Abstract:
Since the 1995-96 Taiwan Strait crisis, scholars and policymakers have become increasingly concerned about China's territorial ambitions. Yet China has also used peaceful means to manage conficts, settling seventeen of its twenty-three territorial disputes, often with substantial compromises. This article develops a counterintuitive argument about the effects of domestic confict on foreign policy to explain China's behavior. Contrary to the diversionary war hypothesis, this argument posits that state leaders are more likely to compromise in territorial disputes when confronting internal threats to regime security, including rebellions and legitimacy crises. Regime insecurity best explains China's pattern of compromise and delay in its territorial disputes. China's leaders have compromised when faced with internal threats to regime security, including the revolt in Tibet, the instability following the Great Leap Forward, the legitimacy crisis after the Tiananmen upheaval, and separatist violence in Xinjiang.

If sunlight is, in Justice Brandeis’s words, “the best of disinfectants,” then Brandon Garrett’s latest book, Too Big to Jail: How Prosecutors Compromise with Corporations might best be conceptualized as a heroic attempt to apply judicious amounts of Lysol to the murky world of federal corporate prosecutions. “How Prosecutors Compromise with Corporations” is the book’s neutral- sounding secondary title, but even casual readers will quickly realize that Garrett means that prosecutors compromise too much with corporations, in part because they fear the collateral consequences of a corporation’s criminal indictment. Through an innovation known as the Deferred Prosecution Agreement, or DPA, prosecutors reach extrajudicial contractual agreements with corporations. Although prosecutors have long touted the transformative potential of these agreements, Garrett concludes that their benefits are often superficial and short-lived. Moreover, prosecutors negotiate these compromises with little oversight or accountability. Even worse, this overly soft approach toward entities has infected prosecutorial resolve to prosecute individual offenders, thereby enabling corporate managers to escape liability for their criminal wrongdoing. No wonder, then, that Garrett perceives a grievous accountability gap in the corporate crime landscape.

Abstract In Sweden all persons under the age of 18 are considered children. The age when it is possible to be held responsible for a criminal act, and therefor convicted in court, is 15. Society’s and, perhaps first and foremost, the authority’s attitude towards juvenile crime is that they should not be equal adults in the process within criminal law. Because children are considered essential for the society of tomorrow, it is important to pay extra attention to crimes committed by juveniles. The social services authorities are considered to have the best resources and competence to handle this group of juveniles. In the criminal law process the prosecutor requests a statement regarding the young person who is reasonably suspected of a criminal act. The statement should contain information about if the young person is in need of certain interventions from social services in order to prevent unfavorable development. The conclusion that has been drawn when the statements has been reviewed is that a borderland has been created where social law and criminal law overlap. This overlapping is in a way a collision where social aspects and principles of criminal law have to meet. However, it is not always easy to make both sides satisfied. As a way to meet the needs of both sides the borderland becomes a compromise consisting of the process regarding the juveniles. The purpose of this essay is to describe and understand the compromise that has been made where statements and young juveniles are existing. The aim of this essay is to study 23 statements from social services that prosecutor request and the 23 court records attached to them. All statements and court records are regarding persons between 15 – 17 years old. The study is limited to the period between 2010-01-01 to 2010-12-31. This essay has been from a qualitative point of view where the discourse analysis as an text analytical method has been used to understand the collected statements and court records. Central results is that the statements reviewed in this essay overall are satisfying in fulfilling the social law and criminal law aspects. However the results also point out that an uncertainty within the social services regarding the design of the statements also is to be found. Descriptions of social aspects about the young juvenile behind the statement seems to be important to emphasize.

Este estudio nace de la preocupación feminista por la violencia de género, la pobreza y las asimetrías de presión política sobre las sociedades. La relación entre Arte y sociedad es un hecho que impregna la realidad artística contemporánea con especial vindicación en el feminismo, que ha ido señalando otros valores éticos diferenciales, un ejemplo de ello sería: la solidaridad, como motor de cambio en su objetivo de denuncia y reparación. Esta investigación comenzó con la creencia de que el arte puede hacer algo por la sociedad y con la preocupación de que el arte no puede hacer nada. La pregunta de “¿El arte nos salva de algo?” conduce a un largo recuestionamiento cuyas respuestas se hilvanan a partir de propuestas y producciones que crearon y produjeron debates sobre el feminismo, en el contexto coreano y europeo. En consecuencia, los trabajos de esta investi- gación se concentran en qué tipo de actitud y posición particular tuvieron y tienen las/os artistas. Para ello se presentan una serie de ejemplos en los que el proceso artístico se convierte en el resultado en una obra de arte, al demostrar la propia política que el artista desarrolla como trabajador del arte, en lugar de dar prioridad a una actitud política ideológica para la producción de la obra. En otras palabras, examinamos que la política de las/os artistas no es la única que puede hacer arte, y esta observación supone que ofrece y da la libertad de ampliar el concepto de identidad de un artista y de cómo ser artista hoy. Al mismo tiempo, se refiere al proceso de mostrar y repensar los limites en el arte, específicamente el límite entre el arte como praxis y el rol de las/os artistas en la sociedad en la que vivimos. En conclusión, el estudio de “Betweenness” es una reflexión del papel político que tienen las/os artistas desde perspectivas no solo feministas sino femeninas. El discurso está estructurado por seis obras que crean interrogantes y abren un debate sobre el feminismo entre ellas y fuera de ellas, y nos permiten pensar sobre como la política de la vida se convierte en arte.
This study was born out of feminist concern about gender-based violence, poverty and asymmetries of political pressure on societies. The relationship between art and society is a fact that permeates contemporary artistic reality, with special vindication in feminism, which has been pointing out other differential ethical values, an example of which would be: solidarity, as a motor of change in its objective of denouncing and repairing. This investigation began with the belief that art can do something for society and with the concern that art can do nothing. The question of “Does art save us from anything” leads to a long reexamination whose answers are threaded through proposals and productions that created debates on feminism, both in the Korean and European context. Consequently, this study concentrates on what kind of attitude and particular position the artists had and have. To this end, a series of examples are presented in which the artistic process becomes the result of a work of art by demonstrating the very politics that the artist develops as an art worker, instead of giving priority to a political ideological attitude for the production of the work. In other words, we examine that the politics of artists is not the only one that can make art, and this observation assumes that it offers the freedom to broaden the concept of an artist’s identity and how to be an artist today. At the same time, it refers to the process of showing and rethinking the boundaries in art, specifically the boundary between art as practice and the role of artists in the society we live in. In conclusion, the study of “Betweenness” is a reflection on the political role of artists from not only feminist but also female perspectives. The discourse is structured by six works that create questions and open a debate about feminism among themselves and outside of them, and allow us to think about how the politics of life becomes art.

Abstract:
The provision of medical care to top-level athletes in New Zealand comes with a number of challenging ethical issues. Some of these arise out of the commercial interest present in sport that links sporting success with funding, sponsorship deals and media interest. The requirement that athletes stay at peak physical function in order to be successful can, at times, be at odds with concepts of well-being and good health. The employment structure under which doctors are engaged by teams and the employment contracts which define these relationships can be the source of divided loyalty for doctors. For example, sharing health information beyond the doctor-athlete relationship may be in line with contractual obligations, but at odds with what the athlete requests. Divided loyalties also exist when athletes wish to participate in sport despite high risk of harm. Here there is a difference between what the doctor understands as the athlete�s best interest, and the athlete�s consideration of best interest. This thesis adopts two strategies for examining the area of sports medicine in elite athletes in New Zealand. The first section utilizes qualitative research. Sixteen sports doctors were interviewed and the data analysed. The next section involves normative reflection. Here two issues (where a range of behaviours were exhibited by participants) selected from the data are considered and discussion is presented on how doctors should respond to these issues. An examination of the level of guidance offered to sports doctors from the Australasian College of Sports Physician�s Code of Ethics follows. The level of guidance offered is considered inadequate and the thesis ends with a call to attend to these concerns.

Abstract:
As the name suggests, the methodology of private international law relates to substantive private law only. A parallel methodological system regarding public law does not exist. The paper argues that this methodological rift lacks any doctrinal justification. It concludes that there are no obstacles to all-sided conflict of laws rules in the public law domain. Since the paper finds that foreign public law is already applicable in private party cases (albeit heavily obscured), it focuses on public law relationships where a foreign state appears as a plaintiff. In this respect, it is shown why the application of foreign public law embodies an attractive compromise between legal assistance and recognition.

Abstract:
A major drawback on the use of sliding mode controllers is their inherent intense control activity. A usual strategy to cope with this problem is to use a boundary layer around the switching surface. The boundary layer thickness choice is based on a compromise between smoothness in the control action and tracking error. Since this compromise may be difficult to achieve, several boundary layer thickness variation laws (BLTVL) have been proposed in literature. In a recent study [1] an interesting BLTVL was proposed, based on the approach angle of the state to the switching surface. Although innovative, that study does not provide a proof of the stability of the controller. Furthermore, the BLTVL definition varies according to the system order and sliding surface definition. This paper extends the work done in [1] by presenting a new BLTVL based on a generalised definition of the approach angle that can be applied to systems of any order using any sliding surface. Furthermore, an innovative stability proof of a variable structure controller (VSC) using the new BLTVL is provided. Experimental results obtained in a servopneumatic system validate the usefulness of this approach.

Abstract:
The phenomenon of cybercrime is becoming more hostile and confrontational as both individuals and organized criminal groups take advantage of new criminal opportunities from the cyber environment. Many cyber-attacks are used to compromise eLearning systems, to change the student’s grades and results, to steal the information available only for trainers and professors, or to infect all the users that are using the platforms. The role of legislation in preventing and combating the cybercrime phenomenon against eLearning systems is very important. Legal measures are needed in all the fields, including investigative measures, procedural powers, jurisdiction, and international cooperation. In a globalized and connected world, the law consists of a collection of national and international legal systems. Sometimes provisions can contradict each other, resulting to collisions of law, because of the interactions between these legal systems. The main goal of the international law is to obtain harmonization of national laws. In the last decade many significant developments were made for the promulgation of multilateral instruments in the field of cybercrime. This paper analyses the collections of regional and international instruments developed in the context of the Council of Europe or the European Union, tools that can help the investigations of compromised online systems. Legal frameworks for the investigation of cybercrime acts in the field of eLearning require a clear scope of application of the power, in order to guarantee the legal actions. Most of the countries have introduced new investigative powers specially created for obtaining electronic evidence which can be used in cases of compromised eLearning systems.

The representative function ensures the unity of action of the parliament - as the central institution of democracy and the elected body that represents all the structures of society that has the unique responsibility to harmonize all conflicting interests and expectations of different groups and communities through democratic dialogue and compromise. Along with the legal definition of the representative function, the analysis and review of the constitutional and legal regulations as well as different theoretical viewpoints and understandings about the nature of the parliamentary mandate, an element of the electoral process, the subject of the author's analysis is the necessity of creating and fostering a constitutional and political culture that implies supplementing legal and political responsibilities, interested and informed voters, the existence of trust between citizens and representatives, and raising awareness of the responsibility of both voters and representatives.

Abstract:
This work is a contribution to optimize the size of gears, by studying the variations of spur gear contact stress. The formulation is based on the virtual work principal and the classical contact law. Such contact problem is non-linear and is generally treated through the Newton-Raphson’s method, which is a robust method but nevertheless requires high computational resources. In this work and as an alternative the used methodology jointly applies the asymptotic numerical method and the finite element method that is a good compromise between efficiency and computational resources. It consists in rewriting the different dependent variables as an asymptotic development which transforms a non-linear problem into a succession of linear ones. The contact is formulated by Hertz theory which assimilate teeth contact to a contact between two cylinders; by applying the classical contact law we take into account the real geometry profile of the teeth.

The success of layered synthetic microstructures (LSM) as reflectance enhancing coatings for mirrors at wavelengths <300 A has prompted a study of their properties when applied to diffraction gratings. In designing the coating, its interference order, usually the first order, must be paired with a suitable diffraction order of the grating. In addition a compromise must be made to reduce the incompatibility caused by the simple Bragg law performance of the grating with the corrected Bragg law performance of the coating.

This paper firstly educes an energy-based ecological function (EF) which is a compromise between energy pumping rate (EPR) and dissipation of EPR for an endoreversible chemical pump (CP) cycle. By solving the equations of Euler Lagrange, the fundamental optimization relationships of the EF and coefficient of performance (COP) for the CP cycles with linear mass transfer (MT) law and diffusive MT law are derived. The numerical calculations to analyze the influences of the cycle parameters on the relationship between the EF and COP are provided, and the influence of two different MT laws on the EF and COP characteristic is discussed in detail. The maximum EF of the cycle with the linear MT law is bigger than that with the diffusive MT law. The results obtained in this paper can be applied to design a class of devices, such as photochemical, electrochemical and solid-state apparatus as well as mass exchangers, etc.

Competition has been claimed to be a very liberal economic tool where market players are meant to be free in arranging their technologies, production and sales on a particular market. In this paper we are developing a new hypothetical of the functioning of market economies which are in a global sense and considering new markets very different and specific. All the global powers, whose centre of influence might change in time, are trying to gain a bigger share regarding raw materials and potential markets. In post-conflicts societies and in particular in our case study of Kosovo and Serbia we can see the more clear market interests of all local, regional and global powers. The research of post-conflict societies is providing us with some answers regarding the possible future developments in certain societies and regions. The EU made Brussels Agreements in Kosovo has managed to establish new enterprises as a solution of a political compromise where energy, telecommunication and natural resources played a key role. The Washington Agreement has liberalized the infrastructure achievements but in some aspects limited the use of energy and telecommunication infrastructure from certain sources. In this sense we can observe the limited capacity of competition rules application in post-conflict societies and in particular Kosovo in this case. These agreements have therefore limited the influence of economic, strategic and energy related influence from main USA competitors which have not been named in the agreements, but are well known. In both agreements it is visible how economic activities and cooperation is encouraged with various non-economic incentives. Competition is accordingly more of a political will than an economic reality for some in post-conflict societies. The introduction of various companies into the Kosovo legal framework and their control by Serbia is an obvious tool how natural resources could be shared for a benefit of citizens where conflict is resolved using free market and competition rules.

Estos compromisos, conocidos como las Contribuciones Determinadas a Nivel Nacional (CDN o NDCs en inglés), representan un peso significativo para los países en su compromiso de cumplir con las metas estipuladas. En este informe, se lleva a cabo un análisis del impacto en el empleo en tres sectores económicos específicos, destacando el potencial considerable de generación de empleos verdes en los sectores de energía, turismo y agricultura en el Perú. Los resultados obtenidos proporcionan valiosas perspectivas para los responsables de políticas públicas, empresas y demás partes interesadas que buscan impulsar una transición justa hacia una economía más respetuosa con el medio ambiente y equitativa desde una perspectiva social.

El mundo enfrenta con urgencia la necesidad de una “transformación verde”, que implica no solo una transición hacia el uso de energías renovables y la reducción de la pérdida de biodiversidad, sino también un profundo cambio social hacia la justicia social y la sostenibilidad. Ello requiere de compromisos sociales entre élites y sectores populares que permitan construir instituciones fuertes para implementar cambios. América Latina afronta enormes desafíos para aumentar la igualdad, la justicia y la sostenibilidad, pero también puede jugar un papel fundamental en la transformación verde global. La región también se caracteriza por tener élites robustas, fuertes movimientos socioambientales y profundos conflictos ambientales, que dificultan los compromisos sociales. Este documento analiza las reacciones de las élites al acuerdo regional más avanzado sobre regulación ambiental y resolución de conflictos, el Acuerdo de Escazù. En muchos países, las élites se opusieron con vehemencia, arguyendo la injerencia sobre su soberanía nacional, pero rechazando particularmente las implicaciones institucionales del acuerdo que suponen un mayor compromiso para permitir la participación popular. A esto se opusieron las élites económicas de los países democráticos (Chile, Colombia, Costa Rica y Perú), así como las élites gubernamentales de los países autoritarios (El Salvador y Venezuela). Sin embargo, en varios casos, la oposición de las élites fue superada gracias a la movilización social y al diálogo. Este documento analiza los aprendizajes de las reacciones de las élites al Acuerdo de Escazú ante futuros compromisos sociales como base para el surgimiento de Estados transformadores en América Latina.

En este trabajo estudia los compromisos de las empresa cementeras y siderúrgicas de la ciudad de Sogamoso con el cambio climático se desarrolló una investigación de tipo mixta con un enfoque descriptivo, por medio de encuesta estructurada y aplicada a las empresas entre grande y medianas, con una muestra que logró establecer el estado de responsabilidad social empresarial dentro de la sostenibilidad y la descarbonización de la empresas en los procesos productivos y los compromisos con el pacto global hacia Cero Net como meta propuesta para 2035 y la contribución con el cambio climático y efecto invernadero. Los compromisos con el cambio climático permiten identificar los factores con los grupos de interés y la responsabilidad medio ambiental de acuerdo a las exigencias del cambio climático y los determinantes de la descarbonización de los procesos productivos de las empresas siderúrgicas y cementaras, además la responsabilidad social está asociado a los objetivos de desarrollo sostenible y las implicaciones hacia la sostenibilidad y la responsabilidad social empresarial. Sogamoso ha sido considerada como una de las ciudades con un alto grado de contaminación según. ESRI (2018) Los resultados arrojaron evidencias claras sobre la responsabilidad social empresarial hacia los aspectos en el medio ambiente y el plan de descontaminación y estabilización del aprovechamiento de los recursos naturales, establecidas en los indicadores del impacto medioambiental por lo que se puede identificar oportunidades de mejora en estas empresas cementeras y siderúrgicas de la ciudad de Sogamoso.

Los países de América Latina y el Caribe (ALC) utilizan la reducción de la tasa de impuesto a la renta empresarial (IRE) para promover la inversión y, a su vez, este incentivo debe cumplir con la condición de no discriminar entre operaciones de exportación y aquellas destinadas a todo el mercado local, según los compromisos contraídos con la de la Organización Mundial del Comercio (OMC) y el proyecto de Erosión de la Base Imponible y Traslado de Beneficios (BEPS, por sus siglas en inglés). Así se posibilita un importante arbitraje tributario cuando las empresas con incentivos en la tasa de renta empresarial venden con sobreprecios a firmas sujetas a tasa normal en el mercado local, trasvasando rentas a las firmas beneficiadas desde las del régimen general. Esto tiene impactos negativos significativos y crecientes en términos de recaudación y equidad entre firmas bonificadas y las del régimen general en el mismo ramo, especialmente en los servicios cuyo crecimiento es notorio (como los digitales o de telecomunicación). Para morigerar este arbitraje será necesario aplicar algunas opciones prácticas, como las que se presentan más adelante, que hagan viable la bonificación tributaria en la tasa del impuesto como herramienta de políticas, sean compatibles con dichos acuerdos internacionales y reduzcan las pérdidas de recaudación. Adicionalmente, se incluyen cuadros con el resumen de los principales regímenes de incentivos tributarios y de la revisión por los pares de los posibles regímenes fiscales perniciosos en América Latina (Acción 5 de BEPS).

En este escrito se pretende concientizar a la población cafetera de Antioquia sobre la importancia de la siembra y comercialización del grano cafetero con una conciencia ambiental. En este artículo cualitativo, se observan las causas y efectos del café amigable con el medio ambiente, y se presentan métodos que se han implementado para producciones sanas y sostenibles. Además, se discute cómo los productores de café en Antioquia pueden contribuir a unas buenas prácticas de agricultura que nos lleven a una producción muy amigable con el medio ambiente, incluyendo la creación de ecosistemas que incluyen el agua como factor vital en la producción del café, junto con la fauna y flora del entorno. Se tuvo como objetivo determinar las causas y efectos que se dan en una producción de café amigable con el medio ambiente. El propósito es brindar a los productores un panorama formativo y aplicativo de lo que sucede en la actualidad del café, más allá de producirlo y llevarlo al consumidor final. De esta manera, se busca concientizar a la población cafetera de Antioquia sobre la importancia del cuidado medioambiental y presentar métodos que se han implementado para producciones sanas y sostenibles.

"Este artículo analiza la importancia de gestionar y atender las denuncias ciudadanas en la Contraloría General de Antioquia, enfatizando su papel crucial en la protección de fondos públicos y en la lucha contra la corrupción. Se describe la denuncia como una herramienta fundamental, protegida por un proceso de investigación y resolución conforme a normas de control fiscal. Se utilizan diversos medios para su registro, incluyendo sistemas internos, líneas telefónicas, correos electrónicos, formularios virtuales y atención presencial, asegurando la libre expresión y participación ciudadana. A pesar de la diversidad de canales, se reconoce que limitantes como la conectividad y el desconocimiento tecnológico pueden restringir este proceso. En efecto, se subraya la necesidad de que las autoridades informen y eduquen a la ciudadanía sobre la denuncia, sus tipos, procedimientos y el proceso post denuncia para fomentar su eficacia en combatir la corrupción. La colaboración entre ciudadanía y autoridades es vital para prevenir la corrupción y proteger los intereses colectivos.
