Abstract:
Chapter 4 focuses on soft law’s second-order consequences for rising regulatory powers. One of the key puzzles in the international regulation of finance is the persistence of cooperation even as the number of economic great powers increases. The emergence of the European Union as a financial rule-maker in the late 1990s and early 2000s, roughly on par with the United States, resulted in a transatlantic alignment of regulatory approaches, not conflict over the fundamentals. This chapter demonstrates how soft law was used by reform-minded factions in Europe to legitimize their claims and tip in their favor political contests over the modernization of internal regulation. International soft law served as a mechanism of endogenous change, helping to foster a great power preference alignment along market-friendly paths and setting the stage for the financial crisis.

Abstract:
This chapter argues that the notion of international cooperation as a purely executive, legal, or technocratic matter misses some decisive features of world politics today. International institutions are seen not only by political, but also by societal actors as political institutions exercising public authority requiring legitimacy. Two broad claims are tested. According to the first, the politicization of international institutions can be ascribed to the patterns of authority in the global governance system. The more political authority international institutions exercise, the more attention they attract, the more actors participate in debates and the more polarization in opinions takes place. The second broad claim is that politicization is a double-edged sword. On the one hand, it leads to a broadening of legitimation efforts including participatory and fairness-based narratives. On the other hand, politicization may also lead to a significant legitimacy gap that can undermine the authorities as a whole.

This chapter argues that poverty is created, maintained, and regulated. Global poverty occupies a unique position as both the ‘blind spot’ and raison d’être of an international legal system that has long attempted to secure a veneer of cooperation, justice, and legitimacy over a reality of competition, conquest, and exploitation. As such, it vividly illustrates the radical indeterminacy and ‘schizophrenia ‘ that ‘ tear[s]‌ apart the fragile structure’ of international law. That this contradiction appears to be little analysed, that there is so little conversation to detail, is testament to the strategies deployed to naturalize, excuse, and obscure the ‘fact’ of poverty.

Abstract:
Besides formal third-party punishment, punishment can take alternative forms such as revenge, gossip, and restorative justice. This chapter examines these alternative punishment forms in light of the idea that punishment is a basic moral instinct. Revenge means that the victim (or people close to the victim) directly punishes the perpetrator. Revenge has a behavioral-control function similar to third-party punishment’s, but it is less successful due to a lack of legitimacy and proportionality. Gossip enables group members to harm an offender’s reputation. These reputational concerns stimulate cooperation, even among the most powerful members of the group, if group members are likely to gossip. Finally, although restorative justice (e.g., healing an injustice through victim–offender mediation) is frequently portrayed as alternative to punishment, it actually works best if it contains punishment. Restorative justice is mostly an improved procedure to implement punishment, increasing fairness and hence cooperation.

Chapter 1 explores perspectives on world order, including power relationships and the rules that shape state behavior and perceptions of legitimacy. After outlining a brief history of the relationship between Russia and China that ranged from cooperation to military clashes, the chapter details Chinese and Russian perspectives on the contemporary international order as shaped by their histories and current political situation. Chinese and Russian views largely coincide on security issues, the desirability of a more multipolar order, and institutions that would enhance their standing in the world. While the Chinese–Russian partnership has accelerated considerably, particularly since the crisis in Ukraine in 2014, there are still some areas of competition that limit the extent of the relationship.

Abstract:
This chapter articulates the conception of separation of powers that underpins the account of constitutional review advanced in this book. Like all constitutional law, separation of powers must be understood as a legitimacy enhancer: political regimes that conform to it make a stronger moral claim to the allegiance of their citizens. Separation of powers achieves this by structuring cooperation among state institutions in accordance with two imperatives—division of labour and checks and balances. The first imperative dictates (a) that government tasks be assigned to those bodies that can carry them out efficiently or in a way that instantiates relevant intrinsic values such as fairness, and (b) that other bodies respect each other’s contribution. The second imperative dictates that mechanisms be put in place for effectively monitoring government power and averting its misuse.
