In contemporary medicine, the traditional paternalistic model of healthcare has largely been replaced with a model which focuses on patient autonomy and the right of patients to have as much control as possible over decisions relating to their medical care. In English law, this has led to the concept of informed consent and the right of patients to withdraw their consent at any time, even if they have previously given consent or signed a consent form.

Abstract:
This chapter deals with the dependent variable of the study: consent. It analyses workplace consent in Russia and China using three indicators that refer to the core requirements of the production systems in automotive companies regarding employee behavior: first, standardized work; and second, compliance with expectations in terms of flexibility, cooperation, and a commitment to improving processes. The third indicator of consent (or the lack of it) is the absence or presence of open criticism, resistance, and labor disputes. The chapter reveals significant and unexpected differences between the Chinese and Russian sites on all three indicators. While the Chinese factories exhibit (with some variance between the companies), a relatively high level of consent, the Russian plants have problems with standardized work, the acceptance of performance expectations, and to some extent with labor disputes.

Consent is threadbare for sexual-justice politics, argues author Joseph Fischel. Spotlighting sex on the periphery, Screw Consent takes aim at the sex imagined at the center of our moral universe: adult, consensual. Each chapter turns another “screw” on consent, interrogating sex that is unfamiliar, atypical, or weird. Consent, shows Fischel, is alternatively insufficient, inapposite, or riddled with scope contradictions. It therefore cannot scaffold a democratically hedonic sexual culture. Access and autonomy, the author suggests, are more promising idioms for our sexual politics.

Abstract:
The British state in the long eighteenth century created an effective fiscal–military state based on an efficient tax system that allowed borrowing without the default that afflicted France. The result was success in wars with France and the expansion of the empire. After the victory at Waterloo in 1815, consent was lost as a result of the high level of debt service which fell on producers within an unreformed political system. This chapter explains how consent was re-established by the use of a political language of neutrality and equity between classes, and by the design of parliamentary and administrative controls over spending. The fiscal state secured a high level of legitimacy and consent that prepared the ground for an expansion of public spending on welfare and warfare in the early twentieth century.

It provides an overview of the common law basis of the Mental Capacity Act 2005, followed by discussion of issues relating to information disclosure, public policy, and the key case of Montgomery. It considers the statutory provisions for adults who lack capacity, exceptions to the requirement to treat patients who lack capacity in their best interests, and consent involving children under the Children Act 1989. Gillick competence, a concept applied to determine whether a child may give consent, is also explained. Relevant court cases, including Gillick, which gave rise to the concept, are cited where appropriate.
