Loin d’un engouement « international » pour la poursuite des crimes commis en Ukraine, nous sommes en présence d’une forte pression occidentale. Cette pression soulève différents problèmes. L’insistance européenne et états-unienne risque d’alimenter la réserve d’États non-occidentaux vis-à-vis de la Cour pénale internationale et fait craindre une fragilisation des enquêtes qu’elle mène sur d’autres situations. La licéité des poursuites pour crimes de guerre visant le Président russe récemment annoncées par la Cour pénale internationale est incertaine dès lors, notamment, que le conflit en Ukraine n’a pas fait l’objet d’un renvoi par le Conseil de sécurité des Nations Unies, qu’il concerne deux États non-parties au Statut de la Cour, et que le travail de celle-ci paraît grandement influencé par un troisième État non-partie, les États-Unis. Enfin, l’impossibilité pour la juridiction pénale internationale de se saisir du crime d’agression, dont la définition est d’ailleurs très stricte au regard des précédents de Nuremberg et de Tokyo, conduit les États occidentaux à contourner la Cour en proposant la création d’un Tribunal ad hoc, au risque de modifier l’état du droit international tel que consacré dans la Charte des Nations Unies.

More people die in Canada every year from work related accidents and illnesses than as a result of murder. More work days are lost to work accidents and illnesses than to strikes and lockouts. Yet the illegalities committed in the field of health and safety in the workplace are, for all intents and purposes, left unnoticed by the criminal justice system. This article addresses the use of penal and criminal law in Quebec against employers who have violated health and safety legislation and the Criminal Code. The first part examines the historical, political and social reasons why deaths and injuries in the work place are perceived as normal and inevitable, rather than as aberra -tions often of a criminal nature. The second part examines the application of statutory legislation in Quebec, particularly the Act Respecting Occupational Health and Safety (R.S.Q. c. S-2.1). The nature of the offences therein provided for is studied, as well as the attitude of the judiciary and the Quebec Health and Safety Commission (C.S.S.T.) towards their application. In the final section the relevant provisions of the Criminal Code are studied, in the light of the rare examples from case law where criminal negligence charges have been laid. The article concludes with the assertion that a change of attitude both on the part of the state and on the part of public opinion is necessary if we wish that health and safety in the workplace be taken seriously by employers.

English Abstract: In recent (post-)conflict scenarios, the diversity and complexity of mass violence, including acts of enforced disappearance and extrajudicial or summary executions, have transformed how knowledge about such crimes is performed and produced socially. In inquiries into human rights violations, the search for, exhumation and identification of missing bodies often buried in mass graves have led distinct applications of forensic work to emerge. These have some differences from traditional crime scene investigation approaches. Novel interactions between forensic science practitioners and the communities where they operate have given place to unprecedented sociocultural, affective and scientific understandings of evidencing mass crimes. Drawing on different ethnographic experiences of unearthing human remains around the world, this collection considers how, in its judicial but also its extrajudicial application, forensic expertise has been transformed in connection to other epistemologies, collective and individual mourning, kinship, memory and a new politics and ethics of care in distinct state- and civil society-led pursuits to account for the dead and missing.French Abstract: Dans les scénarios récents de (post-)conflit, la diversité et la complexité de la violence de masse (y compris les actes de disparition forcée et les exécutions extrajudiciaires ou sommaires) ont transformé la manière dont la connaissance de ces crimes est acquise et produite socialement. Dans le cadre des enquêtes sur les violations des droits de l’homme, la recherche, l’exhumation et l’identification des corps disparus, souvent enterrés dans des fosses communes, ont suscité l’émergence d’applications distinctes du travail médico-légal. Celles-ci diffèrent des approches traditionnelles des enquêtes sur les scènes de crime. Les nouvelles interactions entre les praticiens de la médecine légale et les communautés où ils opèrent ont donné lieu à des compréhensions de la mise en évidence des crimes de masse socioculturelles, affectives et scientifiques sans précédent. En s’appuyant sur différentes expériences ethnographiques de mise au jour de restes humains à travers le monde, cette collection examine comment, dans son application judiciaire mais aussi extrajudiciaire, l’expertise médico-légale a été transformée en relation avec d’autres épistémologies, le deuil collectif et individuel, la parenté, la mémoire, ainsi qu’une nouvelle politique et une nouvelle éthique de la prise en charge dans le cadre des efforts distincts menés par l’État et la société civile pour rendre compte des morts et des disparus.

Résumé Cet essai envisage l’influence éventuelle d’Internet sur la criminalité traditionnelle, c’est-à-dire sur le volume total des vols et des violences dans nos sociétés. Après avoir évalué les recherches sur l’effet criminogène des médias tels que les bandes dessinées, la télévision et les jeux vidéo, nous examinons les effets potentiels d’Internet sur les tendances de la criminalité. En concordance avec la théorie de Cohen et Felson (1979), selon laquelle les changements dans nos activités routinières sont liés aux fluctuations de la criminalité, nous nous demandons comment Internet a pu changer nos habitudes de vies et ainsi jouer sur le volume des crimes. Notre réflexion nous amène à penser qu’Internet fait baisser la criminalité pour trois raisons principales. Premièrement, l’usage d’Internet confine son utilisateur à la maison ou au travail, des lieux de relative sécurité. Deuxièmement, l’usage d’Internet laisse des traces pratiquement indélébiles, ce qui est de nature à dissuader des délinquants potentiels de passer à l’acte. Et troisièmement, Internet fourmille d’informations qui ont un potentiel de protection contre le crime.

Cet article concerne le texte des projets d’articles sur les crimes contre l’humanité provisoirement adopté par la Commission du droit international à sa soixante-huitième session en 2016. Il n’est pas exclu que le texte adopté connaisse ultérieurement des modifications tenant compte de l’évolution des discussions au sein de la Commission du droit international. La version finale du texte des projets d’articles est très attendu par les internationalistes d’autant plus qu’en 2014, la Commission faisait déjà observer dans ce qui constitue un « Rapport final » sur le thème de l’obligation d’extrader ou de poursuivre (aut dedere aut judicare) que le régime conventionnel existant présentait d’importantes lacunes quant à l’obligation d’extrader ou de poursuivre qu’il pourrait être nécessaire de combler. Elle relevait notamment l’absence de conventions internationales comportant cette obligation à l’égard de la plupart des crimes contre l’humanité. Aussi, rappellera-t-elle avoir inscrit ce sujet à son programme de travail, dans le cadre duquel il était envisagé d’élaborer un nouvel instrument portant sur la prévention et la répression des crimes contre l’humanité dont l’un des éléments serait une obligation d’extrader ou de poursuivre les auteurs de ces crimes. Le texte tel qu’adopté pose clairement, d’une part, que les crimes contre l’humanité, qu’ils soient ou non commis en temps de conflit armé, sont des crimes au regard du droit international que les États s’engagent à prévenir et à punir. D’autre part, que les États doivent coopérer à cette fin notamment au moyen de l’obligation de poursuivre ou d’extrader ou de remise. Toutefois, il appert de l’analyse du texte adopté qu’il n’existe à charge des États ni obligation de juger les présumés auteurs, ni celle de les punir. L’obligation consiste en réalité pour l’État à soumettre l’affaire à ses autorités compétentes pour l’exercice de l’action pénale. Ceci ne veut pas dire non plus une obligation d’engager des poursuites dans la mesure où ces autorités gardent sur l’affaire, la maîtrise du déclenchement des poursuites. Elles sont aussi libres de classer celle-ci sans suite sans que cette décision contrevienne à l’obligation imposée à l’État dont elles relèvent, de poursuivre le suspect à défaut de l’extrader ou de le remettre à une juridiction internationale compétente.

Résumé Après la fin de la Seconde guerre mondiale, un débat s’est instauré autour de la question du temps mémoriel qui lie passé et présent. Avec le statut historique acquis par la mémoire collective, une contradiction apparaît alors entre une mémoire multiple et une histoire univoque qui a suscité la défiance d’historiens. Ils optent pour « une histoire critique de la mémoire » et scrutent les « filtres des expériences vécues ». Après une décennie de refoulement du passé, une rupture s’opère au début des années 1960. À la question d’une « histoire critique de la mémoire » des années trente, du IIIe Reich et de ses crimes, les historiens répondent par des théories des fascismes et des analyses de la fin de la République de Weimar. À la fin des années 1970 – alors qu’apparaît le terme Holocauste – le débat sur le temps mémoriel prend en compte la thématique victimes-bourreaux. S’ouvre dès lors en Allemagne de l’Ouest des lieux de mémoire locaux ou régionaux, des itinéraires mémoriels inscrits dans le pavé des villes avec mention nominative des victimes et des « acteurs » directs de l’époque. De vives polémiques apparaissent. Le travail de mémoire reste alors pour l’historien un travail critique qui doit intégrer dans la remémoration volontaire du passé l’interrogation du futur.

Résumé À l’ère de la croissance galopante des prisons sous forme de complexe industriel en Amérique du Nord, les tensions idéologiques vacillent entre châtiment et mouvements en faveur d’une justice réparatrice ou transformatrice. Entre les désinstitutionnalistes, qui cherchent à réduire le nombre de personnes en prison, et les abolitionnistes pénaux, qui visent une transformation sociale, on retrouve nombre de féministes canadiennes. Les femmes au Canada sont désillusionnées suite à l’échec du gouvernement fédéral à mettre en pratique la vision de La création de choix, un rapport d’un groupe de travail sur l’emprisonnement des femmes, datant de 1990. Le gouvernement n’a pas non plus tenu compte des importantes recommandations de la juge Louise Arbour, dont l’enquête de 1996 sur les inconduites du personnel correctionnel met en lumière le non-respect des lois dans les prisons. En 2002, encore plus de femmes se retrouvent dans les prisons à sécurité moyenne ou maximale au Canada pour des crimes relativement mineurs. Les années 1990 nous ont fourni une bonne leçon sur la futilité de la réforme des prisons, tout spécialement au nom du féminisme. Dans l’avenir, les féministes devront impérativement contester les fondements de la pénalité imposée par l’État plutôt que de tenter de réformer une institution désuète.

La presente these entend etudier une oeuvre souvent consideree comme mineure par rapport aux romans les plus celebres et les plus scandaleux du marquis de sade. Le choix des crimes de l'amour obeit a la volonte de combattre cet a priori, de montrer que le recueil de nouvelles tragiques publie en 1800, revele d'une facon singuliere tout l'imaginaire sadien et un remarquable travail d'ecriture, ou l'originalite jaillit derriere le compromis avec les conventions esthetiques et morales. Une premiere partie analyse les rapports des crimes de l'amour avec la tradition de la nouvelle tragique et celle du texte critique defendant la fiction romanesque. Ainsi "l'idee sur les romans", preface aux crimes de l'amour, s'inscrit dans le prolongement de ces textes proposant une definition et un historique d'un genre combattu par les autorites morales, et en meme temps offre une representation nouvelle du romancier. Cette premiere partie etudie egalement les liens avec l'univers de la nouvelle baroque, l'heritage de la nouvelle historique, et montre comment sade parvient a metamorphoser la figure du mechant, omnipresente dans la production romanesque de ses devanciers. Une deuxieme partie, se fondant sur la confrontation du manuscrit de 1787-1788 avec l'edition de 1800, s'emploie a comprendre la genese du texte, et souligne l'inlassable travail de perfectionnement du style associe a une necessaire recherche du compromis avec le public : sade ruse sans jamais se renier, il rehausse la beaute de la vertu souffrante. Une troisieme partie s'attache a montrer que ce recueil est solidaire de toute la production esoterique, elle etudie la conduite du recit, notamment la fonction de l'enchassement narratif dans toutes les fictions sadiennes, elle s'interesse aux destinees feminines et a la figure du libertin dans l'ensemble de l'oeuvre. Ce travail associe l'histoire litteraire, la critique genetique, la reflexion thematique, pour mieux comprendre sadeThis thesis is meant to study a work often considered as minor in relation to the most famous, shocking novels by sade. Choosing les crimes de l'amour comes from the desire to fight against that apriorism, and to show that the collection of the tragic short stories published in 1800 remarkably highlights sade's imagination and his extraordinary art of writing, the originality of which is brought out behind the compromise with the moral and aesthetic conventions. First, i shall study the relationships between les crimes de l'amour and the convention of tragic short stories and that of literary critics defending the fictional art. Thus, "l'idee sur les romans", the preface to les crimes de l'amour, follows that literary tradition giving a definition and the historical background of a genre often questioned by the moral authorities. It also gives a new portrayal of the novelist. I shall also study the links with the world of the baroque short stories, with the legacy of historical short stories and i shall see how sade manages to transfigure the evildoer, an omnipresent character in his precursors' fiction. Second, basing myself on the comparison of the 1787-1788 manuscript with the 1800 edition, i shall cast light on the text's genesis and underline the unflagging effort to improve his style associated with the need to compromise with the reader : by working cleverly without ever renouncing his beliefs, sade beautifully enhances the virtue of suffering. Third, i shall show that this collection of short stories is firmly attached to the esoteric writing. I shall see how the narrative is handled, for instance the role of the embedded narrative, and i shall deal with women's destiny and the libertine character. Cette thèse traite des grèves et de la violence entre les ouvriers agricoles et les patrons dans les plantations de café à São Paulo, au Brésil, dans la période post-abolition (1888-1930). S'appuyant sur l'histoire sociale et sur une diversité de sources historiques, l'objectif est de démontrer que les ouvriers agricoles n'étaient pas des sujets historiques pacifiques et soumis. Bien que les patrons aient interdit la formation de syndicats, les ouvriers ont pu (re)créer des tactiques de résistance et de lutte individuelle, familiale et collective, où les femmes ont joué un rôle primordial en tant que travailleuses et participantes actives dans la lutte contre les multiples formes d’exploitation auxquelles elles étaient soumises dans les fazendas. C’était pour les ouvriers un moyen de contester les stratégies d'exploitation et de domination que les propriétaires de fazendas, par des mécanismes de contrôle rigides et coercitifs et par une discipline excessive, mettaient en œuvre afin de les contenir dans un modèle idéal de travailleur. La répression violente des grèves par les patrons et la police et les agressions physiques entre ouvriers et patrons révèlent que la violence dans les relations de travail en milieu rural au Brésil était fréquente, ce qui démystifie la thèse du pacifisme et de la soumission des travailleurs ruraux brésiliensThis doctoral thesis examines the strikes and the violence between the rural workers and the coffee plantation owners in São Paulo, Brazil, during the post-slavery period (1888-1930). Based on the social history and a wide range of historical sources, the aim being to demonstrate that these rural workers were not in fact passive and submissive historical subjects. On the contrary, although the creation of trade unions was forbidden by the plantation owners, the workers managed to create tactics of resistance as well as individual, familial and collective kinds of struggles. Women played a major role as workers and active participants, fighting against many kinds of exploitations to which they were submitted to in the plantations. It was a way for the workers to contest the strategies of exploitation and domination implemented by the plantation owners, through rigid and coercive control mechanisms and excessive disciplinary measures, in order to confine them into an idealised worker model. The violent repression of the strikes by both the plantation owners and the policy along with physical aggressions between workers and plantation owners, reveal that violence in rural labour relations in Brazil was quite common, demystifying the myth about the pacifism and submission of Brazilian rural workers

Le présent travail analyse les enjeux symboliques liés à l’explication d’un crime par la biographie psychosociale d’un individu marginal lors d’un procès d’assises. Cette thèse s’appuie sur une enquête de « participation observante » menée au sein d’un service social de prévention spécialisée. Du 16 au 25 mars 2010 eut lieu à Tours (France), le procès en cour d’assises de Jean Ouvrard et Julien Lidy. Ils comparaissaient avec cinq autres personnes pour le meurtre avec acte de barbarie de Michel Firmin qui avait eu lieu en 2007. Durant ce procès, je témoignai du suivi éducatif que j’avais mené avec J. Ouvrard dans le cadre de ma fonction d’éducateur de rue. L’hypothèse qui y fut défendue fut, notamment, que le meurtre s’expliquait par les « traits de personnalité pathogènes » du principal accusé, J. Ouvrard. En l’absence de mobile, des extraits de sa biographie psychosociale servirent de support à l’analyse des « raisons du crime ». En ce sens, il y fut « expliqué » une histoire dans laquelle manquait la dimension historique. Dans la première partie du travail, je réalise l’ethnographie du procès d’assises. Dans la deuxième partie, à partir de cette situation, je « déplie » dans le temps et l’espace certaines données issues des débats oraux du procès en analysant différents détours. L’étude des transformations du quartier populaire où résidait J. Ouvrard met en évidence que la déstructuration du tissu ouvrier local a entraîné la stigmatisation identitaire des habitants de Châteauneuf. Les familles en situation de marginalité avancée font l’objet de multiples suivis sociaux et judiciaires. Le suivi du déroulement de ces « prises en charge » auprès de la famille Ouvrard, durant treize années, me permet d’appréhender anthropologiquement des éléments contextuels qui ont conduit ce jeune adulte au désastre mais, au-delà de toutes réifications identitaires, l’attention aux processus socio-anthropologiques favorise également l’observation des tentatives de subjectivation de J. Ouvrard face aux dispositifs sociaux et/ou judiciaires. L’ensemble de ces « détours » permet de mieux revenir, dans la troisième partie du travail, sur les enjeux symboliques liés au dispositif du procès d’assises de J. Ouvrard. L’analyse de la « trame discursive » déployée par les acteurs de la scène judiciaire met en évidence l’agencement d’un « continuum médico-socio- judiciaire » visant à expliquer le meurtre par le « potentiel morbide » de J. Ouvrard. Les traits de personnalité mis en exergue pour expliquer le crime sont notamment liés à la perception négative d’une partie de la jeunesse issue des quartiers populaires français. Ces représentations se retrouvent être relayées par le biais d’un dispositif médiatique dans la société. L’hypothèse du travail est donc d’appréhender ce procès en cour d’assises comme un lieu où se manifestent des vérités identitaires performées à travers la description du « monstre humain », OuvrardThis work analyses what is symbolicallly at stake during a Crown Court case in which a crime is explained by the psychosocial biography of a marginal person. This thesis is built on an «involved observation» survey conducted in a social specialised preventive action department. From March 16th to 25th 2010, in Tours (France), Jean Ouvrard and Julien Lidy were sued in the Crown Court. They appeared with five more people on the charge of Michel Firmin's murder with act of barbarism in 2007. During this lawsuit, I gave evidence of the educationnal support I provided for Jean Ouvrard as a street youth worker. The proposed hypothesis was to account for the murder emphasized by the «pathogenic personality traits» of the main defendant, Jean Ouvrard. Without any motive, some extracts from his psychosocial biography supported the analysis for the «reasons of murder». By this way, a murder case without historical aspects was «explained». As a first part of this work, I focus on the Crown Court ethnography. Secondly, from this case, I «unfold» in time and space some elements of the lawsuit oral debates, analysing some deviations in Jean Ouvrard's life. Examining the transformations of the popular district where Jean Ouvrard lived emphasizes that the breaking up of the local working class social fabric led to stigmatize the Chateauneuf inhabitants' identity. Families living in advanced marginality are subjected to many social supports and judicial proceedings. Following-up the 13 year sequence of «social care» for the Ouvrard family helps me to anthropologically understand some contextual facts which drove this young man to disaster. However, beyond the identity reifications, paying attention to the social and anthropological process enables to observe the individualization attempted by Jean Ouvrard while facing social and/or judicial systems. All these «detours» allow us to return, in the tird part of this thesis, to what is symbolically at stake in the system of the Jean Ouvrard case in the Crown Court. The analisys of the discursive framework displayed by the judicial parties inolved in the court highlights the layout of a «judicial social and medical continuum» aiming at giving account for Jean Ouvrard's «morbid abilities». Specific traits connected to the crime are linked particularly to a negative glimpse of a part of the French popular-district youth. These representations are relayed in the society by the media system. Therefore, this work hypothesis is to puzzle out the Crown Court case as an event in which some obvious character traits are revealed and magnified by describing the «human monster», Jean Ouvrard

Ce travail porte sur les processus psychiques qui sous-tendent l'acte de violence sexuelle à l'âge adulte, avec la perspective de les comprendre à la lumière du processus de subjectivation adolescent, du travail d'historisation et des enjeux identificatoires, en termes de bisexualité psychique, qui y sont liés. Les observations cliniques s'appuient sur plusieurs entretiens non directifs ainsi que sur la passation du Rorschach et du TAT avec 8 hommes auteurs de violence sexuelle étant sous soins pénalement ordonnés après la fin de leur incarcération. Ils ont été rencontrés dans une institution spécialisée en participant de manière libre à cette recherche. Ces hommes ont tous agi leur première violence sexuelle à l'âge adulte et non lors de l'adolescence comme c'est le cas pour la majorité de ces individus. La passation du TAT comporte aussi les planches habituellement destinées aux femmes et la planche 17BM afin d'appréhender davantage les subtilités identificatoires de ces personnes. Ces observations m'ont permis de développer ensuite des hypothèses et réflexions métapsychologiques concernant ces personnes afin de tenter de proposer une interprétation de la manière dont l'acte de violence sexuelle peut s'inscrire dans leur parcours de vie. Enfin, ce travail s'ancre dans des perspectives de soins. En effet, il vise à souligner d'une part l'importance de l'adolescent dans l'adulte au sein de la psychothérapie et, d'autre part, la richesse de la méthode de recherche utilisée ici comme potentiel levier thérapeutique pour les personnes sous soins pénalement ordonnésThe aim of this study is to examine the psychic processes underlying the act of sexual violence within a population of adult offenders in light of the adolescent process of subjectivation, the work of historicization and the bisexual dispositions of identifications. Clinical data was collected from non-directive interviews and projective assessments of 8 male sexual offenders who had committed their first sexual offense later at adulthood, an uncommon criterion in this population. The sample was selected from a specialized institution for penal imposed treatments after incarceration. Along with the Rorschach, the TAT was administered with the exceptional inclusion of the 17BM and feminine cards in order to gain a better understanding of identification dynamics. The findings highlighted metapsychological basis for the interpretation of the function of sexual violence in the patient's life course, thus yielding important therapeutic implications. Essentially, this research emphasizes the importance of considering the adolescent process in adult psychotherapy. It also underlines the potentially therapeutic benefits yielded by this specific research method amongst the population of sexual offenders undergoing court-ordered treatments

Then, we analyse the various relationships between state and workers movement as different integrations of parts of the working class. We discuss the sociological and close to marxism theories of social reproduction. Then we analyse the current crisis as the crisis of the wage-earning, the failure of labour division. Finally, in the current period and through the new educative project of state, we see a tentative redefinition of labour division. The division between manual and intellectual work is now based on the tutorship of the actual workers. As a conclusion, we see the teaching enterprise as a new strategy of the capital to enforce the separation between work and education

Grâce à ce genre d’échanges, et imprégnés par ailleurs de la tradition institutionnaliste en économie et de la Théorie des Organisations, ils ont été amenés à y explorer à la fois l’inertie et le changement. Leur problématique a été développée à travers de nombreuses notions : le caractère incertain et cumulatif du progrès technique, les paradigmes et les trajectoires technologiques, l’irréversibilité des choix, les phénomènes de renfermement dans une trajectoire sous-optimale, les routines et l’apprentissage, et les systèmes nationaux d’innovations, par exemple. Mais malgré ses acquis, la théorie évolutionniste éprouvera des difficultés à traiter la dimension politique de l’entreprise et à intégrer celle-ci dans les processus d’innovation et d’apprentissage. Their loyalty to neo-Schumpeterian heritage has resulted in a strong affinity towards the problematic of the economy of the technology. Due to this kind of exchanges, and also impregnated with the institutionalism tradition in economy and the organisations theory, they were conduced to explore the inertia and the change at the same time. Their problematic was developed through various notions: the uncertain and cumulative character of the technical progress, the technological paradigms and trajectories, the irreversibility of choices, the phenomenon of lock-in at suboptimal trajectories, the routines and the learning process, and the national innovation systems, for instance. However, despite these theoretical advancements, the evolutionist theory will face difficulties in dealing with the enterprise’s political dimension and in inserting it in the innovation and learning process. This thesis has exactly the ambition of contributing to fulfil this gap. On the one hand, the thesis takes into account the ways of institutionalisation of the employment relationship and the modes of organisation of human resources’ management. On the other hand, it considers the modes of institutionalisation of innovation process and the modes of organizing the learning process in the enterprises. The experience of the Brazilian iron and steel industry help to discuss the limits and possibilities of the emergency of cooperative relations, considering the local specificities of the employment relations and the importance of incremental innovations in this industry

La présentation de ces travaux est partie d'un ouvrage d'"ego-histoire" avant la lettre "Lla République se meurt, 1956-1958" (1978) -de ma génération avec la crise finale de la IVe République. En ces années 1956-1958, la notion de crise n'est plus attachée ni aux structures ni à la conjoncture économiques: si l'on peut dire, on y rencontre la politique à l'état pur, dans une explosive autonomie. Partant d’un questionnement qui se réfère aux conditions d’émergence et de prolifération d’emplois informels amplifiés par la crise structurelle que traverse ce pays, laquelle a détruit l’emploi formel, cette thèse réfute l’unicité de l’informel à l’intérieur du marché du travail de la RDC et analyse plutôt son hétérogénéité, en s’appuyant sur les analyses de Lautier (2004), Maloney (2004), Fields (2005) et Bacchetta et al (2009).Cette évidence a justifié la combinaison des théories de l’informalité et de la segmentation, suivie d’une exploitation de deux types de données mutuellement enrichissantes : les données quantitatives de l’enquête 1-2-3 et les données qualitatives collectées sur le terrain d’une activité spécifique : le marché des matériels d’occasion d’Europe, appelés « bilokos » en RDC. AbstractSwiss tourism relies heavily on international clientele to book rooms and purchase goods and services. However, from March to June 2020, due to the COVID-19 pandemic, travel and subsequent bookings slowed and, in some cases, stopped altogether. Based predominantly on Situational Crisis Communication Theory (SCCT), this paper investigates Swiss hotels’ messages on their official Facebook pages and the SCCT strategies they employed during this crisis. The findings from 48 independent four- and five-star hotels show that the Victimage strategy was the most often employed when communicating about the COVID-19 pandemic in general. Further, most hotels published positive messages during this period (68%) and strongly emphasized their roles as victims at this time. Only 5% of the messages posted were negative messages. Hotels ‘blamed’ the government and the sanitary measures for their closing or reduced services. The findings presented here contribute to the literature by offering a pattern of crisis responses from Swiss hotels in the early period of the pandemic. These results are currently being updated with the messages communicated in the 12 months since the beginning of this study. The findings of this crisis communication during an early stage of the pandemic will be used to make concrete recommendations for the strategies that should be implemented in the future if the COVID-19 crisis continues or when faced with other crises.

By enhancing our understanding of the revenge travelers across different types, this study offers insights for industry managers and policymakers in developing better strategies to facilitate recovery in tourism following a crisis.

AbstractOn the last day of 2019, China alerted the World Health Organization to a cluster of mysterious pneumonia cases. A new coronavirus (Covid-19) was discovered. Within three months after the alert, Europe had become the epicenter of a global pandemic. Even though the virus spread easily and quickly within communities, it took its time to travel from China to northern Europe. Nevertheless, many governments were slow to respond to the emerging threat. This chapter analyzes the initial phase of the Covid-19 crisis in Sweden and the Netherlands, focusing on the relationship between experts and decision-makers. The chapter discusses four factors that may help explain why the Swedish and Dutch governments were slow in their response. The governments assumed an epidemic like the one in China would not happen in their country, the experts followed international scientific guidelines, citizens were expected to defy limitations on their freedoms, and both experts and decision-makers were confident with regard to the level of preparedness. Lessons are formulated for further analysis and future preparations.

With surge in post-COVID tourism, the travel destinations are seeing a high volume of travellers seeking to fulfil their pent-up wanderlust. Travellers generally do not consider themselves vulnerable to crimes when on holidays – specifically to first world countries in Europe. However, there has been a significant increase in petty crimes against tourists which have become common in tourist hotspots across Europe and other places. Petty crimes experienced by tourists can often lead to not only material and monetary loss but also result in tainting the whole travel experience. The present paper reviewed existing research in a scoping review which examined tourists’ experiences following petty crimes on their well-being with focus on Europe. Utilizing the Biopsychosocial model, the post crime experiences of travellers were grouped as biological, psychological, and social outcomes to understand the complex ways in which travellers are affected by less than positive experiences while visiting tourist locations. The review shows paucity of works that aimed to understand travellers’ experiences, with majority of works choosing to focus on effect of petty crimes on hospitality sector.

Until the beginning of this year, tourism was the favored brain child, both by economy's family and by destiny. Over the past decades, the cataclysms, crises and upheavals in the global economic family have either diverged or not deeply affected the tourism sector, as it managed quickly to shake them off and stand back on its feet and even thrives. Unfortunately, it seemed that this time the tourism was down on its luck and the industry was shaken to its core and collapsed, sliding on the plane of devastation. Is there any hope, what is the rescue strategy, how scared are the tourists from the crisis caused by SARS-CoV-2 and the disease COVID-19 caused by it? The aim of this report is to use the computer language python and a web-based interactive computing environment for creating documents - jupyter notebook, to answer the above questions, analysing a survey implementing statistical models and tools.

The future of tourism after one of the greatest health crises caused by the novel coronavirus is uncertain. Fear of infection and health concerns increased during the pandemic. The restrictive measures have limited international travel, which led to great expectations of an end to the pandemic for freer movement and safe travel. The great consequences of the COVID-19 for the tourism industry and tourism destinations will have its effects even after the end, and the post-pandemic tourism recovery strategies should be well planned and in focus along with strategies for the keeping tourism industry during the crisis. This paper aims to investigate the residents’ support for post-pandemic tourism in one of the most famous tourism destinations in Serbia, Vrnjačka Banja. The support of the residents was observed taking into account their perceptions on tourism during the pandemic.

The tourism industry is very sensitive to the influence of various crisis situations which can have smaller or greater negative impact on its development. Many tourist destinations closed their borders due to the development of a global pandemic of COVID-19, which resulted in a dramatic reduction of tourist turnover as well as the temporary stop of normal functioning of the tourism industry. Moreover, the current health crisis influenced significantly the changes in decision-making process of tourists when choosing a holiday destination and the way of organizing their journey. The purpose of this paper is to examine the relations among travel risk perception, tourist behavior during travel and the frequency of travel among Serbian residents when the individual characteristics of the respondents are controlled. Results of the empirical research indicate that tourist’s behavior during travel is positively connected with the travel risk perception. Furthermore, age and education affect the travel risk perception.

The crisis caused by the Covid-19 virus has had a significant impact on the tourism industry and brought numerous changes in travel patterns. Uncertainty, travel risks, restrictions, strict measures and limitations in terms of physical contact and mobility affected a re-evaluation of the existing travel plans. The paper investigates travel plans among travelers in three Balkan countries (Serbia, Bosnia and Herzegovina, and Montenegro). Understanding tourists’ preferences and future intentions are the essential basis for creating a tourist offer, keeping tourists at the national and regional level, and mitigating the harmful effects of the crisis. These could contribute to the faster regional recovery of the tourism industry on the one hand and higher levels of tourist satisfaction on the other.

Le programme Covid-19 Responses for Equity (CORE) est une initiative sur trois ans financée par le Centre de recherches pour le développement international (CRDI) du Canada, qui a rassemblé 20 projets issus des pays du Sud afin de comprendre les impacts socio-économiques de la pandémie de Covid-19, d’améliorer les réponses existantes et d’élaborer de meilleures options politiques pour favoriser la relance. Les recherches ont porté sur 42 pays d’Afrique, d’Asie, d’Amérique latine et du Moyen-Orient afin de comprendre comment la pandémie a affecté les régions et les personnes les plus vulnérables en aggravant les fragilités existantes. Les projets de recherche ont couvert un large éventail de thèmes, notamment les politiques macroéconomiques de soutien et de redressement, l’appui aux activités économiques essentielles et la protection des entreprises informelles, des petits producteurs et des femmes au travail, ainsi que la promotion d’une gouvernance démocratique pour renforcer la responsabilité, l’inclusion sociale et l’engagement civique. L’Institute of Development Studies (IDS) a apporté aux partenaires de recherche du programme CORE un appui à l’application des connaissances afin de maximiser l’apprentissage généré dans l’ensemble du portefeuille de recherche et d’approfondir l’engagement auprès des gouvernements, de la société civile et de la communauté scientifique. Les théories du sensemaking, ou fabrication de sens, analysent la manière dont ceux qui participent à une action, et qui sont confrontés à une interruption, répondent à deux questions: Que se passe-t-il? Que faut-il faire maintenant? Les personnes plongées dans l’action ont souvent des difficultés à rester au contact du monde, et cette faillite de la fabrication du sens peut avoir des conséquences dramatiques. En s’appuyant sur de nombreuses études de cas, les auteurs présentent les fondements de la théorie du sensemaking — due au célèbre psychosociologue américain Karl Weick — et ses principaux apports. Le document s’intéresse aux différents facteurs et éléments influençant la capacité des participants à une action à rester en «contact» avec ce qu’il se passe dans «le monde». Notamment, il examine les difficultés à détecter des signes de dégradations de la sécurité, à signaler des anomalies, à adapter son action et à improviser de façon appropriée face à des situations imprévues. But with the increasing availability of vaccines and prospects for a resumption of international travel, light is emerging at the end of the Pandemic tunnel. With this in mind, The Inter-American Development Bank Caribbean1 Departments most recent Quarterly Bulletin reviews the latest available information regarding the crisis impacts on citizens, their economies, and key factors that will determine the speed and depth of recovery. As also discussed in previous editions, prospects for tourism-dependent economies will depend heavily on vaccine penetration and border normalization in source countries particularly the United States and Western Europe, while commodity-intensive economies could benefit from upward revisions to global demand growth estimates. All countries in the region can do much to support a rapid recovery through forward-looking policies aimed at ensuring they are well positioned to take advantage of post-Pandemic preferences with respect to travel and tourism, services trade, and investment. Our latest report considers these issues, what may lie ahead, and how counties can best position themselves for a recovery in 2021 and beyond.

Le projet de recherche fait partie du programme d'éducation BRiCE, financé par la Direction Générale des Partenariats Internationaux de la Commission Européenne et dirigé par Save the Children au Niger et en République Démocratique du Congo (RDC). Ce rapport présente les résultats de l'évaluation à mi-parcours de deux composantes du programme éducatif BRiCE : le développement professionnel des enseignants (DPE) et l'amélioration des environnements d'apprentissage ensemble (ILET). Il présente également une analyse approfondie du bien-être des enseignants et de la qualité de l'enseignement dans les régions de Zinder et Diffa au Niger, et d'Uvira et Fizi dans la province du Sud-Kivu en RDC. As the crisis of climate change looms, transportation policy in California continues to emphasize sustainability in land-use and transportation decisions. This report evaluates the implementation of two sustainability-focused policies (Senate Bill 375 and 743) by local governments and the current-state-of-the-practices by metropolitan planning organizations (MPOs) in assisting them in California. The research focuses on local governments’ access and use of vehicle miles traveled (VMT) and transportation data for achieving VMT and greenhouse gas (GHG) reduction by land-use planning. The research also examines the role of MPOs in providing needed transportation data, training, and technical support to its local members to help them quantify VMT impacts of land-use plans and projects. Through surveys and interviews of 539 city and county governments and 18 MPOs in California, the research team analyzes current practices. Findings include that local governments utilize automobile data more frequently than alternative modes, and do not heavily rely on MPOs for obtaining transportation data. Local governments recognized the need for more transportation data and were particularly interested in publicly available sources. The MPOs reported that VMT/annual average daily traffic data and origin-destination matrix were most frequently requested. More sophisticated data such as travel-time matrix and mode-share scheme were considered useful by the MPOs, while requests were very low. Based on the results of the conducted surveys, interviews, and our analyses, we developed a transportation data guide for local governments that could help them access data for achieving VMT/GHG emission reduction via land-use planning. The guide has two parts, one for general plan update and any land-use plans along with SB 375 and the other for VMT analysis for project-level California Environmental Quality Act reviews. The guide includes several different approaches that can be chosen and tried by local governments depending on their resource level and geographic, social, and physical characteristics. These findings can facilitate the access and use of transportation data to aid in sustainable land-use planning for the betterment of local communities and the planet.

La recherche présentée ici s’intéresse aux processus de qualification et de déqualification d’espaces industriels situés en milieu urbain. En effet, à partir de l’étude des arbitrages entre recherche de sécurité et développement urbain dans le contexte particulier d’un site industriel sinistré, il s’agit de voir en quoi la catastrophe s’impose comme un temps brutal, et parfois irréversible, de déqualification d’un espace dédié jusque-là à l’industrie. Ces travaux entendent montrer comment s’opèrent les arbitrages en situation de crise, la prégnance de la catastrophe et de l’émotion qu’elle suscite dans les décisions à court terme. L’un de leurs intérêts réside dans la mise en perspective de deux cas de sites sinistrés. Il s’agit tout d’abord du pôle chimique sud-toulousain, dévasté par l’explosion dans l’usine d’engrais AZF le 21 septembre 2001. Cet accident a entraîné la mort de 31 personnes, des blessures pour de nombreuses autres, et de multiples dégâts matériels dans toute la ville de Toulouse. L’autre cas concerne l’incendie du dépôt pétrolier Shell dans le port industriel Édouard Herriot de Lyon en juin 1987, ayant causé la mort de deux personnes.

With a few exceptions, research on ride-hailing has focused on North American cities. Previous studies have identified the characteristics and preferences of ride-hailing adopters in a handful of cities. However, given their marked geographical focus, the relevance and applicability of such work to the practice of transport planning and regulation in cities in the Global South is minimal. In developing cities, the entrance of new transport services follows very different trajectories to those in North America and Europe, facing additional social, economic, and cultural challenges, and involving different strategies. Moreover, the determinants of mode choice might be mediated by social issues such as the perception of crime and the risk of sexual harassment in public transportation, which is often experienced by women in large cities such as Mexico. This paper examines ride-hailing in the Metropolitan Area of Mexico City, unpacking the characteristics of its users, the ways they differ from users of other transport modes, and the implications for urban mobility. Building on the household travel survey from 2017, our analytical approach is based on a set of categorical models. Findings suggest that gender, age, education, and being more mobile are determinants of ride-hailing adoption. The analysis shows that ride-hailing is used for occasional trips, and it is usually done for leisure and health trips as well as for night trips. The study also reflects on ride-hailings implications for the way women access the city.
