Abstract:
Just as the Colombian president has historically been very strong, the Colombian Congress has historically played a relatively minor role in the conduct of national policy. The 1991 Constituent Assembly sought to rationalize congressional behavior and give it a more substantial role. However, problems of legislative corruption and dysfunctionality have persisted. This chapter reviews the Court’s attempts to police the scope of congressional inviolability, limit congressional delegation to the executive, and incentivize and ensure adequate legislative deliberation in the lawmaking process. This jurisprudence has sought to alter legislative behavior and ensure that laws are a product of adequate social deliberation, thus improving the role of the Colombian Congress in public life.

Abstract:
While early works in American political development (APD) incorporated congressional actors in accounts of state-building, policymaking, and social reform, there is a growing body of historically oriented scholarship that places the institution of Congress front and center. We highlight three major streams of contemporary congressional research that engage with APD. The first analyzes the development of congressional institutions, often drawing upon concepts of path dependence and layering to understand the presence or absence of change in legislative operations. Second, several important studies of state-building and policy development highlight the role of congressional actors in driving—or blocking—critical political and social reforms. Finally, new datasets that track congressional elections and roll call voting over long time spans have given rise to a growing literature that uses historical evidence to test contemporary theories of legislative behavior. We close with a discussion of the contributions and pitfalls of using historical evidence in this way.

Boyd, Christina L., Michael J. Nelson, Ian Ostrander, and Ethan D. Boldt. The Politics of Federal Prosecution. Oxford University Press, 2021. http://dx.doi.org/10.1093/oso/9780197554685.001.0001.

Full text
Abstract:
Federal prosecutors have immense power and discretion to decide when to bring criminal charges, what plea bargains to offer, and how to implement the federal government’s legal priorities in their districts. While U.S. Attorneys take pains to emphasize their independence, we know relatively little about the extent to which politics colors federal prosecutorial staffing and decision-making. The Politics of Federal Prosecution draws upon a wealth of data from 1990s to the present to examine the interplay of political factors and federal prosecution. First, the authors find that congressional and presidential politics affect who becomes federal prosecutors and how long those individuals serve. Second, the book demonstrates that signals of presidential and congressional preferences, along with local priorities, affect key prosecutorial decisions: whether to bring prosecutions, how to approach plea bargaining negotiations, and when to utilize criminal asset forfeiture to cripple criminal activities. In short, the book demonstrates that politics affects the behavior of U.S. Attorneys at nearly every stage of their service.

Abstract:
This chapter argues that to accurately gauge the impact of political parties on elections, it is necessary to look beyond traditional party committees and consider these organizations’ impact on the thousands of other groups that participate in the financing of campaigns. Using social network analysis and federal campaign finance data, the chapter demonstrates the existence of two distinctive hierarchical extended party networks, each comprising formal party organizations, campaign committees associated with members of Congress and congressional candidates, and PACs allied with one party. It also provides evidence suggesting party organizations’ influence over hundreds of millions of dollars in contributions and expenditures that flow within their networks. The chapter’s results have implications for party and interest group development and behavior, as well as legislative and electoral politics.

Abstract:
For almost thirty years, political scientists have believed that the US Senate would be less affected by partisan polarization due to the existence of a handful of moderate senators who would act as power brokers between the two sides, yet year after year we see partisan gridlock. Life in the Middle argues that the belief in the powerful, pivotal moderate neglects their electoral circumstances and overestimates their legislative power. Indeed, not all senators are elected under equal circumstances where the modern centrist has to balance between two conflicting constituencies like Susan Collins in Maine, or represents a state where the opposition outnumbers their base like Joe Manchin in West Virginia. Using data compiled from the Congressional Record, the book examines the legislative behavior of moderates and finds that they seldom amend legislation to their preferences, rarely speak on the record, and often lose on final votes. Using unique interview data with nineteen legislative directors and six retired centrist senators, it also finds that the behind-the-scenes conversations mirror the on-stage behavior where centrists are not influential or viewed as pivotal by party leaders. Furthermore, moderates reported less satisfaction with legislative outcomes than their peers. Life in the Middle suggests that lawmaking needs to be re-evaluated as being much more variable and less reliant on the work of moderates and more on party leaders. Indeed, the mainstream concerns about polarization and its negative effects of increased gridlock and ideological legislation may be true.

Wineinger, Catherine N. Gendering the GOP. Oxford University Press, 2022. http://dx.doi.org/10.1093/oso/9780197556542.001.0001.

Abstract:
This book, one of the first to focus exclusively on the experiences of Republican congresswomen, uncovers some of the gendered implications of congressional polarization. Looking beyond legislative behavior, Gendering the GOP: Intraparty Politics and Republican Women’s Representation in Congress reveals changes over time in the way Republican congresswomen (1) claim to represent women and (2) work together to advance their own interests within the party. Through extensive interviews with women members of Congress and in-depth analyses of House floor speeches, the book details how women have both navigated and shaped existing gender dynamics within the House GOP conference. It demonstrates that Republican women in Congress are not merely gender-blind partisans. Rather, it complicates traditional understandings of the relationship between descriptive and substantive representation, showing how polarization and party competition have incentivized Republican women to organize around their partisan-gender identity—distinguishing themselves from both Democratic women and Republican men. Doing so has increased their visibility as party messengers, while simultaneously limiting their legislative power in the institution. This book shines light on the ongoing challenges Republican women face, the intricate gender dynamics they must learn to navigate in their party, and potential opportunities for change.
