Abstract:
La coincidenza delle ricorrenze – l’Università Ca’ Foscari compie 150 anni dalla fondazione e sono passati 100 anni dalla fine della Grande guerra – invita a ricordare la coraggiosa, allora ancora giovane, Scuola Superiore di Commercio, che, alla fine del primo conflitto, è costretta a contare i suoi allievi caduti. Dopo due decenni, nel 1943, il Regio Istituto di Economia e Commercio stabilisce di dedicare la corte minore del palazzo Giustinian dei Vescovi alla memoria di tutti gli studenti, i docenti e i dipendenti caduti nei conflitti che fino ad allora avevano insanguinato il secolo. Monumenti, memorie e lapidi sono, in senso figurato, ricomposti nella statua di Niobe, Mater Studiorum che piange la morte violenta dei propri allievi. La corte della Niobe è abitata dalla potente scultura di Napoleone Martinuzzi, suo fulcro visivo ed emotivo, e da tanti, tanti nomi. Il tentativo è stato quindi di cominciare a restituire non solo la storia di quello spazio ma anche delle esistenze e del pensiero di coloro i cui nomi hanno qui trovato dimora. Questi aspetti della memoria sono stati al centro del lavoro di molti e sottotraccia nel lavoro di tutti: di chi si è occupato di delineare un profilo esistenziale dei caduti, di chi ha studiato le ideologie e le politiche che hanno animato i periodi tribolati delle guerre e dei dopoguerra o ha analizzato i processi istituzionali e la mentalità in tempo di guerra, di chi ha indagato sull’assetto e le trasformazioni architettoniche della corte. Ma il problema del tempo passato, delle tracce che lascia e di come conservarle si è posto anche a chi ha compiuto ricerche sui documenti e a chi ha studiato le pietre del sacrario e ne ha avuto cura.

L’uccisione per mano della mafia nel 1893 di Emanuele Notarbartolo, ex direttore del Banco di Palermo, rappresenta un avvenimento controverso e oscuro della storia italiana. Tre i processi (Milano, Bologna, Firenze) che vedono coinvolto anche un deputato siciliano: Raffaele Palizzolo. Il lavoro di documentazione di Anna Franchi si svolge in corte d’Assise di Firenze: sempre presente alle udienze, osservatrice implacabile sia del fenomeno ‘mafia’ sia di quel vero e proprio teatro di testimonianze, confessioni, ritrattazioni, false piste che caratterizzarono il processo fiorentino (1903-1904). Si è potuto integrare ampiamente il resoconto della Franchi con il ritrovamento all’Archivio di Stato di Firenze di tutto il faldone relativo al processo, circa 1500 pagine manoscritte, opera dei vari cancellieri che si sono susseguiti. Il processo si concluse in una assoluzione generale per mandanti ed esecutori per mancanza di prove. L’onore della Sicilia era salvo per alcuni, la verità insabbiata per sempre per molti altri.

Cosa hanno in comune gli studi raccolti in questo volume, su autori così disparati come Conte, Palazzeschi, Zanzotto, Caproni, Rosselli, Biagini, alcuni poeti crepuscolari, Leopardi, Annovi, Giuliani, e perfino certe traduzioni novecentesche di R.M. Rilke? La convinzione che la parola poetica – etimologicamente ‘creatrice’ – generi prospettive cognitive che alterano la nostra percezione del mondo. La lettura della poesia non ha un effetto confinato alla pagina e al momento, ma incide sul nostro rapporto con la realtà, lo cambia e lo arricchisce in maniera spesso insospettabile e sorprendente. In questa raccolta, si cerca dunque di far emergere una sorta di epistemologia della poesia, di chiarire insomma come essa contribuisca ad illuminare la nostra esperienza del mondo e di noi stessi. Il lettore è allora invitato a guardare al di fuori dei confini tradizionalmente stabiliti dalle diverse discipline, in una direzione che è quella della contaminazione reciproca e dell’apertura a suggestioni innovative ed inedite.

Il volume affronta le complesse relazioni fra giustizia costituzionale e sfera politica nel contesto statunitense e in quello italiano. Il tema è approfondito muovendo da un approccio critico e problematico al judicial review of legislation e ai rapporti tra sfera politica e giustizia costituzionale per poi affrontare il delicato profilo della compatibilità di quest’ultima con la democrazia. La riflessione sulla legittimazione degli organi di giustizia costituzionale consente di evidenziare le interconnessioni fra teoria della Costituzione, teoria della giustizia costituzionale e teoria dell’interpretazione costituzionale, offrendo un’occasione di confronto fra la dottrina statunitense e quella italiana. L’opera, inoltre, esamina le diverse modalità con cui la Corte Suprema statunitense e la Corte costituzionale italiana si relazionano a casi con tassi di politicità più o meno palese. Attraverso il prisma dell’indagine teorica e il commento della prassi giurisprudenziale vengono, così, evidenziate le caratteristiche e i profili critici della political question doctrine ed individuati alcuni significativi profili di similitudine fra Stati Uniti e Italia. Il ventaglio degli strumenti a cui la Corte costituzionale ricorre nel rapportarsi alle questioni politiche, in particolare laddove emergono esigenze di rispetto della sfera riservata alla discrezionalità del legislatore, mostra le ambiguità, le criticità e le difficoltà connesse all’individuazione di ipotesi carsiche di una political question doctrine nell’ordinamento italiano. L’analisi casistica consente di apprezzare quel processo osmotico secondo il quale dietro ogni caso pratico si celano problematiche della teoria della giustizia costituzionale che, a loro volta, aprono alle questioni sempre attuali e controverse della teoria costituzionale.

Exposure therapy is a core component of evidence-based treatments for eating disorders (EDs), including cognitive-behavioral therapy and family-based treatment. Despite this, existing treatment guides give relatively limited attention to the clinical issues associated with good implementation of exposure. This book is designed to augment a wide variety of treatment manuals by providing ED clinicians with practical advice for maximizing the effectiveness of exposure, regardless of which evidence-based treatment they use or the profession to which they belong. Written in an easy-to-understand format, this book not only translates the most up-to-date empirical research on exposure for EDs, it also extrapolates clinical advice from the anxiety disorders literature to help busy clinicians become more effective in treating EDs. Readers will walk away with a solid foundation in the theoretical underpinnings of exposure therapy, as well as an understanding of how to utilize this information to sell the rationale for exposure to their ED patients. Three interpretations of the multigovernance polity in the EU—defined as the soft turn, the market turn, and the societal turn—are discussed in relation to Swedish politics. It is argued that there is a fit between the soft turn and the Swedish intergovernmental position, but that the strong presence of law in the EU is also problematic for Swedish governments. The early privatizations and deregulations of parts of the public infrastructure have made Sweden one of the forerunners in the market turn, but they have also created tensions between core Swedish national issues and the EU. The societal turn in the EU follows Swedish traditions of corporativism but also challenges this tradition.

Differentiated integration is a durable feature of the European Union and a major alternative for its future development and reform. This book provides a comprehensive conceptual, theoretical and empirical analysis of differentiation in European integration. It explains differentiation in EU treaties and legislation in general and offers specific accounts of differentiation in the recent enlargements of the EU, the Euro crisis, the Brexit negotiations and the integration of non-member states. Differentiated integration is a legal instrument that European governments use regularly to overcome integration deadlock in EU treaty negotiations and legislation. Instrumental differentiation adjusts integration to the heterogeneity of economic preferences and capacities, particularly in the context of enlargement. By contrast, constitutional differentiation accommodates concerns about national self-determination. Whereas instrumental differentiation mainly affects poorer (new) member states, constitutional differentiation offers wealthier and nationally oriented member states opt-outs from the integration of core state powers. The book shows that differentiated integration has facilitated the integration of new policies, new members and even non-members. It has been mainly ‘multi-speed’ and inclusive. Most differentiations end after a few years and do not discriminate against member states permanently. Yet differentiation is less suitable for reforming established policies, managing disintegration, and fostering solidarity, and the path-dependency of core state power integration may lead to permanent divides in the Union.

This chapter demonstrates that the majority of the enforcement literature falls short of tackling the core compliance problems in the EU today. While the overwhelming focus is on the acquis, the values of the Union are virtually never taken into account. Even the most innovative accounts of enforcement—presenting justice in the EU as a service, for instance—do not pay sufficient attention to the need to ensure that the basic values of Article 2 TEU are adhered to. Viewed against the lacunae in the literature on enforcement, all the values’ enforcement proposals set out in this chapter demonstrate a fundamentally important break with the dangerously short-sighted tradition approaching the issues of enforcement in the context of EU law solely with the Union acquis in mind. The chapter thus recommends that a different approach would be absolutely indispensable at this stage.

This chapter argues against the common consensus regarding the EU 14’s measures against Austria in 2000 by not only retracing the core part of the story but also extending the perspectives on the year 2000 to the past and the future. First, the chapter analyses the historical dimension of Haider’s Freedom Party and the political relevance of the developments in the year 2000 from an Austrian perspective. The chapter contends that the EU did not learn effectively from the measures and failed to develop proper institutional and procedural mechanisms to deal with the questioning of basic values by a Member State. Hereafter, the chapter looks critically back on the participation of the Freedom Party in the Austrian government and the effects of Jörg Haider to Rule of Law and democracy in Austria. Emphasis is placed in acknowledging the different layers of the narrative on the EU 14’s measures.

This EU competition law treatise fully integrates economic reasoning in its treatment of the decisional practice of the European Commission and the case-law of the European Court of Justice. Since the European Commission's move to a “more economic approach” to competition law reasoning and decisional practice, the use of economic argument in competition law cases has become a stricter requirement. Many national competition authorities are also increasingly moving away from a legalistic analysis of a firm's conduct to an effect-based analysis of such conduct, indeed most competition cases today involve teams composed of lawyers and industrial organisation economists. Ensuring an integrated approach to legal and economic analysis, the book contains economic reasoning throughout in accessible form, and, more pertinently for practitioners, examines economics in the light of how it is used and put to effect in the courts and decision-making institutions of the EU. The proper functioning of the EU financial market is protected by public actors, both national and supranational, who are responsible for rulemaking and for supervision of investment firms and other private actors. At the same time, the effectiveness of the EU legal system requires vigilance from private actors such as investment firms and their clients, who may invoke their rights before national authorities and courts. This means that investment firms have a dual role within the system, as subjects of control and enforcement, as well as agents in the maintenance of the rule of law. This book brings together a group of scholars with expertise in different legal disciplines, but a shared interest in the EU internal market and its development. It is intended to integrate a modern study of the form and function of EU rulemaking in the internal market after the financial crisis with an evaluation of core aspects of rulemaking in the financial market and, in this way, to provide a cross-cutting treatment of EU law. This chapter examines the human rights system and the way it deals with human creations and innovations that are the traditional core subject matter of intellectual property (IP) rights. It begins by reviewing the scope for protection under Article 27 (2) Universal Declaration of Human Rights (UDHR) and Article 15 (1) (c) of the International Covenant on Economic, Social and Cultural Rights (ICESCR). The chapter moves on to the protection of property in human rights law, especially on the regional, European level. It examines how IP can be protected as property under the European Convention of Human Rights (ECHR) and under the EU Charter of Fundamental Rights (EU Charter). Finally, the chapter looks at some of the overlaps with international IP rules and the conflict norms in the human rights system to address such overlaps.

Abstract:
This volume is the first comprehensive analysis of women’s ascendance to leadership positions in the European Union (EU) as well as their performance in such positions. It provides a new theoretical and analytical framework capturing both positional and behavioral leadership and the specific hurdles that women encounter on their path to and when exercising leadership. The volume encompasses a detailed set of single and comparative case studies, analyzing women’s representation and performance in the core EU institutions and their individual pathways to and exercise of power in top-level functions, as well as comparative analyses regarding the position and behavior of women in relation to men. On the basis of these individual studies, the volume draws overarching conclusions about women’s leadership in the EU. Regarding positional leadership, women continue to be underrepresented in leadership positions, they more often hold less prestigious portfolios in such positions, and manifold structural hurdles hamper their access to power. Furthermore, huge variations exist across EU institutions, with the intergovernmental bodies being the hardest to access. Regarding behavioral leadership, women acting in powerful EU positions generally perform excellently. They successfully exercise a combined leadership style that integrates attributes of leadership considered to be “masculine” and “feminine.” This is not to argue that women per se are the better leaders. Yet more often than men they are exposed to stronger selection processes and their prevalent practice of a combined leadership style tends to best meet the requirements of modern democratic systems and particularly those of the highly fragmented EU.

L’analisi si concentra, infatti, sui modelli di organizzazione e di gestione di cui agli artt. 6 e 7 del d.lgs. 231/2001, sui permessi di inquinamento e sulla normativa di attuazione italiana in materia di organismi geneticamente modificati. This chapter conducts an alternative investigation of our core theoretical argument that the EU institutions act as control-maximizers when designing or installing control structures. The case-based analysis in Chapter 5 and the large-N statistical analysis in this chapter have different merits. The case-based analysis allows us to include context and details and gives the reader an understanding of the substance. It also makes it possible to examine the actors’ strategies, that is, to show how they pursue their preferences. However, since the analysis is based on a limited number of non-randomly selected cases, the generalizability of the findings is questionable. In this chapter we analyse a large number of delegation situations in the post-Lisbon period with the aim of uncovering systematic preference patterns.

The EU Capital Requirement Regulation (CRR) [8] and of EBA Regulatory Technical Standard for prudent valuation [15], published on Jan. 1st, 2014 and Jan. 28th, 2016, respectively, constitute the EU Prudent Valuation Framework. The CRR, art. 34, requires to Institutions a prudent valuation of positions measured at fair value and the deduction of the resulting Additional Valuation Adjustments (AVAs) from the Common Equity Tier One (CET1) capital. The art. 105 disciplines the AVAs intended to achieve an appropriate level of certainty in prudent value. The EBA RTS [15] allow two approaches to prudent valuation. The simplified approach, applicable by small financial institutions (with total absolute fair-valued assets and liabilities below EUR 15 billions), prescribes a very simple total AVA equal to 0.1% of the total fair value. The core approach, compulsory for institutions above the EUR 15 billion threshold, prescribes the calculation of 9 AVAs, referring to different sources of valuation uncertainty, as the excess of valuation adjustments required to achieve the prudent value with 90% level of confidence. Five out of nine AVAs include a 50% weight to take diversification into account and avoid double counting effects. Those positions for which a change in their fair value affects only partially the CET1 may be partially excluded from the AVAs calculation.

This chapter argues that EU socioeconomic coordination can support social investment. Both the Lisbon Treaty’s main norms and goals and the European Semester’s short-term goals are in line with social investment. This chapter closely scrutinizes the country-specific recommendations (CSRs) stemming from the Stability and Growth Pact (SGP). Whereas this coordination cycle has been criticized for having a one-sided focus on limiting public expenditure, even the SGP at times results in recommendations that encourage social investment. Such recommendations only address a limited number of policies and are communicated to a small number of countries. However, the scope for and the content of social investment recommendations changes from year to year, reflecting that coordination is open to changes. This adjustment capacity provides new opportunities for social investment to further integrate into the European Semester process of socioeconomic coordination, thus building on core social principles of the Lisbon Treaty.

This chapter examines the pervasiveness and importance of enlargement in the history of European integration. It first considers the principles, conditions, and instruments of enlargement before discussing the roles of various institutional actors and the candidate states. It then shows how, faced with the likelihood of large-scale Central and Eastern European accession, the European Union extended the requirements for membership to include the candidate countries' democratic credentials and economic competitiveness. The first enlargement included Britain, Denmark, and Ireland, followed by Greece, Spain, and Portugal, the European Free Trade Association, the Central and Eastern European countries, Cyprus, and Malta. The chapter also explains how the EU has developed a variety of strategies to deal with growing differences among the member states' socio-economic situations and policy needs without formally resorting to a division of its membership in concentric circles, core and peripheral groups, or alternative frameworks.

Il tema del suicidio richiede un confronto con questioni esistenziali fondamentali e il principale rischio di chi affronta un argomento così vertiginoso è quello di non riconoscerne la complessità. La perenne tentazione del giurista è di “chiudere le porte” a una riflessione problematica e sofferta ricorrendo ad equiparazioni che producono effetti semplificatori e occultano la molteplicità delle questioni in gioco. Questo scritto, all’opposto, si pone l’obiettivo di svelare l’inadeguatezza di alcune assimilazioni: la “liceità del suicidio” – principio fondamentale del biodiritto penale – non comporta automaticamente la “liceità dell’aiuto al suicidio”. E il concetto stesso di “aiuto al suicidio” dev’essere analizzato nelle sue numerose sfaccettature: l’agevolazione al suicidio “tradizionale” – provocato da forte sofferenza psicologica ed esistenziale – non può essere equiparata al fenomeno differente e dilemmatico dell’aiuto medico a morire. Il compito di delineare tali distinzioni con nettezza è necessario e urgente, anche alla luce delle recenti e celebri sentenze della Corte costituzionale italiana e di quella tedesca, che per motivi diversi rischiano di generare equivoci e fraintendimenti. L’aiuto al suicidio e il suicidio medicalmente assistito non sono gemelli congiunti e neppure fratelli: sono soltanto parenti che si ribellano a una convivenza forzata. Nell’ambito di queste coordinate il presente volume fornisce un contributo di fondamentale importanza anche nella prospettiva di un dibattito pubblico ponderato sulle questioni di fine vita.

Since the end of the cold war, Austria and Switzerland have maintained their status of neutrality, but reinterpreted their neutrality policy in pragmatic yet different ways. Both, however, joined NATO’s Partnership for Peace (PfP) initiative at an early stage. Within the EU and PfP, Austria focused on armed forces interoperability, whereas Switzerland increased its formerly very low contribution to international peace missions. Both alpine republics conducted three major reforms of their armed forces, which entailed a substantial downsizing of overall mobilization strength and weaponry, while maintaining territorial defence as the core mission. Austria and Switzerland both aim at slightly increasing defence expenditures up to the early 2020s as a consequence of widely increased threat perception (owing to mass migration, Islamist terrorism, and a reasserting Russia), yet they will still find it difficult to replace their rapidly ageing main weapons systems. Troop contributions to international operations are likely to remain at at the 2017 levels.

Universities and economic development in Africa: Pact, academic core and coordination draws together evidence and synthesises the findings from eight African case studies. The three key findings presented in this report are as follows: 1. There is a lack of clarity and agreement (pact) about a development model and the role of higher education in development, at both national and institutional levels. There is, however, an increasing awareness, particularly at government level, of the importance of universities in the global context of the knowledge economy. 2. Research production at the eight African universities is not strong enough to enable them to build on their traditional undergraduate teaching roles and make a sustained contribution to development via new knowledge production. A number of universities have manageable student-staff ratios and adequately qualifi ed staff, but inadequate funds for staff to engage in research. In addition, the incentive regimes do not support knowledge production. 3. In none of the countries in the sample is there a coordinated effort between government, external stakeholders and the university to systematically strengthen the contribution that the university can make to development. While at each of the universities there are exemplary development projects that connect strongly to external stakeholders and strengthen the academic core, the challenge is how to increase the number of these projects. The project on which this report is based forms part of a larger study on Higher Education and Economic Development in Africa, undertaken by the Higher Education Research and Advocacy Network in Africa (HERANA). HERANA is coordinated by the Centre for Higher Education Transformation in South Africa.

This monograph provides an in-depth look at the organisation of the national cybersecurity system and the tasks and responsibilities of the entities operating within this system. The objective of the national cybersecurity system is to ensure cybersecurity at the national level, including the uninterrupted provision of essential services and digital services by achieving the appropriate level of security of the information systems used to provide these services and ensuring the handling of incidents. The EU legislators have been explicit in noting that the scale, frequency, and impact of cybersecurity incidents is growing, putting the functioning of information systems at a serious risk. These systems can be targeted by malicious attacks aimed at damaging or disrupting their operations. Such incidents can hamper the functioning of public administration and business, and cause substantial financial losses, undermine user confidence, and lead to considerable losses in national economies, as well as the EU economy at large. Defined as the resilience of information systems against actions which compromise the confidentiality, integrity, availability, and authenticity of processed data, or the related services provided by those information systems, cybersecurity is an area of concern for private and public entities alike. As far as the public-law sphere is concerned, cybersecurity tasks and powers are performed and exercised by government administration, both central and regional, as well as local and regional governments. At the core of the national cybersecurity system in Poland are the public entities which make Poland's cybersecurity policy with the aim of increasing the level of protection against cyberthreats. Despite having different statuses, tasks, and powers, and places in the public sphere, they share the objective of ensuring cyberspace security.

This book critically investigates the role of data subject rights in countering information and power asymmetries online. It aims at dissecting ‘data subject empowerment’ in the information society through the lens of the right to erasure (‘right to be forgotten’) in Article 17 of the General Data Protection Regulation (GDPR). In doing so, it provides an extensive analysis of the interaction between the GDPR and the fundamental right to data protection in Article 8 of the Charter of Fundamental Rights of the EU (Charter), how data subject rights affect fair balancing of fundamental rights, and what the practical challenges are to effective data subject rights. The book starts with exploring the data-driven asymmetries that characterize individuals’ relationship with tech giants. These commercial entities increasingly anticipate and govern how people interact with each other and the world around them, affecting core values such as individual autonomy, dignity, and freedom. The book explores how data protection law, and data subject rights in particular, enable resisting, breaking down or at the very least critically engaging with these asymmetric relationships. It concludes that despite substantial legal and practical hurdles, the GDPR’s right to erasure does play a meaningful role in furthering the fundamental right to data protection (Art 8 Charter) in the face of power asymmetries online.

Historically, likelihood of confusion has been the core infringement test for trade mark law, and it remains the most frequently applied test in infringement actions by far. However, there are noticeable differences in how it is applied by the Court of Justice of the European Union (CJEU), the General Court, and national courts; and questionable outcomes when it is applied in novel situations. This book is the first comprehensive and systematic account of the confusion test within the harmonised European trade mark system. It considers how the test is applied by national trade mark registries across EU member states, by the European Union Intellectual Property Office (EUIPO), by national courts, and by the CJEU. It offers practical guidance, while also evaluating the viability of more recent developments such as initial-interest confusion, post-sale confusion and consumer responses to uses of trade marks on the internet. The book analyses three distinct strata of legal doctrine: the decisions of the CJEU, including the General Court; the extensive body of decisions by EUIPO; and the application of harmonised trade mark law by courts of member states, focusing on leading decisions as well as wayward ones. Abstract:
Ireland has enjoyed continuous democratic government for almost a century, an unusual experience among countries that gained their independence in the twentieth century. But the way this works has changed dramatically over time. Ireland’s colonial past has had an enduring influence over political life, enabling stable institutions of democratic accountability, while also shaping economic underdevelopment and persistent emigration. More recently, membership of the EU has brought about far-reaching transformation across almost all aspects of life. But the paradoxes have only intensified. Now one of the most open economies in the world, Ireland has experienced both rapid growth and a severe crash in the wake of the Great Recession. By some measures, Ireland is among the most affluent countries in the world, yet this is not the lived experience for many of its citizens. Ireland is an unequivocally modern state, yet public life continues to be marked by ideas and values in which tradition and modernity are uneasy bedfellows. It is a small state that has ambitions to carry more weight on the world stage. Ireland continues to be deeply connected to Britain through ties of culture and trade, now matters of deep concern post-Brexit. And the old fault lines between North and South, between Ireland and Britain, which had been at the core of one of Europe’s longest and bloodiest civil conflicts, risk being reopened. These key issues are teased out in this book, making it the most comprehensive volume on Irish politics to date.
