Abstract:
O artigo constitui-se de revisão teórica e reflexão sobre o conceito de conflito e seu significado na realidade atual, em especial na educação, apontando possibilidades de experiências com o mesmo na realidade escolar. O objetivo é compreender o significado dos conflitos sociais, de modo a subsidiar as discussões sobre o tema, assim como estimular a crítica de concepções tradicionais. A base teórica principal do texto é a dialética, entendendo essa teoria como fundamento essencial para pensar as relações sociais em que se configuram as diferentes formas de conflito nos dias de hoje. O texto parte das características básicas do conceito de conflito, onde, destacando as teorias de Durkheim e de Marx, menciona as ideias as quais têm sido associado na prática social. Depois enfoca as relações entre conflito e consenso, priorizando o debate sobre a teoria da solidariedade durkheiminiana. Conclui com uma discussão inicial sobre o conflito na escola na perspectiva da mediação, em que realça a problemática da compreensão das relações sociais de conflito para a construção das práticas educativas.Palavras-chave: Conflito e Educação. Mediação de Conflitos.Revisiting the conflict to think about the educative practiceAbstractThe article is made of a theoretical review and a reflexion about the concept of conflict and its meaning in reality nowadays, mainly in education, pointing possibilities of experience with it on schools. The main theoretical base of the text is the dialectic, understanding that this theory as an essential foundation to think about the social relationships in which the different forms of conflict are configured nowadays. Abstract:
El objetivo de este trabajo es conocer y analizar los tipos de conflictos entre el profesorado de un Instituto de Enseñanza Secundaria (IES) en la Región de Murcia. Los instrumentos utilizados han seguido una doble metodología. Por una parte, una metodología cuantitativa con aplicación de la técnica de la encuesta y, por otra parte, con una metodología cualitativa en aplicación de las técnicas de grupo de discusión y entrevistas semiestructuradas. Los participantes fueron 35 docentes seleccionados sobre una población total de 92. Los resultados indican que los tipos de conflictos principales son: discrepancias y desacuerdos entre estos y el equipo directivo y la administración. Al mismo tiempo, otro de los tipos de conflictos que se generan es la distribución de horarios y las franjas horarias en las que el profesorado desea impartir las asignaturas. Igualmente, se destacó que el profesorado percibe el conflicto de manera distinta en función de la edad, así pues, el profesorado con edades comprendidas entre los 36 y 45 años prefiere evitar el conflicto, frente al grupo del profesorado de mayor edad que percibe el conflicto como “lucha para vencer”. Sin embargo, el grupo de profesorado más joven y el grupo con mayor experiencia docente, lo percibe como oportunidad de cambio, desde el punto de vista positivo. El sexo femenino ante el conflicto, prefiere bien, ceder o ignorar a la otra parte. Siendo la principales causas de los conflictos: ideológicas, comunicación deficiente, insatisfacción laboral o diferencia de funciones. The objective of this work is to know and analyze the types of conflicts between the teaching staff of a Secondary Education Institute (IES) in the Region of Murcia. The instruments used have followed a double methodology. On the one hand, a quantitative methodology with application of the technique of the survey and, on the other hand, with a qualitative methodology in application of the techniques of discussion group and semi-structured interviews. The participants were 35 selected teachers out of a total population of 92. The results indicate that the main types of conflicts are: discrepancies and disagreements between them and the management team and the administration. At the same time, another of the types of conflicts that are generated is the distribution of schedules and the time slots in which the teaching staff wishes to teach the subjects. Likewise, it was highlighted that teachers perceive the conflict differently depending on their age, therefore, teachers aged between 36 and 45 prefer to avoid conflict, compared to the group of older teachers who perceive the conflict as "fight to win". However, the group of younger teachers and the group with the most teaching experience perceive it as an opportunity for change, from a positive point of view. The female sex in the face of conflict, prefers well, yield or ignore the other party. Being the main causes of conflicts: ideological, poor communication, job dissatisfaction or difference of functions. KEY WORDS: Secondary education, conflicts, teachers, job dissatisfaction.

This article revisits conflicts and the evolution of relationships between Turkey, Syria and Iraq, integrating the role of the Kurds in conflict over water resources, and addresses the causal role water played in the establishment of hydro-hegemonies amongst these riparian countries. The argument developed in this article is that water by itself, even though it is an ingredient of conflict and war, is not the only objective of water rivalries (or processes of cooperation) between co-riparian countries. More often, hydro-hegemonic relations form around this vital resource. Water is not the only cause of hydro-conflicts and even though it is part of basin conflicts, it contributes to a complex system of power relations between States and other actors involved in affairs that affect it. Spanish Tomando como referencia el conflicto entre Turquía, Siria e Iraq e integrando el papel de los kurdos en los conflictos por el agua, el objetivo principal de este artículo es determinar ¿qué indica la evolución de las relaciones entre Turquía, Siria e Iraq y los kurdos en cuanto al papel del agua como causal de conflicto en el establecimiento de hidrohegemonías entre países ribereños? Principalmente se encuentra que el agua per se, pese a ser ingrediente de conflictos y guerras, no es siempre el único objetivo de la rivalidad entre estados corribereños en torno del agua (como no lo es tampoco en los procesos de cooperación). Lo que sí ocurre con mayor frecuencia es el establecimiento de relaciones hegemónicas en torno del líquido vital. Es decir, el agua no es la única causa de los conflictos hídricos y, aunque es parte de los conflictos en las cuencas, entra a formar parte de un sistema complejo de relaciones de poder entre los Estados y otros actores involucrados en los asuntos que las afectan. French Cet article fait le point sur le conflit entre la Turquie, la Syrie et l'Irak, en intégrant le rôle des Kurdes dans les conflits pour l'eau, et tente de répondre à la question : qu'indique l'évolution des relations entre la Turquie, la Syrie et l'Irak relativement au rôle de l'eau comme causalité de conflit dans l'établissement d'hydrohégémonies entre pays riverains ? L'argument développé est que l'eau en soi, même si elle est ingrédient de conflits et de guerres, n'est pas toujours l'unique objet de la rivalité entre États riverains en matière d'eau (comme elle ne l'est pas non plus dans les processus de coopération). Ce qui se produit plus fréquemment est l'établissement de relations hégémoniques autour du liquide vital. L'eau n'est pas l'unique cause des conflits hydriques et, même si elle fait partie des conflits dans les bassins, elle participe d'un système complexe de relations de pouvoir entre les États et d'autres acteurs impliqués dans les sujets qui les affectent.

The frequent use of destructive strategies in everyday conflicts is associated with a growing unease in the family and a discontinuity in the family project. Couples show difficulties to implement courses of action culminating in agreements and commitments. This is a logical issue considering that the conflicts and the resolution strategies are complex situations. This work provides an analysis of daily conflict in couples contemplating conflict variables that mediate the use of resolution strategies and transactional processes that characterize these episodes. Finally, some guidelines are suggested to direct research and intervention in the field of conflict and family life.Keywords: Marital Conflict; Conflict Resolution Strategies; Negotiation; Situational Variables; Emotional Variables; Cognitive Variables.Resumen.Los conflictos son situaciones normales en la vida familiar. El empleo frecuente de estrategias destructivas en los conflictos cotidianos se asocia a un creciente malestar en la familia poniendo en peligro la continuidad del proyecto familiar. Las parejas muestran dificultades para poner en marcha cursos de acción que culminen en acuerdos y compromisos. Lo que resulta comprensible si consideramos que los conflictos y las estrategias de resolución son situaciones complejas. Este trabajo ofrece un análisis del conflicto cotidiano en la pareja los conflictos contemplando las variables que mediatizan el uso de las estrategias de resolución y los procesos transaccionales que caracterizan estos episodios. Abstract:
The Uppsala Conflict Data Program’s (UCDP) Peace Agreement Dataset was first published in 2006. Its main goal was to provide the research community with a dataset on peace agreements that was not linked to conflict termination, i. e. included both successful and failed agreements. The latest update of the dataset includes 355 peace agreements concluded in the 1975–2018 period. A number of studies have been based on the dataset over the years. The dataset is unique in its strict connection to the UCDP conflict data and in its focus on the conflict dyad, actors, and the conflict incompatibility. The dataset’s focus on only those agreements that involve the dyadic relationship between primary warring parties – between governments and rebel groups or between two governments – has direct policy implications, as it is exactly these parties who need to change their stances on incompatibilities in order to solve a conflict. Also, the Peace Agreement Dataset’s focus on agreements that address the key incompatibilities contested by the parties allow it to distinguish peace agreements on other negotiated deals, including ceasefires, and to differentiate between full, partial and peace process agreements. Finally, the analysis of key trends in peace agreements is presented. It shows that in contrast to the previous historical peak in the number of armed conflicts back in the early 1990s that corresponded to the peak in annual numbers of peace agreements, the new peak in annual numbers of armed conflicts in the late 2010s was not matched by a similar rise in peace agreements.

Aun cuando no se aprecian rasgos que permitan plantear el presente teórico del Reconocimiento como una teoría del conflicto, se percibe en la noción una herramienta valiosa para su crítica. Lo central del análisis estaría dado en el cómo se estructuran psicosocialmente las posturas de los individuos afectados por esta forma de injusticia. The article address the concept of recognition -and the concept of neglect- in the analysis of the socioenvironmental conflict related to public landfills in Araucanía, Chile. Even though we do not identify traits that allow us to understand the present theory of Recognition as a theory of conflict, we still see in the notion of recognition a valuable tool for understanding social conflicts. The central analysis would be focused on the psychosocial structuration of the position of those affected by this form of injustice.

Abstract:Pharmaceutical representatives use detailing, gift giving, and the donation of free samples as a means to gain access to and influence over physicians. In biomedical ethics, there has been an ongoing debate as to whether these practices constitute an unethical conflict of interest (COI) on the part of the physician. Underlying this debate are the following antecedent questions: (1) what counts as a conflict of interest, (2) when are such conflicts unethical, and (3) how should the ethical physician respond to conflicts? This article distinguishes between two perspectives that have been developed on these issues: a reliable performance model (PM) and a trustworthiness model (TM). PM advocates argue that a conflict of interest can only be established by demonstrating that a particular influence is undermining the reliability of the physician’s judgment, and this requires empirical evidence of negative patient outcomes. TM advocates, on the other hand, argue that because of the fiduciary nature of the patient-physician relationship, physicians have an obligation to develop and be worthy of patient trust. A COI, on this view, is a condition that undermines the warrant for patients to judge a physician as trustworthy. Although there is much that is right in the PM, it is argued that the TM does a better job of responsibly addressing the unique vulnerabilities of the patient. The TM is then applied to the practices of detailing, gift giving, and sample donation. It is concluded that these practices constitute an unethical conflict of interest.

Crop farmers and cattle herders' conflict have remained the most prevailing resource-use conflict in Girei Local Government Area of Adamawa State. Social and economic factors confined to inflame violent conflicts. The competition between these two Agricultural land user-groups threats the means of survival in the study area. The study describes the socioeconomic characteristics of farmers and herders and determines the causes of conflict in the study area. Primary data collected using structured questionnaire were subjected to simple percentages and chi-square analysis. The study revealed that the major causes of conflict in the study area are the crop damage by cattle, and lawlessness in the society. The findings also revealed that loss of expected yield, loss of cattle and loss of human lives and properties are the major effects of conflict. The study also concludes that the conflicts sometimes spread and lead to ethnic clashes and armed robbery. Therefore, it is in the interest of the state to address the genuine needs of herders and crop farmers since these two provides employment for almost all the rural people. In order to put an end to this conflict, it is therefore recommended that strange faces identified should be reported and leaders should preach the implications of conflict in the society. Le conflit entre les agriculteurs et les éleveurs de bétail pose un grand problème qui est le plus répandu dans la région du gouvernement local de Girei, dans l'État d'Adamawa. Les facteurs sociaux et économiques servent à enflammer des conflits violents. La concurrence entre ces deux groupes d'usagers des terres agricoles menace les moyens de survie dans la zone d'étude. L'étude décrit les caractéristiques socio-économiques des agriculteurs et des éleveurs et détermine les causes des conflits dans la zone d'étude. Les données primaires collectées à l'aide d'un questionnaire structuré ont été soumises à des pourcentages simples et à une analyse du chi carré. L'étude a révélé que les principales causes de conflit dans la zone d'étude sont les dommages causés aux cultures par le bétail et l'anarchie dans la société. Les résultats ont également révélé que la perte de rendement, la perte de bétail et lacperte de vies humaines et de propriétés sont les principaux effets du conflit. L'étude conclutcégalement que les conflits se propagent parfois et conduisent à des affrontements ethniquescet des vols à main armée. Il est donc dans l'intérêt de l'État de répondre aux besoins réels descéleveurs et des agriculteurs, car ces deux moyens fournissent des emplois à presque tous lescruraux. Afin de mettre un terme à ce conflit, il est donc recommandé de signaler les visagescétranges identifiés et les dirigeants devraient sensibiliser aux implications des conflits danscla société.

Este artículo presenta el estado de la cuestión sobre la prevención y resolución de conflictos desde el Área de Educación Física tomando como referencia las principales aportaciones de la comunidad científica internacional. El análisis se ha realizado mediante la explotación de las principales bases de datos, tanto nacionales como internacionales, a saber, ISOC, TESEO, ISI y ERIC, con el objetivo de acceder a las publicaciones que permiten identificar los tipos de conflictos más frecuentes que se dan en el área de educación física, las diferentes estrategias que se adoptan para abordarlos, así como, los modelos que se pueden establecer a partir de las diferentes formas de aproximarse al conflicto. La investigación que ha generado este estado de la cuestión, se centra en la necesidad de abordar, desde la educación física, formas para la prevención y resolución de la conflictividad en los centros escolares cuyo incremento es hoy en día una realidad. Palabras clave: educación física, prevención del conflicto y resolución del conflicto, estado de la cuestión.Abstract: This review paper offers the current international scientific status of the prevention and conflict resolution issue in physical education. Purpose This paper aims to add to the current knowledge about conflict management by examining the relationships between conflict type, conflict expression intensity and the use of the conflict management approach. Design/methodology/approach The authors test theory-based hypotheses using a field study of new product development teams in an interdisciplinary Masters program (Study 1) and an experimental vignette study (Study 2). Findings Results show that people are more likely to respond to task conflict and conflicts expressed with less intensity using collectivistic conflict management approaches (i.e. problem-solving, compromising and yielding), and to relationship conflicts and conflicts expressed with higher intensity through forcing, an individualistic conflict management approach. Information acquisition and negative emotions experienced by team members mediate these relationships. Practical implications Knowing how the characteristics of the conflict (type and expression intensity) affect conflict management, managers can counteract the tendency to use dysfunctional, forcing conflict management approaches in response to high intensity conflicts, as well as to relationship conflicts and support the tendency to use collectivistic conflict management approaches in response to low intensity conflict, as well as task conflicts. Originality/value The authors examine an alternative to the prevailing view that conflict management serves as a moderator of the relationship between conflict and team outcomes. The research shows that conflict type and intensity of conflict expression influence the conflict management approach as a result of the information and emotion they evoke. The authors open avenues for future research on the complex and intriguing relationships between conflict characteristics and the conflict management approach.

Constructive conflict resolution programmes are based on the idea that children and youth do no have sufficient knowledge of the procedures and skills for conflict resolution, which is why the conflicts they take part in soon become destructive. Notwithstanding the indubitable practical significance of the constructive conflict resolution programmes, it can be objected that they are not sufficiently based on empirical findings about the characteristics of conflicts in childhood and adolescence. Hence, this paper explores different types of conflict with peers and friends with the aim of determining the preferred conflict resolution strategies and using the obtained results to consider the implications for the improvement of constructive conflict resolution programmes. The research was conducted on the sample of 286 adolescents. The method of hypothetical conflict situations was used for studying the preferred conflict resolution strategies. The key results, which should be taken into account when developing constructive conflict resolution programmes, indicate that the preference for a conflict resolution strategy varies depending on conflict type (problem solving is mostly used in conflicts occurring due to opinion differences and disrespect of agreement, unlike the conflicts arising due to provocations, stubbornness and dishonesty) and relationship types (in conflicts with friends, adolescents prefer problem solving, while in peer conflicts they more frequently opt for competition).

Juang was taken prisoner. The social conflicts contained in this study are derived from the social relations between the characters in the novel.

The ability to communicate without conflicts is quite highly regarded, and conflicting people always and everywhere cause negative impressions. As Descartes taught, before you talk about anything, you need to agree on terms. If we talk about interpersonal conflicts, it should be noted that conflicts grow out of contradictions and opposites, but they cannot be equated. The conflict situation is a pre-conflict phase. Conflicts are more terrible and more harmful than contradictions and conflict situations, as there is already a mutual infringement of the dignity of the parties to a conflict. Conflicts are always problems, tragedies, tears; it is an “evil foreign body” that interferes with healthy communication. That’s why conflicts must be fought, that is why conflicts must be prevented. Conflicts, like diseases, are easier to prevent than to cure and resolve later. Given the foregoing, the problem of finding the most effective technologies for preventing interpersonal conflicts, conflict situations, and contradictions, as they say, means a lot, especially as it concerns conflicts in business and social organizations.

Purpose The purpose of this research is to investigate the effects of inter-organizational conflicts on the project added value in the Chinese construction industry, and also to examine the mediating effect of conflicts on project added value and the moderating effect of conflict management strategies. Design/methodology/approach A conceptual model was developed, and a structured questionnaire survey was conducted with 667 professionals. The structural equation modeling technique was used to analyze the data. Findings The results showed that task conflict, relationship conflict and process conflict were influenced by subject characteristics of project participants, bilateral relationship characteristics and project characteristics. Similarly, these three types of conflicts interact with each other. Meanwhile, these three types of conflicts influence the added value in construction projects, which are moderated by conflict management strategies. Under a collaborating strategy, task conflict and process conflict were positively associated with project added value, and relationship conflict was negatively associated with project added value. Under a competing strategy, task conflict, process conflict and relationship conflict were negatively associated with added value in construction projects. Therefore, the constructive and destructive effects of conflicts on project added value under different conflict management strategies are verified in Chinese construction projects. Research limitations/implications The variables may not be exhaustive for construction projects and most of them were applied in construction projects for the first time. As a result, their rationality and effectiveness could be further improved. The results implied that inter-organizational conflicts had a constructive effect on project added value and should attract broad attention for future research. Additionally, different driving factors had different influences on these conflicts, and even the driving factors can be divided into different dimensions. Practical implications This study provides a better understanding of the relationship between inter-organizational conflicts and added value in construction projects, and a reliable reference for the project manager to effectively deal with these conflicts. In addition, this research reveals the effects of conflicts on project added value and the path of conflicts transformation. This provides a useful reference for project managers to take advantage of the positive effect of task conflict and process conflict, and to avoid the negative effect of relationship conflict. Originality/value Very few studies attempted to examine the effects of inter-organizational conflicts on project added value in construction projects. Therefore, this research makes significant theoretical and practical contributions to the existing body of knowledge on the conflict management and project added value. This research provides an empirical evidence to support the viewpoint that different types of conflicts can be mutually transformed. Similarly, this study explains how conflicts present functional and dysfunctional effects in construction projects. Both of them are potential theoretical contributions to the existing body of knowledge.

Purpose This paper aims to identify and explore the overall frequency and characteristics of policy conflicts, with a focus upon those factors affecting conflict resolutions in South Korea. Design/methodology/approach The study uses data from cases of conflict from the Korean Public Policy Conflict Database (KPPCDB) (1948-2014). For the analysis of data, chi-squared test and multinomial logistic regression are used. Findings The findings show a total of 2,030 policy conflicts in 1948-2014, most of which were conflicts of interest (47.9 per cent). More than 70 per cent (71.2 per cent) were policy conflicts between the government and the private sector; the field with the most policy conflicts was regional development (21.0 per cent), and 84.1 per cent of all policy conflicts were resolved. The factors that affected conflict resolution by interest were conflicts between the government and private sector, authoritarian government, national regions and capital areas. Practical implications This paper suggests reforming the current procedures of conflict management, adopting alternative dispute resolutions, and developing a social-consensus-building process for efficiently resolving conflicts. Originality/value This study built a database (KPPCDB) examining 66 years of conflict cases that took place between 1948, the year the Korean Government was established, and 2014. This database covers all cases of policy conflicts that occurred in Korea and provides a comprehensive understanding of the phenomena of policy conflicts and conflict resolution.

Conflict is a major aspect of family businesses, which differs highly from non-family businesses, and offers an important research avenue for conflict management scholars to contribute to the investigation of major characteristics of organisations that constitute a large part of the value created in the world.FindingsThe results of a bibliometric analysis and systematic literature review show that studies concerning conflict in family business aggregate around three clusters: organisational conflicts; firm growth and conflicts; and family control, performance and conflicts. An interpretative framework is also developed to interpret how antecedents, conflicts and growth dynamics in family business influence performances. Findings show how family conflicts and work–family balance issues received a lot of attention, yet studies in conflict management still seem to miss a thorough investigation of conflict in family businesses.Originality/valueThis paper contributes to the field of conflict management and family business by providing a systematic analysis of knowledge and family firms. The study of the roles of men and women during violent conflicts and postconflict situations has traditionally restricted the experiences of women to those of victims, and those of men to violent perpetrators. This paper adopts a feminist constructivist approach to explore how traditional gender discourses have sustained the victimisation of women and the association of violence with men in the roles of aggressors and protectors. Throughout the case study of the Rwandan genocide, this research illustrates gender stereotypes tend to ignore on the one hand the role of women as violent perpetrators, and on the other hand, the victim status of men during conflicts. This study attempts to show experiences of Rwandan women were not limited to those of victims, but they planned and participated in genocidal violence and abuses. Additionally, and also contrary to traditional gender discourses, Rwandan men compromised the first targets of violence during the conflict. This thesis concludes that a broader and deeper understanding of conflict studies and ultimately world politics can be acquired by challenging traditional gender discourses, and investigating and recognizing the multifaceted experiences of women and men in conflict and post-conflict situations.Keywords: victimisation, violence, masculinity, femininity, “beautiful souls”, “just warriors”, passivity, agency.Resumen. A lo largo del estudio de caso del genocidio de Ruanda, esta investigación ilustra que en situaciones de conflicto los estereotipos de género tienden a ignorar, por una parte, el papel de las mujeres como perpetradoras violentas y, por otra parte, el estatus de víctima de los hombres. Este estudio intenta mostrar que las experiencias de las mujeres ruandesas no se limitaron únicamente a las de las víctimas, sino que planificaron y participaron de manera active en la violencia y abusos genocidas. Main points of conflict theory are summarized. Multiple dimensions of social resources each generate potential conflicts between haves and have-nots. Potential interests become effective to the degree that they are mobilized, relative to the mobilization of opposing interests; such mobilization depends upon both (1) conditions of ritual solidarity within a conflict group and (2) material resources for organizing. Each round of overt conflict sets the stage for the next round, both materially and by swaying the balance of perceived responsibility for past atrocities. Any particular conflict eventually deescalates, either because material resources for mobilization are used up or by the ritual disassembling of conflict groups. Mild conflicts continue longer than intense conflicts. Deescalation of mild conflicts typically occurs through bureaucratic institutionalization of concessions to interest groups; bureaucratic niches in turn become resource bases for future conflicts. These principles are applied to analyze the patterns of conflict in the United States in the late twentieth century and to predict future patterns of conflict.

To improve college students’ skills in resolving workplace conflict, the authors studied the types of workplace conflicts that students encounter with peers or supervisors in part-time or seasonal work and with whom they discuss these conflicts. The authors found that most students report conflicts that are process or relational in nature, with few students reporting task-oriented conflict. Nearly all students report discussing the conflict with third parties—individuals outside the organization and/or the conflict—and nearly all students find these discussions helpful in resolving or working through the conflict. Based on their literature review and research, the authors developed scenarios to help students “read” and resolve workplace conflicts. The scenarios use conversations with people outside the conflict—third-party discussions—to help students respond appropriately to the conflict.

Land use conflicts are intensifying due to the rapid urbanization and accelerated transformation of social and economic development. Accurate identification of land use conflicts is an important prerequisite for resolving land use conflicts and optimizing the spatial pattern of land use. Previous studies on land use conflict using multi-objective evaluation methods mainly focused on the suitability or competitiveness of land use, ignoring land resource scarcity and the diversity of human needs, hence reducing the accuracy of land use conflict identification. This paper proposes a new framework for land use conflict identification. Considering land use multi-suitability, land resource scarcity and the diversity of human needs, the corresponding evaluation index system was constructed, respectively, and the linear weighted sum model was used to calculate the land use conflict index. Taking Jinan as the study area, the spatial distribution characteristics of land use conflicts are accurately identified and analyzed. The results show that: (1) Land use multi-suitability in Shanghe county and Jiyang district is high, but the intensity of land use conflict is not. This indicates that land use multi-suitability is the premise and basis of land use conflict, but it is not the only determinant, which is consistent with our hypothesis. (2) Land use conflicts in Jinan were dominant by medium conflict, accounting for 43.89% of the conflicts, while strong and weak land use conflicts accounted for 25.21% and 30.90% of the conflicts, respectively. The spatial distribution of land use conflicts is obviously different, with high conflicts in the north and low conflicts in the south. Strong land use conflicts are concentrated in the urban and rural transition zones of Tianqiao, Huaiyin and Shizhong districts and in the northern parts of Licheng and Zhangqiu districts. (3) Inefficient land use and land resource waste aggravated regional land use conflicts in Licheng and Zhangqiu districts. (4) The new framework for land use conflict identification proposed in this study can accurately identify land use conflicts, providing a scientific reference and new ideas for accurate identification of land use conflicts.

Such phenomena slow down and unbalance their development, as well as cause the liquidation of enterprises. This is a natural process. Therefore, it is important to learn how to manage them. Opposites and contradictions are inevitable in the enterprises activities of the service sector, as they are based on the communicative level. The aim of the article is to determine conflict management technologies in hotel and restaurant business using conflict theories. Research methods. The study used general scientific methods: induction and deduction – to generalize opinions on conflict theories, technologies and conflict management in hotel and restaurant business; abstraction, theoretical analysis and synthesis – in determining approaches to conflict management strategy in hotel and restaurant business; comparison – in highlighting the causes of conflicts; generalization – for the construction of conflict management technology in hotel and restaurant business, the algorithm for working with conflicts in hotel and restaurant business; inference – in building the basic patterns of reaction to resistance, the rules of successful conflict management in hotel and restaurant business. Research results. Conflict theories are identified and their evolution is shown. It is established that conflict management is an inevitable process, and stems from the service sector peculiarities. It is noted that conflict management technologies should include development strategy, strategic aims, conflict management strategies, problems of conflicts appearance, patterns of response to resistance, conflict management models. Rules for successful implementation of conflict management technologies are elaborated as well. Conclusions and discussions. It is determined that hotel and restaurant business is changing, that conflicts and contradictions are inevitable. They are exacerbated by COVID-19. An algorithm for dealing with conflicts in hotel and restaurant business are elaborated. It contains 5 steps: listening, concretization, compassion, variability, gratitude for feedback. Marker words that should be used in resolving conflicts are suggested.

Purpose This paper aims to explain how contractual complexity, including contractual control, coordination and adaptation, makes a difference to the task and relationship conflict, and then, to investigate the moderating roles played by both, total interdependence and interdependence asymmetry, in altering the association between the two types of conflicts. Design/methodology/approach This study obtained data through a questionnaire survey in the Chinese construction industry and the final sample consisted of 232 responses. The data were analysed using hierarchy analysis using SPSS. Findings The results are as follows: first, higher contractual control and coordination reduce the level of relationship conflicts, and higher contractual coordination also reduces the level of task conflicts; second, task conflict positively affects relationship conflict; third, task conflict mediates the relationship between contractual coordination and relationship conflict; and finally, when total interdependence is higher, task conflict induces more relationship conflict. On the contrary, high interdependence asymmetry weakens the positive relationship between task and relationship conflicts. Practical implications This study highlights the importance of contracts in conflict management. The findings can guide practitioners in drafting suitable contracts to deal with task and relationship conflicts more effectively. Originality/value This study differentiates the effects of distinct components of contracts on task and relationship conflicts, and then reveals the contingent effects of interdependence on the relationship between task and relationship conflicts in inter-organisational transactions.

The objectives of this study are to analyze the religious conflicts and characteristics of the religious conflict reflected in the novel. This study uses descriptive qualitative method using sociological approach and several theories of religious conflict. The result, this study depicts the religious conflicts between by Muslim and Hindu as well as the characteristics of the religious conflict. The religious conflicts are presented in the sphere of belief: conflict between Muslim and Hindu, ideology: conflict between Kashmiri and Indian, organization: conflict between separatist groups of Kashmir against Indian government, family: conflict between Keshav and Zara’s family, and individual: conflict between Zara and Keshav.

This article aims to clarify the effects of conflicts on the task performance of supervisory boards in education. Management studies on conflicts on corporate boards sometimes find a positive effect and sometimes a negative effect on the performance of boards. These mixed findings are considered a result of the triggering of harmful personal conflicts through disagreements about process and content within boards. In order to gain more insight into the complex ways in which conflicts influence the effectiveness of supervisory boards in education, a multidimensional operationalisation of conflict has been designed, in which three different types of conflict – task, process and relationship conflict – are distinguished. Chairs of the executive boards of schools in the Netherlands (N = 300) were questioned via a survey on various conflict dimensions and their supervisory board’s task performance. The results of hierarchical regression analyses underscore the need for a multidimensional approach to conflicts on supervisory boards in education. Task conflict has a positive effect and relationship conflict a negative effect, while process conflict seems to have no significant effect on supervisory board effectiveness. Furthermore, task conflicts have a mitigating, rather than a triggering, effect on relationship conflicts. Supervisory boards in education should therefore not avoid substantive discussions on the differences of opinion among their members to be more effective.

Abstract: The relationship of fundamental rights and private law is often filled with mistrust, which results in a framework where (1) the issue of horizontal effect acquires an oversized importance; (2) the relationship is described in terms of the conflict between fundamental rights and private rights; and (3) fundamental rights are seen as a constraint on consent. This article proposes a different, symbiotic, approach, where (1) horizontal effect is given less attention, because, in general, courts refuse to be tied by a single, unifying theory, when they approach the issue; (2) the purported ‘conflict between’ is reframed as an issue of overlapping conflicts between private interests on one level, and fundamental rights on the other, which are resolved through different methods; and (3) party autonomy is a cornerstone of both fundamental rights and private law, and a tool to address the two levels of conflict. With this approach we can identify some ‘false’ conflicts and restrict the ‘real conflicts’ to identifiable scenarios. The analysis is based on the extensive case law of Spanish courts, and the case law by the European Court of Human Rights (ECtHR), using parallels with other jurisdictions for purposes of comparison. The subject of study in the article is the process of socio-economic conflict management. The purpose of the work is to substantiate the theoretical provisions and methodological approaches in the management of labor conflicts as a form of social and labor relations based on Ukrainian and foreign experience. The following tasks are solved in the article: to investigate the essence and place of social and labor conflict in the system of social contradictions; provide a classification of conflicts in the social and labor sphere; to study the forms and methods of resolving social and labor conflicts: to analyze the success of conflict prevention in Ukrainian and foreign practice. The following methods are used: method of analysis and synthesis, classification-analytical method, abstract-logical method, historical-retrospective analysis and generalization. The following results were obtained: the concept of socio-economic conflict is clarified. The classification of conflicts is carried out, which gives an understanding of the nature and essence of conflict relations on the following grounds: the method of conflict resolution (antagonistic and compromise conflicts); spheres of conflict (political, social, economic, organizational conflicts); direction of impact (vertical and horizontal conflicts); degree of conflict confrontation (hidden and open conflicts); the number of participants in conflict interaction (intrapersonal, interpersonal, intergroup); needs (cognitive and interest conflicts). Structural and interpersonal methods for resolving conflict situations are defined. An analysis of the current state of resolution and prevention of labor conflicts in 2020 was conducted according to the National Service for Mediation and Reconciliation. Foreign experience in resolving labor disputes has proved the feasibility of developing the following ways to resolve labor disputes in Ukraine: with the help of special courts on labor and social security (sectoral justice); through civil proceedings in general courts; through conciliation and arbitration procedures. Conclusions: The analysis allowed to determine the essence of social and labor conflict as a form of social and labor relations at the micro, meso, and macro levels, which is manifested in the opposition of the subjects of the socio-economic sphere. Applying the gained world experience it is possible to reduce social tensions and to strengthen social and economic safety of the state. This paper highlights the importance of considering two facets of the content of internal conflicts: The concrete subject theme of the conflict and the abstract motivations that people perceive as being conflicted (e.g. values implicated in the conflict). The paper demonstrates how personal value priorities contribute to the understanding of internal conflicts. In two studies I examined the relationship between values and the content of internal conflicts. In Study 1 ( N = 250), students described a central conflict that they were experiencing and analysed the values they perceived as opposing in their conflict. Results indicated that the reported conflicts were usually between values not conceptualized as motivationally opposite to each other. Furthermore, personal value priorities were related to the values implicated in the conflict both directly and indirectly by their effect on the themes of the conflicts. In Study 2 ( N = 230), working parents analysed the values they perceive as coming in conflict in two work–family dilemmas. Findings supported the premise that values explain individual differences in the motivational meaning attributed to a conflict even when the conflict theme is held constant. This article opens a dialogue between different notions of conflict and the sociology of power and suggests a new theoretical framework for the analysis of international conflicts. Refusing to consider abstract entities as actors, it helps us better determine who the relevant actors are in each international conflict and gives special attention to the existing power relations between them. Accordingly, it is considered that a large social system is made up of numerous actors with multiple conflicts between them. Thus, in the case of international conflicts, we do not face one single conflict, but a conflictual complex involving a multitude of actors with their different power resources, who weave a network of conflicts and power relations between them, and at its top a dominant conflict, the conflict around which the other conflicts evolve. Acknowledging the complexity of international conflicts, this new theoretical approach should better explain both the behaviour of the actors and the evolution of the conflictual complex itself.

The expansion of renewable energy infrastructure comes with increasing conflicts at local level that significantly impede the expansion of renewable energy in Germany and impact the realization of national and international climate goals. In some conflicts, rural communities are torn apart and social relations strained beyond the energy conflict. Other projects are realized with no or only minor disruption. To researchers, project developers and local politicians alike, it seems unpredictable as to which way local energy conflicts evolve. Thus, the paper aims to shed light on conflict dynamics and identifies a number of aspects that influence local energy conflicts. The paper applies a conflict theoretical perspective on local energy conflicts. Rather than identifying energy conflicts as a sign of dysfunctionality, conflicts are seen as an important element of a democratic society struggling to find the best way through the transformation towards decarbonization. Based on qualitative research on local energy conflicts in five German municipalities the paper analyzes aspects that encourage constructive conflicts and aspects that impede such developments. With reference to Dahrendorf’s conditions of conflict the categories of energy conflicts are systematized within an analytical framework according to conditions of organization, conflict and change. These categories and aspects are embedded in specific local conditions, making conflicts on the one hand typical and on the other very specific. They are also entry points for dealing constructively with the conflicts.

The article is devoted to different methods of constitutional conflicts resolution, classification of constitutional conflicts, genesis of constitutional conflict diagnostics theory as a system of different measures for constitutional conflicts prevention.The purpose of the article is to confirm or disprove hypothesis that methods of constitutional conflicts resolution and prevention may be classified by different bases.The methodology of the study includes general scientific methods (analysis, synthesis, description) as well as sociological and economic approaches. The main results and scope of their application. The author describes different groups of conflict resolution methods, it’s types and system. The optimal way to resolve the constitutional conflict is systematic application of the following principles: 1) the legality of measures; 2) priority of human and civil rights and freedoms; 3) ultimo ratio (last resort); 4) proportionality of measures; 5) the effectiveness of measures, aimed at resolving the constitutional conflict. Conclusions. Constitutional conflicts are resolved by special legal methods. Depending on the enforceability of such methods for the conflicting parties, such methods can be classified into: - enforcement methods, that are based on the constitutional power of legal enforcement to be applied to one side of the conflict by the other party or by the actor of the constitutional-legal conflict (measures of constitutional enforcement, the mechanism of checks and balances); - cooperative methods, which are understood as mechanisms for resolving constitutional conflicts, enshrined in the norms of constitutional law and based on cooperation, mutual assistance of the parties to the conflict on a parity basis (various forms of coordination, such as negotiations, mediation, conciliation). Methods and mechanisms of conflicts prevention are not the part of methods of resolving constitutional conflicts, since the first methods are applied before the appearance of constitutional and legal conflicts. A constitutional conflict diagnostics as a method of constitutional conflict prevention is based on risk management system and represents a system of legal and organizational measures, aimed at identifying risks of constitutional conflicts and legal monitoring.

This review examines how family businesses manage family-related conflicts that occur at three interfaces: family-business, family-ownership, and family-business-ownership. We find that work-family conflicts, conflicts of interest, and relationship conflicts are prevalent family-related conflicts. Four conflict management strategies are frequently used to deal with these conflicts: vacillation, domination, separation, and third-party intervention. The popularity of these strategies is influenced by some unique characteristics of family businesses, such as high emotional attachment among family members. By integrating insights from the broader conflict research, paradox and dialectic studies, we develop a research agenda targeted at better connecting family-related conflicts to conflict management strategies.

Religious leaders are part of the efforts of solving the conflicts. In addition, this study is also aimed to determine and analyze the types of inter-family conflicts that exist and the processes for conflict resolution among families in the Tolaki in Konawe. The research data is based on two categories of informant; traditional leaders and ordinary informants that are public figures such as religious leaders, government officials within the scope of sub-district, village, and community members both at the level of individuals, families, and communities. The traditional leaders get involved in conflict resolution while public figures have experience on dealing with such conflicts and are sometime involved in a conflict. The work indicates that the conflicts in the Tolaki people take the form of closed and open conflicts. While the sources or the causes of the conflict come from tulura (speech), peowai (actions), and powaihako (behavior). The sources of the conflict then are manifested in the daily life of Tolaki people and become sisala'aineperapua (conflict in marriage), sisala'aine hapo-hapo (conflict by treasure), and conflict in social relations. Social and cultural conditions that often lead to inter-family conflicts are the difference in social strata, economic inequality, and religious differences. Tolaki People then settle their conflict through the expertise and charisma of religious and cultural leaders by the completion of melanggahako, mesokei, peohala, mombopoo'rai, sombalabu, and mosehe.

The text notes that the lack of theoretical understanding of the problem of social conflicts makes it difficult to logically solve practical problems aimed at preventing conflict situations in the modern community. The article examines the difficulties encountered in the localization and resolution of conflicts, thoroughly analyzes the entire course of the conflict development with the subsequent establishment of its possible causes and consequences. Also, this article discusses the causes of social conflicts in modern society, as well as the features of their occurrence. The works on the development of problems of methodology and general theory of conflict occurring in society are noted. In our country, there is a tradition of studying social conflicts through the objective contradiction of the interests of the majority of social groups, which dictate to the parties the logic, duration, degree of tension of the struggle for the satisfaction of urgent needs. However, it is not always necessary to equate objective contradictions of social groups with conflicts. The conflict is somehow connected with people's subjective awareness of the inconsistency of their interests as members of certain social groups. Aggravated contradictions generate open or closed conflicts only when they are deeply experienced by people, are realized as incompatibility of interests and goals. Taking into account the fact that philosophers in the Ancient World began to be interested in the nature of conflicts, the representatives of three modern socio-philosophical concepts of conflict made the greatest systematic contribution to its understanding: the concepts of positive-functional conflict proposed by L.Kozerom: R. Darrendorff's conflict models of society and K. Boulding's general theory of conflict.

Alongside with the appearance of the so far unknown reality called cyberspace, the new conditions of the course of conflicts emerged, consequently both the scientists as well as practitioners started to use the term cyber conflict. Unfortunately, presently there is no consistent, common view concerning a cyber conflict.The article presents a theoretical basis of cyber conflicts based on the research carried out by the authors. The article itself is an added value since it provides the suggestion and explanation of the perspective for the understanding of cyber conflicts through the prism of Gerasimov’s perception of a contemporary conflict. Moreover, it presents a new definition of a cyber conflict as the process being the system of activities. The authors also present the stages of a conflict according to Gerasimov, as well as the structure of a cyber conflict. Additionally, the article envisages the aspects of Russian attitude to conflict solving which are worth paying attention to. The presented article offers the perspective of the Russian understanding of the resolution of conflicts, it bridges the gap in research on cyber conflicts as well as assures a strong theoretical basis for the understanding of a Russian point of view on the solution of contemporary conflicts, which might be useful for counteracting cyber conflicts. The authors hold the view that the article is the incentive for further research on cyber conflicts during competition.
