Mindfulness and mindlessness are two relevant psychological constructs for the field of amyotrophic lateral sclerosis (ALS). When mindful, people are more open, flexible, and aware, and this attitude results in a higher psychological well-being. A mindful attitude is a source of psychological resilience for people with ALS and their caregivers. Conversely, a mindless view about the illness, reducing the whole person’s identify to the diagnosis, represents a threat to their quality of life. Furthermore, preliminary findings seem to suggest that mindfulness is associated with a slower course of the disease. In this chapter we discuss the impact that mindfulness can exert on both the quality and the quantity of life.

We notice in the laws of debt and insolvency an attempt to systematize and render definite what had been flexible. Earlier, debt obligations were tacitly looked upon as a matter of honour, involved the credibility of a person’s dealings, and were enforced by the influence of those whose personal authority was acknowledged both by the debtor and the creditor. By contrast, the use of the instruments of the state, the law courts, and prisons moved debt obligations out from the private to the public domain.

This chapter looks at how readers of eighteenth-century British fiction seem to have possessed less carefully policed divisions between fact and fiction. It speculates that their credulity was more flexible than that of current critics and readers. Into the 1750s and beyond, many narratives that were obviously fictional featured titles or subtitles that gestured toward the kind of factuality to be found in such ‘news’: fiction that was somehow truthful or claimed a kind of non-literal truth. The chapter notes that, from antiquity onwards historians were ignorant of many things. And of course the classical tradition of historical writing allowed or indeed encouraged invented speeches and concocted descriptions.

Because of the scope and duration of Colombia’s internal armed conflict, that conflict has produced much suffering in the civilian population. This chapter focuses on the Court’s jurisprudence protecting the rights of victims, especially of the internal armed conflict. In this area, the incorporation of international law has been particularly important. Drawing on this jurisprudence, the Court has insisted that victims be given rights to truth, justice, and reparations. The contours of this right have proven particularly important in processes in which the government has sought to give amnesties or sentence reductions in return for participation in the peace process by illegal armed groups, first with paramilitaries and now with guerrilla groups. In reviewing these frameworks, the Court has sought to create criteria that are flexible while retaining the core restrictions of international human rights law and international humanitarian law.

The chapter addresses, first, the ontological issue of whether the interpretation of a constitution is fundamentally different than the construction of statutes. Based on a comparison of the Supreme Court of Canada decisions in constitutional interpretation, especially Charter cases, and the contemporary approach to statutory interpretation, endorsing Driedger’s modern principle, it is argued that a convergence of methodology has occurred. Second, recent developments in the domestic use of international law—that is interlegality—also show commonality in constitutional and statutory interpretation. The hypothesis is that recent case law on the operationalization of international normativity, far from supporting the end of the international/national divide, actually reaffirms the Westphalian paradigm. The contextual argument and the presumption of conformity, as interpretative tools, allow courts to be more flexible, indeed more permissive, in resorting to international law.

This book addresses the question of social constitutionalism, especially with regard to its role in the contemporary European project. For reasons of history and democracy, Europeans share a deep commitment to social constitutionalism. But at the same time, Europeans are concerned about an overconstitutionalization and the balancing-away of less-favoured rights, leading to the entrenchment of the status quo and stifling of the living constitutionalism and democracy. The book challenges the common view that constitutionalization means de-politicization. Without claiming for themselves the final word, courts can exert a more indirect—forum-creative and agenda-setting—role in the process of an ongoing clarification of the meaning of a right. In exerting this role, courts rely less on a pre-existing consensus, but a potential consensus is sufficient: courts can induce debate and deliberation that leads to consensus in a non-hierarchical dialogue in which the conflicting parties, state actors, civil society organizations, and the diverse stakeholders themselves develop flexible substantive standards that interpret constitutional requirements, often over repeat litigation. The CJEU and the ECtHR—as courts beyond the nation state—in their constitutionalizing jurisprudence are able to constructively re-open and re-politicize controversies that are blocked at the national level, or which cannot be resolved at the domestic level. But, crucially, the understanding of constitutional framework-principles is itself subject to revision and reconsideration as the experience of dealing with the diverse national contexts of discovery and application accumulates. This democratic-experimentalist process lies at the heart of the distinctive model of contemporary Euroconstitutionalism.

Implied licences can serve as a flexible and targeted mechanism to balance competing interests, including those of copyright owners and content users, especially in today’s dynamic technological environment. However, implication as a process is contentious and there are no established principles for implying copyright licences. The resulting uncertainty has led to incoherence, diminishing the value of implied licences in judicial reasoning. This book develops a methodical and transparent way of implying copyright licences, based on three sources: the consent of the copyright owner; an established custom; and state intervention to achieve policy goals. The frameworks proposed are customised separately for implying bare and contractual licences, where relevant. The book goes on to analyse the existing case law methodically in the light of these frameworks to demonstrate how the court’s reasoning can be made transparent. Underscoring the contemporary relevance of implied licences, the book tests and validates the methodology in relation to three essential and ubiquitous functions on the internet—browsing, hyperlinking, and indexing.

This chapter discusses the practice of incorporating charterparty arbitration clauses into bills of lading and examines recent decisions of the English courts which have tended to take a flexible and liberal approach in determining the effectiveness of such incorporation. It notes that a restrictive approach to the recognition of the validity of such arbitration clauses results in a highly uncertain position for a carrier who may find itself having to arbitrate in different locations to respond to different claims arising out of the same incident. It also criticizes the European Court of Justice’s decision in Allianz SpA (formerly RiunioneAdriatica di SicurtaSpA) v West Tankers Inc (The Front Comor). The case has created the potential of much confusion on the enforceability of a charterparty arbitration clause incorporated into a bill of lading, and creates unnecessary unpredictability and the heightened potential of litigation costs to determine preliminary issues.

Memory in early modern Europe closely related to the knowledge of what was ‘customary’. The term ‘custom’ was used to describe both cultural, often local, habits, and usages that had acquired legal power, and its status derived from its being ancient and its being common knowledge. Custom was both an elite tool to keep the poor in place, and the best strategy for poor people to defend themselves against unwanted changes. In the course of the early modern period the status of custom changed. First, codification of custom rendered it less flexible than it had once been. Secondly, the emergence of new intellectual tools led to more scepticism about the past as a stable source of authority. Finally, as a consequence of contact with non-Europeans, there emerged new ideas on the development of human culture, in which the abandoning of custom came to be seen as a hallmark of civility.

It is a product of both one and two semester courses that have been taught over a period of more than two decades. The target audiences are students at all levels of graduate studies, highly motivated senior undergraduates, and practicing engineers and scientists. The book is divided into two sections. Part I, Foundations, lays down the fundamental principles of the field of organic electronics. It is assumed that the reader has an elementary knowledge of quantum mechanics, and electricity and magnetism. Background knowledge of organic chemistry is not required. Part II, Applications, focuses on organic electronic devices. It begins with a discussion of organic thin film deposition and patterning, followed by chapters on organic light emitters, detectors, and thin film transistors. This book addresses the judicial review on social public policies, intending to propose a new approach to its exercise in Brazil, based on the standards and instruments consolidated in the structural remedies practice. The review approach championed by Brazilian courts creates illegitimate, anti-isonomic and ineffective decisions, which derives from the reliance on a traditional form of adjudication, bipolar and adversarial, that is inadequate to the polycentric and distributive features of the conflicts involving the delivery of public services by the government. Inspired on pioneering experiences in both foreign and domestic jurisdictions, the work outlines a theory of structural remedies applied to public policy issues that seeks to address the shortcomings of the mainstream approach, resulting in a paradigmatic shift in three main aspects of adjudication, regarding legal reasoning (distributive and dialogical), remedial practice (experimentalist, prospective and consensual) and the characteristics of the adjudication process (flexible and cooperative). Besides sustaining the merits of the described methodological shift, the author’s efforts are also aimed at formulating interpretative constructions to allow for its implementation in the Brazilian legal system. By exploring practical solutions towards a more legitimate and effective judicial review, and arranging them in a coherent theoretical framework, the book contributes to the academic debate and also gives valuable input to the public law practitioners entrusted with the duty to oversee the public administration activities in Brazil.

Abstract:
This book provides the first detailed account of the role of revolutionary justice in the early Soviet state. Law has often been dismissed by historians as either unimportant after the October Revolution amid the violence and chaos of civil war or even, in the absence of written codes and independent judges, little more than another means of violence. This is particularly true of the most revolutionary aspect of the new justice system, revolutionary tribunals—courts inspired by the French Revolution and established to target counter-revolutionary enemies. This book paints a more complex picture. The Bolsheviks invested a great deal of effort and scarce resources into building an extensive system of tribunals that spread across the country, including into the military and the transport network. At their peak, hundreds of tribunals heard hundreds of thousands of cases every year. Not all ended in harsh sentences: some were dismissed through lack of evidence; others given a wide range of sentences; others still suspended sentences; and instances of early release and amnesty were common. This book, therefore, argues that law played a distinct and multifaceted role for the Bolsheviks. Tribunals stood at the intersection between law and violence, offering various advantages to the Bolsheviks, not least strengthening state control, providing a more effective means of educating the population on counter-revolution, and enabling a more flexible approach to the state’s enemies. All of this adds to our understanding of the early Soviet state and, ultimately, of how the Bolsheviks held on to power.

In a culture dominated by discourses of “colorblindness” but still rife with structural racism, digital and social media have become a resource for Black Americans navigating a society that simultaneously perpetuates and obscures racial inequality. Though the Ferguson protests made such Black digital networks more broadly visible, these networks did not coalesce in that moment. They were built over the course of years through much less spectacular, though no less important, everyday use, including mundane social exchanges, humor, and fandom. This book explores these everyday practices and their relationship to larger social issues through an in-depth analysis of a network of Black American digital media users and content creators. These digital networks are used not only to cope with and challenge day-to-day experiences of racism, but also as an incubator for the discourses that have since exploded onto the national stage. This book tells the story of an influential subsection of these Black digital networks, including many Black amateur podcasts, the independent media company This Week in Blackness (TWiB!), and the network of Twitter users that has come to be known as “Black Twitter.” Grounded in her active participation in this network and close ethnographic collaboration with TWiB!, Sarah Florini argues that the multimedia, transplatform nature of this network makes it a flexible resource that can then be deployed for a variety of purposes—culturally inflected fan practices, community building, cultural critique, and citizen journalism. Florini argues that these digital media practices are an extension of historic traditions of Black cultural production and resistance.

This volume examines the current resolution process for distressed micro, small, and medium enterprises (MSMEs), and proposes a different, more appropriate, ‘modular’ approach to the treatment of such entities when faced with insolvency proceedings. MSMEs play a vital role in virtually all global economies. They are a primary means of employment and the vehicle by which entrepreneurs bring new business propositions to the market and deliver a range of products and services to local economies. MSMEs tend to be more reliant than larger businesses on favourable legal and regulatory climates in order to survive and thrive. Yet in assuming an extensive insolvency estate of significant worth, the presence of creditors and other concerned stakeholders to participate in and oversee the process, and the extensive involvement of courts and insolvency and legal professionals, insolvency regimes are often more tailored to the circumstances of larger businesses. These assumptions and features generally sit incongruously with the reality of MSMEs, whose estates characteristically have modest value and many of whose stakeholders tend to be disinterested in the MSME’s insolvency process. The Modular Approach developed in this text addresses the imbalances, inconsistencies, and lack of supervision which are often apparent in the treatment of insolvent MSMEs. The volume provides an overview of existing approaches to MSME insolvency, the place of MSMEs in the global economy, and the particular needs of MSMEs in financial distress. It then sets out the procedural framework, policy objectives, and key components of the Modular Approach, detailing how a choice of modules enables national policymakers a more flexible process for resolution. The volume outlines the roles, positions, and obligations of key stakeholder groups, and explains the managerial, administrative, and judicial functions of this approach. Finally, it explains how elements of the broader legal system should be aligned with, and supportive of, the optimal functioning of the Modular Approach.

Despite all the medical and media attention focused on the rate of overweight and obesity in the African American population, African American images and body types are greatly influencing changes in the fashion, fitness, advertising, television and movie industries. This is because overweight, like beauty, can be in the eye of the beholder. Most research studies investigating attitudes about body image and body type among African Americans have shown they are more satisfied with their bodies than are their white counterparts and that there appears to be a wider range of acceptable body shapes and weights, and a more flexible standard of attractiveness, among black Americans as compared to whites. That fact is not being lost on leaders of industries that might profit from understanding this wider range of beauty, as well as playing to it. In this book, medical anthropologist Eric Bailey introduces and explains the self–acceptance and body image satisfaction of African Americans, and traces how that has spurred changes in industry. His book fills the void of scientific evidence to enhance the understanding of African Americans’ perceptions related to body image and beauty—and is the first to document these issues from the perspective of an African American male. Thus, there appears to be a wider range of acceptable body shapes and weights, and a more flexible standard of attractiveness, among black Americans as compared to whites. That fact is not lost on leaders of industries that might profit from understanding this wider range of beauty, as well as playing to it. Voluptuous supermodel Tyra Banks is just one African American who’s broken the mold in that industry. The effects have been seen right down to department and local clothes stores, where lines of larger and plus–size fashions are expanding, becoming more colorful and more ornate. In the fitness industry, health gurus Madonna Grimes and Billy Blanks have been revolutionizing how people get fit and how fitness needs to be redeveloped for the African American population. Advertising has taken a similar turn, not the least manifestation of which were the major campaigns Dove and Nike ran in 2005 with plus–sized actresses (who continue to appear in promotions for both companies). In movies and on television shows, the African American beautiful body image has followed suit. In this book, medical anthropologist Eric Bailey introduces and explains the self–acceptance and body image satisfaction of African Americans, and traces how that has spurred changes in industry. The objectives and principles of neurological history and examination in children are the same as those in adults. This chapter therefore, will not provide an all-encompassing description of the neurological assessment of children, but highlights where the approach must differ substantially from that used in adults. Further it aims to provide a practical and useful approach to the examination of children, who may be preverbal and certainly will show less stamina for cooperation than adults. Of course as children get older, the examination can become more conventional and systematized. By adolescence the examination can be the same as the adult examination.The first and overriding factor for success is to be flexible and to make observations when the opportunity arises rather than to wait for abnormalities to arise during the course of a more systematic approach. Nonetheless a systematic approach to recording these results is essential, so as to bring together related observations made disparately in time. The history is of paramount importance in guiding the examination. Since it is unlikely that you will be able to complete a full examination, it is important to prioritize the observations needed in light of a differential diagnosis before you begin examining. Rather than rushing straight into the examination it is rewarding to gain a young child’s confidence by playing briefly with them. Also, instead of insisting on examining the child on a couch, it helps to become adept at examining young children on their parent’s or caretaker’s knee. Finally, no matter how cooperative a child is, potentially disturbing investigations should be left until last, including tendon reflexes or examination of the tongue, fundi, and ears. Otherwise all subsequent cooperation from the child may be lost after these examinations.The examination room environment is the key to a successful neurological examination and requires careful thought. There should be sufficient space to accommodate families and for the children to play. The room needs to be friendly and conducive to encouraging play. It needs to be equipped with carefully selected toys, pictures, pencils and paper, and books of interest to children over a wide age range. Observation of the child’s play whilst you are taking a history from the parents or caregivers will allow assessment of the child’s motor skills and developmental stage. Their use of play material can yield important clues to the nature of a deficit, by revealing ataxia, weakness, involuntary movements, tics, or spasticity. Play also provides an opportunity to assess the child’s behaviour, for instance their impulsivity, distractibility, and attention span. Interaction of the child with parents or caregivers can be observed also. If the child participates actively in the history taking, their understanding and contribution to the session allows you to make assessments of their language and intellectual skills.
