Rather than repudiating the proposition that the people is the bearer of constituent power, Chapter 4 moves beyond it in five ways: (1) by recuperating a commonsensical understanding of the moment of its exercise; (2) by redeeming the neglected dimensions of the concept of constituent power; (3) by distinguishing between two visions of ‘constituting’: constituting as founding, and constituting as taking part in ‘making-with stand’; (4) by reimagining constituent power as the configuration of three, more specific, types of constitutive powers: the enterprising enthusiasm, the forming force, and the capacity for responsiveness; and finally by (5) by raising the profile of the figures of hope and purpose: two intimately related forward-looking expectant mental states that give power to constitutive power.

Abstract:
This chapter illuminates the role that sources doctrine plays in construing international law as a system. It frames international law’s systemic qualities within the recursive relationship between sources doctrine and debates over international law’s systematicity. Sources doctrine reinforces and buttresses international law’s claim to constitute a legal system; and the legal system demands and requires that legal sources exist within it. International law’s systematicity and the doctrine of international legal sources exist in a mutually constitutive relationship, and cannot exist without one another. This recursive relationship privileges unity, coherence, and the existence of a unifying inner logic which transcends mere interstate relations and constitutes a legal structure. In this respect, the social practices of those officials who are part of the institutional workings of the system, and especially those with a law-applying function, are of heightened relevance in conceiving of international law as a system.

Abstract:
In Chapter 8, I discuss how I came to the question of constitutive exclusion in the aftermath of the US invasion of Iraq in 2003. Drawing on both Afro-pessimist and Latina feminist thought, I outline a pluralist political ontology as a response to the political ontologies presumed by and reinscribed through constitutive exclusion. Reconstitution, rather than mere inclusion, would be necessary to respond adequately to constitutive exclusion. And I argue for a recognition of our selves as multiple and constituted by each other—a possibility implicit in the critical account of the book, and explicitly developed in practice by #BlackLivesMatter and allied activist organizations.
