Abstract:
The role of the judiciary, law enforcement officials in the resolution of disputes is important. The number of disputes is increased, many authorities in Indonesia produce multiple decisions with conflicting legal force making it difficult to execute. The purpose of the study was to find the standardization of competency of law enforcement officials, the relationship between the professionalism of law enforcement officials and legal certainty in the settlement of land disputes as mandated by Article 33 paragraph (3) of the 1945 Constitution and the Basic Agrarian Law Number 5/1960. Settlement of land disputes is achieved through the General Court and the Administrative Court. The existence of regulations regarding competency standards for law enforcement officials who handle land disputes for the sake of fair settlement of land disputes and legal certainty.

Abstract:
The debate on the absolute competency of the State Administrative Court in Indonesia to set the dispute over the State Financial Losses Report (LHPKKN) is proved to have caused dissenting opinion. The judgments between one administrative court to other court in Indonesia cause main problem of achieving justice and legal certainty. This research examines the issue of absolute competence of the Administrative Court in adjudicating disputes on the State Financial Losses Report published by the Financial and Development Monitoring Agency (BPKP). This article uses normative legal research and implement the statute approach, conceptual approach, and case approach. These approaches are used to discern and analyze several related legal materials or documents scientifically. The aims and objectives of this research are to find a legal solution on how this classic issue has to be approached and solved. As a result, it is found through this article that the Administrative Court has absolute competence in deciding disputes on the Report on the Calculation of State Financial Losses issued by the Financial and Development Monitoring Agency, which is supported by several fundamental reasons.

Abstract:
This article aims to describe the results of the competency analysis of SKI teachers at MAN 2 Model Medan in implementing the 2013 curriculum learning based on the Semester Credit System. The method used is a qualitative research method with a naturalistic analysis approach using data collection techniques through observation, interviews and documentation. Then the data analysis techniques used through data reduction, data presentation and drawing conclusions. While the data validity techniques are credibility (trust), transferability (transferability), dependability (dependence), and confirmability (certainty). The results showed that: (1) The competence of SKI teachers in analyzing the characteristics of students was considered quite good, with indicators of understanding the physical, moral, spiritual, social, cultural, emotional and intellectual aspects of students. (2) The competence of SKI teachers in mastering learning theory and learning principles is quite good, with indicators of deep learning theory of constructivism, behaviorism, and cognitivism learning theory. While the learning principle uses the PAIKEM approach. (3) The competency of SKI teachers in implementing the 2013 curriculum based on credits is quite good, namely the implementation of learning using the 5 M approach, namely Associating, Asking, Observing, Creating networks, and Conducting trials. (4) The competence of SKI teachers in utilizing information and communication technology is in a good category, involving TV, films, VCD/DVD/VCR and the internet. (5) The competence of SKI teachers in using process evaluation and learning outcomes is quite good, with indicators of conducting an assessment taking into account the principles of continuity and authenticity including knowledge, attitudes and skills.

Abstract:
Objective. Continued Professional Development (CPD) is one of the most significant precursors to increased competency. Appropriate instruments and support are required for its implementation. This paper demonstrates the attitudes held by pharmacists on the impact of the competency framework on CPD, its acceptance among Serbian pharmacists and potential future application. Furthermore, the motivational impact of the competency framework on CPD as well as the relationship between certain demographic indicators and motivators of CPD are provided. Method. Research on the cross-sectional method throughout 2015-16 included pharmacists working in publicly-owned pharmacies. The survey was anonymous and voluntary. The questionnaires generated for this research contain demographic data on those surveyed and open-ended questions with multiple choice answers and applied a Likert-type scale. Statistical analysis was conducted by applying Microsoft Office 2003 and the Statistical Package for Social Sciences (SPSS) version 22. Results. Among the respondents, the female gender dominated, respondents who had not completed a speciality within their respective field, with an average age of 42 years, and an average of approx. 15 years of service. 26.12% of the respondents had prior experience with the competency framework. Most respondents were of the opinion that these instruments motivated them to actively manage their own PD, to set concrete PD objectives and to review their own competency. Over half intend to apply competency frameworks in future. The statistical Chi-square test indicates it is not possible to determine with certainty that there are differences in terms of motivation in managing PD and in PD goal setting between the groups of variables. Conclusion. The research indicates a positive attitude/opinion of pharmacists towards the competency framework and in recognising these instruments as supportive to CPD.

IntroductionTransnationalism provides a serious challenge in mental health care, especially due to the crucial role of communication. Emergency room interactions offer an opportunity to analyze the role of cultural competency among providers and how they relate to immigrants in the clinical encounter.ObjectivesThis study addresses three aims: to assess the level of provider-perceived accuracy of diagnoses; to evaluate the use of restraints; and to compare diagnoses rates between patients of diverse racial/ethnic groups.MethodsWe examined patients’ race/ethnicity and their relation to service use and perceived certainty of mental health diagnoses. Three hundred and forty-seven migrants and 67 natives as well as their providers were interviewed in psychiatry emergency rooms in Barcelona (Spain).ResultsThe perceived certainty of clinical diagnosis is lower for Asians (OR = 0.2, 95% CI [0.07–0.63]), and higher when the clinician feels comfortable with the patient (OR = 5.41, 95% CI [2.53–11.58]). The probability of restraints is higher for Maghreb patients compared to native born (OR = 3.56, 95% CI [1.03–12.26]). The probability of compulsory admission is lower for Latinos compared to native born (OR = 0.26, 95% CI [0.08–0.88]). The probability of receiving a diagnosis of psychosis is lower when the clinician can communicate in the patient's language (OR = 0.37, CI 95% [0.16–0.83]).ConclusionsCultural factors such as level of comfort and communication in the patient's language play a central role in diagnosis and treatment. Purpose.The purpose of this article is to consider the features of competence-oriented physical and psychophysio-logical training organization for future pilots and to reveal the essence of the search and transformation stage of phys-ical and health competencies development. Methodology. Interpretation of the search-transforming stage in the self-development of physical and health competencies involves consideration of this didactic phenomenon in the context of its autodidactic component. Since competence-oriented Physical and Psychophysiological Training is a creative way of forming physical and health competencies, it can be considered a technology of transferring educational activi-ties to the mode of personal development, when the cadet becomes a subject of educational activity and integration of psychological and pedagogical knowledge to solve the outlined tasks. Results. Competence-oriented physical and psychophysiological training in the course of constructive activity passes from disparate processes and systems to a holistic formation with synergetic unity and certainty of structural elements. The ability to understand the educational activities in the discipline of Physical and Psychophysiological Training as a constructive and transformative force motivates the cadet to physical activity, which is correlated with his physical culture and health competencies and the purpose of professional education. Originality. Interest in the phenomenon of «psychophysiological reliability» as a didactic construct of quality professional education is explained by the development of problems in psychological readiness of future pilots for flight activities. A new impetus to the modernization of professional education in modern conditions is the introduction of a competency approach as a methodological basis that will realize the fullness of in-tegration facilities in the flight training with developed professional and personal competencies. That is why the prob-lem of professional reliability development for future pilots in the context of the competency approach today reaches the level of priorities in the aviation industry and higher education, in particular. Practical value. The content, structure and logic of competency-oriented Physical and Psychophysiological Training and its component «Search and Transformation Stage» implementation allow access to internal psychological and physiological resources of future pilots for effective development of psychophysiological reliability and psychological readiness for the flight profes-sion; to inner world in such a way that personal contradictions and meanings in physical activity become the driving force for professional and personal self-development.

Teacher competency is assumed to still be one of the factors that can determine student learning success. This problem needs to be explored further so that the cause can be known with certainty. This research aims to analyse the perception of biological teachers on pedagogic competence of prospective biological teachers in Sikka district. Pedagogic competence is one of the important components that also determine the success of the learning process in school. Prospective teachers need to equip these competencies so that they can apply them in the workforce. The perception of biological teachers on pedagogic competence of prospective biological teachers has a role in determining the progress of the learning process. In conducting this research, the researcher uses descriptive qualitative approach. Data sources come from biology teachers in 6 senior high schools (1 SMA Negeri and 5 SMA Swasta) in district Sikka. In wich the subject of this research is using purposive sampling technique. The data collected through interviews, questionare and document study. The validity of the data is determined using the credibility, transferability, dependability, and confirmability. Data analysis technique used refers to the concept of data reduction, data display, and conclusions or verifications. The results showed that the perception of biological teachers on pedagogic competence of prospective biological teachers in Sikka district belongs to acceptable category, although for the dimension of learning process that can inspire students learning motivation still have problem that need to be improved.

Abstract:
The results of the study discovered that the actualization of personnel in building construction permit services in Lhokseumawe city, Aceh, Indonesia, is manifested through fair behavior, work quality behavior, competency behavior, initiative behavior, communication behavior, and work standard behavior. This research concludes that although the behavior of the officials has been manifested in the aforementioned behavior, it has not been fully actualized in the building construction permit service, because there are still many internal and external obstacles. Internal obstacles such as limited personnel resources, services that are not yet transparent and not accountable. Besides, there is no certainty of time, no operational standard work, and complicated bureaucratic path. The external obstacle is the lack of public legal awareness, and most of them have not fulfilled the completeness of administrative documents. It is suggested that the apparatus can actualize their behavior in IMB services optimally. This study suggests that the stakeholder should provide particular and extra training and education for the personnel, including character building, as well as forming a special team to supervise and evaluate the IMB.

The Indonesian Workers Placement and Protection Service Center Semarang is the Indonesian Workers Placement and Protection Service Center which houses Indonesian labor services in the Central Java Province. The problem of the rise of illegal migrant workers, the processing of documents which still requires a long time, the high placement of Indonesian workers in the informal sector and the still high complaints of Indonesian workers in the Semarang Indonesian Placement and Protection Workforce Service Center show that there are still many problems with migrant workers. This study aims to identify the service quality of the Semarang Indonesian Workers Placement and Protection Service Center provided to Indonesian workers. This type of research is qualitative research. Data collection techniques used through interviews, observation and documentation. Sources of data used through primary and secondary data. The results of this study are the responsiveness dimension of the Indonesian Workers Placement and Protection Service Center can realize the pre-departure process in an average of one month, the insurance dimension is still a problem related to service convenience, tangibles dimension has been effectively seen from the competency test facilities and the final debriefing, the empathy dimension needs a little improvement on the acceptance of service input, the reability dimension is quite good with the certainty of costs but an evaluation of HR related needs.

Abstract:
This study aims to determine the level of community satisfaction through the results of a survey and assessment of the performance of services that have been provided by the apparatus of the DPM-PTSP Jambi Province licensing service provider in 2019. Dimensions measured to determine the community satisfaction index are Service Requirements, Systems, Mechanisms and Procedures Service, Service Time, Service Cost / Tariff, Product Specifications Type of Service, Implementing Competence, Behavior (Courtesy and Hospitality) Service Officers, Facilities and Infrastructure, Handling complaints, suggestions and input. This study uses a survey method that is supported by quantitative descriptive analysis. The population in this study is the User Services at the DPM-PTSP Jambi Province in 2019 as many as 200 people. While the sample is taken by random sampling or taken randomly and incidental sampling. The number of samples using a sample table from Morgan and Krejcie was 132 respondents.The analytical tool used is univariate and bivariate analysis. The index of community satisfaction in the DPM-PTSP of Jambi Province was 3,662 or 91,540 for the IKM value after being converted. The value of the IKM indicates that the service quality is at level A and the performance of the DPM-PTSP licensing service unit in Jambi Province is very good. There are 4 service elements that have a Community Satisfaction Index, namely Service Officer Behavior Elements (IKM 91,288), Implementing Competency Elements (IKM 90,909), Quality Facilities and Infrastructure Elements (IKM 89,962), Complaints Handling Elements, Suggestions and Feedback (IKM 89,394) ), but the quality of service is still at level A or categorized as very good. Furthermore, there are five service elements that have a Community Satisfaction Index (IKM) above the average Service Requirement Element (IKM 93,371), Service Procedure (IKM 92,424), Service Time (IKM 92,045), Service Cost / Tariff (IKM 92,614), Service Products (IKM 91,856). The service element that has the highest community satisfaction index is the service requirement element, then the service element that has the lowest community satisfaction index is the handling of complaints, suggestions and. The main factor influencing community satisfaction is the competence of the executor and handling of service complaints, input and advice on the DPM-PTSP licensing service unit of Jambi Province which must be appropriate and there is a complaint box, and there must be follow-up with transparent, accountable, and certain service complaint handling mechanisms. time table (time table) and legal certainty. Based on the results of the bivariate analysis that in the licensing service unit in DPM-PTS Jambi Province the service elements from elements 1 to 9 are still partial and not yet comprehensive and synergic. This can be seen from the relationship between elements that are not significant, it needs to be strengthened in the implementation of management functions, especially the stronger coordination and supervision functions between sectors in licensing services in DPM-PTS Jambi Province.

Abstract:
The high unemployment rate is certainly different from the goal of SMK, which should be a ready-to-work workforce. It is influenced by the lack of employment opportunities and the weak competence of graduates in the field of expertise. In addition, qualified educators are needed so that they can improve students' competencies and skills. This study aims to analyze the competency needs of vocational students for the world of work. This alternative can be seen from the curriculum used by Vocational High Schools and the competencies produced by the needs of the world of work oriented to the standards of the Indonesian National Qualifications Framework. This type of research is qualitative. The method used in this research is the Mixed Method, by combining quantitative research and qualitative research. The instrument used in collecting data is a questionnaire. The data analysis technique used the respondent achievement level (TPR) with the Milles and Huberman model. The results of this study indicate a weakness in the competence of SMK graduates to the competence needs of the world of work, with a percentage gain of 45.61%. These weaknesses appear in the skills possessed by students to the needs of the world of work. It means that there is a need for improved analysis to be in the good and excellent categories in the future. The competence of SMK graduates can refer to the competency needs that exist in the world of work and reduce unemployment at the SMK level.

Abstract:
This study aims to determine the forms of Election malpractice that occur in the process of voting and counting at polling stations (TPS) in the implementation of simultaneous elections in 2019 in Buton District. Other than that, this study also aims to identify what factors influence the occurrence of Election Malappractice in Buton District, focus on the process of voting and counting at polling stations. The method used in this study is description research. Data sources in writing this thesis consist of primary data and secondary data. Primary data in the form of interviews and observations. Structured interviews were conducted with election organizers in Buton Regency in this case members of Bawaslu, KPU, PPK, PPS and KPPS. While observations in the voting and counting process are conducted in 2 (two) different polling stations, namely TPS 001 Bungi Village, and 004 TPS, Kombeli Village. Meanwhile, secondary data in the form of voter data, data on the results of voting and counting, recapitulation of the results of vote counting, letters, and regulations related to the voting and counting process. The data that has been obtained is then analyzed by reducing, presenting and drawing conclusions. The results of the study showed that there were malpractices in the election in the process of voting and counting at polling stations in the form of ghost voters, double voting, writing inaccurate C1 form, manipulation of vote acquisition of Election participants, lack of logistics, inaccurate voter data, voting that does not provide comfort for all groups of voters and the implementation of voting and counting in a certain degree it is not transparent and inaccurate. While the factors that influence the occurrence of malpractice are in the form of heavy workload, lack of competency of KPPS officers, changing regulations and no legal certainty, witnesses to the Election participants did not understand their duties and roles at the polling station, and a large amount of logistics.

Abstract:
Background: The study of the futsal coach competency evaluation instrument was done because there was no any existed instrument used to measure the futsal coach competence. Objective: This research aims to determine the validity and reliability of the futsal coach competency evaluation instrument. Method: the validation and reliability instruments were determined using three quantitative methods in the main phases or steps, which are expertly judged (content validation), theory test (logical validation) and data test (construct validation). The research was done by distributing questionnaires via a google form. Result: The instrument validity data is based on the average score of the research subjects assessment. Media experts scored 90.71%, 89.5% and 93.3% in 3 aspects. While material experts scored 87.69%, 85.38%, and 96.15% in 5 aspects. The KMO and MSA factors analysis test covers four competencies results: personality 0.893, social 0.884, intellectual 0.886 coachings 0.782. The instrument is valid based on the value range of 0.517-0.954. The instrument’s reliability, divided into four competencies, is reliable because the Cronbach alpha score is higher than 0.7. Conclusion: The findings of this study brings a new insight that the coach’s competence needs to be measured using appropriate, valid and reliable instruments. The results in this study are a competency evaluation instrument consisted of 4 competencies (personality, social, intellectual and coaching). This research will certainly provide a positive point to evaluate the competencies owned by futsal coaches.

Abstract:
Many factors can increase employee job satisfaction, such as leadership style, compensation, and competence, and this certainly has an impact on improving employee performance. The purpose of this study was to determine the effect of leadership style, compensation and competence on employee performance through job satisfaction. This research was explanatory research using quantitative methods. The population was 32 employees; the sampling technique used total sampling. The analysis used in this study is path analysis using the Smart PLS program. The results of the path analysis show that leadership style and compensation have a direct effect on employee performance, while the competency variable does not directly affect employee performance. Intervening job satisfaction, while compensation and competence have no effect on the intervening variable of job satisfaction. Indirect test results also show that leadership style, compensation and competence have no effect on employee performance through job satisfaction. Thus, Micro, Small, and Medium Enterprises (MSMEs), in running their business, need to pay attention to things that can improve employee work performance, such as leadership style, compensation provided, and competencies possessed by employees so that they can achieve maximum business goals.

With the adoption of the new Law on Certification of Signatures, Manuscripts and Transcripts the Montenegrin legislator did not take into account the fact of introducing the notary services into the legal system of Montenegro. Unlike most of the comparative legislations, certification of signatures, transcripts and manuscripts have not been transferred to the exclusive competence of notaries, but a competitive competence of notaries, local administration authorities and the courts in carrying out these assignments has been retained. Further retention of competitive jurisdiction in this matter is not justified any more. The analysis of this decision has shown that it leads to an unequal position, depending on the authority before which the certification is performed, whereas the obligations and professional competences of officials and notaries are different. Notarial certifications contribute to greater legal certainty and besides are more available to the citizens and not more expensive. Parallel jurisdiction is not a standard of notarial services in European continental law which has adopted the Latin model of notary as a independent profession having public authorities. This solution does not lead to building a legal certainty, protection of public interest and relieving the work of courts and administrative authorities, which has been the underlying legal political reason for introducing notariat.

In the era of the COVID-19 pandemic, online learning has become the main alternative to the learning system taken by schools. The implementation of the online system certainly affects teachers' performance as the frontline in the success of a learning process. In this case, at least the teacher's performance has been directly or indirectly influenced by the learning system that is being carried out. This study aimed to describe and analyze the performance of teachers’ competencies during the COVID-19 pandemic. The study relied on a quantitative descriptive method, and the data were taken from the results of a questionnaire distributed to 89 teachers. The research instrument used questionnaires and interviews, which had previously been tested for validity and reliability. Furthermore, the results of the questionnaires were analyzed based on theories related to teacher performance and theories related to teacher competency development. The result showed that the teachers’ performances with the online learning system during the COVID-19 pandemic were varied and greatly influenced by the competence of the previous teacher. Based on these results, it could be concluded that teachers with high competence had higher performance than teachers with low competence in online learning. Likewise, there was an interaction between the ability of teacher competence and teacher performance in online mathematics learning. Further, the average performance of mathematics teachers in online learning was lower than the performance of teachers who use ordinary learning.

Nursing services are an integral part of health services which have a very strategic position in an effort to improve the quality of services in hospitals. With this condition a nurse is required to have the ability and professionalism in implementing professional nursing care in a hospital service. The purpose of this study was to determine the effect of competency factors, and workload on nurses' behavior in implementing professional nursing care in the Praya Hospital inpatient installation. The research design used was quantitative analytic with cross sectional approach. The sampling technique uses cluster random sampling with a sample of 114 respondents. Data were collected using a questionnaire and observation sheet, then analyzed using the ordinal regression test. The results of the statistical test by stimulatory results obtained p value of 0,000 <? = 0.05, meaning that all independent variables together affect the dependent variable. While partial statistical test results for each variable obtained results, namely competency (p <0.008) and workload (p <0.012). Multivariate analysis showed competence was the most dominant variable influencing the behavior of nurses in applying professional nursing care with a value (p <0.008). The behavior of nurses in implementing professional nursing care in hospitals is influenced by several factors including competency and workload. These aspects certainly need to be considered and managed well in the hope of getting better nurse performance results for the creation of maximum nursing services.

Corruption is a negative social phenomenon being present in all societies and states, and which can be found in all layers and relationships within a society. Corrupt practice, as an ubiquitous negative social phenomenon, certainly has its political, sociological, criminological, legal and other aspects. Bearing in mind the fact that the widespread corrupt practice significantly erodes the foundation of society, the allowance of its both survival and deepening necessarily results in the abandonment of democracy, democratic values, legal certainty and the rule of law. Therefore, every legislator, including the legislator in Republic of Serbia, prescribes various material and procedural legal measures trying to suppress corruption in the country. This paper looks at certain criminal law specific features of the incrimination of corruption at both the international and national level, but also at certain procedural aspects of prosecuting corruption crimes. In this sense, there is involved the competence of the specialized prosecuting and judicial authorities, including special evidentiary actions that are regularly used in discovering and prosecuting corrupt criminal offenses.

The existing regulations of Administrative Court do not regulates the procedural process to proceed general election administrative disputes, and the competence of Adminisitrative Court are limited. This becomes a legal gap in law enforcement and legal certainty. The issue is how the competence of administrative court to setllement the administrative dispute of general election based on the regulations.The method is juridical normative by statute approach, conceptual approach. Statute approach and conceptual approach by compared the relevant regulations.The result shows that the Administrative Court has competence to settlement the administrative dispute of general election. To give law certainty and law enforcement, the Supreme Court had legitimized some regulations to proceed the disputes settlement. The novelty is there should be a new regulation of Administrative Court consider the development and modernization.

The result of this action research indicates that coaching through academic supervision supervisors can improve the performance of teachers in designing learning systematically in kindergarten Patronage Bengkulu City reached 100% completeness.

Actualmente la población inmigrante supone alrededor del 10% de la población. Este proceso implica una responsabilidad conjunta para adaptarse a los cambios y un desafío para la prestación de servicios educativos, sanitarios y asistenciales. El contacto con una nueva cultura conlleva una serie de dificultades que tienen impacto sobre el individuo y estar en el origen, evolución y pronóstico de muchos trastornos de salud mental, rendimiento educativo y adaptación sociolaboral. Factores específicos como el proceso migratorio, las rupturas de vínculos afectivos y sociales, las condiciones de trabajo precarias o la percepción de discriminación, pueden ser fuente de estrés y de malestar, sin duda son factores de mayor vulnerabilidad para una población inmigrante. La formación y capacitación en competencia multicultural se ha mostrado como la herramienta más eficaz para la atención a la diversidad cultural. En España el interés por la formación en competencia multicultural en el ámbito de la psicología es escaso aun cuando aparece como una de las competencias trasversales en el libro Blanco del Título de Grado de Psicología de la Agencia Nacional de Evaluación de la Calidad y Acreditación (ANECA). La literatura consultada muestra que la competencia multicultural es la herramienta más adecuada tanto a nivel profesional como institucional para una atención de calidad. El propósito de este artículo, de carácter teórico, es mostrar la realidad multicultural en España, reflexionar acerca de la importancia que se le da en la formación universitaria en la carrera de Psicología, y plantear la necesidad de impulsar el aprendizaje en competencia multicultural para responder de manera efectiva a las necesidades existentes y a los nuevos retos como es la crisis de los refugiados.In recent years Spain has seen a substantial increase in immigrant population being an exceptional case in European history to receive five million people less than 10 years. Currently the immigrant population accounts for about 10% of the population. This process involves a joint responsibility to adapt to change and challenge for the provision of education, health and care services. Contact with a new culture involves a series of economic, social difficulties of an information or communication that impact on the individual and can be the origin, evolution and prognosis of many mental health disorders, educational performance and social and labor adaptation. Specific factors such as the migration process, ruptures of affective and social ties, poor working conditions or the perception of discrimination, can be a source of stress and discomfort, certainly are factors more vulnerable to an immigrant population. Training and training in multicultural competition has proven to be the most effective attention to cultural diversity tool. In Spain the interest in training in multicultural competence in the field of psychology is scarce, even when it appears as one of the transversal competences in the White Paper of the Degree of Psychology of the National Agency for Quality Assessment and Accreditation (ANECA). The literature shows that multicultural competence is most suitable both for professional and institutional quality care tool. The purpose of this theorical paper, is to show the multicultural reality in Spain, reflect on the importance given in university education in the career of Psychology, and raise the need to promote learning in multicultural competence to respond effectively to existing needs and new challenges such as the refugee crisis way.

One of the important positions of the last curricular reform in Slovenia, which included systemic issues of education (White Paper on Education, 2011) and curricula for compulsory subjects in primary school, is the fact that Slovenia has been integrated into Europe, and thus education should also include the development of core European competences. One such competence is cultural awareness and expression, which until now has been an issue more in the context of cultural policies than school policies in Slovenia. The purpose of the present article is to critically analyse the curricular reform of art education (i.e., visual art education), through which, in terms of certain components of the competence of cultural awareness and expression, it is foreseen that the student will gain a knowledge of art, develop an ability to experience works of art and develop a creative attitude towards art and heritage.Because the starting point and goal of curricular change is the curriculum, our analysis is derived from curriculum theories, and not from the art theories and pedagogical theories that have predominantly framed previous attempts at curriculum analysis. Critical consideration of the curricular reform of art education in primary school in terms of certain components of the competence of cultural awareness and expression was undertaken by comparing curricula in the field of aesthetic education. We compared art education with music education and literature within the Slovenian language curriculum. Qualitative analysis showed that, despite the reform, the curriculum for arts education does not realise selected components of the competence of cultural awareness and expression, largely due to the curriculum’s conceptual structure. Art education is centred principally on art-making activities, with an obviousneglect of appreciation. The integration of arts subjects at school, as proposed by the White Paper, is therefore not possible, due to the existing model of art education. From a practical point of view, the analysis also raised the question of the knowledge and competences of teachers.

Introduction Previous studies indicated, that mentalization mediates the link between adult attachment and stress, however, this relationship was not tested before among non-clinical parents of children aged between 12 and 18 years. Objectives The aim of this study was to explore the relationship between parental reflective functioning, attachment style, perceived parental sense of competence, and stress among parents. Methods After providing written consent, 186 non-clinical mothers completed a questionnaire packet that included a demographic form, The Parental Reflective Functioning Questionnaire - Adolescent version, the Attachment Style Questionnaire, the Parental Sense of Competence Scale, and the Perceived Stress Scale. A moderated mediation analysis with parental sense of competence as a dependent variable, mother’s attachment style as an independent variable, certainty about mental states hypermentalization subscale as a mediator, and stress as a moderator was conducted. Results In the moderated mediation analysis, the direct effect of the attachment style on the parental sense of competence in the case of preoccupied attachment style was significant (p < .001). The interaction term of the hypermentalization subscale by perceived stress was also significant in the case of low level (w = -1.57, p < .001) and high level of perceived stress (w= 1.21, p = .049) among mothers with a preoccupied attachment style. Conclusions These findings suggest that the preoccupied attachment style is related to the parental sense of competence through certainty about mental states hypermentalization in case of low level and high level of perceived stress, so mentalization-based interventions are warranted. Disclosure No significant relationships.

Purpose – The purpose of this paper is to address the role of intermediaries in open innovation networks in achieving ICT-enabled innovations. The ultimate goal of open innovation networks is to create value for endusers and providers, and to share the risks and rewards. The aim of this paper is to analyse the competences that intermediaries in open innovation networks need to master and exploit during the exploration and exploitation phases of an innovation process. Design/methodology/approach – Based on 14 cases, all of which are examples of collaborative multi-party projects with a focus on ICT-enabled innovations, the paper inductively develops a competence model for intermediaries that can be applied at different stages in the innovation. Findings – The research shows that intermediaries can play an effective role in open innovation, provided they have the right set of competences. It can be concluded that the role of innovation intermediary is most relevant in the creation and development phases. Research limitations/implications – This study certainly has its limitations. The researchers were involved in several cases, which may have biased their views, even though an external expert who was familiar with the case and the work of the intermediary was involved to minimize the risk. Most importantly, the cases all involved of a single intermediary, albeit with many different private and public partners. The cases were primarily located in the Netherlands. It would be interesting to complement this study with results from other innovation intermediaries. Practical implications – The paper identified which competences of organizations in innovation are required, and how to balance the competences between the different partners, including the innovation intermediary. The study allows to link the type of goal of the collaboration to a number of best practices, including the competences and roles that are required at different stages. Originality/value – The paper combines the core innovation competences with the innovation value chain concept developed, and evaluate the resulting model in 14 different cases. The model is new and relevant in practice.

The transformation into stated-owned legal body (BHMN/BHP) makes quite a significant impact on UT management, since the autonomy is wider and consequently it brings bigger responsibilities and challenges. One of these challenges is adjusting compensation system which previously referred to Civil Servants System and currently has several weaknesses, such as externally less competitive salary level, very close gap between highest and lowest salary and minimal concern about performance. It leads to the need of designing new compensation system during UT-BHP transitional period (2008-2017). Competency based Pay (CbP) which is rewarding the way people work, not just recognizing what they can be deliver, fits the academic world. In a learning organization, colleges and universities certainly qualify, the focus on competence and the importance of individual growth is tied explicitly to the organization’s mission and value also consistent with the growing interest in life long learning. The acceptance of individual development and skill acquisition as the criteria for rewarding staff employees should be a natural in higher education. This compensation design is focused on academic staffs, which are lecturer, researcher, and managerial position. The reflections undertaken in this article focus on the role that civic education plays in education for peace. Certainly these two areas of educational activity are not the same; Education for Peace is a much broader and more complex process, requiring the involvement of all teachers. However, the knowledge, competences and motivations that should be developed as preparation for responsible civic participation are very important for building a peaceful order. I begin my reflections with a brief discussion of the most important issues related to contemporary perception of peace. Next, I refer to the terms "citizen", "citizenship", to highlight their meaning and in this context to reflect on the most important areas of civic education. This is the starting point for showing the tasks included in civic education as essential in the process of building peaceful coexistence of people. These tasks concern different areas of civic education: cognitive, competence, affective, and value areas.In carrying out these tasks we can hope to educate people who contribute to peace building through responsible civic activity.

Rhetorical competence among Polish university students of German as a foreign languageAccording to the Bologna Process reforms, the orientation of university teaching and learning towards competence is the key to the ‘future employability’ of graduates. One such skill is rhetorical competence in oral communication, which is crucial to both lifelong learning and to the workplace. The teaching of this key competence would certainly ease the transition between university and working life. However, particularly in German Studies programs at Polish universities, the transmission of rhetorical competence is often of peripheral importance – if it is taught at all. Often, this skillset is simply expected of students, for example when they are required to give an oral presentation. This contribution examines the competence of Polish-speaking students of German as a foreign language in an intercultural learning context. It will focus in particular on the capturing of possibilities for improvement, particularly on the communicative effect on German native speakers of non-native speakers making oral presentations.

The purpose of this study was to analyze the relationship between the characteristics of midwives and internal marketing efforts (empowerment, reward system, and capacity building) with midwife loyalty. This research is an analytical study with a population of midwives involved in PONED services at Puskesmas. The results showed that employment status has a positive correlation with loyalty (sig = 0.019). Empowerment efforts and reward systems have no relationship with midwife loyalty, while efforts to increase competence have a positive relationship with commitment (sig = 0.037). In conclusion, the certainty of employment status and the better the efforts to increase competence carried out by the Puskesmas will determine midwives' loyalty in PONED services. Assessment in higher education requires multifaceted instruments to capture competence structures and development. The construction of a competence model of preservice mathematics teachers’ mathematical abilities and epistemic beliefs allows for comparing different groups at different stages of their studies. We investigated 1st and 4th semester students with respect to their epistemic beliefs on the certainty of mathematical knowledge (assessed by both denotative and connotative judgments) and their mathematical abilities (defined as critical thinking with respect to mathematical problem situations). We show that students’ beliefs change during the first four semesters, and that the level of critical thinking does not depend on belief orientation but goes along with the level of sophistication of the epistemic judgments uttered by the students.

I read with interest the article concerning the New York panel that wants to have physicians take competency tests for relicensure. I welcome this effort and would encourage this with one qualification: that our elected officials, especially those at the state and federal levels, have some basic education before governing similar to that required of physicians before practicing medicine. We cannot begin to practice medicine until we have gone through years of rigorous, demanding preparatory education, then must pass competency tests (board exams). Our elected officials, however, have no such requirements. I would suggest that these elected officials have some basic education in governing and be required to maintain a certain grade-point average before they are permitted to run for office. They should be required to take competency tests concerning world history, economics, human relations, and world affairs. Politicians also should not be exempt from recertification. Certainly, world politics have changed as much or more than anything in the field of medicine.

Researched are factors that prevent teachers from realizing their information and communication competence in their professional activities and identifying opportunities to overcome them. To achieve this goal, the paper analyzes the results of modern scientific, theoretical and sociological research. Digital literacy of a teacher is considered in the article as an integral component of his information and communication competence, which ensures the effective development of the entire system of digitalization of education at the university. The paper focuses on the study of the components of the digital aspect of this competence, which determine the content of the relevant training. An important place is given to identifying the real level of information and communication competence of modern teachers, including those related to distance learning technologies, as well as determining the reasons that affect the lack of activity of teachers in educational-digital activity. The results of the study allow to conclude that the main problems of the development of the faculty of the graduate school of information and communicative competence (including digital) and its full realization in professional activity are: lack of certainty of the digital aspect of competence, weak system of motivation of teachers to master and apply digital tools and technology in professional activities, insufficient resources, technical and financial support of teachers in the implementation of their digital competence.

Legal certainty is needed so that order can be realized. One of the efforts that can be done is positive integration between the government and the ulama in determining the competence of a muftī. This article provides discourse and solutions regarding the criteria for a muftī in providing legal answers in extraordinary cases (nawāzil). Ordinary Muslims in this matter become an important concern, because they need legal certainty from experts. Wrong in seeking legal solutions, of course, has an impact on legal misguidance. More than that, the phenomenon of the emergence of an impromptu muftī, of course, can cause legal chaos. Through a literature study, this paper concludes that the presence of a credible muftī and fatwā institution is a must for a country, so that legal products that realize the benefit of the people can be realized.

This paper aimed at exploring judges’ disparity in deciding divorce disputes in religious courts and district courts. Disparity is not only the differences in legal subjects that obey the absolute competence of different judicial environment but also the norms that serve as guidelines. This research is empirical juridical research with primary data namely judges’ decision and the results of judges’ interview. This research found that there were several disparity differences between religious and district judges in deciding divorce disputes. First, the considerations of district court judges were oriented to the aspect of legal certainty over juridical considerations. Second, besides paying attention to legal certainty aspects, the panel of judges at religious courts also considered religious aspects in making decision. Consideration of the rules of Islamic law has a very important role for judges in making decisions.

La inserción laboral repercute positivamente en el entorno del colectivo de personas con discapacidad intelectual (DI), y el empleo es decisivo en su proceso de integración social y participación comunitaria. Se pretenden optimizar los procesos de integración laboral y desarrollo profesional de las personas con DI leve y moderada para facilitar su inclusión social. Se realizó un muestreo no probabilístico de tipo incidental, en el que participaron 16 centros ocupacionales de la provincia de Barcelona. Se creó y aplicó un cuestionario a 100 personas con grados de DI leve y moderado. Se utilizó un diseño de investigación no experimental, en el que se analizaron las competencias profesionales de los participantes en su contexto natural (centros ocupacionales). Se constata una relación (positiva y moderada) estadísticamente significativa entre todas las competencias. Las personas con DI tienen un desarrollo similar en las competencias analizadas; las que presentan un grado de DI leve muestran niveles competenciales superiores a los de las personas con DI moderada. Es destacable que, independientemente del grado, todas las competencias evaluadas superen la puntuación media. Seguramente el hecho de que las personas analizadas estén ubicadas en centros ocupacionales es una variable que facilita su desarrollo competencial. Labour integration has a positive impact on people with Intellectual Disability (ID), being employment a key element in their process of social integration and community participation. The aim of this research is to optimize the labour integration and professional development of people with mild and moderate ID in order to facilitate their social inclusion. A non-probabilistic incidental sampling was carried out, with the participation of 16 occupational centres of Barcelona’s metropolitan area. A questionnaire was created and administered to 100 people with mild and moderate ID. A non-experimental research design was used, in which the professional skills of the participants in their natural professional context (occupational centres) were analysed. Results show a statistically significant relationship (positive and moderate) between all the competences. People with ID have a similar development in the analysed competences; those with a low degree of ID show higher levels of competence than those with moderate ID. It is noteworthy that, regardless of the degree, all the evaluated competences exceed the average score. The fact that the participants in the research are located in occupational centres is certainly a variable that facilitates their competence development.

Nursing competency test is a process that must be passed by nursing students to measure the suitability between knowledge, skills and student behavior against competency standards of graduates who meet work competency standards. Only students who pass the competency test are able to enter health services. Passing competency test is certainly influenced by various aspects, some of them are GPA and study period. Both of these things are an important role in the teaching and learning process that a student goes through. GPA is an indicator to assess learning achievement and the length of study is the time taken by the student to complete his studies. However, recently there has been an assumption among students that a high GPA does not guarantee in passing competency test and a prolonged study period does not prevent students from first passing the competency test, therefore researchers are interested in seeing the correlation of the two things. Objective The aim of the reasearch was to determine the correlation between Grade Point Average (GPA) and the period of study toward passing the Nursing Competency Test in Nursing Departement of the Health Polytechnic of the Ministry of Health in Mamuju. Method This research is an analytic study with cross sectional design using secondary data. This research used total sampling with a sample size of 138. The Result showed that GPA had p<0,001 with correlation r= 0,908 and the study period had p<0,001 with correlation r=0,291. The Conclusion of the research is GPA had positive corelation very strong and the study period also had positive corelation but poor corelation.

Administrative Court is a specialized court under the Supreme Court with a role to settle the administrative disputes included staffing disputes. The legitimation of Law No. 30 of 2104 concerning Government Administration has brought a new paradigm in the governance framework. Also, the competence of the Court is broader than before. In Addition, some regulations give more competence to the Court. It is normative juridical research. It uses statute, conceptual approach to observed, analyzed and discussion on the issues. This research is to develop the relations between the competence of the Court and administrative justice. Based on the research, broader competence gives more opportunity to get access to justice.In conclusion, administrative justice has some meanings; first, it is the rights of an individual. Therefore, the government has to provide detail, clear information for any individual before issuing a decree based on the application, rights to claims and revision for any mistakes. Second, the defendant must obey and implement the judicial verdict. This obligation as an implementation of administrative justice and legal certainty for Plaintiff and obedience by the Defendant to the judge verdict. Third, administrative justice should be supported by the regulations by obeying the judge verdict. This is part of improving the quality of governance.
