulation practices.
