Abstract:

Il lavoro di ricerca indaga il tema della determinazione dei trattamenti economici dei lavoratori subordinati,alla luce dei principi costituzionali in materia e dei poteri espressamente attribuiti in tal senso dall'ordinamento italiano alla contrattazione collettiva.In primo luogo, l'analisi verte sull'approfondimento dei diversi orientamenti in dottrina e in giurisprudenza circa il contenuto e l'ambito di operatività del precetto di cui all'art. 36 Cost.,sull'individuazione del contratto collettivo c.d. parametro (strumento delegato dalla giurisprudenza all'indicazione del contenuto di cui alla retribuzione costituzionale),sul tema della verifica giudiziale della compatibilità delle clausole collettive in materia retributiva con i criteri di proporzionalità e sufficienza della retribuzione di cui all'art. 36 Cost., sul meccanismo dell'applicazione giurisprudenziale dell'art. 36 Cost., sul tema della differenziazione salariale su base territoriale ad opera della contrattazione collettiva autorizzata da interventi legislativi. In secondo luogo, si analizza il tema della definizione dei trattamenti retributivi ad opera della contrattazione collettiva italiana,alla luce dell'evoluzione storica del sistema, delle funzioni e competenze specifiche assegnate ai diversi livelli di contrattazione, ai principali istituti retributivi regolati, al rapporto tra contratti collettivi di diverso livello, soprattutto con riferimento alle recenti modifiche apportate al sistema dagli Accordi del 2009. Infine, si approfondiscono le questioni interpretative che derivano dalla struttura e dal funzionamento attuali del sistema di contrattazione collettiva italiano, ovvero se il principio della giusta retribuzione ex art. 36 Cost. sia suscettibile ancora di valida attuazione da parte della contrattazione collettiva stessa ed in che misura le determinazioni in materia retributiva del contratto collettivo di secondo livello(in special modo aziendale)possano fungere da parametro collettivo orientativo ugualmente affidabile, rispetto al contratto collettivo nazionale, come indicatore della retribuzione ex art. 36 Cost. In tal senso sono esaminate le ipotesi in cui la contrattazione collettiva di secondo livello, in particolare aziendale, preveda clausole retributive che deroghino ai trattamenti retributivi previsti dal contratto collettivo di categoria, in ragione di fattori "esterni" indipendenti dal contenuto della prestazione lavorativa. Il concorso/conflitto che deriva da contratti collettivi di diverso livello che prevedono diposizioni antinomiche in materia retributiva ripropone all'attenzione del dibattito attuale temi quali la delimitazione degli ambiti di competenza dei diversi livelli di contrattazione collettiva, l'efficacia soggettiva del contratto collettivo di primo e secondo livello. Infine, si riflette sulla situazione di inapplicabilità dell'art. 36 Cost. all'area del c.d. lavoro autonomo economicamente dipendente, auspicando anche per tali categorie di lavoratori un'estensione delle tutele proprie dei lavoratori subordinati.

Abstract:

L'émergence d'un marché du faire-valoir indirect en Roumanie advient dans un contexte de transition caractérisé par de multiples imperfections de marché. La littérature en économie du développement a mis récemment l'accent sur le rôle potentiel du faire-valoir indirect dans l'amélioration de l'efficacité et l'équité de l'allocation de la terre lorsque les marchés autres que celui de la terre sont imparfaits. La thèse s'intéresse au développement du marché du faire-valoir indirect en Roumanie. Plus particulièrement, l'objectif du travail est d'identifier les déterminants des pratiques contractuelles foncières. Notre analyse s'appuie sur les théories économiques des contrats agraires relevant de la Nouvelle Economie Institutionnelle. D'un point de vue méthodologique, nous adoptons une démarche compréhensive, que nous complétons par un traitement formel de données quantitatives. Le travail est basé sur des enquêtes de terrain réalisée en 2003 et 2004 dans deux communes du département d'Alba, en Transylvanie. Nous montrons que le faire-valoir indirect permet aux acteurs de surmonter les contraintes liées aux imperfections de marché et à l'incertitude qui caractérisent la transition. Cependant, l'ajustement permis par le faire-valoir indirect apparaît limité par la présence de coûts de transaction sur ce marché. Par ailleurs, l'impact positif du faire-valoir indirect en terme d'équité est remis en cause dans un contexte où les principaux acteurs de la demande de terre en faire-valoir indirect, des formes sociétaires de production en situation de quasi-monopole, sont en mesure de choisir et d'appliquer les termes des contrats à leur seul avantage, en l'absence de tout mécanisme d'«enforcement».
