Abstract:
This book is a compilation of twenty essays prepared for the occasion of the XIII Academic Conference of the Constitutional Court of the Republic of Colombia, held in Bogota in January of 2019. Gathering some of the most prominent authors in constitutionalism and legal theory, the chapters critically examine classical debates. These debates concern the role of judicial review in a democracy, the enforcement of socio-economic rights, the doctrine of unconstitutional amendments, the use of international and foreign precedents by national Courts, and the theory of transitional justice. The book opens a dialogue between philosophers and empirical researchers, building bridges between 'Global North' and 'Global South' approaches to constitutionalism. As such, it is an invitation to reengage with the classical debates on constitutionalism whilst also providing fresh insights into the future of this discipline.

Abstract:
In settler societies, tribal self-governance creates a legal distinction between indigeneity (defined by settler governments) and tribal membership (defined by tribes). Many legally indigenous persons are not tribal members, and some tribal members are not legally indigenous. This book considers the membership rules included in the constitutions and membership codes of nearly 750 recognized tribes in Canada, New Zealand, Australia, and the United States. It addresses the first-order question of tribal constitutionalism: who are the members of tribes, and how are they chosen? The question is of practical and theoretical import. A large proportion of indigenous peoples in each state are not enrolled in a recognized tribe, and the majority of indigenous peoples do not live near their tribal territories. The book's empirical study challenges many of the assumptions used to model tribalism in theories of cultural pluralism, especially those that depict tribes as distinctively insular, ascriptive, and territorially-confined. The book shows that while they are descent-based groups, tribes also self-constitute relationally, by enrolling non-descendants in accordance with cultural and social criteria, and by recruiting from other indigenous communities. The book draws on tribal law and practice, political theory, legal doctrine, policy, and demographic data to critically assess the strategies used by tribes and states to manage the jurisdictional and ideological challenges of tribal membership governance.

Abstract:
This chapter shows that, in the absence of bureaucratic institutions, courts were the primary institutions by which central political authorities could enforce law and policy in localities. The courts, in turn, were local institutions under local control in every colony except, perhaps, Pennsylvania. In many colonies juries that determined both law and fact used their power to nullify legislation and other commands of central government. In other colonies, county courts were self-perpetuating bodies whose judges felt free to ignore the commands of appellate courts and other central authorities. Other colonies were so small that power was necessarily local in nature. Pennsylvania was the only large colony in which the Supreme Court controlled the work of lower courts, but its authority was also under challenge.

Rainer Forst is a leading German political philosopher and was named ‘the most important political philosopher of his generation’ upon his 2012 receipt of the Leibniz Prize. This book brings together discussion from political philosophy, constitutional theory, and legal philosophy to examine Forst’s theory of justice, paying special attention to the application of his moral theory to legal fields. Forst then responds to his interlocutors in a concluding chapter. The book is structured from the general to the specific, and begins by examining the philosophical fundaments of Forst’s ‘right to justification’ as the basis for justice. This right is in the second section transferred to the realm of constitutional theory, exploring the implications the right to justification has for conceptualizing legal discourses in a constitutional democracy. The concluding section sees Forst respond to the foregoing chapters.
