Abstract:
Ultimately, the enforcement of the criminal law in early modern England depended upon the co-operation and involvement of a number of parochial officers: in particular the parish constables, but also churchwardens and manorial jurors. Recently social historians examining local law enforcement have rejected the earlier tendency to disparage parochial officers and have emphasized the relative efficiency of local officers, the importance of the shifting relation between central authority and local society, and the implications of social and cultural change among the bulk of the population. This paper provides an overview of these themes, and stresses the importance of the law at all social levels in early modern England.

Abstract:
During the central and late Middle Ages, European lawmakers and jurists began to make intensive use of the principles of both Roman and canon law in their legislation and court decisions. Embedded in these legal principles were ideas about gender that would have a profound effect on litigation involving women. The substantive law that emerged during this legal renaissance helped to define women's place in medieval society, but equally important were the new law's procedural rules, which allowed reputation to be taken into account in legal proceedings, thereby rendering women's self-representation critical in determining the outcomes of their court cases. An examination the interaction of learned law and community knowledge encourages us to see medieval women as active participants in their own fates, as well as in a major shift in legal culture that would shape European women's legal status more generally.

Beauchamps, Marie. Modelling the self, creating the other: French denaturalisation law on the brink of World War II1. Manchester University Press, 2017. http://dx.doi.org/10.7228/manchester/9781526107459.003.0011.

Abstract:
Adding a historical note to a practice that has recently garnered renewed attention, this chapter looks at the policy of denaturalisation in France at the beginning of World War II. Denaturalisation law as a juridical political discourse centres on the deprivation of citizenship; it draws on security rhetoric in order to rewrite the limits of inclusion and exclusion regarding citizenship and is a means to model the national community. Based on archival material collected at the French National Archives, the chapter argues that denaturalisation law is at the core of the security/mobility dynamic: emphasising a fear of movement on the one hand, and the operationalisation of adaptable juridical practices on the other hand, denaturalisation interrupts our capacity of dissent while fixing the means to govern beyond democratic control. The analysis contributes to a better understanding of the politics of nationality where notions of selfhood and otherness are being shaped, mobilised and transformed.

Abstract:
In the early twentieth century Russia embarked on one of the most radical legal experiments ever undertaken in a modern state. The chapter describes this experiment, paying particular attention to the role of Bolshevik ideology in shaping the new socialist legal order. It then goes on to assess the fit between this legal order and the three institutional pillars of socialism (rule by a Leninist party, a predominance of state ownership of productive property, and a top-down system of bureaucratic coordination), suggesting that it was these pillars that gave Soviet law its most distinctive and enduring characteristic: a tendency for agencies of justice to be subsumed within an overarching system of central management. Finally the chapter considers the transplantation of socialist law to the states of Eastern Europe after the Second World War, examines efforts to reform the socialist legal system and assesses its legacy today.

Handmer, John, and Katharine Haynes, eds. Community Bushfire Safety. CSIRO Publishing, 2008. http://dx.doi.org/10.1071/9780643095618.

Full text
Abstract:
Community Bushfire Safety brings together in one accessible and comprehensive volume the results of the most important community safety research being undertaken within the Australian Bushfire Cooperative Research Centre (CRC). Using perspectives deriving from social science, economics and law, it complements the extensive literature already existing on bushfires, which ranges from ecology and fire behaviour to information about emergency management. In doing so, the book supports the increasing emphasis on community safety and the vital role it has to play in Australian bushfire management. Managing community safety requires a diversity of knowledge and an understanding of the many social processes that shape and ultimately determine a community’s resilience to bushfire. The wide range of issues covered in this volume reflects this diversity, including research into gender and vulnerability; the law and its implications for public/fire agency interactions; the arsonist’s rationale; the influence of the media; the role of economics in bushfire management and decision-making; understanding declines in fire brigade volunteerism; bushfire safety policy and its implementation; the effectiveness of community education and risk reduction schemes; and modes of building ignition. Community Bushfire Safety is accessible to practitioners, policy-makers, researchers and students. While the research reported has been undertaken in Australia, much of the material is generic and is likely to be relevant and useful to those dealing with community bushfire safety elsewhere in the world.
