Full text« The coercive act in criminal law and procedure » [L’acte coercitif en procédure pénale]. Being essentially coercive, the French criminal law and procedure are composed of a succession of acts that the Public Authorities conduct. As they are all different by nature, these acts principally constitute judicial administration measures,acts of the judiciary police, prosecution or investigation measures, as well as jurisdictional acts. Among this great number of acts, some of them can prove to be coercive. And they have one particular point in common:they all encroach on individual liberties. One simply has to consider the controls or verifications of people’sidentities, police custody, search and seizure, the interceptions of any correspondence over the telecommunications, the use of sound and image detection technology, the judicial suspension, the electronically-monitored house arrest, or custody on remand. These acts, a-priori heterogeneous, constitute infact a category of their own. Corresponding to the judicial reality, a notion of coercive acts exists in criminal procedures in parallel with traditional concepts. Its main criterion lies in the specificity of its grievance. A two part classification of the acts, grounded on their coercive or non-coercive features, is then possible. Practical interests appear beyond a tangible theoretical one. For example, it will be possible to identify any new binding action the investigating judge is not allowed to take when new facts are discovered, in view of the prohibition to carry out coercive acts in such a situation. In addition, this notion qualifies for an autonomous regime. It serves not only constitutional and conventional but also legislative requirements that make it possible to exceed the inevitable variations of the acts that compose this category; namely the notions of legality, necessity and proportionality, the effective control by the judicial authority, the respect of the person’s dignity and health ASO… If the coercive act is to respect the rights of the defense, it could also be appealed in all cases through the courts. At last, its abuses remain punishable by law as the Penal Code represses abuses of authority. Thus, the persons who decide or carry out a coercive arbitrary act expose themselves to prosecution

Full textIn this thesis, we study the strategies that abusive fathers adopt in the context of parental separation. Based on interviews with twenty women who have separated from an abusive partner with whom they had children, we identify the tactics employed by abusers before, during and after separation: isolation, deprivation of resources, control, intimidation, devaluation, confusion, overburden of responsibility and violence. These tactics accumulate, combine and intertwine in the strategy to maintain power and control over the victimised woman and children. Social and institutional responses to violence may replicate the tactics identified, and may involve complicity with the abuser.The space for action of the victims, reduced during the relationship and then extended by the separation, is again restricted by the principle of joint parental authority, which implies maintaining the link that can expose the victims to further violence and subject them to control of their daily activities by the aggressor.Women's resistance to post-separation violence and control and their attempts to protect the children are then seen as an obstacle to co-parenting. Victims' parental rights may be curtailed or the children's residence transferred to the abuser. This analysis highlights the institutional resistance to taking post-separation domestic violence into account in parenting

Full textDiametrically opposed to the peremptory norm of non-discrimination, apartheid is a violation of international law in several ways, mainly of the Charter of the United Nations, the Universal Declaration of Human Rights and other legal instruments. It was characterized as crime against humanity, modern slavery or political genocide policies, and above all a terrorist state, which practiced torture, bantoustanization, massive transfer of population, resulted of homeland policy and its concomitant denationalization. The sui generis occupation of Namibia, violence, destabilization and even war against front line states, refusal of implementing United Nations resolutions against starget states were too violative of il. To refuse, notwithstanding the illegality of apartheid, international coercion, articles 2,7, 27,3, 39 are interpreted in order to protect the apartheid regime. If sanction a phenomenon of power, the weakness of claiming states produced this result. So, only a mandatory embargo was decided during near fifty years, and it came too late and was too little. Above all, sanctions busters, many kind of upholders, and questionable interpretation of il, negotiations policy, or specialized institution of United Nations, mainly the financial ones, the inclusion of apartheid state in east-west ideological confrontation, prevented the right characterization and the subsequent correct punishment it lacked real sanctions and bona fide implementation. Certainty the wrong fact, certitude of sanction must have been automatically and quickly decided, because time factor is a key one of the success of coercion, so are neutrality of states, solidarity. . . . States disjoined practices, questionable interpretation of past precedents, graduation of sanctions, the a priori exclusion of undisputed legal sanctions, like. .
