Full textIn the wounded late-modern consciousness, the general feeling of impotence and anthropological depression finds an unprecedented projection in the penal field, linking the sense of unease to criminality. In a generalized climate of hybris, the criminal law is called to compensate for the inadequacies of bonds of trust, with distorting consequences on production of legislation, interpretation of jurisprudence and social relations. This analysis aims to examine the current tendency to react, with respect to the most heterogeneous individual and social problems, with an «accusatory ‘response’» and to understand that worrying securitarian strategy called ‘penal populism’. An elective terrain for an evaluation of the solicitations that distort the fundamental principles is the articulated ‘archipelago’ of crimes against the public administration, with specific reference to those designed to combat corruption. The purpose of this research is to provide answers to the question of how to proceed to avoid that the criminal justice sector perpetuates its own nature of «factory of illusions». To promote a virtuous change of paradigm, it is emphasized the need of not only a critical rethinking of their role by the legislature and the judiciary but also the promotion of a cultural growth of all components of the community.

Full textThe research project reflects on the criminal protection of the multiple forms of "caporalato". After reconstructing the genesis and evolution of the incriminating case of art. 603 bis c.p., the constitutive elements of the crime emerging from the current normative formulation are taken into consideration, as well as the main interpretative questions that they have posed both in doctrine and in jurisprudence. Among these, particular attention is paid to the nature and content of the indices of exploitation enumerated by the third paragraph of the codified provision. In addition, this project analyzes both the effects that the commission of illicit intermediation and exploitation of work in the interest or to the advantage of a legal entity places on the latter under the terms of Legislative Decree no. 231 of June 8, 2001, and the main instruments currently in force to combat the phenomenon within the system.

Full textEl objeto del presente trabajo consiste en determinar la naturaleza jurídica del control de identidad del artículo 85 del Código Procesal Penal, en otras palabras, comprender cuál es la finalidad que cumple dicha institución en el ordenamiento jurídico. Para ello, realizamos un estudio pormenorizado de las modificaciones legales que ha presentado la normativa y los motivos del legislador para realizar dichos cambios en tan poco tiempo. En segundo lugar, para la mejor comprensión de la institución, recurriremos a los conceptos elaborados por la doctrina, haciendo una revisión general de los aspectos del procedimiento del control de identidad, desde sus supuestos habilitantes hasta el término del procedimiento. Enseguida, para lograr nuestro objetivo y acercarnos a las posibles finalidades de la norma, analizaremos las opiniones de la doctrina, la legislación comparada y la jurisprudencia. De lo anterior, advertiremos tres distintas finalidades de la figura: cautelar, investigativa o preventiva. Para determinar cuál de las finalidades descritas es preponderante en la norma, realizaremos un estudio detallado de la figura, contrastándola con su ubicación dentro del Código Procesal Penal, cada uno de los supuestos que autorizan a solicitar la identificación del sujeto, las medidas que faculta la institución, como el registro, cotejo de órdenes de detención pendiente; y las reformas efectuadas por la ley. Esto nos permitirá comprender a cabalidad el sentido y alcance de la figura. Por último, analizaremos las ideas centrales del proyecto de ley del año 2003 que establecía un nuevo control de identidad de carácter preventivo. Finalizando con el estudio y críticas de las reformas efectuadas por la ley 20.931 al artículo 85 Código Procesal Penal y la implementación de una nueva figura, denominada “control de identidad preventivo”.

However, is the enforcement of social norms as well dependent on its costs? So far, there has been little research on the validity of the low – cost hypothesis for so called second order collective goods. In our work, the enforcement of social norms is studied by means of analyzing social control in neighbourhoods. We use data of a mail survey conducted in 2001 in Leipzig, Germany, with 631 respondents: Correlations between approval of social control and willingness to tolerate social control personally decrease with increasing costs to tolerate these control activities. Additionally, the logic of low – cost is transferable to other sociological constructs: The effect of fear of crime and authoritarianism is the less relevant for tolerating social control activities, the higher the costs for these control activities. These empirical findings confirm the low cost hypothesis for the production of second order collective goods
