Résumé Se situant dans le droit fil de la récente controverse sur les fondements de la théorie des contrats incomplets (Maskin et Tirole, 1999 ; Hart et Moore, 1999 ; Tirole, 1999), cette revue de la littérature cherche à définir la notion d’incomplétude contractuelle et à en comprendre l’origine. Deux résultats importants sont dégagés : (i) les raisons traditionnellement avancées pour expliquer l’incomplétude contractuelle, telles que l’indescriptibilité des contingences futures ou l’asymétrie d’information entre les parties contractantes, ne sont pas forcément pertinentes ; (ii) la contrainte d’invérifiabilité, concept clé de la théorie des contrats incomplets, parvient à rendre compte d’un choix d’incomplétude lorsqu’elle est couplée à la contrainte de renégociation du contrat initial. Cette double contrainte permet à la théorie des contrats incomplets de générer un choix endogène d’incomplétude. Plus précisément, cette théorie montre que l’on peut définir un choix de contrat incomplet comme une forme limite du contrat complet.

Abstract:
Dans ce commentaire, l’auteur analyse un arrêt de la Cour d’appel, confirmant la décision de la Cour supérieure, et qui renverse un arrêt de principe datant de 1978. En reconnaissant la compétence arbitrale pour juger du renvoi pour « fausses déclarations à l’embauchage », notre Cour d’appel s’aligne sur l’approche des provinces de common law. La Cour supérieure en avait fait un cas d’espèce, s’appuyant sur le libellé de la clause conventionnelle applicable. Mais en un second temps (et en obiter), l’honorable juge Lévesque généralisait sa motivation dans la foulée de la jurisprudence récente de la Cour suprême du Canada sur la doctrine de la déférence judiciaire envers les tribunaux administratifs. Mais la Cour d’appel attaque plutôt le problème de plein fouet, affirmant que l’ancienne règle n’est plus adéquate, à la lumière des directives de la Cour suprême. Après une revue de la jurisprudence, la Cour déclare qu’en présence d’une convention collective, il n’y a plus d’entente individuelle qui tienne et donc que l’arbitre, ex post factum a compétence pour juger de la validité de la formation du contrat individuel de travail initial qui avait placé le salarié sous l’empire de la convention collective. Bien que cette approche ne soit pas nouvelle, il est à se demander s’il était nécessaire, voire opportun, d’aller jusque là pour disposer du litige. Car en mettant le point final à la discussion sur la coexistence du contrat individuel et de la convention collective, la Cour a peut-être ouvert une boîte de Pandore. En effet, le droit disciplinaire et non disciplinaire du travail fait constamment appel aux droits et obligations nés du contrat individuel de travail, le plus souvent implicitement. Le contrat de travail évanoui, par quoi le remplacera-t-on ? L’auteur est d’avis que la jurisprudence et la doctrine construites à ce jour prendront le Orelais. Les règles subsisteront; le fondement et l’explication devront en être raffermis à partir de l’acquis du passé. Il est également à prévoir que les chefs d’entreprises seront plus enclins à édicter ou négocier des règlements intérieurs mieux structurés que la plupart de ceux qu’on rencontre de nos jours.

RÉSUMÉ Cet article présente quelques résultats d'une recherche fondée sur les récits de vie de 30 chômeurs et chômeuses de longue durée de plus de 45 ans. Pour ces personnes modelées par une société salariale intégrée autour du travail et dotée de formes familiales et de politiques sociales associées à l'État-providence, le chômage de longue durée est un échec et une trahison. Alors que le « contrat » initial leur promettait la retraite légitime au bout d'une vie de labeur, la perte d'emploi durable les condamne au statut d'assisté social et leur laisse un « fossé » de dix à quinze ans à combler avant la retraite légitime. Plus que la pauvreté, c'est la perte de statut qui les marque, car elle porte atteinte à leur identité. Certains s'épuisent à tenter de reconquérir un statut de travailleur, d'autres tentent de trouver de nouvelles identités hors du travail.

Loin d’être exclu comme pourrait le laisser croire le principe de l’indisponibilité de l’autorité parentale, le mécanisme contractuel est fréquemment utilisé pour le règlement des conflits parentaux. Ainsi, l’aménagement des conséquences de la rupture au regard des enfants peut aujourd’hui s’opérer au moyen d’une convention ; ce mode de règlement des conflits est par ailleurs privilégié par la loi. Le législateur espère ainsi faire bénéficier le contentieux familial de deux des vertus principales dont se pare le contrat, soit l’égalité des parties et l’apaisement des conflits. Pourtant, le recours à ces mécanismes contractuels n’a toujours pas apporté d’amélioration sensible au contentieux familial. Bien au contraire ! L’égalité entre le père et la mère consacrée sur un plan législatif peine à se concrétiser en pratique, le recours aux conventions pouvant à l’inverse la desservir. En outre, les conflits entre les parents, loin de s’apaiser, perdurent, voire se radicalisent : s’ils ne se manifestent pas au moment de l’aménagement de la rupture, ils ressurgissent ultérieurement lorsqu’un aléa de la vie ou les nécessités de l’éducation de l’enfant impliquent de remettre en cause l’accord initial…

La puesta en práctica del modelo de formación dual universitaria plantea importantes incógnitas en relación con la manera de organizar la parte de la formación universitaria que se desarrolla en las entidades colaboradoras, puesto que se suscitan enormes dudas a la hora de seleccionar la concreta modalidad contractual a través de la cual deben contratarse a estos estudiantes por parte de las mismas, así como sobre el íntegro régimen jurídico aplicable a dicha contratación, especialmente, en materia retributiva. En este contexto, se ha introducido una nueva modalidad de contrato formativo, denominada contrato para la formación dual universitaria, con la que se pretende establecer un mecanismo de contratación idóneo para este modelo de formación universitaria. Like spores of many fungi, conidia of Blumeria graminis, the powdery mildew fungus of cereals, release extracellular material. It is released within seconds where conidial surface projections touch a leaf. This ECM is probably adhesive since centrifugation showed that forces greater than those due to normal wind speeds are needed to displace conidia. Also, ECM release is probably involved in rapid sensing of substratum contact, leading to germ tube emergence close to the contact site. Thus, ECM release apparently confers at least two benefits to pathogen survival.

Abstract:
Microgeometric parameters of the effect of discrete electrospark coatings on their stress-strain state have been evaluated for the case of using a combined technology of modification of duralumin D16, which includes the technique of electrospark alloying with subsequent surface plastic deformation of coatings formed. According to the profilograms of discrete electrical coatings, the curves of the bearing surface (Abbott curves) were constructed and the parameters that drastically affect tribological characteristics of the coatings were determined. It was shown that modification of duralumin D16 with a combined electrospark coating VK-8 + Cu reduces the arithmetic mean height of peaks in the top portion of the profile by 4.4 and 3.2 times, doubles the arithmetic mean depth of the profile core irregularities, increases the arithmetic mean depth of profile valleys by 1.8 and 1.1 times, in comparison with electrospark coatings from hard alloy VK-8 and copper, respectively. These parameters help to reduce the period of running-in of the contact surfaces strengthened by the combined electrospark coating VK-8 + Cu, increase their bearing capacity, contact durability and specific oil consumption. On the basis of the finite element analysis method of the Nastran software complex, a model of the stress-strain state of a discrete coating/base was designed and distribution of the main normal stresses was determined for a coating compactness of 60% under a normal load of 600 N. The performed modeling revealed advantages of a combined technology for formation of wear-resistant electrospark coatings, which consists in turning residual tensile stresses into compressive ones. When modifying the duralumin D16 with a VK-8 + Cu coating, on the coating surface and in the base material, compressive stresses (-93 MPa and -20 MPa, respectively) are formed, which provides a decrease in wear of the modified surface by two times compared to unmodified duralumin D16.

This paper presents an analysis of the contact stresses and the contract area of mating disks in frictional transmission. Hertz’s formulations are adopted to determine the maximum contact stresses as well as the size of the contact area resulting from elastic deformation due to clamping force. Hertz’s formulations are expressed in terms of geometrical features of the active surface of mating disks. The obtained relationships can be readily applied for quantitative estimation of the contact stresses and the contact area parameters for different range of transmission ratio. Samples of numerical results are presented in graphical form.

In the Southern Bavarian variety of Tyrolean, laryngeal contrasts undergo a typologically interesting process of neutralisation in word-initial position. We undertake an acoustic analysis of Tyrolean stops in word-initial, word-medial intersonorant and word-final contexts, as well as in obstruent clusters, investigating the role of the acoustic parameters VOT, prevoicing, closure duration and F0 and H1–H2* on following vowels in implementing contrast, if any. Results show that stops contrast word-medially via [voice] (supported by the acoustic cues of closure duration and F0), and are neutralised completely in word-final position and in obstruent clusters. Word-initially, neutralisation is subject to inter- and intraspeaker variability, and is sensitive to place of articulation. Aspiration plays no role in implementing laryngeal contrasts in Tyrolean.

A field experiment was carried out in the fields of the Experimental Farm in Zawady owned by the University of Podlasie in Siedlce. An influence of soil tillage methods and herbicides application on the content of glycoalkaloids in edible potato tubers of the Viking cultivar was studied. The results obtained indicated that the content of glycoalkaloids in non-peeled tubers significantly depended on the method of soil tillage and weed control as well as on the research year, whereas in peeled tubers the content significantly depended only on the weather conditions in the growing season. The content of glycoalkaloids in the tubers subjected to the initial treatment (peeling) decreased to 46.81&minus;55.3%, compared to the level of glycoalkaloids before peeling.

ABSTRACTSpeech sound production changes that occurred during acquisition of the initial voicing contrast induced through treatment in phonologically disordered children were compared to those that occurred during normal acquisition of the contrast. Target stop productions from three normally developing children and six phonologically disordered children were analyzed acoustically along the temporal measure of VOT. The phonologically disordered subjects displayed different patterns of voicing contrast acquisition, none of which replicated the normally developing children's pattern. The phonologically disordered children's patterns of acquisition were characterized by larger and more variable VOT values in comparison to those of the normally developing children. Different patterns of voicing contrast acquisition observed in VOTs are discussed with regard to the nature of linguistic change and the source of breakdown in children's speech sound errors.
