Full textInternational relations are governed by customs, which are repeated conduct of States (practice) based on acceptance as law (opinio juris), other than by treaties willingly concluded by States. Article 31.3.b) of the 1969 Vienna Convention on the law of treaties (VCLT), however, allows to interpret a treaty via the ‘subsequent practice’ of States, under certain conditions: such practice must be connected to the treaty, and show the agreement of State parties about interpretation. The goal of the thesis is to ascertain how such ‘subsequent practice’ relates to that practice which represents the material element of custom. Attempting to realize such comparison, the starting point must be the recent work of the International Law Commission, which in 2012 assigned two special rapporteurs to the topics of identification of custom and of subsequent agreement and practice in treaty interpretation. Their reports contain Conclusions about various themes connected to practice, which the present thesis places special emphasis upon. Every chapter deals with a theme, analyzing practice from a certain point of view: the first part of each one underlines those Conclusions that mostly relate with the theme, while the second part highlights analogies and differences, using doctrine to substantiate further reflection. The first chapter concerns the ‘objective’ aspect of practice, meaning the various conditions required for practice to perform its normative, customary function, and its interpretative, conventional one. The possibility arises to understand the requirement of unanimous agreements of the States parties to the treaty, explicitly called for by article 31.3.b) VCLT, as either an ‘objective’ requirement of practice, or as a ‘psychological element’, like the opinio juris in customary international law. The second chapter refers to the ‘subjective’ side of practice, meaning the conditions required for its attribution to a State, but also the role of other non State actors that operate at the international level (though lacking legal personality in the technical sense). Any State organ could generate practice potentially becoming custom, regardless of the competence of each to enter international relations, though the internal hierarchy between organs must be accounted for to assess its weight. ‘Subsequent practice’ also needs to execute a conventional obligation, thus requiring to be directly effected by organs capable to implement the treaty, or authorized by such organs. One particularly elusive question regards the possibility to attribute to a State the conduct of an international organization, since one could scarcely outline in the abstract the criteria to that end. Practice of other non State actors merely serves in the realm of evidence, or as an impulse for practice by States themselves. The third chapter examines the role of practice in the relation between customs and treaties, and proposes to verify if and how the conduct of States parties to a treaty in its implementation could be used not just to interpret, but also to modify its provisions. Such a modification could be effected via the practice itself (‘informal modification’), when an agreement to that purpose exists; certainly, one should consider that possibility as an extrema ratio, considering the ample scope of interpretation that the VCLT allows. This hypothesis differs from modifications realized via subsequent customs, and becomes even more challenging if considering the possibility of modifying a codified custom, where that two norms exist, one conventional and one customary, whose content is the same, but both capable of different evolution.

Full textThis thesis aims to analyze conflicts and interactions between different legal cultures in rural communities of Madagascar, specifically in the Haute Matsiatra region, located in the central highlands of the country. In the context of rural communities in the Haute Matsiatra region it has been seen how legal principles of the Malagasy State Law and legal principles of the local vindictive legal culture are juxtaposed in local practices of conflict resolution, especially in cases of cattle theft and territorial disputes, sometimes quite articulate and some others more conflictive. The dina, law based in the local legal practices, has been taken up by the Malagasy State as an own legal resource presenting a conflictive juxtaposition. The research developed in this thesis is built around three pillars: First, the articulation of different legal cultures. Second, the social aspect of the law. Third, the political uses of local practices.

Pasa revista, críticamente, a los conceptos que han sido desarrollados entorno de la temática en los ámbitos internacionales, regionales y locales, y desarrolla la tesis de la aplicación del derecho consuetudinario en especial en lo atinente al consentimiento fundamentado previo y la distribución de beneficios. Sin desdeñar el tratamiento de los conflictos planteados, y los que se avizoran en un inminente futuro, se abordan las implicaciones y escenarios en los que la determinación de los Estados y de los organismos internacionales han de enfrentar en la materia.

Resumo: Esta tese adota uma perspectiva socioecológica com o intuito de identificar e entender as respostas encontradas por pescadores artesanais para manutenção de seu modo de vida diante de alterações sociais e naturais no ambiente em que se inserem. O aporte teórico interdisciplinar situa-se no âmbito da Etnoecologia Abrangente. A identificação dos elementos, estratégias e condições que favorecem ou obstam o potencial de auto-organização e evolução do sistema socioecológico da pesca artesanal foi realizada por meio do estudo da trajetória das regras informais existentes na pesca artesanal da praia de Itaipu (bairro do município de Niterói/RJ) nos últimos 35 anos. A praia de Itaipu mostrou-se também o locus privilegiado para o estudo por apresentar iniciativas de implantação de uma Reserva Extrativista Marinha. Procedimentos diversificados (depoimentos livres, mapeamento de pontos de pesca, registro fotográfico, entre outros), foram usados para subsidiar as análises, que se concentraram no conhecimento ecológico local das diferentes artes de pesca, áreas de pesca utilizadas, disputas pelos recursos naturais, identificação e compreensão das regras informais e rede de significados imbricados na dinâmica das instituições que permeiam esta atividade de uso coletivo e direcionam as práticas de manejo. Os dados revelam que a manutenção desta atividade secular às margens da região metropolitana de Niterói deve-se ao refinado conhecimento ecológico local e à observação de regras informais por parte dos pescadores artesanais, fatores estes que se adaptam às transformações sociais e ecológicas e devem ser considerados em qualquer iniciativa de gestão na área
Abstract: This thesis adopts a socio-ecological perspective in order to identify and understand the answers found by fishermen to maintain their lifestyle in the face of changes in social and natural environment in which they operate. The interdisciplinary theoretical framework is situated within the Comprehensive Ethnoecology. The identification of the elements, strategies and conditions that foster or impede the potential for self-organization and evolution of socioecological system of artisanal fishing was performed by studying the trajectory of informal rules in the existing artisanal fishing of Itaipu beach (neighborhood in the city of Niteroi, Rio de Janeiro state) over the past 35 years. The Itaipu beach proved to be the locus for the study due to initiatives to implement a Marine Extractive Reserve. Diverse procedures (free depositions, mapping fishing spots, photographic record, amongst others) were used to subsidize the analysis, which were focused on the local ecological knowledge of different fishing arts, fishing areas used, disputes over natural resources, identification and understanding of informal rules, and the imbricated network of meanings in the dynamics of institutions that underlie this activity of collective use and direct their management practices. The data show that the maintenance of this secular activity on the fringes of Niterói metropolitan area is due to the refined local ecological knowledge and the observation of informal rules on the part of fishermen, factors which adapt to social and ecological transformations and should be considered in any management initiative in the area

Full textThis is a study on the contemporary vindicatory justice of the shepherds in the inland Sardinian highlands. The starting point is the classical work by Antonio Pigliaru La vendetta barbaricina come ordinamento giuridico (1959). Despite its indisputable relevance, both as a case study and as recognition and establishment of vendetta in Barbagia as a vindicatory system, this study has had no continuity. Evolutionary and ethnocentric prejudices about vendetta as a prelegal and private justice system persist even in the Sardinian highlands. Only recently has Pigliaru's work been critically reviewed as it deserves in terms of Comparative and Legal Anthropology (Terradas 2008). This thesis aims at checking the present validity of Pigliaru's findings against new ethnographic evidence. Many present vindictive homicides show the persistence of vindicatory customary law. How has this system persisted until nowadays? We may say that Pigliaru, despite historical evidence, didn't give artibration and pacification institutions its due, while he oversized vindictive resolutions. But there is also ethnographic and historical evidence of bloodfeud spreading during the last decades. So the main issue here is the disappearance of composition and reconciliation procedures, demonstrated as universals by ethnography. The basic pillars of this research are: field work on sociability and hospitality in relation to amity and feud regimes, analysis of some court cases on homicides occurred during de 1980s, and the study of Social and Legal Anthropology and History of Sardinia. Its main goal is the verification of persistence of vindicatory customary law in relation to the displacement and reduction of the scope of sociability and community life. Accordingly we ultimately confirm the reduction of the extent of solidarity, reciprocity and hospitality, and, consequently, of the mechanisms to resolve and compose conflicts and offenses. The successful contemporary adaptation to the grazing economy, which has expanded to the detriment of agriculture, required the establishment of a sedentary livestock enterprise and consequently a strengthening of the bond between male brothers. The success of the livestock "business", increasingly based on private property and adapted to the rhythms and forms of the capitalist economy, demands results that have led to this reinforcement, since it is the male brothers who inherit and grow the cattle. A shift would have taken place away from the solidarity of a wider kinship sphere towards an agnatic reduction that relegates women historically the main activators of reciprocity and custodians of hospitality among houses, contracts the broader scope of kinship solidarity and hinders the activation of prevention, composition and reconciliation mechanisms.

Full textEste trabajo desarrolla los fundamentos dogmáticos que se hallan detrás de la consideración de la costumbre indígena, en nuestro derecho y en lo penal, como un antecedente para el reconocimiento de una eximente o atenuante de responsabilidad penal. Y en la aceptación de que este reconocimiento normativo, se hace en aras del respeto del principio de culpabilidad. Por lo anterior, seguimos la tesis de que el fundamento de aquel reconocimiento normativo se fundamenta, en la existencia de un error de prohibición que, probado, determinará la eventual irresponsabilidad o benignidad en el tratamiento punitivo del indígena infractor de ley. A su vez, en materia probatoria, postulamos que la exigencia del art. 54 inc. 1° de la Ley 19.253 en concordancia con el art. 8.2 del Convenio OIT 169, obligan a que la acreditación en juicio de la costumbre indígena que se invoca, implica justificar ésta y su vigencia, su compatibilidad con la Constitución Política de la República y con los derechos fundamentales que establece el sistema jurídico nacional o con los derechos humanos internacionalmente reconocidos; y probar que, el proceder del individuo, se motivó en el influjo socio-jurídico que sobre él provocó la regla de comportamiento existente en la comunidad, de que forma parte

Full textThe thesis analyzes and deepens the history of Italian monetary policies in Somalia in the period between 1905 and 1950 with the aim of demonstrating and explaining the reasons for their failure. The use of the monetary question as an investigation tool allows us to analyze the Italian colonial experience in Somalia from an innovative point of view. Deepening the history of coinage, therefore, allows you to focus attention on different aspects of the Italian colonial project. From the pervasiveness of the administration's power to the difficult relations with local populations, from the clashes with other European powers for the control of the money market to the acts of resistance and boycott of Africans. Monetary history thus becomes a new interpretative paradigm of the history of the failures of Italian colonialism in Somalia.

Full textOver the last few decades in Latin America the struggles of indigenous peoples for the acceptance and recognition of their own cultures have turned to political and legal demands. The role of political allies of these peoples in the emergence of these claims has been decisive.The example of Bolivia is an exemplary case of the struggles of native peoples because of the proportion of the national population belonging to ethnic groups and the rise to power of Evo MORALES. The Political Constitution of the Plurinational State of Bolivia, approved in 2009, values collective and cultural rights and promotes the recognition of indigenous traditions and knowledge, particularly in the application of justice. Nevertheless, the constitutional precepts promulgated in 2009 relating to native indigenous peasant justice are contradicted by the Jurisdictional "Deslinde" Law, promulgated barely a year later. As we will see this has led to an ambivalent and nebulous implementation of the plural justice system.In the absence of debate and negotiation on the new standards of plural justice, we will see how lynchings played a central role in the homogenizing construction of a new institution, operated by the native authorities of indigenous communities, according to their ancestral norms and customs.Ethnological observation in several rural Andean communities has enabled us to qualify this conception as well as to analyze the numerous petitions of indigenous people to the Plurinational Constitutional Court and state judges. The increase in conflicts, but also the impasse that ensues when these legal claims develop, creates a difficult situation for {indigenous and union] community authorities between, on the one hand, community members who destabilize their role as arbitrator and on the other, the state justice that exercises increasing pressure over them

Full textOs problemas sobre o direito de acesso, posse, propriedade, uso e aproveitamento da Terra, constituem matéria de debate actual a nível internacional, com realce para a região da Africa Austral e Moçambique em especial. É uma matéria que preocupa os governos e a população em geral, por a terra ser um bem de grande utilidade sócio-económica e política. Moçambique possui um regime jurídico sobre terra (lei nº-19/97 de 1 de Outubro, seu Regulamento e Anexo Técnico), no entanto, ela é lacunosa e carece de reforma afim de se adaptar à realidade dos problemas que se levantam no âmbito da posse, uso e aproveitamento e dos conflitos emergentes. Alguns factores do surgimento de conflitos no âmbito do processo da posse, uso e aproveitamento da terra resultam no entanto, da perda de confiança dos particulares em relação aos órgãos do aparelho do Estado que lidam com matérias sobre terras, devido a burocracia e a corrupção praticada por alguns funcionários. A terra em Moçambique é propriedade do Estado, o que implica uma maior responsabilidade por parte do governo, na sua gestão. O actual regime jurídico sobre a terra, carece de concertação de alguns aspectos fundamentais do ponto de vista legal. Trata-se da harmonização da legislação pertinente sobre terras. As leis promulgadas sobre a matéria embora defendem a necessidade de gestão da terra que beneficie os seus utilizadores, tal vontade, entretanto, não têm produzido efeitos satisfatórios. É, pois, neste contexto, que a presente tese cujo título é Alguns Aspectos do Regime Jurídico da posse e do Direito de uso e aproveitamento da terra e os conflitos emergentes em Mçambique, pretende contribuir na contínua abordagem sobre a problemática da posse da terra e dos conflitos emergentes. Bem gerida, a terra pode constituir um importante factor de paz, estabilidade sócio-política e de desenvolvimento económico.
