Abstract:
This chapter develops an account of the content of parental rights—that is, what they are rights to do and against whom they are held. It distinguishes between fundamental parental rights, which are grounded in the interests of the parents, and derivative parental rights, which are grounded in other considerations. It argues that parents have fundamental rights to realize the goods that they have made possible through their work in raising their child. The content of derivative parental rights will depend to a significant extent on how a society or community organizes child-rearing. To illustrate this view the chapter considers putative parental rights to physically punish one’s child and to exercise religious freedom with respect to one’s child. Finally, there is a discussion of the relationship between parental rights and various justice-related considerations. The chapter closes by summarizing a framework for evaluating whether a putative parental right is justified.

This chapter examines the hip-hop community's relationship with Obama. The hip-hop community was generally supportive of Obama as the first prospective black president and an imagined emblem of hope and change, while Obama acknowledged the phenomenal power of hip-hop and admitted that he is a fan of distinguished contemporary artists in the genre. Adversely, hip-hop is highly skeptical and critical of government, and Obama has voiced disdain for the negative content and misogynist messages in hip-hop music. Now that Obama is elected, how will this anomalous relationship impact the collective posture of the hip-hop community? How will he communicate and approach the hip-hop community? Will the presence of Obama and his positive messages make the typical outlier of drug dealer passé and make it cool to be informed, articulate, and befittingly ambitious?

Abstract:
This chapter examines the guarantee of ‘due process of law’ in the Indian Constitution. After providing an account of Constituent Assembly Debates and the historical intent behind this guarantee, the Chapter explores how substantive due process came to become a part of Indian constitutional law. Through a reading of important cases, it demonstrates the shift from substantive due process to procedural due process before turning to a third kind of due process presently seen in Indian constitutional law that is distinct from these two standard forms. It examines this third form of ‘pure form’ due process, as well as provides some reflections upon the concepts of arbitrariness and reasonableness and their relationship with this guarantee.

Abstract:
This commentary focuses on Article 5.2.4 of the UNIDROIT Principles of International Commercial Contracts (PICC) concerning defences of the promisor against the promisee and against the beneficiary. Art 5.2.4 stipulates that the promisor may assert against the beneficiary all defences which the promisor could assert against the promisee. The phrase ‘all defences’ has to be read as ‘all defences based on the contract from which the third party derives its right, but not those based on other relationships between the promisor and the promisee’. The promisor has to prove the existence of a defence against the promisee arising out of the contractual relationship which confers a right upon the beneficiary. The burden of proof is on the beneficiary if it wants to argue that the parties agreed not to make the promisor's defences available against the beneficiary.

This commentary focuses on Article 5.3.4 of the UNIDROIT Principles of International Commercial Contracts (PICC) concerning the duty to preserve the rights of a party. Art 5.3.4 imposes obligations on the parties during the period of suspension of the condition. It requires the parties not to act, contrary to the duty to act in accordance with good faith and fair dealing, act so as to prejudice the other party's rights in case of fulfilment of the condition. Art 5.3.4 applies to both suspensive and resolutive conditions, but it should arguably apply with less intensity to resolutive conditions. This commentary discusses the prejudicial act that breaches the duty of good faith and fair dealing, the relationship between Arts 5.3.3 and 5.3.4, remedies for breach of Art 5.3.4, and the intensity of the obligation.
