Abstract:
The purpose of the article is to analyze the method of reconstruction as one of the general scientific methods of criminology used in the investigation of crimes. The subject of research is the method of reconstruction in forensic science. The research methodology includes the use of general scientific and special methods of scientific cognition: dialectical, historical and legal, formal and logical, comparative and legal, logical, system and structural methods, method of generalization. Research results. General scientific methods of criminology and their significance for crime investigation are considered. Reconstruction as a type of modeling method and its place in the system of forensic methods is defined. The signs of reconstruction and its features distinguishing from modeling are analyzed. The variants of reconstruction and their features are given. Practical meaning. The concept of reconstruction as an independent method of crime investigation and its implementation in the system of investigative (search) actions are proposed. Value / originality. Emphasis is placed on the need for further study of reconstruction as a special method of investigating crimes.

Abstract:
The issue of the escalation of crime, which is increasingly varied and is getting heavier, is becoming a global concern. The development and progress of the world seems to have contributed to changes in the type and quality of crime, not only in the form and method, but also in the damage it causes. Crime trends increasingly point to collective crimes, systematic crimes, and crimes with extensive and massive excess damage. This article intends to criticize the systematic change (evolution) that has occurred in the concept of ḥirābah crime in Islamic law from a classical to contemporary perspective. The qualitative analysis of this article is focused on three fundamental issues, namely; ḥirābah interpretation, ḥirābah liability, and ḥirābah punishment. The author reveals in the conclusion that; first, based on its elements and characteristics, the definition of ḥirābah can be expanded to include new types of crimes such as; terrorism, rape, and drug trafficking and smuggling. Second, it is necessary to reconstruct the ḥirābah responsibility theory into a formulation that considers the principle of legal certainty and the principle of equality before the law. The reconstruction model, among others, is the affirmation that all people who involve themselves in the crime are perpetrators of ḥirābah (with an ishtirāk approach). Likewise, reconstruction efforts are needed to enforce equality of accountability between male and female actors. Third, as a serious crime, ḥirābah deserves a severe punishment and has a strong deterrent effect, as offered by Islamic law. However, the opportunity to give dispensation to the punishment will always be open if the perpetrator can prove his seriousness in repenting.[Eskalasi kriminalitas yang semakin beragam dan berat telah menjadi perhatian global saat ini. Pembangunan dan kemajuan dunia berkontribusi pada perubahan pola dan tingkat kriminalitas, tidak hanya bentuk dan cara, tetapi juga akibat yang ditimbulkan. Trend kriminalitas bertambah mulai dari yang berkelompok, sistematis, hingga yang kerusakannya masif dan pengaruhnya panjang. Tulisan ini mengkritisi perubahan sistematis pada konsep kriminal (ḥirābah) dalam hukum Islam dari pendekatan klasik hingga kontemporer. Analisis kualitatif dalam tulisan ini fokus pada tiga hal mendasar yaitu penafsiran, arah kecenderungan dan hukuman. Kesimpulan pertama tulisan ini adalah definisi kriminal berdasarkan unsur dan karakternya yang dapat meluas maknanya termasuk terorisme, pemerkosaan, narkoba, dan penyelundupan. Kedua, perlu rekonstruksi baru teori kriminalitas yang mempertimbangkan kepastian hukum dan kesetaraan hak dimuka hukum. Ketiga, sebagai kejahatan serius, ḥirābah pantas mendapat hukuman berat dan mempunyai efek pencegahan yang kuat seperti halnya dalam hukum Islam. Meski demikian, ada peluang dispensasi hukuman jika pelaku dapat menunjukkan kesungguhan untuk bertobat.]

Abstract:
In this paper I reconsider the Roman law on magic through an examination of three key ““moments””: the Lex Cornelia de sicariis et veneficiis; the trial of Apuleius as known from his Apology; and a passage from The Opinions of Paulus. I argue that the Roman law on magic grounded in the Lex Cornelia gradually shifted from a focus on harmful and uncanny actions to a concern with religious deviance. This shift was already underway at the time of Apuleius' trial, if only on an ad hoc basis, and was firmly established in the formal discourse of Roman law by ca. 300 CE, the date of The Opinions of Paulus. I argue for the importance of retaining ““magic”” as a heuristic category, since it is the only term fluid enough to function as an inclusive rubric for this shifting set of concerns.

Civil rights cemented its place on the national agenda with the passage of the Civil Rights Act of 1964, fair housing legislation, federal enforcement of school integration, and the outlawing of discriminatory voting mechanisms in the Voting Rights Act of 1965. Less recognized but no less important, the Second Reconstruction also witnessed one of the most punitive interventions in United States history. The death penalty was reinstated, felon disenfranchisement statutes from the First Reconstruction were revived, and the chain gang returned. State and federal governments revised their criminal codes, effectively abolishing parole, imposing mandatory minimum sentences, and allowing juveniles to be incarcerated in adult prisons. Meanwhile, the Law Enforcement Assistance Act of 1965 gave the federal government an altogether new role in crime control; several subsequent policies, beginning with the Crime Control and Safe Streets Act of 1968 and culminating with the Federal Sentencing Guidelines, ‘war on drugs,’ and extension of capital crimes, significantly altered the approach. These and other developments had an exceptional and long-lasting effect, with imprisonment increasing six-fold between 1973 and the turn of the century. Certain groups felt the burden of these changes most acutely. As of the last census, fully half of those imprisoned are black and one in three black men between ages 20 and 29 are currently under state supervision. Compared to its advanced industrial counterparts in western Europe, the United States imprisons at least five times more of its citizens per capita.

Abstract:
Recently, with an increase in the number of studies of the safety of both pedestrians and passengers, computer software, such as MADYMO, Pam-crash, and LS-dyna, has been providing human models for computer simulation. Although such programs have been applied to make machines beneficial for humans, studies that analyze the reconstruction of accidents or crime scenes are rare. Therefore, through computational experiments, the present study presents reconstructions of two questionable accidents. In the first case, a car fell off the road and the driver was separated from it. The accident investigator was very confused because some circumstantial evidence suggested the possibility that the driver was murdered. In the second case, a woman died in her house and the police suspected foul play with her boyfriend as a suspect. These two cases were reconstructed using the human model in MADYMO software. The first case was eventually confirmed as a traffic accident in which the driver bounced out of the car when the car fell off, and the second case was proved to be suicide rather than homicide.

Corruption crimes is an iceberg phenomenon whose cases increase every year in Indonesia. The crime is carried out by person, groups of people, and corporations. Sadly, the perpetrators of corruption are also dragging the government or authorities, both executive, legislative, and judicial institutions. Policy by policy has been issued and there are even ad hoc institutions and special courts that handle these crimes. But in fact, this problem still not over, so there are indications that policies have not succeeded in overcoming corruption. The problems that have troubled the nation are very important to be studied scientifically. Reconstruction is needed for law enforcement efforts to deal with criminal acts of corruption, especially in its criminal system. This study aims to determine the criminal system of corruption and the reconstruction of the criminal system on corruption. This study uses a type of normative juridical research with the specification of the research is descriptive analytical. The data used is secondary data obtained through librarian and documentation studies which are then analyzed qualitatively. Based on the research, the results are: First, the criminal system on corruption acts refers to Law No. 39 of 1999 as amended by Law No. 20 of 2001 as its lex specialis. Second, the reconstruction of the criminal system can be directed at the rules of legislation governing material, formal, and implementing criminal law. In this case the researcher highlights criminal sanctions which include form, severity, and indicators of imposition of sanctions, and the methods of execution and coaching.

Corruption is a crime, just like all other crimes which has existed since a long time ago. The problem is that corruption is like a virus in the society which may spread very quickly. It is difficult to eradicate. The efforts to eradicate corruption has been carried out, but the reality shows that it keeps on increasing along with the increasing welfare, technologies, and development. On 2018, Indonesia stood in the 89th place of the world corruption rank. Thus, there needs to be a reconstruction to the forms of the main and the additional punishments in Indonesia’s positive law, so that it is clear that corruption is a terrible crime which must be fought using extraordinary methods. In Indonesia’s constitution of Corruption Eradication Article 2 clause 2 of the constitution No. 31 of 1999 it states that, “In the case of the crime of corruption as meant in clause (1), when carried out under certain conditions, death penalty may be imposed.” From the explanation of that article, and also from the Constitution No. 31 of 1999 it can be concluded that the forms of existing main punishments are: Imprisonment for some time or life sentence, death sentence, or fine. Meanwhile, the forms of additional punishments are: The revocation of certain rights, the deprivation of certain items, the announcement of the judge’s verdict, the deprivation of tangible movable properties (unmovable and intangible) which are used or are obtained from corruption, the payment of replacement money according to the amount obtained from corruption, the closing of some businesses for the maximum period of one year, and the revocation of all or some rights (the elimination of some privileges. The United States Constitution established a federal system, not a national government. States continued necessarily and by design as active and important centers of governmental activity. States were institutions of inherent authority, while the federal government by original intent and then explicitly by amendment, was a government of only delegated powers. Since the federal government derived its power directly from the people and acted directly on individuals, it was decisively more powerful than the pre-Constitution Confederation. But the Bill of Rights itself is evidence of the continued worry, pervasive until modified by the Reconstruction Amendments, that the federal government might, but should not, overwhelm the states.

Abstract:
A valuable aspect during crime scene investigation is the digital documentation of the scene. Traditional means of documentation include photography and in situ measurements from experts for further analysis. Although 3D reconstruction of pertinent scenes has already been explored as a complementary tool in investigation pipelines, such technology is considered unfamiliar and not yet widely adopted. This is explained by the expensive and specialised digitisation equipment that is available so far. However, the emergence of high-precision but low-cost devices capable of scanning scenes or objects in 3D has been proven as a reliable alternative to their counterparts. This paper summarises and analyses the state-of-the-art technologies in scene documentation using 3D digitisation and assesses the usefulness in typical police-related situations and the forensics domain in general. We present the methodology for acquiring data for 3D reconstruction of various types of scenes. Emphasis is placed on the applicability of each technique in a wide range of situations, ranging in type and size. The application of each reconstruction method is considered in this context and compared with respect to additional constraints, such as time availability and simplicity of operation of the corresponding scanning modality. To further support our findings, we release a multi-modal dataset obtained from a hypothetical indoor crime scene to the public.

The process of disease diagnosis reminds of the process of solving a crime. This starts with a so-called ‘crime scene investigation’ (CSI) carried out in a highly systematic manner. The CSI is followed by ‘forensic investigation’ in specialized laboratories. The final step in solving a crime is the ‘crime scene reconstruction’ process, which involves systematic elimination of unlikely scenarios and comparison of results from the analysis of physical evidence with eye witness accounts. If more evidence becomes available, an ‘old case may be reactivated’. In this review, the same sequence of activities is followed to solve a plant disease problem using a case study of a disease that was difficult to diagnose, namely the ‘case’ of corky root of lettuce.

Participants’ interviews revealed four superordinate themes: (1) insight and change in the lives of OAPO; (2) a series of losses lead to disillusionment with a life of crime; (3) desistance as the only alternative; and (4) fear of death in prison as a catalyst for desistance. The findings suggest that desistance intention among older adults in prison is an individualized process deeply affected by age-related motivations and dynamics.

Abstract:
Crime scene documentation is a fundamental task which has to be undertaken in a fast, accurate and reliable way, highlighting evidence which can be further used for ensuring justice for victims and for guaranteeing the successful prosecution of perpetrators. The main focus of this paper is on the documentation of a typical crime scene and on the rapid recording of any possible contamination that could have influenced its original appearance. A 3D reconstruction of the environment is first generated by processing panoramas acquired with the low-cost Ricoh Theta 360 camera, and further analysed to highlight potentials and limits of this emerging and consumer-grade technology. Then, a methodology is proposed for the rapid recording of changes occurring between the original and the contaminated crime scene. The approach is based on an automatic 3D feature-based data registration, followed by a cloud-to-cloud distance computation, given as input the 3D point clouds generated before and after e.g. the misplacement of evidence. All the algorithms adopted for panoramas pre-processing, photogrammetric 3D reconstruction, 3D geometry registration and analysis, are presented and currently available in open-source or low-cost software solutions.

The most important part in a Book of Criminal Law (Penal Code) is a prison, because the prison contains rules about the size and implementation of the criminal. The position of life imprisonment in the national criminal justice system is still considered relevant as a means of crime prevention, it can be seen from the number of offenses punishable with life imprisonment. However, life imprisonment is considered contrary to the penal system. This study aims to investigate the implementation of life imprisonment, weaknesses, and the solution in the future. The approach used in the study is a non-doctrinal legal research with socio-legal research types (Juridical Sociological).The results of research studies show that life imprisonment is contrary to prison system, and life imprisonment become an obstacle to fostering convicts back into society. Bill Criminal Code of September 2019 can be used as a solution to life imprisonment change in the future. Presented advice, in order to be disseminated to the application of the criminal purpose of the Criminal Code of Prison adopted in the future, so that the public and experts no longer make the criminal as a form of retaliation.Keywords: Reconstruction; Crime; Prison; Life Imprisonment; System; Corrections.

Purpose. The total variation (TV) minimization algorithm is an effective image reconstruction algorithm capable of accurately reconstructing images from sparse and/or noisy data. The TV model consists of two terms: a data fidelity term and a TV regularization term. Two constrained TV models, data divergence-constrained TV minimization (DDcTV) and TV-constrained data divergence minimization (TVcDM), have been successfully applied to computed tomography (CT) and electron paramagnetic resonance imaging (EPRI). In this work, we propose a new constrained TV model, a doubly constrained TV (dcTV) model, which has the potential to further improve the reconstruction accuracy for the two terms which are both of constraint forms. Methods. We perform an inverse crime study to validate the model and its Chambolle-Pock (CP) solver and characterize the performance of the dcTV-CP algorithm in the context of CT. To demonstrate the superiority of the dcTV model, we compare the convergence rate and the reconstruction accuracy with the DDcTV and TVcDM models via simulated data. Results and Conclusions. The performance-characterizing study shows that the dcTV-CP algorithm is an accurate and convergent algorithm, with the model parameters impacting the reconstruction accuracy and the algorithm parameters impacting the convergence path and rate. The comparison studies show that the dcTV-CP algorithm has a relatively fast convergence rate and can achieve higher reconstruction accuracy from sparse projections or noisy projections relative to the other two single-constrained TV models. The knowledge and insights gained in the work may be utilized in the application of the new model in other imaging modalities including divergence-beam CT, magnetic resonance imaging (MRI), positron emission tomography (PET), and EPRI.

The technical progress in the last decades makes photo and video recording devices omnipresent. This change has a significant impact, among others, on police work. It is no longer unusual that a myriad of digital data accumulates after a criminal act, which must be reviewed by criminal investigators to collect evidence or solve the crime. This paper presents the VICTORIA Interactive 4D Scene Reconstruction and Analysis Framework (“ISRA-4D” 1.0), an approach for the visual consolidation of heterogeneous video and image data in a 3D reconstruction of the corresponding environment. First, by reconstructing the environment in which the materials were created, a shared spatial context of all available materials is established. Second, all footage is spatially and temporally registered within this 3D reconstruction. Third, a visualization of the hereby created 4D reconstruction (3D scene + time) is provided, which can be analyzed interactively. Additional information on video and image content is also extracted and displayed and can be analyzed with supporting visualizations. The presented approach facilitates the process of filtering, annotating, analyzing, and getting an overview of large amounts of multimedia material. The framework is evaluated using four case studies which demonstrate its broad applicability. Furthermore, the framework allows the user to immerse themselves in the analysis by entering the scenario in virtual reality. This feature is qualitatively evaluated by means of interviews of criminal investigators and outlines potential benefits such as improved spatial understanding and the initiation of new fields of application.

White-collar offenders have access to resources that make financial crime convenient. In the rare case of crime suspicion, resources are available in terms of professional attorney work, control over internal investigations, and public relations support. Hiring private investigators at an early stage of potential crime disclosure enables the organization to control the investigation mandate and influence the investigation process and the investigation output. Getting an early start on reconstruction of the past in terms of a fraud examination makes it possible for the suspect and the organization to influence what facts are relevant and how facts might be assessed in terms of possible violations of the penal code. Convenience aspects of private investigations are discussed in this article in terms of five internal investigations, two in the United States (General Motors and Lehman Brothers) and three in Norway (Telenor VimpelCom, DNB Bank, and Norwegian Football Association). The aim of this research is to contribute insights into convenience associated with internal private investigations.

Forensic examination of human remains is a complex process that relies on the contribution of multidisciplinary forensic medicine specialties. Here we present a complex forensic case regarding a double murder whose victims were found almost completely skeletonized. Post-mortem investigations allowed us to define the biological profile of the two bodies (ancestry, sex, age and stature), to discover their identity through forensic DNA analysis, and to detect peri-mortem injuries caused by firearms and stabbing weapons. Three men were recognized as involved in the crime and two of them were condemned to life imprisonment for homicide. The judges accepted the reconstruction of the crime promoted by the Prosecutor (double firearm murder).

Abstract Over the past half century, conservatism has been a powerful force in shaping public and political responses to crime in Britain. But within criminology, conservative ideology remains curiously neglected and poorly understood. In this paper, I develop an interpretive reconstruction of conservative thinking about crime that seeks to make good this inattention. My central contention is that one finds in conservative ideology both an emotionally and culturally resonant case for making police authority and penal control central to the production of order and arguments for sceptical penal restraint and non-penal modes of socialization. But from which aspects of its conceptual morphology do these two faces of conservatism arise? In answering this question, my encounter identifies the claims that conservatism brings to contests over a better politics of crime (claims with which non-conservatives are required to reckon), as well as pinpointing certain shortcomings and blind spots of conservative ideology.
