Abstract:

Abstract:

Abstract:

Abstract:
On September the 28th 1981, the Supreme Court of Canada made public its opinion as to the constitutionaly of the Federal government's plan to repatriate and amend the B.N.A. Act. Modifications affecting provincial powers require, according to convention, the existance of which is recognized by six of the Judges, a certain degree of provincial consensus. The federal projet, contested by eight of the ten provinces, was therefore considered unconstitutional by a majority of the Judges. The Court mentioned furthermore that the federal plan, should it become law, would impinge upon the distribution of powers set forth in the B.N.A. Act. Seven of the nine Judges so deciding declared, on the other hand, that the Senat and House of Commons' resolution pertaining to the plan of repatriation and amendement was perfectly legal and that the British Parliament was, in law, the only authorized body to bring about the changes sought by said plan.

Abstract:

Abstract:
Automotive suspension design is a compromise brought about by the conflicting demands of ride and handling. The past few years have seen the introduction of increasingly sophisticated, electronically controlled, components into automotive suspensions which redefine the boundaries of the compromise. The paper has been written in two parts. This first part reviews the compromises which are required in the design of a conventional passive suspension. It then goes on to show how those compromises can be changed by the inclusion of active components. The second part discusses the hardware employed which ranges from simple switched dampers, through semi-active dampers, and low bandwidth/soft active suspensions, to high bandwidth/stiff active suspensions. The benefits to be derived from each of the technologies will be assessed, together with their strengths and weaknesses.

The present contribution outlines the history of negotiations and the structure and main provisions of the Convention. In particular, it examines the compromise that has been struck between the principles of university and territoriality and the impact of this compromise on issues of jurisdiction, recognition and the powers of liquidators. It also explores the many choice of law problems that may arise in the course of insolvency litigation.

Abstract:
Our thesis looks at the capacity of a social work training institution that is considered pluralist to adopt a compromise agreement between “worlds” during a process of absorbing external knowledge so that it can fulfil its public interest mission. The thesis investigates how a compromise agreement is drawn up and delivered based on knowledge absorptive capacity. Furthermore, based on our literature review, we can establish an analytical model that clarifies the action of the knowledge absorption process on the adoption of the compromise agreement by the knowledge broker. To review this process, we look at an embedded case study with two project groups in a social work training institution. For one of the two groups, the interviews that were conducted demonstrate, the major role of the knowledge broker as it develops towards a function of a broker of worlds. His action manages to generate a compromise agreement during the absorption process. The experience of the second group is dissimilar: the agreement figure produced is the arrangement that does not commit the compromise agreement. During the transition to the organisation, the empirical study highlights the fact that neither of the two groups succeeds in having the compromise agreement adopted in the training institute. The discussion of our results focuses on the levers that promote the adoption of a compromise agreement within a pluralist organisation to fulfil a public interest mission: (1) the major role of the broker of worlds ; (2) the functioning in a managed community of practice with common good; and (3) the reflexive dimension exercised inside the organisation

Abstract:

Recently, the parisian newspaper industry has been suffering constraints due to new trends resulting from changes and modernization on the market. These changes have brought two types of mutations, that are interconnected. The first one has to do with social relations in this particular branch, that is to say "craft trade unionism" and "craft labor market", both relevant from contract compromises, negociated for each professional category of printing workers. The second one is related to the strategies to be followed and the new identity to give to the newspaper industry : multimedia, partnership

Arbitrtion has increased its scope in contemporary societies, but is still underused, despite the Express constitutional authorization. In fact, alternative methods of conflict resolution is a new field of procedures, which are replacing traditional ways of solving problems related to disputes of rights available. The increase in economic transactions has changed the way of understanding the traditional theory of legal transactions, in which a contract is not concluded by the same, but there is a huge difference in the legal position of the parties. The solution demands for arbitration is based on the autonomy of the will of the parties, to provide justice faster, faster, and cheaper in Brazil. For this method to be effective, necessary it is that the convention is held and developed without vices will. The dissertation it is the validity of the arbitration agreement, recognizing, however, that there are several points to be reformed, with respect to special legislation. Thus, on account of such facts, this study will investigate the phenomena of historical facts related to arbitration, until our present day, with emphasis on the advantages of the institute, and shape and effectiveness of the arbitration agreement.

Abstract:
The present thesis has as an objective the study of the relations among painters and other artists registered in the Saint Lucas Brotherhood (as a free organization of painters), with the Anunciada convent nuns. When in 1602 the painters purchased the chapel to the nuns, to use as headquarters under the Saint Lucas protection, the nuns collaboration on the maintenance of the chapel was established on the contract, without any payment for the service being registered. The Brotherhood grew by, increasing the activities, and in addition to the chapel maintenance and the mass preparation, the nuns were providing other services as the chapel decoration and the confection of cakes for the parties of the Brotherhood. In the year 1712 a contract for the payment of 3.000 reis was set. However, the nuns didn’t just collaborate on the Brotherhood’s daily life but were inscribed as sisters and were elected stewards and presidents. After de Earthquake, there was an hiatus between 1755 and 1777. After this date, several tryouts were made to rebuild the Brotherhood under the aegis of Cyrillo Volkmar Machado whom after 1791 worked with other painters on the writing of a new Compromise. Only in 1793 the painters and the nuns from the Saint Joana Convent renewed the 1602 contract, again delivering the chapel to the Brotherhood to use as headquarters, and where before had been placed the Saint Lucas panel painted by Amaro do Vale and the silver lamp brought over by the nuns of the old convent. The French invasions raised the caos and the Brotherhood didn’t resist. It was over in 1808

Authorized by a convention of all Sikh parties, Master Tara Singh, with four other Sikh leaders, met Jawaharlal Nehru on 24 October 1955. Maulana Azad and G.B. Pant were also present. The talks were ‘friendly but rather vague’. On 8 February 1956, a plan, generally known as the Regional Formula, was discussed by the Sikh leaders. In his address to the All-India Akali Conference on 11 February, Master Tara Singh dwelt on Punjabi Suba as the real solution for the Punjab problem. But the Akali Dal accepted the Regional Formula in March 1956. Furthermore, the Akali Dal Working Committee resolved in September 1956 to implement the Formula. The constitution of the Akali Dal was suitably amended and the Akali legislators joined the Congress party.

Abstract:
These concluding reflections analyse the approaches and stances adopted across the volume and, on that basis, highlight some of the bones of contention in current human rights scholarship on conflicting (Convention) rights. The first matter on which opinions diverge is ‘to name or not to name’, i.e. whether or not to explicitly identify a conflict between Convention rights. The second is that of ‘choice versus compromise’, i.e. whether a finding of conflicting rights automatically leads to a solution that prioritizes one right over the other, or whether instead a compromise between the conflicting rights is preferable. The third issue is that of ‘balancing’ as opposed to other approaches that allow to prioritize among conflicting rights. The final issue, on which diverging opinions are discussed, is that of subsidiarity and the margin of appreciation.

AbstractGiven the serious adverse effects of hypothermia in term and preterm infants, thermal protection is of paramount importance in neonatal care. To compare potential benefits of wIRA radiators with conventional radiant warmers in neonatology, physical investigations (agar phantoms) and clinical observations (term and preterm neonates) were performed. Physical investigations revealed a fundamental difference in the mode of action between the two types of radiation: Whereas with conventional radiant warmers, the increase in core temperature (phantoms) is preceded by marked elevations in surface temperature, wIRA leads to more direct rises in core temperature and results in smaller amounts of evaporative water loss from the surface. Clinical observations reveal that wIRA causes less skin surface warming than conventional heat irradiation at equal power densities (irradiances). wIRA used as a supplementary source of heat during primary care in the delivery room was found to exert a preventive effect against unintentional heat loss during the subsequent incubator transport of preterm neonates to the intensive care unit. Overall, due to its specific physical properties (“enhanced depth effect with less surface overheating”), wIRA seems to be particularly suited to replace the extra heat losses occurring in preterm or otherwise compromised neonates without undue risk of superficial burns.

Abstract:
AbstractCryogenic minimum quantity lubrication (CMQL) represents a compromise satisfying both efficiency and sustainability in many manufacturing processes. In previous series of experiments a variation of the thermodynamic state of the cryogenic medium taken from riser bottles could be observed. Consequently, the aim of this study was to specifically control the thermodynamic state of the CO2 and, associated with this, the density after removal from the riser bottles. To achieve this objective conventional cooling was implemented for the CO2 after withdrawal from the riser bundle in order to have a constant liquid state of the CO2 during feeding. The density of the cryogenic medium could be raised from ρ = 550 kg/m3 to over 800 kg/m at a mass flow rate of $$\dot{m}_{CO2}$$ m ˙ C O 2 = 5 kg/h with the applied cooling method and can also be stabilized regarding the density pulsation. Subsequently, the effects of temperature-controlled CO2 on the sprayability and solubility in CMQL were examined and resulted in increased atomization of the oils and widening of the spray corridor with a greater main spray length and intensity. In addition stable conditions for the CMQL-supply to the manufacturing process were achieved by a lower pulsation of the CO2-oil mixture.

Abstract:
Chapters 1 to 3 show that important interests are at stake in regulating conscientious refusals in reproductive health care, and that this is true for both conscientious objectors and patients. One might think, therefore, that devising a compromise between the parties would be the best way to deal with these conflicts. Chapter 4 rejects this approach, however, on the grounds that developing a good or even a true (i.e. genuine) compromise is unlikely to happen for typical refusals in reproductive health care. The chapter delves deeply into the nature of compromises and also uses what has been called the “conventional compromise” (conscientious objectors can refuse to provide the offending service but must offer a proper referral for it) to illustrate why the compromise approach fails.

Abstract “The great compromise” examines how the constitutional convention shaped the nature of Congress. This resulted in a proportionally representative House of Representatives and an equality of the states in the Senate. Without this “Great Compromise” the framers of the Constitution would have been unable to progress and there would be no Constitution. The rejection of a parliamentary model and the way Congress has developed and the respective roles of the House of Representatives and the Senate are set in the context of the wider Constitution. Compromise, negotiation, and bipartisanship are all key elements in the life of the U.S. Congress.

Abstract:
After more than one hundred years the Titanic is still probably the most remembered ship in the world. This paper briefly discusses the history of the Titanic from why the White Star Line decided to build the Olympic class ships through the recently signed treaty protecting the ship. It is shown that many of the design features of the ship were far ahead of the rest of the industry but that some compromises were against the naval architect’s desires. A number of myths concerning the ship are dispelled. The circumstances leading up to the collision with the iceberg and the sinking of the ship are examined followed by an analysis of the sinking; the discovery of the ship; and finally after almost thirty-five years, a treaty to protect the ship.

Abstract:
The capability to continually perform operations in ice is a function of multiple design factors. These factors may directly influence one another and are integral to the design spiral. The compromises made in vessel design directly impact the vessel’s noise and vibration characteristics. Unlike conventional ships, icebreakers are subject to additional dynamic loads arising from interaction with ice. Because icebreaker hull forms are generally influenced by unique performance requirements, engineering past experiences, production feasibility, and risk mitigation during operation, early design development to optimize both ship arrangement and machinery system parameters is necessary to avoid vibration problems. Numerical modeling techniques like the finite element method are indispensable when evaluating the low frequency vibration of a vessel during the design stage. Methodologies for estimating the dynamic loads associated with common shipboard excitations such as unsteady propeller forces, cavitation pressure pulses and propulsion machinery are non-trivial, but established. Estimating the spatial and temporal characteristics of dynamic loads associated with ice operations, such as icebreaking and ice milling, is a challenge. In this paper, techniques for estimating dynamic loads associated with icebreaking and ice milling operations are discussed. Approaches to applying these forces to a finite element model for the evaluation of these forces on a vessel’s low frequency vibration are presented.

Abstract:
At early design stages is where most part of the decisions and costs are compromised, and where 2D drawings are still widely used. The idea of using a single tool for the whole process, starting with the creation of a 3D model at early design stages has been profusely required in naval shipbuilding. It is not easy to convince the agents involved about the advantage of having an increased work at early phases although that will be largely reused downstream. This paper describes in detail the benefits of changing the process for minor warships design, by means of using an advanced CAD tool from the early stages and explaining the advantage in terms of quality and cost. The most remarkable benefits come from the data integrity and the avoidance of long design periods and cost increases due to errors, re-work and inconsistencies. The main challenges refer to the integration of all stages and disciplines, relying on the use of a single CAD tool that must be effective at all stages, including those in basic design such as the quick definition of the 3D model, as well as in the transfer of a simplified model to the analysis and calculation tools. This paper describes SENER findings in minor warships, as an example of engineering work, by means of an approach based on the use of FORAN, a shipbuilding oriented CAD System.

Abstract:
Abstract The layout of fiber composite structures compared to that of structures made from conventional homogenous isotropic materials is far more difficult, because a fiber composite (laminate) is built up of several unidirectional layers (UD-layers) with fibers set at different angles. A contribution to the structural analysis and preliminary design of a fiber-reinforced conical shell is made in this paper. The equations of the membrane theory are used for analyzing the shell behavior. The design, with the objective of obtaining minimal deformation at minimal weight, subject to a set of failure constraints, is achieved by formulating and solving a compromise Decision Support Problem. Some designs of a fiber reinforced conical shell subjected to pressure load and temperature are presented.

Abstract:
Compliant contacting filament seals such as brush seals are well known to give improved leakage performance and hence specific fuel consumption benefit compared to labyrinth seals. The design of the brush seal must be robust across a range of operating pressures, rotor speeds and radial build-offset tolerances. Importantly the wear characteristics of the seal must be well understood to allow a secondary air system suitable for operation over the entire engine life to be designed. A test rig at the University of Oxford is described which was developed for the testing of brush seals at engine-representative speeds, pressures and seal housing eccentricities. The test rig allows the leakage, torque and temperature rise in the rotor to be characterized as functions of the differential pressure(s) across the seal and the speed of rotation. Tests were run on two different geometries of bristle-pack with conventional, passive and active pressure-balanced backing ring configurations. Comparison of the experimental results indicates that the hysteresis inherent in conventional brush seal design could compromise performance (due to increased leakage) or life (due to exacerbated wear) as a result of reduced compliance. The inclusion of active pressure-balanced backing rings in the seal designs are shown to alleviate the problem of bristle-backing ring friction, but this is associated with increased blow-down forces which could result in a significant seal-life penalty. The best performing seal was concluded to be the passive pressure-balanced configuration, which achieves the best compromise between leakage and seal torque. Seals incorporating passive pressure-balanced backing rings are also shown to have improved heat transfer performance in comparison to other designs.

Computer mice and keyboards have for long been the dominant input devices for desktop computers. Nonetheless, they still represent quite a barrier — especially for people whose upper-limb motor skills are compromised. This work proposes a low-cost, mouth-puffing-based device that is able to perform the mouse click on computational platforms. Additionally, a driver was developed to allow the device to communicate with the computer via audio jack P2 interface. The mouse cursor is controlled by head tracking thanks to eViacam software. The evaluation took place by comparing the proposed equipment with the dwell time method on navigation tasks elaborated over websites.

Abstract:
Many regional 3Ds cover large areas where the geological and geophysical settings can change from sub-basin to sub-basin. Because of these variations, the processing flow designed for these surveys is unlikely to be optimum for individual prospect areas. In this case study, a description of the application of an optimized gather conditioning work flow to 2019 regional 3d survey and subsequent pre-stack data analysis will be presented. The objective of this conditioning was to provide optimized gather volumes for predrill AVA analysis. The data and results of the interpretation provided input into prospect risking, resource estimates of the prospects, and increased our understanding of the rock physics parameters. Evaluation of the final angle stacks from a recent multi-client 3D in the Andaman Sea identified issues that could compromise the AVA fidelity of the data, and hence the need to perform gather conditioning. The input data for the conditioning were raw PSDM TWT (PSDM gathers converted to time) gathers which were analyzed using QC attributes to design an optimized conditioning work flow. This process included RMO, Radon Demultiple, Spectral Balancing, Random Noise Attenuation, Q-compensation, and Trim Statics. The QC attributes were computed to measure AVA compliance, residual moveout, gather flatness, seismic bandwidth, and coherent and incoherent noise contamination. The conditioned volumes were integrated with the available well control. Intercept and gradient volumes were used to generate various relative attribute volumes. Chi angle reflectivity and EEI colored inversion attributes provided insight into the relative bounding conditions and rock physics properties needed to generate the response observed on the seismic and identify a calibrated range of pre-drill scenarios. In summary, the gather conditioning improved the AVA fidelity of the data and provided an uplift in the understanding of the range of rock physics parameters and prospect risking.

Abstract:
Abstract This paper describes a vapour phase method for cleaning and decontamination of a slug catcher in a gas processing plant. Corrosion and heavy metal losses required the slug catchers to be replaced. Safe decommissioning demanded the elimination of H2S, LEL and pyrophoric iron. Compromised integrity made traditional cleaning methods like circulation or pressure jetting unfeasible. The proposed method significantly reduced decontamination times and the associated effluent. The vapour phase method using degassing chemicals entrained in steam lowered H2S and LEL levels to substantially zero and also neutralized the pyrophoric material. The entire cleaning process was conducted with a temporary H2S scrubber due to unavailability of the process flare. This method did not require the system to be liquid filled or subject to high jetting pressure, making it possible to limit the treatment pressure to below 2 barg, thus minimizing the stress on the structural integrity of the slug catcher. In addition, the slug catcher weak zones were fortified externally in preparation for decontamination. This technique of using steam as a medium to distribute and apply the degassing chemicals throughout the slug catcher has proven to overcome the limitations of conventional cleaning methods. It further provided a viable solution to reducing the time and resources required to achieve substantially zero H2S, LEL and pyrophoric content by half. With traditional cleaning methods, the effluent generated would be substantial, necessitating additional logistical support for transporting the waste from the offshore location. Decontamination in a steam saturated vapour phase reduced the amount of effluent generated significantly, to only one third in comparison. This resulted in a solution that was more economical and environmentally friendly. Effective decontamination eliminated the risk associated with the presence of hydrogen sulfide (H2S) gas and pyrophoric materials, ensuring the slug catcher was decommissioned safely and successfully. For heavily compromised systems and for locations with water supply, waste management or schedule constraints, the vapour phase decontamination process has distinct advantages over conventional methods. The resultant savings in time and resources makes this an attractive option for mainstream oil and gas processing facilities as well.

In the contemporary context, the knitting industry is dealing with a scarcity of 3d simulation tools, resulting, to date, in a sampling-based method where refinements to a specific design are often abandoned or compromised. While, in other design fields, virtual 3d modeling profitably interacts with hardware technology (e.g., 3d printers) (Verbruggen, 2014), such tools do not easily connect to the conventional textile technology of industrial knitting machines (Underwood, 2018).This paper explores the state of the art of knitted textiles digitalization, aiming to outline practical support to knitwear design practice with a specific focus on possible digital tools to integrate design and fabrication prerogatives.

Review question / Objective: The aim of this article is to obtain an in-depth review of ameloblastoma tumor to determine the available level of evidence and the possible benefit of targeted therapeutics for the treatment of BRAF V600E mutation in ameloblastoma tumor. Condition being studied: Ameloblastoma is an epithelium-derived odontogenic tumour that evolved since the prehistoric era. Ameloblastoma is unique among the odontogenic neoplasms occurring in the jaws, because of its locally invasive behaviour and high recurrence rate. Facial asymmetry, displacement of teeth, malocclusion, and pathologic fractures are some of the asymmetrical features that ameloblastoma is known to cause. If left untreated, they often lead to wide tissue destruction and deformity. For the treatment of ameloblastomas, conventional chemotherapy and radiation have been unexplored or contraindicated and to date, wide surgical resection is the only treatment of choice for ameloblastoma tumours, resulting in post-treatment compromised quality of life in the individuals.
