Abstract:
Feeling united with academic community reflects in increased responsibility for one’s own quality of work. This is the quality of carrying yearly BASEES Conferences in Cambridge that impresses participants coming from the academic environments in which procedure and scope of events are not really respected. Therefore, learning from this kind of experience is always useful. The most inspiring thing is hope that conferences of such a level someday will become a routine for Ukrainian scholars as well. The more so, because our post-Socialist experience is interesting in itself for our foreign colleagues, since the way which the scientific rationality makes under conditions of overcoming totalitarian repression and aiming at democratic freedom is currently important not for Ukrainians only. Under current conditions, the part of rationality in the dimension of freedom obtains a universal meaning, making the need of reconsidering the phenomena of freedom even more rapid. This article is intended to present to Ukrainian academic community some theoretical and organizational achievements of this year’s BASEES Conference and to engage Ukrainian scholars more actively to participate in international academic events and considering the ways of implementing the experience received into their activities home. This year the conference was dedicated to the fifty years of the Prague Spring. The experience of the Prague Spring in the reflections of the BASEES conference proves the relevance of the issues of freedom and the need to rethink the key concept of modern thinking – progress. The critique of progress that puts under the question the significance of the concept itself for contemporary socio-philosophical discourse is, in the main, directed against progressism as a modern mechanistic version of progress. The revealing of the complex and ambiguous forms of progress in contemporary epoch tends to accept rather than reject the progress.

The environment was not high on the IGC agenda. The environmental improvements of the Amsterdam Treaty are nevertheless remarkable. Sustainable development has been made a Union objective, together with the principle of a high level of environmental protection; the provisions of Article 100A (the environmental guarantee) have been clarified; the integration principle has been strengthened; all EC environmental legislation will now be drafted following the improved co-decision procedure; the horizontal principles of subsidiarity and proportionality will have to be tailored to environmental policy; the case for making the Union more transparent and the declaration on the improvement of Community legislation could benefit environmental policy; and finally, the uncertainty surrounding the "right to protection of the environment" prevented its inclusion in the Treaty. The changes made in Amsterdam with respect to environmental policy are more than merely cosmetic.

Abstract:
Purpose Video-assisted thoracoscopic surgery (VATS) lobectomy has become an accepted procedure for the treatment of selected cases of lung cancer. The aim of this project was to establish national practical recommendations for the management of patients suitable for VATS lobectomy. Methods The Scientific Committee of the VATS Lobectomy Group (a branch of the Italian Society of Thoracic Surgery) identified the consensus conference as an appropriate tool for a national debate. The consensus conference was organized following indications of the Italian Department of Health: a panel of experts reviewed the literature, the jury board revised the experts’ reports, and the national conference discussed and voted on statements. The strength of recommendation for a statement was classified as weak, fair, or high when the total score ranged between 51% and 67%, 68% and 84%, or 85% and 100%, respectively. Results Eighty-six Italian thoracic surgeons attended the 1st Italian Consensus Conference on VATS lobectomy in Giulianova, Italy, on October 29-30, 2015. Thirty-three topics were discussed: indications, surgical strategy, perioperative management, and training were the main topics. Consensus was reached on 24 statements that were consequently recommended. Conclusions The Italian Consensus Conference is the first attempt to discuss VATS lobectomy-related issues in a national scientific community. Such experience determined an improvement in epistemic knowledge among the Italian thoracic surgeons and could be a suggestion for other national communities.

This paper describes the principles and procedure of ‘definitional ceremony’; a narrative method employed to create a community of narrative practice. It argues that the transformative power of these practices can be regarded as transpersonal. Additionally, such an approach can be rapidly implemented across groups and entire communities. Therefore, building communities of narrative practice is more efficient and effective than traditional care model and one-to-one psychological interventions. The paper argues that it is an appropriate approach to a crisis situation – such as the aftermath of the Grenfell fire – where rapid community intervention is needed. (This paper is written in preparation for the workshop in collaboration with Cruse Bereavement Care UK at the BPS East of England Branch 1st Annual Conference: Applying psychology in the Eastern region: From theory to practice, at Anglia Ruskin University, Cambridge on 8 September 2017. The workshop offers an opportunity to train more psychologists, counsellors, social workers, community leaders and trainers who may not be familiar in this approach thereby widening access to psychological interventions.)

The constitutionalism of the Community legal order as an evolutionary process of transforming an international organisation into a constitutional legal order has found its latest expression in the Treaty Establishing a Constitution for Europe. This document evokes the language of the constitutional state when it refers to “this Constitution” in Article I-1 and expresses its gratitude to the “European Convention for having prepared the draft of this Constitution on behalf of the citizens and States of Europe.” However, ambiguity is not far behind. The length of the document resembles a carefully drafted prenuptial agreement rather than a constitutional text. Moreover, the reference to the Constitution cannot disguise the fact that it has been adopted as an international treaty in the usual procedure of an Intergovernmental Conference and will have to be ratified by each and every Member State to enter into force.

ObjectivesA multistakeholder expert group under the Women’s Health Technology Coordinated Registry Network (WHT-CRN) was organized to develop the foundation for national infrastructure capturing the performance of long-acting and permanent contraceptives. The group, consisting of representatives from professional societies, the US Food and Drug Administration, academia, industry and the patient community, was assembled to discuss the role and feasibility of the CRN and to identify the core data elements needed to assess contraceptive medical product technologies.DesignWe applied a Delphi survey method approach to achieve consensus on a core minimum data set for the future CRN. A series of surveys were sent to the panel and answered by each expert anonymously and individually. Results from the surveys were collected, collated and analyzed by a study design team from Weill Cornell Medicine. After the first survey, questions for subsequent surveys were based on the analysis process and conference call discussions with group members. This process was repeated two times over a 6-month time period until consensus was achieved.ResultsTwenty-three experts participated in the Delphi process. Participation rates in the first and second round of the Delphi survey were 83% and 100%, respectively. The working group reached final consensus on 121 core data elements capturing reproductive/gynecological history, surgical history, general medical history, encounter information, long-acting/permanent contraceptive index procedures and follow-up, procedures performed in conjunction with the index procedure, product removal, medications, complications related to the long-acting and/or permanent contraceptive procedure, pregnancy and evaluation of safety and effectiveness outcomes.ConclusionsThe WHT-CRN expert group produced a consensus-based core set of data elements that allow the study of current and future contraceptives. These data elements influence patient and provider decisions about treatments and include important outcomes related to safety and effectiveness of these medical devices, which may benefit other women’s health stakeholders.

Abstract The International Fact-Finding Commission mentioned by Article 90 of Additional Protocol I is the only new measure introduced by the Diplomatic Conference of 1914-1911 intended to strengthen implementation of international humanitarian law. (The word ‘humanitarian’ was added to the title by the Commission itself, in order to better express the Commission's limited jurisdiction.) The Commission was established and its rules of procedure were adopted, but never since 1977 has any party to an armed conflict or any other State ever asked the Commission to exercise its activity in a concrete situation. The author (a member of the Commission) examines the reasons of this apparent failure and suggests new ways of understanding Article 90. He has no doubts about the Commission's usefulness, and he calls upon States and the other members of the international community – in particular the United Nations – to accept the Commission as a tool for strengthening respect for international humanitarian law.

Indication representation is the transaction of communication delivery nailed into a single credible insigne that contains meaning, from missing stimuli to ever -changing individual behaviors. Included in the poor families for this generalization, the researcher wants to introduce the Pattern of Interpersonal Communication between Children and Parents (Case Study of Broken Home Family in Penggalangan Village Community of Tebing Syahbandar District). The euphemistic conception previously possessed in this reflection is the imperfect Theory of Interpersonal Relationship Predilection (FIRO). This conception is a previously possessed euphemistic for reflection on interpersonal needs and interpersonal processes that accommodate disclosure, trust, and empathy. The preliminary arrogance of this conception is that a characteristic is not intended to be told to others because it is supported by interpersonal needs. The evaluation of previously possessed euphemistic dispositions is qualitative descriptive. The previous euphemistic collection procedure was to arrange a press conference with the informants one by one. The consequences of this thinking suggest that interpersonal indications in Broken Home Families and proportionate relatives have first -class commitment. Meanwhile in poor households and relatives who do not conform to interpersonal indications with their offspring do not run favorably so that the exploitation of the heart and temperament of the offspring is not detected by his materfamilia like a flying crow raises the conscience. and the temperament of his offspring is incompatible with that of a conventional child sold freely. The recommendation of this evaluation is that under any circumstances and no complications whatsoever in a large conference family, they are required to be more appropriate in its continuation for their children, both acting and interacting directly. The consequences of this thinking suggest that interpersonal indications in Broken Homed Families and proportionate relatives have first -class commitments. This process was repeated twice over a 3-month time period until consensus was achieved.ResultsTwenty-nine experts participated in the Delphi surveys, which began with an initial list of 200 data elements. The working group reached final consensus on 97 data elements capturing patient medical history, imaging data, procedure-related data, post-procedure data, and long-term follow-up data.ConclusionsThe CRN successfully convened an expert panel on uterine fibroids treatment technologies and used the Delphi method to produce a consensus-based core set of data elements. These identified data elements include important outcomes related to efficacy and safety and thus, influence patient, provider, and regulatory decision-making about treatments for uterine fibroids. Finally, the core data elements provide the foundation of the infrastructure needed for the CRN that will allow for the comparative study of uterine fibroid treatment devices and technologies.

Penelitian ini bertujuan untuk mengetahui dan menjelaskan tentang tugas, peran serta prosedur standar pengambilan keputusan lembaga Pusat Pengendalian Operasi Penanggulangan Bencana (Pusdalops PB) di dalam implementasi kebijakan Sistem Peringatan Dini Tsunami (InaTEWS) di Bali. Penelitian ini menggunakan metode deskriptif kualitatif dan pendekatan induktif dengan teknik pengumpulan data melalui observasi, wawancara, dan dokumentasi. Teknik pemeriksaan keabsahan data menggunakan uji kredibilitas dan teknik analisis data mengunakan model interaktif yaitu pengumpulan data, reduksi data, display data, dan kesimpulan/verifikasi. Hasil penelitian menunjukan Pusdalops PB mempunyai tugas dalam menganalisa informasi dan diseminasi informasi. Mempunyai wewenang mengaktivasi sirine InaTEWS, memberikan arahan evakuasi, mengarahkan seluruh potensi lembaga dan masyarakat, serta mengatur dan mengawasi implementasi kebijakan. Prosedur pengambilan keputusan arahan evakuasi yang disebarkan kepada masyarakat adalah berdasarkan informasi dari Badan Meteorologi, Klimatologi dan Geofisika (BMKG). Keputusan yang diambil tersebut, kemudian harus diteruskan kepada Gubernur dan atau Musyawarah Pimpinan Daerah Bali.This study aims to find out and explain the tasks, roles and standard procedures of the Pusat Pengendalian Operasi Penanggulangan Bencana (Pusdalops PB) decision-making agency in implementing the Tsunami Early Warning System (InaTEWS) in Bali. This study uses descriptive qualitative methods and inductive approaches to data collection techniques through observation, interviews, and documentation. Data validity checking techniques use the credibility test and data analysis techniques using an interactive model that is data collection, data reduction, data display, and conclusions/verification. The results showed that Pusdalops PB has the task of analyzing information and information dissemination. Has the authority to activate InaTEWS sirens, provide evacuation directions, direct all institutional and community potentials, and manage and oversee policy implementation. The decision-making procedure for evacuation directives distributed to the public is based on information from the Meteorology, Climatology and Geophysics Agency. The decision taken must then be forwarded to the Governor and or the Bali Regional Leadership Conference.

Abstract:

This study utilises the age-old strategy of community conferencing in a case study design to evaluate the effectiveness of using the strategy to reduce school bullying. The community conferencing strategy is founded on the assumption that an individual's emotions are the most effective regulator of his/her behaviour(s).

The literature review describes how community conferencing has been used in various contexts in the past and how it is currently used by such organisations as the Queensland Juvenile Justice Department. In the case study, a community conference was conducted with a student bully, his family, peers, the victim and his family, and relevant other educational authorities. The offending student had been previously excluded from school for a period of eighteen months and was in the re-entry phase when another bullying incident occurred. It was at this stage that the education authorities decided to use community conferencing as a means of reducing the reoccurrence of the bullying behaviour in this particular student.

In the case study design, multiple data types were used to gather as much data from as many sources as possible that related to the case. Short, relaxed, semi -structured interviews were conducted with the victim, offender supporters, and neutral education authorities. Observations of the conference were recorded unobtrusively by a third party. Various official records of the conference were kept and analysed. Finally a participant' satisfaction questionnaire was completed by those who took part.

Findings of the study revealed that four months after the conference the victim felt that the conference made a positive difference to how safe and supported he feels at school. The victim also reported that the bully's behaviour toward him had improved and he reported that he had more confidence to handle a similar situation should another arise in the future. The present study recommends that some changes be made to the community conference procedure but that generally conferencing should be included in the range of strategies used by schools in their anti -bullying policies.

The special edition of the national professional scientific and practical legal magazine “The Slovo of the National School of Judges of Ukraine” was published, which contains reports delivered at the online conference "Ensuring the unity of judicial practise: the legal positions of the Grand Chamber of the Supreme Court and standards of the Council of Europe", held on the occasion of the third anniversary of the Grand Chamber of the Supreme Court. time of thematic sessions and webinars for judges of each of the courts of cassation in the Supreme Court, as well as joint sessions for judges of different jurisdictions at the end of 2020. The National School of Judges of Ukraine held these events together with the Supreme Court and in synergy with the Council of Europe projects "Support to Judicial Reform in Ukraine", "Further Support for Ukraine's Implementation in the Context of Article 6 of the European Convention on Human Rights", USAID New Justice Program, OSCE Project Coordinator in Ukraine. These are projects that support various aspects of judicial reform in Ukraine, compliance with Council of Europe standards and recommendations, offering best practices from member states to help make priorities in the national reform process. The conference and training events were attended by more than 550 participants - judges of the Supreme Court, other courts, leading Ukrainian and foreign experts, representatives of the legal community. Trainers and all structural subdivisions of the National School of Judges of Ukraine were involved, the training activities of which were identified by the CCEJ in one of its conclusions as one of the important tools to ensure the unity of judicial practice. Programs of activities included reports on the role of the Grand Chamber of the Supreme Court in ensuring the unity of judicial practice and the impact on the legal system; unity of judicial practice in the context of standards - improving access to justice in Ukraine: removing procedural obstacles and ensuring the right to an impartial court, approaches to identifying cases of minor complexity and cases of significant public interest or exceptional importance for a party in the context of access to court of cassation: practice the supreme courts of the member states of the Council of Europe and the European Court of Human Rights; key positions of the Supreme Court - application of the provisions of the procedural codes on the grounds for transferring the case to the Chamber, the joint chamber or the Supreme Court, the impact of its decisions on legislative activity, ensuring the specialization of courts and judges, the practice of the Supreme Court of the Supreme Court on administrative cases, the practice of considering cases of disciplinary liability of judges, conclusions on the rules of criminal law, review of court decisions in criminal proceedings in exceptional circumstances; the impact of the case law of the European Court of Human Rights on the case law of national courts and the justification of court decisions and the "balance of rights" in civil cases in its practice, the development of the doctrine of human rights protection; ECtHR standards on evidence and the burden of proof, the conclusions of the CCEJ and their reflection in judicial practice; judicial rule-making in the activities of European courts of cassation, etc. The issues raised are analyzed in the Ukrainian and international contexts from report to report, which, we hope, will be appreciated by every lawyer - both practitioners and theorists. As well as the fact that the depth of disclosure of each of the topics through the practice of application serves the development of law and contributes to the formation of the unity of judicial practice of the Supreme Court, the creation of case law is a contribution to rulemaking and lawmaking. The conversion of intellectual discourse into the practice of Ukrainian courts is an important step towards strengthening public confidence in the judiciary. And here the unifying force of the Supreme Court can be especially important, as the Chairman of the Supreme Court Valentyna Danishevska rightly remarked, speaking about the expectations of the society.

Abstract:
AbstractRemoving the language barrier could bring great benefits not only to the scientific community. Therefore, it is necessary to strive to improve both the tools and procedures in which these tools are used, to ensure a reliable exchange of knowledge. The authors try to find out whether the existing and widely available technology (Google Translate) contributes to the facilitation of knowledge sharing among scientists. Humanity has been trying to construct and improve the technology of universal real-time translation for a long time. For many, it was inspired by scifi works, in which, probably, this idea appeared already in the 1940s (see Leinster’s “First contact”). This is an important topic because the language of science has long since become English, and for most of the scientific community it is not the mother tongue. Furthermore, we are now talking about the English languages of the world, or “world Englishes”, not to mention those who say “the language of science is bad English”. The paper tells a story which on the one hand constitutes a thoughtful anecdote, on the other may offer a good introduction to a serious scientific study. As it stands now, the main argument for including it is the story itself, with which we encourage further studies to scale our ideas in terms of a broader sample and comparability.

This chapter illustrates the authors' intradepartmental, collaborative self-study of their literacy master's program through use of an adapted collaborative conference protocol to surface problems and solutions related to policies, procedures, and pedagogies. The department prioritized pedagogies fostering deep engagement with literacy education content as well as relationship-building with students. This intradepartmental case study leverages self-study methodology to structure collective inquiry, identifying “critical events” for deeper questioning, reflection, observation, and guidance for future practice. Three critical events created tensions relating to the literacy master's program's implementation during the COVID-19 pandemic: field experience placements, community-building with students, and student-teacher workload.

"The Union is the direct successor to the three communities that were set up in the 1950s by six European States. Just as over time the references to the three Communities became one reference to the ‘European Community’, now the supranational organisation that is referred to has grown since 1992 and the general name by which it is known is no longer the European Community, but the European Union. Clearly the Union is a much larger entity than the Community, as can be seen from the list of the three areas covered by the Union set out above. But the idea of a large Union had always been within the documents setting up the European Community. The Community remains intact—but as one of three spheres of activity. However, concentrated within the Community are the lawmaking powers of the Union. The Union was established by the Treaty of Maastricht 1992 and the Treaty of Amsterdam 1997 (both formally called the Treaty on European Union (TEU)). The same institutions that had served the three Communities were enlarged to serve the Union. The Treaty of Nice in 2000 made further steps towards altering aspects of the institutions of the Union to be ready for enlargement of the number of Member States who were to become part of the Union from 2004. In coming years, the nature of the Union will become increasingly streamlined as it grows in size. The Treaty of Nice reached major agreement on the simplification of the voting procedures for the enactment of secondary legislation, and declared adherence to the Union’s proposed Charter on Fundamental Rights. The terms of reference for the next inter-governmental conference on the Union will consider the simplification of the founding treaties into one new treaty. There are therefore more changes ahead that will affect law students! For all public intents and purposes, there is now only the Union. The official website http://europa.eu.int only refers to European Union and within its legal pages speaks of European Union law. However, it remains true to say that to use that term is technically incorrect. The Union has no law making powers outside those conferred by the founding treaties of the Community, so the appropriate phrase is Community law or European Community law (EC law), not Union law. The next section will deal with the basic consideration of the historical development of the European Community and European Community law. It will lay out the treaties of importance and note the different types of law, and the mechanisms for Community law having an effect within the legal systems of Member States. The legal systems of the Member States are often referred to by the term ‘domestic law’, a metaphoric use of ‘domestic’ linking it to ‘home’. The courts in Member States tend to be referred to by two phrases: ‘domestic courts’, or ‘national courts’. As already noted, whilst much smaller than the ever-growing Union, the Community contains the law making powers of the Union, and therefore it determines its legislative competency. The next section will also attempt to draw attention to areas where name changes have lead to confusion. Despite the wholesale use of the term ‘European Union’ it is useful to deal with name changes incrementally by going back to the creation of the Community and tracing its development into the Union. For decades, finite element analysis (FEA) has served as a ubiquitous tool, allowing engineers and scientists to gain critical insights into the behavior of complex composite materials. Despite the wide adoption of FEA, creating a conforming mesh for the most complex composite material models, such as mesoscale models of 3D textiles or microscale models of composites with reinforcement and irregular voids, remains a significant challenge. Much of the difficulty lies in the fact that many tools that create realistic surface geometries through process simulation often result in complex interpenetrations between objects. This paper proposes a pipeline of algorithms, some adopted from the visualization community and some novel, to automatically create a conforming, high-quality tetrahedral mesh for composite materials with complex geometries that may overlap. The details of a novel algorithm used to identify volume, surface, and edge features, while avoiding the use of a tolerance, are provided. Additionally, the paper describes three different methods to remove overlaps between tows. Finally, the algorithms are applied to a simple case with two orthogonal tows that overlap where they cross, demonstrating the result at each step and revealing the advantages and disadvantages of each of the three overlap removal algorithms.

Main goal of the project within the European Community 5th Framework Program was in a preparation, evaluation and mutual agreement of a “Unified Procedure for Lifetime Assessment of Components and Piping in WWER Type Nuclear Power Plants”. This procedure should be based on former Soviet rules and codes, as WWER components were designed and manufactured in accordance with requirements of these codes and from prescribed materials. Then, critical analysis of possible application of some approaches used in PWR type components was performed and such approaches have been incorporated into the prepared procedure as much as possible with the aim of a harmonization of WWER and PWR Codes and procedures. Preparation of a Unified Procedure for WWERs operating in Finland, Czech Republic, Slovak Republic, Hungary and Bulgaria will increase the level of lifetime/integrity evaluation in these countries and will help to elaborate a unified approach and fully comparable results between individual plants and countries. Then, harmonization with PWR codes allows to obtain results that will be comparable, reliable and more sophisticated as similar approaches will be used in both types of reactors. The paper described main principles, approaches and achievements of the “Unified Procedure...”.

Abstract A key challenge in the gas turbine community is to adapt the engine model by matching measured data with simulation data. This study presents a procedure aiming to calibrate a certain type of gas turbine for power generation. To reproduce degradation, disturbance is injected into the healthy components maps at different time. Subsequently, six correction factors along with measured data and unmeasured parameters are coupled together using cooperative working equations and optimized based on primal-dual interior point method. When performing the adaptive procedure, Jacobian and hessian matrices are calculated using finite difference since the component maps have external, mapped, functions implemented as lookup-tables, and mode-switching statements. To improve the accuracy of first-order and second-order partial derivatives, the finite difference is enhanced by Richardson extrapolation method. The search scope of correction factors and unmeasured parameters are determined by the whole working conditions. Meanwhile, an adaptive update method of initial solution is proposed to make sure the convergence of the optimization procedure as quickly as possible. Finally, the proposed method is further applied to the on-line adaptation in case of performance degradation. The influence of measurement noise on optimization is also studied. It is demonstrated that the procedure is capable of refining the component maps progressively, which is significant for the model-based gas path diagnostics and prognostics.

A number of Fitness-for-Service (FFS) procedures (include analytical methods) have been specifically developed and used to address the components of a particular industrial sector. A number of industrial sectors, such as nuclear power, petrochemical, offshore, aerospace or pipeline girth weld applications have established FFS standards in place for the assessment of flaws found in-service. Some methods for design and remaining life assessments of fatigue-loaded structures are still unduly conservative in different loading regimes. Hence, there is still a need to generate a general purpose, unified, comprehensive and updated FFS methodology in Europe by covering four major failure modes (fracture, fatigue, creep and corrosion) in metallic load bearing components with or without welds. As a result, the European Community funded the project FITNET in the form of a Thematic Network (TN) organisation to review the existing FFS procedures and develop an updated, unified and verified European FITNET FFS Procedure to cover structural integrity analysis to avoid failures due to fracture, fatigue, creep and corrosion. FITNET TN is a four year project with the objective of developing and extending the use of FITNET FFS Procedure for welded and non-welded metallic structures throughout Europe. It is partly funded by the European Commission within the fifth framework programme and launched at February 2002. The network currently consists of 50 organisations from 16 European and three non-European countries representing various industrial sectors and academia. FITNET Fitness-for-Service analysis of engineering structures aims to provide better design principles, support for fabrication of new components, prevention of service failures due to fracture, fatigue, creep and corrosion damages (no coverage of structural instability due to buckling). FITNET FFS criteria can be used to establish the size limits for defects in various engineering structures and can provide substantial cost savings in operating such structures. The use of the FITNET FFS Procedure involves making an assessment of a component containing a defect to ensure its structural integrity for its intended design life or until its next inspection period. The outcome of the assessment of a component in service is a decision to operate as is, repair, monitor (including re-setting of inspection intervals), or replace. The aim of this paper is to give an overview of the objectives and technical content of the FITNET FFS Procedure currently developed and validated by the European Fitness for Service Network FITNET and hence inform the offshore technical community.

The author continues to present his analysis of various aspects of the violation of educators’ rights at the national and international levels, which he has articulated extensively in publications and conferences. This is of particular importance in the current context of uncertainty regarding the content of Generation Z and even more so about Generation Alpha’s professional activities. Given that up to 85% of professions, to which part of them shall be ready as early as in a decade, have not yet been identified even by name, the education system is faced with the challenge of developing special qualities of personality - sustainability, adaptability to change and the desire for self-development. Can an educator under systemic pressure from violations of academic rights and freedoms provide an effective solution to such a challenge? The author begins to seek an answer to this question by drawing attention to the contradictions in the dispositions of public and private law regarding intellectual property, work quota settings for teaching staff and the rating of the effectiveness of educational activities. The employed methodology of content analysis allowed for the author’s conclusions concerning the necessity of amending the regulatory procedure of higher school function for the purpose of the remedy of the mentioned disproportions to be justified. A proposal was made on the need for reconcilation of institutional innovations in the course of recovery of the basis of university autonomy regarding the elaboration of objective parameters of ranking universities both at national and at international levels, the correction of work quotas for teachers in order to achieve comparability in the activities of the academic community in the two dimensions of its actors: in the scientific, in which pedagogy is the accompanying activity segment, and in the pedagogical, in which pedagogy is the accompanying activity segment.

Traditionally, the International Optical Design Conference has included a lens design problem for members of the design community to consider. The present problem was not only to be enjoyable and instructive, but is also of practical value. Designing a lens with a low volume is a design goal with a wide range of applications. From the more general point of view of optical system design, this problem is interesting because of the fact, that the merit function is a non-optical quantity. The normal optical quantities (aberrations, etc.) appeare only as constraints which must be fulfilled, otherwise the solution is excluded from competition. And this in general is nowadays a widespread procedure in modern lens design: Nonoptical requirements dominate the specifications and the fact that image quality requirements must be fulfilled is self-evident. But this self-evidence often is a problem to the designer, and this fact is also shown by the present problem.
