It first examines the timing, format, and content of cost submissions and statements of costs before discussing the relevant arbitral rules that govern such submissions in International Centre for Settlement of Investment Disputes (ICSID) Convention and ICSID Additional-Facility arbitration proceedings, along with the average amount of such costs. It then explains the UNCITRAL Arbitration Rules on costs submissions, taking into account the average amount of those costs, and the duration of arbitration proceedings. It also analyses how arbitral tribunals have allocated costs in ICSID and UNCITRAL proceedings and highlights the factors deemed relevant by tribunals in those decisions.

Growth involves two flows of energy. The first is chemical potential energy in the monomers used to construct the proteins, lipids, polysaccharides and nucleic acids forming the new tissue. The second is the metabolic energy (ATP or GTP) used to construct the new tissue; this is the metabolic cost of growth and can be expressed as a dimensionless fraction of the energy retained in the new tissue. Its value is ~0.33. Typical temperature sensitivities for growth in the wild lie in the range Q10 1.5 – 3. Within species there may be evolutionary adjustments to growth rate to offset the effects of temperature, though these involve trade-offs with other physiological factors affecting fitness. Outside the tropics, many mammals and birds exhibit a cline in size, with larger species at higher latitudes (Bergmann’s rule). Carl Bergmann predicted such a cline from biophysical arguments based on endotherm thermoregulatory costs; Bergmann’s rule thus applies only to mammals and birds. Many ectotherms grow more slowly but attain a larger adult size when grown at lower temperatures (the temperature-size rule). The large size of some aquatic invertebrates at lower temperatures (notably in the polar regions and the deep sea) is associated with a higher oxygen content of the water.

Chapter 5 of the Arbitration Act covers arbitral awards and closely follows most of the corresponding provisions of Chapter VI of the Model Law. Evidence demonstrating the efficacy of treatment and prevention programs for eating disorders is accruing. However, the common face-to-face delivery of these interventions has a number of limitations, including high cost and limited accessibility. E-mental health, referring to the use of information and communication technology—particularly the Internet—in interventions for mental health disorders, has the potential to overcome these barriers and enhance the treatment and prevention of eating disorders. To date, the limited number of evaluations have documented small to moderate effect sizes in the improvement of eating disorder symptomatology through Internet-based treatment and prevention. Beyond efficacy, major questions remain regarding content, structure, and modes of delivery of Internet-based interventions; suitable diagnostic tools and safety measures; and cost-effectiveness, dissemination, and implications for public health programming. These aspects deserve attention in future research before widely recommending Internet-based interventions for eating disorders.

This chapter analyzes the materialities of Internet protocols, focusing on the relationship between content and conduit, which involves both the compression and modulation of signals. Network protocols are shaped by material constraints. Similarly, the centrality of routing to the Internet can be understood materially in terms of the arrangement of network nodes, the cost of routing, the structure of networks, the size of routing tables, and the dynamics of connectivity. Critically, this materiality cuts across apparently different domains of concern—from the practice of network operations to the rhetoric of democratic access. The chapter then contrasts two different protocols, the Routing Information Protocol and the Exterior Gateway Protocol, which emerged in different historical moments and cultural conditions. Abstract:
Contrary to judgments, arbitral awards are final in the sense that they are not subject to appeals. This chapter examines the very limited remedy of annulment or setting aside of the award in accordance with Article 190(2) PILA, emphasizing that the annulment grounds in that provision are essentially concerned with the manner in which justice was rendered, as opposed to the content of the decision. The chapter also covers all aspects of the annulment procedure before the Swiss Supreme Court, from the admissibility of the action to cost allocation. In that context, it addresses the possibility for parties not seated in Switzerland to waive their right to seek the annulment of the award (Article 192(1) PILA). The chapter further discusses the revision of the award, and, in its final section, the recognition and enforcement of foreign arbitral awards by the Swiss courts in accordance with the New York Convention.
