Abstract:
This paper explores the regulation of specific performance of sales by reference to Spain and the USA, two jurisdictions which are exemplars of their respective legal families. It contrasts provisions under the Spanish Civil Code, Spain's Ley de Enjuiciamiento Civil, and under the American Uniform Commercial Code, and speculates on the interaction of these municipal laws with the regulation of specific performance under the United Nations Convention on Contracts for the International Sale of Goods (CISG). The study is split into two parts, the first of which appears here, and the second of which follows in the next issue of the Edinburgh Law Review. In this first part, section B outlines method, while section C explores the modern Spanish doctrine on performance and damages in light of the Romano-Germanic preference for performance. Section D examines the preference for damages over performance in US commercial law. By comparing Spanish and United States approaches to specific performance, Section E identifies points of possible convergence between the two systems as well as some noteworthy differences between them. In the second part of the study, Section F will explore the CISG's approach to specific performance, with the goal of inquiring, on one hand, whether the drafters have successfully accounted for both the Anglo-American and the Romano-Germanic preferences, or, on the other hand, whether the CISG's synthesis of the preferences is faulty and manifests incompatible goals that may be difficult to harmonise. Recent US decisions on specific performance under the CISG will be sampled in section G, which will make explicit some assumptions underlying the reasoning processes of US courts in commercial cases. Section H, an epilogue, will speculate on reasons for the intensity of the rivalry between proponents of specific performance as a primary remedy and those favouring damages as a primary remedy.

The first part of this article appeared in the first issue of this volume of the Edinburgh Law Review. Organic photovoltaic (OPV) solar cells represent an emerging and promising solution for low-cost clean energy production. Being flexible and semi-transparent and having significant advantages over conventional PV technologies, OPV modules represent an innovative solution even in applications that cannot be based on traditional PV systems. However, relatively low efficiencies, poor long-term stability, and thermal issues have so far prevented the commercialization of this technology. This paper describes two outdoor experimental campaigns that compared the operation of OPV modules with traditional PV modules—in particular crystalline silicon and copper–indium–selenium (CIS)—and assessed the OPV modules’ power generation potential in vertical installation and facing towards the cardinal directions.

Currently, roller bits are widely used in rock drilling, which are devices with rotating rollers armed with teeth. There are various approaches in assessing the effectiveness of rock destruction by a roller drilling tool, which can be conditionally divided into structural and technological ones. In addition, all the efficiency factors of the roller bit are related to the correspondence of its characteristics and the drilling process to the properties of the rock it destroys. The article analyzes the operating conditions of the roller bit during drilling of rocks of various hardness. On the example of operation of a two-screw drill bit, the process of power interaction of the toothed weapon with rock is considered depending on various factors, such as the shape and pitch of the teeth, angle of inclination, sharpness of the tooth and others. It is shown that kinematic characteristics of interaction of toothed armament with drilled rock have a significant influence on efficiency of process of face destruction. Virus perform harmful task on affected host computer such as possessing on hard disk, CPU time, accessing private information etc. This paper specifies the performance of (McAFee, Avast, Avira, Bitdefender, Norton) antivirus and its effectiveness on the computer. The performance is tested based on the time acquired by each antivirus to act on a computer. The parameters used to analyze the performance are quick scan, full scan and custom scan with respect to time. Through the analysis Bitdefender performance is better than other selected antivirus.

Abstract:
This paper examines performance outcomes of capitalization in the European bank market. Using a European sample with 2,504 firm-year observations for the years 1992–2012, the authors analyze the effect of capitalization as used by the financial regulators on bank risk and bank profitability with alternative accounting- and market-based measures. All accounting-based measures consistently show that higher capitalization reduces bank risk and is associated with increased profitability. Contrary to this, market-based risk measures show higher bank risk implying possibly different risk assessment by capital market participants. Our results are corroborated by an ex post analysis of bank performance in times of crisis. Higher capitalized banks have fared better after the crisis in respect of profitability and risk.

Abstract:
The amount of oil together with the water Originally in Place (OIP), makes up the liquid phase in heavy oil reservoir systems. This amount of liquid present in the pores of the reservoir system is known as liquid saturation, plays a vital role in improving oil recovery through In-Situ Combustion (ISC) process. The oil phase acts as fuel in generating thermal energy required for viscosity reduction and the water phase supports in the formation of an enlarged condensation zone that aids in higher mobility of the low viscous oil. A numerical investigation is carried out to study the role of water saturation on the performance of in-situ combustion in a heavy oil reservoir. A finite-difference based numerical model is developed and validated for water recovery. The model is then used to carry out the impact of liquid saturation on the performance of the ISC, as it plays a vital role in screening criteria for the selection of ISC. The numerical results projected a significant effect on the thermal and production profile during the process. A comparison between the effect of variation in water and oil saturations projected a significant increase in reservoir temperatures with increased water saturation than the oil saturation. The highest reservoir temperatures are observed at the maximum liquid (oil and water together) saturation. Further, the additional water drive provided by increased water saturation is observed to contribute to early production rates.

Abstract:
Massive open online courses (MOOCs) have delivered a high level of education around the world, but the significant dropout rate has impacted their educational efficiency. In MOOC, the researchers mainly focused on dropout prediction using various approaches. Our work emphasizes the real-time dataset of KDD CUP 2015 to extract certain main features, implemented by using various methods, and find out the different performance measures with different metrics. To measure early learner dropout, this work used a set of unique features extracted from real-time datasets. Individual user contributions and performance are frequently analyzed using the learning analytics framework. It also aids in the decision-making process for students in higher education. According to the data, the suggested model has a classification accuracy of 78 to 85%. The experimental results are also predicted, which one of the learning methods is mostly applicable to the dropout prediction in MOOC. In this evaluation, the performance measures are compared and the best one is reported.

There are two sectors of banks operating in Indonesia, namely Sharia banks and conventional banks. Improving performance is important in maintaining public confidence in the bank. Efficiency is one of the parameters to measure the performance of Sharia banks. This study measures the comparative level of technical efficiency of Sharia commercial banks and conventional banks by Stochastic Frontier Analysis method during 2011–2015 period by using 10 samples of Sharia commercial banks and conventional banks. Input variables in this study are total deposits, operational costs, and other operational costs. Total financing is an output variable. The results of this study show that total deposits and operational costs have a positive and significant impact on total financing in Sharia and conventional banks. The average score of the technical efficiency of Sharia commercial banks during the period observed is 0.84 and conventional banks is 0.85.

In the scientific literature there are researches presenting the comparison of the form of financial statements of business and public sector and non-profit organizations, however in Lithuania these issues have not been performed. Cross-cultural differences in national accounting and reporting create preconditions for a more detailed research in Lithuania. All this presupposes the need to evaluate pros and cons of different organizations, provides to look for commonalities between different sectorial reports. Proposals for presentation alignment of results of corporate and public sector and non-profit organizations are encountered in the literature, as well as proposals for application of different reporting formats. Detailed analysis of accounting and presentation of performance results in financial statements of business and public sector and non-profit organizations was carried out in this research. At first, it showed that all organizations prepare their performance reports on an accrual basis. The reports contain information both on results of organization's operating activity, and on financial and investment activities. Only the business organizations present information about special items. However, specifics of activities and aim to meet the different information needs of users determine that it is not appropriate to align the organization's performance reports.

Abstract:
Executive dashboards have become popular in enterprise software applications. Consequently, much advice has been offered by private consulting firms on how best to design dashboards. This paper details a couple of studies testing the advice given by the dashboard experts. The results suggest that some of the notions about how dashboard widgets should be designed might be incorrect. The results indicate that colored widgets are not necessarily inferior to simpler, colorless widgets. Similarly, fancy widgets (i.e., those with three dimensional characteristics) were not demonstrated to be inferior to plainer widgets. While some methodological challenges must be overcome in similar future studies, the results of the described studies do not support some popular ideas about executive dashboards (and data visualization in general), and suggest that the area of interest is ripe for further investigation.
