This concluding chapter offers a synthesis of the law around fitness to stand trial drawn from the different jurisdictions surveyed in the book. While individual jurisdictions have crafted their own solutions to questions of definition, procedure, and disposition, a range of specific issues have come to the fore requiring further analysis and resolution. These include the permissibility or otherwise of compulsorily medicating incapacitated defendants to restore competence, the desirability of disaggregating the unitary test for fitness, the movement from cognition to decision-making capacity as the focus of unfitness, the utility of the decisional competence construct, and the parameters of effective participation. While no single jurisdiction offers an entirely satisfactory way of dealing with the unfit to plead, what the differing approaches show is how important it is to endeavour to find approaches to the problems in the law and procedure in this complex area.

Establishing a successful rapid response system (RRS) requires policy and procedure that supports the system. The purpose of the policy is to outline organizational resources, process of care for patients, employees, and other non-hospitalized persons who experience a crisis or life-threatening circumstance while on the hospital campus. The policy should define the scope of the system, provide definition for terminology associated with the team, define the types of emergencies that will be addressed by the team, and any special circumstances to be considered. The associated procedure should provide detail on all aspects of the system including the criteria for calling the team, responsibilities of team personnel, and identification of any necessary specialty resources and equipment and how to access them. In this chapter, we will explore the elements of creating a policy, detailing a corresponding procedure, establishing and maintaining competence of the team, and monitoring quality of the RRS.

This chapter assesses competency to stand trial in Italian Criminal Procedure, using a two-pronged analysis. First, there is analysis of the relevant provisions of the Italian Code of Criminal Procedure (CCP). Pursuant to these provisions, the trial must be suspended in case the defendant is not capable of meaningful participation. The CCP also regulates various aspects connected to this incapacity. In particular, it sets forth the grounds on which the suspension must be granted and provides for the means through which the incompetency should be ascertained, if not immediately apparent. The picture painted by the Code is complex and many of these provisions have been challenged as unconstitutional in front of the Constitutional Court, with different results. The chapter focuses on such problems, in order to illustrate the approach of the Constitutional Court, as well as examining the solutions proposed by legal scholarship, including the definition of incapacity.

Many of the critical moral decisions related to the care of terminally and critically ill patients actually involve the ethical issues of informed consent or the refusal and withdrawal of consent. Legal as well as most ethical theories consider the moral principle of autonomy to take priority over paternalism. If this is true, then it is acceptable for the substantially autonomous patient, even if treatment is life-sustaining, to decline or to withdraw consent. This chapter begins with the problems associated with definitions of death. In succeeding sections, the cases deal with decisions by surrogates for terminally or critically ill patients who are not competent to make their own choices, looking first at formerly competent patients and then at those who have never been competent. In the final section, the issue is new controversies over limiting the amount of care that is provided to terminally ill patients in order to conserve scarce medical resources.

This chapter reviews three chapters concerned with the definition and measurement of 21st skills. Technology and other factors cause jobs to change, and so it is reasonable that the skills required in the workforce also change. Employer surveys suggest that communication, teamwork, leadership, work ethic, and problem solving are sought-after skills for new hires. The three chapters contribute to our understanding of workforce readiness by summarizing existing findings and suggesting new fertile research areas, including improving measurement of 21st century skills and focusing particular attention on the constructs leadership, teamwork, creativity, and cross-cultural competency. The chapters also point to the importance of both teaching these skills in school and the workplace and monitoring their growth and development.

The success of the language program was ultimately to be judged by the ability to communicate the gospel message to the Indian neophytes. The same criterion regulated the fierce competition within the colonial clergy for Indian parishes, or doctrinas. Secular priests vied with regular clergy and locally born creoles with peninsular Spaniards for control of these lucrative benefices, for which the principal qualification was competence in the parish’s main indigenous language or languages. Despite diocesan language examinations to ensure sufficient mastery to preach and administer the sacrament of confession, definitions and standards of proficiency varied widely. Over time the secular clergy, dominated by often bilingual creoles, began to edge out the more formally trained regulars. But the minority languages, especially in distant, impoverished doctrinas, remained ill served.

This chapter follows up on the issue of the American public's reception of constructivist ideas. Interviews were conducted with anthropologists, biologists, and undergraduate students, and a sample of high school textbooks was consulted due to their better representation of what is being taught to the general public than college-level textbooks. Most of the textbooks transmitted essentialist views of the definition of race. When undergraduate students were asked how they would define race, most equated race with culture or utilized biological descriptions. The professors with essentialist views believe the academics who see race constructively are not real or competent scientists, and vice versa. Because natural sciences hold a prestige advantage over social sciences, essentialism has the upper hand when it comes to perceptions of scientificity.

Dictionary definitions concur that “acculturation” means second-culture acquisition, but “acculturation” began as a Eurocentric concept that inferior peoples improve themselves by imitating superior peoples. Shadows of this persist despite the acceleration of acculturation research from nine studies per decade in the 1920s to the current rate of more than 6000 per decade. Reviews of this research have noted confused findings and lack of utility. Critics either (1) advocate for qualitative methods because culture, identity, and human experience are too complex for psychometric methods, or (2) recommend new models and new forms of quantitative analysis, or (3) fault research for poor social science practices. Rudmin (2006) has argued that academics’ shared liberal ideology causes collective confirmation bias that shapes research to promote advocacy of bicultural integration. Many future research designs and projects are proposed, including emic studies of rural-urban migration in China and the development of single-case measures of acculturative competence.

I defend four main theses: (1) Knowledge, in Plato’s vocabulary, is a kind of conceptual competence, involving ‘knowing what it is’ about something like virtue or justice; (2) There is a corresponding special meaning of the verb ‘is’ that occurs in the expression ‘knowing what it is’, which is key to understanding what Plato means by claiming that Forms have a superior kind of being; (3) When one knows ‘what it is’ about such concepts, one knows neither a proposition, nor set of propositions, nor an object, but something like a type. Plato’s term is eidos. Plato rightly notes that, in ordinary experience, we never encounter types, only tokens; (4) Although encountering such tokens does not constitute knowledge, it can provide a ladder whereby philosophers can attain a better grasp of the truths in question. Plato’s preferred philosophical method turns out to be an ‘iconic method’—consciously using images and particulars as stepping stones in the enquiry. Via case studies from the Meno, Republic, and Theaetetus, I establish that these theses are not only compatible with the texts, but render some otherwise puzzling passages intelligible. I show that Plato diagnoses, and deliberately sidesteps, the impasse of Socrates’ fruitless quest for definitions, developing a new method inspired by geometry’s ability to deal pictorially with indefinable lengths. The book offers a novel picture of Plato as resisting and overcoming, not following, the Socratic obsession with definitions, and adopting, not resisting, the use of pictorial proofs and imagery.

Psychometrics permits the quantification of cognition, affect and behaviour, thus permitting both the identification of pathology and degree of deviation from normality. These methods have been principally used in older populations to screen affective and cognitive disorders, as an adjunct to the differential diagnosis of different forms of cognitive dysfunction and also to describe and monitor the functional consequences of pathology. The application of psychometric tests in older populations raises several problems, notably the confounding effects of associated pathologies, changing definitions of disease threshold in parallel with advances in medical technology, and inadequate knowledge of normal information processing at higher ages. Computerized assessment, once considered inappropriate in older populations, is now commonly used to standardize administration procedures and tailor testing to individual competency. It has also permitted the more accurate measurement of information processing time, which is important in the diagnosis of many neuropsychiatric disorders.

Multistakeholder partnerships (MSPs) are formed to tackle knotty societal problems, promote innovation, provide public services, expand governance capabilities, set standards for a field, or resolve conflicts that impede progress on critical issues. Partnerships are viewed as collaboration among four types of stakeholders: businesses, governments, nongovernmental organizations (NGOs), and civic society. The objective of collaboration is to create a richer, more comprehensive appreciation of the iss/problem than any of the partners could construct alone by viewing it from the perspectives of all the stakeholders and designing robust solutions. Such partnerships are necessary because few organizations contain sufficient knowledge and resources to fully analyze issues and take action on them unilaterally. Five essential components of a rigorous definition of collaboration are presented: interdependence among partners, emergence of shared norms, wrestling with differences, respect for different competencies, and assuming joint responsibility for outcomes. Several examples of MSPs are provided.

This essay aims to educate scholars and practitioners about the context of lesbian, gay, bisexual, and transgender (LGBT) parenting and perinatal psychology in LGBT people to further research on this population, as well as to ensure provision of appropriate care during the perinatal period. The essay begins by providing an overview of the minority stress framework, a theoretical framework that is useful in understanding the mental health concerns of LGBT people. The essay then discusses language and definitional issues, providing a brief glossary of key terms necessary for culturally competent work with LGBT people. Next, an overview is provided of the ways in which LGBT people are forming families in contemporary society. As the health care industry continues to grow, it is critical that those entering health care careers possess interprofessional competency and a collaborative skill set. This study explores the planning considerations of the United States military in formulating and implementing policy for the occupation of Okinawa from April 1945 to July 1946. American soldiers, Marines, and sailors on Okinawa encountered not only a Japanese enemy, but a large local population. The Okinawans were ethically different from the Japanese, yet Okinawa shared politics with Japan as a legal prefecture. When devising occupation policies, the United States military analyzed practical military considerations such as resources, weapons capability and terrain, as well as attempted to ascertain a conclusive definition of Okinawa’s relation to Japan through conscious, open, rational analysis of racial and ethnic identity. While the Marines held steadfast to the image of the enemy civilian, soldiers’ ideas about the race, ethnicity, and identity of the Okinawans evolved through their interactions with the civilians on the battlefield. As the population exhibited obedience and cooperation, the Army expressed feelings of kinship toward the civilians and reshaped its military government policies toward leniency. With the exception of the Marines, the U.S. military recognized the Okinawans as competent and civilized: a group that formed a distinct, separate, unique ethnic community that was neither American nor Japanese in its likeness. Considerations of race, ethnicity, and identity by the Americans deeply influenced the conduct of the occupation beyond practical concerns of resources and battlefield conditions. The mercurial nature of the identity of the Okinawans displays both the malleability of race and ethnicity and its centrality in occupation planning.

Fraud and misconduct are firstly introduced by clearly defining the meaning of the two words along with what constitutes good data quality and data integrity. Falsification, Fabrication and Plagiarism are discussed. The concept of how regulators view high quality data is described along with the consequences of falsification. The chapter then goes on to present multiple definitions of fraud and misconduct to show similarities and differences between regulatory authorities in the UK and US as compared to other organisations such as the Royal College of Physicians, the Medical Research Council Policy and UK Research Integrity office. Additionally, five landmark and historical cases are presented to demonstrate what constitutes fraud. The General Medical Counsel's role in protecting public safety by ensuring proper medical standards is described along with the UK Research Integrity Office (UKRIO) and the EU Competent Authority roles in conducting investigations of suspected fraud and misconduct cases. The important roles of whistleblowers are described as well as COPE's role in reviewing published medical journal's research. Practical examples are provided to be used for the detection of fraud as well as specific approaches used by the pharmaceutical industry to detect fraudulent data. In the US, databases are available to conduct searches for individuals who have committed fraud such as the Office of Research Integrity (ORI) and the PHS Administration Action Bulletin Board. Additionally, the process for how fraud and misconduct cases are handled in the UK are discussed along with the options available for regulators, such as the MHRA, on sharing information with the public.

The law of international crimes has become increasingly dense over the years, which has rendered the law of international crimes more sophisticated and more complex. This is perhaps most apparent in relation to the law of crimes against humanity. From a single paragraph in Article 6 of the Nuremberg Charter, the law of crimes against humanity has grown into dozens of interacting definitional elements and an extensive body of practice. As part of this development, crimes against humanity have established their own normative identity with a distinctive chapeau or contextual element and a broad range of underlying offences, including discrimination-based crimes, penal translations of what are in effect serious human rights violations, a series of gender-based crimes and a residual offence of ‘other inhuman acts’. The combined effect of a sophisticated body of criminal law, international obligations directed at ensuring accountability and a multiplication of judicial venues competent to adjudicate upon such crimes, carries with it the hope that crimes against humanity could become an effective enforcer of international justice. However, resistance to full and universal accountability for such crimes is still a powerful political reality that undermines the possibility of justice and the institutions that are devoted to it. The present volume hopes to contribute to achieving that goal as the law of crimes against humanity is as important and relevant today as it was when first enforced. As it stands today, that law is a testimony to the efforts of many who have strived to ensure that atrocities should not remain unpunished.

The book consists of six chapters devoted to relevant and topic issues relating to the core business of an industrial enterprise. Chapter 1 The nature of the industrial enterprise is an introduction to further considerations and deals with the essence of the basic aspects of the company. Both popular and less known definitions of an enterprise, its features, functions and principles of operation are presented. An important part of the chapter is the presentation and formulation of strategic, tactical and operational goals. Moreover, the division of enterprises is presented with the use of various criteria and the features of the industrial market, which make it distinct. Chapter 2 The operational management evolution and its role in the industrial enterprise discusses the evolution and concept of production and operational management. The management levels were also presented, indicating their most important functions. An integral part of the chapter is the essence of the production system, viewed through the prism of the five elements. Chapter 3 Functions and role in operations management presents the issues concerning the organization of production processes, production capacity and inventory management. Agentes públicos de maneira geral estão percebendo a necessidade de inovar e aperfeiçoar os serviços públicos. Outro não poderia ser o caminho, pois o Estado, a quem os agentes públicos prestam seus serviços, intervém direta e indiretamente na ordem econômica por autorização da Constituição da República Federativa do Brasil, de 5 de outubro de 1988, nos termos do art. 173 fincado no Título VII, que trata da Ordem Econômica e Financeira. Das formas de intervenção indireta estatal apontadas pelos estudiosos, o planejamento é decerto aquela que mais se relaciona ao bom desempenho do setor público. Com a escassez de recursos materiais, humanos e financeiros, planejar se tornou uma ação vital para a administração pública. Não por acaso, a Constituição Federal estabelece em seu art. 174 que o planejamento é determinante para o setor público, o que destaca a relevância do planejamento estratégico e o impacto dessa atividade nas Instituições. No atual cenário de crise econômica e restrições a recursos financeiros, preconiza-se a necessidade e a exigência de um Estado mais eficiente no manejo dos gastos públicos para o atendimento mais eficaz das demandas da sociedade. Neste sentido, importante avanço foi incorporado ao nosso ordenamento pela nova Lei Geral de Licitações e Contratos, a Lei nº 14.133, de 1º de abril de 2021, ao positivar os novos princípios do planejamento, da transparência, da eficácia, da segregação de funções, da motivação, da segurança jurídica, da razoabilidade, da competitividade, da proporcionalidade, da celeridade, da economicidade e do desenvolvimento nacional sustentável. Merece destaque a sustentabilidade, uma vez que na Lei de Licitações (Lei 8.666/93) o tema era superficialmente abordado, ficando a cargo da discricionariedade administrativa. Entretanto, com o advento da Nova Lei de Licitações e Contratos (Lei nº 14.133/2021), o desenvolvimento nacional sustentável assume o duplo papel de princípio e de objetivo da licitação. Percebe-se que o novel diploma caminha à inovação e a modernização da já defasada legislação em vigor, possibilitando a unificação de regras, além de gerar uma maior agilidade nas licitações e execução dos contratos administrativos. É aqui que as contratações públicas assumem relevância no desenvolvimento econômico dos entes políticos, seja na esfera federal, estadual ou municipal. Seu executor, o gestor público, é personagem principal da aquisição proba, eficaz e transparente, em atuação sempre pautada pela legalidade e inovação com vistas à proposta mais vantajosa em contrapartida à promoção do desenvolvimento sustentável. Em consequência, oplanejamento torna-se rotina obrigatória e fundamental a qualquer instituição não apenas enquanto instrumento de gerenciamento orçamentário, mas também como ferramenta para o aumento da oferta e da qualidade dos serviços públicos disponíveis aos cidadãos, devendo ser incorporado a toda atividade administrativa. Esta Cartilha tem por objetivo informar aos gestores públicos, de maneira clara e precisa, sobre a chamada "fase interna da licitação", que pela nova Lei Geral atende por “fase preparatória”. É um estímulo à incorporação de valores e do necessário planejamento nas aquisições de bens e serviços para atendimento às necessidades do Poder Executivo Municipal de Camaragibe, em face de sua extrema relevância no cotidiano dos gestores e seu impacto direto na realização de qualquer despesa pública. A formulação deste produto partiu da necessidade de reestruturação funcional do Ente Público, vítima de quebra da continuidade nos procedimentos administrativos em decorrência de acontecimentos políticos que lhe modificaram a conformação do Poder. Com a vigência da nova Lei de Licitações e Contratos (Lei nº 14.133/2021), emergiu com mais vigor a necessidade de organização dos procedimentos licitatórios, fundamentais para a transparência da gestão a possibilitar o inescapável controle externo. Mais que reestruturar o fluxo dos processos utilizados em sua atividade material, foi preciso inovar a prática administrativa com o uso oportuno do período de transição do novo diploma (que possui lapso temporal de dois anos) para compatibilizar a utilização da legislação anterior, que ainda produz efeitos jurídicos, com a nova Lei. Para isso, foram empreendidos estudos para atualizar os procedimentos da Lei nº 8.666/1993, da Lei nº 10.520/2002 e da Lei nº 12.462/2011, com vistas à implantação das mudanças que deverão ser necessariamente aplicadas a partir de 1º de abril de 2023, com a revogação obrigatória das normas anteriores e o estabelecimento pleno e definitivo da Lei nº 14.133/2021. Assim, esta Cartilha destina-se a consagrar a boa prática administrativa, estruturando procedimentos que induzem a uma gestão integra, competente, eficaz e transparente, com foco na inovação e nas modernas ferramentas de gestão que traduzem o compliance enquanto instrumento da prevenção de riscos no âmbito da atividade administrativa pública. The study is funded by Doha International Family Institute (DIFI), a member of Qatar Foundation, and is a collaboration between the Muslim Resource Centre for Social Support and Integration of London, Ontario; University of Guelph, Ontario; and University of Calgary, Alberta, all located in Canada; and the Doha International Family Institute, Qatar. The study received research ethics approval from the University of Guelph and the University of Calgary. This study aims to assess the impact of pre- and post-migration on marital relationships and family dynamics for Arab refugee families resettled in Canada. The study also examines the role of professional service providers in supporting these Arab refugee families. The unique experiences of Arab families displaced from their countries due to war and political conflict, and the various hardships experienced during their stay in transit countries, impact their family relations and interactions within the nuclear family context and their interconnectedness with their extended families. Furthermore, these families encounter various challenges within their resettlement process that interrupt their integration. Understanding the impact of traumatic experiences within the pre-migration journey as well as the impact of post-migration stressors on recently settled Arab refugee families in Canada provides insight into the shift in spousal and family relationships. Refugee research studies that focus on the impact of pre-migration trauma and displacement, the migration journey, and post-migration settlement on family relationships are scarce. Since the majority of global refugees in recent years come from Arab regions, mainly Syria, as a result of armed conflicts, this study is focused on the unique experiences of Arab refugee families fleeing conflict zones. The Canadian role in recently resettling a large influx of Arab refugees and assisting them to successfully integrate has not been without challenges. Traumatic pre-migration experiences as a result of being subjected to and/or witnessing violence, separation from and loss of family members, and loss of property and social status coupled with experiences of hardships in transit countries have a profound impact on families and their integration. Refugees are subjected to individual and collective traumatic experiences associated with cultural or ethnic disconnection, mental health struggles, and discrimination and racism. These experiences have been shown to impact family interactions. Arab refugee families have different definitions of “family” and “home” from Eurocentric conceptualizations which are grounded in individualistic worldviews. The discrepancy between collectivism and individualism is mainly recognized by collectivist newcomers as challenges in the areas of gender norms, expectations regarding parenting and the physical discipline of children, and diverse aspects of the family’s daily life. For this study, we interviewed 30 adults, all Arab refugees (14 Syrian and 16 Iraqi – 17 males, 13 females) residing in London, Ontario, Canada for a period of time ranging from six months to seven years. The study participants were married couples with and without children. During the semi-structured interviews, the participants were asked to reflect on their family life during pre-migration – in the country of origin before and during the war and in the transit country – and post-migration in Canada. The inter - views were conducted in Arabic, audio-recorded, and transcribed. We also conducted one focus group with seven service providers from diverse sectors in London, Ontario who work with Arab refugee families. The study used the underlying principles of constructivist grounded theory methodology to guide interviewing and a thematic analysis was performed. MAXQDA software was used to facilitate coding and the identification of key themes within the transcribed interviews. We also conducted a thematic analysis of the focus group transcription. The thematic analysis of the individual interviews identified four key themes: • Gender role changes influence spousal relationships; • Traumatic experiences bring suffering and resilience to family well-being; • Levels of marital conflict are higher following post-migration settlement; • Post-migration experiences challenge family values. The outcome of the thematic analysis of the service provider focus group identified three key themes: • The complex needs of newly arrived Arab refugee families; • Gaps in the services available to Arab refugee families; • Key aspects of training for cultural competencies. The key themes from the individual interviews demonstrate: (i) the dramatic sociocul - tural changes associated with migration that particularly emphasize different gender norms; (ii) the impact of trauma and the refugee experience itself on family relation - ships and personal well-being; (iii) the unique and complex aspects of the family journey; and (iv) how valued aspects of cultural and religious values and traditions are linked in complex ways for these Arab refugee families. These outcomes are consist - ent with previous studies. The study finds that women were strongly involved in supporting their spouses in every aspect of family life and tried to maintain their spouses’ tolerance towards stressors. The struggles of husbands to fulfill their roles as the providers and protec - tors throughout the migratory journey were evident. Some parents experienced role shifts that they understood to be due to the unstable conditions in which they were living but these changes were considered to be temporary. Despite the diversity of refugee family experiences, they shared some commonalities in how they experi - enced changes that were frightening for families, as well as some that enhanced safety and stability. These latter changes related to safety were welcomed by these fami - lies. Some of these families reported that they sought professional help, while others dealt with changes by becoming more distant in their marital relationship. The risk of violence increased as the result of trauma, integration stressors, and escalation in marital issues. These outcomes illustrate the importance of taking into consideration the complexity of the integration process in light of post-trauma and post-migration changes and the timespan each family needs to adjust and integrate. Moreover, these families expressed hope for a better future for their children and stated that they were willing to accept change for the sake of their children as well. At the same time, these parents voiced the significance of preserving their cultural and religious values and beliefs. The service providers identified gaps in service provision to refugee families in some key areas. These included the unpreparedness of professionals and insufficiency of the resources available for newcomer families from all levels of government. This was particularly relevant in the context of meeting the needs of the large influx of Syrian refugees who were resettled in Canada within the period of November 2015 to January 2017. Furthermore, language skills and addressing trauma needs were found to require more than one year to address. The service providers identified that a longer time span of government assistance for these families was necessary. In terms of training, the service providers pinpointed the value of learning more about culturally appropriate interventions and receiving professional development to enhance their work with refugee families. In light of these findings, we recommend an increased use of culturally integrative interventions and programs to provide both formal and informal support for families within their communities. Furthermore, future research that examines the impact of culturally-based training, cultural brokers, and various culturally integrative practices will contribute to understanding best practices. These findings with regard to refugee family relationships and experiences are exploratory in their nature and support future research that extends understanding in the area of spousal relationships, inter - generational stressors during adolescence, and parenting/gender role changes.
