Abstract:
This research engages critically with major public sector accountability theories in relation to the development of law centres in Aotearoa/New Zealand (and comparative international examples) focusing on the two centres in Otago, the Ngai Tahu Maori Law Centre and the Dunedin Community Law Centre. Definitions of accountability are argued to be embedded within theoretical discourses which produce definable models of accountability corresponding to these theoretical statements. Case studies of the discourses of both law centres and their funding bodies are described and contrasted in terms of their views of the role of law centres, interaction with various interest groups and their accountability relationships. The data identifies a desire of both community law centres to engage with a communitarian, �bottom-up�, model of accountability, in contrast to the former social democratic-bureaucratic and current liberal �stakeholder� and �contract� models of the official funding agencies. The current dominance of the liberal �stakeholder� discourse is seen as based on professional power, hierarchical legal structure and control of funding. It is argued that any shift in the dominance of power relationships surrounding community law centres in Aotearoa/New Zealand would entail a strengthening of ties and links with the community, through seeking alternative power supports, a participatory structure and locally controlled funding. Abstract:
This thesis is about the organization of Community Law Centres (CLCs). They are established to provide legal services for those unable to pay for them in areas of legal practice of particular importance to those whose social and economic situations prevent them from exercising their rights. They were founded on the belief that their resources, human and material, should be managed and controlled by management committees made up of representatives of those who would use them, their "client community". This study aims to explore how this has been done. The context for this study is set out in Chapters One and Two. Chapter One explores the historical, theoretical and conceptual roots of CLCs, identifies operational dilemmas and challenges discussed in the literature, and establishes a conceptual framework and the research question. The review of the literature revealed that the principal organizational dilemmas facing CLCs might be conceputalized as "professional accountability" and "community control". These twin concepts have focused this research. Chapter Two discusses the methodological issues associated with the conduct of qualitative case study research. It establishes the research framework and approach for the field work and data analysis in this study. It also explains the basis for the selection of the four case organizations. Chapters Three to Seven report and discuss the data. Chapter Three discusses the manifest organizational features of the cases, observing their similarities and differences, and is mainly based on data from documents. Chapters Four to Seven address the organizational issues emerging from the data from interviews with organizational participants. Chapter Four focuses on the perceived roles and relationships of management committees. Chapters Five and Six are concerned with the roles and relationships of paid staff and volunteers respectively. Chapter Seven identifies specific environmental factors and examines their impact on the cases. Finally, Chapter Eight reconsiders the data in light of the conceptual framework - "professional accountability" and "community control" - and proposes a new conceptualization of organizational relationships in CLCs. It also identifies some implications of the study for practitioners and makes some suggestions for further research.

Abstract:
This thesis looks at the current fracking debate on a national scale, before focusing specifically on how this debate is playing out in the landscape of Central Arkansas. Focusing on the lack of national regulation, the unique array of state regulations that have popped up are assessed in their effectiveness on the ground through speaking with residents of the area. The demographics of these residents are analyzed within an assessment of environmental injustice vulnerability. This ethnographic approach also compares the de jure v. de facto outcomes of these regulations through the narratives of residents working with organizations across the political spectrum, and specifically seeks to gauge their own personal stories and experiences with regulators and the fracking industry. Other key actors are identified. This thesis concludes that agency capture is a reality for these residents, and their perceived powerlessness drastically increases the power of the gas companies that monopolize the political agenda in the region.

Abstract:

Research on the relationship between policing and homeland security has focused on issues associated with the gathering of information related to potential acts of terror such as crime mapping and environmental design such as CompStat, intelligence-gathering activities and methodologies, and effective reporting methods. However, there seems to be insufficient research focusing on methodologies and systems leading to the “natural” sharing of information that can be converted into actionable intelligence between law enforcement and faith-based organizations such as the Muslim-American community. This research considers an organized cultural competency program of sharing and community-building between local police and a specific faith-based community, in which the emphasis is on an overall cultural shift where all members of the agency and community have the opportunity to interact outside of their regular duty-related interactions; such as, patrol functions, responding to emergencies, and the enforcement of ordinances and laws. By implementing a long-term, interactive program facilitated by a cultural competency committee, based on feasible activities, it would appear that closer, personal relationships develop where police and community members get to “know each other,” rather than attempting to reactively “deal” with each other when placed in an incident or unexpected interaction. By implementing a program that has all members of law enforcement and congregants taking part, and evaluating the interaction on a regular basis, community leaders and their constituents become more trustful and informed when an incident does occur.

In this study, the Executive Community Outreach Program (ECOP) is implemented with the South Brunswick Police Department and Islamic Society of Central Jersey under the guidance of a representative Cultural Competency Committee. An effective program serves to develop effective relationships that lead to greater information-sharing and the identification of potential threats and vulnerabilities, as well as a stronger and closer community. Based on the research, an organized process by which local law enforcement and the Muslim community may develop effective relationships in order to share information would seem to be a prudent course of inquiry

Section 27 of the Constitution of the Republic of South Africa, 1996 provides that everyone has a right to have access to health care. South Africa embraces the concept of universal health care coverage. Access to health care has four dimensions: geographic accessibility, availability, financial accessibility and acceptability. If there were barriers to access to health care, the stake-holders would be duty-bound to design interventions requisite to address those barriers. The aim of the study was to establish whether health care users enjoy the right to have access to health services at Ratshaatsha Community Health Centre (RCHC). The study used a combination of quantitative and qualitative research designs. While a questionnaire was used to collect quantitative data, focused group discussions and participant observations were employed to collect qualitative data. The following are the main findings of the study. Human rights instruments clearly spell out the indivisible and mutually supportive rights that persons have. There are barriers that often affect the rights to have access to health services at RCHC. For instance, the RCHC is not within a 25 km radius of some of the consumers of health care. The roads that link up the health care users and RCHC are in poor condition. The community is generally poverty-stricken. Many cannot afford, among others, the costs of basic needs, transport fares and opportunity costs. Travelling distance and time, scarce skills and lack of medication and equipment rank among demand-side and supply-side barriers to access to health care. Health care users often choose to consult churches and traditional healers. It is recommended that government should, among others, co-ordinate primary health care services in collaboration with churches and traditional healers; commission research into traditional health medicine and healing procedures and protocols of other health care providers; develop policy on cross-referral of patients; improve community participation; set minimum norms and standards for the delivery of alternative health care services; establish health care management guidelines for churches and traditional healers; integrate health care provisioning into IDPs; and provide health care in an integrated intergovernmental manner.

The relationship between the citizen and the state in most European states is no longer understood in terms of preservation of states power, but focused on the protection of citizen rights again abuse by the state. In these latter years efforts of society to protect its rights and interests are very appreciable: various non-governmental organizations, activity groups are formed to strive to participate in enactment of decisions in public sector by administrative authorities, to have an opportunity to test the legality and transparency of these decisions and administrative procedures, to appeal the decision and so on. More and more attention is given not only to protection of private person against abuse by administrative authorities, but to protection of public interest – rights and freedoms that are essentially significant, necessary and valuable to the society. Establishment of community organizations or community centers is here a new process, just recently started in Lithuania, but nowadays getting intense – more and more community organizations are formed as in urban, so in the rural territories. Background: Low back pain (LBP) has a high prevalence worldwide. LBP is significantly associated with a range of poor socio-demographic circumstances which should be addressed in preventive programs. Despite this there is a dearth of information about the prevalence and associated factors among low-income communities in South Africa. It is speculated that the burden of LBP may be most significant in these underprivileged communities. Objective: The objective of this study was to assess the prevalence of LBP among the lowincome communities in the Cape Town Metropole and to establish associated factors in order to make recommendations for management. Study design: A cross-sectional study was conducted among the visitors of eight community health centres (CHCs) in the Cape Town Metropole. Methodology: A new measurement tool was developed based on existing validated outcome measures and initial testing of the psychometric properties of the questionnaire was conducted. The questionnaire was administered to 489 eligible subjects. Descriptive analysis was used to describe the sample and logistic regression analytical techniques were applied to determine associated factors. Main findings: Lifetime prevalence for LBP was 76.49% (n=358). About 37% (n=133) suffered from chronic LBP. LBP was significantly associated with belonging to the black ethnic group, any co-morbidity, poor perceived general health, and any type of pain medication. Lifting weights > 20 kg and kneeling and squatting were physical factors significantly associated with LBP. Severe psychological distress was significantly associated with acute and chronic LBP. Having a better or same perceived general health compared to a year ago, was protective for LBP. Conclusion: LBP has a high prevalence among the low income communities, visiting the CHCs, in the Cape Town Metropole. Multiple factors were associated with LBP, which imply that a tailormade multidisciplinary program addressing lifestyle issues, self management strategies, medication use, chronic diseases and psychosocial factors may be required for this population to combat LBP.

Partnerships between organizations are seen as one of the building blocks of the �Third Way� approach to welfare provision both in Europe and in New Zealand. While there is much discussion of this emphasis on building social capital and working in partnerships these partnerships are usually perceived as being between government and community or private organizations as part of a new phase of neo-liberalism. Using qualitative research this thesis explores three partnership sites: Those within a Maori social service provider, Te Whanau Arohanui, and the local Hapu and State organisations; that between the Ngai Tahu Maori Law Centre (an indigenous organization) and the Dunedin Community Law Centre; and finally the State lead Strengthening Families partnership initiative. This thesis is concerned with the development of citizen participation in public policy decision-making through partnerships. While contemporary studies of policy change have identified stakeholder and actor-network forms as dominant these often seem even less democratic, participatory, accountable and transparent than those they have supposedly replaced. I draw on ideas of deliberative governance to explore options for both the theory and practice of sustainable, permanent and participatory policy change in an age of diversity. I suggest that the practice of Community Development is needed to supplement descriptive and post-facto accounts of policy change and so create a usable practice theory of effective mechanisms for participatory input. Using a series of case studies of partnerships, a tentative practice theory and strategy for change is proposed. This is set within an interactive framework that is able to confront levels of power to encourage diversity and participation in decision-making from bottom-up initiatives.

Abstract:
The present thesis explores Article 19 of the United Nations Convention on the Rights of Persons with Disabilities, which recognizes the right of all persons with disabilities to live in the community, with choices equal to others. The relationship between Article 19 and the other articles of the Convention are explored, in order to discuss the role of Article 19 in the Convention. The thesis examines whether the right to live in the community, set out in Article 19, can be considered as the most central right of the Convention. The thesis applies the legal analytical method, and it is based on the Convention on the Rights of Persons with Disabilities; the communications of the Committee on the Rights of Persons with Disabilities; official reports of the United Nations as well as international non-governmental organizations; and scientific articles from books and journals. By using Arendt’s idea of “the right to have rights” as a theory, this thesis argues that the right to live in the community, contained in Article 19, constitutes the right to have rights for persons with disabilities and therefore it can be considered as the most central right of the Convention.

Abstract:
Progress Village, a historically Black neighborhood outside of Tampa, FL, encountered structural violence that included construction of an adjacent phosphogypsum stack. Why the neighborhood signed a legal agreement with the stack’s operating industry and the impacts of this decision provides a lesson in critical environmental justice. Theories of urban political ecology frame exploration of resident priorities, relationships with industry, risk perceptions, and health concerns. Utilizing activist anthropology, this thesis aims to be mutually beneficial to scholarly and neighborhood development. Ultimately, this research demonstrates how southern gradualism, racism, and a trend towards isolationism created today’s striving, yet marginalized and divided community. This thesis encourages scholarship on everyday resident-industry interactions and provides insights to strengthen future Community Benefits Agreements, while questioning if such agreements serve environmental justice.

The subject of this diploma thesis is based on the specific intention of the town Žďár nad Sázavou to rebuild the original nursery school at Okružní street to the community center. The building of former crches is located on the border of Stalingrad and new locations with family houses Klafar. The design of the building modification of the existing building is based on the perception of the continuity of the development, especially of the building structure. The aim of the project is to create a multifunctional community center with operational and administrative facilities. With regard to the capacity of the current building, it was necessary to extend the extension to meet the spatial requirements of each site. The construction program was specified by the developer and extended by two new facilities - the community center and the headquarters. It also includes the solution of outdoor areas, sufficient parking capacity and, in particular, the creation of a clear identity of the community site.

Diese Arbeit bietet eine solide theoretische Grundlage zu Philanthropie und religiös motivierten Spendenaktivitäten und deren Einfluss auf Wohltätigkeitstrends, Entwicklungszusammenarbeit und einer auf dem Gedanken der sozialen Gerechtigkeit beruhenden Philanthropie. Untersucht werden dafür die Strukturen religiös motivierte Spenden, für die in der islamischen Tradition die Begriffe „zakat“, „Waqf“ oder im Plural auch „awqaf-“ oder „Sadaqa“ verwendet werden, der christliche Begriff dafür lautet „tithes“ oder „ushour“. Aufbauend auf diesem theoretischen Rahmenwerk analysiert die qualitative und quantitative Feldstudie auf nationaler Ebene, wie die ägyptische Öffentlichkeit Philanthropie, soziale Gerechtigkeit, Menschenrechte, Spenden, Freiwilligenarbeit und andere Konzepte des zivilgesellschaftlichen Engagements wahrnimmt. Um eine umfassende und repräsentative Datengrundlage zu erhalten, wurden 2000 Haushalte, 200 zivilgesellschaftliche Organisationen erfasst, sowie Spender, Empfänger, religiöse Wohltäter und andere Akteure interviewt. Die so gewonnen Erkenntnisse lassen aussagekräftige Aufschlüsse über philanthropische Trends zu. Erstmals wird so auch eine finanzielle Einschätzung und Bewertung der Aktivitäten im lokalen Wohltätigkeitsbereich möglich, die sich auf mehr als eine Billion US-Dollar beziffern lassen. Die Erhebung weist nach, dass gemessen an den Pro-Kopf-Aufwendungen die privaten Spendenaktivitäten weitaus wichtiger sind als auswärtige wirtschaftliche Hilfe für Ägypten. Das wiederum lässt Rückschlüsse zu, welche Bedeutung lokale Wohltätigkeit erlangen kann, wenn sie richtig gesteuert wird und nicht wie bislang oft im Teufelskreis von ad-hoc-Spenden oder Hilfen von Privatperson an Privatperson gefangen ist. Die Studie stellt außerdem eine Verbindung her zwischen lokalen Wohltätigkeits-Mechanismen, die meist auf religiösen und kulturellen Werten beruhen, und modernen Strukturen, wie etwa Gemeinde-Stiftungen oder Gemeinde-„waqf“, innerhalb derer die Spenden eine nachhaltige Veränderung bewirken können. Daher bietet diese Arbeit also eine umfassende wissenschaftliche Grundlage, die nicht nur ein besseres Verständnis, sondern auch den nachhaltiger Aus- und Aufbau lokaler Wohltätigkeitsstrukturen in Ägypten ermöglicht. Zentral ist dabei vor allem die Rolle lokaler, individueller Spenden, die beispielsweise für Stiftungen auf der Gemeindeebene eingesetzt, wesentlich zu einer nachhaltigen Entwicklung beitragen könnten – und das nicht nur in Ägypten, sondern in der gesamten arabischen Region. Als konkretes Ergebnis dieser Arbeit, wurde ein innovatives Modell entwickelt, dass neben den wissenschaftlichen Daten das Konzept der „waqf“ berücksichtigt. Der Wissenschaftlerin und einem engagierten Vorstand ist es auf dieser Grundlage gelungen, die Waqfeyat al Maadi Community Foundation (WMCF) zu gründen, die nicht nur ein Modell für eine Bürgerstiftung ist, sondern auch das tradierte Konzept der „waqf“ als praktikable und verbürgte Wohlstätigkeitsstruktur sinnvoll weiterentwickelt.
This work provides a solid theoretical base on philanthropy, religious giving (Islamic zakat, ‘ushour, Waqf -plural: awqaf-, Sadaqa and Christian tithes or ‘ushour), and their implications on giving trends, development work, social justice philanthropy. The field study (quantitative and qualitative) that supports the theoretical framework reflects at a national level the Egyptian public’s perceptions on philanthropy, social justice, human rights, giving and volunteering and other concepts that determine the peoples’ civic engagement. The statistics cover 2000 households, 200 Civil Society Organizations distributed all over Egypt and interviews donors, recipients, religious people and other stakeholders. The numbers reflect philanthropic trends and for the first time provide a monetary estimate of local philanthropy of over USD 1 Billion annually. The survey proves that the per capita share of philanthropy outweighs the per capita share of foreign economic assistance to Egypt, which implies the significance of local giving if properly channeled, and not as it is actually consumed in the vicious circle of ad-hoc, person to person charity. In addition, the study relates local giving mechanisms derived from religion and culture to modern actual structures, like community foundations or community waqf that could bring about sustainable change in the communities. In sum, the work provides a comprehensive scientific base to help understand- and build on local philanthropy in Egypt. It explores the role that local individual giving could play in achieving sustainable development and building a new wave of community foundations not only in Egypt but in the Arab region at large. As a tangible result of this thesis, an innovative model that revives the concept of waqf and builds on the study’s results was created by the researcher and a dedicated board of trustees who succeeded in establishing Waqfeyat al Maadi Community Foundation (WMCF) that not only introduces the community foundation model to Egypt, but revives and modernizes the waqf as a practical authentic philanthropic structure.

The Communautary Court of Justice (CCJ), the Communautary Court of Account (CCA) and the Common Court of Justice and Arbitration (CCJA) are the three supranational jurisdictions respectively created by EMCAC and OHBLA treaties to reinforce the new processes of economical and judicial integration for their member States. In the measure where these jurisdictions are competent to exercise a juridictional control, by determining the communautary norms, the first control being carried out by the national juridictions, the conception, the organisation, the functioning, the characteristics, the roles or competences of these new jurisdictions and also the destiny of the decisions they rend in their strictly judiciary functions or in their accessory functions of supporting the arbitral procedure, present an interest worthy of a doctorate research. If it appears that the supplementary Milestones of efficiency of the new processes of integration had been installed by the creation of the said jurisdictions, it had also been observed that the gravities of jurisdictional, structural or functional order continue to delay the speed of cruise. The solutions that we have proposed to overcome these difficulties involves the reorganization of communautary jurisdictions, the clearly distribution of competences between them, the reinforcement of the communautarian law control procedure, a permanent vulgarisation of integration law, a revalorisation of executary titles, a clarification of immunity of execution domain, a development of the recovery procedures, a continual training of judicial actors, and improvement of their working and living conditions, a resurgence of moral ethic, a real independence of the Justice… This means that the study put a stress on the obstacles which hold up the new processes of integration and propose solutions to perfect the legislative texts and their jurisprudential interpretations, in the perspective of accelerating the economic development of the concerned States, for the best global prosperity of the world’s economies

Les transitions et a fortiori les consolidations démocratiques font émerger un double phénomène d’interaction entre les acteurs et le système, dans la recherche d’un nouvel équilibre. Les partis ethniques se politisent alors que le système s’ouvre à l’acteur ethnique. On assiste donc à un réajustement évolutif du système devant la nouvelle donne. Le système s’ouvre aux nouvelles demandes à caractère ethnique de différentes façons et à différents degrés : entre la légalisation et la tolérance. Côté acteurs, les partis ethniques rentrent progressivement dans le jeu politique ; de différentes façons et à différents degrés. Dans notre champ problématique les relations interactives se déploient entre acteurs multi-niveaux (partis-Etats) et dans les divers champs (politique, sociétal et juridique). Leurs connexions sont croisées entre l’espace étatique et internationale, public et civil, politique et sociétal ; avec les Etats d’accueil ou d’origine, mais aussi, les Etats-tiers. The revolutions of Eastern induced fragmentation of States were accompanied internally by a revival of ethnic parties, which is not without its problems in political democracy. Transitions and even more democratic consolidation are emerging a double phenomenon of interaction between actors and the system in search of a new equilibrium. Ethnic parties then politicize the system opens the ethnic actor. We are witnessing an evolutionary adjustment of the system to the new situation. The system opens to the new demands ethnic ways and to different degrees: between legalization and tolerance. Side actors, are gradually returning ethnic parties in the political game, in different ways and to different degrees. In our problem the field deploy interactive relationships between multi-level actors (parties-States) and in the various fields (political, societal and legal). Their connections are crossed between the State and international space, public and civil, political and social, with host countries or origin, but also the third States. They are separatist ambitions or simply political lobbies. We tried to highlight the main aspects of the complexity of the ethnic issue in young democracies political '' in consolidation ''. The ethnic problem of CEEC can help us to complete updating some general visions of political science? Background: After independence education was declared one of the inviolable fundamental human rights of all persons entrenched in the Supreme Law of the country, the Constitution of the Republic of Namibia. It is an irrefutable fact proven by a number of research findings and confirmed by educational theorists and decided cases that appropriate and quality early childhood education is a foundation of all levels of education. In Namibia currently, public early childhood development and education is provided by community members in Early Childhood Development Community Centres in both rural and urban areas. It is against this background that the purpose of the study on which this research report is based was to determine, through stakeholder participants’ eyes, how the presumed right to education of the pre- grade one learners in rural early childhood development and education community centres (ECDECCs) in Northern Namibia is adhered to. Research Design and Methodology: The study was based on a qualitative interpretive hybrid case study of four (including pilot study) rural ECDECCs, review of early childhood development and education literature, legal literature, relevant legislation, case law, regulations, policies and International Human Right Instruments conducted before and after conducting research in the field. Empirical data were collected through semi-structured individual (one on one) face to face interviews with various stakeholder participants (such as heads of/teachers at ECDECCs, parents/guardians, community leaders/members, officials from the Ministry of Gender Equality, Ministry of Education and Human Rights Activists. The findings of the study were inter alia that all participants had knowledge of and understood the fact that five to six years old children indeed have the right to education, and most of them also understood the significance of pre- grade one learners’ education. As such, the communities were doing everything in their power to provide early childhood education. However, early childhood development and education community centres were ill-equipped in terms of physical facilities, human resources, and learning-teaching aids. In addition, heads of centres/teachers were not properly trained. There was no tap water, no electricity, and no toilet facilities. Most children did not fully or not at all attend community centres for early childhood education, because of inability on the part of their parents/guardians to pay the prescribed fees. Buildings (structures) in which pre-grade one education was practised were not completed and therefore not suitable for human occupation, as community members who initiated them did not have sufficient funds to finance such undertakings. Literature studies of selected relevant legal literature, Constitutions, legislation, decided cases and international human right instruments confirm the fact that pre-grade one education is indeed a legally enforceable fundamental human right to basic education. To this end, there are legal determinants of the provision of pregrade one learners early childhood development and education. Recommendations were that the State (government) had to take over early childhood education, and that teachers have to be academically and professionally trained and accordingly paid salaries by the Ministry of Education. Because of the above obstacles experienced in rural ECDECCs, pre-grade one learners’ right to education leaves much to be desired. Consequently, it is recommended that the Ministry of Education must, as of necessity, legally take over education of all pre-grade one learners (preprimary learners) in entirety in order to comply with the provisions of International Human Rights Instruments in general, and Article 20 (1) of the Constitution of Namibia in particular. In addition, in order to ensure promotion, advancement, realisation and fulfilment of the pre-grade one learners’ right to education, the current Namibian Education Act needs to be amended like the South African Schools Act, or a new Early Childhood Development and Education Act has to be promulgated altogether, to specifically and particularly cater for the pre-grade one learners’ right to basic education. This is indispensable because, in the words of Smith (2011: 305): “The value and necessity of education is beyond dispute because education is both a human right in itself and a crucial means of realising other human rights.” The study concluded that early childhood education provision and practice in ECDECCs in rural areas in their current nature and status at the time of conducting this study in Northern Namibia leaves much to be desired. As such, it is not the best possible vehicle for the early childhood development and education provision of pregrade one education for the five to six years old children in light of their human right to education.

The present study investigates a bereavement training programme with a group of volunteer lay counsellors. In South Africa, the number of orphans resulting from an increase in parental deaths from natural causes, such as AIDS and nonnatural causes, for example violence, is increasing rapidly. The increasing number of bereaved children is creating a demand for professional support services that cannot be met by the present number of trained professionals. To address this imbalance, the training of lay counsellors is proposed. It is thus relevant to train those who are willing to help with the necessary knowledge and skills in a bereavement training programme. The present study involves ten volunteers from a Community Centre. Qualitative research methods are employed to analyse the data that is gained from the preand post-training responses to the interviews and Case Examples. Content analysis is used to elucidate the themes that emerge from the collected data. The results of the present study indicate that perceptual and developmental changes have occurred within the volunteers following the training programme, however, it is evident that further training is necessary because of the limited ability that the volunteers demonstrate in practically transferring the knowledge to new cases. In terms of this finding it is clear that factors such as language, age, educational level and personal experiences of death are important criteria to consider in the selection of volunteers for a bereavement training programme. Furthermore, traditional African perspectives of death, cultural differences and HIV/AIDS awareness need to be incorporated into future bereavement training programmes. In terms of the outcomes of the study, a positive outcome is the revision of the Bereavement Programme for children, taking cognisance of cultural sensitiveness, to make it more applicable within the local context. The results of the study also highlight the limitations and implications of the present research, which are discussed and recommendations for future research are made.

Abstract Keywords: Lay counsellors, training and evaluation. The training of lay counselling is of great significance to the field of Counselling Psychology. Therefore,the Health Professions Council of South Africa (HPCSA) decided to allow for the registration of lay counsellor training courses. However, the criteria for registration need to be formulated. This study evaluated the Wits Crisis course for volunteer counsellors, via illumination of the perceptions of the trainees and a measurement of their self-efficacy and personal relations before and after the training. The study included qualitative and quantitative methodology. Past trained counsellors and trainees were interviewed and then assessed on Self-Efficacy and Personal Relations before and after training. A Wilcoxon Matched-Pairs Signed-Rank significance in self-efficacy or personal relations scores after training. However, the interviews of the participants' perceptions of the course and its impact on them supported the hypotheses. Overall, perceptions were positive. Negative perceptions were highlighted, as this information could add to the knowledge base of the program.

The legalising of abortion in many countries has given women the choice or right to decide to terminate pregnancy. The Choice on Termination of Pregnancy Act (Act No 92 of 1996) was promulgated in 1997. This legislation promotes reproductive rights including to choose between having an unwanted pregnancy terminated early, safely and legally. The legislation affects both the women who choose to terminate pregnancy and the staff involved in the termination of pregnancy (TOP) procedures. This exploratory, descriptive and contextual qualitative study was designed to gain insight into the experiences of registered nurses in the procedure for termination of pregnancy and to explore recommendations based on these experiences. The researcher adopted a phenomenological approach. Participants were drawn from registered nurses providing TOP services at Soshanguve Community Health Centre near Pretoria. Registered nurses have the right to refuse to participate in TOP, those that do provide the service are exposed to emotional and psychological trauma.

South Africa’s education system is in crisis. Problems in education directly impact the country’s economy through its influence on skills development for employability. Young children trapped in an environment under serviced by educational resources and haracterised poor social cohesion cannot reach their full potential. This study, undergirded by Bronfenbrenner’s ecological model, sought to establish whether stateled early childhood development centres (ECDCs) in the Cape Flats can establish social cohesion and foster responsible citizenship and youth resilience. A qualitative study was conducted in selected ECDCs. Focus group interviews with caregivers of children from sampled centres and face-to-face interviews with the owners/managers of centres were augmented by an interview with an official from local government. The study concluded that the sampled ECDCs are merely coping, but restricted by various problems. They cannot function optimally as institutions for community development, although the community holds them in high esteem. Recommendations are made for improvements.

The Energy Efficiency and Conservation Block Grant (EECBG) Program, funded by the American Recovery and Reinvestment Act in 2009, holds important lessons for United States climate policy. A one-time infusion of funding given primarily to local governments to for the purpose of reducing energy use and greenhouse gas emissions, the policy had important but uneven effects. Most recipients were able to show progress on energy efficiency goals to meet program requirements. But communities with pre-existing interest in and experience with climate and energy programs tended to multiply the effects of the funding, using it to launch long-term efforts or prove concepts in order to secure further funding and support. The dissertation shows the value of communities’ participation in voluntary policy initiatives related to climate and energy, as municipalities with even a small amount of related experience were better positioned to turn a one-time infusion of federal funding into long-lasting programs. At the same time, the program’s outcomes demonstrate the enduring power and influence of the federal government in achieving more widespread success, as municipalities that had not previously participated in climate and energy planning were generally unable to continue their work once federal funding was removed, even in the presence of local champions and demonstrated successes. The program also demonstrates that using federal grants-in-aid to accomplish policy goals has important limitations. Though EECBG grants often had a major impact on local policies, their uneven impact exposes the risk that grants-in-aid may further stratify local governments’ capacities in the policy areas to which they are applied. Rather than evening out the playing field, it is possible for such programs to increase the disparities between policy leaders and the rest. The dissertation points to the importance of tailoring federal programs to varying local needs and to the importance of building local differences into program evaluations.

By definition, homelessness refers to general understanding of people without a home or a roof over their heads. As consequences of a number of factors, homelessness has become a serious problem especially in cities throughout the United States. Homeless people are usually most visible on the streets and in settings like shelters due to the fact that their presences and activities in public spaces are considered illegal or at least “unwanted” by city officials and by members of the public. In response to this issue, activists throughout the country have worked tiresly on behalf of homeless people to demand policy changes, an effort that resulted in the passage of the homeless bill of rights in three states, namely Connecticut, Rhode Island, and Illinois. As I discovered through my fieldwork, in Indiana, the homeless, themselves, are currently lobbying for passage of a similar measure. Locating my fieldwork on homelessness in Indianapolis in two sites, the Indianapolis Marion County Public Library (the Central Library) and the IUPUI Library, I examine the use of library buildings as alternative temporary shelters and spaces where the homeless can organize for political change. As an Indonesian ethnographer, I utilized an ethnographic approach, which helped me to reveal “Western values” and “American culture” as they play out in the context of homelessness. In this thesis, I show that there is a multi-sited configuration made up of issues, agents, institutions, and policy processes that converge in the context of the use of library buildings by the homeless. Finally, I conclude that public libraries and university libraries as well can play a more important role beyond their original functions by undertaking tangible actions, efforts, engagements, and interventions to act as allies to the homeless, who are among their most steadfast constituencies. By utilizing public university library facilities, the homeless are also finding their voices to call for justice, for better treatment, and for policies that can help ameliorate the hardship and disadvantages of homelessness.

The diploma thesis is divided into two basic topics, in which it deals in a brief outline with the origin and development of confessional and ecclesiastical law in general and with development and mutual relation between confessional and ecclesiastical law in the territory of Czech lands since the arrival of the Cyril and Methodius until the establishment of the Czechoslovak Church. Further on it presents the timeline of sources of the "First" Constitution of the Czechoslovak Church (Ústava Církve československé). These sources are divided into the periods before and after the establishment of the Czechoslovak Church. Abstract:
The transformation of the Department of Correctional Services into an institution of rehabilitation and the promotion of corrections as a societal responsibility brought a new dimension to the release policy of South Africa. A new Correctional Services Act 111 of 1998 came into effect and the Department of Correctional Services published a White Paper on Corrections during 2005. The idealistic correctional goal of protecting the community while rehabilitating the offender has served as a reason for conducting research into the parole process from a South African perspective. The qualitative aim of the study is to explore parole as a phenomenon and to describe the process involved in successfully reintegrating an offender into the community. The significant role that Correctional Supervision and Parole Boards play in the parole process and the emphasis they place on community safety, the interest of the victim and the rehabilitation and control of offenders as part of their mission statement are highlighted in the study.

Oral health is crucial to overall health and a focus of the U.S. Health Center program, which provides preventive dental services in medically underserved communities. Dental hygiene is an oral health profession whose practice is focused on dental disease prevention and oral health promotion. Variations in the practice and regulation of dental hygiene has been demonstrated to influence access to dental care at a state level; restrictive policies are associated lower rates of access to care. Understanding whether and to what extent policy variations affect availability and access to dental care and the oral health of medically underserved communities served by grantees of the U.S. Health Center program is the focus of this study. This longitudinal study examines dental service utilization at 1,135 health center grantees that received community health center funding from 2004 to 2011. The Dental Hygiene Professional Practice Index (DHPPI) was used as an indicator of the state policy environment. The influence of grantee and state level characteristics are also considered. Mixed effects models were used to account for correlations introduced by the multiple hierarchical structure of the data. Key findings of this study demonstrate that state policy environment is a predictor of the availability and access to dental care and the oral health status of medically underserved communities that received care at a grantee of the U.S. Health Center program. Grantees located in states with highly restrictive policy environments were 73% less likely to deliver dental services and, those that do, provided care to 7% fewer patients than those grantees located in states with the most supportive policy environments. Population’s served by grantees from the most restrictive states received less preventive care and had greater restorative and emergency dental care needs. State policy environment is a predictor of availability and access to dental care and the oral health status of medically underserved communities. This study has important implications for policy at the federal, state, and local levels. Findings demonstrate the need for policy and advocacy efforts at all levels, especially within states with restrictive policy environments.
